			 contents</header>
			<subsection id="H2834F7590AAF474D81E001DA53265EB5"><enum>(a)</enum><header>Short
			 title</header><text>This Act may be cited as the <quote>Strengthening the
			 Transition and Reintegration Of the National Guard and Reserves Act</quote> or
			 the <quote>STRONGR Act</quote>.</text>
			</subsection><subsection id="H106CB585F2D04851B794D8234D57BFD6"><enum>(b)</enum><header>Table of
			 contents</header><text>The table of contents for this Act is as follows:</text>
				<toc container-level="legis-body-container" lowest-bolded-level="division-lowest-bolded" lowest-level="section" quoted-block="no-quoted-block" regeneration="yes-regeneration">
					<toc-entry idref="HF2833C22C0B74A3EAB12B0ECC95379E7" level="section">Sec. 1. Short title; table of contents.</toc-entry>

				year for members of reserve components for mental health care.</toc-entry>

				members of the Selected Reserve and members of reserve components supporting

			</subsection></section><section id="H2E06B369B5DB4FB78D385743D3002296"><enum>2.</enum><header>Extension of
			 transitional health care coverage to one year for members of reserve components
			 for mental health care</header><text display-inline="no-display-inline">Section
			 1145(a) of title 10, United States Code, is amended in paragraph (3)—</text>
			<paragraph id="H952F2B1B92DA4589A8FDCAD9D661BEA1"><enum>(1)</enum><text>by inserting
			 <quote>(A)</quote> after <quote>(3)</quote>; and</text>
			</paragraph><paragraph id="HB2565DDFD9C2440C921FC87F6E5598BA"><enum>(2)</enum><text>by adding at the
			 end the following new subparagraph:</text>
				<quoted-block display-inline="no-display-inline" id="H674107627C824E3EAD5FCE059DDF3F63" style="USC">
					<subparagraph id="H29FB0B592DB44B7E9870BEAB4C8B4E56" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">In
				addition to the period described in subparagraph (A), transitional health care
				shall be available for an additional 180 days, for mental health care only, to
				a member of a reserve component described in paragraph (2)(B). The additional
				180 days shall begin at the end of the period described in subparagraph
				(A).</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="HD9F0FC85B4244753A0D225EAC6E417A4"><enum>3.</enum><header>Increase in
			 amount of basic educational assistance for members of the Selected Reserve and
			 members of reserve components supporting contingency operations</header>
			<subsection id="HED3C674BCFD04CCFA2993CC09E07EF9B"><enum>(a)</enum><header>Members of
			 Selected Reserve</header>
				<paragraph id="H098937C3D81F41D189623319DADE8B67"><enum>(1)</enum><header>Increase in
			 amount of assistance</header><text><external-xref legal-doc="usc" parsable-cite="usc/10/16131">Section 16131(b)</external-xref> of title 10, United States
			 Code, is amended—</text>
					<subparagraph id="H5E15F12322BC4E9AB7EA2D75FF3900DB"><enum>(A)</enum><text>in paragraph (1),
			 by striking <quote>at the following rates</quote> and all that follows through
			 the end and inserting <quote>at the rate provided under paragraph (2).</quote>;
			 and</text>
					</subparagraph><subparagraph id="HFF3BA718F1EE46FEB913311EEC7672C3"><enum>(B)</enum><text>in paragraph (2),
			 by striking all and inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="H1871710DEF1D45B98F73E2AEB2A73C5F" style="USC">
							<paragraph id="H64AF15CCC28B4F05B0DBBCEA5E336F5E" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HC982A4D644914ED7A4756E9EA702B3F8"><enum>(A)</enum><text display-inline="yes-display-inline">Educational assistance provided under this
				chapter shall be paid at a rate equal the applicable percentage under
				subparagraph (B) of the rate provided under <external-xref legal-doc="usc" parsable-cite="usc/38/3015">section 3015(a)</external-xref> of title 38 for an
				approved program of education pursued on a full-time basis.</text>
								</subparagraph><subparagraph id="H90BEF504958A4E8DA82B304685C5DA24" indent="up1"><enum>(B)</enum><text>The applicable percentage under this
				subparagraph is—</text>
									<clause id="HF82758D9916F42AE84E1B43CD623562B"><enum>(i)</enum><text>50 percent for each month in which the
				individual pursues an approved program of education on a full time
				basis;</text>
									</clause><clause id="H84F982D6E60A4C2A9719669BBC1512AC"><enum>(ii)</enum><text>37.5 percent for each month in which
				the individual pursues an approved program of education on a three-quarter-time
				basis;</text>
									</clause><clause id="H90C82DCE8C3348A5919774EB40004129"><enum>(iii)</enum><text>25 percent for each month in which
				the individual pursues an approved program of education on a half-time basis;
				and</text>
									</clause><clause id="HCC689EFE8DC94197ADB96CE9B1959265"><enum>(iv)</enum><text>an appropriately reduced percent, as
				determined under regulations which the Secretary of Veterans Affairs shall
				prescribe, for each month in which the individual pursues an approved program
				of education on less than a half-time basis, except that no payment may be made
				to an individual for a month in which the individual pursues such a program on
				less than a half-time basis if tuition assistance is otherwise available to the
				individual for such pursuit from the military department
				concerned.</text>
									</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H2127115BC6C948DBB3F4422027BBA4B4"><enum>(2)</enum><header>Effective
			 date</header><text>The amendments made by paragraph (1) shall apply with
			 respect to an educational assistance allowance under section 16131(b) of such
			 title paid for months beginning after the date of the enactment of this
			 Act.</text>
				</paragraph></subsection><subsection id="H29CB4EC8287A41BA8DE404D27CD60692"><enum>(b)</enum><header>Reserve
			 components supporting contingency operations</header>
				<paragraph display-inline="no-display-inline" id="HFE8B4973A4524418BEDF17FFFBE464A8"><enum>(1)</enum><header>Increase in
			 amount</header><text><external-xref legal-doc="usc" parsable-cite="usc/10/16162">Section 16162(c)(4)</external-xref> of title 10, United States Code, is
			 amended—</text>
					<subparagraph display-inline="no-display-inline" id="H85D66CCA26E6428E86EDF4E831133EE6"><enum>(A)</enum><text>in subparagraph
			 (A) by striking <quote>40 percent</quote> and inserting <quote>60
			 percent</quote>; and</text>
					</subparagraph><subparagraph display-inline="no-display-inline" id="H7E1A3653C9B7402E8F1C2016A922266B"><enum>(B)</enum><text>in subparagraph
			 (B) by striking <quote>60 percent</quote> and inserting <quote>70
			 percent</quote>.</text>
					</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H442ABD9AD68044848BA433ACFD9F4F28"><enum>(2)</enum><header>Effective
			 date</header><text>The amendments made by paragraph (1) shall apply with
			 respect to an educational assistance allowance under section 16162(c)(4) of
			 such title paid for months beginning after the date of the enactment of this
			 Act.</text>
				</paragraph></subsection></section><section id="H24F08869CB254490BE1872008B7DACD0"><enum>4.</enum><header>Nonreduction in
			 pay while Federal employee is serving on active duty in a reserve component of
			 the uniformed services</header>
			<subsection id="H3A7209B474C74E4FB5B28DB4916B791C"><enum>(a)</enum><header>In
			 general</header><text>Subchapter IV of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/55">chapter 55</external-xref> of title 5, United States
			 Code, is amended by adding at the end the following new section:</text>
				<quoted-block id="H63C0E192A32F4E8EA2ABF1F6E83068F2" style="USC">
					<section id="HE29B8105DCB7473C96C5FFE106108468"><enum>5538.</enum><header>Nonreduction
				in pay while serving on active duty in a reserve component</header>
						<subsection id="H855D50B333724B32A3038E28A7A68779"><enum>(a)</enum><text>An employee who is
				also a member of a reserve component and is absent from a position of
				employment with the Federal Government under a call or order to serve on active
				duty for a period of more than 30 days shall be entitled to receive, for each
				pay period described in subsection (b), an amount equal to the amount by
				which—</text>
							<paragraph id="H9C09597729D44544A324C83142E86676"><enum>(1)</enum><text>the amount of
				civilian basic pay that would otherwise have been payable to the employee for
				such pay period if the employee’s civilian employment with the Government had
				not been interrupted by the service on active duty, exceeds (if at all)</text>
							</paragraph><paragraph id="H79898DBFF7C14E93805824E295B8812F"><enum>(2)</enum><text>the amount of
				military compensation that is payable to the employee for the service on active
				duty and is allocable to such pay period.</text>
							</paragraph></subsection><subsection id="H6F5EC4F2CAC84A7D914EE9B27DADC959"><enum>(b)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HDC3EEF2F7C6443D6BD5FC97473A93E22"><enum>(1)</enum><text>Amounts under this
				section shall be payable with respect to each pay period (which would otherwise
				apply if the employee’s civilian employment had not been interrupted) that
				occurs—</text>
								<subparagraph id="HB1FC206F9250473BB96860769027787C" indent="up1"><enum>(A)</enum><text>while the employee serves on active
				duty for a period of more than 30 days;</text>
								</subparagraph><subparagraph id="H9BFC3EFC07114E6300D05C5E4CE65378" indent="up1"><enum>(B)</enum><text>while the employee is hospitalized
				for, or convalescing from, an illness or injury incurred in, or aggravated
				during, the performance of such active duty; or</text>
								</subparagraph><subparagraph id="H0AB39FCDD64047BEB274F4854B8E4C52" indent="up1"><enum>(C)</enum><text>during the 14-day period beginning at
				the end of such active duty or the end of the period referred to in
				subparagraph (B).</text>
								</subparagraph></paragraph><paragraph id="HE44F1B27D7D94DA9A2691E5098B4D853" indent="up1"><enum>(2)</enum><text>Paragraph (1) shall not apply with
				respect to a pay period for which the employee receives civilian basic pay
				(including by taking any annual, military, or other paid leave) to which the
				employee is entitled by virtue of the employee’s civilian employment with the
				Government.</text>
							</paragraph></subsection><subsection id="H631D8A034B9545BB90F283DD617246B2"><enum>(c)</enum><text>Any amount payable
				under this section to an employee shall be paid—</text>
							<paragraph id="HC72EB87954144480B939B5436F008F13"><enum>(1)</enum><text>by the employing
				agency of the employee;</text>
							</paragraph><paragraph id="H562505ACCEB0464EB215AE3438153D57"><enum>(2)</enum><text>from the
				appropriation or fund that would be used to pay the employee if the employee
				were in a pay status; and</text>
							</paragraph><paragraph id="H9CB7A811BCDB49FCAF270070F40089D3"><enum>(3)</enum><text>to the extent
				practicable, at the same time and in the same manner as would civilian basic
				pay if the employee’s civilian employment had not been interrupted.</text>
							</paragraph></subsection><subsection id="H68CF85548BF6486CBCE90976AF5929ED"><enum>(d)</enum><text>In consultation
				with Secretary of Defense, the Office of Personnel Management shall prescribe
				such regulations as may be necessary to carry out this section.</text>
						</subsection><subsection id="HDAE27AF136E541D8A2B25684499727B"><enum>(e)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HF9B1CD5C830E4B958FD475CE149761BB"><enum>(1)</enum><text>In consultation with the
				Office, the head of each agency referred to in section 2302(a)(2)(C)(ii) shall
				prescribe procedures to ensure that the rights under this section apply to the
				employees of such agency.</text>
							</paragraph><paragraph id="HDFA4DA071D944F42A1D95CB4F050E2DD" indent="up1"><enum>(2)</enum><text>The Administrator of the Federal
				Aviation Administration shall, in consultation with the Office, prescribe
				procedures to ensure that the rights under this section apply to the employees
				of that agency.</text>
							</paragraph></subsection><subsection id="H4F10F33AF69541FA9E88C282C21FF14B"><enum>(f)</enum><text>For the purpose of
				this section—</text>
							<paragraph id="H4191D08426924605AFFC304EAE758ECE"><enum>(1)</enum><text>the terms
				<term>active duty for a period of more than 30 days</term>,
				<term>member</term>, and <term>reserve component</term> have the meanings given
				such terms in <external-xref legal-doc="usc" parsable-cite="usc/37/101">section 101</external-xref> of title 37;</text>
							</paragraph><paragraph id="H8767135BCC4A4D799BA5B884EA0175DF"><enum>(2)</enum><text>the term
				<term>civilian basic pay</term> includes any amount payable under section
				5304;</text>
							</paragraph><paragraph id="H0AC9E74A52B34A5C8765B74F6216B600"><enum>(3)</enum><text>the term
				<term>employing agency</term>, as used with respect to an employee entitled to
				any payments under this section, means the agency or other entity of the
				Government (including an agency referred to in section 2302(a)(2)(C)(ii)) with
				respect to which the employee has reemployment rights under chapter 43 of title
				38; and</text>
							</paragraph><paragraph id="H7AB511C0958347D5B519742DC8F4FAFB"><enum>(4)</enum><text>the term
				<term>military compensation</term> has the meaning given the term
				<term>pay</term> in section 101(21) of title
				37.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H9ACC19E6C5E948F7AC23664BE1F811E"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of chapter 55 of
			 title 5, United States Code, is amended by inserting after the item relating to
			 section 5537 the following new item:</text>

				component.</toc-entry>
					</toc>
					<after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H443CC766EF9E4BEAB4341C7D39CB57DD"><enum>(c)</enum><header>Application of
			 amendment</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/5538">Section 5538</external-xref> of title 5, United States Code, as added
			 by subsection (a), shall apply with respect to pay periods (as described in
			 subsection (b) of such section) beginning on or after the date of the enactment
			 of this Act.</text>
			</subsection></section><section display-inline="no-display-inline" id="H09A6491923A844D0B4EE6D3F9EADAB2F" section-type="subsequent-section"><enum>5.</enum><header>Assistance for State
			 and local governments that continue to pay employees who serve on active duty
			 in a reserve component of the uniformed services</header>
			<subsection id="H4F45A3BA50D04EFA8E3EE35BFEDCDC63"><enum>(a)</enum><header>In
			 general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/37/17">Chapter 17</external-xref> of title 37, United States Code, is amended by
			 adding at the end the following new section:</text>
				<quoted-block id="H6645E93E498A4842B3D71559B296A747" style="USC">
					<section id="HD096FEA54BD74945808E890045A2F867"><enum>911.</enum><header>Assistance for
				State and local governments that continue to pay employees who serve on active
				duty</header>
						<subsection id="H59520D4EA2CB4B6497BAA7E6C77D19B"><enum>(a)</enum><header>Continuation of
				civilian basic pay</header><text>It is the purpose of this section to encourage
				States and local governments to continue to pay a portion of the civilian
				compensation of those employees who are also members of a reserve component and
				are absent from a position of employment with the State or local government
				under a call or order to serve on active duty for a period of more than 30 days
				so that the employees receive compensation in an amount that, when taken
				together with their military pay, is at least equal to their civilian
				compensation.</text>
						</subsection><subsection id="HE6AB24B754B3474EA999E25848830084"><enum>(b)</enum><header>Reimbursement
				offered</header><paragraph commented="no" display-inline="yes-display-inline" id="HE42D406143D94EBAAC91291CA9F540FD"><enum>(1)</enum><text>At
				the request of a State or local government that continues to pay all or a
				portion of the civilian compensation of an employee described in subsection
				(a), the Secretary concerned shall reimburse the State or local government for
				50 percent of the civilian compensation paid by the State or local government
				for each pay period described in subsection (c), but not to exceed 50 percent
				of the difference (if any) between—</text>
								<subparagraph id="H542D8340384E420C9956B67336E5C99F" indent="up1"><enum>(A)</enum><text>the amount of civilian compensation
				that would otherwise have been payable to the employee for such pay period if
				the employee’s civilian employment with the State or local government had not
				been interrupted by the service on active duty; and</text>
								</subparagraph><subparagraph id="H313CDFDB0CDF4D62BF9415C3E9540075" indent="up1"><enum>(B)</enum><text>the amount of military pay that is
				payable to the employee for the service on active duty and is allocable to such
				pay period.</text>
								</subparagraph></paragraph><paragraph id="H1A2F923C045E4741B5C99E06BBE56CC8" indent="up1"><enum>(2)</enum><text>If the pay periods described in
				subsection (c) extend more than nine consecutive months after the first day of
				the first month during which the employee began to serve on active duty for a
				period of more than 30 days, the reimbursement rate shall become 100 percent
				for the subsequent payments. However, as is the case under paragraph (1),
				reimbursement shall be provided only for the difference (if any)
				between—</text>
								<subparagraph id="HE4F2A9273FA844E19FE9A1FD266256AC"><enum>(A)</enum><text>the amount of civilian compensation
				that would otherwise have been payable to the employee for such pay period if
				the employee’s civilian employment with the State or local government had not
				been interrupted by the service on active duty; and</text>
								</subparagraph><subparagraph id="H69581CF76A3240FD860090FE25230916"><enum>(B)</enum><text>the amount of military pay that is
				payable to the employee for the service on active duty and is allocable to such
				pay period.</text>
								</subparagraph></paragraph></subsection><subsection id="H4B3AE52C19274333BC0089423C713E91"><enum>(c)</enum><header>Pay
				periods</header><text>Reimbursement shall be provided under this section with
				respect to each pay period (which would otherwise apply if the employee’s
				civilian employment had not been interrupted) that occurs—</text>
							<paragraph id="H606E0E26E2C443C19C2BDD2B04027D25"><enum>(1)</enum><text>while the employee
				serves on active duty for a period of more than 30 days;</text>
							</paragraph><paragraph id="H3A656C333BF44D63A41DB2002DA51EAC"><enum>(2)</enum><text>while the employee
				is hospitalized for, or convalescing from, an illness or injury incurred in, or
				aggravated during, the performance of such active duty; or</text>
							</paragraph><paragraph id="H17170D264E9A4395007B8DAE37005E3F"><enum>(3)</enum><text>during the 14-day
				period beginning at the end of such active duty or the end of the period
				referred to in subparagraph (B).</text>
							</paragraph></subsection><subsection id="HCCFC2A471A774277B8626FA4D7EACFD9"><enum>(d)</enum><header>Effect of
				failure To return to employment</header><paragraph commented="no" display-inline="yes-display-inline" id="H2986DD75F21A4EE3AA40895238AA0055"><enum>(1)</enum><text>If an employee described
				in subsection (a), with respect to whom reimbursement is provided to a State or
				local government under this section, fails to report or apply for employment or
				reemployment with the State or local government by the end of the period
				referred to in subsection (c)(3), the employee shall refund to the Secretary
				concerned the total amount of the reimbursement provided with respect to the
				employee.</text>
							</paragraph><paragraph id="HD8D6F5653C9A4FB5B3CB938D10856D01" indent="up1"><enum>(2)</enum><text>Subject to paragraph (3), an
				obligation to refund moneys to the United States imposed under paragraph (1) is
				for all purposes a debt owed to the United States.</text>
							</paragraph><paragraph id="H27D6B974EFED48EC998441B8DB34774F" indent="up1"><enum>(3)</enum><text>The Secretary concerned may waive, in
				whole or in part, a refund required under paragraph (1) if the Secretary
				concerned determines that recovery would be against equity and good conscience
				or would be contrary to the best interests of the United States.</text>
							</paragraph><paragraph id="HD79FC5FECC0141B2BF4B7BAFA8B44600" indent="up1"><enum>(4)</enum><text>A discharge in bankruptcy under title
				11 that is entered less than five years after the end of the period referred to
				in subsection (c)(3) does not discharge the employee from a debt arising under
				paragraph (1). This paragraph applies to any case commenced under title 11
				after the date of the enactment of this section.</text>
							</paragraph></subsection><subsection id="HCEDAF7BFB18C4E05AD9D8432BAF94639"><enum>(e)</enum><header>Regulations</header><text>The
				Secretaries concerned shall prescribe regulations to carry out this
				section.</text>
						</subsection><subsection id="H12120F7475C5464185EB699109F31403"><enum>(f)</enum><header>Definitions</header><text>In
				this section:</text>
							<paragraph id="HBA95C4A9FED548A396A7C98E7747967E"><enum>(1)</enum><text>The term
				<term>civilian compensation</term> means the wages or salary that an employee
				of a State or local government normally receives from the employee’s employment
				by the State or local government.</text>
							</paragraph><paragraph id="H915BC0A18D1E46A7A1F042EC98D624AF"><enum>(2)</enum><text>The term
				<term>local government</term> means an agency or political subdivision of a
				State.</text>
							</paragraph><paragraph id="H4CE58E9C35AC4F7284B7A2A222E18585"><enum>(3)</enum><text>The term
				<term>military pay</term> has the meaning given the term <term>pay</term> in
				section 101(21) of this title.</text>
							</paragraph><paragraph id="H0E1AA21EDFB44F4C9DBE817E7029C4A2"><enum>(4)</enum><text>The term
				<term>State</term> means each of the several States of the United States, the
				District of Columbia, the Commonwealth of Puerto Rico, Guam, the Virgin
				Islands, and other territories or possessions of the United
				States.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HF06F09576277472091A6AC9497E6A199"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of chapter 17 of
			 title 37, is amended by inserting after the item relating to section 909 the
			 following new item:</text>

			</subsection><subsection id="HFDCA5AC0BE8345859BAEB4B5BDC7C8AF"><enum>(c)</enum><header>Application of
			 amendment</header><text><external-xref legal-doc="usc" parsable-cite="usc/37/911">Section 911</external-xref> of title 37, United States Code, as added
			 by subsection (a), shall apply with respect to pay periods (as described in
			 subsection (b) of such section) beginning on or after the date of the enactment
			 of this Act.</text>
			</subsection></section><section id="H82D7F11570B8408595703355B66DCE01"><enum>6.</enum><header>Active-duty
			 reserve component employee credit added to general business credit</header>
			<subsection id="H943BF6AD23DD48FBAEE94F604131C39D"><enum>(a)</enum><header>Addition of
			 credit</header><text>Subpart D of part IV of subchapter A of chapter 1 of the
			 Internal Revenue Code of 1986 (relating to business-related credits) is amended
			 by adding at the end the following new section:</text>
				<quoted-block id="H90D552D466CE4F33B6FCB0BBC64487BE">
					<section id="H9E4A1C3AA5FD4C5EABDAA23308E74E00"><enum>45N.</enum><header>Active-duty
				reserve component employee credit</header>
						<subsection id="H944DE6B8F0D44C0A81503F37F316CC58"><enum>(a)</enum><header>General
				rule</header><text>For purposes of section 38, in the case of an employer, the
				active-duty reserve component employee credit determined under this section for
				the taxable year is an amount equal to 50 percent of the compensation paid by
				the employer to an employee who is also a member of a reserve component during
				the taxable year when the employee was absent from employment for a reason
				described in subsection (b).</text>
						</subsection><subsection id="H06E58A13B76D4C7DAEC8D04171F7017D"><enum>(b)</enum><header>Limitation</header><text>The
				amount allowed as a credit under subsection (a) shall not exceed 50 percent of
				the difference (if any) between—</text>
							<paragraph id="HD7CB218E72D24C2485E62DAB10D37948"><enum>(1)</enum><text>the amount of
				compensation that would otherwise have been payable to the employee during such
				absence if the employee’s employment with the employer had not been interrupted
				by the employee’s absence; and</text>
							</paragraph><paragraph id="HA7A4491E63F542109C1F9E3F00AE733"><enum>(2)</enum><text>the amount of
				military pay that is payable to the employee during the absence.</text>
							</paragraph></subsection><subsection id="H2E6FAD72DD094090A5006704827517BB"><enum>(c)</enum><header>Covered pay
				periods</header><text>Subsection (a) shall apply with respect to an employee
				who is also a member of a reserve component—</text>
							<paragraph id="H8300247AFE2A4DF29720CED871BFF897"><enum>(1)</enum><text>while the employee
				serves on active duty for a period of more than 30 days;</text>
							</paragraph><paragraph id="H3F839ACFF1444632AE3FB8066E8CA5D8"><enum>(2)</enum><text>while the employee
				is hospitalized for, or convalescing from, an illness or injury incurred in, or
				aggravated during, the performance of such active duty; or</text>
							</paragraph><paragraph id="H495257AC26144A95BDBD5C00E6BD98A3"><enum>(3)</enum><text>during the 14-day
				period beginning at the end of such active duty or the end of the period
				referred to in paragraph (2).</text>
							</paragraph></subsection><subsection id="HEA84515722D34205A5DC6538C5AE906"><enum>(d)</enum><header>Days not taken
				into account</header><text>No credit shall be allowed under subsection (a) with
				respect to an employee on any day on which the employee was not scheduled to
				work (for a reason other than such service on active duty) and ordinarily would
				not have worked.</text>
						</subsection><subsection id="H7919ABE5799B4D3184A48FB92315E965"><enum>(e)</enum><header>Definitions</header><text>For
				purposes of this section—</text>
							<paragraph id="H2E5A52C478864DBBB80022B4DE9514DB"><enum>(1)</enum><text>The terms
				<term>active duty for a period of more than 30 days</term>,
				<term>member</term>, and <term>reserve component</term> have the meanings given
				such terms in <external-xref legal-doc="usc" parsable-cite="usc/37/101">section 101</external-xref> of title 37, United States Code.</text>
							</paragraph><paragraph id="HB0FDB002A809445195B085D131D93CC8"><enum>(2)</enum><text>The term
				<term>compensation</term> means any remuneration for employment, whether in
				cash or in kind, which is paid or incurred by a taxpayer and which is
				deductible from the taxpayer’s gross income under section
				162(a)(1).</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H4524D97287F54912A950AE32BA197702"><enum>(b)</enum><header>Credit To be
			 part of general business credit</header><text>Subsection (b) of section 38 of
			 such Code (relating to general business credit) is amended by striking
			 <quote>plus</quote> at the end of paragraph (30), by striking the period at the
			 end of paragraph (31) and inserting <quote>, plus</quote>, and by adding at the
			 end the following new paragraph:</text>

					<paragraph id="HA6EC2A8398754B1EA4DA9B73A604D5C"><enum>(32)</enum><text>the active-duty
				reserve component employee credit determined under section
				45N(a).</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H1B80E0F3B2CC465BBF384C42C07E8BCA"><enum>(c)</enum><header>Conforming
			 amendment</header><text>The table of sections for subpart D of part IV of
			 subchapter A of chapter 1 of such Code is amended by inserting after the item
			 relating to section 45M the following new item:</text>

			 date</header><text>The amendments made by this section shall apply to taxable
			 years beginning after December 31, 2007.</text>
