		<official-title>To amend the Uniformed and Overseas Citizens Absentee
		  Voting Act to prohibit States from refusing to accept balloting materials
		  solely because the materials are generated through the use of a computer
		  program, are not printed on a specific type of paper, or do not otherwise meet
		  similar extraneous requirements which are not clearly necessary to prevent
		  fraud in the conduct of elections, and for other purposes.</official-title>

		<section display-inline="no-display-inline" id="HF161E29E7CD74674AECCC181A8E66E78" section-type="section-one"><enum>1.</enum><header>Short Title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Overseas
			 Voting Practical Amendments Act of 2007</quote>.</text>
		</section><section id="H3A80A8AD422840F7AD3F65EC821200FB"><enum>2.</enum><header>Designation of
			 Official Federal Form as Federal Voter Registration and Ballot
			 Application</header>
			<subsection id="H400973C29A7143CC93D0735E543C60D5"><enum>(a)</enum><header>Designation and
			 Distribution</header><text>Section 101 of the Uniformed and Overseas Citizens
			 Absentee Voting Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1973ff">42 U.S.C. 1973ff</external-xref>) is amended—</text>
				<paragraph id="H14AC7A9F2B644E41BDBF53AC47CC1DB8"><enum>(1)</enum><text>in subsection
			 (b)(2), by striking <quote>an official post card form</quote> and inserting
			 <quote>an official Federal Voter Registration and Ballot Application</quote>;
			 and</text>
				</paragraph><paragraph id="H864E95F91E684C7288571803EAC8C3FB"><enum>(2)</enum><text>in subsection
			 (c)(2), by striking <quote>official post card forms</quote> and inserting
			 <quote>official Federal Voter Registration and Ballot
			 Applications</quote>.</text>
				</paragraph></subsection><subsection id="HF7D0D61E3CFD48A7A6C9C1B63CF399B3"><enum>(b)</enum><header>Conforming
			 Amendments</header>
				<paragraph id="H3A718307E4BD478083879F19000046A5"><enum>(1)</enum><header>State
			 responsibilities</header><text>Section 102(a)(4) of such Act (42 U.S.C.
			 1973ff–1(a)(4)) is amended by striking <quote>the official post card
			 form</quote> and inserting <quote>the official Federal Voter Registration and
			 Ballot Application</quote>.</text>
				</paragraph><paragraph id="HB33CDB0657A945FFA93B7377C0CD8566"><enum>(2)</enum><header>Use of single
			 application for all subsequent elections</header><text>Section 104 of such Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/1973ff-3">42 U.S.C. 1973ff–3</external-xref>) is amended—</text>
					<subparagraph id="HF742D88D377541AAA114E0290079F33F"><enum>(A)</enum><text>in subsection (a),
			 by striking <quote>an official post card form</quote> and inserting <quote>an
			 official Federal Voter Registration and Ballot Application</quote>;</text>
					</subparagraph><subparagraph id="H3875D6605E404BC3813F8226EE2701F7"><enum>(B)</enum><text>in subsection
			 (c)—</text>
						<clause id="H6951B3696AD343B0A109F19476CA8DF3"><enum>(i)</enum><text>in
			 the heading, by striking <quote><header-in-text level="subsection" style="OLC">Official Post Card Form</header-in-text></quote> and inserting
			 <quote><header-in-text level="subsection" style="OLC">Official Federal Voter
			 Registration and Ballot Application</header-in-text></quote>, and</text>
						</clause><clause id="HE7B800110F7744069B80FD291819D632"><enum>(ii)</enum><text>in

			 balloting materials</header><text>Section 107(2) of such Act (42 U.S.C.
			 1973ff–6(2)) is amended by striking <quote>official post card forms</quote> and
			 inserting <quote>official Federal Voter Registration and Ballot
			 Applications</quote>.</text>
				</paragraph></subsection></section><section id="HC762EAE6DA9E43D6BD5056C900922C43"><enum>3.</enum><header>Prohibiting
			 Refusal to Accept Applications, Ballots, and Other Materials For Failure to
			 Meet Nonessential Requirements</header>
			<subsection id="HFF107125AD8B4ADF9C21F0FE82277B49"><enum>(a)</enum><header>Voter
			 Registration and Absentee Ballot Applications</header><text>Section 102 of the
			 Uniformed and Overseas Citizens Absentee Voting Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1973ff-1">42 U.S.C. 1973ff–1</external-xref>) is
			 amended by adding at the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="HF0DECF0D29664254BAFF47FFE73A404" style="OLC">
					<subsection id="H79F96DEB2A264010AD322DE22C9DE400"><enum>(e)</enum><header>Prohibiting
				Refusal To Accept Applications for Failure To Meet Nonessential
				Requirements</header><text display-inline="yes-display-inline">A State may not
				refuse to accept or process any otherwise valid voter registration application
				or absentee ballot application (including the official Federal Voter
				Registration and Ballot Application prescribed under section 101) submitted by
				an absent uniformed services voter or overseas voter on any of the following
				grounds:</text>
						<paragraph id="H6CD5D81043FA47FDBCF505D3957AAEF"><enum>(1)</enum><text>The application is
				not on a post card, is printed or otherwise produced through the use of a
				computer program or an Internet site, or is otherwise a facsimile of an
				official application.</text>
						</paragraph><paragraph id="HA4F1F2505A5840CF87AF122CB4515882"><enum>(2)</enum><text display-inline="yes-display-inline">In the case of the official Federal Voter
				Registration and Ballot Application prescribed under section 101, the
				application does not include specific information included on applications
				produced by the State.</text>
						</paragraph><paragraph id="HDB8D605B653F43DF90AA73946600F91D"><enum>(3)</enum><text>The application,
				the envelope in which the application is submitted, or any affidavit or other
				attestation accompanying the application does not conform to specific
				requirements under State law regarding the size, shape, weight, or color of the
				paper on which it is produced.</text>
						</paragraph><paragraph id="H2F570D7CAB6B44EC8494AFA2EC6FEF27"><enum>(4)</enum><text>The application is
				not notarized or witnessed by a Notary Public or other official authorized to
				administer oaths.</text>
						</paragraph><paragraph id="H8ED1D777250042D3837BF6693653391E"><enum>(5)</enum><text>The application is
				received by the State other than through delivery by the United States Postal
				Service.</text>
						</paragraph><paragraph id="H397B42E855D44017BA70ED6FBD35DB82"><enum>(6)</enum><text display-inline="yes-display-inline">The application, the envelope in which the
				application is submitted, or any affidavit or other attestation accompanying
				the application does not meet any other requirement which the Presidential
				designee determines (under regulations promulgated by the Presidential
				designee) is not clearly necessary to prevent fraud in the conduct of
				elections.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HDD01821FA4684FEE8F1B20D8537F5E28"><enum>(b)</enum><header>Absentee
			 Ballots</header><text>Section 103 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1973ff-2">42 U.S.C. 1973ff–2</external-xref>) is
			 amended—</text>
				<paragraph id="H808DE92E34534EE5A78991E182495486"><enum>(1)</enum><text>by redesignating
			 subsection (f) as subsection (g); and</text>
				</paragraph><paragraph id="HC1E7F3B0ACEA4548A7418BDC58F1BF86"><enum>(2)</enum><text>by inserting after
			 subsection (e) the following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="HE61528F74E16445786C590123773C8B0" style="OLC">
						<subsection id="HC4937E6901BA4F388ECC4CFE40A71D29"><enum>(f)</enum><header>Prohibiting
				Refusal To Accept Ballot for Failure To Meet Nonessential
				Requirements</header><text>A State may not refuse to accept or process any
				otherwise valid absentee ballot, including the Federal write-in absentee
				ballot, submitted by an absent uniformed services voter or overseas voter on
				any of the following grounds:</text>
							<paragraph id="H5AD3258D429946B9B5939F37A2003D99"><enum>(1)</enum><text display-inline="yes-display-inline">The ballot as submitted is printed or
				otherwise produced through the use of a computer program or an Internet site or
				is otherwise a facsimile of the original ballot.</text>
							</paragraph><paragraph id="HFC82703161A54C87A2809208ECCFEBA0"><enum>(2)</enum><text>The ballot, the
				envelope in which the ballot is submitted, or any affidavit or other
				attestation accompanying the ballot as submitted does not conform to specific
				requirements under State law regarding the size, shape, weight, or color of the
				paper on which it is produced.</text>
							</paragraph><paragraph id="HDDFDD329D45541DE8C12948F803643A2"><enum>(3)</enum><text>The ballot is not
				notarized or witnessed by a Notary Public or other official authorized to
				administer oaths.</text>
							</paragraph><paragraph id="HD0F339383059431FA321B2BDFB3FBA66"><enum>(4)</enum><text>The ballot is
				received by the State other than through delivery by the United States Postal
				Service.</text>
							</paragraph><paragraph id="H9D145BF0E4174C59A7D9FC0CC802822"><enum>(5)</enum><text>The ballot, the
				envelope in which the ballot is submitted, or any affidavit or other
				attestation accompanying the ballot as submitted does not meet any other
				requirement which the Presidential designee determines (under regulations
				promulgated by the Presidential designee) is not clearly necessary to prevent
				fraud in the conduct of
				elections.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="HA34559D23BDC4167920066A106F53E8E"><enum>4.</enum><header>Requiring
			 Clarification of Postage Markings on Certain Balloting Materials Mailed by
			 States</header><text display-inline="no-display-inline">Section 3406 of title
			 39, United States Code, is amended—</text>
			<paragraph id="H75BC9242866541E9A833CF4CF0C995DE"><enum>(1)</enum><text>by redesignating
			 subsection (b) as subsection (c); and</text>
			</paragraph><paragraph id="H317B267965534379ABE5C6F01EB4121"><enum>(2)</enum><text>by
			 inserting after subsection (a) the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H9AE23215829440B7B700DE541C5800FE" style="USC">
					<subsection id="H5093A45E51D34604A6C0B815E207781"><enum>(b)</enum><text>In the case of
				balloting materials under the Uniformed and Overseas Citizens Absentee Voting
				Act consisting of pre-printed return envelopes which are prepared by a State
				for the submission of materials by an absent uniformed services voter or
				overseas voter under such Act—</text>
						<paragraph id="H14019BD04F5D422ABE27B3545C8C5DCA"><enum>(1)</enum><text>the State shall
				ensure that the address to which the materials are to be submitted includes the
				designation <quote>United States of America</quote> or <quote>USA</quote>;
				and</text>
						</paragraph><paragraph id="H05E6BC442EA1467F844C6F19D3782800"><enum>(2)</enum><text>if the materials
				are designated as postage paid, the State shall clarify whether the designation
				applies only to materials mailed within the United States or to materials
				mailed overseas through the Army Post Office or Fleet Post
				Office.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="HD90F183F80F24DAC921FD9E7C5C9BC4E"><enum>5.</enum><header>Provision of
			 Ballots in Subsequent Elections</header>
			<subsection id="H55BD79F5FB9D40318C5641A9A08BE9C"><enum>(a)</enum><header>Permitting Voters
			 To Request Absentee Ballots in All Subsequent Elections</header><text display-inline="yes-display-inline">Section 104(a) of the Uniformed and
			 Overseas Citizens Absentee Voting Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1973ff-3">42 U.S.C. 1973ff–3(a)</external-xref>) is amended by
			 striking <quote>through the next 2 regularly scheduled general
			 elections</quote> and all that follows through <quote>such general
			 elections),</quote> and inserting <quote>(subject to subsections (b) and
			 (d)),</quote></text>
			</subsection><subsection id="HB2032BB854D74717A6A6296B40001F44"><enum>(b)</enum><header>Waiver of
			 Requirement To Provide Absentee Ballots in Subsequent Elections to Individuals
			 With Unknown Addresses</header><text>Section 104(a) of such Act (42 U.S.C.
			 1973ff–3(a)) is amended by striking the period at the end and inserting the
			 following: <quote>, other than any election occurring after any absentee ballot
			 or other election material sent by the State to the voter is returned to the
			 State as undeliverable or with no forwarding address within the
			 State.</quote>.</text>
			</subsection><subsection id="HB150FF072A8A46968B2654A31141FBE8"><enum>(c)</enum><header>Permitting Early
			 Submission of Request During Previous Year</header><text>Section 104(e) of such
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1973ff-3">42 U.S.C. 1973ff–3(e)</external-xref>) is amended—</text>
				<paragraph id="HB0C99D07AC94473987F4AD95B96E7DD2"><enum>(1)</enum><text>by striking
			 <quote>during a year</quote>; and</text>
				</paragraph><paragraph id="H3F19B0B1D59A45C1AEB7E593298B4E7C"><enum>(2)</enum><text>by striking
			 <quote>for that year</quote>.</text>
				</paragraph></subsection></section><section id="HF64285F577E04D20A19B2EF13F661EFA"><enum>6.</enum><header>Application of
			 UOCAVA to Individuals Never Residing in United States Whose Parents Are
			 Overseas Voters</header><text display-inline="no-display-inline">Section
			 107(5)(C) of the Uniformed and Overseas Citizens Absentee Voting Act (42 U.S.C.
			 1973ff–6(5)(C)) is amended to read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="H4310AE12E424402485E3EED940078C4" style="OLC">
				<subparagraph id="HC5AEB4308E63433F96CBCBC87F7C82F9"><enum>(C)</enum><text>a person who
				resides outside the United States and (but for such residence) would be
				qualified to vote—</text>
					<clause id="H36E8813CDE4446EC85C2E476CA23EC16"><enum>(i)</enum><text>in
				the last place in which the person was domiciled before leaving the United
				States, or</text>
					</clause><clause id="H1AF67ECA1BC942B3BF65C9A77E42420"><enum>(ii)</enum><text>in
				the case of an individual who has never resided in the United States, in the
				last place in which the person’s parent or guardian was domiciled before
				leaving the United
				States;</text>
					</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H43FDF63DC5FE4BC7A5ABF1F0D171BFAA"><enum>7.</enum><header>Requiring Prompt
			 Notification of Rejection of Voter Registration or Absentee Ballot
			 Request</header><text display-inline="no-display-inline">Section 102(d) of the
			 Uniformed and Overseas Citizens Absentee Voting Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1973ff-1">42 U.S.C. 1973ff–1(d)</external-xref>) is
			 amended by striking <quote>shall provide</quote> and inserting <quote>shall
			 promptly provide</quote>.</text>
		</section><section id="H6E2B6599D5AE467090C9FCC88D726B36"><enum>8.</enum><header>Use of Diplomatic
			 Pouch for Returning Completed Absentee Ballots</header><text display-inline="no-display-inline">Section 101(c) of the Uniformed and Overseas
			 Citizens Absentee Voting Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1973ff">42 U.S.C. 1973ff(c)</external-xref>) is amended by adding at the
			 end the following new paragraph:</text>
			<quoted-block display-inline="no-display-inline" id="HF26555431DC241CE85001F391E191FB4" style="OLC">
				<paragraph id="H135801F0A24E4AC890E60000F9C83E85"><enum>(3)</enum><header>Use of
				diplomatic pouch for returning completed absentee ballots</header><text>If an
				overseas voter delivers a completed absentee ballot to an overseas facility of
				the Department of State, the Secretary of State shall use the diplomatic pouch
				to transmit the ballot to the United States, but only if—</text>
					<subparagraph id="HB462130146034B7692D87E1263999EE3"><enum>(A)</enum><text>the ballot is
				delivered to the facility not earlier than 14 days prior to the date of the
				election involved; and</text>
					</subparagraph><subparagraph id="H6BD4DA0C156C4E0BA43068F0BE60006"><enum>(B)</enum><text>the Secretary of
				State determines that there is no effective alternative available at the
				location of the facility (including private courier services) for the overseas
				voter to use to ensure the timely receipt of the
				ballot.</text>
					</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H36B534303C0C4A63818CA2997F00C75B"><enum>9.</enum><header>Effective
			 Date</header><text display-inline="no-display-inline">The amendments made by
			 this Act shall apply with respect to elections occurring on or after the
			 expiration of the 45-day period which begins on the date of the enactment of
			 this Act.</text>
