<enum>I</enum><header>Policy on Redeployment and Conduct of Operations In Iraq</header> <section id="HFD00AA91A347492BB7F6125C2FCA00C6"><enum>101.</enum><text display-inline="yes-display-inline">It is the sense of the Congress that—</text> <paragraph id="H70A456942B0F4941BEE0CDDC8427D59E"><enum>(1)</enum><text>the war in Iraq should end as safely and quickly as possible and our troops should be brought home;</text></paragraph> <paragraph id="H4934ACE26CF144C0AFE77E28FAD889DA"><enum>(2)</enum><text display-inline="yes-display-inline">the performance of United States military personnel in Iraq and Afghanistan should be commended, their courage and sacrifice have been exceptional, and when they come home, their service should be recognized appropriately; and</text></paragraph> <paragraph id="HEDEDA1CBB4AA4EF7848DB37ED456F947"><enum>(3)</enum><text display-inline="yes-display-inline">the primary purpose of funds made available by this Act should be to transition the mission of United States Armed Forces in Iraq and undertake their redeployment, and not to extend or prolong the war.</text></paragraph></section> <section id="H35F3261BAE774383AE446B980000DF96"><enum>102.</enum> <subsection id="H9D7FA21E49A84475A8B0BCAA6CACBCE" display-inline="yes-display-inline"><enum>(a)</enum><text>No person in the custody or under the effective control of the United States Government shall be subject to any treatment or technique of interrogation not authorized by and listed in the United States Army Field Manual FM2–22.3 Human Intelligence Collector Operations.</text></subsection> <subsection id="HB45AEB10170040BA9F40DB535D4C00F4"><enum>(b)</enum><text><internal-xref idref="H9D7FA21E49A84475A8B0BCAA6CACBCE" legis-path="102.(a)">Subsection (a)</internal-xref> shall not apply with respect to any person in the custody or under the effective control of the United States Government pursuant to a criminal law or immigration law of the United States. Nothing in this section shall be construed to affect the rights under the United States Constitution of any person in the custody or under the physical jurisdiction of the United States.</text></subsection></section> <section id="H8DC92F9D052449879760B98C37466426"><enum>103.</enum><text display-inline="yes-display-inline">None of the funds made available in this Act may be used in contravention of the following laws enacted or regulations promulgated to implement the United Nations Convention Against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment (done at New York on December 10, 1984)—</text> <paragraph id="HA3CA9E368F864F5C9384BCA428165004"><enum>(1)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/18/2340A">section 2340A</external-xref> of title 18, United States Code;</text></paragraph> <paragraph id="H56A964A092F242708FC9711890B534BF"><enum>(2)</enum><text>section 2242 of the Foreign Affairs Reform and Restructuring Act of 1998 (division G of <external-xref legal-doc="public-law" parsable-cite="pl/105/277">Public Law 105–277</external-xref>; 112 Stat. 2681–822; <external-xref legal-doc="usc" parsable-cite="usc/8/1231">8 U.S.C. 1231</external-xref> note) and regulations prescribed thereto, including regulations under part 208 of title 8, Code of Federal Regulations, and part 95 of title 22, Code of Federal Regulations; and</text></paragraph> <paragraph id="H2B17CB31CC3F4ECA89B7F831C040EB93"><enum>(3)</enum><text>sections 1002 and 1003 of the Department of Defense, Emergency Supplemental Appropriations to Address Hurricanes in the Gulf of Mexico, and Pandemic Influenza Act, 2006 (<external-xref legal-doc="public-law" parsable-cite="pl/109/148">Public Law 109–148</external-xref>).</text></paragraph></section> <section id="H55749E9CBC2943CE847987D0B0781CB5"><enum>104.</enum> <subsection id="HF13D771F00DD464EA0FFDF8C1E3DAAFE" display-inline="yes-display-inline"><enum>(a)</enum><text>The Congress finds that United States military units should not enter into combat unless they are fully capable of performing their assigned mission. The Congress further finds that this is the policy of the Department of Defense.</text></subsection> <subsection id="HDB8DE96CCEB64B1CB168EADDAD85FA00"><enum>(b)</enum><text>None of the funds appropriated or otherwise made available by this Act may be used to deploy any unit of the Armed Forces to Iraq unless the President has certified in writing to the Committees on Appropriations and the Committees on Armed Services of the Senate and the House of Representatives at least 15 days in advance of the deployment that the unit is <quote>fully mission capable</quote>.</text></subsection> <subsection id="HDFC3D2B4CEA545FDA65DE4C47FE7676B"><enum>(c)</enum><text>For the purposes of <internal-xref idref="HDB8DE96CCEB64B1CB168EADDAD85FA00" legis-path="104.(b)">subsection (b)</internal-xref> the term <term>fully mission capable</term> means capable of performing a unit’s assigned mission to the prescribed standards under the conditions expected in the theater of operation, consistent with the guidelines set forth in the Department of Defense’s Defense Readiness Reporting System.</text></subsection> <subsection id="H18C910A6D7414696A407B9E823CC9690"><enum>(d)</enum><text>The President, by certifying in writing to the Committees on Appropriations and the Committees on Armed Services of the Senate and the House of Representatives that the deployment to Iraq of a unit that is not assessed fully mission capable is required for reasons of national security and by submitting along with a certification a report in classified and unclassified form detailing the particular reason or reasons why the unit’s deployment is necessary, may waive the limitations prescribed in <internal-xref idref="HDB8DE96CCEB64B1CB168EADDAD85FA00" legis-path="104.(b)">subsection (b)</internal-xref> on a unit-by-unit basis.</text></subsection></section> <section id="H40C75A9700974DBDAA2949914FAF4C97"><enum>105.</enum> <subsection id="H008C738A848F40C08EA9D93961782FB7" display-inline="yes-display-inline"><enum>(a)</enum><text>Notwithstanding any other provision of law, funds appropriated or otherwise made available by this Act are available immediately for obligation to plan and execute a safe and orderly redeployment of United States Armed Forces from Iraq.</text></subsection> <subsection id="HA0798BD9E0B347C3AA6E49F28F96D7"><enum>(b)</enum><text display-inline="yes-display-inline">Within 30 days after enactment of this Act, the President shall commence an immediate and orderly redeployment of United States Armed Forces from Iraq, which shall be implemented as part of the comprehensive regional stability plan described in <internal-xref idref="HB9C7259559804034981E53E1486F8B70" legis-path="105.(g)">subsection (g)</internal-xref>. The President shall endeavor to begin such redeployment with units of the Armed Forces that have been deployed in excess of 365 days, except to the extent those units are needed to provide for the safe withdrawal of other units of the Armed Forces or to protect United States and Coalition personnel and infrastructure.</text></subsection> <subsection id="HCAC29D82BB294B0BA8D2EDE20009E496"><enum>(c)</enum><text display-inline="yes-display-inline">The reduction in United States Armed Forces required by this section shall be implemented in conjunction with a comprehensive diplomatic, political and economic strategy that includes sustained engagement with Iraq’s neighbors and the international community for the purpose of working collectively to bring stability to Iraq.</text></subsection> <subsection id="H93223A76F4A843C9B763B668AC6C05C6"><enum>(d)</enum><text>The goal for the completion of the transition of United States Armed Forces to a limited presence and missions as described in <internal-xref idref="H795E764F585F488E811245BECDBC3800" legis-path="105.(e)">subsection (e)</internal-xref> shall be a date that is not later than December 15, 2008.</text></subsection> <subsection id="H795E764F585F488E811245BECDBC3800"><enum>(e)</enum><text>After the conclusion of the reduction and transition of United States Armed Forces to a limited presence as required by this section, the Secretary of Defense may deploy or maintain members of the Armed Forces in Iraq only for the following missions:</text> <paragraph id="H002CCE575F154A989EECCDBC708B2467"><enum>(1)</enum><text display-inline="yes-display-inline">Protecting United States diplomatic facilities, United States Armed Forces, and American citizens.</text></paragraph> <paragraph id="H3F9EE8244FB94D24BFBFF3CE9233F618"><enum>(2)</enum><text>Conducting limited training, equipping, and providing logistical and intelligence support to the Iraqi Security forces.</text></paragraph> <paragraph id="HA590A281DD9B476199997FB88E9B11F3"><enum>(3)</enum><text>Engaging in targeted counterterrorism operations against al-Qaeda, al-Qaeda affiliated groups, and other terrorist organizations in Iraq. </text></paragraph></subsection> <subsection id="H621EE8556ACA496ABB8C5CF638848BDF"><enum>(f)</enum><text>Not later than February 1, 2008, and every 90 days thereafter, the Secretary of Defense shall submit to the congressional defense committees a report setting forth the following:</text> <paragraph id="H86632ABE4DF8422CA69746CED5FAFA3B"><enum>(1)</enum><text display-inline="yes-display-inline">The current plan for and the status of the reduction of United States Armed Forces in Iraq and the transition of the Armed Forces in Iraq to a limited presence whose missions do not exceed the missions specified in <internal-xref idref="H795E764F585F488E811245BECDBC3800" legis-path="105.(e)">subsection (e)</internal-xref>, including the associated force reductions and adjustments and expectations with respect to timelines and the force levels anticipated to perform those missions.</text></paragraph> <paragraph id="HAAB1DD006D8C475CA1401FF9972E6674"><enum>(2)</enum><text>A comprehensive current description of efforts to prepare for the reduction and transition of United States Armed Forces in Iraq in accordance with this section and to limit any destabilizing consequences of such reduction and transition, including a description of efforts to work with the United Nations and countries in the region toward that objective.</text></paragraph></subsection> <subsection id="HB9C7259559804034981E53E1486F8B70"><enum>(g)</enum><text display-inline="yes-display-inline">Not later than February 15, 2008, the President shall submit to the Congress in classified and unclassified form a comprehensive regional stability plan for the Middle East, which shall include a military, diplomatic, political and economic strategy that provides for the national security interests of the United States in the region and for the engagement of targeted counterterrorism operations. The plan shall include a detailed description of the projected United States military force presence in and around the Middle East region for the 5-year period beginning on October 1, 2008.</text></subsection></section> <section id="H5994C88E4F7B43AC8BACD21F003E0976"><enum>106.</enum><text display-inline="yes-display-inline">The amounts appropriated by this Act are sufficient to fully meet the immediate needs of the United States Armed Forces deployed to Iraq. Congressional consideration of additional funding shall be deferred until the first report required by <internal-xref idref="H621EE8556ACA496ABB8C5CF638848BDF" legis-path="105.(f)">section 105(f)</internal-xref> is submitted to the Congress.</text></section>

Provisions</header></appropriations-major> <section id="H174787B8DBEE4909AA437590A811957F"><enum>201.</enum><text display-inline="yes-display-inline">Appropriations provided in this Act are available for obligation until September 30, 2008, unless otherwise provided in this Act.</text></section><appropriations-small id="HF8B67DC3C03B46B29473DBB9F5BE34A6"><header>(transfer of funds)</header></appropriations-small> <section id="HA7D9F307129540C1B6C278F5811F7580"><enum>202.</enum> <subsection id="HF6E84600122F47D78892E5420361E2AE" display-inline="yes-display-inline"><enum>(a)</enum><text>Upon a determination by the Secretary of Defense that such action is necessary in the national interest, the Secretary may transfer between appropriations up to $4,000,000,000 of the funds made available to the Department of Defense in this Act. </text></subsection> <subsection id="H0BCE6A4D590241EBA1D52794D5AF702F"><enum>(b)</enum><text display-inline="yes-display-inline">The Secretary shall notify the Congress promptly of each transfer made pursuant to the authority in this section.</text></subsection> <subsection id="H2BAF36AE60414F44B46C1329A4DF040"><enum>(c)</enum><text>The authority provided in this section is in addition to any other transfer authority available to the Department of Defense and is subject to the same terms and conditions as the authority provided in section 8005 of the Department of Defense Appropriations Act, 2008, except for the fourth proviso.</text></subsection></section> <section id="HC42F880A012D4E0C90C83069BE4CC3ED"><enum>203.</enum><text display-inline="yes-display-inline">Funds appropriated in this Act, or made available by the transfer of funds in or pursuant to this Act, for intelligence activities are deemed to be specifically authorized by the Congress for purposes of section 504(a)(1) of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/414">50 U.S.C. 414(a)(1)</external-xref>).</text></section> <section id="H6BD30000069343F491C4547FB2D17D4E"><enum>204.</enum><text display-inline="yes-display-inline">None of the funds provided in this Act may be used to finance programs or activities denied by the Congress in fiscal years 2007 or 2008 appropriations to the Department of Defense or to initiate a procurement or research, development, test and evaluation new start program unless such program or project must be undertaken immediately in the interest of national security and after written prior notification to the congressional defense committees.</text></section> <section id="H6BD977C5254844D2B0B935DEBF79956"><enum>205.</enum> <subsection id="H5C994A75C14444A89C174F787C57E98F" display-inline="yes-display-inline"><enum>(a)</enum><text>From funds made available for operation and maintenance in this Act to the Department of Defense, not to exceed $500,000,000 may be used, notwithstanding any other provision of law, to fund the Commander’s Emergency Response Program, for the purpose of enabling military commanders in Iraq and Afghanistan to respond to urgent humanitarian relief and reconstruction requirements within their areas of responsibility by carrying out programs that will immediately assist the Iraqi and Afghan people.</text></subsection> <subsection id="HF728D4BC23AA40F19646023E7B092E85"><enum>(b)</enum><text>Not later than 15 days after the end of each fiscal year quarter, the Secretary of Defense shall submit to the congressional defense committees a report regarding the source of funds and the allocation and use of funds during that quarter that were made available pursuant to the authority provided in this section or under any other provision of law for the purposes of the programs under <internal-xref idref="H5C994A75C14444A89C174F787C57E98F" legis-path="205.(a)">subsection (a)</internal-xref>.</text></subsection></section> <section id="HA5D3DEE736094205A1867B4EDB2E1510"><enum>206.</enum> <subsection id="H9E5425599CBF42328BDB557F01DBA097" display-inline="yes-display-inline"><enum>(a)</enum><text>During fiscal year 2008, funds available in this Act to the Department of Defense for operation and maintenance may be used, notwithstanding any other provision of law, to provide supplies, services, transportation, including airlift and sealift, and other logistical support to Coalition forces supporting military and stability operations in Iraq and Afghanistan.</text></subsection> <subsection id="H4BCB4BFE03884A7DA5C48F8ED22837D"><enum>(b)</enum><text display-inline="yes-display-inline">The Secretary of Defense shall provide quarterly reports to the congressional defense committees regarding support provided under this section.</text></subsection></section> <section id="HA64880A86E464969BD5EF0EFFCC64B8"><enum>207.</enum> <subsection id="HEF95F3F3D635489EB7A8A96C3BE61F05" display-inline="yes-display-inline"><enum>(a)</enum><text>Supervision and administration costs associated with a construction project funded with appropriations available for operation and maintenance, Afghanistan Security Forces Fund, or Iraq Security Forces Fund, and executed in direct support of the Global War on Terror only in Iraq and Afghanistan, may be obligated at the time a construction contract is awarded.</text></subsection> <subsection id="HCDB4F7B6D8864739AAEC99B994828BBF"><enum>(b)</enum><text display-inline="yes-display-inline">For purposes of this section, the term <term>supervision and administration costs</term> includes all in-house Government costs.</text></subsection></section> <section id="HA6876B25DA844B93B47BE4001723C4D4"><enum>208.</enum><text display-inline="yes-display-inline">Each amount appropriated or otherwise provided in this Act is designated as an emergency requirement and necessary to meet emergency needs pursuant to subsections (a) and (b) of section 204 of S. Con. Res. 21 (110th Congress), the concurrent resolution on the budget for fiscal year 2008.</text></section> <section id="H5FDFA72C21BC44C0B1AB9C02C69C4F6F"><enum>209.</enum> <subsection id="H0826C66369D54711B3009B3090D7CD24" display-inline="yes-display-inline"><enum>(a)</enum><text>Not later than January 15, 2008 and every 90 days thereafter through the end of fiscal year 2008, the Secretary of Defense shall set forth in a report to the Congress a comprehensive set of performance indicators and measures for progress toward military and political stability in Iraq.</text></subsection> <subsection id="H4090871B5A014EECA75BCE2D5E22005F"><enum>(b)</enum><text>The report shall include performance standards and goals for security, economic, and security force training objectives in Iraq, together with a notional timetable for achieving these goals.</text></subsection> <subsection id="H09EC1354E8E14C64A303A70042E562FB"><enum>(c)</enum><text>The report shall include, at a minimum, the following specific provisions:</text> <paragraph id="H094E667A7B544168BBFA06F44528C9CC"><enum>(1)</enum><text>With respect to stability and security in Iraq, the following:</text> <subparagraph id="HC0F30BABC091468FAF110037117660F4"><enum>(A)</enum><text>Key measures of political stability, including the important political milestones that must be achieved over the next several years.</text></subparagraph> <subparagraph id="HE5D74D326CF44492A1F16CF2BC04E8F"><enum>(B)</enum><text>The primary indicators of a stable security environment in Iraq, such as number of engagements per day, numbers of trained Iraqi forces, trends relating to numbers and types of ethnic and religious-based hostile encounters, and progress made in the transition to Provincial Iraqi Control (PIC).</text></subparagraph> <subparagraph id="H571D9C88731349C981E9EC50A01DDE"><enum>(C)</enum><text>An assessment of the estimated strength of the insurgency in Iraq and the extent to which it is composed of non-Iraqi fighters.</text></subparagraph> <subparagraph id="HD6030E8411CA4790AED71DABFAB5E11F"><enum>(D)</enum><text>A description of all militias operating in Iraq, including the number, size, equipment strength, military effectiveness, sources of support, legal status, and efforts to disarm or reintegrate each militia.</text></subparagraph> <subparagraph id="H99C93DA05D3F4EA7A885BD3370BDFAFC"><enum>(E)</enum><text>Key indicators of economic activity that should be considered the most important for determining the prospects of stability in Iraq, including—</text> <clause id="H18DFA84305224794BC16F19069EF1C7B"><enum>(i)</enum><text>unemployment levels;</text></clause> <clause id="HE6F91763E10F41F1AAD3C90137E031FC"><enum>(ii)</enum><text>electricity, water, and oil production rates; and</text></clause> <clause id="HE955022EA88A4F03B52B883EDB1E3800"><enum>(iii)</enum><text>hunger and poverty levels.</text></clause></subparagraph> <subparagraph id="H6CE93B541C4440A7B73F006E1D9C5C00"><enum>(F)</enum><text>The criteria the Administration will use to determine when it is safe to begin withdrawing United States forces from Iraq.</text></subparagraph></paragraph> <paragraph id="H2F063E380FD84D278641CB6770BBE642"><enum>(2)</enum><text>With respect to the training and performance of security forces in Iraq, the following:</text> <subparagraph id="H8455FA961D394E99880600AD8B829074"><enum>(A)</enum><text>The training provided Iraqi military and other Ministry of Defense forces and the equipment used by such forces.</text></subparagraph> <subparagraph id="H20ED9F2452EF4458B5C481E8BA7D28C4"><enum>(B)</enum><text>Key criteria for assessing the capabilities and readiness of the Iraqi military and other Ministry of Defense forces, goals for achieving certain capability and readiness levels (as well as for recruiting, training, and equipping these forces), and the milestones and notional timetable for achieving these goals.</text></subparagraph> <subparagraph id="HF60DECA2460444A7A48FAF33F523E3AA"><enum>(C)</enum><text>The operational readiness status of the Iraqi military forces, including the type, number, size, and organizational structure of Iraqi battalions that are—</text> <clause id="H695559528CEE4F6E86362C00C0B2DAAF"><enum>(i)</enum><text>capable of conducting counterinsurgency operations independently, without any support from Coalition forces;</text></clause> <clause id="H2E247B7D8FEE4FACB0DE63457CBA8D57"><enum>(ii)</enum><text>capable of conducting counterinsurgency operations with the support of United States or Coalition forces; or</text></clause> <clause id="H5B41D7DC588746ACB1C2EA57745CF9A4"><enum>(iii)</enum><text>not ready to conduct counterinsurgency operations.</text></clause></subparagraph> <subparagraph id="H85E8D9372E24493BB34248534FF07FF0"><enum>(D)</enum><text>The amount and type of support provided by Coalition forces to the Iraqi Security forces at each level of operational readiness.</text></subparagraph> <subparagraph id="H4D6FA151108D40BBA9743365E5D251DE"><enum>(E)</enum><text>The number of Iraqi battalions in the Iraqi Army currently conducting operations and the type of operations being conducted.</text></subparagraph> <subparagraph id="H71E0FB467B8147738499D300E220C935"><enum>(F)</enum><text>The rates of absenteeism in the Iraqi military forces and the extent to which insurgents have infiltrated such forces.</text></subparagraph> <subparagraph id="H8EB09E1544C7402F9119C4CBAD07E3DB"><enum>(G)</enum><text>The training provided Iraqi police and other Ministry of Interior forces and the equipment used by such forces.</text></subparagraph> <subparagraph id="HEC24D49502454D4EBD21CDA9F4E3F42"><enum>(H)</enum><text>Key criteria for assessing the capabilities and readiness of the Iraqi police and other Ministry of Interior forces, goals for achieving certain capability and readiness levels (as well as for recruiting, training, and equipping), and the milestones and notional timetable for achieving these goals, including—</text> <clause id="H71A995321D494541A7005422BC1F9462"><enum>(i)</enum><text>the number of police recruits that have received classroom training and the duration of such instruction;</text></clause> <clause id="H759E6C76F80D47D88003EBBF67AD4E83"><enum>(ii)</enum><text>the number of veteran police officers who have received classroom instruction and the duration of such instruction;</text></clause> <clause id="HCE044DED79FB42319195A979E25904A2"><enum>(iii)</enum><text>the number of police candidates screened by the Iraqi Police Screening Service, the number of candidates derived from other entry procedures, and the success rates of those groups of candidates;</text></clause> <clause id="H8623C62FA78B4385AD4772352503499B"><enum>(iv)</enum><text>the number of Iraqi police forces who have received field training by international police trainers and the duration of such instruction;</text></clause> <clause id="HCD825C65FCFF4B0C82B6CF3915E3F2FD"><enum>(v)</enum><text>attrition rates and measures of absenteeism and infiltration by insurgents; and</text></clause> <clause id="H85E84E13DECF4B568030007067D83666"><enum>(vi)</enum><text>the level and effectiveness of the Iraqi Police and other Ministry of Interior forces in provinces where the United States has formally transferred responsibility for the security of the province to the Iraqi Security forces under the Provincial Iraqi Control (PIC) process.</text></clause></subparagraph> <subparagraph id="H7EBCEE76606A497BBBAD347F9D44F315"><enum>(I)</enum><text>The estimated total number of Iraqi battalions needed for the Iraqi Security forces to perform duties now being undertaken by Coalition forces, including defending the borders of Iraq and providing adequate levels of law and order throughout Iraq.</text></subparagraph> <subparagraph id="HAF71F268EA0B44CD00C8EB85FF43B3C"><enum>(J)</enum><text>The effectiveness of the Iraqi military and police officer cadres and the chain of command.</text></subparagraph> <subparagraph id="HC8FE58CB760A47CB953E6CDEAE0674EF"><enum>(K)</enum><text>The number of United States and Coalition advisors needed to support the Iraqi Security forces and associated ministries.</text></subparagraph> <subparagraph id="H8E55D5B1C86A4E73B4A47FD400008B86"><enum>(L)</enum><text>An assessment, in a classified annex if necessary, of United States military requirements, including planned force rotations, through the end of calendar year 2008.</text></subparagraph></paragraph></subsection></section> <section id="H823055FB8CDA4AC787BC6EAF4F78628"><enum>210.</enum><text display-inline="yes-display-inline">None of the funds appropriated or otherwise made available by this or any other Act shall be obligated or expended by the United States Government for a purpose as follows:</text> <paragraph id="H1D6A4E30BBA145A58191DEE8DC752D80"><enum>(1)</enum><text>To establish any military installation or base for the purpose of providing for the permanent stationing of United States Armed Forces in Iraq.</text></paragraph> <paragraph id="HDD9B0405CBC4478F81D299908D027D39"><enum>(2)</enum><text>To exercise United States control over any oil resource of Iraq.</text></paragraph></section> <section id="H57C366D2F979411A8495C707B796A9F"><enum>211.</enum><text display-inline="yes-display-inline">None of the funds appropriated or otherwise made available by this Act may be obligated or expended to provide award fees to any defense contractor contrary to the provisions of section 814 of the John Warner National Defense Authorization Act for Fiscal Year 2007 (<external-xref legal-doc="public-law" parsable-cite="pl/109/364">Public Law 109–364</external-xref>).</text></section> <section id="H5CEA7A4EE3B149A8ABB9D9E14BCEB69E"><enum>212.</enum><text display-inline="yes-display-inline">During the current fiscal year, appropriations made available to the Department of Defense for operation and maintenance in this Act may, upon determination by the Secretary of Defense that such action is necessary to meet the operational requirements of a Commander of Combatant Command engaged in contingency operations overseas, be used to purchase items having an investment item cost of not more than $500,000.</text></section> <section id="H8ED0203A066B4E80AB8BD9DB9BDE0012"><enum>213.</enum><text display-inline="yes-display-inline">Section 3303(c) of <external-xref legal-doc="public-law" parsable-cite="pl/110/28">Public Law 110–28</external-xref> shall apply to funds appropriated in this Act.</text></section> <section section-type="undesignated-section" display-inline="no-display-inline" id="H3AA9B4BC43F348D6AD81C38F063700B"><text display-inline="yes-display-inline">This Act may be cited as the <quote><short-title>Orderly and Responsible Iraq Redeployment Appropriations Act, 2008</short-title></quote>.</text></section>
