<official-title>To authorize grants for programs that provide support services to exonerees.</official-title>

<section id="HCADDC532C03C4DC687004823D424D7B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Restitution for the Exonerated Act of 2007</short-title></quote>.</text></section> 
<section id="HD4EC243B5BBB473EBF26BDCE9E5B08A9" section-type="subsequent-section"><enum>2.</enum><header>Grant program authorized</header> 
<subsection id="H92F9FB2BAF694B32A33EBEC504B89EC1"><enum>(a)</enum><header>Exoneree services grants authorized</header><text display-inline="yes-display-inline">The Attorney General may award grants to eligible organizations to carry out programs that provide support services to exonerees.</text></subsection> 
<subsection id="H884DBA085D8A493F881BD105E2F441B" commented="no"><enum>(b)</enum><header>Grant period; renewability</header><text display-inline="yes-display-inline">A grant awarded under this section shall be for a period of one year, and may be renewed for subsequent one-year periods as the Attorney General determines to be appropriate. </text></subsection> 
<subsection id="H41180FD727224FA2005B43363B9D93C3" commented="no"><enum>(c)</enum><header>Emergency grants</header><text display-inline="yes-display-inline">The Attorney General may award an emergency grant under this subsection to an eligible organization that is receiving a grant under <internal-xref idref="H92F9FB2BAF694B32A33EBEC504B89EC1" legis-path="2.(a)">subsection (a)</internal-xref>, in addition to such grant under <internal-xref idref="H92F9FB2BAF694B32A33EBEC504B89EC1" legis-path="2.(a)">subsection (a)</internal-xref>, if the Attorney General determines that there is a systemic problem related to the provision of exoneree support services in the geographic region serviced by such organization, and that there is a need to address such systemic problem immediately by increasing the resources available to such organization. Such an emergency grant shall be used by the eligible organization to address the immediate need for support services for exonerees in such region, shall be awarded for a period not to exceed 6 months, and shall not be renewable. An eligible organization may not receive more than one emergency grant under this subsection.</text></subsection> </section> 
<section id="H9EBC5367ED8D4D2CA7EA7385D4DA3500"><enum>3.</enum><header>Grant uses</header> <text display-inline="no-display-inline">A grant under this section shall be used by an eligible organization—</text> 
<paragraph id="HCD899C1CBC21497DB55FC82F67EBB776"><enum>(1)</enum><text>to carry out a program that provides and coordinates the delivery of support services for exonerees, including—</text> 
<subparagraph id="HE3C43F23B4BC4E6CA4006453128741DC"><enum>(A)</enum><text>employment training;</text></subparagraph> 
<subparagraph id="H5B8FF973360547D7007D00A7A4663E15"><enum>(B)</enum><text>vocational training;</text></subparagraph> 
<subparagraph id="H3D9D7B33B9C64B78936036C04BF2241E"><enum>(C)</enum><text>education;</text></subparagraph> 
<subparagraph id="HCAB8FB26B33A4320A15062F1926E8119"><enum>(D)</enum><text>health care services;</text></subparagraph> 
<subparagraph id="H46BED7CF98DE4BA6915003F883BFFBEC"><enum>(E)</enum><text>mental health services;</text></subparagraph> 
<subparagraph id="HDE3EAA9775A440C0B6ECB73D0689D671"><enum>(F)</enum><text>housing assistance;</text></subparagraph> 
<subparagraph id="H2D5A9EBB640D4E4187B6203BF7B71BE0"><enum>(G)</enum><text>substance abuse training;</text></subparagraph> 
<subparagraph id="H8509DF52F3774A1E9DB30051E3F67400"><enum>(H)</enum><text>legal assistance;</text></subparagraph> 
<subparagraph id="HA5F335B4ECD0488DA2007C08DD82BEC"><enum>(I)</enum><text>children and family support; and</text></subparagraph> 
<subparagraph id="H4817F8FD52C643029400A5CEB5E3FDEF"><enum>(J)</enum><text>other appropriate services, as determined by the Attorney General; and</text></subparagraph></paragraph> 
<paragraph id="HAFF47A711F8A4F018C765B20FB49DAD"><enum>(2)</enum><text>for administrative expenses necessary to carry out the program described in <internal-xref idref="HCD899C1CBC21497DB55FC82F67EBB776" legis-path="3.(a)(1)">paragraph (1)</internal-xref>, including staff salaries, research, and training. </text></paragraph> </section> 
<section id="HBCAA93152D9247ADA5B137E051F42857"><enum>4.</enum><header>Applications</header> 
<subsection id="HA4BFE758D5BD41B9BB95F4BF16BD77D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">To request a grant under this Act, an eligible organization shall submit an application to the Attorney General at such time, in such manner, and containing such information as the Attorney General may require. Such application shall—</text> 
<paragraph id="H719079113C3747F0813154ADC81E32D6"><enum>(1)</enum><text>describe the program to be funded by the grant, and the need for such program;</text></paragraph> 
<paragraph id="H2107DE6DA9464F17BF36A56F54C13B5"><enum>(2)</enum><text>describe a long-term strategy and detailed implementation for such program;</text></paragraph> 
<paragraph id="HE8C48D8C895647ABAA2516B68C92645E"><enum>(3)</enum><text display-inline="yes-display-inline">identify the governmental and community agencies with which the program will collaborate, and that the program will utilize to enhance exoneree services; and</text></paragraph> 
<paragraph id="H61450794A0CC426288211F6EB47E9851"><enum>(4)</enum><text>describe the methodology and outcome measures that will be used to evaluate the effectiveness of such program.</text></paragraph></subsection> 
<subsection id="H0DF6CFADD0234D47AAE22C382EFBE70"><enum>(b)</enum><header>Application deadlines</header><text>The Attorney General shall solicit and review applications for grants under this Act at least once during each six-month period.</text></subsection> 
<subsection id="H5C48E87A913349D4A3C810D4D46E180" commented="no"><enum>(c)</enum><header>Priority based on need</header><text>In awarding grants under this Act, the Attorney General shall give priority to eligible organizations that serve geographic regions that have the greatest need for exoneree support services, as determined by the Attorney General.</text> </subsection></section> 
<section id="H28E6D12706404DA184923BC5A3568514"><enum>5.</enum><header>Reports</header><text display-inline="no-display-inline">For each year in which an eligible organization receives a grant under this Act, the eligible organization shall submit a report to the Attorney General that describes the program carried out by the organization with such grant, and evaluates the effectiveness of such program during such year.</text></section> 
<section id="HE0653482BEF240DABA9BE588D66F5FE"><enum>6.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="H23C311CDC95A4C59AAC98264D3B969CF"><enum>(1)</enum><header>Eligible organization</header><text>The term <term>eligible organization</term> mean any nonprofit organization that—</text> 
<subparagraph id="H173FDC9FBC654F40883BCE5021F86E25"><enum>(A)</enum><text>has experience and expertise in coordinating and delivering support services specific to the needs of exonerees; or</text></subparagraph> 
<subparagraph id="H3D3231347654494D99CE00CFE98648E4"><enum>(B)</enum><text display-inline="yes-display-inline">demonstrates the capacity to effectively coordinate and deliver such support services, as determined by the Attorney General.</text> </subparagraph></paragraph> 
<paragraph id="H6A25FF3F4DF24994BCAC124BEF55E7E8"><enum>(2)</enum><header>Exoneree</header><text display-inline="yes-display-inline">The term <term>exoneree</term> means an individual who—</text> 
<subparagraph id="H6CCAB26222B54C71AB78177BAAE99B5F"><enum>(A)</enum><text display-inline="yes-display-inline">has been convicted by a Federal or State court of an offense that is punishable by a term of imprisonment that is equal to or greater than one year;</text></subparagraph> 
<subparagraph id="HC4EE26D35FC44FF7A6CB1C5F00E752E0"><enum>(B)</enum><text>has served a term of imprisonment of at least 6 months in a Federal or State prison or other correctional facility as a result of such conviction; and</text></subparagraph> 
<subparagraph id="H47EF5A2DC7524AAFA24EEBAA5FA88191"><enum>(C)</enum><text>has been determined to be factually innocent of such offense.</text></subparagraph></paragraph> 
<paragraph id="HC8A4038B3AB14C19AD833BA53BC5B74B"><enum>(3)</enum><header>Factually innocent</header><text display-inline="yes-display-inline">The term <term>factually innocent</term> means, with respect to an individual who has been convicted of an offense described in <internal-xref idref="H23C311CDC95A4C59AAC98264D3B969CF" legis-path="5.(1)">paragraph (2)(A)</internal-xref>, when one or more of the following has occurred:</text> 
<subparagraph id="H86147CAEEC8F414C875D0029B8DAB95"><enum>(A)</enum><text>A court has issued a factual finding of innocence.</text></subparagraph> 
<subparagraph id="H87088E6507034F45BA6FF15EB27800DB"><enum>(B)</enum><text>The Governor of the State in which the individual was convicted has issued a pardon based on the facts of the offense for which the individual was convicted.</text></subparagraph> 
<subparagraph id="HE954EDAF0BC74B50B99F49EA60977F5D"><enum>(C)</enum><text>The conviction has been vacated or reversed by a court.</text></subparagraph></paragraph></section> 
<section id="HADBA62DDC6D14A28B033EE00C4409E6"><enum>7.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated to carry out this Act $1,250,000 for each of the fiscal years 2008 through 2012. Amounts authorized under this section shall remain available until expended.</text> </section>
