<official-title>To amend the Internal Revenue Code of 1986 to modify the rules relating to coins and bullion that may be held by individual retirement accounts and certain other individually-directed accounts.</official-title>

<section id="HFFCAED7380C74F8196B7EB96D04640E3" section-type="section-one"><enum>1.</enum><header>Modification of rules relating to coins and bullion that may be held by individual retirement accounts and certain other individually-directed accounts</header>
<subsection id="H977FABEFF5E24BACB8DEF1C5A8C4C446"><enum>(a)</enum><header>Bullion may be held in bar, ingot, or coin form</header><text display-inline="yes-display-inline">Subparagraph (B) of <external-xref legal-doc="usc" parsable-cite="usc/26/408">section 408(m)(3)</external-xref> of the Internal Revenue Code of 1986 (relating to exception for certain coins and bullion) is amended by inserting <quote>(whether in the form of a bar, ingot, or coin)</quote> after <quote>bullion</quote>.</text></subsection>
<subsection id="H0F06E3543A184704B9D156526B9F8098"><enum>(b)</enum><header>Physical possession requirement satisfied if trustee holds indicia of ownership</header>
<paragraph id="HAF13D1EB9611404F97EB4394508D63AB"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Paragraph (3) of section 408(m) of such Code is amended by inserting before the period <quote>or if the requirements of paragraph (4) are met</quote>.</text></paragraph>
<paragraph id="HC881670DE8614210A2DD46479CB84231"><enum>(2)</enum><header>Special rules relating to indicia of ownership</header><text>Subsection (m) of section 408 of such Code is amended by adding at the end the following new paragraph:</text>
<quoted-block style="OLC" id="H8A3795F024CA4E73981035DABED17A8" display-inline="no-display-inline">
<paragraph id="H2273BA515F344651B9192F9144FCEE5C"><enum>(4)</enum><header>Trustee may hold indicia of ownership in lieu of physical possession</header><text display-inline="yes-display-inline">For purposes of paragraph (3), the requirements of this paragraph are met if—</text>
<subparagraph id="HB28533A57CEE482DB6F618654D49ACF"><enum>(A)</enum><text>the trustee holds the indicia of ownership for the coins or bullion described in paragraph (3),</text></subparagraph>
<subparagraph id="H196A1F260F504C19A8194D9E9398D9D"><enum>(B)</enum><text>physical possession of such coins or bullion is maintained by a custodian—</text>
<clause id="H2B83732C804A4B49AAD1E8002C5D4FA9"><enum>(i)</enum><text>which holds the coins or bullion as agent for the trustee, and</text></clause>
<clause id="HEBE005E850364C53A63F22BD00A402"><enum>(ii)</enum><text>which regularly engages in the business of holding bullion, coins, and precious metals,</text></clause></subparagraph>
<subparagraph id="H12F2017EE87E42339CA6FFEA4993CBDC"><enum>(C)</enum><text>the trustee remains the account fiduciary and otherwise liable to the account beneficiary to the same extent as if the trustee had physical possession of the coins or bullion,</text></subparagraph>
<subparagraph id="HAC735D33421E4CA8BCEA445E739DC4F"><enum>(D)</enum><text>the indicia of ownership—</text>
<clause id="H4FA31C11E20640BFBCD0BA277DF76777"><enum>(i)</enum><text>are not subject to any right, charge, security interest, lien, or claim of any kind in favor of such custodian, and</text></clause>
<clause id="H4169B725D403498EA2F60215DABEA287"><enum>(ii)</enum><text>are freely transferable by the trustee without payment of money or value other than for safe custody and administration, and</text></clause></subparagraph>
<subparagraph id="HD7C7D3CB05AE46468F761D861D4FAA33"><enum>(E)</enum><text>upon written request by the account beneficiary, the trustee notifies such beneficiary in writing of the name, address, and principal place of business of such custodian.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="HC2ADEEB663FC4B6FA7DF62B76BDDF1C9"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on the date of the enactment of this Act.</text> </subsection></section>
