<official-title>To provide grants and loan guarantees for the development and construction of science parks to promote the clustering of innovation through high technology activities.</official-title>

<section id="H4C4869F117F744A194A950BCD789F68" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Building a Stronger America Act</short-title></quote>.</text></section> 
<section id="H2708868E6F874F0BB0586D41C20084C3"><enum>2.</enum><header>Development of science parks</header> 
<subsection id="H49C98C6BF0684E2494107E3D9EEEA815"><enum>(a)</enum><header>Finding</header><text>Section 2 of the Stevenson-Wydler Technology Innovation Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/15/3701">15 U.S.C. 3701</external-xref>) is amended by adding at the end the following:</text>

<paragraph id="H7B1CF6C5F1E542AEBFA36684E9FF078"><enum>(12)</enum><text>It is in the best interests of the Nation to encourage the formation of science parks to promote the clustering of innovation through high technology activities.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H966F868A09F94193B704E464B6001E03"><enum>(b)</enum><header>Definition</header><text>Section 4 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/15/3703">15 U.S.C. 3703</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="HF688BD84258A48BAA5BD006417B9381D" style="OLC"> 
<paragraph id="H016F17BE9C06408B83B2CCCEDAEF62"><enum>(14)</enum><text><term>Business or industrial park</term> means a primarily for-profit real estate venture of businesses or industries which do not necessarily reinforce each other through supply chain or technology transfer mechanisms.</text></paragraph> 
<paragraph id="HABBC813AE6CE43B8A9B025E280DDAC80"><enum>(15)</enum><text><term>Science park</term>—</text> 
<subparagraph id="H2D87E9D584D54001A1195BC489ABF892"><enum>(A)</enum><text>means a group of interrelated companies and institutions, including suppliers, service providers, institutions of higher education, start-up incubators, and trade associations that—</text> 
<clause id="H4D350887BD034A3499E6FFC5E500B12C"><enum>(i)</enum><text>cooperate and compete with each other;</text></clause> 
<clause id="H8A31140533CE4695A99DF96F3151DCA2"><enum>(ii)</enum><text>are located in a specific area or region that promotes real estate development, technology transfer, and partnerships between such companies and institutions;</text></clause></subparagraph> 
<subparagraph id="HB38C063DA35E4F799531EA9503E3E6D5"><enum>(B)</enum><text>includes a science park, research park, technology park, research and development park, research and technology park, and science and technology park; and</text></subparagraph> 
<subparagraph id="HF914FDF642F441EABECE5151FFD6FCDF"><enum>(C)</enum><text>does not include a business or industrial park.</text></subparagraph></paragraph> 
<paragraph id="H12895B08C6164C1F8278336DE1458EC5"><enum>(16)</enum><text><term>Science park infrastructure</term> means facilities that support the daily economic activity of a science park.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H8890CBE1071745D5BBC76D11997B7B96"><enum>(c)</enum><header>Science parks</header><text>The Stevenson-Wydler Technology Innovation Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/15/3701">15 U.S.C. 3701 et seq.</external-xref>) is amended by adding at the end the following:</text>

<section id="H549F4E1A7DFF4580BEEC9996AA937E76"><enum>24.</enum><header>Science parks</header> 
<subsection id="H5629FBD6C5B74E1A9C1E948929BDE3FB"><enum>(a)</enum><header>Development of plans for construction of science parks</header> 
<paragraph id="H21CC31569B0E47FCA1472835246F07AF"><enum>(1)</enum><header>In general</header><text>The Secretary shall award grants for the development of feasibility studies and plans for the construction of new or expansion of existing science parks.</text></paragraph> 
<paragraph id="H76517EB9A25547CEBAD83171A545B3F7"><enum>(2)</enum><header>Limitation on amount of grants</header><text>The amount of a grant awarded under this subsection may not exceed $750,000.</text></paragraph> 
<paragraph id="HDCF306F24BE84011B8339DAAC7889CDB"><enum>(3)</enum><header>Award</header> 
<subparagraph id="H962EE26C72114041B9E149FC695335CC"><enum>(A)</enum><header>Competition required</header><text>The Secretary shall award any grant under this subsection pursuant to a full and open competition.</text></subparagraph> 
<subparagraph id="HCB03FCB401FC47F400BC9850963D9905"><enum>(B)</enum><header>Geographic dispersion</header><text>The Secretary is encouraged to divide the grants awarded under this subsection among low, medium, and high population density States.</text></subparagraph> 
<subparagraph id="HC7130B1401654FD0808E6709C252B697"><enum>(C)</enum><header>Advertising</header><text>The Secretary shall advertise any competition under this paragraph in the Commerce Business Daily.</text></subparagraph> 
<subparagraph id="HDFD0D63E388F4C55BC005815002F9138"><enum>(D)</enum><header>Selection criteria</header><text>The Secretary shall publish the criteria to be utilized in any competition under this paragraph for the selection of recipients of grants under this subsection, which shall include requirements relating to—</text> 
<clause id="H7F5F05D802374C849F87C0B490BDA400"><enum>(i)</enum><text>the number of jobs to be created at the science park each year during its first 5 years;</text></clause> 
<clause id="H7E3995FB27D349A09475C3469D09A103"><enum>(ii)</enum><text>the funding to be required to construct or expand the science park during its first 5 years;</text></clause> 
<clause id="H0C806E38B6424067A7F45F82CA825999"><enum>(iii)</enum><text>the amount and type of cost matching by the applicant;</text></clause> 
<clause id="HF1730D2FF79C473B88D513AEABC2DFD9"><enum>(iv)</enum><text>the types of businesses and research entities expected in the science park and surrounding community;</text></clause> 
<clause id="HD8173E45BB0E42A4AE3C30C2E45F888C"><enum>(v)</enum><text>letters of intent by businesses and research entities to locate in the science park;</text></clause> 
<clause id="HD13D32CE041F46BE9F5BF950C3A3E5C5"><enum>(vi)</enum><text>the expansion capacity of the science park during a 25-year period;</text></clause> 
<clause id="H6AC7345701EB4E4FA5ADC41DAB768967"><enum>(vii)</enum><text>the quality of life at the science park for employees at the science park;</text></clause> 
<clause id="H0C4F07E4EFFD44A48B8ECD4FE0E93D9"><enum>(viii)</enum><text>the capability to attract a well trained workforce to the science park;</text></clause> 
<clause id="H7D5768801BA84E32BBE5D3BBD9A462CB"><enum>(ix)</enum><text>the management of the science park;</text></clause> 
<clause id="HABD1FEFA129F4422A02758966DD184A2"><enum>(x)</enum><text>expected risks in the construction and operation of the science park;</text></clause> 
<clause id="H5269359C6C06428AB65990AB1FFBEBF6"><enum>(xi)</enum><text>risk mitigation;</text></clause> 
<clause id="HA62D4A929F0E4E78A6FFF3B18E914F82"><enum>(xii)</enum><text>transportation and logistics;</text></clause> 
<clause id="HB1F0A83752AC4436AEDBBB6695F648B"><enum>(xiii)</enum><text>physical infrastructure, including telecommunications; and</text></clause> 
<clause id="HDB277613D09544C9A52F23F76134196F"><enum>(xiv)</enum><text>ability to collaborate with other science parks throughout the world.</text></clause></subparagraph></paragraph> 
<paragraph id="H4FECCB9BE1D1440E80CD14716B6C153B"><enum>(4)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated $7,500,000 for each of the fiscal years 2008 through 2012 to carry out this subsection.</text></paragraph></subsection> 
<subsection id="H31460A91A68847EBA9B2FC6C8979E481"><enum>(b)</enum><header>Loan guarantees for science park infrastructure</header> 
<paragraph id="HAC345935309949D3B26B1D5D60C94C45"><enum>(1)</enum><header>In general</header><text>The Secretary may guarantee up to 80 percent of the loan amount for loans exceeding $10,000,000 for projects for the construction of science park infrastructure.</text></paragraph> 
<paragraph id="H252A5C72C8CF49BD9B009E14B12B55B"><enum>(2)</enum><header>Limitations on guarantee amounts</header><text>The maximum amount of loan principal guaranteed under this subsection may not exceed—</text> 
<subparagraph id="H206CB923C89F4B6AAE00F700D7AFA83E"><enum>(A)</enum><text>$50,000,000 with respect to any single project; and</text></subparagraph> 
<subparagraph id="H0099DF1D722A4EB69F6F52CE689E8247"><enum>(B)</enum><text>$500,000,000 with respect to all projects.</text></subparagraph></paragraph> 
<paragraph id="HAE4B7522093A461384C573AA331D1DF1"><enum>(3)</enum><header>Selection of guarantee recipients</header><text>The Secretary shall select recipients of loan guarantees under this subsection based upon the ability of the recipient to collateralize the loan amount through bonds, equity, property, and other such criteria as the Secretary shall prescribe. Entities receiving a grant under subsection (a) are not eligible for a loan guarantee during the period of such grant.</text></paragraph> 
<paragraph id="H24B8D9975E5E4E6CA100FAB56C7E1625"><enum>(4)</enum><header>Terms and conditions for loan guarantees</header><text>The loans guaranteed under this subsection shall be subject to such terms and conditions as the Secretary may prescribe, except that—</text> 
<subparagraph id="H6612A8DA62C8489295A754B82F98007F"><enum>(A)</enum><text>the final maturity of such loans made or guaranteed may not exceed the lesser of—</text> 
<clause id="H096030EA504E4288BA5495C2710455D5"><enum>(i)</enum><text>30 years and 32 days; or</text></clause> 
<clause id="HE54288881FDE4B81BE6FAD30B2B6C500"><enum>(ii)</enum><text>90 percent of the useful life of any physical asset to be financed by such loan;</text></clause></subparagraph> 
<subparagraph id="H2AD69020B50449E3B9F4B5C63B753FC1"><enum>(B)</enum><text>a loan made or guaranteed under this subsection may not be subordinated to another debt contracted by the borrower or to any other claims against the borrowers in the case of default;</text></subparagraph> 
<subparagraph id="H7F5CB92657334D1783CC03E34D3C0707"><enum>(C)</enum><text>a loan may not be guaranteed under this subsection unless the Secretary determines that the lender is responsible and that adequate provision is made for servicing the loan on reasonable terms and protecting the financial interest of the United States;</text></subparagraph> 
<subparagraph id="HC4022AAB3EBA4646AA6145C624DA0C"><enum>(D)</enum><text>a loan may not be guaranteed under this subsection if—</text> 
<clause id="HBC7DCAA878B14BCBB27C66905648A00"><enum>(i)</enum><text>the income from such loan is excluded from gross income for purposes of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986; or</text></clause> 
<clause id="HC92BCAE98D4F45119942D9B17F264381"><enum>(ii)</enum><text>the guarantee provides significant collateral or security, as determined by the Secretary, for other obligations the income from which is so excluded;</text></clause></subparagraph> 
<subparagraph id="HB4FA9AE4DAB64CF9906D6D617F2473E6"><enum>(E)</enum><text>any guarantee provided under this subsection shall be conclusive evidence that—</text> 
<clause id="HE1B244A454EB4939A108FED028AE5DC6"><enum>(i)</enum><text>the guarantee has been properly obtained;</text></clause> 
<clause id="HD1578D8477B040FF8BA9066A9482F7C"><enum>(ii)</enum><text>the underlying loan qualified for such guarantee; and</text></clause> 
<clause id="H51517F3A163F4DBC9D69DC781C0876B6"><enum>(iii)</enum><text>absent fraud or material misrepresentation by the holder, the guarantee is presumed to be valid, legal, and enforceable;</text></clause></subparagraph> 
<subparagraph id="H3D9CA169343445E898A9213F12BB4B26"><enum>(F)</enum><text>the Secretary shall prescribe explicit standards for use in periodically assessing the credit risk of new and existing direct loans or guaranteed loans;</text></subparagraph> 
<subparagraph id="H5545034D548A4FA690DC314EC2593EC4"><enum>(G)</enum><text>the Secretary may not extend credit assistance unless the Secretary has determined that there is a reasonable assurance of repayment; and</text></subparagraph> 
<subparagraph id="HA96431E185414F8B91D5CB40D3BB3E67"><enum>(H)</enum><text>new loan guarantees may not be committed except to the extent that appropriations of budget authority to cover their costs are made in advance, as required under section 504 of the Federal Credit Reform Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/2/661c">2 U.S.C. 661c</external-xref>).</text></subparagraph></paragraph> 
<paragraph id="HFBFE2B6FFBC24AF8892DCF55FFC70287"><enum>(5)</enum><header>Payment of losses</header> 
<subparagraph id="H03246991F2D8433BB2D521B70024F751"><enum>(A)</enum><header>In general</header><text>If, as a result of a default by a borrower under a loan guaranteed under this subsection, after the holder has made such further collection efforts and instituted such enforcement proceedings as the Secretary may require, the Secretary determines that the holder has suffered a loss, the Secretary shall pay to such holder the percentage of such loss specified in the guarantee contract. Upon making any such payment, the Secretary shall be subrogated to all the rights of the recipient of the payment. The Secretary shall be entitled to recover from the borrower the amount of any payments made pursuant to any guarantee entered into under this section.</text></subparagraph> 
<subparagraph id="H23280B9EF3304D17A7196919BCD6853E"><enum>(B)</enum><header>Enforcement of rights</header><text>The Attorney General shall take such action as may be appropriate to enforce any right accruing to the United States as a result of the issuance of any guarantee under this section.</text></subparagraph> 
<subparagraph id="H220038CEDDCB49AEBA383DBBBD05E00"><enum>(C)</enum><header>Forbearance</header><text>Nothing in this section may be construed to preclude any forbearance for the benefit of the borrower which may be agreed upon by the parties to the guaranteed loan and approved by the Secretary, if budget authority for any resulting subsidy costs (as defined under the Federal Credit Reform Act of 1990) is available.</text></subparagraph> 
<subparagraph id="HE5DA1DF6457A4375B6054C8336ED2E19"><enum>(D)</enum><header>Management of property</header><text>Notwithstanding any other provision of law relating to the acquisition, handling, or disposal of property by the United States, the Secretary may complete, recondition, reconstruct, renovate, repair, maintain, operate, or sell any property acquired by the Secretary pursuant to the provisions of this section.</text></subparagraph></paragraph> 
<paragraph id="H1864EF7170354D0B9FC5F500F100A03C"><enum>(6)</enum><header>Review</header><text>The Comptroller General of the United States shall, not later than 2 years after the date of the enactment of this section—</text> 
<subparagraph id="H6410B7B25AAF4AA5AB5800392353FE9D"><enum>(A)</enum><text>conduct a review of the subsidy estimates for the loan guarantees under this subsection; and</text></subparagraph> 
<subparagraph id="H9EE1BDA469484D198317D5415E3F091D"><enum>(B)</enum><text>submit to Congress a report on the review conducted under this paragraph.</text></subparagraph></paragraph> 
<paragraph id="HF45A64462E04454FA2CDB96900092AD"><enum>(7)</enum><header>Termination</header><text>A loan may not be guaranteed under this subsection after September 30, 2012.</text></paragraph> 
<paragraph id="HD7EB7ACAF63E45389FD4FC96E932D3AE"><enum>(8)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated—</text> 
<subparagraph id="H8F30A1676CAB4853923DEBCDB3FC8E15"><enum>(A)</enum><text>$35,000,000 for the cost, as defined in section 502(5) of the Federal Credit Reform Act of 1990, of guaranteeing $500,000,000 of loans under this subsection; and</text></subparagraph> 
<subparagraph id="HB624ADC525F7412CB46ECEB17D9CBC6D"><enum>(B)</enum><text>$6,000,000 for administrative expenses for fiscal year 2008, and such sums as are necessary for administrative expenses in subsequent years.</text></subparagraph></paragraph></subsection> 
<subsection id="H0A87FCD778C74C7FBF7391C77DCD5C48"><enum>(c)</enum><header>National academy of sciences evaluation</header> 
<paragraph id="H913DF379C91C4E11BF12B1DE82653E16"><enum>(1)</enum><header>In general</header><text>The Secretary shall enter into an agreement with the National Academy of Sciences under which the Academy shall evaluate, every 3 years, the activities under this section.</text></paragraph> 
<paragraph id="HF8F5C1A8AE7A408BA5369336569400F0"><enum>(2)</enum><header>Tri-annual report</header><text>Under the agreement entered into under paragraph (1), the Academy shall submit to the Secretary a report on its evaluation of science park development under that paragraph. Each report may include such recommendations as the Academy considers appropriate for additional activities to promote and facilitate the development of science parks in the United States.</text></paragraph></subsection> 
<subsection id="HF423CE866A094B7D848B9339E7E1EB7F"><enum>(d)</enum><header>Tri-annual report</header><text>Not later than March 31 of every third year, the Secretary shall submit to Congress a report on the activities under this section during the preceding 3 years, including any recommendations made by the National Academy of Sciences under subsection (c)(2) during such period. Each report may include such recommendations for legislative or administrative action as the Secretary considers appropriate to further promote and facilitate the development of science parks in the United States.</text></subsection> 
<subsection id="H34D088CD7E114295B9D5BD2005A700CE"><enum>(e)</enum><header>Rulemaking</header><text>Not later than 1 year after the date of the enactment of this section, the Secretary shall prescribe regulations to carry out this section in accordance with Office of Management and Budget Circular A–129, <quote>Policies for Federal Credit Programs and Non-Tax Receivables</quote>.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="H026121B91FA343B18D2717EA43B1148C"><enum>3.</enum><header>International partnership study</header><text display-inline="no-display-inline">The Director of the National Science Foundation shall enter into an arrangement with the National Academy of Sciences for a study of the successes of international partnerships among governments, industry, and academia in advancing the capabilities of science and technology in conjunction with a corresponding increase in business opportunities. Not later than 18 months after the date of enactment of this Act, the Director shall transmit to the Congress a report on the results of such study.</text></section>
