<official-title>To authorize the Secretary of Health and Human Services to conduct a demonstration project for administering influenza vaccine to elementary and middle school students in qualified low-income schools, and for other purposes.</official-title>

<section id="H74E73F681E4B4CB29F9F47AC619EB9BA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Flu Vaccine Availability Act of 2008</short-title></quote>.</text></section> 
<section id="HC763FF649B234508B76415AF4900CB15"><enum>2.</enum><header>Demonstration project for administering influenza vaccine to elementary and middle school students in qualified low-income schools</header> 
<subsection id="HBB4A545DD84A4DBB93EEB3ED59E5CD8D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">For the purpose of studying and reducing any socioeconomic disparities in the administration of influenza vaccine, the Secretary of Health and Human Services, directly or by grant or contract, shall conduct a demonstration project to administer influenza vaccine to all students who are enrolled in kindergarten through grade 8 in one or more qualified low-income schools in a metropolitan area.</text></subsection> 
<subsection id="HEE85D3C42E3C4F60A8B24FD434B3C61"><enum>(b)</enum><header>Report</header><text>Not later than the end of fiscal year 2010, the Secretary shall submit a report to the Congress addressing the results of the demonstration project under this section. At a minimum, such report shall include the following:</text> 
<paragraph id="H156B865284304CCAA96D2843695DF85D"><enum>(1)</enum><text>An analysis of—</text> 
<subparagraph id="H5DD7EC2C6C6A44F7B3254E70B1CCBE8"><enum>(A)</enum><text>any socioeconomic disparities in the administration of influenza vaccine to students described in subsection (a); and</text></subparagraph> 
<subparagraph id="H23FAFC1C1DF5478D90B360B8DB095E89"><enum>(B)</enum><text>the effects of the demonstration project under this section on such disparities.</text></subparagraph></paragraph> 
<paragraph id="HC855CA31C6B84A61A35DEA8D53459BDE"><enum>(2)</enum><text display-inline="yes-display-inline">Recommendations on whether the demonstration project under this section should be extended or expanded.</text></paragraph> 
<paragraph id="H739F3FA6A798401100EF5483C648C22"><enum>(3)</enum><text>Recommendations on any other administrative or legislative actions appropriate for reducing socioeconomic disparities in the administration of influenza vaccine.</text></paragraph></subsection> 
<subsection id="HD608939CDC364F4997432E8983739031"><enum>(c)</enum><header>Definitions</header><text>In this Act;</text> 
<paragraph id="HF3E27A1AC55D4B3D8DD751C447E7C34D"><enum>(1)</enum><text>The term <term>Secretary</term> means the Secretary of Health and Human Services.</text></paragraph> 
<paragraph id="HCF3C39051992410285989B92C145A4BC"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>qualified low-income school</term> means a public school that—</text> 
<subparagraph id="HF02B6981CEA14C2E87416D377E86BC1"><enum>(A)</enum><text>receives funds under part A of title I of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311 et seq.</external-xref>); or</text></subparagraph> 
<subparagraph id="H78C27DF9008F43F484312C3D4DB639D7"><enum>(B)</enum><text>has a high percentage, as determined by the Secretary, of children eligible for free and reduced priced lunches under the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751 et seq.</external-xref>). </text></subparagraph></paragraph></subsection> 
<subsection id="HEBE50733DEA5414C8B4700F38929C7E"><enum>(d)</enum><header>Authorization of appropriations</header><text>To carry out this Act, there are authorized to be appropriated such sums as may be necessary for each of fiscal years 2009 and 2010.</text></subsection></section>
