		<section id="H192828519843469196F6048BC1AED296" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Satellite Consumers’ Access to Public
			 Television Digital Programming Act of 2007</short-title></quote>.</text>
		</section><section id="HCD605D51B11547F7BD1300B1927BCA95"><enum>2.</enum><header>Satellite
			 carriage of qualified noncommercial educational television stations’ digital
			 signals</header><text display-inline="no-display-inline">Section 338(a) of the
			 Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/338">47 U.S.C. 338(a)</external-xref>) is amended by adding at the end
			 the following new paragraph:</text>

				<paragraph id="HF0A50984887B4015A776D8F924439216"><enum>(5)</enum><header>Carriage of
				qualified noncommercial educational television stations’ digital
				signals</header>
					<subparagraph id="H12DD44D3703B4E2782C76300BB82F620"><enum>(A)</enum><header>Obligation to
				carry</header><text>A satellite carrier that offers multichannel video
				programming distribution service in the United States to more than 5,000,000
				subscribers shall, within 1 year after the date of the enactment of the
				Satellite Consumers’ Access to Public Television Digital Programming Act of
				2007, retransmit the digital signals (including all free, over-the-air digital
				programming streams) of each qualified noncommercial educational television
				station located in any local market in the United States. The retransmissions
				of each such station—</text>
						<clause id="HCC394B553C60463DA9A09234F09C16C9"><enum>(i)</enum><text>shall be made
				available to all of the satellite carrier’s subscribers in such station’s local
				market; and</text>
						</clause><clause id="HB3B271FAECCB45C1B78B926F752C29BF"><enum>(ii)</enum><text>shall be carried
				in the digital format originally transmitted by the broadcaster, and,
				notwithstanding any other provision of law or regulation, without material
				degradation, including conversion to any lower-resolution or non-digital
				format.</text>
						</clause></subparagraph><subparagraph id="HB20D49E1FB9C4ECE948B44E21CCB2639"><enum>(B)</enum><header>Existing
				contracts</header><text>Nothing in this paragraph shall alter the contractual
				rights or obligations of the parties to any contract between a qualified
				noncommercial educational television station, or its representative, and a
				satellite carrier that is in force and effect as of the date of enactment of
				the <short-title>Satellite Consumers’ Access to Public
				Television Digital Programming Act of
				2007</short-title>.</text>
					</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HE96C5937B5BC41A88DF240FF978E3604"><enum>3.</enum><header>Definition</header><text display-inline="no-display-inline">Section 338(k) is amended—</text>
			<paragraph id="H001EA5696B144F2CAAD645DD2E84BF83"><enum>(1)</enum><text>by redesignating
			 paragraphs (5) through (8) as paragraphs (6) through (9), respectively;
			 and</text>
			</paragraph><paragraph id="HEA80A1A177FB4B689F33C2F53ED71D80"><enum>(2)</enum><text>by inserting after
			 paragraph (4) the following new paragraph:</text>

					<paragraph id="HC3121BFEE7D74B50800410949777C67"><enum>(5)</enum><header>Qualified
				noncommercial educational television station</header><text>The term
				<term>qualified noncommercial educational television station</term> has the
				meaning given such term in section 615(l)(1) of this
				Act.</text>
