		  Bureau of Land Management land in Chaves and Dona Ana Counties, New Mexico, and
		  to establish the Lesser Prairie Chicken National Habitat Preservation Area, and

		<section id="HB9833D56EAEA4E21A595771888BE8922" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Lesser Prairie Chicken National
			 Habitat Preservation Area Act of 2007</short-title></quote>.</text>
		</section><section id="HC8A5DFBC1CDB4E3FB31C38A27FC74DDD"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds as follows:</text>
			<paragraph id="HABE9171A3B004BFCA157BC8E828202DB"><enum>(1)</enum><text display-inline="yes-display-inline">The Sand Ranch Preservation Area is one of
			 the best strongholds of the Lesser Prairie Chicken and possibly the most
			 accessible place for the public to view them.</text>
			</paragraph><paragraph id="HEF2C568C8BD5457AAAF63524617C3B16"><enum>(2)</enum><text display-inline="yes-display-inline">The Preservation Area is also inhabited by
			 the Sand Dune Lizard, which is found nowhere else in the world except in the
			 sand dune blowout-shinnery oak habitat of southeast New Mexico and adjacent
			 areas of Texas.</text>
			</paragraph><paragraph id="H17779E9A068C4D6C8EAB651175373615"><enum>(3)</enum><text display-inline="yes-display-inline">Both the Lesser Prairie Chicken and the
			 Sand Dune Lizard are species of concern which will only benefit from additional
			 conservation. Such conservation will be achieved through the establishment of
			 the Sand Ranch Preservation Area.</text>
			</paragraph></section><section id="HD5933C69325E430D86C701999CE791E6"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="H1827DBDA41C341E1872639B686AB491E"><enum>(1)</enum><header>State
			 land</header><text display-inline="yes-display-inline">The term <term>State
			 land</term> means the land administered by the Secretary, acting through the
			 State, consisting of approximately 5,018 acres, as depicted on the map.</text>
			</paragraph><paragraph id="HB31AC6B4FE9A447AB3369E493D627304"><enum>(2)</enum><header>Map</header><text display-inline="yes-display-inline">The term <term>map</term> means the map
			 titled <quote>Lesser Prairie Chicken National Habitat Preservation Area and
			 Land Exchange</quote> and dated October 17, 2007.</text>
			</paragraph><paragraph id="HCCE5F9FFC5E4416ABE1089A0A5298938"><enum>(3)</enum><header>Non-Federal
			 land</header><text>The term <term>non-Federal land</term> means the
			 approximately 14,048 acres of State land, as depicted on the map.</text>
			</paragraph><paragraph id="HDB3DAD94967E45D8B143146BD24102C9"><enum>(4)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
			</paragraph><paragraph id="HC0746C17C382402BAD407686F58EAE36"><enum>(5)</enum><header>State</header><text>The
			 term <term>State</term> means the State of New Mexico.</text>
			</paragraph><paragraph id="HF7987BC264284BB582B2C0F041EBA553"><enum>(6)</enum><header>County</header><text>The
			 term <term>County</term> means the County of Chaves.</text>
			</paragraph><paragraph id="HB97BD54A6E7E4343A7BEA94871D843B0"><enum>(7)</enum><header>Preservation
			 Area</header><text>The term <term>Preservation Area</term> means the Lesser
			 Prairie Chicken National Habitat Preservation Area.</text>
			</paragraph></section><section id="H7AD64B968DDA496300E440F5B80900C8"><enum>4.</enum><header>Land
			 exchange</header>
			<subsection id="H795B71739325426A8F57004E00A4FF56"><enum>(a)</enum><header>In
			 General</header><text display-inline="yes-display-inline">The Secretary shall
			 convey to the State all right, title, and interest of the United States in and
			 to the Federal land.</text>
			</subsection><subsection id="H4857B4093349445BB089DFE52235176B"><enum>(b)</enum><header>Consideration</header><text>As
			 consideration for the conveyance of the Federal land under subsection (a), the
			 State shall convey to the United States all right, title, and interest of the
			 State in and to the non-Federal land.</text>
			</subsection><subsection id="HB6031E749B8A475000D0E4B1F541004E"><enum>(c)</enum><header>Interests
			 Included in Exchange</header><text>Subject to valid existing rights, the land
			 exchange under this Act shall include the conveyance of all surface,
			 subsurface, mineral, and water rights to the Federal land and non-Federal
			 land.</text>
			</subsection><subsection id="HDC8C902DD21849B39C38A1D55C8D00EB"><enum>(d)</enum><header>Compliance With
			 Federal Land Policy and Management Act</header><text>The Secretary shall carry
			 out the land exchange under this Act in accordance with section 206 of the
			 Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1716">43 U.S.C. 1716</external-xref>).</text>
			</subsection><subsection id="H81F72667E5EE4E02BD58A7E8F2EE69D5"><enum>(e)</enum><header>No Amendment to
			 Management Plan Required</header><text>The exchange of Federal land and
			 non-Federal land shall not require an amendment to the Mimbres Resource
			 Management Plan.</text>
			</subsection><subsection id="H87D642C50F3042A28663D99E0668195"><enum>(f)</enum><header>Additional Terms
			 and Conditions</header><text>The Secretary may require such additional terms
			 and conditions for the land exchange as the Secretary considers to be
			 appropriate to protect the interests of the United States.</text>
			</subsection></section><section id="H324D369126254EB10041869DF8D1052"><enum>5.</enum><header>Lesser prairie
			 chicken national habitat preservation area</header>
			<subsection id="HD926BEF30B964EB3B92308BDD6F0D9AB"><enum>(a)</enum><header>Establishment;
			 Purposes</header><text display-inline="yes-display-inline">There is established
			 in the County the Lesser Prairie Chicken National Habitat Preservation Area to
			 protect, conserve, and enhance habitat for the Lesser Prairie Chicken.</text>
			</subsection><subsection id="H0699BF9F7A1645829C5FD5001CA8C370"><enum>(b)</enum><header>Boundaries</header><text display-inline="yes-display-inline">The Preservation Area shall consist of
			 approximately 39,462 acres of public land in the County, including those lands
			 acquired under section 4, as generally depicted on the map.</text>
			</subsection><subsection id="HF95A0234B687418FBA1D6724DDF2D9F7"><enum>(c)</enum><header>Maps and Legal
			 Description</header>
				<paragraph id="H1806720826614E3C84B71550F6769DB"><enum>(1)</enum><header>In
			 General</header><text>Not later than 30 days after the date of the enactment of
			 this Act, the Secretary shall submit to Congress a map and legal description of
			 the Preservation Area.</text>
				</paragraph><paragraph id="H5E45260B0CEB430BB4DA75497F4DD3C"><enum>(2)</enum><header>Force and
			 Effect</header><text>The map and legal description submitted under paragraph
			 (1) shall have the same force and effect as if included in this Act, except
			 that the Secretary may correct clerical and typographical errors in the map and
			 legal description.</text>
				</paragraph><paragraph id="H57E4251E5BB242CB9CDC3711A5858D4F"><enum>(3)</enum><header>Public
			 Availability</header><text>Copies of the map and legal description submitted
			 under paragraph (1) shall be on file and available for public inspection
			 in—</text>
					<subparagraph id="HA09D23E986B5443DA59B2EFFDE56503C"><enum>(A)</enum><text>the Office of the
			 Director of the Bureau of Land Management;</text>
					</subparagraph><subparagraph id="H8DB3F2564E6E40E18C444424FD5BB21F"><enum>(B)</enum><text>the Office of the
			 State Director;</text>
					</subparagraph><subparagraph id="HC7343D2D497947CCAE69FC50EBF764B7"><enum>(C)</enum><text>the Office of the
			 Pecos District Manager of the Bureau of Land Management; and</text>
					</subparagraph><subparagraph id="H0BBBF2EB30534F7B92E1EF1B44738A1"><enum>(D)</enum><text>the Office of the
			 County Clerk in Roswell, New Mexico.</text>
					</subparagraph></paragraph></subsection></section><section id="H5A8891C0AD36468EBF35ED4665FAFD46"><enum>6.</enum><header>Management of the
			 preservation area</header>
			<subsection id="H9BC6A7B182F14F608DFA8C9530D33139"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary shall
			 manage the Preservation Area—</text>
				<paragraph id="H08B37B1C9AD34740AD3D41B61D06C5A4"><enum>(1)</enum><text>in a manner that
			 protects, conserves, and enhances the habitat for the Lesser Prairie Chicken;
			 and (2) in accordance with—</text>
					<subparagraph id="H1CD6AA5B4B3E43DF828D178428BEB182"><enum>(A)</enum><text>this Act;</text>
					</subparagraph><subparagraph id="H892A8B5F915940A3825CDCB61376CAD1"><enum>(B)</enum><text>the Federal Land
			 Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>); and</text>
					</subparagraph><subparagraph id="HD01E9BC710C1498783383DABEB248814"><enum>(C)</enum><text>any other
			 applicable laws.</text>
					</subparagraph></paragraph></subsection><subsection id="HEEFC7547CF8D4761A997B2D5A4A35521"><enum>(b)</enum><header>Uses</header>
				<paragraph id="H8D183A15A0D24340A18577199DD4693"><enum>(1)</enum><header>In
			 General</header><text>The Secretary shall allow only uses of the Preservation
			 Area that the Secretary determines will further the purposes for which the
			 Preservation Area is established.</text>
				</paragraph><paragraph id="H37EEE73D68644309AF48C0A7ADC372CA"><enum>(2)</enum><header>Use of Motorized
			 Vehicles</header><text>Except as needed for administrative purposes or to
			 respond to an emergency, the use of motorized vehicles or mechanized transport
			 in the Preservation Area shall be allowed only on roads and trails designated
			 for vehicular use under the management plan so long as such use is in
			 conformance with the purposes of this Act.</text>
				</paragraph></subsection><subsection id="H13FDCB60FC414622AD8FE23CF5FEE83B"><enum>(c)</enum><header>Withdrawals</header><text>Subject
			 to valid existing rights (including lease rights) and historic rights of
			 access, all Federal land within the Preservation Area and any land and
			 interests in land acquired for the Preservation Area by the United States after
			 the date of the enactment of this Act are withdrawn from—</text>
				<paragraph id="H20A48466F38A4CCCA9858FB891EB58E1"><enum>(1)</enum><text>all forms of
			 entry, appropriation, or disposal under the public land laws;</text>
				</paragraph><paragraph id="H9C0561DBE29C4FAABAF6941F7C97F5D"><enum>(2)</enum><text>location, entry,
			 and patent under the mining laws; and</text>
				</paragraph><paragraph id="H4F792758F084494981BF3BF3C5D86994"><enum>(3)</enum><text>disposal under the
			 mineral leasing, mineral materials, and geothermal leasing laws.</text>
				</paragraph></subsection><subsection id="HA8A3645D382C46729220D7C92400AC5D"><enum>(d)</enum><header>Hunting and
			 Trapping</header>
				<paragraph id="H96DD8CE174A44522A8C26E91CBBB002B"><enum>(1)</enum><header>In
			 general</header><text>Subject to paragraph (2), hunting and trapping shall be
			 allowed in the Preservation Area.</text>
				</paragraph><paragraph id="H9D16A35CDDF5439E008361ADED6C5453"><enum>(2)</enum><header>Limitations</header>
					<subparagraph id="HDE4E54F7A8CF46E4B6C34DDFAE1F6E7"><enum>(A)</enum><header>Regulations</header><text>The
			 Secretary may designate by regulation areas in which, and establish periods
			 during which, for reasons of public safety, administration, or compliance with
			 applicable laws, no hunting or trapping will be permitted in the Preservation
			 Area.</text>
					</subparagraph><subparagraph id="H50C99469C5F045AB9B8B4958E3E43929"><enum>(B)</enum><header>Consultation</header><text>Except
			 in emergencies, the Secretary shall consult with, and obtain the approval of,
			 the appropriate State agency before promulgating regulations under subparagraph
			 (A) that close a portion of the Preservation Area to hunting and
			 trapping.</text>
					</subparagraph></paragraph></subsection><subsection id="H95037024122C403DAC0265879C2187ED"><enum>(e)</enum><header>Grazing</header><text>The
			 Secretary may allow grazing solely for the purpose of vegetative management to
			 enhance Lesser Prairie Chicken habitat.</text>
			</subsection><subsection id="H694F9EA05D024A15BF00557600EC3919"><enum>(f)</enum><header>No Buffer
			 Zones</header>
				<paragraph id="H874584F1A6F747E09BFC94DACAD3C692"><enum>(1)</enum><header>In
			 general</header><text>There shall be no protective perimeter or buffer zone
			 around the Preservation Area.</text>
				</paragraph><paragraph id="H6DE426178F014F27A391AB431F329BF3"><enum>(2)</enum><header>Activities
			 Outside Preservation Area</header><text>The fact than an activity or use of
			 land is not permitted on land within the Preservation Area shall not preclude
			 the activity or use outside the boundary of the Preservation Area or on private
			 land within the Preservation Area, consistent with other applicable law.</text>
				</paragraph></subsection><subsection id="H9F1D80C3B34B40228E58478C6FC7651D"><enum>(g)</enum><header>Acquisition of
			 Land</header>
				<paragraph id="H90F64A157AF14FE091B56988729CF007"><enum>(1)</enum><header>In
			 General</header><text>The Secretary may acquire non-Federal land in the
			 Preservation Area only—</text>
					<subparagraph id="H08680F2DA2B84CAAA817F2AD98D904B"><enum>(A)</enum><text>from a willing
			 seller; and</text>
					</subparagraph><subparagraph id="H000D1027A8D747EE8E44BD8632C63ECA"><enum>(B)</enum><text>through purchase,
			 exchange, or donation.</text>
					</subparagraph></paragraph><paragraph id="H3AAE39DB151F485B8E001FD784B6875"><enum>(2)</enum><header>Management</header><text>Land
			 acquired under paragraph (1) shall by managed as part of the Preservation Area
			 in accordance with this Act.</text>
				</paragraph></subsection><subsection id="H4AEC7085756F4C4E8317063E3FCD00D1"><enum>(h)</enum><header>Interpretative
			 Sites</header><text>The Secretary may establish sites in the Preservation Area
			 to permit the interpretation of the historical, cultural, scientific,
			 archaeological, natural, and education resources of the Preservation
			 Area.</text>
			</subsection><subsection id="H619619320FD74830BDCB253FA963037E"><enum>(i)</enum><header>Water
			 Rights</header><text>Nothing in this Act constitutes an express or implied
			 reservation of any water right.</text>
			</subsection></section><section id="HF22D5F98853A4C2FB722E7FD744C9FDF"><enum>7.</enum><header>Management
			 plan</header>
			<subsection id="H8A3CDE066A624F8BBD4BDA22EF72F778"><enum>(a)</enum><header>In
			 General</header><text display-inline="yes-display-inline">Not later than 1 year
			 after the date of the enactment of this Act, the Secretary shall develop a
			 comprehensive plan for the long-range protection and management of the
			 Preservation Area.</text>
			</subsection><subsection id="HE1B66F8C52A54A6AB191D14B60E24785"><enum>(b)</enum><header>Contents</header><text>The
			 management plan shall—</text>
				<paragraph id="HB2EE83A8E9014B30A89F79BA0000E38F"><enum>(1)</enum><text>describe the
			 appropriate uses and management of the Preservation Area in accordance
			 with—</text>
					<subparagraph id="HAF00057A39DC4956920006F5782D14BC"><enum>(A)</enum><text>this Act;</text>
					</subparagraph><subparagraph id="H28E9B55B5E8948838FA82C69AD2551F1"><enum>(B)</enum><text>the Federal Land
			 Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>); and</text>
					</subparagraph><subparagraph id="HE106824285A044DAA832786E009021E0"><enum>(C)</enum><text>other applicable
			 laws;</text>
					</subparagraph></paragraph><paragraph id="H600AEF6AACDC48D0A1020737E33F4B9B"><enum>(2)</enum><text>incorporate, as
			 appropriate, decisions in any other management or activity plan for the land
			 within or adjacent to the Preservation Area; and</text>
				</paragraph><paragraph id="H4CFCB07588604ACD84E717B472005928"><enum>(3)</enum><text>take into
			 consideration—</text>
					<subparagraph id="H04F1778873524AAE9D514BAA8435FE00"><enum>(A)</enum><text>any information
			 developed in studies of the land within or adjacent to the Preservation Area;
			 and</text>
					</subparagraph><subparagraph id="HDF7CEC68A1FA4F44A4B83C2E18ED812"><enum>(B)</enum><text>the historical
			 involvement of the local community in the interpretation and protection of the
			 resources of the Preservation Area.</text>
					</subparagraph></paragraph></subsection></section></legis-body>
