		<official-title>To amend the Individuals with Disabilities Education Act
		  to permit a prevailing party in an action or proceeding brought to enforce the
		  Act to be awarded expert witness fees and certain other
		  expenses.</official-title>

		<section id="HDBCC0E8D852942E49C67C44B1F121397" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>IDEA
			 Fairness Restoration Act</quote>.</text>
		</section><section id="H03566B253A6843CABFE64000C54EADD5"><enum>2.</enum><header>Inclusion of
			 Expert Witness Fees and Other Expenses as Attorneys’ Fees</header>
			<subsection id="H319E00410BF64BEDB5E58BA55B3339A4"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 615(i)(3) of
			 the Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1415">20 U.S.C. 1415(i)(3)</external-xref>) is
			 amended by adding at the end the following new subparagraph:</text>
				<quoted-block display-inline="no-display-inline" id="HF37E70B3F8644FAB8ED3201B716FCE15" style="OLC">
					<subparagraph id="HDC6FCEEBAF2E4A8EBD3BE6341EA60739"><enum>(H)</enum><header>Inclusion of
				Expert Witness Fees and Other Expenses as Attorneys’ Fees</header><text display-inline="yes-display-inline">For the purposes of this paragraph, the
				term <quote>attorneys’ fees</quote> shall include the fees of expert witnesses,
				including the reasonable costs of any test or evaluation necessary for the
				preparation of the parent or guardian’s case in the action or
				proceeding.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H810237B2DAA94C508531E426E000EF31"><enum>(b)</enum><header>Effective
			 Date</header><text>The amendment made by subsection (a) shall apply to any
			 action or proceeding brought under section 615 of the Individuals with
			 Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1415">20 U.S.C. 1415</external-xref>) that has not been finally
			 adjudicated as of the date of the enactment of this Act.</text>
