		<section commented="no" display-inline="no-display-inline" id="H51299969535C400AB1B5CE34A2ACBC89" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>War Profiteering Prevention Act of
			 2007</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="HFB49D8709F9248D89DB86C3EF25B7F" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Prohibition of profiteering</header>
			<subsection commented="no" display-inline="no-display-inline" id="HC68150F29A8243D38EAD23E7AEF06F5F"><enum>(a)</enum><header display-inline="yes-display-inline">Prohibition</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H2CF2E8CD46274518A654C1B3FEB4B71"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/47">Chapter 47</external-xref> of title 18,
			 United States Code, is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H22F1916EA2FB4CEFB7D02BECCDC9077F" style="USC">
						<section commented="no" display-inline="no-display-inline" id="HF9EF63BD59214ACC9F6621AF59283D64" section-type="subsequent-section"><enum>1040.</enum><header display-inline="yes-display-inline">War profiteering and fraud</header>
							<subsection commented="no" display-inline="no-display-inline" id="HA5E83136EEFD4EF890585F15D2B347D0"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">Whoever, in any matter involving a contract
				with, or the provision of goods or services to, the United States or a
				provisional authority, in connection with a mission of the United States
				Government overseas, knowingly—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="HF46CBD2E09144BB8AE7F69B6B6E33538"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H2EA1F49441654F2FACB0ECC93398A700"><enum>(A)</enum><text display-inline="yes-display-inline">executes or attempts to execute a scheme or
				artifice to defraud the United States or that authority; or</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H79D3466A90B440DD9DF9CE042064859F" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">materially overvalues any good or service
				with the intent to defraud the United States or that authority;</text>
									</subparagraph><continuation-text commented="no" continuation-text-level="paragraph">shall be fined not more than
				$1,000,000 or imprisoned not more than 20 years, or both; or</continuation-text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0F57739067B6457CB944AF5DE7B988DC"><enum>(2)</enum><text>in connection with
				the contract or the provision of those goods or services—</text>
									<subparagraph id="H4049932DFAAC4CC2A5B861E535D3ED73"><enum>(A)</enum><text>falsifies,
				conceals, or covers up by any trick, scheme, or device a material fact;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2B71D03203BE4D1B8480E3408E74462E"><enum>(B)</enum><text display-inline="yes-display-inline">makes any materially false, fictitious, or
				fraudulent statements or representations; or</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H626C1CB421E5409CB36437AA7958E1C7"><enum>(C)</enum><text display-inline="yes-display-inline">makes or uses any materially false writing
				or document knowing the same to contain any materially false, fictitious, or
				fraudulent statement or entry;</text>
									</subparagraph><continuation-text commented="no" continuation-text-level="paragraph">shall be fined not more than
				$1,000,000 or imprisoned not more than 10 years, or both.</continuation-text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H3969B96B32B249B4ADDDC592FD346A6"><enum>(b)</enum><header display-inline="yes-display-inline">Extraterritorial jurisdiction</header><text display-inline="yes-display-inline">There is extraterritorial Federal
				jurisdiction over an offense under this section.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="H3935BED53EDE4ECD9999044E46A5BC3"><enum>(c)</enum><header display-inline="yes-display-inline">Venue</header><text display-inline="yes-display-inline">A prosecution for an offense under this
				section may be brought—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="H5E15EF02EFD445829F5670AD87C7F092"><enum>(1)</enum><text display-inline="yes-display-inline">as authorized by chapter 211 of this
				title;</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H03B76BC23AD14A7788DD52BECB659026"><enum>(2)</enum><text display-inline="yes-display-inline">in any district where any act in
				furtherance of the offense took place; or</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCD1E434A345E4192B704E00089004E13"><enum>(3)</enum><text display-inline="yes-display-inline">in any district where any party to the
				contract or provider of goods or services is
				located.</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H17A3E030819A463DB4CD15CD2DE58FC1"><enum>(2)</enum><header display-inline="yes-display-inline">Table of sections</header><text display-inline="yes-display-inline">The table of sections for chapter 47 of
			 title 18, United States Code, is amended by adding at the end the
			 following:</text>

							<toc-entry bold="off" level="section">1040. War profiteering and
				fraud.</toc-entry>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H2315AD4A47E7456700684839D700BAEB"><enum>(b)</enum><header display-inline="yes-display-inline">Criminal forfeiture</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/982">Section 982(a)(2)(B)</external-xref> of title 18,
			 United States Code, is amended by striking <quote>or 1030</quote> and inserting
			 <quote>1030, or 1040</quote>.</text>
			</subsection><subsection id="H36BEB7D7AB0448FCA0DB7984C1E83702"><enum>(c)</enum><header>Money
			 laundering</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/1956">Section 1956(c)(7)(D)</external-xref> of title 18,
			 United States Code, is amended by inserting <quote>section 1040 (relating to
			 war profiteering and fraud),</quote> after <quote>liquidating agent of
			 financial institution),</quote>.</text>
			</subsection><subsection id="HC6770BD69894474A9B205205EEE82F04"><enum>(d)</enum><header>RICO</header><text>Section
			 1961(1) of title 18, United States Code, is amended by inserting <quote>section
			 1040 (relating to war profiteering and fraud),</quote> after <quote>in
			 connection with access devices),</quote>.</text>
