R. 4121 IN THE HOUSE OF REPRESENTATIVES November 8, 2007 Mr. Carney (for himself, Mr. Space, and Ms. DeLauro) introduced the following bill; which was referred to the Committee on Oversight and Government Reform A BILL To amend the Ethics in Government Act of 1978 to prevent Government officials from accepting travel from persons having business before their agencies, and for other purposes.

Short title
This Act may be cited as the Restoring Trust in Public Officials Act of 2007.
2.
Acceptance of travel by Government officials
The Ethics in Government Act of 1978 is amended by adding at the end the following: <enum>VI</enum><header>Acceptance of travel by Government officials</header> <section id="H2DEB3C3B1A864909B35B861B4643F401"><enum>601.</enum><header>Acceptance of certain travel by certain Government officials prohibited</header> <subsection id="H5A2E8F3BC499410999FF9FC70D6A3E7"><enum>(a)</enum><header>Generally</header><text display-inline="yes-display-inline">A covered official shall not accept any travel paid for by a prohibited source. Nor shall an agency accept a payment for travel that a covered official may not accept under this section.</text> </subsection><subsection id="HEBA362DA50BF4AA69073BA04776B85C8"><enum>(b)</enum><header>Sanctions</header><text display-inline="yes-display-inline">The prohibition of this title shall be enforced in the same manner as the prohibitions of title V, and a violation of a prohibition of this title shall be subject to the same sanctions as a violation of that title.</text> </subsection><subsection id="H1B484102B11A40BCAB2436BE436156F8"><enum>(c)</enum><header>Definitions</header><text>In this title—</text> <paragraph id="H4778759595F74EF48B506DDD52BAADA3"><enum>(1)</enum><text display-inline="yes-display-inline">the term <quote>covered official</quote> means a person described in <external-xref legal-doc="usc" parsable-cite="usc/18/207">section 207(c)(2)(A)</external-xref> of title 18, United States Code; and</text> </paragraph><paragraph id="H9733A3ADCC2B44F6A4973D81B4C50021"><enum>(2)</enum><text>the term <quote>prohibited source</quote> means any person who—</text> <subparagraph id="HDD0815C1753141F29D426BB0DDD3FE2"><enum>(A)</enum><text display-inline="yes-display-inline">is seeking official action by the covered official’s agency;</text> </subparagraph><subparagraph id="H5AE6A03FF13943A4A1355BF41EB2ACA5"><enum>(B)</enum><text>does business or seeks to do business with the covered official's agency;</text> </subparagraph><subparagraph id="H1425AC56B50443CBA15417ACE819136D"><enum>(C)</enum><text>conducts activities regulated by the covered official’s agency;</text> </subparagraph><subparagraph id="H3019C73AE3C3493BB48F21B2DC60B1B"><enum>(D)</enum><text>has interests that may be substantially affected by the performance or nonperformance of the covered official’s official duties; or</text> </subparagraph><subparagraph id="H59C124AD68ED44AC985588B3E8E7987"><enum>(E)</enum><text>is an organization a majority of whose members are described in any of paragraphs (A) through (D).</text> </subparagraph></paragraph></subsection></section>.

Conforming amendment to title 31, United States Code
Section 1353(a) of title 31, United States Code, is amended by inserting , consistent with title VI of the Ethics in Government Act of 1978, after shall prescribe by regulation.
