		<official-title>To amend title XVIII of the Social Security Act to impose
		  minimum nurse staffing ratios in Medicare participating hospitals, and for
		  other purposes.</official-title>

		<section display-inline="no-display-inline" id="H041E0BCCA8F44CF0A4DED401CE7605BF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Registered Nurse Safe Staffing Act of
			 2007</short-title></quote>.</text>
		</section><section id="HD68087335CE649DAABF2D97B63A57932"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress makes the following
			 findings:</text>
			<paragraph id="HD1D18DB84B0F425CB3396F16C109D482"><enum>(1)</enum><text>There are
			 hospitals throughout the United States that have inadequate staffing of
			 registered nurses to protect the well-being and health of the patients.</text>
			</paragraph><paragraph id="H823B02E3A4194083B6042CC591D6F9A9"><enum>(2)</enum><text>Studies show that
			 the health of patients in hospitals is directly proportionate to the number of
			 registered nurses working in the hospital.</text>
			</paragraph><paragraph id="H360A2232F5AE41D1925458F100DF3333"><enum>(3)</enum><text>There is a
			 critical shortage of registered nurses in the United States.</text>
			</paragraph><paragraph id="H657CDF05CD4843FE9B696F2F8F5311D8"><enum>(4)</enum><text>The effect of that
			 shortage is revealed in unsafe staffing levels in hospitals.</text>
			</paragraph><paragraph id="H7095EF2FEF9743DC8F1B2B3B14515723"><enum>(5)</enum><text>Patient safety is
			 adversely affected by these unsafe staffing levels, creating a public health
			 crisis.</text>
			</paragraph><paragraph id="HE8938327A2DA41EBB9CF59FA42766970"><enum>(6)</enum><text>Registered nurses
			 are being required to perform professional services under conditions that do
			 not support quality health care or a healthful work environment for registered
			 nurses.</text>
			</paragraph><paragraph id="HCEA891003AA14A7BB112DFBE8341EB57"><enum>(7)</enum><text>As a payer for
			 inpatient and outpatient hospital services for individuals entitled to benefits
			 under the program established under title XVIII of the
			 <act-name parsable-cite="SSA">Social Security Act</act-name>, the Federal
			 Government has a compelling interest in promoting the safety of such
			 individuals by requiring any hospital participating in such program to
			 establish minimum safe staffing levels for registered nurses.</text>
			</paragraph></section><section id="H92AED8D311434D34A4356E5958384C8B"><enum>3.</enum><header>Establishment of
			 minimum staffing ratios by medicare participating hospitals</header>
			<subsection id="H78E73E5A849645F6AB09824D9F328745"><enum>(a)</enum><header>Requirement of
			 Medicare provider agreement</header><text>Section 1866(a)(1) of the
			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.
			 1395cc(a)(1)) is amended—</text>
				<paragraph id="H963B125553ED49DCA9A33D2F64C46B"><enum>(1)</enum><text>by
			 striking <quote>and</quote> at the end of subparagraph (U);</text>
				</paragraph><paragraph id="H8DC034C7F79642138D5E94CE662C3910"><enum>(2)</enum><text>by striking the
			 period at the end of subparagraph (V) and inserting <quote>, and</quote>;
			 and</text>
				</paragraph><paragraph id="H2E7B92519E304E588019852D5B3E8E68"><enum>(3)</enum><text>by inserting after
			 subparagraph (V) and before the end matter the following:</text>
					<quoted-block id="HCB69B163DA90485180C400914B00CE39">
						<subparagraph id="HF5D2FE3B3E1E46EC830000A9C0BBA4C6"><enum>(W)</enum><text>in the case of a
				hospital—</text>
							<clause id="HE3065006644D4E8C9B3F5FE8EB7F5412"><enum>(i)</enum><text>to
				adopt and implement a staffing system that meets the requirements of section
				1898;</text>
							</clause><clause id="HFE4D98E6B1964FA595940159EBD10100"><enum>(ii)</enum><text>to meet the
				requirements of such section relating to—</text>
								<subclause id="HC1DBACC765EA49450046428D11BCB370"><enum>(I)</enum><text>records
				maintenance;</text>
								</subclause><subclause id="H3A7937F04EBE4473BBBA261E2F62BEB8"><enum>(II)</enum><text>data collection;
				and</text>
								</subclause><subclause id="HE2F9A0E72B034090AA8E0074D744DC44"><enum>(III)</enum><text>data submission;
				and</text>
								</subclause></clause><clause id="HD870EF9634BD4AD0A674B47DD4115730"><enum>(iii)</enum><text>to meet the
				requirements of such section relating to non-discrimination and
				retaliation.</text>
							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HC68E79D0D6C146AF9C16A1F4E2ECDE8"><enum>(b)</enum><header>Requirements</header><text>Title
			 XVIII of the <act-name parsable-cite="SSA">Social Security Act</act-name> (42
			 U.S.C. 1395 et seq.) is amended by adding at the end the following:</text>
				<quoted-block act-name="Social Security Act" id="H267E2A0D24C84664BA3CED00C5D43B5E" other-style="archaic" style="traditional"><section id="HCA25401D57234410B1C4B6293EE700E"><enum>1898.</enum><header>Staffing requirements for Medicare
		  participating hospitals</header><subsection commented="no" display-inline="yes-display-inline" id="H0EF0B9D5C8DA4EB6BF4345166D00CCD5"><enum>(a)</enum><header>Establishment of
				staffing system</header><text>Each participating hospital shall adopt and
				implement a staffing system that ensures a number of registered nurses on each
				shift and in each unit of the hospital to ensure appropriate staffing levels
				for patient care. A staffing system adopted and implemented under this section
				shall—</text>
							<paragraph id="H1FE4728650A0418F8F4C48EFC66DA857"><enum>(1)</enum><text>be developed on
				the basis of input from the direct care-giving registered nurse staff or, where
				nurses are represented, with the applicable recognized or certified collective
				bargaining representatives of the registered nurses;</text>
							</paragraph><paragraph id="HA4FCE667A578491DA0CFCF0024BB7E4"><enum>(2)</enum><text>be based upon the
				number of patients and the level and variability of intensity of care to be
				provided, with appropriate consideration given to admissions, discharges and
				transfers during each shift;</text>
							</paragraph><paragraph id="H4FA1D7AD953E47CABAC96C316F35A300"><enum>(3)</enum><text>account for
				contextual issues affecting staffing and the delivery of care, including
				architecture and geography of the environment and available technology;</text>
							</paragraph><paragraph id="H08B1ACF55F814A689358C242009BBFD6"><enum>(4)</enum><text>reflect the level
				of preparation and experience of those providing care;</text>
							</paragraph><paragraph id="HC61D8CDF722B445F804537D20026CEDC"><enum>(5)</enum><text>account for
				staffing level effectiveness or deficiencies in related health care
				classifications, including but not limited to, certified nurse assistants,
				licensed vocational nurses, licensed psychiatric technicians, nursing
				assistants, aides and orderlies;</text>
							</paragraph><paragraph id="H271B4771AE2F45DABFCEAFBAC157E87C"><enum>(6)</enum><text>reflect staffing
				levels recommended by specialty nursing organizations;</text>
							</paragraph><paragraph id="HAED97020A1574C569BDFF566055DDA21"><enum>(7)</enum><text>subject to
				subsection (b), establish upwardly adjustable registered nurse-to-patient
				ratios based upon registered nurses’ assessment of patient acuity and existing
				conditions;</text>
							</paragraph><paragraph id="H534627F0743F4492986597AC19F23EA"><enum>(8)</enum><text>provide that a
				registered nurse shall not be assigned to work in a particular unit without
				first having established the ability to provide professional care in such unit;
				and</text>
							</paragraph><paragraph id="HA3FB2956CA7541A4A9EC00751981D6FA"><enum>(9)</enum><text>be based on
				methods that assure validity and reliability.</text>
							</paragraph></subsection><subsection id="H14DD9E97C29C402EAF414871EB3D89C5"><enum>(b)</enum><header>Limitation</header><text>A
				staffing system adopted and implemented pursuant to subsection (a) may
				not—</text>
							<paragraph id="HFFE9E448749D455BBA34D091D0885EE"><enum>(1)</enum><text>set
				registered-nurse levels below those required by any Federal or State law or
				regulation; or</text>
							</paragraph><paragraph id="HA3C35474E4DA4974B3DDE3150404F464"><enum>(2)</enum><text>utilize any
				minimum registered nurse-to-patient ratio established pursuant to subsection
				(a)(7) as an upper limit on the staffing of the hospital to which such ratio
				applies.</text>
							</paragraph></subsection><subsection id="H82A723AC698F484C9CA484F9CCE800C9"><enum>(c)</enum><header>Reporting, and
				release to public, of certain staffing information</header>
							<paragraph id="H9135F4CDE22B4EFA8079D138384CDA01"><enum>(1)</enum><header>Requirements for
				hospitals</header><text>Each participating hospital shall—</text>
								<subparagraph id="HC9EC1DCB78B548D893380000DEF58EC5"><enum>(A)</enum><text>post daily for
				each shift, in a clearly visible place, a document that specifies in a uniform
				manner (as prescribed by the Secretary) the current number of licensed and
				unlicensed nursing staff directly responsible for patient care in each unit of
				the hospital, identifying specifically the number of registered nurses;</text>
								</subparagraph><subparagraph id="H13871DA628B94321B188CC766FD996A4"><enum>(B)</enum><text>upon request, make
				available to the public—</text>
									<clause id="H0B7DD48C92F04384AAD28C1EF26872C3"><enum>(i)</enum><text>the nursing staff
				information described in subparagraph (A); and</text>
									</clause><clause id="H56AAA8180BE0436DB8E646D1AB8BDBBF"><enum>(ii)</enum><text>a
				detailed written description of the staffing system established by the hospital
				pursuant to subsection (a); and</text>
									</clause></subparagraph><subparagraph id="H93C92C42A450412DBB2FB485E8EFC6FF"><enum>(C)</enum><text>submit to the
				Secretary in a uniform manner (as prescribed by the Secretary) the nursing
				staff information described in subparagraph (A) through electronic data
				submission not less frequently than quarterly.</text>
								</subparagraph></paragraph><paragraph id="H278D667B53474BC485480580465202B8"><enum>(2)</enum><header>Secretarial
				responsibilities</header><text>The Secretary shall—</text>
								<subparagraph id="H422D13F8522749DAABB3D32878E2B2C4"><enum>(A)</enum><text>make the
				information submitted pursuant to paragraph (1)(C) publicly available,
				including by publication of such information on the Internet site of the
				Department of Health and Human Services; and</text>
								</subparagraph><subparagraph id="HCFE17FD2F09F44BB87AF06AFF5DA9CD4"><enum>(B)</enum><text>provide for the
				auditing of such information for accuracy as a part of the process of
				determining whether an institution is a hospital for purposes of this
				title.</text>
								</subparagraph></paragraph></subsection><subsection id="HD231F73BCCEA4AE38BF4583B7C4993EA"><enum>(d)</enum><header>Record-keeping;
				data collection; evaluation</header>
							<paragraph id="HB8B88A298698424E96BF38F100217719"><enum>(1)</enum><header>Record-keeping</header><text>Each
				participating hospital shall maintain for a period of at least 3 years (or, if
				longer, until the conclusion of pending enforcement activities) such records as
				the Secretary deems necessary to determine to whether the hospital has adopted
				and implemented a staffing system pursuant to subsection (a).</text>
							</paragraph><paragraph id="H9CF4CFE2B4D64502B75500F9AE23856F"><enum>(2)</enum><header>Data collection
				on certain outcomes</header><text>The Secretary shall require the collection,
				maintenance, and submission of data by each participating hospital sufficient
				to establish the link between the staffing system established pursuant to
				subsection (a) and—</text>
								<subparagraph id="H4798410808414125B7385437464DC609"><enum>(A)</enum><text>patient acuity
				from maintenance of acuity data through entries on patients’ charts;</text>
								</subparagraph><subparagraph id="H0FE23EFFBF404228836BC8C3ADD361A4"><enum>(B)</enum><text>patient outcomes
				that are nursing sensitive, such as patient falls, adverse drug events,
				injuries to patients, skin breakdown, pneumonia, infection rates, upper
				gastrointestinal bleeding, shock, cardiac arrest, length of stay, and patient
				re-admissions;</text>
								</subparagraph><subparagraph id="H7521B541C0D349B2BD37C5E87E25A626"><enum>(C)</enum><text>operational
				outcomes, such as work-related injury or illness, vacancy and turnover rates,
				nursing care hours per patient day, on-call use, overtime rates, and
				needle-stick injuries; and</text>
								</subparagraph><subparagraph id="H5C5A246C0C084E6399248B098BD89B48"><enum>(D)</enum><text>patient complaints
				related to staffing levels.</text>
								</subparagraph></paragraph><paragraph id="H78D89B67E8894007BF47E01755B3E6A9"><enum>(3)</enum><header>Evaluation</header><text>Each
				participating hospital shall annually evaluate its staffing system and
				established minimum registered nurse staffing ratios to assure on-going
				reliability and validity of the system and ratios. The evaluation shall be
				conducted by a joint management-staff committee comprised of at least 50
				percent of registered nurses who provide direct patient care and where nurses
				are represented, with the involvement of the applicable recognized or certified
				collective bargaining representatives of the registered nurses.</text>
							</paragraph></subsection><subsection id="H0BC733024A2047FFA9707F49A26F9DC1"><enum>(e)</enum><header>Enforcement</header>
							<paragraph id="HFAECDEAB3E644E15B214875F0014E695"><enum>(1)</enum><header>Responsibility</header><text>The
				Secretary shall enforce the requirements and prohibitions of this
				section.</text>
							</paragraph><paragraph id="H2E4B80A37D48439AA87E7C95C1D764FB"><enum>(2)</enum><header>Procedures for
				receiving and investigating complaints</header><text>The Secretary shall
				establish procedures under which—</text>
								<subparagraph id="H0853BA7D21AE4318A80623E5B7299639"><enum>(A)</enum><text>any person may
				file a complaint that a participating hospital has violated a requirement or a
				prohibition of this section; and</text>
								</subparagraph><subparagraph id="HBDFF7E61B534448986F9DAB2D51DC08B"><enum>(B)</enum><text>such complaints
				are investigated by the Secretary.</text>
								</subparagraph></paragraph><paragraph id="H1F61BAAA06C2412B849E1625BFBBC6AB"><enum>(3)</enum><header>Remedies</header><text>If
				the Secretary determines that a participating hospital has violated a
				requirement of this section, the Secretary—</text>
								<subparagraph id="H2A3816A624D9473A87432E14ADA88E94"><enum>(A)</enum><text>shall require the
				facility to establish a corrective action plan to prevent the recurrence of
				such violation; and</text>
								</subparagraph><subparagraph id="H8491ADAA4D75467E0000DECA324DE0F"><enum>(B)</enum><text>may impose civil
				money penalties under paragraph (4).</text>
								</subparagraph></paragraph><paragraph id="HC6C3E48DAD2D4B4EB04BD94346DB00B6"><enum>(4)</enum><header>Civil money
				penalties</header>
								<subparagraph id="H6DE9AF6A5545490CB0A0C408790032CA"><enum>(A)</enum><header>In
				general</header><text>In addition to any other penalties prescribed by law, the
				Secretary may impose a civil money penalty of not more than $10,000 for each
				knowing violation of a requirement of this section, except that the Secretary
				shall impose a civil money penalty of more than $10,000 for each such violation
				in the case of a participating hospital that the Secretary determines has a
				pattern or practice of such violations (with the amount of such additional
				penalties being determined in accordance with a schedule or methodology
				specified in regulations).</text>
								</subparagraph><subparagraph id="HBC007F8B30994708995B085BD423FDF1"><enum>(B)</enum><header>Procedures</header><text>The
				provisions of section 1128A (other than subsections (a) and (b)) shall apply to
				a civil money penalty under this paragraph in the same manner as such
				provisions apply to a penalty or proceeding under section 1128A.</text>
								</subparagraph><subparagraph id="HD051675907214126B9C2480500524CA"><enum>(C)</enum><header>Public notice of
				violations</header>
									<clause id="HA99BD969052E4D01A486E2E1E28F6CA1"><enum>(i)</enum><header>Internet
				site</header><text>The Secretary shall publish on the Internet site of the
				Department of Health and Human Services the names of participating hospitals on
				which civil money penalties have been imposed under this section, the violation
				for which the penalty was imposed, and such additional information as the
				Secretary determines appropriate.</text>
									</clause><clause id="H8CD424F827154E2EBEF7CD7BDD45CEA"><enum>(ii)</enum><header>Change of
				ownership</header><text>With respect to a participating hospital that had a
				change in ownership, as determined by the Secretary, penalties imposed on the
				hospital while under previous ownership shall no longer be published by the
				Secretary of such Internet site after the 1-year period beginning on the date
				of change in ownership.</text>
									</clause></subparagraph></paragraph></subsection><subsection id="HDAFD1867E1F8447B8F22B9A96918441E"><enum>(f)</enum><header>Whistle-blower
				protections</header>
							<paragraph id="HD30C8A5C960D4571A94F939540F15E9"><enum>(1)</enum><header>Prohibition of
				discrimination and retaliation</header><text>A participating hospital shall not
				discriminate or retaliate in any manner against any patient or employee of the
				hospital because that patient or employee, or any other person, has presented a
				grievance or complaint, or has initiated or cooperated in any investigation or
				proceeding of any kind, relating to the staffing system or other requirements
				and prohibitions of this section.</text>
							</paragraph><paragraph id="H94184A0CC2DA4ECF90BBE8F180E07DCC"><enum>(2)</enum><header>Relief for
				prevailing employees</header><text>An employee of a participating hospital who
				has been discriminated or retaliated against in employment in violation of this
				subsection may initiate judicial action in a United States District Court and
				shall be entitled to reinstatement, reimbursement for lost wages and work
				benefits caused by the unlawful acts of the employing hospital. Prevailing
				employees are entitled to reasonable attorney’s fees and costs associated with
				pursuing the case.</text>
							</paragraph><paragraph id="HC63FD24E3FCB477DB3FCD89F6823EBAE"><enum>(3)</enum><header>Relief for
				prevailing patients</header><text>A patient who has been discriminated or
				retaliated against in violation of this subsection may initiate judicial action
				in a United States District Court. A prevailing patient shall be entitled to
				liquidated damages of $5,000 for a violation of this statute in addition to any
				other damages under other applicable statutes, regulations or common law.
				Prevailing patients are entitled to reasonable attorney’s fees and costs
				associated with pursuing the case.</text>
							</paragraph><paragraph id="H70EBE7EA851A4931BEA2174820033B9B"><enum>(4)</enum><header>Limitation on
				actions</header><text>No action may be brought under paragraph (2) or (3) more
				than 2 years after the discrimination or retaliation with respect to which the
				action is brought.</text>
							</paragraph><paragraph id="H667C5824FB8C41F49B2129FF418F2100"><enum>(5)</enum><header>Treatment of
				adverse employment actions</header><text>For purposes of this
				subsection—</text>
								<subparagraph id="HC2A52D48B5214B06BCED1CC2249871FC"><enum>(A)</enum><text>an adverse
				employment action shall be treated as <quote>retaliation or
				discrimination</quote>; and</text>
								</subparagraph><subparagraph id="H2124FF4537FD45BCA9C2A29FB0B751B0"><enum>(B)</enum><text>an adverse
				employment action includes—</text>
									<clause id="H30B859C902DC4FE18590D9D2EB5BAD79"><enum>(i)</enum><text>the failure to
				promote an individual or provide any other employment-related benefit for which
				the individual would otherwise be eligible;</text>
									</clause><clause id="H3674EBB5FC984211ADDA90FB1CE5C090"><enum>(ii)</enum><text>an adverse
				evaluation or decision made in relation to accreditation, certification,
				credentialing, or licensing of the individual; and</text>
									</clause><clause id="HACAAE49839E94872A202FFE400651500"><enum>(iii)</enum><text>a personnel
				action that is adverse to the individual concerned.</text>
									</clause></subparagraph></paragraph></subsection><subsection id="H6DCA7324EA6C483BAADA9D4B2D82D3E3"><enum>(g)</enum><header>Rules of
				construction</header>
							<paragraph id="H171F38A8F0344E569E92EBFBF68401B6"><enum>(1)</enum><header>Relationship to
				State laws</header><text>Nothing in this section shall be construed as
				exempting or relieving any person from any liability, duty, penalty, or
				punishment provided by any present or future law of any State or political
				subdivision of a State, other than any such law which purports to require or
				permit the doing of any act which would be an unlawful practice under this
				title.</text>
							</paragraph><paragraph id="H854C1E19B68B47CE935E43C810791837"><enum>(2)</enum><header>Relationship to
				conduct prohibited under the National Labor Relations Act</header><text>Nothing
				in this section shall be construed as permitting conduct prohibited under the
				National Labor Relations Act or under any other Federal, State, or local
				collective bargaining law.</text>
							</paragraph></subsection><subsection id="H38E4E12AF6DC427AAE6B672385138245"><enum>(h)</enum><header>Regulations</header><text>The
				Secretary shall promulgate such regulations as are appropriate and necessary to
				implement this Act.</text>
						</subsection><subsection id="H659B5FC8DAEF41A1B64EBFA269EBC812"><enum>(i)</enum><header>Definitions</header><text>For
				purposes of this section—</text>
							<paragraph id="H19A4B6AC2FAE4F85006FFFF018769345"><enum>(1)</enum><text>the term
				<term>participating hospital</term> means a hospital that has entered into a
				provider agreement under section 1866;</text>
							</paragraph><paragraph id="H8B2524BCF1E54B31A2F39DF5DD53D2C5"><enum>(2)</enum><text>the term
				<term>registered nurse</term> means an individual who has been granted a
				license to practice as a registered nurse in at least one State;</text>
							</paragraph><paragraph id="HE402539B99A940BC8877D745918E2D16"><enum>(3)</enum><text>the term
				<term>unit</term> of a hospital is an organizational department or separate
				geographic area of a hospital, such as a burn unit, a labor and delivery room,
				a post-anesthesia service area, an emergency department, an operating room, a
				pediatric unit, a step-down or intermediate care unit, a specialty care unit, a
				telemetry unit, a general medical care unit, a subacute care unit, and a
				transitional inpatient care unit;</text>
							</paragraph><paragraph id="H30C22E83CE0843CF8388B3AF9174DA39"><enum>(4)</enum><text>a
				<term>shift</term> is a scheduled set of hours or duty period to be worked at a
				participating hospital; and</text>
							</paragraph><paragraph id="H86CF8226EA184AB9AF296FEA39F5031F"><enum>(5)</enum><text>a
				<term>person</term> includes one or more individuals, associations,
				corporations, unincorporated organizations or labor
				unions.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H12A1AB5E639B48ACB64C802C3F4099BA"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall become effective
			 on January 1, 2008.</text>
