		<official-title>To amend the Magnuson-Stevens Fishery Conservation and
		  Management Act to extend the authorized time period for rebuilding of certain
		  overfished fisheries, and for other purposes.</official-title>

		<section id="H1502C7090CEC4C66B541B7B791D28263" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Flexibility in Rebuilding American
			 Fisheries Act of 2007</short-title></quote>.</text>
		</section><section id="HD87D2F51ACE641A99057647801542374"><enum>2.</enum><header>Extension of time
			 period for rebuilding certain overfished fisheries</header><text display-inline="no-display-inline">Section
			 304(e) of the Magnuson-Stevens Fishery Conservation and Management Act (16
			 U.S.C. 1854(e)(4)) is amended—</text>
			<paragraph id="HB18A14E9FDE746EFB4A2AB63C64DF905"><enum>(1)</enum><text>in paragraph
			 (4)(A)—</text>
				<subparagraph id="H2B009E6A585C49A7BC4D5100FFC292E0"><enum>(A)</enum><text>in clause (i) by
			 striking <quote>possible</quote> and inserting <quote>practicable</quote>;
			 and</text>
				</subparagraph><subparagraph id="H870046161D5E467390F28DC8A7D966D4"><enum>(B)</enum><text>by amending clause
			 (ii) to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="H6B65A94CE2C848D59FAB124612E6EA1E" style="OLC">
						<clause id="H5246967987A94E1EAE6956C85B5C1208"><enum>(ii)</enum><text display-inline="yes-display-inline">not exceed 10 years, except in cases
				where—</text>
							<subclause id="HA1E87DCDB9724ACCA99D6DAC004C7CC9"><enum>(I)</enum><text>characteristics of
				the biology of the stock of fish, other environmental conditions, or management
				measures under an international agreement in which the United States
				participates dictate otherwise;</text>
							</subclause><subclause id="HC7D619A11B39463F82CAA38300B24F3"><enum>(II)</enum><text>the Secretary
				determines that such 10-year period should be extended because the cause of the
				fishery decline is outside the jurisdiction of the Council or the rebuilding
				program cannot be effective only by limiting fishing activities;</text>
							</subclause><subclause id="HB1D568F359614B15855141CA42327BE7"><enum>(III)</enum><text display-inline="yes-display-inline">the Secretary determines that such 10-year
				period should be extended to provide for the sustained participation of fishing
				communities or to minimize the economic impacts on such communities, provided
				that there is evidence that the stock is on a positive rebuilding
				trajectory;</text>
							</subclause><subclause id="HC01EEAD5BA304734BE00FBE4908550E1"><enum>(IV)</enum><text display-inline="yes-display-inline">the Secretary determines that such 10-year
				period should be extended for one or more stocks of a multi-species fishery,
				provided that there is evidence that those stocks are on a positive rebuilding
				trajectory; or</text>
							</subclause><subclause id="H39F4F23C14814DA483E0FF29E71D2F4D"><enum>(V)</enum><text display-inline="yes-display-inline">the Secretary determines that such 10-year
				period should be extended because of a substantial change to the biomass
				rebuilding target for the stock of fish concerned after the rebuilding plan has
				taken effect.</text>
							</subclause></clause><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="HBFF426B3294D41B7B780801816ADAE78"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HF4A2B38354F9455BA324B0EE31CD9475" style="OLC">
					<paragraph id="H4D25CC1B20FF4B6F867609375949414F"><enum>(8)</enum><text display-inline="yes-display-inline">If the Secretary determines that extended
				rebuilding time is warranted under subclause (III), (IV), or (V) of paragraph
				(4)(A)(ii), the maximum time allowed for rebuilding the stock of fish concerned
				may not exceed the sum of the following time periods:</text>
						<subparagraph id="HBA8F08C4F3BD498BB658A823B7163D00"><enum>(A)</enum><text>The initial
				10-year rebuilding period.</text>
						</subparagraph><subparagraph id="H489C12E192A64A718584322105FA19CD"><enum>(B)</enum><text>The expected time
				to rebuild the stock absent any fishing mortality and under prevailing
				environmental conditions.</text>
						</subparagraph><subparagraph id="H95224FBC711B42F1986D00D3F7E71155"><enum>(C)</enum><text>The mean
				generation time of the
				stock.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
