		<section display-inline="no-display-inline" id="HABC2CBDDFD9F4470B58D3E3DFD6B0A4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Preserving Crime Victims’ Restitution Act of
			 2007</short-title></quote>.</text>
		</section><section id="H2F1D32A1D2B14A1193FFA1C7A0D7C37"><enum>2.</enum><header>Effect of death of
			 a defendant in Federal criminal proceedings</header>
			<subsection id="H63B1C05BCE734F5AA13F7D6000FBA2C2"><enum>(a)</enum><header>In
			 General</header><text>Subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/227">chapter 227</external-xref> of title 18, United States
			 Code, is amended by adding at the end the following:</text>
				<quoted-block id="HD2CFD16EBBC94008B4167B9FF9899E26" style="USC">
					<section id="HD0DB1555C1BF40F99BC72D751DA1C3F2"><enum>3560.</enum><header>Effect of
				death of a defendant in Federal criminal proceedings</header>
						<subsection id="HB7909AAC791C462A9613BC1928DB9B8"><enum>(a)</enum><header>General
				Rule</header><text>Notwithstanding any other provision of law, the death of a
				defendant who has been convicted of a Federal criminal offense shall not be the
				basis for abating or otherwise invalidating a plea of guilty or nolo contendere
				accepted, a verdict returned, a sentence announced, or a judgment entered prior
				to the death of that defendant, or for dismissing or otherwise invalidating the
				indictment, information, or complaint on which such a plea, verdict, sentence,
				or judgment is based, except as provided in this section.</text>
						</subsection><subsection id="H9A8B2B3334C148338D978559ECFCE915"><enum>(b)</enum><header>Death After Plea
				or Verdict</header>
							<paragraph id="H8635B3B092BE4943B7D795752522C88F"><enum>(1)</enum><header>Entry of
				judgment</header><text>If a defendant dies after a plea of guilty or nolo
				contendere has been accepted or a verdict has been returned, but before
				judgment is entered, the court shall enter a judgment incorporating the plea of
				guilty or nolo contendere or the verdict, with the notation that the defendant
				died before the judgment was entered.</text>
							</paragraph><paragraph id="HACF45EE77D28485B9C73526FAA65DB00"><enum>(2)</enum><header>Punitive
				sanctions</header>
								<subparagraph id="HA9066F50DDDB4F77AB9212A4A03D4736"><enum>(A)</enum><header>Death before
				sentence announced</header><text>If a defendant dies after a plea of guilty or
				nolo contendere has been accepted or a verdict has been returned and before a
				sentence has been announced, no sentence of probation, supervision, or
				imprisonment may be imposed, no criminal forfeiture may be ordered, and no
				liability for a fine or special assessment may be imposed on the defendant or
				the defendant’s estate.</text>
								</subparagraph><subparagraph id="H766A56E65D3049D085694E3BE95245F0"><enum>(B)</enum><header>Death after
				sentencing or judgment</header><text>The death of a defendant after a sentence
				has been announced or a judgment has been entered, and before that defendant
				has exhausted or waived the right to a direct appeal—</text>
									<clause id="H7B45ED011A334476AC325F1C56B8F38D"><enum>(i)</enum><text>shall terminate
				any term of probation, supervision, or imprisonment, and shall terminate the
				liability of that defendant to pay any amount remaining due of a criminal
				forfeiture, of a fine under section 3613(b), or of a special assessment under
				section 3013; and</text>
									</clause><clause id="H819B0EA537744456A2004F5CB738811E"><enum>(ii)</enum><text>shall not require
				return of any portion of any criminal forfeiture, fine, or special assessment
				already paid.</text>
									</clause></subparagraph></paragraph><paragraph id="H6B33362F4E6E4D6EB4C7559B22ED5B44"><enum>(3)</enum><header>Restitution</header>
								<subparagraph id="HB0995F23399B411184DF84928F782D16"><enum>(A)</enum><header>Death before
				sentence announced</header><text>If a defendant dies after a plea of guilty or
				nolo contendere has been accepted or a verdict has been returned and before a
				sentence has been announced, the court shall, upon a motion under subsection
				(c)(2) by the Government or any victim of that defendant’s crime, commence a
				special restitution proceeding at which the court shall adjudicate and enter a
				final order of restitution against the estate of that defendant in an amount
				equal to the amount that would have been imposed if that defendant were
				alive.</text>
								</subparagraph><subparagraph id="H163D2E6E2EB744C58502959C8F48C661"><enum>(B)</enum><header>Death after
				sentencing or judgment</header><text>The death of a defendant after a sentence
				has been announced shall not be a basis for abating or otherwise invalidating
				restitution announced at sentencing or ordered after sentencing under section
				3664(d)(5) of this title or any other provision of law.</text>
								</subparagraph></paragraph><paragraph id="H2257802C84D643478F53DDDC77C864EC"><enum>(4)</enum><header>Civil
				proceedings</header><text>The death of a defendant after a plea of guilty or
				nolo contendere has been accepted, a verdict returned, a sentence announced, or
				a judgment entered, shall not prevent the use of that plea, verdict, sentence,
				or judgment in civil proceedings, to the extent otherwise permitted by
				law.</text>
							</paragraph></subsection><subsection id="H84B6835CDD4C43D2BCF281D265677075"><enum>(c)</enum><header>Appeals,
				Motions, and Petitions</header>
							<paragraph id="H1A6BA300733F44788E138E272955F310"><enum>(1)</enum><header>In
				general</header><text>Except as provided in paragraph (2), after the death of a
				defendant convicted in a criminal case—</text>
								<subparagraph id="HF8DE0068B32344EBB06400B15D99CF83"><enum>(A)</enum><text>no appeal, motion,
				or petition by or on behalf of that defendant or the personal representative or
				estate of that defendant, the Government, or a victim of that defendant’s crime
				seeking to challenge or reinstate a plea of guilty or nolo contendere accepted,
				a verdict returned, a sentence announced, or a judgment entered prior to the
				death of that defendant shall be filed in that case after the death of that
				defendant; and</text>
								</subparagraph><subparagraph id="HFB6D018178744E188396016B8665FDF"><enum>(B)</enum><text>any pending motion,
				petition, or appeal in that case shall be dismissed with the notation that the
				dismissal is due to the death of the defendant.</text>
								</subparagraph></paragraph><paragraph id="HA4EF2EA5FCAE49809400CF5F475FA059"><enum>(2)</enum><header>Exceptions</header>
								<subparagraph id="H921244BEE8C848498909A6C2F244C9AE"><enum>(A)</enum><header>Restitution</header><text>If
				a defendant dies after being convicted in a criminal case but prior to
				sentencing or the exhaustion or waiver of direct appeal, the personal
				representative of that defendant, the Government, or any victim of that
				defendant’s crime may file or pursue an otherwise permissible direct appeal,
				petition for mandamus or a writ of certiorari, or an otherwise permissible
				motion described in section 3663, 3663A, 3664, or 3771, to the extent that the
				appeal, petition, or motion raises an otherwise permissible claim to—</text>
									<clause id="H2FE8226B6D03452BA283085D4156A3BB"><enum>(i)</enum><text>obtain, in a
				special restitution proceeding, a final order of restitution under subsection
				(b)(3);</text>
									</clause><clause id="HE93B5F656586449981F8D53784355E7"><enum>(ii)</enum><text>enforce, correct,
				amend, adjust, reinstate, or challenge any order of restitution; or</text>
									</clause><clause id="H601BE0EE900C48308D896C00DF33E202"><enum>(iii)</enum><text>challenge or
				reinstate a verdict, plea of guilty or nolo contendere, sentence, or judgment
				on which—</text>
										<subclause id="H128971C72921414C826CB6562C46F4BF"><enum>(I)</enum><text>a restitution
				order is based; or</text>
										</subclause><subclause id="H5E0F754C3BD640AE00CFCB8E2EEF1BDA"><enum>(II)</enum><text>restitution is
				being or will be sought by an appeal, petition, or motion under this
				paragraph.</text>
										</subclause></clause></subparagraph><subparagraph id="H36DAC814F46C4EAEAF8BBE9CFD312BF3"><enum>(B)</enum><header>Other civil
				actions affected</header><text>If a defendant dies after being convicted in a
				criminal case but prior to sentencing or the exhaustion or waiver of direct
				appeal, the personal representative of that defendant, the Government, or any
				victim of that defendant’s crime may file or pursue an otherwise permissible
				direct appeal, petition for mandamus or a writ of certiorari, or an otherwise
				permissible motion under the Federal Rules of Criminal Procedure, to the extent
				that the appeal, petition, or motion raises an otherwise permissible claim to
				challenge or reinstate a verdict, plea of guilty or nolo contendere, sentence,
				or judgment that the appellant, petitioner, or movant shows by a preponderance
				of the evidence is, or will be, material in a pending or reasonably anticipated
				civil proceeding, including civil forfeiture proceedings.</text>
								</subparagraph><subparagraph id="HE3C7BED85A4A41D69753764278368856"><enum>(C)</enum><header>Collateral
				consequences</header>
									<clause id="HEBF7D78D2FCC46FD9EC215C7A5E502C4"><enum>(i)</enum><header>In
				general</header><text>Except as provided in subparagraphs (A) and (B), the
				Government may not restrict any Federal benefits or impose collateral
				consequences on the estate or a family member of a deceased defendant based
				solely on the conviction of a defendant who died before that defendant
				exhausted or waived the right to direct appeal unless, not later than 90 days
				after the death of that defendant, the Government gives notice to that estate
				or family member of the intent of the Government to take such action.</text>
									</clause><clause id="H8630B39E1740486B832E1E249691A281"><enum>(ii)</enum><header>Personal
				representative</header><text>If the Government gives notice under clause (i),
				the court shall appoint a personal representative for the deceased defendant
				that is the subject of that notice, if not otherwise appointed, under section
				(d)(2)(A).</text>
									</clause><clause id="H380A34C1D3994C10956F185C5CC5007"><enum>(iii)</enum><header>Tolling</header><text>If
				the Government gives notice under clause (i), any filing deadline that might
				otherwise apply against the defendant, the estate of the defendant, or a family
				member of the defendant shall be tolled until the date of the appointment of
				that defendant’s personal representative under clause (ii).</text>
									</clause></subparagraph></paragraph><paragraph id="H5714B6779E0D4C3FB039BDCC99B94C3B"><enum>(3)</enum><header>Basis</header><text>In
				any appeal, petition, or motion under paragraph (2), the death of the defendant
				shall not be a basis for relief.</text>
							</paragraph></subsection><subsection id="H1F83A4A75F6145DAAB60320000800466"><enum>(d)</enum><header>Procedures
				Regarding Continuing Litigation</header>
							<paragraph id="H27614026B39A45608BC07B6F11873BA"><enum>(1)</enum><header>In
				general</header><text>The standards and procedures for a permitted appeal,
				petition, motion, or other proceeding under subsection (c)(2) shall be the
				standards and procedures otherwise provided by law, except that the personal
				representative of the defendant shall be substituted for the defendant.</text>
							</paragraph><paragraph id="HC64FB097EA28425D8BBAFC377C2D9456"><enum>(2)</enum><header>Special
				procedures</header><text>If continuing litigation is initiated or could be
				initiated under subsection (c)(2), the following procedures shall apply:</text>
								<subparagraph id="HA1BFE690E6764BC48C00462D2FAAC385"><enum>(A)</enum><header>Notice and
				appointment of personal representative</header><text>The district court before
				which the criminal case was filed (or the appellate court if the matter is
				pending on direct appeal) shall—</text>
									<clause id="H085DBB2F647546419EDE3F3C2E061EEB"><enum>(i)</enum><text>give notice to any
				victim of the convicted defendant under section 3771(a)(2), and to the personal
				representative of that defendant or, if there is none, the next of kin of that
				defendant; and</text>
									</clause><clause id="HAE902C2D54754956A3FFF3B4FC0968E"><enum>(ii)</enum><text>appoint a personal
				representative for that defendant, if not otherwise appointed.</text>
									</clause></subparagraph><subparagraph id="H138707D45106420788AD87F475DE59DE"><enum>(B)</enum><header>Counsel</header><text>Counsel
				shall be appointed for the personal representative of a defendant convicted in
				a criminal case who dies if counsel would have been available to that
				defendant, or if the personal representative of that defendant requests counsel
				and otherwise qualifies for the appointment of counsel, under section
				3006A.</text>
								</subparagraph><subparagraph id="HCC12E41507224B048753D4FF00A1C73B"><enum>(C)</enum><header>Tolling</header><text>The
				court shall toll any applicable deadline for the filing of any motion,
				petition, or appeal during the period beginning on the date of the death of a
				defendant convicted in a criminal case and ending on the later of—</text>
									<clause id="H87B52F02096D4EA59203968C240682E7"><enum>(i)</enum><text>the date of the
				appointment of that defendant’s personal representative; or</text>
									</clause><clause id="H5F27F7BB7B584DD49D56F29679184CBD"><enum>(ii)</enum><text>where applicable,
				the date of the appointment of counsel for that personal representative.</text>
									</clause></subparagraph><subparagraph id="H4083808FA0D1436891DF4C9DBE563F6B"><enum>(D)</enum><header>Restitution</header><text>If
				restitution has not been fully collected on the date on which a defendant
				convicted in a criminal case dies—</text>
									<clause id="HC4733B9332F645029F9B39E8B7D3D6EC"><enum>(i)</enum><text>any amount owed
				under a restitution order (whether issued before or after the death of that
				defendant) shall be collectible from any property from which the restitution
				could have been collected if that defendant had survived, regardless of whether
				that property is included in the estate of that defendant;</text>
									</clause><clause id="HE3FBBD99CDEB42F4AB3FDAB7FB048009"><enum>(ii)</enum><text>any restitution
				protective order in effect on the date of the death of that defendant shall
				continue in effect unless modified by the court after hearing or pursuant to a
				motion by the personal representative of that defendant, the Government, or any
				victim of that defendant’s crime; and</text>
									</clause><clause id="H19E139599A4E4DE1932693B82CDAE164"><enum>(iii)</enum><text>upon motion by
				the Government or any victim of that defendant’s crime, the court shall take
				any action necessary to preserve the availability of property for restitution
				under this section.</text>
									</clause></subparagraph></paragraph></subsection><subsection id="H5422DC70F4604680BB00C15DED511E75"><enum>(e)</enum><header>Forfeiture</header>
							<paragraph id="H76113939039E47DFACDEC69B17133D79"><enum>(1)</enum><header>In
				general</header><text>Except as provided in paragraph (2), the death of an
				individual does not affect the Government’s ability to seek, or to continue to
				pursue, civil forfeiture of property as authorized by law.</text>
							</paragraph><paragraph id="HADE36A1EDD804CE4A0C5F11D64F3C68"><enum>(2)</enum><header>Tolling of
				limitations for civil forfeiture</header><text>Notwithstanding the expiration
				of any civil forfeiture statute of limitations or any time limitation set forth
				in section 983(a) of this title, not later than the later of the time period
				otherwise authorized by law and 2 years after the date of the death of an
				individual against whom a criminal indictment alleging forfeiture is pending,
				the Government may commence civil forfeiture proceedings against any interest
				in any property alleged to be forfeitable in the indictment of that
				individual.</text>
							</paragraph></subsection><subsection id="H2FAB3500034E42C4A000827FC1947699"><enum>(f)</enum><header>Definitions</header><text>In
				this section—</text>
							<paragraph id="HA9C27DB1F14C4FF4AF48DE2ED526133D"><enum>(1)</enum><text>the term
				<term>accepted</term>, relating to a plea of guilty or nolo contendere, means
				that a court has determined, under rule 11(b) of the Federal Rules of Criminal
				Procedure, that the plea is voluntary and supported by a factual basis,
				regardless of whether final acceptance of that plea may have been deferred
				pending review of a presentence report or otherwise;</text>
							</paragraph><paragraph id="H149931884FA44FABB9EF6CED5FC11BFB"><enum>(2)</enum><text>the term
				<term>announced</term>, relating to a sentence, means that the sentence has
				been orally stated in open court;</text>
							</paragraph><paragraph id="HD0EFED7EA6AB472A892D336051B97BCA"><enum>(3)</enum><text>the term
				<term>convicted</term> refers to a defendant—</text>
								<subparagraph id="H533A5B8010324B4EB2B8F6F0E8664008"><enum>(A)</enum><text>whose plea of
				guilty or nolo contendere has been accepted; or</text>
								</subparagraph><subparagraph id="HE064A2088338428C9C061BC6B5BD8372"><enum>(B)</enum><text>against whom a
				verdict of guilty has been returned;</text>
								</subparagraph></paragraph><paragraph id="HE7C3478C6390477199CA17EDE57057C9"><enum>(4)</enum><text>the term
				<term>direct appeal</term> means an appeal filed, within the period provided by
				rule 4(b) of the Federal Rules of Appellate Procedure, from the entry of the
				judgment or order of restitution, including review by the Supreme Court of the
				United States; and</text>
							</paragraph><paragraph id="H67C2B7628708417EA0278F4CFD176F38"><enum>(5)</enum><text>the term
				<term>returned</term>, relating to a verdict, means that the verdict has been
				orally stated in open
				court.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H2F5C068F44544BC6AF2067DB8200D185"><enum>(b)</enum><header>Conforming
			 Amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/227">chapter 227</external-xref> of title 18,
			 United States Code, is amended by adding at the end the following:</text>

					</toc>
					<after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="H879CDDD15FF347E99BB422ED9429A93C"><enum>3.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">The amendments made by
			 this Act shall apply to any criminal case or appeal pending on or after July 1,
			 2007.</text>
		</section><section id="H1867AFEE398946DB9E888CE55D07DA3"><enum>4.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act, any amendment
			 made by this Act, or the application of such provision or amendment to any
			 person or circumstance is held to be unconstitutional, the remainder of the
			 provisions of this Act, the amendments made by this Act, and the application of
			 such provisions or amendments to any person or circumstance shall not be
			 affected.</text>
