<title id="H60CC6A7E1994405CA8003D5F79F7F01E"><enum>I</enum><header>Optimizing Visa Entry Rules</header> 
<section id="HD290E7C659A345A5A704A2C2D411308D"><enum>101.</enum><header>Worldwide levels of immigration</header><text display-inline="no-display-inline">Beginning with fiscal year 2009, notwithstanding section 201 of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151</external-xref>)—</text> 
<paragraph id="H63C8578F490F43328C15E94F92588803"><enum>(1)</enum><text display-inline="yes-display-inline">the worldwide level of family-sponsored immigrants under subsection (c) of such section in any fiscal year shall be zero;</text> </paragraph> 
<paragraph id="H3C131AAC1F324851B6F78CDD34DB00F4"><enum>(2)</enum><text display-inline="yes-display-inline">the worldwide level of employment-based immigrants under subsection (d) of such section in any fiscal year shall be 5,200; and</text> </paragraph> 
<paragraph id="HE2151882F8E14784AC972987EC306B00"><enum>(3)</enum><text display-inline="yes-display-inline">the worldwide level of diversity immigrants under subsection (e) of such section in any fiscal year shall be zero.</text> </paragraph></section> 
<section id="HA5F08646765F404F9C224B2F8CB2C766"><enum>102.</enum><header>Allotment of visas</header> 
<subsection id="HA9E427BBB3E3450D915F6F2DFA02D365"><enum>(a)</enum><header>In general</header><text>Beginning with fiscal year 2008, notwithstanding section 203 of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153</external-xref>)—</text> 
<paragraph id="H54B91CE163DB48E88571CC77C34B9C8E"><enum>(1)</enum><text display-inline="yes-display-inline">the number of visas that shall be allotted to family-sponsored immigrants under subsection (a) of such section in any fiscal year shall be zero;</text> </paragraph> 
<paragraph id="H603850C62B124E05AAA500487C7168B8"><enum>(2)</enum><text display-inline="yes-display-inline">the number of visas that shall be allotted to priority workers under subsection (b)(1) of such section (and to spouses and children of such workers under subsection (d) of such section) in any fiscal year shall not exceed 5,000, the number of visas that shall be allotted in any fiscal year to priority workers under subsection (b)(5) of such section (and to spouses and children of such workers under subsection (d) of such section) in any fiscal year shall not exceed 200, and the number of visas that shall be allotted to other aliens subject to the worldwide level for employment-based immigrants in any fiscal year shall be zero;</text> </paragraph> 
<paragraph id="H41FEB0FB71A44C25A86E7802C238507E"><enum>(3)</enum><text>the number of visas that shall be allotted to special immigrants under subsection (b)(4) of such section (and to spouses and children of such workers under subsection (d) of such section) in any fiscal year shall not exceed 1,000; and</text> </paragraph> 
<paragraph id="H27205073C3A74EA1A9C5AAA8A8BC509C"><enum>(4)</enum><text display-inline="yes-display-inline">the number of visas that shall be allotted to diversity immigrants under subsection (c) of such section in any fiscal year shall be zero.</text> </paragraph><continuation-text continuation-text-level="subsection">Nothing in this title shall be construed as imposing any numerical limitation on special immigrants described in subparagraph (A) or (B) of section 101(a)(27) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(27)</external-xref>) who may be provided immigrant visas (or who otherwise may acquire the status of an alien lawfully admitted for permanent residence).</continuation-text></subsection> 
<subsection id="HBC1AC45AA6224476A730DFA7BC928949"><enum>(b)</enum><header>Limitation on sponsorship by certain aliens</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, effective October 1, 2008, no visa may be allotted to any immigrant on the basis of a petition by an individual who has filed an application under section 210 or section 245A of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1160">8 U.S.C. 1160</external-xref>, 1255a).</text> </subsection> 
<subsection id="H155FC4CED8B74CBFB0BA4716DBCA29D1"><enum>(c)</enum><header>Elimination of preference categories</header><text>Effective October 1, 2008, no classification petition may be filed or approved, and no alien may be issued an immigration visa number, for the following preference categories:</text> 
<paragraph id="H4405A162330B46CA00CA62B06BAA860"><enum>(1)</enum><header>Family preference</header><text>Preference under section 203(a).</text> </paragraph> 
<paragraph id="HFF23D05A259E471D9D011C6C347ECF8"><enum>(2)</enum><header>Employment-based preference</header><text>Preference under section 203(b), other than as an alien described in subparagraph (A) or (B) of section 203(b)(1) or under section 203(b)(5), or under section 203(d) as the spouse or minor child of either such an alien.</text> </paragraph> 
<paragraph id="HDAEE7385BE4B434E9B836FFE04DAF872"><enum>(3)</enum><header>Diversity</header><text>Preference under section 203(c).</text> </paragraph></subsection> 
<subsection display-inline="no-display-inline" id="HBAE5EDFD46FA415F862F22AC48F2AA56"><enum>(d)</enum><header>Limitation on granting immigrant status</header><text>Effective October 1, 2008, the Secretary of Homeland Security may not accept or approve any petition for classification under section 204 of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1154">8 U.S.C. 1154</external-xref>) except for classification by reason of a family relationship described in section 201(b)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151(b)(2)</external-xref>) or priority worker or investor status under paragraph (1)(A), (1)(B), or (5) of subsection (b) of section 203 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153</external-xref>), or as a spouse or child of such a worker or investor under subsection (d) of such section, or as an alien described in section 201(b)(1)(B) or 201(b)(1)(C) of such Act.</text> </subsection></section> 
<section id="HE4C4A430AF15433E84E4B1A1B7DACAB0"><enum>103.</enum><header>Humanitarian immigration</header> 
<subsection id="H211000FC186548579509E0131CDD60C8"><enum>(a)</enum><header>Annual limitation of 50,000</header><text>Notwithstanding any other provision of law, subject to subsection (b), beginning with fiscal year 2008, the sum of the following shall not exceed 50,000:</text> 
<paragraph id="HE814A84706D948D08536003FB956F51D"><enum>(1)</enum><text>The number of refugees who are admitted under section 207 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1157">8 U.S.C. 1157</external-xref>) in a fiscal year.</text> </paragraph> 
<paragraph id="H61B194D8D2D34D168799B3268534A24F"><enum>(2)</enum><text>The number of admissions made available in such fiscal year to adjust to the status of permanent residence the status of aliens granted asylum under section 209(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1159">8 U.S.C. 1159(b)</external-xref>).</text> </paragraph> 
<paragraph id="H82623C903A1E48148D4F995EAD438939"><enum>(3)</enum><text display-inline="yes-display-inline">The number of aliens whose status is adjusted in such fiscal year under section 646 of the Immigration Reform and Immigrant Responsibility Act of 1996 (division C of <external-xref legal-doc="public-law" parsable-cite="pl/104/208">Public Law 104–208</external-xref>), relating to Polish and Hungarian parolees.</text> </paragraph> 
<paragraph id="H6915984CAF3248DF98AF2998B3794C8F"><enum>(4)</enum><text display-inline="yes-display-inline">The number of aliens whose status is adjusted in such fiscal year under section 599E of the Foreign Operations, Export Financing, and Related Programs Appropriations Act, 1990 (relating to Soviet and Indochinese parolees).</text> </paragraph> 
<paragraph id="HAF09AE403D2345D2914DEB5FAE8FE1D3"><enum>(5)</enum><text display-inline="yes-display-inline">The number of other aliens whose removal is cancelled (and whose status is adjusted) in such fiscal year under section 240A of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1229b">8 U.S.C. 1229b</external-xref>).</text> </paragraph> 
<paragraph id="HAFAD03A8CAEE4864ACDE109D88B08700"><enum>(6)</enum><text display-inline="yes-display-inline">The number of aliens who are provided lawful permanent resident status in such fiscal year on the basis of a private bill passed by Congress.</text> </paragraph></subsection> 
<subsection id="HBDB277D81DC747D69316DACADBC46200"><enum>(b)</enum><header>Exception</header><text>In applying subsection (a), aliens who are spouses or children of citizens of the United States, or who are admitted under the limitations described in section 102, shall not be counted.</text> </subsection></section> 
<section id="HA5DD01A9566E45A5AF9FE2023738BAA3"><enum>104.</enum><header>Sunsetting adjustments under various provisions</header> 
<subsection id="HF371AA2111554F26BCBC6FB9ED8B088B"><enum>(a)</enum><header>Sunset for IRCA-related and certain other amnesties</header><text display-inline="yes-display-inline">An alien may not be issued an immigrant visa or otherwise acquire the status of an alien lawfully admitted for permanent residence under any of the following provisions, unless the alien has filed an application for such visa or status on or before the date of the enactment of this Act:</text> 
<paragraph id="HA75B2DE0022447EAB04778359FE27BD9"><enum>(1)</enum><text>Section 245A of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1255a">8 U.S.C. 1255a</external-xref>), commonly known as the IRCA legalization program.</text> </paragraph> 
<paragraph id="HEBCF65FCF71046928653E6F7B04C48AB"><enum>(2)</enum><text>Section 210 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1160">8 U.S.C. 1160</external-xref>), commonly known as the agricultural worker amnesty program.</text> </paragraph>

<paragraph id="H71A42FEB71F043C8B3D07624629B24B5"><enum>(1)</enum><text>Section 202 of the Nicaraguan Adjustment and Central American Relief Act of 1997 (title II of <external-xref legal-doc="public-law" parsable-cite="pl/105/100">Public Law 105–100</external-xref>).</text> </paragraph> 
<paragraph id="HE256F1AF748F4250B79E00E343E2BD66"><enum>(2)</enum><text>The Haitian Refugee and Immigration Fairness Act of 1998 (division A of section 101(h) of <external-xref legal-doc="public-law" parsable-cite="pl/105/277">Public Law 105–277</external-xref>).</text> </paragraph></subsection> 
<subsection id="H9577EF51B71641BBAA56DD6D00AC53CF"><enum>(c)</enum><header>Immediate repeal of Cuban-Haitian adjustment</header><text>An alien may not be issued an immigrant visa and may not otherwise acquire the status of an alien lawfully admitted for permanent residence under section 202 of the Immigration Reform and Control Act of 1986, unless the alien has filed an application for such visa or status on or before the date of the enactment of this Act:</text> </subsection> 
<subsection id="HF8AFD76F523643E3B707FC6663689745"><enum>(d)</enum><header>Immediate repeal of Lautenberg-Morrison provisions</header><text>Effective on the date of the enactment of this Act, section 599D of the Foreign Operations, Export Financing, and Related Programs Appropriations Act, 1990 (<external-xref legal-doc="public-law" parsable-cite="pl/101/167">Public Law 101–167</external-xref>) is repealed.</text> </subsection></section> 
<section id="H35534FDCF20F46A08DC45F9CBE500EB"><enum>105.</enum><header>Requirement for Congressional approval for extension of designation of foreign states for purposes of temporary protected status</header><text display-inline="no-display-inline">Effective on October 1, 2008, the period of designation of a foreign state under section 244(b) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1254">8 U.S.C. 1254(b)</external-xref>) may not be extended beyond the initial designation period without the approval of both Houses of Congress.</text> </section> 
<section id="H442B1DA9CE66434291007C59B5441CFB"><enum>106.</enum><header>Establishment of new nonimmigrant classifications; conversion of certain existing immigrant classification petitions</header> 
<subsection id="H60A600A6F2C64E3F98F3DC73B7FC3B68"><enum>(a)</enum><header>Establishment of nonimmigrant classifications</header><text>Effective October 1, 2008, the Secretary of Homeland Security shall establish the following new nonimmigrant classifications (under section 101(a)(15) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)</external-xref>):</text> 
<paragraph id="HDFCAE67FF9E6494FA27863B840418578"><enum>(1)</enum><header>Spouses and minor children of lawful permanent residents</header> 
<subparagraph id="HDF341BD666914483AA4E1294C251C00"><enum>(A)</enum><header>In general</header><text>A nonimmigrant classification for an alien who is the spouse or child of an alien lawfully admitted for permanent residence.</text> </subparagraph> 
<subparagraph id="H9C5BF8CB0CA64A6C80B4B136D03D33B"><enum>(B)</enum><header>Period of validity of nonimmigrant visa</header><text>A visa issued for nonimmigrant classification under this paragraph shall be valid for a period of 3 years. Such visa may be renewed indefinitely so long as the principal alien is residing in the United States and the nonimmigrant alien remains the spouse or child of such alien.</text> </subparagraph> 
<subparagraph id="HBF9E4893FF4D4AD78FA52C73FEC95EE6"><enum>(C)</enum><header>Subsequent adjustment to lawful permanent resident status as immediate relatives upon naturalization of principal alien</header><text>If the principal alien described in subparagraph (A) becomes a naturalized citizen of the United States, the alien may apply for permanent resident status of such spouse and child as an immediate relative under section 201(b)(2)(A) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151(b)(2)(A)</external-xref>) and, for purposes of making such determination, the age of the child shall be the age of such child as of the date of approval of the nonimmigrant status under subparagraph (A).</text> </subparagraph></paragraph> 
<paragraph id="HA078CE94758B43F28F8687A726F8CEB9"><enum>(2)</enum><header>Parents of adult United States citizens</header> 
<subparagraph id="H8A3F242374764EEE9CEA7D1280E0F5CF"><enum>(A)</enum><header>In general</header><text>A nonimmigrant classification for an alien who is the parent of a citizen of the United States if the citizen is at least 21 years of age.</text> </subparagraph> 
<subparagraph id="H8A1F432CC89342A1929F2CDF35FA99EB"><enum>(B)</enum><header>Period of validity of nonimmigrant visa</header><text display-inline="yes-display-inline">A visa issued for nonimmigrant classification under this subparagraph shall be valid for a period of 5 years. Such visa may be renewed indefinitely so long as the citizen son or daughter is residing in the United States.</text> </subparagraph> 
<subparagraph id="HBBD27363C2504C8E9DFDAE9C559598DF"><enum>(C)</enum><header>Limitations on employment and public benefits and support by petitioning citizen son or daughter</header><text>An alien provided nonimmigrant status under this paragraph is not authorized to be employed in the United States and is not entitled, notwithstanding any other provision of law, to any benefits funded by the Federal Government or any State. In the case of such an alien, the petitioning United States citizen son or daughter shall be responsible for the support of the alien in the United States, regardless of the resources of such alien.</text> </subparagraph></paragraph></subsection> 
<subsection id="H674AB1714D2F4F73A605FDFCA75CAFF1"><enum>(b)</enum><header>Conversion of current classification petitions</header> 
<paragraph id="H2775D3DB8B774E9F0030057C214BFA23"><enum>(1)</enum><header>Family second preference conversions</header><text>In the case of a classification petition under section 204(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1154">8 U.S.C. 1154(a)</external-xref>) for preference status described in section 203(a)(2)(A) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(a)(2)(A)</external-xref>) for an alien that has been filed before October 1, 2008, as of such date such petition shall be deemed to be a petition for classification of the alien involved as a nonimmigrant under the classification established under subsection (a)(1).</text> </paragraph> 
<paragraph id="H1FA5A72945C04C368BD2449355447795"><enum>(2)</enum><header>Immediate relative petitions for parents</header><text display-inline="yes-display-inline">In the case of a classification petition under section 204(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1154">8 U.S.C. 1154(a)</external-xref>) for immediate relative status under section 201(b)(2)(A) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151(b)(2)(A)</external-xref>) as the parent of a United States citizen that has been filed before October 1, 2008, as of such date such petition shall be deemed to be a petition for classification of the alien involved as a nonimmigrant under the classification established under subsection (a)(2).</text> </paragraph></subsection></section></title> 
<title id="H02C05E563C154DE49F90BFF033343B2C"><enum>II</enum><header>Miscellaneous Provisions</header> 
<section id="HF820A1929AD74D3AABC10552A0FD248"><enum>201.</enum><header>Limitation on automatic birthright citizenship</header><text display-inline="no-display-inline">Notwithstanding any other provision of law, with respect to an individual born after the date of the enactment of this Act, the individual shall not be a national or citizen of the United States at birth under section 301 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1401">8 U.S.C. 1401</external-xref>) unless at least one of the individual’s parents is, at the time of birth, a citizen or national of the United States or an alien lawfully admitted for permanent residence.</text> </section> 
<section id="H17C52A42BC9843DC8448D54791D04C75"><enum>202.</enum><header>Requirement for immigrants to provide affidavit of allegiance to the United States</header> 
<subsection id="H2C3B86264FF645FA8F8E8F51E46CCCB6"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, no alien shall be provided an immigrant visa or otherwise provided status as an alien lawfully admitted to the United States for permanent residence unless the alien has executed an affidavit of allegiance to the United States that is in a form approved by the Secretary of Homeland Security.</text> </subsection> 
<subsection id="H472BFCA4116E4F25821B99E8D89297F8"><enum>(b)</enum><header>Effective date</header><text>Subsection (a) shall take effect on and after such date, not later than 60 days after the date of the enactment of this Act, as the Secretary of Homeland Security specifies after having approved the form for the affidavit under such subsection.</text> </subsection></section> 
<section id="H21EC2AFC3B724B979700178FAC101CF5"><enum>203.</enum><header>Requirement of affidavit of support for employment-based immigrants</header> 
<subsection id="HB1E01C9F9C7B435BA421D42DE5A0A1FB"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, no alien shall be provided an immigrant visa or otherwise provided status as an alien lawfully admitted to the United States for permanent residence as an employment-based immigrant under section 203(b) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(b)</external-xref>) unless there has been executed an affidavit of support that meets the requirements of section 213A of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1183a">8 U.S.C. 1183a</external-xref>) and the alien has executed an affidavit of allegiance to the United States that is in a form approved by the Secretary of Homeland Security.</text> </subsection> 
<subsection id="H56AB4C0DB33B4E1A96B41E807C53FAA4"><enum>(b)</enum><header>Effective date</header><text>Subsection (a) shall apply to visas and lawful permanent residence status provided after the date of the enactment of this Act.</text> </subsection></section> 
<section id="H51897E74F4734ACD8503E66777431B9"><enum>204.</enum><header>Making voting in foreign election a basis for automatic loss of citizenship</header> 
<subsection id="H70371212F582429290BD00443EC5085F"><enum>(a)</enum><header>In general</header><text>Section 349(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1481">8 U.S.C. 1481(a)</external-xref>) is amended—</text> 
<paragraph id="H9CA6352D22624D14A8D6A16DCA84717D"><enum>(1)</enum><text>by striking the period at the end of paragraph (7) and inserting <quote>; or</quote>; and</text> </paragraph> 
<paragraph id="H11844DA36F5A486B81B04DCEDA6CF6B1"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text> 
<quoted-block display-inline="no-display-inline" id="H8FE77D3C9D7B44D5A31018086214E17D" style="OLC"> 
<paragraph id="H1FACB10E463F4E14B02464D13C3E29D8"><enum>(8)</enum><text>voting in an election in a foreign country.</text> </paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection> 
<subsection id="HF04E043626544728966F8D98A5D2781C"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall apply to voting that occurs after the date of the enactment of this Act.</text> </subsection></section> 
<section id="H911EA78B3E734227A51769186E9C6124"><enum>205.</enum><header>Treating illegal presence in the United States as not demonstrating good moral character</header> 
<subsection id="HA18224CADFF0496591E763399EA15B95"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 101(f) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(f)</external-xref>) is amended—</text> 
<paragraph id="H69A75F16D0BA42759887B38BC5054CCF"><enum>(1)</enum><text>by striking <quote>or</quote> at the end of paragraph (8);</text> </paragraph> 
<paragraph id="H1E06D9A8E09143E3BA18514555DC5B93"><enum>(2)</enum><text>by striking the period at the end of paragraph (9) and inserting <quote>; or</quote>; and</text> </paragraph> 
<paragraph id="H8BD9D337F8EC408DA2CEB003B3F304B1"><enum>(3)</enum><text>by inserting after paragraph (9) the following new paragraph:</text> 
<quoted-block display-inline="no-display-inline" id="H1495D440282B4134BEB7CB225BE194D2" style="OLC"> 
<paragraph id="H91C4E51A196F4F9C8C9646C6CEBDAF3E"><enum>(10)</enum><text>one who—</text> 
<subparagraph id="H79932AD3A8384D80B6E9A37078DBE5A2"><enum>(A)</enum><text>at the time good moral character is required to be demonstrated, is unlawfully present in the United States without having been admitted or paroled;</text> </subparagraph> 
<subparagraph id="H73C4F185EF53466BACF9E7A867D389D5"><enum>(B)</enum><text display-inline="yes-display-inline">at the time good moral character is required to be demonstrated, has been inspected and admitted to the United States but gained such admission through fraud or misrepresentation; or</text> </subparagraph> 
<subparagraph id="H931E04D17B4E4DB8BB21C521F95E3EA0"><enum>(C)</enum><text>at any time has been unlawfully present in the United States for an aggregate period of 181 days or more.</text> </subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection> 
<subsection id="H920BEC7EC15746BCA022B4364363BDFD"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall apply to determinations of good moral character made after the date of the enactment of this Act.</text> </subsection></section> 
<section display-inline="no-display-inline" id="H4A27235E7F7940B495F1B6BF4EB749AF" section-type="subsequent-section"><enum>206.</enum><header>Requirement of DNA testing for aliens seeking visas based on a biological relationship</header> 
<subsection id="H0386CC7EB6C9458699580331AD6B0856"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 221(d) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1201">8 U.S.C. 1201(d)</external-xref>) is amended—</text> 
<paragraph id="H0FEC6B7E2CF849EC8C8435F3C5E77E22"><enum>(1)</enum><text>by striking <quote>(d)</quote> and inserting <quote>(d)(1)</quote>; and</text> </paragraph> 
<paragraph id="HF2D71DA5DC9E41A0983C87003D33BFD5"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text> 
<quoted-block display-inline="no-display-inline" id="H045D9CA807FF4FFAA588D9006CFD6B23" style="OLC"> 
<paragraph id="H84624B74D42C40F889C6D64F64883708" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Prior to the issuance of an immigrant visa to an alien that is predicated on a biological relationship to a family member, the consular officer shall require such alien to submit the results of DNA testing in order to confirm that the purported biological relationship is not inconsistent with the results.</text> </paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection> 
<subsection id="H8E126F8003D74B44B2A2B16B7800B0BF"><enum>(b)</enum><header>Authorization of fees</header><text>The Secretary of Homeland Security is authorized to adjust the fees collected from aliens described in section 221(d)(2) of the Immigration and Nationality Act, as added by subsection (a)(2), in order to carry out such section.</text> </subsection> 
<subsection id="H40E20777EB6640BBAFDEA0634160F500"><enum>(c)</enum><header>Testing facilities</header><text>The Secretary of Homeland Security, in consultation with the Secretary of State, shall promulgate regulations with respect to the facilities where DNA testing is authorized to be performed, as required by section 221(d)(2) of the the Immigration and Nationality Act, as added by subsection (a)(2).</text> </subsection></section></title> 
<title id="H87C5681C1B474925A2760094AF46B700"><enum>III</enum><header>Demanding Uniform Enforcement</header> 
<subtitle id="HC3583A95696348C981FA376308EAD03"><enum>A</enum><header>No access; No opportunity </header> 
<section display-inline="no-display-inline" id="HF4098020536B49A7B157874384F2002C"><enum>301.</enum><header>Sense of Congress on role of Department of Defense</header><text display-inline="no-display-inline">It is the sense of Congress that the Secretary of Defense should, to the maximum extent possible—</text> 
<paragraph id="H2C990D323E5945499546D3D5F44E400"><enum>(1)</enum><text>conduct training in conjunction with the United States Border Patrol where the Department of Defense can perform a supporting role; and</text> </paragraph> 
<paragraph id="HDC556FC4CE75424E00BE2F02E63EE531"><enum>(2)</enum><text>conduct surveillance to act as a force multiplier for the Border Patrol agents.</text> </paragraph></section> 
<section id="H8261644DE99D4BE19FBA5233893ECB52"><enum>302.</enum><header>Use of Army and Air Force to secure the borders</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/1385">Section 1385</external-xref> of title 18, United States Code, is amended by inserting after <quote>execute the laws</quote> the following: <quote>other than at or near a border of the United States in order to prevent aliens, terrorists, and drug smugglers from entering the United States</quote>.</text> </section> 
<section display-inline="no-display-inline" id="HB8FF88FB757A4430A0D2AFCAB7615D03"><enum>303.</enum><header>Assignment of members of the Armed Forces to assist United States Customs and Border Protection and United States Immigration and Customs Enforcement</header> 
<subsection id="H89EFD4271BDC466092C4451C036352D4"><enum>(a)</enum><header>Assignment authority of Secretary of Defense</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/18">Chapter 18</external-xref> of title 10, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/10/374">section 374</external-xref> the following new section:</text> 
<quoted-block id="H00BD5DBA48F5448C9C39D0B48DFF4DF6" style="USC"> 
<section id="H4CDABFD6EF834453BE4DBFAC00D8CBF3"><enum>374a.</enum><text display-inline="yes-display-inline">Assignment of members to assist border patrol and control</text> 
<subsection id="H0A8A6001DC4540E689277B7DA014B312"><enum>(a)</enum><header>Assignment authorized</header><text>Upon submission of a request consistent with subsection (b), the Secretary of Defense may assign members of the Army, Navy, Air Force, and Marine Corps to assist the Bureau of Customs and Border Protection and the United States Immigration and Customs Enforcement of the Department of Homeland Security—</text> 
<paragraph id="HED281F60BB07487AA53E35A00900A51D"><enum>(1)</enum><text>in preventing the entry of terrorists, drug traffickers, and illegal aliens into the United States; and</text> </paragraph> 
<paragraph id="H98E20153EDD248498BD5C6561FCA209"><enum>(2)</enum><text>in the inspection of cargo, vehicles, and aircraft at points of entry into the United States to prevent the entry of weapons of mass destruction, components of weapons of mass destruction, prohibited narcotics or drugs, or other terrorist or drug trafficking items.</text> </paragraph></subsection> 
<subsection id="HF7AD696EA8954863A4349F6E40D48743"><enum>(b)</enum><header>Request for assignment</header><text>The assignment of members under subsection (a) may occur only if—</text> 
<paragraph id="HDC2FD3142AFF4A43A4D7E2C9308F5560"><enum>(1)</enum><text>the assignment is at the request of the Secretary of Homeland Security; and</text> </paragraph> 
<paragraph id="H5BBF4AB9854943AF8D047FCAEC0084DD"><enum>(2)</enum><text>the request is accompanied by a certification by the Secretary of Homeland Security that the assignment of members pursuant to the request is necessary to respond to a threat to national security posed by the entry into the United States of terrorists, drug traffickers, or illegal aliens.</text> </paragraph></subsection> 
<subsection id="HEA2E9548A5F34D03B3B6823745B71F09"><enum>(c)</enum><header>Training program required</header><text>The Secretary of Homeland Security and the Secretary of Defense, shall establish a training program to ensure that members receive general instruction regarding issues affecting law enforcement in the border areas in which the members may perform duties under an assignment under subsection (a). A member may not be deployed at a border location pursuant to an assignment under subsection (a) until the member has successfully completed the training program.</text> </subsection> 
<subsection id="HB9F65736DA74477F8D4C64F85BB234EF"><enum>(d)</enum><header>Conditions of use</header> 
<paragraph commented="no" display-inline="yes-display-inline" id="HA98E65A9C9834474A2485C7F0038042C"><enum>(1)</enum><text>Whenever a member who is assigned under subsection (a) to assist the Bureau of Customs and Border Protection or the United States Immigration and Customs Enforcement is performing duties pursuant to the assignment, a civilian law enforcement officer from the agency concerned shall accompany the member.</text> </paragraph> 
<paragraph id="HCF5B8BD67B2D4B3ABC1BBCCF9F0306A4"><enum>(2)</enum><text>Nothing in this section shall be construed to—</text> 
<subparagraph id="HF9B47900B95B4A16989C688EC649F71B"><enum>(A)</enum><text>authorize a member assigned under subsection (a) to conduct a search, seizure, or other similar law enforcement activity or to make an arrest; and</text> </subparagraph> 
<subparagraph id="H26BB3C3212BA41C3ABA217031CBFE722"><enum>(B)</enum><text>supersede <external-xref legal-doc="usc" parsable-cite="usc/18/1385">section 1385</external-xref> of title 18 (popularly known as the <quote>Posse Comitatus Act</quote>).</text> </subparagraph></paragraph></subsection> 
<subsection id="H120AAF8FA6604EFDB178D6AF00BE156F"><enum>(e)</enum><header>Establishment of ongoing joint task forces</header> 
<paragraph commented="no" display-inline="yes-display-inline" id="H3302E6BA579F4825846644E1E4F463E3"><enum>(1)</enum><text>The Secretary of Homeland Security may establish ongoing joint task forces if the Secretary of Homeland Security determines that the joint task force, and the assignment of members to the joint task force, is necessary to respond to a threat to national security posed by the entry into the United States of terrorists, drug traffickers, or illegal aliens.</text> </paragraph> 
<paragraph id="HEFCDF30EA67C4C6ABAA7E105F6FC3100"><enum>(2)</enum><text>If established, the joint task force shall fully comply with the standards as set forth in this section.</text> </paragraph></subsection> 
<subsection id="H59C533E62F9945D4BA009FB0797E2456"><enum>(f)</enum><header>Notification requirements</header><text>The Secretary of Homeland Security shall provide to the Governor of the State in which members are to be deployed pursuant to an assignment under subsection (a) and to local governments in the deployment area notification of the deployment of the members to assist the Department of Homeland Security under this section and the types of tasks to be performed by the members.</text> </subsection> 
<subsection id="H05C698FA86D9473A86D45D147E93E0E6"><enum>(g)</enum><header>Reimbursement requirement</header><text>Section 377 of this title shall apply in the case of members assigned under subsection (a).</text> </subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection id="HD21CC484233C4C039600A8BA342580AD"><enum>(b)</enum><header>Commencement of training program</header><text>The training program required by subsection (c) of <external-xref legal-doc="usc" parsable-cite="usc/10/374a">section 374a</external-xref> of title 10, United States Code, shall be established as soon as practicable after the date of the enactment of this Act.</text> </subsection>

<subsection id="H40AA0775B83E4B2DA1630074ADF3CCDD"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The President shall provide for construction of the secure fencing authorized under section 102(b) of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1103">8 U.S.C. 1103</external-xref> note).</text> </subsection> 
<subsection id="HFC02CFC19BE74183005710A880059705"><enum>(b)</enum><header>Use of competitive bidding</header><text display-inline="yes-display-inline">In carrying out subsection (a), the President shall provide for a competitive bidding process under which a company is eligible to submit a bid if such company is enrolled, before submitting such a bid, in the electronic employment verification program under section 402 of such Act.</text> </subsection></section> 
<section display-inline="no-display-inline" id="H8B0A674D2976489A86E9A53BEFE7482F" section-type="subsequent-section"><enum>305.</enum><header>Report by Sandia National Laboratories concerning border security</header> 
<subsection id="HFBEEA39F3ED843FB91317E6933A7102F"><enum>(a)</enum><header>In general</header><text>Not later than one year after the date of the enactment of this Act, the head of Sandia National Laboratories shall submit to Congress a report concerning recommendations for the construction, establishment, or implementation of the most effective combination of manpower and border infrastructure for the entire international land border of the United States to prevent all unlawful entries into the United States.</text> </subsection> 
<subsection id="HAF857010067146E1BD114CC500D1F30"><enum>(b)</enum><header>Action by Congress</header><text>Not later than 60 days after submission of the report required under subsection (a), Congress shall conduct a vote to determine whether or not to implement the recommendations set out in such report.</text> </subsection></section> 
<section id="H2A496F943EE54F5DA90028B9C5C0B300"><enum>306.</enum><header>Increase in full-time USCBP immigration inspectors</header><text display-inline="no-display-inline">Subject to the availability of appropriations, the Secretary of Homeland Security shall increase by 2,000 above the number funded in fiscal year 2006 the number of full-time United States Customs and Border Protection immigration inspectors by the end of fiscal year 2008. There are authorized to be appropriated such sums as may be necessary for such additional resources for support personnel and equipment for inspections as may be necessary to implement such an increase in inspectors.</text> </section> 
<section id="H8AE966BE28D0445D86AF4EEBC2BB5C2E"><enum>307.</enum><header>Increase in full-time USICE detention and removal officers</header><text display-inline="no-display-inline">Subject to the availability of appropriations, the Secretary of Homeland Security shall increase by 2,000 above the number funded in fiscal year 2006 the number of full-time United States Immigration and Customs Enforcement detention and removal officers by the end of the fiscal year 2008. There are authorized to be appropriated such sums as may be necessary for additional resources for support personnel and equipment for detention and removals to implement such increase in personnel.</text> </section> 
<section id="H6D3419E372404252BEF089D21B646F68"><enum>308.</enum><header>Functions of detention and removal officers</header><text display-inline="no-display-inline">Notwithstanding any other provision of law, detention and removal officers of the Department of Homeland Security at the GS–9 and GS–11 levels are authorized to perform interior patrol functions, including locating, detaining, and transporting aliens who have overstayed their visas, alien absconders, and aliens apprehended by State or local authorities.</text> </section> 
<section id="HCB07E8CAD4F549238740073D8D783C73"><enum>309.</enum><header>Increase in USICE criminal investigators for benefits fraud</header><text display-inline="no-display-inline">Subject to the availability of appropriations, the Secretary of Homeland Security shall increase by 500 above the number funded in fiscal year 2006 the number of 1811-series criminal investigators to be assigned to the benefits fraud unit in the United States Immigration and Customs Enforcement to do benefits and false claims investigation by the end of fiscal year 2008. There are authorized to be appropriated such sums as may be necessary for related training and support.</text> </section> 
<section id="H65B4DC5D57274188A8F15F3BD4108550"><enum>310.</enum><header>Increase in attorneys for the USICE legal program</header><text display-inline="no-display-inline">Subject to the availability of appropriations, the Secretary of Homeland Security shall increase by 300 above the number funded in fiscal year 2006 the number of attorneys for the United States Immigration and Customs Enforcement Legal Program by the end of the fiscal year 2008. There are authorized to be appropriated such sums as may be necessary for related training and support.</text> </section> 
<section id="H8F47D7BC41734C4EB336B0B94F89CCF2"><enum>311.</enum><header>Suspension of visa waiver program</header> 
<subsection id="HEB732CE5283C489DBF66B70660319C5C"><enum>(a)</enum><header>Suspension</header><text>Notwithstanding any other provision of law, the visa waiver program established under section 217 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1187">8 U.S.C. 1187</external-xref>) is suspended until the Secretary of Homeland Security determines and certifies to the Congress that—</text> 
<paragraph id="HA8C10D8930044EB8904DC6FA68C7BC1"><enum>(1)</enum><text>the automated entry-exit control system authorized under section 110 of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1221">8 U.S.C. 1221</external-xref> note), as amended, is fully implemented and functional;</text> </paragraph> 
<paragraph id="HE0346D6E7A1247B7B89EE99CD339BCAC"><enum>(2)</enum><text>all United States ports of entry have functional biometric machine readers; and</text> </paragraph> 
<paragraph id="H5DD891B568694DBCA6212D045F482B94"><enum>(3)</enum><text>all nonimmigrants, including Border Crossing Card holders, are processed through the automated entry-exit system.</text> </paragraph></subsection> 
<subsection id="HA9037FD43C784910817BA0E347D94720"><enum>(b)</enum><header>Repeal</header><text>Subparagraph (B) of section 217(a)(3) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1187">8 U.S.C. 1187(a)(3)</external-xref>) is repealed.</text> </subsection></section> 
<section id="HDA3E2DF363DC4174A100CB40FE82D00"><enum>312.</enum><header>Civil and criminal penalties for unlawful presence</header> 
<subsection id="HB4CBB6159030414ABEA6B9AE09E878E8"><enum>(a)</enum><header>Aliens unlawfully present</header><text>Title II of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151 et seq.</external-xref>) is amended by inserting after section 275 the following new section:</text> 
<quoted-block display-inline="no-display-inline" id="H9E21D7C90D4E48E9A0F50DF24A4D56C" style="traditional"> 
<section id="HA1CAC123C7194E81AC7B2FEA88671FB2"><enum>275A.</enum><header>Criminal penalties and forfeiture for unlawful presence in the United States</header> 
<subsection commented="no" display-inline="yes-display-inline" id="H03E087189DC94D9DA93095028104E729"><enum>(a)</enum><text>In addition to any other violation, an alien present in the United States in violation of this Act shall be guilty of a felony and shall be fined under title 18, United States Code, imprisoned not less than 1 year, or both. The assets of any alien present in the United States in violation of this Act shall be subject to forfeiture under title 18, United States Code.</text> </subsection> 
<subsection id="H5789D5B5E6C1419E9F9E3709A6929D52"><enum>(b)</enum><text>It shall be an affirmative defense to a violation of subsection (a) that the alien overstayed the time allotted under the visa due to an exceptional and extremely unusual hardship or physical illness that prevented the alien from leaving the United States by the required date.</text> </subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection id="H5C56893B27FF428383ED8F4D336963C8"><enum>(b)</enum><header>Increase in criminal penalties for illegal entry</header><text>Section 275(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1325">8 U.S.C. 1325(a)</external-xref>) is amended by striking <quote>not more than 6 months,</quote> and inserting <quote>not less than 1 year,</quote>.</text> </subsection></section> 
<section id="H7C915E47448A4252A2FC3D027D46B033"><enum>313.</enum><header>Listing of immigration violators in the National Crime Information Center Database</header> 
<subsection id="HDC1BA13B223644B100223E8E85860472"><enum>(a)</enum><header>Provision of information to the NCIC</header><text>Not later than 180 days after the date of the enactment of this Act, the Under Secretary for Border and Transportation Security of the Department of Homeland Security shall provide the National Crime Information Center of the Department of Justice with such information as the Director may have on all aliens against whom a final order of removal has been issued, all aliens who have signed a voluntary departure agreement, and all aliens who have overstayed their visa. Such information shall be provided to the National Crime Information Center regardless of whether or not the alien received notice of a final order of removal and even if the alien has already been removed.</text> </subsection> 
<subsection id="HC8A9E9D70098431B85DFA14D92E70200"><enum>(b)</enum><header>Inclusion of information in the NCIC database</header><text><external-xref legal-doc="usc" parsable-cite="usc/28/534">Section 534(a)</external-xref> of title 28, United States Code, is amended—</text> 
<paragraph id="H0F4D4CF4E90F486292671CD70011F13F"><enum>(1)</enum><text>in paragraph (3), by striking <quote>and</quote> at the end;</text> </paragraph> 
<paragraph id="HDA1799E441284D1DB52BC1A7285500B4"><enum>(2)</enum><text>by redesignating paragraph (4) as paragraph (5); and</text> </paragraph> 
<paragraph id="H6929E69CC0F442478FBCF68978567495"><enum>(3)</enum><text>by inserting after paragraph (3) the following:</text> 
<quoted-block id="HD5188E9921934A53B1A45EBBC43CCE9" style="OLC"> 
<paragraph id="H512E09E264354E00876E70423F6BF96E"><enum>(4)</enum><text>acquire, collect, classify, and preserve records of violations of the immigration laws of the United States, regardless of whether or not the alien has received notice of the violation and even if the alien has already been removed; and</text> </paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection> 
<subsection id="H7FE8C7E7E6B54C1F91D71853C3A2A027"><enum>(c)</enum><header>State and local law enforcement provision of information about apprehended illegal aliens</header> 
<paragraph id="H1799170DF30947E6A470C418D9C12D06"><enum>(1)</enum><header>Provision of information</header> 
<subparagraph id="H592E1D3724FE4B24A8ECB2779D7BDF1"><enum>(A)</enum><header>In general</header><text>In order to receive funds under the State Criminal Alien Assistance Program described in section 241(i) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1231">8 U.S.C. 1231(i)</external-xref>), States and localities shall provide to the Department of Homeland Security the information listed in subsection (b) on each alien apprehended in the jurisdiction of the State or locality who is believed to be in violation of an immigration law of the United States.</text> </subparagraph> 
<subparagraph id="HC326E8FBA3F4428599E9C4B8BBBE1B31"><enum>(B)</enum><header>Time limitation</header><text>Not later than 10 days after an alien described in paragraph (1) is apprehended, information required to be provided under paragraph (1) shall be provided in such form and in such manner as the Secretary of Homeland Security may, by regulation or guideline, require.</text> </subparagraph></paragraph> 
<paragraph id="HF0947D33404A428C9C2000A6B706FA02"><enum>(2)</enum><header>Information required</header><text>The information listed in this subsection is as follows:</text> 
<subparagraph id="H1A3A6B132E7A45C7A2E4638D5C2B6D1C"><enum>(A)</enum><text>The alien’s name.</text> </subparagraph> 
<subparagraph id="HB088DBD02EC742739D4C0200D6BEC9B4"><enum>(B)</enum><text>The alien’s address or place of residence.</text> </subparagraph> 
<subparagraph id="H88A6CD4FC5CB4BD200F8A4A6852395BC"><enum>(C)</enum><text>A physical description of the alien.</text> </subparagraph> 
<subparagraph id="HF3D7583FB0AE423298002C0580157E00"><enum>(D)</enum><text>The date, time, and location of the encounter with the alien and reason for stopping, detaining, apprehending, or arresting the alien.</text> </subparagraph> 
<subparagraph id="HE5F984982C794A5BAB02DF00BA70A438"><enum>(E)</enum><text>If applicable, the alien’s driver’s license number and the State of issuance of such license.</text> </subparagraph> 
<subparagraph id="H9183973BC1444435852D2B747789DAA3"><enum>(F)</enum><text>If applicable, the type of any other identification document issued to the alien, any designation number contained on the identification document, and the issuing entity for the identification document.</text> </subparagraph> 
<subparagraph id="H8CD196A814FF43DFB197EE26087C2924"><enum>(G)</enum><text>If applicable, the license plate number, make, and model of any automobile registered to, or driven by, the alien.</text> </subparagraph> 
<subparagraph id="H772D95DE5F3842B7A1003984BBF32CAD"><enum>(H)</enum><text>A photo of the alien, if available or readily obtainable.</text> </subparagraph> 
<subparagraph id="HFC2BB6D12E6D410DB70018D8CC43FC3"><enum>(I)</enum><text>The alien’s fingerprints, if available or readily obtainable.</text> </subparagraph></paragraph> 
<paragraph id="H31BFBCFAA2C34B5D81DC99801DD5D52C"><enum>(3)</enum><header>Reimbursement</header><text>The Department of Homeland Security shall reimburse States and localities for all reasonable costs, as determined by the Secretary of Homeland Security, incurred by that State or locality as a result of providing information required by this section.</text> </paragraph> 
<paragraph id="HDB0216A426864E5B9C03EC910777B179"><enum>(4)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated such sums as necessary to carry out this Act.</text> </paragraph></subsection> 
<subsection id="HB61919B540C34E9D81C8308E26749443"><enum>(d)</enum><header>Forgery of Federal documents</header> 
<paragraph id="HACCCD81D6A3D4E2885491914B2FF091B"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/25">Chapter 25</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text>

<section id="HBB5A0AA6B5A04A25AEAD399EBCFB16B"><enum>515.</enum><header>Federal records, documents, and writings, generally</header><text display-inline="no-display-inline">Any person who—</text> 
<paragraph id="H0D0D5986411247559D230581EC9164E8"><enum>(1)</enum><text>falsely makes, alters, forges, or counterfeits any Federal record, Federal document, Federal writing, or record, document, or writing characterizing, or purporting to characterize, official Federal activity, service, contract, obligation, duty, property, or chose;</text> </paragraph> 
<paragraph id="H0DFEA3677C2742E385006600EEAF2BF6"><enum>(2)</enum><text>utters or publishes as true, or possesses with intent to utter or publish as true, any record, document, or writing described in paragraph (1), knowing, or negligently failing to know, that such record, document, or writing has not been verified, has been inconclusively verified, is unable to be verified, or is false, altered, forged, or counterfeited;</text> </paragraph> 
<paragraph id="H158B633E71634145B0CD910018807C4E"><enum>(3)</enum><text>transmits to, or presents at any office, or to any officer, of the United States, any records, document, or writing described in paragraph (1), knowing, or negligently failing to know, that such record, document, or writing has not been verified, has been inconclusively verified, in unable to be verified, or is false, altered, forged, or counterfeited;</text> </paragraph> 
<paragraph id="H453BBBCFB84A474EB8253E6952167F6C"><enum>(4)</enum><text>attempts, or conspires to commit, any of the acts described in paragraphs (1) through (3); or</text> </paragraph> 
<paragraph id="H78D69CE0975A48578C542D133BC144E"><enum>(5)</enum><text>while outside of the United States, engages in any of the acts described in paragraphs (1) through (3),</text> </paragraph></section> 
<quoted-block-continuation-text quoted-block-continuation-text-level="subsection">shall be fined under this title, imprisoned not more than 10 years, or both.</quoted-block-continuation-text><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph>

<subsection id="HCCFE2B275C1E4ADBBBC609CBBEA30023"><enum>(a)</enum><header>Federal agencies</header><text>No department, agency, commission, other entity, or employee of the Federal Government may accept, recognize, or rely on (or authorize the acceptance or recognition of or reliance on) for the purpose of establishing identity any document except those described in subsection (c).</text> </subsection> 
<subsection id="HB51EE653DD3B42FEAD339CC178C4E551"><enum>(b)</enum><header>State and local agencies</header><text>No department, agency, commission, other entity, or employee of a State or local government charged with providing or approving applications for public benefits or services funded in whole or in part with Federal funds may accept, recognize, or rely on (or authorize the acceptance or recognition of or reliance on) for the purpose of establishing identity any document except those described in subsection (c).</text> </subsection> 
<subsection id="H91873A21DD8F4913A3719F5165B01D00"><enum>(c)</enum><header>Documents described</header><text>Documents described in this subsection are limited to—</text> 
<paragraph id="HE50D82D0EEE645E9BF92E8158EE9C15"><enum>(1)</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="H12EF9381C81E4CD480898866A6599200"><enum>(A)</enum><text>Valid, unexpired United States passports, immigration documents, and other identity documents issued by a Federal authority.</text> </subparagraph> 
<subparagraph id="H355C439F4B13478C8C587847B1BC3F53" indent="up1"><enum>(B)</enum><text>Individual taxpayer identification numbers issued by the Internal Revenue Service shall not be considered identity documents for purposes of subparagraph (A).</text> </subparagraph></paragraph> 
<paragraph id="H9978A4E0B7DC46B39E267BE1B4B85666"><enum>(2)</enum><text>Valid, unexpired identity documents issued by a State or local authority if—</text> 
<subparagraph id="HF97CB643B5704E3789E8FE38F1718B72"><enum>(A)</enum><text>the State or local authority statutorily bars issuance of such identity documents to aliens unlawfully present in the United States; and</text> </subparagraph> 
<subparagraph id="H7D2AC70A91554DA28D6FA8EA3BD3AABB"><enum>(B)</enum><text>the State or local authority requires independent verification of records provided by the applicant in support of the application for such identity documents.</text> </subparagraph></paragraph> 
<paragraph id="H1BAA2545B6EC4055A79DE19DB0C10042"><enum>(3)</enum><text>Valid, unexpired foreign passports, if such passports include or are accompanied by proof of lawful presence in the United States.</text> </paragraph></subsection></section> 
<section id="HF1A2941B2F5B47D0BA606BE027E999A1"><enum>316.</enum><header>Fingerprinting of applicants for United States passports</header><text display-inline="no-display-inline">Section 1 of title IX of the Act of June 15, 1917 (<external-xref legal-doc="usc" parsable-cite="usc/22/213">22 U.S.C. 213</external-xref>) is amended—</text> 
<paragraph id="H819AD789026A4409B47608CA281E6D98"><enum>(1)</enum><text>by inserting <quote>(a)</quote> before <quote>Before a passport</quote>;</text> </paragraph> 
<paragraph id="HB6FF693D6157449383B5D654286D0487"><enum>(2)</enum><text>by adding at the end the following new subsection:</text>

<section id="H04A68560884C4C88B9077D8FD5228F7F"><enum>317.</enum><header>Visa term compliance bonds</header> 
<subsection id="H8BE7FE7F593043CEB7B986C409555A6"><enum>(a)</enum><header>Definitions</header><text>For purposes of this section:</text> 
<paragraph id="HF673A078748241D38FC52EFB75F5DE32"><enum>(1)</enum><header>Visa term compliance bond</header><text>The term <term>visa term compliance bond</term> means a written suretyship undertaking entered into by an alien individual seeking admission to the United States on a nonimmigrant visa whose performance is guaranteed by a bail agent.</text> </paragraph> 
<paragraph id="H4AEB20CAF412420CAC32C501E7881F61"><enum>(2)</enum><header>Suretyship undertaking</header><text>The term <term>suretyship undertaking</term> means a written agreement, executed by a bail agent, which binds all parties to its certain terms and conditions and which provides obligations for the visa applicant while under the bond and penalties for forfeiture to ensure the obligations of the principal under the agreement.</text> </paragraph> 
<paragraph id="H3FE06D955DCF40A7AA6C22F6E5EE5CD6"><enum>(3)</enum><header>Bail agent</header><text>The term <term>bail agent</term> means any individual properly licensed, approved, and appointed by power of attorney to execute or countersign bail bonds in connection with judicial proceedings and who receives a premium.</text> </paragraph> 
<paragraph id="H3C385B8777C849A1975D945CD3AF2E2E"><enum>(4)</enum><header>Surety</header><text>The term <term>surety</term> means an entity, as defined by, and that is in compliance with, sections 9304 through 9308 of title 31, United States Code, that agrees—</text> 
<subparagraph id="H26BDF249D34446A7BB4E6FE3E22E66F3"><enum>(A)</enum><text>to guarantee the performance, where appropriate, of the principal under a visa term compliance bond;</text> </subparagraph> 
<subparagraph id="HE12B9AD643FB40AB9C32DFB93BBB8627"><enum>(B)</enum><text>to perform as required in the event of a forfeiture; and</text> </subparagraph> 
<subparagraph id="HB498A294FA4C42569CEFF8606217113C"><enum>(C)</enum><text>to pay over the principal (penal) sum of the bond for failure to perform.</text> </subparagraph></paragraph> 
<paragraph id="H8FF21A917F0C4BEDA955DF5909D7E915"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Homeland Security.</text> </paragraph></subsection> 
<subsection id="HF03F5610435E4F86B840EAA6F0043F89"><enum>(b)</enum><header>Issuance of bond</header><text>A consular officer may require an applicant for a nonimmigrant visa, as a condition for granting such application, to obtain a visa term compliance bond.</text> </subsection> 
<subsection id="H22BDD54A84D64BFD0000A85FE3CFC2B"><enum>(c)</enum><header>Validity, expiration, renewal, and cancellation of bonds</header> 
<paragraph id="HCDE1C7354EDE4218AB1264B2FFBFE642"><enum>(1)</enum><header>Validity</header><text>A visa term compliance bond undertaking is valid if it—</text> 
<subparagraph id="H2DF010086E714CFF931F1EE5F799BD36"><enum>(A)</enum><text>states the full, correct, and proper name of the alien principal;</text> </subparagraph> 
<subparagraph id="H60A582076AC745E39B2DDDBA2C49AFF0"><enum>(B)</enum><text>states the amount of the bond;</text> </subparagraph> 
<subparagraph id="H07175A954CBF4D1E85265CFF0145FD85"><enum>(C)</enum><text>is guaranteed by a surety and countersigned by an attorney-in-fact who is properly appointed;</text> </subparagraph> 
<subparagraph id="HFB24BEA4C40349A4A5B23637E984C495"><enum>(D)</enum><text>is an original signed document;</text> </subparagraph> 
<subparagraph id="HC8225E14E41E42118DBA71937335BFBA"><enum>(E)</enum><text>is filed with the Secretary of Homeland Security along with the original application for a visa; and</text> </subparagraph> 
<subparagraph id="H53A3DC255ED0401DB0A242886BC35B87"><enum>(F)</enum><text>is not executed by electronic means.</text> </subparagraph></paragraph> 
<paragraph id="H10FAA6828F21474C8069146F99B3B65E"><enum>(2)</enum><header>Expiration</header><text>A visa term compliance bond undertaking shall expire at the earliest of—</text> 
<subparagraph id="HF50E3B7A1301436BA6B2AFA0079FCF08"><enum>(A)</enum><text>1 year after the date of issue;</text> </subparagraph> 
<subparagraph id="H1FA7069E5BD346058E02381E425C6EBB"><enum>(B)</enum><text>at the expiration, cancellation, or surrender of the visa; or</text> </subparagraph> 
<subparagraph id="H9BED63DF3C4348E9BE27C53F207ED6C7"><enum>(C)</enum><text>immediately upon nonpayment of the premium.</text> </subparagraph></paragraph> 
<paragraph id="HC7E61B25274F4FC8AC4D97DFB765441F"><enum>(3)</enum><header>Renewal</header><text display-inline="yes-display-inline">A visa term compliance may be renewed annually with payment of proper premium at the option of the bail agent or surety, but only if there has been no breech of conditions, default, claim, or forfeiture of the bond.</text> </paragraph> 
<paragraph id="H253B18D0C30649DEBEE80032174F4912"><enum>(4)</enum><header>Cancellation</header><text>A visa term compliance bond shall be canceled and the surety and bail agent exonerated—</text> 
<subparagraph id="HC0CF7D359E0148B3831C84AC33FC67D6"><enum>(A)</enum><text>for nonrenewal;</text> </subparagraph> 
<subparagraph id="HA8382F1B805A43A5BBAF70D5E8310080"><enum>(B)</enum><text>if the surety or bail agent provides reasonable evidence that there was misrepresentation or fraud in the application for the bond;</text> </subparagraph> 
<subparagraph id="H65052D334F0B43E684B3248800AE9204"><enum>(C)</enum><text>upon termination of the visa;</text> </subparagraph> 
<subparagraph id="H89A3CD79EE1F415E9DFD3B2CA3EA5646"><enum>(D)</enum><text>upon death, incarceration of the principal, or the inability of the surety to produce the principal for medical reasons;</text> </subparagraph> 
<subparagraph id="HFD5312E3F17A41C88515E07DBA5D67DD"><enum>(E)</enum><text>if the principal is detained in any city, State, country, or political subdivision thereof;</text> </subparagraph> 
<subparagraph id="HDEDA283B9F954A958F762573228297FE"><enum>(F)</enum><text>if the principal departs from the United States for any reason without permission of the Secretary of Homeland Security and the surety or bail agent; or</text> </subparagraph> 
<subparagraph id="HE7850EAF0D74474D805EB7B3929E4F70"><enum>(G)</enum><text>if the principal is surrendered by the surety.</text> </subparagraph></paragraph> 
<paragraph id="HFB76EA8EAC684968BB7CEF38901480EA"><enum>(5)</enum><header>Effect of expiration or cancellation</header><text>When a visa term compliance bond expires without being immediately renewed, or is canceled, the nonimmigrant status of the alien shall be revoked immediately.</text> </paragraph> 
<paragraph id="H7B75EE96A4664EE4BA772E0174BFB9DA"><enum>(6)</enum><header>Surrender of principal; forfeiture of bond premium</header> 
<subparagraph id="H8BD0B3A4FB7E42788B5D548868ED3D53"><enum>(A)</enum><header>Surrender</header><text>At any time before a breach of any of the conditions of a visa term compliance bond, the surety or bail agent may surrender the principal, or the principal may surrender, to any United States Immigration and Customs Enforcement or United States Customs and Border Protection office or facility.</text> </subparagraph> 
<subparagraph id="HCAE473B3490549D2A2D45DA74428D67"><enum>(B)</enum><header>Forfeiture of bond premium</header><text>A principal may be surrendered without the return of any bond premium if the visa holder—</text> 
<clause id="HD0AC86527D6A45A9929BE6C2FA00F34F"><enum>(i)</enum><text>changes address without notifying the surety or bail agent and the Secretary of Homeland Security in writing at least 60 days prior to such change;</text> </clause> 
<clause id="H31BE0E9EC2F04CE497BD7CA78871848B"><enum>(ii)</enum><text>changes schools, jobs, or occupations without written permission of the surety, bail agent, and the Secretary;</text> </clause> 
<clause id="H63D81A0A4D8D4624B3008F2D1293001E"><enum>(iii)</enum><text>conceals himself or herself;</text> </clause> 
<clause id="HCE5C637FF8FE481E931F27E33881CA30"><enum>(iv)</enum><text>fails to report to the Secretary as required at least annually; or</text> </clause> 
<clause id="H6175F322E0BB4455B9FE2B8049BE8337"><enum>(v)</enum><text>violates the contract with the bail agent or surety, commits any act that may lead to a breech of the bond, or otherwise violates any other obligation or condition of the visa established by the Secretary.</text> </clause></subparagraph></paragraph> 
<paragraph id="HE4BE632A96FA441587CDC57B4C3045D8"><enum>(7)</enum><header>Certified copy of undertaking or warrant to accompany surrender</header> 
<subparagraph id="H1C5F94134DA4411491F6BB5E5E20A10"><enum>(A)</enum><header>In general</header><text>A person desiring to make a surrender of the visa holder—</text> 
<clause id="H2DA04CEF73444F19B5E0358B987C00B5"><enum>(i)</enum><text>shall have the right to petition any Federal court for an arrest warrant for the arrest of the visa holder;</text> </clause> 
<clause id="HC02D242CAF6242A4800016B2108CB3B1"><enum>(ii)</enum><text>shall forthwith be provided a certified copy of the arrest warrant and the undertaking; and</text> </clause> 
<clause id="HF94B7493D08C4504A673F8731D35ADDB"><enum>(iii)</enum><text>shall have the right to pursue, apprehend, detain, and deliver the visa holder, together with the certified copy of the arrest warrant and the undertaking, to any official or facility of the United States Immigration and Customs Enforcement or of United States Customs and Border Protection or any detention facility authorized to hold Federal detainees.</text> </clause></subparagraph> 
<subparagraph id="H810F5AAE933A41B5A23877467D09FAAA"><enum>(B)</enum><header>Effects of delivery</header><text>Upon delivery of a person under subparagraph (A)(iii)—</text> 
<clause id="HFB17D37AA01A4E89BAFA99B32B310025"><enum>(i)</enum><text>the official to whom the delivery is made shall detain the visa holder in custody and issue a written certificate of surrender; and</text> </clause> 
<clause id="H6B62385EFE464768B20068001480C800"><enum>(ii)</enum><text>the court issuing the warrant described in subparagraph (A)(i) and the Secretary of Homeland Security shall immediately exonerate the surety and bail agent from any further liability on the bond.</text> </clause></subparagraph></paragraph> 
<paragraph id="H303D3A87026443F6863B43A93E7DAC"><enum>(8)</enum><header>Form of bond</header><text>A visa term compliance bond shall in all cases state the following and be secured by a surety:</text> 
<subparagraph id="H044B2145C6004160928F414FBFDD6072"><enum>(A)</enum><header>Breach of bond; procedure; forfeiture; notice</header> 
<clause id="H49B967EEC9AA4B3993A251744E2F28C2"><enum>(i)</enum><header>In general</header><text>If a visa holder violates any conditions of the visa or the visa bond the Secretary shall—</text> 
<subclause id="H0474C72F01334552966D94582EADE784"><enum>(I)</enum><text>order the visa canceled;</text> </subclause> 
<subclause id="H305242B5F2834B6D91F8FE48B5FEAF8"><enum>(II)</enum><text>immediately obtain a warrant for the visa holder’s arrest;</text> </subclause> 
<subclause id="HD84304AB97A74397B65FFD00B5B5B17B"><enum>(III)</enum><text>order the bail agent and surety to take the visa holder into custody and surrender the visa holder to the Secretary; and</text> </subclause> 
<subclause id="H500D39B8B60940238418D835C5341EDC"><enum>(IV)</enum><text>mail notice to the bail agent and surety via certified mail return receipt at each of the addresses in the bond.</text> </subclause></clause> 
<clause id="H2EF9B973D5C2462B83FB32F276964300"><enum>(ii)</enum><header>Access</header><text>A bail agent or surety shall have full and complete access to all information, electronic or otherwise, in the care, custody, and control of the United States Government or any State or local government or any subsidiary or police agency thereof regarding the visa holder needed to comply with <inline-comment display="yes">section 213 of the REAL GUEST Act of 2007</inline-comment><inline-comment display="yes">???</inline-comment> that the court issuing the warrant believes is crucial in locating the visa holder.</text> </clause> 
<clause id="H122954E2D8CA4249BFABF0212D029147"><enum>(iii)</enum><header>Arrest; detainer</header><text>If the visa holder is later arrested, detained, or otherwise located outside the United States and the outlying possessions of the United States (as defined in section 101(a) of the Immigration and Nationality Act), the Secretary shall—</text> 
<subclause id="HBE61113B75D44D3C89F5F014F2299ED4"><enum>(I)</enum><text>order that the bail agent and surety are completely exonerated, and the bond canceled and terminated; and</text> </subclause> 
<subclause id="H9FBE06F6BC544059B5426EF6FB56D9BD"><enum>(II)</enum><text>if the Secretary has issued an order under clause (i), the surety may request, by written, properly filed motion, reinstatement of the bond.</text> </subclause><continuation-text continuation-text-level="clause">Subclause (II) may not be construed to prevent the Secretary from revoking or resetting a higher bond.</continuation-text></clause> 
<clause id="HA6CEE7267165482EAFF82007E200C4DE"><enum>(iv)</enum><header>Actions</header><text display-inline="yes-display-inline">If a visa holder violates any conditions of the visa or the visa bond the bail agent or surety shall—</text> 
<subclause id="H58329435265847DEB2D96E245141003B"><enum>(I)</enum><text>produce the visa bond holder; or</text> </subclause> 
<subclause id="H4A9501F0A84C404896D3B49C1AFE8D"><enum>(II)</enum> 
<item commented="no" display-inline="yes-display-inline" id="H96626C3B52A94625AD7E00F24F7E3290"><enum>(aa)</enum><text>prove within 180 days that producing the bond holder was prevented—</text> 
<subitem id="HCC9B3843A8844E67BD185513740176AA" indent="up1"><enum>(AA)</enum><text>by the bond holder’s illness or death;</text> </subitem> 
<subitem id="H7F43589787CE4D5BBD50F49DDD5B493D" indent="up1"><enum>(BB)</enum><text>because the bond holder is detained in custody in any city, State, country, or political subdivision thereof;</text> </subitem> 
<subitem id="H196058F316324EAAB0E23B382E737B45" indent="up1"><enum>(CC)</enum><text>because the bond holder has left the United States or its outlying possessions (as defined in section 101(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)</external-xref>); or</text> </subitem> 
<subitem id="H843135C7E135470DAB28F7FC679376AA" indent="up1"><enum>(DD)</enum><text>because required notice was not given to the bail agent or surety; and</text> </subitem></item> 
<item id="H5A623473C252426E94CEDF8B7FC3E51" indent="up1"><enum>(bb)</enum><text>prove within 180 days that the inability to produce the bond holder was not with the consent or connivance of the bail agent or sureties.</text> </item></subclause></clause> 
<clause id="H81C6904F836D46EE874F008BE1FB8BCC"><enum>(v)</enum><header>Assessment of penalty within 60 days</header><text>If the bail agent or surety does not comply with the terms of this bond within 60 days after the mailing of the notice required under clause (i)(IV), a portion of the face value of the bond shall be assessed as a penalty against the surety.</text> </clause> 
<clause id="H32017D0EC9FB4F32A0566D059D3B4E08"><enum>(vi)</enum><header>Assessment of penalty between 60 and 90 days</header><text>If compliance occurs more than 60 days but no more than 90 days after the mailing of such notice, the amount assessed shall be one-third of the face value of the bond.</text> </clause> 
<clause id="H0C37379FE4EE4ED48ED201EBE4485E23"><enum>(vii)</enum><header>Assessment of penalty between 90 and 180 days</header><text>If compliance occurs more than 90 days, but no more than 180 days, after the mailing of such notice, the amount assessed shall be two-thirds of the face value of the bond.</text> </clause> 
<clause id="H74EB6984238F458791AFE775FB099CA3"><enum>(viii)</enum><header>Assessment of penalty greater than 180 days</header><text>If compliance does not occur within 180 days after the mailing of such notice, the amount assessed shall be 100 percent of the face value of the bond.</text> </clause> 
<clause id="H7C58B31A0BD64B9E85BC67497553A27F"><enum>(ix)</enum><header>Payment terms</header><text>All penalty fees shall be paid by the surety within 45 days after the end of such 180-day period.</text> </clause></subparagraph> 
<subparagraph id="H4FF755C0E1324DD6BDCF56DC8883CB48"><enum>(B)</enum><header>Waiver</header><text>The Secretary may waive the penalty fees or extend the period for payment or both under subparagraph (A), if—</text> 
<clause id="H8595203FB9064B9FAE9D5615EBEC2FD"><enum>(i)</enum><text>a written request is filed with the Secretary; and</text> </clause> 
<clause id="H1EB7045778534DE28BAE376F2EC4CFC4"><enum>(ii)</enum><text>the bail agent or surety provides evidence satisfactory to the Secretary that diligent efforts were made to effect compliance of the visa holder.</text> </clause></subparagraph> 
<subparagraph id="H442410A97F94479D9FF3DCE793AA5E38"><enum>(C)</enum><header>Compliance; exoneration; limitation of liability</header> 
<clause id="H1C81D6F08F96434F98A929B8F4F606BF"><enum>(i)</enum><header>Compliance</header><text>The bail agent or surety shall have the absolute right to locate, apprehend, arrest, detain, and surrender any visa holder, wherever the visa holder may be found, who violates any of the terms and conditions of the visa or bond.</text> </clause> 
<clause id="HC88238E75B364A800077089CA5530060"><enum>(ii)</enum><header>Exoneration</header><text>Upon satisfying any of the requirements of the bond, the surety shall be completely exonerated.</text> </clause> 
<clause id="HBA989D2E4CD5467DB62B19FAF5A37133"><enum>(iii)</enum><header>Limitation of liability</header><text>The total liability on any undertaking shall not exceed the face amount of the bond.</text> </clause></subparagraph></paragraph></subsection></section> 
<section id="H98B9DBA61F3D4993831263057488431B"><enum>318.</enum><header>Release of aliens in removal proceedings</header><text display-inline="no-display-inline">Section 236(a)(2) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1226">8 U.S.C. 1226(a)(2)</external-xref>) is amended to read as follows:</text> 
<quoted-block display-inline="no-display-inline" id="H2D3A8FCDB0F244A69F1CD439BD4FA880" style="OLC"> 
<paragraph id="H306A2321AB084C848571FF2CEE856420"><enum>(2)</enum><text>subject to section 241(a)(8), may release the alien on bond of at least $10,000, with security approved by, and containing conditions prescribed by, the Secretary of Homeland Security, but the Secretary shall not release the alien on or to the alien’s own recognizance unless an order of an immigration judge expressly finds that the alien is not a flight risk and is not a threat to the United States; and</text> </paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </section> 
<section id="HDE1D2DB1CF5044E89056B034E8302001"><enum>319.</enum><header>Detention of aliens delivered by bondsmen</header> 
<subsection id="H26D5B09BA9BA4BBF91E2B58CA002BFF"><enum>(a)</enum><header>In general</header><text>Section 241(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1231">8 U.S.C. 1231(a)</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block id="H94204E82BB9C43879CC116C362E406FA" style="OLC"> 
<paragraph id="H52BDF1E8615C4F5EA528CCCDEF3FB6AB"><enum>(8)</enum><header>Effect of production of alien by bondsman</header><text>Notwithstanding any other provision of law, the Secretary of Homeland Security shall take into custody any alien subject to a final order of removal, and cancel any bond previously posted for the alien, if the alien is produced within the prescribed time limit by the obligor on the bond. The obligor on the bond shall be deemed to have substantially performed all conditions imposed by the terms of the bond, and shall be released from liability on the bond, if the alien is produced within such time limit.</text> </paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection id="H1857BB3E72C04DF89963CE30DCE8B33E"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall take effect on the date of the enactment of this Act and shall apply to all immigration bonds posted before, on, or after such date.</text> </subsection></section> 
<section id="H69CAABD7597444979683F6DD180600CD"><enum>320.</enum><header>Independent verification of birth records provided in support of applications for social security account numbers</header> 
<subsection id="H5F8EE50A7B544420A3484C48E82B3B7B"><enum>(a)</enum><header>Applications for social security account numbers</header><text>Section 205(c)(2)(B)(ii) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/405">42 U.S.C. 405(c)(2)(B)(ii)</external-xref>) is amended</text> 
<paragraph id="H9F0FCC5D529F47708004F751F2C57CD1"><enum>(1)</enum><text>by inserting <quote>(I)</quote> after <quote>(ii)</quote>; and</text> </paragraph> 
<paragraph id="H1FAC0F9E01BD45108F2156F5BC2B1F91"><enum>(2)</enum><text>by adding at the end the following new subclause:</text> 
<quoted-block display-inline="no-display-inline" id="H595ED22733D04B728BAA0500A04030A" style="traditional"> 
<subclause id="H51D8AEB954BE4F04B3F2ADEB6429400" indent="up4"><enum>(II)</enum><text>With respect to an application for a social security account number for an individual, other than for purposes of enumeration at birth, the Commissioner of Social Security shall require independent verification of any birth record provided by the applicant in support of the application.</text> </subclause><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection> 
<subsection id="HD457EF26DC0E40A3B0A9A07249602396"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall apply with respect to applications filed more than 180 days after the date of the enactment of this Act.</text> </subsection></section> 
<section id="H08F080DBB168404C8CF714CB0059CEFE"><enum>321.</enum><header>Birth certificates</header> 
<subsection id="H057156447D6D4675A1233EF781CA1BA"><enum>(a)</enum><header>Applicability of minimum standards to local governments</header><text>The minimum standards in this section applicable to birth certificates issued by a State shall also apply to birth certificates issued by a local government in the State. It shall be the responsibility of the State to ensure that local governments in the State comply with the minimum standards.</text> </subsection> 
<subsection id="H90E848600DFC4F3789F2EB966612A6E7"><enum>(b)</enum><header>Minimum standards for Federal recognition</header> 
<paragraph id="HA9C3425C908147F980A92BFD267C6803"><enum>(1)</enum><header>Minimum standards for Federal use</header> 
<subparagraph id="HC562FD8F25894E31BB004E6B5BF053B"><enum>(A)</enum><header>In general</header><text>Beginning 3 years after the date of the enactment of this Act, a Federal agency may not accept, for any official purpose, a birth certificate issued by a State to any person unless the State is meeting the requirements of this section.</text> </subparagraph> 
<subparagraph id="H9166DAEF29BC422BA9B6AAB095853FA"><enum>(B)</enum><header>State certifications</header><text>The Secretary of Homeland Security shall determine whether a State is meeting the requirements of this section based on certifications made by the State to the Secretary. Such certifications shall be made at such times and in such manner as the Secretary, in consultation with the Secretary of Health and Human Services, may prescribe by regulation.</text> </subparagraph></paragraph> 
<paragraph id="HAFE4B05087DD4D92B101F139F167C900"><enum>(2)</enum><header>Minimum document standards</header><text>To meet the requirements of this section, a State shall include, on each birth certificate issued to a person by the State, the use of safety paper, the seal of the issuing custodian of record, and such other features as the Secretary of Homeland Security may determine necessary to prevent tampering, counterfeiting, and otherwise duplicating the birth certificate for fraudulent purposes. The Secretary may not require a single design to which birth certificates issued by all States must conform.</text> </paragraph> 
<paragraph id="HB3BAA591595B4D758C00541CF5EE9B3D"><enum>(3)</enum><header>Minimum issuance standards</header> 
<subparagraph id="HAB74854AA288436C84BFA8D67353ED34"><enum>(A)</enum><header>In general</header><text>To meet the requirements of this section, a State shall require and verify the following information from the requestor before issuing an authenticated copy of a birth certificate:</text> 
<clause id="H1F45A4D6A7CD44558495314F98D063A5"><enum>(i)</enum><text>The name on the birth certificate.</text> </clause> 
<clause id="H5F1EF9DC65BA4EB2AB71C0F18042DED6"><enum>(ii)</enum><text>The date and location of the birth.</text> </clause> 
<clause id="H309D7433237042E6A005D415AE00B8AC"><enum>(iii)</enum><text>The mother’s maiden name.</text> </clause> 
<clause id="H72A03D0079334A639DDF56EEB4CEB6E"><enum>(iv)</enum><text>Substantial proof of the requestor’s identity.</text> </clause></subparagraph> 
<subparagraph id="H29A39377EDCD49C0B1B499525100A0DC"><enum>(B)</enum><header>Issuance to persons not named on birth certificate</header><text>To meet the requirements of this section, in the case of a request by a person who is not named on the birth certificate, a State must require the presentation of legal authorization to request the birth certificate before issuance.</text> </subparagraph> 
<subparagraph id="H4C61221D5FD5478996C169113000F49F"><enum>(C)</enum><header>Issuance to family members</header><text>Not later than one year after the date of the enactment of this Act, the Secretary of Homeland Security, in consultation with the Secretary of Health and Human Services and the States, shall establish minimum standards for issuance of a birth certificate to specific family members, their authorized representatives, and others who demonstrate that the certificate is needed for the protection of the requestor’s personal or property rights.</text> </subparagraph> 
<subparagraph id="H3EA9B775BD47492E96E8BFEC4E1058AD"><enum>(D)</enum><header>Waivers</header><text>A State may waive the requirements set forth in clauses (i) through (iii) of subparagraph (A) in exceptional circumstances, such as the incapacitation of the registrant.</text> </subparagraph> 
<subparagraph id="H098E305E84CC42289DD77C9301CC400"><enum>(E)</enum><header>Applications by electronic means</header><text>To meet the requirements of this section, for applications by electronic means, through the mail or by phone or fax, a State shall employ third party verification, or equivalent verification, of the identity of the requestor.</text> </subparagraph> 
<subparagraph id="H43E8F0F6228F442CABAC3B5D5E2B2013"><enum>(F)</enum><header>Verification of documents</header><text>To meet the requirements of this section, a State shall verify the documents used to provide proof of identity of the requestor.</text> </subparagraph></paragraph> 
<paragraph id="H0C32E928E2834C0D9909C84236E52F37"><enum>(4)</enum><header>Other requirements</header><text>To meet the requirements of this section, a State shall adopt, at a minimum, the following practices in the issuance and administration of birth certificates:</text> 
<subparagraph id="H8926336193C446F1B41B946043917481"><enum>(A)</enum><text>Establish and implement minimum building security standards for State and local vital record offices.</text> </subparagraph> 
<subparagraph id="HD7A59A73890D4B12A4D7432069050020"><enum>(B)</enum><text>Restrict public access to birth certificates and information gathered in the issuance process to ensure that access is restricted to entities with which the State has a binding privacy protection agreement.</text> </subparagraph> 
<subparagraph id="HA2192B75844D453A9EB72757000938A5"><enum>(C)</enum><text>Subject all persons with access to vital records to appropriate security clearance requirements.</text> </subparagraph> 
<subparagraph id="H2006701ACC7C4087803E51E89313EB6"><enum>(D)</enum><text>Establish fraudulent document recognition training programs for appropriate employees engaged in the issuance process.</text> </subparagraph> 
<subparagraph id="H8BB8E473405C433E9D6E113D32F0A283"><enum>(E)</enum><text>Establish and implement internal operating system standards for paper and for electronic systems.</text> </subparagraph> 
<subparagraph id="HE4ECFE32AB924FC3B9B3C1203B943578"><enum>(F)</enum><text>Establish a central database that can provide interoperative data exchange with other States and with Federal agencies, subject to privacy restrictions and confirmation of the authority and identity of the requestor.</text> </subparagraph> 
<subparagraph id="H24C0B0EA3E314EECB3418800AB00AF10"><enum>(G)</enum><text>Ensure that birth and death records are matched in a comprehensive and timely manner, and that all electronic birth records and paper birth certificates of decedents are marked <quote>deceased</quote>.</text> </subparagraph> 
<subparagraph id="HEBBEDA40EEF34451B1373F282ECFDAF"><enum>(H)</enum><text>Cooperate with the Secretary of Homeland Security in the implementation of electronic verification of vital events under subsection (d).</text> </subparagraph></paragraph></subsection> 
<subsection commented="no" id="HE497D1639709426093F0D330239EF46"><enum>(c)</enum><header>Establishment of electronic birth and death registration systems</header><text>In consultation with the Secretary of Health and Human Services and the Commissioner of Social Security, the Secretary of Homeland Security shall take the following actions:</text> 
<paragraph commented="no" id="HC00A0FB0E8B1412D89F9205DBF99A4BA"><enum>(1)</enum><text>Work with the States to establish a common data set and common data exchange protocol for electronic birth registration systems and death registration systems.</text> </paragraph> 
<paragraph id="HE44542D37CC64AADA7DBDCA387AD6EF9"><enum>(2)</enum><text>Coordinate requirements for such systems to align with a national model.</text> </paragraph> 
<paragraph id="HF4CB8F2470B74439AEC85740EDA7BFC"><enum>(3)</enum><text>Ensure that fraud prevention is built into the design of electronic vital registration systems in the collection of vital event data, the issuance of birth certificates, and the exchange of data among government agencies.</text> </paragraph> 
<paragraph id="H35F6E2235C344C5DB3C71E9C98F400C0"><enum>(4)</enum><text>Ensure that electronic systems for issuing birth certificates, in the form of printed abstracts of birth records or digitized images, employ a common format of the certified copy, so that those requiring such documents can quickly confirm their validity.</text> </paragraph> 
<paragraph id="HD8CFCD5CC83E4FD0B2946280E0471EB0"><enum>(5)</enum><text>Establish uniform field requirements for State birth registries.</text> </paragraph> 
<paragraph id="H0AE06C99FF5D41458B7B4C8E853FD5FF"><enum>(6)</enum><text>Not later than 1 year after the date of the enactment of this Act, establish a process with the Department of Defense that will result in the sharing of data, with the States and the Social Security Administration, regarding deaths of United States military personnel and the birth and death of their dependents.</text> </paragraph> 
<paragraph id="HA16AA5209A4D4D8BADA7118605B06B34"><enum>(7)</enum><text>Not later than 1 year after the date of the enactment of this Act, establish a process with the Department of State to improve registration, notification, and the sharing of data with the States and the Social Security Administration, regarding births and deaths of United States citizens abroad.</text> </paragraph> 
<paragraph id="H22CC9ABEE30642CCA3D9E642095EB444"><enum>(8)</enum><text>Not later than 3 years after the date of establishment of databases provided for under this section, require States to record and retain electronic records of pertinent identification information collected from requestors who are not the registrants.</text> </paragraph> 
<paragraph id="H4ACE1378E91F434CAB9562162FC0B4AF"><enum>(9)</enum><text>Not later than 6 months after the date of the enactment of this Act, submit to Congress a report on whether there is a need for Federal laws to address penalties for fraud and misuse of vital records and whether violations are sufficiently enforced.</text> </paragraph></subsection> 
<subsection id="H5D9BA20A32A1408EA2999B47DECF47E"><enum>(d)</enum><header>Electronic verification of vital events</header> 
<paragraph id="HEA9A1AC7A584439B9E433D004F003233"><enum>(1)</enum><header>Lead agency</header><text>The Secretary of Homeland Security shall lead the implementation of electronic verification of a person’s birth and death.</text> </paragraph> 
<paragraph id="HF1F2F62B8F5344E092B4113F206DD68C"><enum>(2)</enum><header>Regulations</header><text>In carrying out paragraph (1), the Secretary shall issue regulations to establish a means by which authorized Federal and State agency users with a single interface will be able to generate an electronic query to any participating vital records jurisdiction throughout the United States to verify the contents of a paper birth certificate. Pursuant to the regulations, an electronic response from the participating vital records jurisdiction as to whether there is a birth record in their database that matches the paper birth certificate will be returned to the user, along with an indication if the matching birth record has been flagged <quote>deceased</quote>. The regulations shall take effect not later than 5 years after the date of the enactment of this Act.</text> </paragraph></subsection> 
<subsection id="HC36BD69038A24D18B2A4833894CC8D24"><enum>(e)</enum><header>Grants to states</header> 
<paragraph id="H64F5DBEE19DB485586BE2437BC854E1D"><enum>(1)</enum><header>In general</header><text>The Secretary of Homeland Security may make grants to States to assist the States in conforming to the minimum standards set forth in this section.</text> </paragraph> 
<paragraph id="H1CBC46332AE34A2A83E242F6000728EC"><enum>(2)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Secretary of Homeland Security for each of the fiscal years 2008 through 2011 such sums as may be necessary to carry out this section.</text> </paragraph></subsection> 
<subsection id="HB14D7ED0857944189D274D4776953875"><enum>(f)</enum><header>Authority</header> 
<paragraph id="H8A61A928B60E4A19A505E9B2F03348D"><enum>(1)</enum><header>Participation with Federal agencies and 25 states</header><text>All authority to issue regulations, certify standards, and issue grants under this section shall be carried out by the Secretary of Homeland Security, with the concurrence of the Secretary of Health and Human Services and in consultation with State vital statistics offices and appropriate Federal agencies.</text> </paragraph> 
<paragraph id="HC4DE9B07436A462296FFE4621B46F183"><enum>(2)</enum><header>Extensions of deadlines</header><text>The Secretary of Homeland Security may grant to a State an extension of time to meet the requirements of subsection (b)(1)(A) if the State provides adequate justification for noncompliance.</text> </paragraph></subsection> 
<subsection id="H10F48AE9AE8D427FB3E47700AB620349"><enum>(g)</enum><header>Repeal</header><text>Section 7211 of the Intelligence Reform and Terrorism Prevention Act of 2004 (<external-xref legal-doc="public-law" parsable-cite="pl/108/458">Public Law 108–458</external-xref>) is repealed.</text> </subsection></section> 
<section id="H8905D0636BBB4ED2A141C1E3D0E16C80"><enum>322.</enum><header>Maximum period of validity for State licenses and identification documents</header><text display-inline="no-display-inline">Section 202(d)(10) of the REAL ID Act of 2005 (division B of <external-xref legal-doc="public-law" parsable-cite="pl/109/13">Public Law 109–13</external-xref>) is amended by striking <quote>8 years</quote> and inserting <quote>5 years</quote>.</text> </section> 
<section id="H9962397368114D6F90B424FF5B81F2F"><enum>323.</enum><header>No preemption of certain State and local laws regarding employment eligibility verification requirements</header> 
<subsection id="H722031C873E24182B6006F04E009687C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Paragraph (2) of section 274A(h) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1324a">8 U.S.C. 1324a(h)</external-xref>) is amended to read as follows:</text> 
<quoted-block display-inline="no-display-inline" id="HA33C3D48D4734EEDBF257BD4065B7E48" style="OLC"> 
<paragraph id="H41AD9975BB7B4F7CAB5450899E9434CD"><enum>(2)</enum><header>No preemption</header><text display-inline="yes-display-inline">The provisions of this section shall not preempt any State or local law that imposes—</text> 
<subparagraph id="H62ECFF82DB4E4523BCE3893210C01379"><enum>(A)</enum><text display-inline="yes-display-inline">employment eligibility verification requirements imposed upon employers or employees consistent with or in addition to the employment eligibility verification requirements under this section;</text> </subparagraph> 
<subparagraph id="HA527844A05DD4C3D9DE62391A7F9243F"><enum>(B)</enum><text>civil or criminal penalties for violation of such State or local employment eligibility verification requirements;</text> </subparagraph> 
<subparagraph id="H975904E16E724C25B2A1D951B0255F95"><enum>(C)</enum><text>civil or criminal penalties for acts prohibited in this section;</text> </subparagraph> 
<subparagraph id="H11E4D3F4ECDB42AEBF517B2FDEDFBE5"><enum>(D)</enum><text display-inline="yes-display-inline">licensing sanctions for violation of such State or local employment eligibility verification requirements;</text> </subparagraph> 
<subparagraph id="H2410D75778FE43B7B6CBAF9100CD23A6"><enum>(E)</enum><text display-inline="yes-display-inline">licensing sanctions for acts prohibited in this section; or</text> </subparagraph> 
<subparagraph id="HF503861F989D45F59695698617DE7D83"><enum>(F)</enum><text>limitations on the right of a private party to sue for up to treble damages.</text> </subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection commented="no" id="HB0AF5DCF1D7644FDAD162036AB54A337"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendment made by subsection (a) shall take effect on the date of the enactment of this Act and shall apply as of such date to all applicable State or local laws that were enacted before, on, or after such date.</text> </subsection></section></subtitle> 
<subtitle id="H621D1929279444EF91E6CC8DBE278EBA"><enum>B</enum><header>Reversing Unlawful Migration </header> 
<section id="HBC02DCC972804865B2F9162680862DEC"><enum>331.</enum><header>Mandatory employment authorization verification</header> 
<subsection id="H838C39E09CD841AD86BBFECE1E2A375"><enum>(a)</enum><header>Renaming of basic pilot program</header><text>The basic pilot program established under section 403(a) of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (division C of <external-xref legal-doc="public-law" parsable-cite="pl/104/208">Public Law 104–208</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/8/1324a">8 U.S.C. 1324a</external-xref> note) is hereby renamed the <quote>Employment Authorization Status Instant Check</quote> or <quote>EASI Check</quote> system.</text> </subsection> 
<subsection id="H2A8817A9B3274EDB8F3CAF63FF4D8657"><enum>(b)</enum><header>Permanent operation of the program</header><text>The EASI Check system shall continue in operation permanently and shall not terminate.</text> </subsection> 
<subsection id="H7263A0E1210A4EBCB149B6BB20543B32"><enum>(c)</enum><header>Mandatory use of EASI check system</header> 
<paragraph id="H79954E76E3E14569B51344FB6E7C2CF6"><enum>(1)</enum><header>In general</header><text>Subject to paragraphs (2) and (3), every person or other entity that hires one or more individuals for employment in the United States shall verify through the EASI Check system that each such individual is authorized to work in the United States.</text> </paragraph> 
<paragraph id="HD7C37FD06E044D69B3D45F4F3963C3C2"><enum>(2)</enum><header>Select entities required to use easi check system immediately</header><text>The following entities shall satisfy the requirement in paragraph (1) by not later than one year after the date of the enactment of this Act:</text> 
<subparagraph id="H30A9AC1170AB44D784ED856BD9341AE"><enum>(A)</enum><header>Federal agencies</header><text>Each department and agency of the Federal Government;</text> </subparagraph> 
<subparagraph id="HE477CDDFB55148379D1D7D9FB3C87CF5"><enum>(B)</enum><header>Federal contractors</header><text>A contractor that—</text> 
<clause id="HC8086EFE09214195B7E4996FB11D49DC"><enum>(i)</enum><text>has entered into a contract with the Federal Government to which section 2(b)(1) of the Service Contract Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/41/351">41 U.S.C. 351(b)(1)</external-xref>) applies, and any subcontractor under such contract; or</text> </clause> 
<clause id="H22B5E74077B3458995B6308CED852819"><enum>(ii)</enum><text>has entered into a contract exempted from the application of such Act by section 6 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/41/356">41 U.S.C. 356</external-xref>), and any subcontractor under such contract.</text> </clause></subparagraph> 
<subparagraph id="HCA6C67E9DC024D4E8CE361258CB4F5FD"><enum>(C)</enum><header>Larger employers in certain industries</header><text>An employer that employs more than 50 individuals in the United States in any of the following industries, as defined by the Secretary of Labor:</text> 
<clause id="H3352F19062CF47F192A4E2C8CB945743"><enum>(i)</enum><text>Agriculture.</text> </clause> 
<clause id="H92B783CE0B45400BAAE7F40300B1C9F"><enum>(ii)</enum><text>Meat packing.</text> </clause> 
<clause id="HA186462A2A774E1E87F5BD57C60884EE"><enum>(iii)</enum><text>Construction.</text> </clause> 
<clause id="H4D33E55F879D4CB287846522B05D53B3"><enum>(iv)</enum><text>Leisure and hospitality.</text> </clause></subparagraph></paragraph> 
<paragraph id="H7272AA7F4F49477A977997770085D4DD"><enum>(3)</enum><header>Phasing-in for other employers</header> 
<subparagraph id="HE67A7132685B4E8900F57BE411E3392"><enum>(A)</enum><header>Two years for employers of 20 or more</header><text>Entities that employ 20 or more individuals in the United States in any industry shall satisfy the requirement in paragraph (1) by not later than two years after the date of the enactment of this Act.</text> </subparagraph> 
<subparagraph id="HCA83F406ADA1495A87C023DC2975A544"><enum>(B)</enum><header>Three years for all employers</header><text>All entities that employ one or more individuals in the United States shall satisfy the requirement in paragraph (1) by not later than three years after the date of the enactment of this Act.</text> </subparagraph></paragraph> 
<paragraph id="H48D11510689943CE83E653C1B1B75C7D"><enum>(4)</enum><header>Verifying employment authorization of current employees</header><text>Every person or other entity that employs one or more persons in the United States shall verify through the EASI Check system by no later than four years after the date of the enactment of this Act that each employee is authorized to work in the United States.</text> </paragraph> 
<paragraph id="HB1D51F27F1B84E24A978DA0082F1D19"><enum>(5)</enum><header>Defense</header><text>An employer who establishes that the employer complied in good faith with the requirements in paragraphs (1) and (4) shall not be liable for hiring an unauthorized alien, if—</text> 
<subparagraph id="H1ED08F45CC044CB8A5FA5B78EF8627FD"><enum>(A)</enum><text>such hiring occurred due to an error in the EASI Check system that was unknown to the employer at the time of such hiring; and</text> </subparagraph> 
<subparagraph id="HA5BCD7F6A0B44BC8AA23ADD658A8B530"><enum>(B)</enum><text>the employer terminates the employment of the alien upon being informed of the error.</text> </subparagraph></paragraph> 
<paragraph id="HCD00E422546944578E85924E76E520D6"><enum>(6)</enum><header>Sanctions for noncompliance</header><text>The failure of an employer to comply with the requirements in paragraph (1) or (4) shall—</text> 
<subparagraph id="H7AFEA95C554B40E08015C7914825C2C2"><enum>(A)</enum><text>be treated as a violation of section 274A(a)(1)(B) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1324a">8 U.S.C. 1324a(a)(1)(B)</external-xref>) with respect to each individual whose employment authorization status was not verified; and</text> </subparagraph> 
<subparagraph id="HCE40B6B5579A4BA49C95C99D009E28AB"><enum>(B)</enum><text>create a rebuttable presumption that the employer has violated section 274A(a)(1)(A) of such Act.</text> </subparagraph></paragraph> 
<paragraph id="H52970F9D615F4A3CA5C7DF276732B5D3"><enum>(7)</enum><header>Voluntary participation of employers not immediately subject to requirement</header><text>Nothing in this subsection shall be construed as preventing a person or other entity that is not immediately subject to the requirement of paragraph (1) pursuant to paragraph (2) or (3) from voluntarily using the EASI Check system to verify the employment authorization of new hires, current employees, or both.</text> </paragraph></subsection> 
<subsection id="HF71D765B46434F85ACF2C04F795B5912"><enum>(d)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated such sums as may be required to carry out this section.</text> </subsection></section> 
<section id="H3091DB755AA548128689F30A147998B"><enum>332.</enum><header>Employer sanctions</header> 
<subsection id="HAB6C80228268479BAD203826971CBFB4"><enum>(a)</enum><header>Increase in penalty for violations</header><text>Subsection 274A(e)(4) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1324a">8 U.S.C. 1324a(e)(4)</external-xref>) is amended—</text> 
<paragraph id="HA4FAADA8E707421EA8D4925739F7FABA"><enum>(1)</enum><text>in subparagraph (A)(i), by striking <quote>not less than $250 and not more than $2,000</quote> and inserting <quote>$5,000</quote>;</text> </paragraph> 
<paragraph id="H8C13883053CE4B128320AC99C660E3A5"><enum>(2)</enum><text>in subparagraph (A)(ii), by striking <quote>not less than $2,000 and not more than $5,000</quote> and inserting <quote>$10,000</quote>;</text> </paragraph> 
<paragraph id="HDB11234C9DAA48729D229B105150D36E"><enum>(3)</enum><text>in subparagraph (A)(iii), by striking <quote>not less than $3,000 and not more than $10,000</quote> and inserting <quote>$25,000</quote>; and</text> </paragraph> 
<paragraph id="H185581E2D613491A9B74D92EA00F925"><enum>(4)</enum><text>in subparagraph (B), by striking clause (i) and redesignating clause (ii) as clause (i).</text> </paragraph></subsection> 
<subsection id="H51AF43CD30654419A08B93DFBEC3BAD3"><enum>(b)</enum><header>Enforcement through limitation on H nonimmigrant petitions</header><text>Subsection 274A(e) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1324a">8 U.S.C. 1324a(e)</external-xref>) is further amended by adding at the end the following:</text> 
<quoted-block id="HDBFE73A63BAE4597BE5E66E69C79CC00" style="OLC"> 
<paragraph id="HC6C21CB4B0AC438482F9669DBD5425B5"><enum>(10)</enum><header>Limitation on H nonimmigrant petitions</header><text>Any person or entity found in violation of subsection (a)(1)(A) or (a)(2) shall be ineligible for a period of 5 years following the first offense, and permanently following the second offense, to petition for a nonimmigrant described in section 101(a)(15)(H).</text> </paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection id="H705F9C34C97E4A3CA2F91590E822A00"><enum>(c)</enum><header>Increase in criminal penalty</header><text>Section 274A(f)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1324a">8 U.S.C. 1324a(f)(1)</external-xref>) is amended to read as follows:</text>

<paragraph id="H59C067A9AC464131BE9216F9CA887F3E"><enum>(1)</enum><header>Criminal penalty</header><text>Any person or entity which engages in a pattern or practice of violations of subsection (a)(1)(A) or (a)(2) shall be fined not more than $25,000 for each unauthorized alien with respect to whom such a violation occurs, imprisoned for not less than one year, or both, notwithstanding the provisions of any other Federal law relating to fine levels.</text> </paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </subsection></section> 
<section id="H4E4AE0A692E94272B75438005FB3FFC2"><enum>333.</enum><header>Limited duration social security account numbers for nonimmigrants</header> 
<subsection id="HE4818A896D6B4DC2826E01FA13909DC6"><enum>(a)</enum><header>Temporary social security cards for nonimmigrants</header><text>Section 205(c)(2)(G) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/405">42 U.S.C. 405(c)(2)(G)</external-xref>) is amended by inserting after the first sentence the following: <quote>Social security cards issued to aliens who are not lawful permanent residents, but who are authorized to engage in employment in the United States, shall bear on their face an expiration date that coincides with the expiration of the alien’s permission to be employed in the United States. The social security account numbers on such cards shall not be valid to prove work authorization, either through the EASI Check system or otherwise, following their expiration.</quote>.</text> </subsection> 
<subsection id="HEB042851AAB04F36B2233C8B315D5FA5"><enum>(b)</enum><header>Timing of issuance to aliens</header><text>Subclause (I) of section 205(c)(2)(B)(i) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/405">42 U.S.C. 405(c)(2)(B)(i)(I)</external-xref>) is amended to read as follows:</text> 
<quoted-block id="H94D338FA29864B87B0EE9F1D27F33FE9" style="OLC"> 
<subclause id="HC0452D8D696A43A58B8D86001664FCB0" indent="up3"><enum>(I)</enum><text>to aliens at the time of their lawful admission to the United States for or adjustment of status to—</text> 
<item id="H8A4954FD6CE549DFA8548791BC4F55D7"><enum>(aa)</enum><text>permanent residence; or</text> </item> 
<item id="HB9C0195DF9E94136836990C706C579C"><enum>(bb)</enum><text>temporary or other short-term residence in a category that permits them to engage in employment in the United States, except that these aliens shall be issued the social security cards described in the second sentence of subparagraph (G);</text> </item></subclause><after-quoted-block>.</after-quoted-block></quoted-block> </subsection></section> 
<section id="H53756B2A839E428BB9BB8DAD2729114B"><enum>334.</enum><header>Mandatory notification of social security account number mismatches and multiple uses</header> 
<subsection id="HA8BCDE718E8A4858A9B52F58DFD400AD"><enum>(a)</enum><header>Notification of mismatched name and social security account number</header><text>The Commissioner of Social Security shall notify on an annual basis each United States employer with one or more employees whose social security account number does not match the employee’s name or date of birth in the Commissioner’s records. Such notification shall instruct employers to notify listed employees that they have 10 business days to correct the mismatch with the Social Security Administration or the employer will be required to terminate their employment. The notification also shall inform employers that they may not terminate listed employees prior to the close of the 10-day period.</text> </subsection> 
<subsection id="H0E8A790B37514A288DBB5C329562556E"><enum>(b)</enum><header>Notification of multiple uses of individual social security account numbers</header><text>Prior to crediting any individual with concurrent earnings from more than one employer, the Commissioner of Social Security shall notify the individual that earnings from two or more employers are being reported under the individual’s social security account number. Such notice shall include, at a minimum, the name and location of each employer and shall direct the individual to contact the Social Security Administration to present proof that the individual is the person to whom the social security account number was issued and, if applicable, to present a pay stub or other documentation showing that such individual is employed by both or all employers reporting earnings to that social security account number.</text> </subsection></section> 
<section id="H188AA1DFB778401684B2F812FE7BE2E"><enum>335.</enum><header>No social security credit for work performed while unlawfully present</header><text display-inline="no-display-inline">Sections 214(c)(1) and 223(a)(1)(C)(i) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/414">42 U.S.C. 414(c)(1)</external-xref>, 423(a)(1)(C)(i)), as added by section 211 of the Social Security Protection Act of 2004 (<external-xref legal-doc="public-law" parsable-cite="pl/108/203">Public Law 108–203</external-xref>), are each amended by striking <quote>at the time of assignment, or at any later time</quote> and inserting <quote>at the time any such quarters of coverage are earned</quote>.</text> </section> 
<section id="H9219852E015849F2BFA40526869DED6B"><enum>336.</enum><header>Reducing individual taxpayer identification number abuse</header> 
<subsection id="HC0593CAD28E947F29CFFA59038B9BEF4"><enum>(a)</enum><header>Modified IT IN format and lawful presence requirement</header> 
<paragraph id="HFD52304ABF81439493DA07B0072A671"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/6109">Section 6109(c)</external-xref> of the Internal Revenue Code of 1986 is amended to read as follows:</text>

<subsection id="H5E01F8906D01433D9FA1386B0012B3B5"><enum>(c)</enum><header>Requirement of information</header> 
<paragraph id="H2FE6598CE1914DCEA521743C75378C18"><enum>(1)</enum><header>In general</header><text>For purposes of this section, the Secretary is authorized to require such information as may be necessary to assign an identifying number of any person.</text> </paragraph> 
<paragraph id="HF6575FB1EDFD442AA2FCBC3B7BB764D6"><enum>(2)</enum><header>Separate from social security account numbers</header><text>Any identifying number assigned by the Secretary shall be comprised of a sequence of numerals and dashes that is visually distinguishable from and will not be mistaken for a social security account number.</text> </paragraph> 
<paragraph id="HEEE8DD26944D4E5A88ED8F5B18596122"><enum>(3)</enum><header>Verification of status for aliens</header><text>Prior to issuing any identifying number, the Secretary shall verify with the Department of Homeland Security that the applicant for such number is lawfully present in the United States.</text> </paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph> 
<paragraph id="H55A1646879EE42E0004300BCFA82BE79"><enum>(2)</enum><header>Effective date</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/6109">Section 6109(c)(2)</external-xref> of the Internal Revenue Code of 1986, as amended by paragraph (1), shall take effect not later than 30 days after the date of the enactment of this Act.</text> </paragraph></subsection> 
<subsection id="H5F93F68E487A42789F9EE3447B900F4"><enum>(b)</enum><header>Information sharing</header> 
<paragraph id="H12D3E6CB43CD42A0BF28B4F8057D77D"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/6103">Section 6103(i)(3)</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new subparagraph:</text>

<subparagraph id="H3739A60A4A294DE7002CFEE2D9B1E1D"><enum>(D)</enum><header>Possible violations of Federal immigration law</header><text>The Secretary shall disclose in electronic format to the Secretary of Homeland Security the taxpayer identity (as defined in subsection (b)(6)) of each taxpayer who has been assigned an individual taxpayer identification number. The Secretary of Homeland Security may disclose such information to officers and employees of the Department to the extent necessary to enforce Federal immigration laws.</text> </subparagraph><after-quoted-block></after-quoted-block></quoted-block> </paragraph> 
<paragraph id="HDC8EB2531D3B4421BAFF6CBB0071007F"><enum>(2)</enum><header>Effective date</header><text>The Secretary of the Treasury shall disclose information under the amendment made by paragraph (1) not later than 60 days after the date of the enactment of this Act.</text> </paragraph></subsection></section> 
<section id="H45D5E995F0AB4196AF008600AE49D8BC"><enum>337.</enum><header>Limited eligibility for tax credits and refunds</header><text display-inline="no-display-inline">Notwithstanding any other provision of law, an individual who submits to the Internal Revenue Service an income tax return that relies on an individual taxpayer identification number in lieu of a social security account number shall not be eligible for any tax credit or refund, including the earned income tax credit under <external-xref legal-doc="usc" parsable-cite="usc/26/32">section 32</external-xref> of the Internal Revenue Code of 1986.</text> </section> 
<section id="H165DEF60AD8F481789F94C058CE5CDF7"><enum>338.</enum><header>Penalty for failure to file correct information returns</header> 
<subsection id="H2FBB088D84A249E68F5FD15CD256C8BE"><enum>(a)</enum><header>Most egregious noncompliant employers</header><text>Section 6721 of the Internal Revenue Code is amended—</text> 
<paragraph id="H2A69ABE354D247829934BB947102C400"><enum>(1)</enum><text>by striking subsections (b), (c), and (d);</text> </paragraph> 
<paragraph id="HD1F82A2BF98D4AD59069C5B990EDB3CC"><enum>(2)</enum><text>by redesignating subsection (e) as subsection (b); and</text> </paragraph> 
<paragraph id="H7BF4218E215347E98D8F8CA234958006"><enum>(3)</enum><text>by adding at the end the following new subsection:</text> 
<quoted-block id="HF7CEFB2B1FC14380883C6FDC1008EE7" style="OLC"> 
<subsection id="HB86842AF6D574708AF404F335F9CF2D"><enum>(c)</enum><header>Penalty for egregious noncompliance employers</header><text>The Secretary shall assess the maximum allowable penalties on each employer designated in any taxable year by the Social Security Administration as one of the most egregious non-compliant employers.</text> </subsection><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection> 
<subsection id="H42D3E1E33E704DCD008F4FD8E1D379C"><enum>(b)</enum><header>Standard compliance program</header> 
<paragraph id="HC07C2F39375E4595A0E427E3B0F3BF6E"><enum>(1)</enum><header>In general</header><text>No later than 60 days after the date of the enactment of this Act, the Secretary of the Treasury, in consultation with the Commissioner of Social Security and the Secretary of Homeland Security, shall implement a regularly scheduled program for proposing, assessing, and collecting penalties from the filers of incorrect information returns under the Internal Revenue Code of 1986.</text> </paragraph> 
<paragraph id="HD07BB5D529854499B35C2D1551C4A3B9"><enum>(2)</enum><header>Report</header><text>The Secretary of the Treasury shall report to Congress not later than 180 days after the date of the enactment of this Act on the results of the program required in paragraph (1). Such report shall include at least the following:</text> 
<subparagraph id="HDBFF9427B8C045F489CEC9116BE3FBB"><enum>(A)</enum><text>The total number of filers who submitted incorrect information returns.</text> </subparagraph> 
<subparagraph id="HDD614D4E93EC4BFABC4426DFE8FE44C9"><enum>(B)</enum><text>The number of incorrect information returns submitted by such filers.</text> </subparagraph> 
<subparagraph id="H4E952A50DAD3432D8911338028A087D9"><enum>(C)</enum><text>The total amount of penalties proposed, assessed and collected through the program.</text> </subparagraph> 
<subparagraph id="H3099F5D643FC4237AB5C5F87D7687E62"><enum>(D)</enum><text>The number of waivers granted to filers of incorrect information returns.</text> </subparagraph></paragraph></subsection></section> 
<section id="H51990FBC468D425DA0B5E4DC65E9A0F9"><enum>339.</enum><header>Adjustment of status</header><text display-inline="no-display-inline">Section 245 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1255">8 U.S.C. 1255</external-xref>) is amended—</text> 
<paragraph id="HC8D938BA6EFC4306AE3FFFB50808DE26"><enum>(1)</enum><text>by striking subsections (a) through (i) and subsection (k);</text> </paragraph>

<subsection id="H2227D432FAA641C8A0727D5754D2D83F"><enum>(b)</enum><header>Aliens eligible for temporary protected status</header><text>Section 244(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1254a">8 U.S.C. 1254a(c)</external-xref>) is amended—</text> 
<paragraph id="H2692FA3F898F44038E116B3222ED8900"><enum>(1)</enum><text>in paragraph (3)(B)—</text>

<subsection id="H686F21D5310E4E3500A6969073702C39"><enum>(a)</enum><header>In general</header><text>Section 249 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1259">8 U.S.C. 1259</external-xref>) is repealed.</text> </subsection> 
<subsection id="H80E18AF310F34717A30000E41EEA22F"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents for the Immigration and Nationality Act is amended by striking the item relating to section 249.</text> </subsection></section> 
<section id="HB9E1AAF069B0459589EE1EE27501381B"><enum>342.</enum><header>Penalties for violations of Federal immigration laws by States and localities</header> 
<subsection id="HF71EDA25A18E4FC3A0B3A91F6B3269A4"><enum>(a)</enum><header>Preferential treatment of aliens not lawfully present for higher education benefits</header><text>Section 505 of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (Pub. Law 104–208) is amended—</text> 
<paragraph id="H4135581206484080A0FEDB5108508DCC"><enum>(1)</enum><text>in subsection (a), by inserting <quote>or graduation from a high school in the United States</quote> after <quote>on the basis of residence</quote>; and</text> </paragraph> 
<paragraph id="H74E81DC1C3DB4A0F94CEC3D46DDF15E9"><enum>(2)</enum><text>by adding at the end the following:</text> 
<quoted-block id="H2AC23EB7DF35413DAE6FDA48D0056A3" style="OLC"> 
<subsection id="H10039576EC034A4E9F193927F8278F92"><enum>(c)</enum><header>Annual report</header><text>The Attorney General shall report annually to Congress on which, if any, post-secondary educational institutions are providing benefits in contravention of this section.</text> </subsection> 
<subsection id="H1A74FF8ADF6B45929279AA53A9FBC4B"><enum>(d)</enum><header>Limitation on Federal financial assistance</header><text>No Federal agency shall provide any grant, reimbursement, or other financial assistance to any post-secondary educational institution determined under subsection (c) to be providing benefits in contravention of this section. Any funds withheld under this subsection shall be reallocated among qualifying educational institutions that are in compliance with subsection (a).</text> </subsection><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection> 
<subsection id="HB15429FC6981416B84CE12D85F5BCB4B"><enum>(b)</enum><header>Non-cooperation by States and localities</header><text>Section 241(i) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1231">8 U.S.C. 1231(i)</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block id="HFBF5A6024C554C0292006F33043F461F" style="OLC"> 
<paragraph id="H91E3E9C0FDA5477FA4E9C6B89214C388"><enum>(7)</enum><text>Prior to entering into a contractual arrangement with a State or political subdivision under paragraph (1), the Attorney General shall determine whether such State or political subdivision of a State has in place any formal or informal policy that violates section 642 of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1373">8 U.S.C. 1373</external-xref>). The Attorney General shall not enter into a contractual arrangement with, or allocate any of the funds made available under this section to, any State or political subdivision of a State with a policy that violates such section.</text> </paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </subsection></section> 
<section id="H8B235A9E6F334C31A104741B14A04D1E"><enum>343.</enum><header>Clarification of inherent authority of State and local law enforcement</header><text display-inline="no-display-inline">Notwithstanding any other provision of law and reaffirming the existing inherent authority of States, law enforcement personnel of a State or a political subdivision of a State have the inherent authority of a sovereign entity to apprehend, arrest, detain, or transfer to Federal custody aliens in the United States (including the transportation of such aliens across State lines to detention centers), in the enforcement of the immigration laws of the United States. This State authority has never been displaced or preempted by Congress.</text> </section> 
<section id="HD2FA9358056E4D18A463186EB47BCCA1"><enum>344.</enum><header>USICE response to requests for assistance from State and local law enforcement</header> 
<subsection id="H0504CD808EE646ACAC2250CD7CC74EDD"><enum>(a)</enum><header>In general</header><text>Title II of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151 et seq.</external-xref>) is amended by inserting after section 240C the following new section:</text> 
<quoted-block display-inline="no-display-inline" id="H6F919EDB57A640AB9B38A16D4B00439D" style="traditional"> 
<section id="H6784E7041EE348D490F9F74586C71483"><enum>240D.</enum><header>Custody of illegal aliens</header> 
<subsection commented="no" display-inline="yes-display-inline" id="H7A0ED553E39A4901B5B1657F468FBC75"><enum>(a)</enum><text>If the chief executive officer of a State (or, if appropriate, a political subdivision of the State) exercising authority with respect to the apprehension of an illegal alien submits a request to the Secretary of Homeland Security that the alien be taken into Federal custody, the Secretary of Homeland Security—</text> 
<paragraph id="H8A61864E7E8D4119AECCF00D43CB83B"><enum>(1)</enum><text>shall—</text> 
<subparagraph id="HD1E63F7DC837419A9100ADD14BD125F7"><enum>(A)</enum><text>not later than 48 hours after the conclusion of the State charging process or dismissal process, or if no State charging or dismissal process is required, not later than 48 hours after the illegal alien is apprehended, take the illegal alien into the custody of the Federal Government and incarcerate the alien; or</text> </subparagraph> 
<subparagraph id="HE21669EC19BE46ECB940DFBD61912279"><enum>(B)</enum><text>request that the relevant State or local law enforcement agency temporarily incarcerate or transport the illegal alien for transfer to Federal custody; and</text> </subparagraph></paragraph> 
<paragraph id="HD07A2D559E2B4A4C9E5289F6A8E94644"><enum>(2)</enum><text>shall designate a Federal, State, or local prison or jail or a private contracted prison or detention facility within each State as the central facility for that State to transfer custody of the criminal or illegal aliens to the Department of Homeland Security.</text> </paragraph></subsection> 
<subsection id="H12524F0B8FAE46CCB47692AA94A317E7"><enum>(b)</enum><text>The Department of Homeland Security shall reimburse States and localities for all reasonable expenses, as determined by the Secretary of Homeland Security, incurred by a State or locality in the incarceration and transportation of an illegal alien as described in subparagraphs (A) and (B) of subsection (a)(1). Compensation provided for costs incurred under such subparagraphs shall be the average cost of incarceration of a prisoner in the relevant State, as determined by the chief executive officer of a State (or, as appropriate, a political subdivision of the State) plus the cost of transporting the criminal or illegal alien from the point of apprehension, to the place of detention, and to the custody transfer point if the place of detention and place of custody are different.</text> </subsection> 
<subsection id="HDAC8005671FD4C46B22FCBCF79459250"><enum>(c)</enum><text>The Secretary of Homeland Security shall ensure that illegal aliens incarcerated in Federal facilities pursuant to this section are held in facilities which provide an appropriate level of security.</text> </subsection> 
<subsection id="H5C37BB7FE3A0483600A8D069684695C1"><enum>(d)</enum> 
<paragraph commented="no" display-inline="yes-display-inline" id="HED2E24D8903E40E8A000341ED8F45422"><enum>(1)</enum><text>In carrying out this section, the Secretary of Homeland Security may establish a regular circuit and schedule for the prompt transfer of apprehended illegal aliens from the custody of States and political subdivisions of States to Federal custody.</text> </paragraph> 
<paragraph id="H0E70D80860E34250B500BFB5BB429484" indent="up1"><enum>(2)</enum><text>The Secretary of Homeland Security may enter into contracts with appropriate State and local law enforcement and detention officials to implement this section.</text> </paragraph></subsection> 
<subsection id="H2692D936623E4B0CB74B5F40E6C2ED4F"><enum>(e)</enum><text>For purposes of this section, the term <term>illegal alien</term> means an alien who—</text> 
<paragraph id="H83C8E453E38B470AB092D2073F2E2201"><enum>(1)</enum><text>entered the United States without inspection or at any time or place other than that designated by the Secretary of Homeland Security;</text> </paragraph> 
<paragraph id="H6A647CBA74F74A7C9EADA32989596857"><enum>(2)</enum><text>was admitted as a nonimmigrant and who, at the time the alien was taken into custody by the State or a political subdivision of the State, had failed to—</text> 
<subparagraph id="HF6920C1F14924442A8C258F6375ECE9B"><enum>(A)</enum><text>maintain the nonimmigrant status in which the alien was admitted or to which it was changed under section 248; or</text> </subparagraph> 
<subparagraph id="HD5146D33DB5045AE003E978724679CC1"><enum>(B)</enum><text>comply with the conditions of any such status;</text> </subparagraph></paragraph> 
<paragraph id="H8FFA47C626034248B367FA22D1516FE"><enum>(3)</enum><text>was admitted as an immigrant and has subsequently failed to comply with the requirements of that status; or</text> </paragraph> 
<paragraph id="HD4362D04EE0641DDBBA477CFECD364F1"><enum>(4)</enum><text>failed to depart the United States under a voluntary departure agreement or under a final order of removal.</text> </paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection id="H099C445AC4ED4146853C38D54D3593E7"><enum>(b)</enum><header>Authorization of appropriations for the detention and transportation to federal custody of aliens not lawfully present</header><text>There is authorized to be appropriated $500,000,000 for the detention and removal of aliens not lawfully present in the United States under the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>) for fiscal year 2008 and each subsequent fiscal year.</text> </subsection></section> 
<section id="H8C6ABC3186AE417BB9DA27B8005393B"><enum>345.</enum><header>Basic immigration enforcement training for State, local, and tribal law enforcement officers</header> 
<subsection id="H5BBAACC6F59248D70053F47482AFDF5"><enum>(a)</enum><header>Demonstration project</header> 
<paragraph id="H8970C635C42F46F1943B73009DB9D1E5"><enum>(1)</enum><header>In general</header><text>Cameron University, located in Lawton, Oklahoma, shall establish and implement a demonstration project (in this section referred to as the <quote>demonstration project</quote>) to assess the feasibility of establishing a nationwide e-learning training course, covering basic immigration law enforcement issues, to be used by State, local, and tribal law enforcement officers in order to improve and enhance their ability, during their routine course of duties, to assist Federal immigration officers in the enforcement of Federal immigration laws.</text> </paragraph> 
<paragraph id="H920A6E15D59E40C4844F28BE26EE9B95"><enum>(2)</enum><header>Project Director responsibilities</header><text>The Project Director charged with establishing and implementing the demonstration project shall do the following:</text> 
<subparagraph id="H7432075CB8424768A20033F7652064BC"><enum>(A)</enum><text display-inline="yes-display-inline">The Project Director shall develop an on-line, e-learning website to provide State, local, and tribal law enforcement officers access to the e-learning training course. Such website shall—</text> 
<clause id="H91C24313995E43FDB972785700F5C5BF"><enum>(i)</enum><text>have the capability to enroll officers in the e-learning training course, record officers’ performance on the course, and track officers’ proficiency in learning the course’s concepts;</text> </clause> 
<clause id="H36776CE4B9154E16A0F51BCE00B5B6F5"><enum>(ii)</enum><text>ensure a high level of security; and</text> </clause> 
<clause id="H2E9F8B7A2863408EAEED8EFAEFD9C9B"><enum>(iii)</enum><text>encrypt personal and sensitive information.</text> </clause></subparagraph> 
<subparagraph id="HFAF181001F594A15865BDAEDA4AAE27D"><enum>(B)</enum><text display-inline="yes-display-inline">The Project Director shall develop an e-learning training course, which entails no more than four hours of training, is accessible through the on-line, e-learning website under subparagraph (A), and covers both the basic principles and practices of immigration law and the policies that relate to the enforcement of immigration laws. The e-learning training course shall—</text> 
<clause id="H1041C5078DA84B1C88653B62C09FED2B"><enum>(i)</enum><text display-inline="yes-display-inline">include, but not be limited to, instruction about employment-based and family-based immigration, the various types of nonimmigrant visas, the differences between immigrant and nonimmigrant status, the differences between lawful and unlawful presence, the criminal and civil consequences of unlawful presence, the various grounds for removal, the types of false identification that illegal and criminal aliens commonly use, the common methods of alien smuggling and groups that commonly participate in alien smuggling rings, the inherent legal authority of local law enforcement officers to enforce federal immigration laws, and detention and removal procedures, including expeditious removal; and</text> </clause> 
<clause id="HEAE00D2665E1461AA4C4AE97855F15AC"><enum>(ii)</enum><text>incorporate content similar to that covered in the four-hour training course the Immigration and Naturalization Service provided to all Alabama State Troopers in 2003 (in addition to, and separate from, the training given pursuant to the State’s section 287(g) agreement).</text> </clause></subparagraph> 
<subparagraph id="H9D3E893FEFB74068AE00D797C63C1963"><enum>(C)</enum><text display-inline="yes-display-inline">The Project Director shall assess the feasibility of expanding to State, local, and tribal law enforcement agencies throughout the United States the on-line, e-learning website, including the e-learning training course, by using on-line technology.</text> </subparagraph></paragraph></subsection> 
<subsection id="HB60072BEAFB247A78DFF44F79F008EAA"><enum>(b)</enum><header>Period of project</header><text display-inline="yes-display-inline">The Project Director shall carry out the demonstration project for a one-year period beginning 90 days after the date of the enactment of this Act.</text> </subsection> 
<subsection id="HA109B48B55C1479DBC8DDCB88D5F97E0"><enum>(c)</enum><header>Location of project</header> 
<paragraph display-inline="no-display-inline" id="H37018B897A1143B390A9B25506D21F11"><enum>(1)</enum><header>States covered</header><text display-inline="yes-display-inline">The Project Director shall carry out the demonstration project by enrolling in the e-learning training course State, local, and tribal law enforcement officers from Alabama, Colorado, Florida, Oklahoma, and Texas, and from at least one, but not more than three, other additional States.</text> </paragraph> 
<paragraph id="H7BD91D60D06942568565CD665370A5B4"><enum>(2)</enum><header>Number of officers</header><text display-inline="yes-display-inline">A total of 100,000 officers shall have access to, enroll in, and complete the e-learning training course provided under the demonstration project.</text> </paragraph> 
<paragraph id="HE5823116C0014504008BCF3613554DAD"><enum>(3)</enum><header>Apportionment</header><text display-inline="yes-display-inline">The number of officers who are selected to participate in the demonstration project shall be apportioned according to the State populations of the participating States.</text> </paragraph> 
<paragraph id="H0735C322B98F48629E438D9B3DFD7C43"><enum>(4)</enum><header>Selection</header><text display-inline="yes-display-inline">Participation in the demonstration project shall—</text> 
<subparagraph id="H4823287E77FF41C5BD0089B8441E40CC"><enum>(A)</enum><text>be equally apportioned between State, county, and municipal law enforcement agency officers;</text> </subparagraph> 
<subparagraph id="H2EE6328F1D1C4A42A137002E80808ED2"><enum>(B)</enum><text>include, when practicable, a significant subset of tribal law enforcement officers; and</text> </subparagraph> 
<subparagraph id="H6E84514A47734E19AA71076983F231E5"><enum>(C)</enum><text>include officers from urban, rural, and highly rural areas.</text> </subparagraph></paragraph> 
<paragraph id="H3499E08E9F0040B08F3789989C9C9BA2"><enum>(5)</enum><header>Limitation on participation</header><text display-inline="yes-display-inline">Officers shall be ineligible to participate in the demonstration project if they are employed by a State, local, or tribal law enforcement agency that has in effect a statute, policy, or practice that prohibits its law enforcement officers from cooperating with Federal immigration enforcement agents (or if the State, local, or tribal law enforcement agency is otherwise in contravention of section 642(a) of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1373">8 U.S.C. 1373(a)</external-xref>).</text> </paragraph></subsection> 
<subsection id="H0041D007A2F941E1AE10A424AA4CB7EC"><enum>(d)</enum><header>Demonstration project requirements</header> 
<paragraph commented="no" display-inline="yes-display-inline" id="HA03A647882ED4CADA7D988CA1844A0F2"><enum>(1)</enum><text display-inline="yes-display-inline">The e-learning training course provided under the demonstration project shall be accessible through the secure, encrypted on-line, e-learning website, within 90 days of the date of the enactment of this Act, and recruitment of participants shall begin immediately, and occur concurrently, with the e-learning training course’s establishment and implementation.</text> </paragraph> 
<paragraph id="H82A5F0468E7043369CD43E7754E94155" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The law enforcement officers selected to participate in the e-learning training course provided under the demonstration project shall undergo standard vetting procedures, pursuant to the Federal Law Enforcement Training Center Distributed Learning Program, to ensure that each individual is a bona fide law enforcement officer.</text> </paragraph> 
<paragraph id="H27C03A90BF0F4EEB84EA556FBD1C6BA3" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">The law enforcement officers selected to participate in the e-learning training course provided under the demonstration project shall be granted continuous access, throughout the demonstration project’s one-year period, to on-line course material and to other training and reference resources accessible through the on-line, e-learning website.</text> </paragraph></subsection> 
<subsection id="H43ABE4CEAAF341A8998F1F5F61465309"><enum>(e)</enum><header>Report</header> 
<paragraph display-inline="no-display-inline" id="H672D430A77254317BA7D32E3B941F847"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than the end of the one-year period described in subsection (b), the Project Director shall transmit to the Committees on the Judiciary and on Homeland Security of the House of Representatives and the Committees on the Judiciary and Homeland Security and Governmental Affairs of the Senate a report about the e-learning training course completed by State, local, and tribal law enforcement officers through the demonstration project.</text> </paragraph> 
<paragraph id="H21DA5DB73DA141ADBA30E0FD96A4B950"><enum>(2)</enum><header>Matters to be included</header><text display-inline="yes-display-inline">The report under paragraph (1) shall include the following:</text> 
<subparagraph id="H91C637FE5154497BBDCA64ED280012ED"><enum>(A)</enum><text display-inline="yes-display-inline">An estimate of the cost savings realized by offering training through the e-learning training course as opposed to offering similar training through the residential classroom method.</text> </subparagraph> 
<subparagraph id="HD1537C479A4B44D090AE016DE548EC6B"><enum>(B)</enum><text display-inline="yes-display-inline">An estimate of the difference between the 100,000 law enforcement officers who received training through the e-learning training course and the number of law enforcement officers who could have received training through the residential classroom method in the same one-year period.</text> </subparagraph> 
<subparagraph id="HC2A1C349F8D04B7E8E91A656A881B6AC"><enum>(C)</enum><text display-inline="yes-display-inline">The effectiveness of the e-learning training course with respect to student-officer performance.</text> </subparagraph> 
<subparagraph id="H079BC10262674290ABBAE6596B1E5CF4"><enum>(D)</enum><text display-inline="yes-display-inline">The convenience accorded to student-officers with respect to their ability to access the e-learning training course at their own convenience and to return to the on-line, e-learning website for refresher training and reference.</text> </subparagraph> 
<subparagraph id="H4F6E82DAB03849909F4C4545576DB52E"><enum>(E)</enum><text display-inline="yes-display-inline">The ability of the on-line, e-learning website to safeguard the student officers’ private and personal information while providing supervisors with appropriate information about student performance and course completion.</text> </subparagraph></paragraph></subsection> 
<subsection id="H46A1C7C054D84EB69B68CFAB0593297D"><enum>(f)</enum><header>Expansion of program</header> 
<paragraph id="H8138FA507EE249B098557E6806A9341"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Following the completion of the demonstration project, the Department of Homeland Security shall continue to make available the on-line, e-learning website and the e-learning training course, enroll in the e-learning training course 100,000 new State, local, and tribal law enforcement officers annually, and consult with Congress regarding the addition, substitution, or removal of participating States.</text> </paragraph> 
<paragraph id="HDE65C9AE5973479589008DBA7EC9D71B"><enum>(2)</enum><header>Limitation on participation</header><text display-inline="yes-display-inline">Officers shall be ineligible to participate in the expansion of this program if they are employed by a State, local, or tribal law enforcement agency that has in effect a statute, policy, or practice that prohibits its law enforcement officers from cooperating with Federal immigration enforcement agents (or if the State, local, or tribal law enforcement agency is otherwise in contravention of section 642(a) of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1373">8 U.S.C. 1373(a)</external-xref>).</text> </paragraph></subsection> 
<subsection id="H5A5B1F0CB1D442E88395F6D6F7AC5F57"><enum>(g)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated $3,000,000 in fiscal year 2008 to carry out this section. Funds appropriated under this subsection shall remain available until expended. There are authorized to be appropriated in each subsequent fiscal year such sums as are necessary to continue to operate, promote, and recruit participants for the demonstration project and expansion program under this section.</text> </subsection></section> 
<section display-inline="no-display-inline" id="H9B42D96DF8BB4518B1755E7B2D8CE900" section-type="subsequent-section"><enum>346.</enum><header>Completion of exit component of US-VISIT entry and exit data system</header><text display-inline="no-display-inline">Not later than two years after the date of the enactment of this Act, the Secretary of Homeland Security shall complete the exit component of the entry and exit data system, (as defined in section 7208(b) of the Intelligence Reform and Terrorism Prevention Act of 2004, <external-xref legal-doc="usc" parsable-cite="usc/8/1365b">8 U.S.C. 1365b(b)</external-xref>, <external-xref legal-doc="public-law" parsable-cite="pl/108/458">Public Law 108–458</external-xref>), commonly referred to as <quote>US-VISIT</quote>, including at all land, sea, and air ports of entry and with respect to nationals from every country.</text> </section> 
<section id="HDEA37DD615FF45B8A17271DDF60091F8"><enum>347.</enum><header>Clarification that wages paid to unauthorized aliens may not be deducted from gross income</header> 
<subsection id="HC9562D6F8B3740B697B08442B6A22F6D"><enum>(a)</enum><header>In general</header><text>Subsection (c) of <external-xref legal-doc="usc" parsable-cite="usc/26/162">section 162</external-xref> of the Internal Revenue Code of 1986 (relating to illegal bribes, kickbacks, and other payments) is amended by adding at the end the following new paragraph:</text> 
<quoted-block display-inline="no-display-inline" id="H56E97562DF1D4F4EAE5400BA624D80BC" style="OLC"> 
<paragraph id="HE4E335291F3141F5B697F9C7ABABF5E0"><enum>(4)</enum><header>Wages paid to or on behalf of unauthorized aliens</header><text></text> 
<subparagraph id="HCFAF23289AEA46988000599651D62B5D"><enum>(A)</enum><header>In general</header><text>No deduction shall be allowed under subsection (a) for any wage paid to or on behalf of an unauthorized alien, as defined under section 274A(h)(3) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1324a">8 U.S.C. 1324a(h)(3)</external-xref>).</text> </subparagraph> 
<subparagraph id="H146FAC1A92F64CD49179E672BFB016BC"><enum>(B)</enum><header>Wages</header><text>For the purposes of this paragraph, the term <quote>wages</quote> means all remuneration for employment, including the cash value of all remuneration (including benefits) paid in any medium other than cash.</text> </subparagraph> 
<subparagraph id="H171A70364E484B9AB78FC004D5840788"><enum>(C)</enum><header>Safe Harbor</header><text display-inline="yes-display-inline">If a person or other entity is participating in the basic pilot program described in section 403 of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1324a">8 U.S.C. 1324a</external-xref> note) and obtains confirmation of identity and employment eligibility in compliance with the terms and conditions of the program with respect to the hiring (or recruitment or referral) of an employee, subparagraph (A) shall not apply with respect to wages paid to such employee.</text> </subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection id="H4BA581BE56E241E0A123432CAD2000F4"><enum>(b)</enum><header>6-year limitation on assessment and collection</header><text>Subsection (c) of section 6501 of such Code (relating to exceptions) is amended by adding at the end the following new paragraph:</text> 
<quoted-block display-inline="no-display-inline" id="HEF874A32D82545088CE6C28482F845B1" style="USC"> 
<paragraph id="H14327D34B5AE4D3EB814B6C69007CCF"><enum>(10)</enum><header>Deduction claimed for wages paid to unauthorized aliens</header><text>In the case of a return of tax on which a deduction is shown in violation of section 162(c)(4), any tax under chapter 1 may be assessed, or a proceeding in court for the collection of such tax may be begun without assessment, at any time within 6 years after the return was filed.</text> </paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection id="H4906E228C8FE44D9905C838900ACB869"><enum>(c)</enum><header>Use of documentation for enforcement purposes</header><text display-inline="yes-display-inline">Section 274A of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 is amended—</text> 
<paragraph id="H9DAFA7B165EB4EE3B6685B30F021BD2C"><enum>(1)</enum><text>in subparagraph (b)(5), by inserting <quote>, <external-xref legal-doc="usc" parsable-cite="usc/26/162">section 162(c)(4)</external-xref> of the Internal Revenue Code of 1986,</quote> after <quote>enforcement of this chapter</quote>;</text> </paragraph> 
<paragraph id="H862A584E99BF43C90080BF5737DF7F"><enum>(2)</enum><text>in subparagraph (d)(2)(F), by inserting <quote>, <external-xref legal-doc="usc" parsable-cite="usc/26/162">section 162(c)(4)</external-xref> of the Internal Revenue Code of 1986,</quote> after <quote>enforcement of this chapter</quote>; and</text> </paragraph> 
<paragraph id="H52F1FD3A6517420A8CFE96BD54A5C9"><enum>(3)</enum><text>in subparagraph (d)(2)(G), by inserting <quote>section 162(c)(4) of the Internal Revenue Code of 1986 or</quote> after <quote>or enforcement of</quote>.</text> </paragraph></subsection> 
<subsection id="H73234DFD8B2B4A32AAEF382ECC44B9BC"><enum>(d)</enum><header>Availability of information</header><text>The Commissioner of Social Security shall make available to the Commissioner of Internal Revenue any information related to the investigation and enforcement of <external-xref legal-doc="usc" parsable-cite="usc/26/162">section 162(c)(4)</external-xref> of the Internal Revenue Code of 1986, including any no-match letter and any information in the suspense earnings file.</text> </subsection> 
<subsection id="H527BA80E5D3B4105BAD2ECD00A2815"><enum>(e)</enum><header>Effective date</header> 
<paragraph id="H6E7665ADC74F4380A7ADA9CF00CE20"><enum>(1)</enum><text>Except as provided in paragraph (2), this Act and the amendments made by this Act shall take effect on the date of the enactment of this Act.</text> </paragraph> 
<paragraph id="HCECD589F0FE9499F9F38675CBE00A865"><enum>(2)</enum><text>The amendments made by subsections (a) and (b) shall apply to taxable years beginning after December 31, 2007.</text> </paragraph></subsection></section></subtitle></title> 
<title id="H24459E0AA7474622981800EBD740FF36"><enum>IV</enum><header>Revision of Federal Reimbursement of Emergency Health Care Services Furnished to Illegal Aliens</header> 
<section id="HE0BCA6FF0FB04D0F8299BA42297864D"><enum>401.</enum><header>Revision of Federal reimbursement of emergency health care services furnished to illegal aliens</header> 
<subsection id="HEE60C1AB93E746B1AF832470C29470BC"><enum>(a)</enum><header>Elimination of funding limitations; extension of appropriations through fiscal year 2011</header><text>Subsection (a) of section 1011 of the Medicare Prescription Drug, Improvement, and Modernization Act of 2003 (<external-xref legal-doc="public-law" parsable-cite="pl/108/173">Public Law 108–173</external-xref>) is amended—<inline-comment display="yes">NOTE: if you strike paragraph (1) and not paragraph (2), then you have two funding instructions for FY 08; isn’t your policy to eliminate all funding for health care services to illegals? Perhaps you should strike all of subsection (a); if you leave paragraph (2), you will continue the funding through FY 13.</inline-comment></text> 
<paragraph commented="no" id="H643D4A9D53104B71B0442B9800E9656"><enum>(1)</enum><text>by striking <quote>for each of fiscal years 2005 through 2008</quote> and inserting <quote>for each of fiscal years 2005 through 2007</quote>; and</text> </paragraph> 
<paragraph commented="no" id="HD907E37C32DA4CF4A8EB9202F4C557F3"><enum>(2)</enum><text>by adding at the end the following: <quote>Out of any funds in the Treasury not otherwise appropriated, there are appropriated to the Secretary for each of fiscal years 2008 through 2013 such sums as may be necessary for the purpose of payments to eligible providers.</quote>.</text> </paragraph></subsection> 
<subsection id="H44817DC44B8C44F595B1D7F6A02F6A7"><enum>(b)</enum><header>Elimination of State allotments</header><text>Such section is further amended—</text> 
<paragraph id="HC020DA37AAC947BCAF31D9967BED9B5F"><enum>(1)</enum><text>in subsection (b), by adding at the end the following new paragraph:</text> 
<quoted-block display-inline="no-display-inline" id="H7781A29B128D4B7AB902F2C04C855727" style="OLC"> 
<paragraph commented="no" id="H3C3208F8BFD341DA8FF35C981E48FD15"><enum>(3)</enum><header>Limitation to fiscal year 2007</header><text>The preceding provisions of this subsection shall only apply to fiscal year 2007.</text> </paragraph><after-quoted-block>;</after-quoted-block></quoted-block> </paragraph> 
<paragraph id="H46484196F008446FAD26AA896CEBE8BA"><enum>(2)</enum><text>by amending subsection (c)(1) to read as follows:</text> 
<quoted-block display-inline="no-display-inline" id="HCB7C3AC756EF45F289A861E3606EA77B" style="OLC"> 
<paragraph id="H73359EEF5A794D82A1D79F84DC00FB46"><enum>(1)</enum><header>Authority to make payments</header><text display-inline="yes-display-inline">The Secretary shall pay directly to eligible providers located in a State for the provision of eligible services to aliens described in paragraph (5) the amount described in paragraph (2) to the extent that the eligible provider was not otherwise reimbursed (through insurance or otherwise) for such services.</text> </paragraph><after-quoted-block>;</after-quoted-block></quoted-block> </paragraph> 
<paragraph commented="no" id="HF3C24CE21A7C42B48B930288B673A6FF"><enum>(3)</enum><text>in subsection (c)(2)(B), by striking <quote>If the amount</quote> and inserting <quote>For fiscal year 2007, if the amount</quote>; and</text> </paragraph>

<subsection id="H77A8C1DA043C430D85B53997A8C891CF"><enum>(c)</enum><header>Requirement for provision of information for hospital qualifications for funding</header><text>Subsection (c) of such section is amended by adding at the end the following new paragraph:</text>

<subparagraph id="H6EC9E87943684F37896B2282253B89BF"><enum>(6)</enum><header>Requirement for payment</header><text display-inline="yes-display-inline">Beginning with fiscal year 2008, payment shall not be made under this section to an eligible provider with respect to services furnished to an alien described in paragraph (5) unless the provider obtains the citizenship information about the alien, and transmits such information and all other non-clinical information concerning the alien to Immigration and Customs Enforcement, not later than 72 hours after the time of discharge of the alien from the provider.</text> </subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </subsection>
