		<official-title display="yes">To prohibit the transfer of personal
		  information to any person or business outside the United States, without
		  notice.</official-title>

		<section id="H60E03D228D1C4337B603CB612BCF7D4B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Notify Americans Before Outsourcing
			 Personal Information Act</short-title></quote>.</text>
		</section><section id="id82CC20B98A484C1B8F967B31165200E2"><enum>2.</enum><header>Protection of
			 personally identifiable information from unauthorized transfer</header>
			<subsection id="idED20035B4F544DF9B8CDCDB0DC4941C8"><enum>(a)</enum><header>In
			 General</header><text>A business shall not transfer personally identifiable
			 information regarding a citizen of the United States to any foreign affiliate
			 or subcontractor located in another country without providing that citizen
			 written notice that such information may be transferred to such foreign
			 affiliate or subcontractor.</text>
			</subsection><subsection id="id3922332A8BED451C820A4F27F5483D95"><enum>(b)</enum><header>Plain Language
			 Requirement</header><text>Written notice must be sent by regular mail, not
			 e-mail, and separate from any other financial disclosure or information. It
			 must be written in easily understandable, plain language.</text>
			</subsection><subsection id="id457436692E294234A56E5E7D09B68B77"><enum>(c)</enum><header>Notice
			 Period</header><text>Written notice must be provided to a citizen of the United
			 States at least ninety (90) days before such information may be transferred to
			 any foreign affiliate or subcontractor.</text>
			</subsection></section><section id="id01774A0816994AF69D8CAAD6DEF9DE70"><enum>3.</enum><header>Private cause of
			 action</header><text display-inline="no-display-inline">To enforce compliance
			 with this Act, to obtain damages, including compensatory and punitive; to
			 obtain injunctive relief; and to obtain any other compensation, a private cause
			 of action in State court is authorized.</text>
		</section><section id="id7DA7B1A6BE9E4EB6BA89F930D44309C8"><enum>4.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">This Act shall take
			 effect on the 90th day beginning after the date of the enactment of this
			 Act.</text>
		</section><section id="id9EE8EE32372244AF9973026C98FB77A1"><enum>5.</enum><header>Definitions</header>
			<subsection id="id6918F2F4FE2C483AA2F38F8CBB94C3B9"><enum></enum><text display-inline="yes-display-inline">As used in this Act, the following
			 definitions apply:</text>
				<paragraph id="id8F29576E61BC4BA385E8AAF889D48745"><enum>(1)</enum><header>Business</header><text>The
			 term <quote>business</quote> means any financial institution that collects or
			 retains personally identifiable information.</text>
				</paragraph><paragraph id="idE48FDF7C08914F008089C077530E003C"><enum>(2)</enum><header>Personally
			 identifiable information</header><text>The term <quote>personally identifiable
			 information</quote> includes information such as, but not limited to:</text>
					<subparagraph id="idE5D65BADDBF9488B9AD8976304C06B79"><enum>(A)</enum><text>name;</text>
					</subparagraph><subparagraph id="id1BBEB753B7914F06AC9572CAEB7FD7B3"><enum>(B)</enum><text>postal
			 address;</text>
					</subparagraph><subparagraph id="id9BC6890ABCFA4D9B9BD774783C84F6EB"><enum>(C)</enum><text>financial
			 information;</text>
					</subparagraph><subparagraph id="id80B1383E40B54899B5B1DCD4FFC40325"><enum>(D)</enum><text>date of
			 birth;</text>
					</subparagraph><subparagraph id="id879B7DF27C114F1981107F31506E6532"><enum>(E)</enum><text>phone number
			 (landline and/or cell phone);</text>
					</subparagraph><subparagraph id="id159BD3CA342347F9805CDC0DA653AD17"><enum>(F)</enum><text>e-mail
			 address;</text>
					</subparagraph><subparagraph id="id28AD3CB3CB91491E9B69FF4CB1FA1842"><enum>(G)</enum><text>social security
			 number;</text>
					</subparagraph><subparagraph id="idD45D8C025DBC49E9A768D124B72B5F52"><enum>(H)</enum><text>mother's maiden
			 name;</text>
					</subparagraph><subparagraph id="id22DAA2C6C0BD4B858960E442E6393076"><enum>(I)</enum><text>password for
			 access to electronic Internet records;</text>
					</subparagraph><subparagraph id="id364BA1A2CF8A40859EE8AF49C28FD856"><enum>(J)</enum><text>driver's license
			 number; and</text>
					</subparagraph><subparagraph id="id0B4CF1890F724ADA9D7301569BE516EB"><enum>(K)</enum><text>personal tax
			 information.</text>
					</subparagraph></paragraph></subsection></section></legis-body>
