		<official-title display="yes">To amend title 18, United States Code, to
		  provide for more effective prosecution of cases involving child pornography,
		  and for other purposes.</official-title>

		<section id="HC4BE3C09432F4E1DAFA700994009A011" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Effective Child Pornography
			 Prosecution Act of 2007</short-title></quote>.</text>
		</section><section id="H374B16F86010479E80BE5F4FF8B879A5"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following
			 findings:</text>
			<paragraph id="HCF9FE17C31A646958D4C58D010D65554"><enum>(1)</enum><text display-inline="yes-display-inline">Child pornography is estimated to be a
			 multibillion dollar industry of global proportions, facilitated by the growth
			 of the Internet.</text>
			</paragraph><paragraph id="H3F25E55AAD6A4BBDBC02AFD849D64FC"><enum>(2)</enum><text>Recent data has
			 shown that 83 percent of child pornography possessors had images of children
			 younger than 12 years old, 39 percent had images of children younger than 6
			 years old, and 19 percent had images of children younger than 3 years
			 old.</text>
			</paragraph><paragraph id="H07606D384FA642AE956556DF66854207"><enum>(3)</enum><text>Child pornography
			 is a permanent record of a child’s abuse and the distribution of child
			 pornography images revictimizes the child each time the image is viewed.</text>
			</paragraph><paragraph id="H8BAE65EB39244673AD00197D9943CE00"><enum>(4)</enum><text>Child pornography
			 is readily available through virtually every Internet technology, including Web
			 sites, email, instant messaging, Internet Relay Chat, newsgroups, bulletin
			 boards, and peer-to-peer.</text>
			</paragraph><paragraph id="HB234617BCA7C434F9500792FFEBFAA5"><enum>(5)</enum><text>The technological
			 ease, lack of expense, and anonymity in obtaining and distributing child
			 pornography over the Internet has resulted in an explosion in the
			 multijurisdictional distribution of child pornography.</text>
			</paragraph><paragraph id="H168EEE6B37914072B5F746848171CCC6"><enum>(6)</enum><text>The Internet is
			 well recognized as a method of distributing goods and services across State
			 lines.</text>
			</paragraph><paragraph id="HBD1C1F2FBC4E4383B4F828FDFBC79FAF"><enum>(7)</enum><text>The transmission
			 of child pornography using the Internet constitutes transportation in
			 interstate commerce.</text>
			</paragraph></section><section id="H83B96F669BB344A385C1F96B5396E926"><enum>3.</enum><header>Effective child
			 pornography prosecution</header>
			<subsection id="H9F99B9B2086140F8AFD57E92AE452372"><enum>(a)</enum><header>Section
			 2252</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/2252">Section 2252</external-xref> of title 18, United States Code, is
			 amended—</text>
				<paragraph id="H9E961074B1664A9DB6E35390061BC550"><enum>(1)</enum><text>in subsection
			 (a)(1), by inserting <quote>or affecting</quote> after <quote>ships
			 in</quote>;</text>
				</paragraph><paragraph id="HDFFF4C5C2A70479492D1A95CF510FD71"><enum>(2)</enum><text>in subsection
			 (a)(2), by striking <quote>knowingly</quote> and all that follows through
			 <quote>mails</quote> and inserting <quote>knowingly receives, distributes, or
			 reproduces for distribution, in or affecting interstate or foreign commerce,
			 any visual depiction</quote>;</text>
				</paragraph><paragraph id="H14A6DC8060C642D8909DDDB96E60EA90"><enum>(3)</enum><text>in subsection
			 (a)(3)(B), by inserting <quote>or affecting</quote> before
			 <quote>interstate</quote>; and</text>
				</paragraph><paragraph id="H4D36E8B799AB408E933200AF3BB8DF2"><enum>(4)</enum><text>in
			 subsection (a)(4)(B)—</text>
					<subparagraph id="HA6C082E75E5F4B51BE7620AE00966CB7"><enum>(A)</enum><text>by inserting
			 <quote>in or affecting interstate or foreign commerce</quote> after
			 <quote>possesses</quote>; and</text>
					</subparagraph><subparagraph id="H56BA530CD2DA4A54A246C1228C81525D"><enum>(B)</enum><text>by striking
			 <quote>that has been</quote> and all that follows through <quote>by
			 computer</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="H3EDEA67F1C7440BDA0B7E31CDCB9080"><enum>(b)</enum><header>Section
			 2252A</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/2252A">Section 2252A</external-xref> of title 18, United States Code, is
			 amended—</text>
				<paragraph id="H4230DAC71DA74EEF8BAF549CBE52DC51"><enum>(1)</enum><text>in paragraphs (1)
			 through (4) and (6) of subsection (a), by inserting <quote>or affecting</quote>
			 before <quote>interstate or foreign commerce</quote> each place it appears;
			 and</text>
				</paragraph><paragraph id="H3F5A212BF5814C48A6C7E3BA44FC7173"><enum>(2)</enum><text>in subsection
			 (a)(5)(b)—</text>
					<subparagraph id="H0CA88135656E45B29589EA0068000873"><enum>(A)</enum><text>by inserting
			 <quote>in or affecting interstate or foreign commerce</quote> after
			 <quote>possesses</quote>; and</text>
					</subparagraph><subparagraph id="HD07C1209D555487EA236CFECFC66F1F0"><enum>(B)</enum><text>by striking
			 <quote>that has been</quote> and all that follows through <quote>by
			 computer</quote> the second place it appears.</text>
					</subparagraph></paragraph></subsection></section></legis-body>
