		<section id="HF4EF33C50F9D42DF8D4533DEA8C718E0" section-type="section-one"><enum>1.</enum><header>Establishment of new fashion
			 model nonimmigrant classification</header>
			<subsection id="H27419485D651448F911C526BEC62C34E"><enum>(a)</enum><header>In general</header>
				<paragraph id="HA24042C79B954402958FC9F100FD82E"><enum>(1)</enum><header>New
			 classification</header><text>Section 101(a)(15)(P) of the Immigration and
			 Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(P)</external-xref>) is amended—</text>
					<subparagraph id="HBA64B3B4550A4057AA79A2AF16232C17"><enum>(A)</enum><text>in clause (iii), by
			 striking <quote>or</quote> at the end;</text>
					</subparagraph><subparagraph id="HDA8D08E1095F49DC8BB7AD4C1B6CFBCB"><enum>(B)</enum><text>in clause (iv), by
			 striking <quote>clause (i), (ii), or (iii)</quote> and inserting <quote>clause
			 (i), (ii), (iii), or (iv)</quote>;</text>
					</subparagraph><subparagraph id="HB791227B55484E08BD39174CC2CA465C"><enum>(C)</enum><text>by redesignating clause
			 (iv) as clause (v); and</text>
					</subparagraph><subparagraph id="HCACFF5B841784A78A141C3CC524C3489"><enum>(D)</enum><text>by inserting after clause
			 (iii) the following:</text>
						<quoted-block changed="added" committee-id="HJU00" display-inline="no-display-inline" id="HD5D61D83D3494FA1B627F8192C7BA42F" reported-display-style="italic" style="OLC">
							<clause id="H602BF61C4B1E42F8AAF6BED0451CA88" indent="up1"><enum>(iv)</enum><text display-inline="yes-display-inline">is a fashion model who is of distinguished
				merit and ability and who is seeking to enter the United States temporarily to
				perform fashion modeling services that involve events or productions which have
				a distinguished reputation or that are performed for an organization or
				establishment that has a distinguished reputation for, or a record of,
				utilizing prominent modeling talent;
				or</text>
							</clause><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H367F39C8E9C4473CBE4D42AFD3D15155"><enum>(2)</enum><header>Authorized period of
			 stay</header><text>Section 214(a)(2)(B) of the Immigration and Nationality Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(a)(2)(B)</external-xref>) is amended in the second sentence—</text>
					<subparagraph id="HBA691F45DC7446F1A1B5605DB08A2BC"><enum>(A)</enum><text>by inserting <quote>or
			 fashion models</quote> after <quote>athletes</quote>; and</text>
					</subparagraph><subparagraph id="H39FDBB00D71042FB80846BDD59F600B9"><enum>(B)</enum><text>by inserting <quote>or
			 fashion model</quote> after <quote>athlete</quote>.</text>
					</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="HB945F37563EA4B959EC1CA84B53E0035"><enum>(3)</enum><header>Numerical
			 limitation</header><text display-inline="yes-display-inline">Section 214(c)(4)
			 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(c)(4)</external-xref>) is amended by
			 adding at the end the following:</text>
					<quoted-block changed="added" committee-id="HJU00" display-inline="no-display-inline" id="H89D6A50066794B14BF970072841DF0DE" reported-display-style="italic" style="traditional">
						<subparagraph id="H4EF034C1191F4FC783E3687E89587F61" indent="up2"><enum>(I)</enum><clause commented="no" display-inline="yes-display-inline" id="HC3CFD4F50D4F4F54BB74DF38EA00B481"><enum>(i)</enum><text>The total number of
				aliens who may be issued visas or otherwise provided nonimmigrant status during
				any fiscal year under section 101(a)(15)(P)(iv) may not exceed 1,000.</text>
							</clause><clause changed="added" committee-id="HJU00" id="HA066DC1A60444326AE4C90AF6E23002B" indent="up1" reported-display-style="italic"><enum>(ii)</enum><text>The numerical limitation
				established by clause (i) shall only apply to principal aliens and not to the
				spouses or children of such aliens.</text>
							</clause><clause changed="added" committee-id="HJU00" id="HCDDCAFD568884DA1BF90BDA516BEABD7" indent="up1" reported-display-style="italic"><enum>(iii)</enum><text>An alien who has
				already been counted toward the limitation established by clause (i) shall not
				be counted again during the same period of stay or authorized extension under
				subsection (a)(2)(B), irrespective of whether there is a change in petitioner
				under subparagraph
				(C).</text>
							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" id="H2B284E4CBAA549B4ACC18C5E258B11E1"><enum>(4)</enum><header>Consultation</header>
					<subparagraph id="H62911299D2A040A283A8AC92165D009D"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 214(c)(4)(D)
			 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(c)(4)(D)</external-xref>) is amended by
			 striking <quote>clause (i) or (iii)</quote> and inserting <quote>clause (i),
			 (iii), or (iv)</quote>.</text>
					</subparagraph><subparagraph id="H45EBE6CCA61C45BFA26156208F73C215"><enum>(B)</enum><header>Advisory
			 opinion</header><text display-inline="yes-display-inline">Section
			 214(c)(6)(A)(iii) of the Immigration and Nationality Act (8 U.S.C.
			 1184(c)(6)(A)(iii)) is amended—</text>
						<clause id="HDB2411A4B8A24742B887E18E8E3FB9C5"><enum>(i)</enum><text>by striking
			 <quote>section 101(a)(15)(P)(i) or 101(a)(15)(P)(iii),</quote> and inserting
			 <quote>clause (i), (iii), or (iv) of section 101(a)(15)(P),</quote>; and</text>
						</clause><clause id="HFEBEABC8BA81407CBC971BC8A676B858"><enum>(ii)</enum><text>by striking <quote>of
			 athletics or entertainment</quote>.</text>
						</clause></subparagraph><subparagraph id="H1ED20168A848485AB4C106C1CA72BBA"><enum>(C)</enum><header>Expedited
			 procedures</header><text display-inline="yes-display-inline">Section
			 214(c)(6)(E)(i) of the Immigration and Nationality Act (8 U.S.C.
			 1184(c)(6)(E)(i)) is amended by striking <quote>artists or entertainers</quote>
			 and inserting <quote>artists, entertainers, or fashion models</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="H0369E5A46B20430EAF2DCE9517703015"><enum>(b)</enum><header>Elimination of H–1B
			 classification for fashion models</header><text>Section 101(a)(15)(H)(i)(b) of
			 the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(H)(i)(b)</external-xref>) is
			 amended—</text>
				<paragraph id="H0DCCF26C60284B02AF5786FB8100B350"><enum>(1)</enum><text>by striking <quote>or as
			 a fashion model</quote>; and</text>
				</paragraph><paragraph id="HB14B7AE939794E43002BD4A363803FDD"><enum>(2)</enum><text>by striking <quote>or, in
			 the case of a fashion model, is of distinguished merit and
			 ability</quote>.</text>
				</paragraph></subsection><subsection id="H341125514D37481589C8B6BE784F581C"><enum>(c)</enum><header>Effective date and
			 implementation</header>
				<paragraph id="HD6452964E9D7405A9DA956E73B2BA9D8"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The amendments made
			 by this section shall take effect on the date of the enactment of this
			 Act.</text>
				</paragraph><paragraph id="HF440134FF2984547B7D0789C7991BB30"><enum>(2)</enum><header>Regulations,
			 guidelines, and precedents</header><text display-inline="yes-display-inline">The regulations, guidelines and precedents
			 in effect on the date of the enactment of this Act for the adjudication of
			 petitions for fashion models under section 101(a)(15)(H)(i)(b) of the
			 Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(H)(i)(b)</external-xref>), shall be
			 applied to petitions for fashion models under section 101(a)(15)(P)(iv) of the
			 Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(P)(iv)</external-xref>), as added by this
			 Act, except to the extent modified by the Secretary of Homeland Security
			 through final regulations (not through interim regulations) promulgated in
			 accordance with subchapter II of chapter 5, and chapter 7, of title 5, United
			 States Code (commonly known as the <quote>Administrative Procedure
			 Act</quote>).</text>
				</paragraph><paragraph id="HA860D54B007E4A3E9FFE5CC66308F956"><enum>(3)</enum><header>Construction</header><text>Nothing
			 in this section shall be construed as preventing an alien who is a fashion
			 model from obtaining nonimmigrant status under section 101(a)(15)(O)(i) of the
			 Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(O)(i)</external-xref>) if such alien is
			 otherwise qualified for such status.</text>
				</paragraph><paragraph id="H173835F242BC4259B63800F3F24EB35"><enum>(4)</enum><header>Treatment of pending
			 petitions</header><text>Petitions filed on behalf of fashion models under
			 section 101(a)(15)(H)(i)(b) of the Immigration and Nationality Act (8 U.S.C.
			 1101(a)(15)(H)(i)(b)) that are pending on the date of the enactment of this Act
			 shall be treated as if they had been filed under section 101(a)(15)(P)(iv) of
			 the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(P)(iv)</external-xref>), as added by
			 this Act.</text>
				</paragraph></subsection></section></legis-body>
