<official-title>To amend the Higher Education Act of 1965 to prohibit assistance to institutions of higher education located in States that provide in-State tuition or other forms of student financial assistance to illegal aliens.</official-title>

<section id="H2CE4FA6943AB41A481AE198C5881E380" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fairness in Higher Education Act of 2007</short-title></quote>.</text></section> 
<section id="HAD7A9FF1588F4C12BF403E61862E8CCA"><enum>2.</enum><header>Limitation on assistance to institutions</header><text display-inline="no-display-inline">Part B of title I of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1011">20 U.S.C. 1011 et seq.</external-xref>) is amended by adding at the end the following new section:</text>

<section id="H1A7E29E492814D018200CC03AC8EDDF4"><enum>123.</enum><header>Limitation on assistance to institutions</header> 
<subsection id="H1AE0829FDF1D4EA28C2DC3890979B350"><enum>(a)</enum><header>Limitation</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this Act, none of the funds made available under this Act may be provided, under a grant to or contract with an institution of higher education, to an institution that is located in a State that by law expressly authorizes the provision of State student financial assistance to students who are aliens who are not lawfully present in the United States.</text></subsection> 
<subsection id="H56A77E7A51334CAB9279627C85AFD3C4"><enum>(b)</enum><header>Inapplicability to Federal student financial assistance</header><text display-inline="yes-display-inline">The limitation contained in <internal-xref idref="H1AE0829FDF1D4EA28C2DC3890979B350" legis-path="123.(a)">subsection (a)</internal-xref> shall not be construed to prohibit, limit, or otherwise affect the payment of Federal student financial assistance to any student at an institution that is located in a State described in such subsection.</text></subsection> 
<subsection id="H2CE3670796F5426ABA00F3F43893F655"><enum>(c)</enum><header>Definitions</header> 
<paragraph id="H1A127CAE07D847A2BDBA49C5A2E40046"><enum>(1)</enum><header>State student financial assistance</header><text>The term <term>State student financial assistance</term> means any grant, loan, work-study, or other form of financial assistance provided by a State (or agency or instrumentality thereof) to reduce the cost of attendance for a student at an institution of higher education, and includes a reduction in the tuition or fees (or both) for students who reside within that State (as compared to the tuition or fees charged to non-residents of that State).</text></paragraph> 
<paragraph id="HD32BEFD06E294F1EA53608E1F0953F8C"><enum>(2)</enum><header>Federal student financial assistance</header><text display-inline="yes-display-inline">The term <term>Federal student financial assistance</term> means any grant, loan, work-study, or other form of financial assistance provided under this Act to reduce the cost of attendance for a student at an institution of higher education.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </section>
