<section commented="no" display-inline="no-display-inline" id="id1C7FA7C3672F4C3BA55620E4D6091CDA" section-type="subsequent-section"><enum>101.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This title may be cited as the
<quote>Effective Child Pornography Prosecution Act of 2007</quote>.</text>
</section><section commented="no" display-inline="no-display-inline" id="H374B16F86010479E80BE5F4FF8B879A5" section-type="subsequent-section"><enum>102.</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
<paragraph commented="no" display-inline="no-display-inline" id="HCF9FE17C31A646958D4C58D010D65554"><enum>(1)</enum><text display-inline="yes-display-inline">Child pornography is estimated to be a
multibillion dollar industry of global proportions, facilitated by the growth
of the Internet.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3F25E55AAD6A4BBDBC02AFD849D64FC"><enum>(2)</enum><text display-inline="yes-display-inline">Data has shown that 83 percent of child
pornography possessors had images of children younger than 12 years old, 39
percent had images of children younger than 6 years old, and 19 percent had
images of children younger than 3 years old.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H07606D384FA642AE956556DF66854207"><enum>(3)</enum><text display-inline="yes-display-inline">Child pornography is a permanent record of
a child’s abuse and the distribution of child pornography images revictimizes
the child each time the image is viewed.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8BAE65EB39244673AD00197D9943CE00"><enum>(4)</enum><text display-inline="yes-display-inline">Child pornography is readily available
through virtually every Internet technology, including Web sites, email,
instant messaging, Internet Relay Chat, newsgroups, bulletin boards, and
peer-to-peer.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB234617BCA7C434F9500792FFEBFAA5"><enum>(5)</enum><text display-inline="yes-display-inline">The technological ease, lack of expense,
and anonymity in obtaining and distributing child pornography over the Internet
has resulted in an explosion in the multijurisdictional distribution of child
pornography.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H168EEE6B37914072B5F746848171CCC6"><enum>(6)</enum><text display-inline="yes-display-inline">The Internet is well recognized as a method
of distributing goods and services across State lines.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBD1C1F2FBC4E4383B4F828FDFBC79FAF"><enum>(7)</enum><text display-inline="yes-display-inline">The transmission of child pornography using
the Internet constitutes transportation in interstate commerce.</text>
</paragraph></section><section commented="no" display-inline="no-display-inline" id="id75159F5551FC455CB254CD08EDF27C73" section-type="subsequent-section"><enum>103.</enum><header display-inline="yes-display-inline">Clarifying ban of child
pornography</header>
<subsection commented="no" display-inline="no-display-inline" id="id6A83FD05BDC348EE92D330FECE3D87F9"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/110">Chapter 110</external-xref> of title 18, United States
Code, is amended—</text>
<paragraph commented="no" display-inline="no-display-inline" id="idF0EC21A678EF487AAC702ED7556D09BE"><enum>(1)</enum><text display-inline="yes-display-inline">in section 2251—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="id31B11D2E16ED47499157D51643E43EC9"><enum>(A)</enum><text display-inline="yes-display-inline">in each of subsections (a), (b), and (d),
by inserting <quote>using any means or facility of interstate or foreign
commerce or</quote> after <quote>be transported</quote>;</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD74D4720C9874030BC9F1C123D6E2C2F"><enum>(B)</enum><text display-inline="yes-display-inline">in each of subsections (a) and (b), by
inserting <quote>using any means or facility of interstate or foreign commerce
or</quote> after <quote>been transported</quote>;</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA72AA312CA0444E38AB062A46FAE4275"><enum>(C)</enum><text display-inline="yes-display-inline">in subsection (c), by striking
<quote>computer</quote> each place that term appears and inserting <quote>using
any means or facility of interstate or foreign commerce</quote>; and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id11421D7963E34B59911320BA93D6FB8E"><enum>(D)</enum><text display-inline="yes-display-inline">in subsection (d), by inserting
<quote>using any means or facility of interstate or foreign commerce or</quote>
after <quote>is transported</quote>;</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDf6b693b74dd9442f93e2381a22b737ff"><enum>(2)</enum><text display-inline="yes-display-inline">in section 2251A(c), by inserting
<quote>using any means or facility of interstate or foreign commerce or</quote>
after <quote>or transported</quote>;</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDeca493bb50c540d2a07bae319bf75d8b"><enum>(3)</enum><text display-inline="yes-display-inline">in section 2252(a)—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="id52F06FB1DEA9430FB84D5CFE0E1C1B36"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1), by inserting <quote>using
any means or facility of interstate or foreign commerce or</quote> after

</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id9F8BC07DD56343C9A9DA76F4879084CD"><enum>(b)</enum><header display-inline="yes-display-inline">Affecting interstate commerce</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/110">Chapter 110</external-xref> of title 18, United States
Code, is amended in each of sections 2251, 2251A, 2252, and 2252A, by striking
<quote>in interstate</quote> each place it appears and inserting <quote>in or
affecting interstate</quote>.</text>
</subsection><subsection commented="no" display-inline="no-display-inline" id="ID6ebb9de40f404161bdc90e91af8808e0"><enum>(c)</enum><header display-inline="yes-display-inline">Certain activities relating to material
involving the sexual exploitation of minors</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/2252">Section 2252(a)(3)(B)</external-xref> of title 18, United
States Code, is amended by inserting <quote>, shipped, or transported using any
means or facility of interstate or foreign commerce</quote> after <quote>that
has been mailed</quote>.</text>
</subsection><subsection commented="no" display-inline="no-display-inline" id="ID5c0896a10cf04ec481f8fd5a15abc8d8"><enum>(d)</enum><header display-inline="yes-display-inline">Certain activities relating to material
constituting or containing child pornography</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/2252A">Section 2252A(a)(6)(C)</external-xref> of title 18, United
States Code, is amended by striking <quote>or by transmitting</quote> and all
that follows through <quote>by computer,</quote> and inserting <quote>or any
means or facility of interstate or foreign commerce,</quote>.</text>
</subsection></section><enum>II</enum><header display-inline="yes-display-inline">Enhancing the Effective Prosecution of
Child Pornography Act of 2007</header>
<section commented="no" display-inline="no-display-inline" id="id9005AD9EDFED4C53A49764078A001F95" section-type="subsequent-section"><enum>201.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This title may be cited as the
<quote>Enhancing the Effective Prosecution of Child Pornography Act of
2007</quote>.</text>
</section><section commented="no" display-inline="no-display-inline" id="H3E92930770A046D7A4E806BB61F4E93" section-type="subsequent-section"><enum>202.</enum><header display-inline="yes-display-inline">Money laundering predicate</header><text display-inline="no-display-inline">Section
1956(c)(7)(D) of title 18, United States Code, is amended by
inserting <quote>section 2252A (relating to child pornography) where the child
pornography contains a visual depiction of an actual minor engaging in sexually
explicit conduct, section 2260 (production of certain child pornography for
importation into the United States),</quote> before <quote>section
2280</quote>.</text>
</section><section commented="no" display-inline="no-display-inline" id="H1E653E6E73B440828888F8A9ADDD8E4F" section-type="subsequent-section"><enum>203.</enum><header display-inline="yes-display-inline">Knowingly accessing child pornography with
the intent to view child pornography</header>
<subsection commented="no" display-inline="no-display-inline" id="idB730089D7E8048A49BE3CFC05715B1E9"><enum>(a)</enum><header display-inline="yes-display-inline">Materials involving sexual exploitation of
minors</header><text display-inline="yes-display-inline">Section 2252(a)(4)
of title 18, United States Code, is amended—</text>
<paragraph commented="no" display-inline="no-display-inline" id="H9650FE6E012644E58200E59D7ECD6C2D"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (A), by inserting <quote>,
or knowingly accesses with intent to view,</quote> after
<quote>possesses</quote>; and</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H40D17FE8EBC8493DB0DF00CC09FF1992"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (B), by inserting <quote>,
or knowingly accesses with intent to view,</quote> after
<quote>possesses</quote>.</text>
</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idC3AF12706CA64364AF0D04E606977E56"><enum>(b)</enum><header display-inline="yes-display-inline">Materials constituting or containing child

of title 18, United States Code, is amended—</text>
