<official-title display="yes">To amend title 23, United States Code, to improve the safety of Federal-aid highway bridges, to strengthen bridge inspection standards and processes, to increase investment in the reconstruction of structurally deficient bridges on the National Highway System, and for other purposes. </official-title>

<section id="H19D93C7A84994876ADB95036563CFD7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Highway Bridge Reconstruction and Inspection Act of 2008</short-title></quote>.</text> </section> 
<section id="HEDFAFFD42BBF4586B161E020F9B85306"><enum>2.</enum><header>Highway bridge program</header> 
<subsection id="HE7318B115E884F89A812582302D0C2EC"><enum>(a)</enum><header>Bridges on Federal-aid highways</header> 
<paragraph id="H65932022E2104B42A08349EA47BCC127"><enum>(1)</enum><header>Risk-based prioritization for replacement and rehabilitation of deficient bridges</header><text><external-xref legal-doc="usc" parsable-cite="usc/23/144">Section 144</external-xref> of title 23, United States Code, is amended by striking subsections (b) and (c) and inserting the following:</text> 
<quoted-block style="OLC" id="H7DCDC19791E347BD8E504DB750F58912" display-inline="no-display-inline"> 
<subsection id="H139DE573B88843648F17E3975C30604F"><enum>(b)</enum><header>Bridges on Federal-aid highways</header><text display-inline="yes-display-inline">The Secretary, in consultation with the States, shall—</text> 
<paragraph id="H23A06357ADF7499DAA63FC189657F32C"><enum>(1)</enum><text>inventory all bridges on Federal-aid highways that are bridges over waterways, other topographical barriers, other highways, and railroads;</text></paragraph> 
<paragraph id="H40C6A5DE71694E2BB9E84600CFE2B571" commented="no"><enum>(2)</enum><text>identify each bridge inventoried under paragraph (1) that is structurally deficient or functionally obsolete;</text></paragraph> 
<paragraph id="HA35BDBD59E6548D3AA207BEA001CD702"><enum>(3)</enum><text display-inline="yes-display-inline">assign a risk-based priority for replacement or rehabilitation of each such bridge after consideration of safety, serviceability, and essentiality for public use and public safety, including the potential impacts to emergency evacuation routes and to regional and national freight and passenger mobility if the serviceability of the bridge is restricted or diminished; and</text></paragraph> 
<paragraph id="H1A00D804FFE64037AB0153897F654010"><enum>(4)</enum><text>determine the cost of replacing each such bridge with a comparable facility or of rehabilitating such bridge.</text></paragraph></subsection> 
<subsection id="HAB2AEF2526D14BF3AB6033736744F902"><enum>(c)</enum><header>Bridges on other public roads</header> 
<paragraph id="H67E7E7662AE1480383A8A5F52772E140"><enum>(1)</enum><header>Inventory of bridges</header><text>The Secretary, in consultation with the States, shall—</text> 
<subparagraph id="H9C96E936B65A4C1CBE257DC100129B8B"><enum>(A)</enum><text>inventory all those highway bridges on public roads, other than those on any Federal-aid highway, which are bridges over waterways, other topographical barriers, other highways, and railroads;</text></subparagraph> 
<subparagraph id="HCD60B36248EF4567B4CCD0D69FCEDC11"><enum>(B)</enum><text>identify each bridge inventoried under subparagraph (A) that is structurally deficient or functionally obsolete;</text></subparagraph> 
<subparagraph id="HBC5C204C242041E3BFC0B106936C2970"><enum>(C)</enum><text display-inline="yes-display-inline">assign a risk-based priority for replacement or rehabilitation of each such bridge after consideration of safety, serviceability, and essentiality for public use and public safety, including the potential impacts to emergency evacuation routes and to regional and national freight and passenger mobility if the serviceability of the bridge is restricted or diminished; and</text></subparagraph> 
<subparagraph id="H2A451055027C4710A102E200B695DDEF"><enum>(D)</enum><text>determine the cost of replacing each such bridge with a comparable facility or of rehabilitating such bridge.</text></subparagraph></paragraph> 
<paragraph id="HDF513FFDD9A14954A7A3C138D95BE00"><enum>(2)</enum><header>Inventory of bridges for historic significance</header><text>The Secretary may, at the request of a State, inventory bridges, on and off Federal-aid highways, for historic significance.</text></paragraph> 
<paragraph id="HAE6579C8C19B4B8F8DC2723707F5AE27"><enum>(3)</enum><header>Inventory of Indian reservation and park bridges</header><text>As part of the activities carried out under paragraph (1), the Secretary, in consultation with the Secretary of the Interior, shall—</text> 
<subparagraph id="H75B9447FEEDE4B719631DA8FCC5F05E"><enum>(A)</enum><text>inventory all those highway bridges on Indian reservation roads and park roads which are bridges over waterways, other topographical barriers, other highways, and railroads;</text></subparagraph> 
<subparagraph id="H70C12B7ADBE7494F00557BAE77E3BA8D"><enum>(B)</enum><text display-inline="yes-display-inline">identify each bridge inventoried under subparagraph (A) that is structurally deficient or functionally obsolete;</text></subparagraph> 
<subparagraph id="H4FAAD060B2DB4D59A1D7B9D315C313EF"><enum>(C)</enum><text display-inline="yes-display-inline">assign a risk-based priority for replacement or rehabilitation of each such bridge after consideration of safety, serviceability, and essentiality for public use and public safety, including the potential impacts to emergency evacuation routes and to regional and national freight and passenger mobility if the serviceability of the bridge is restricted or diminished; and</text></subparagraph> 
<subparagraph id="HA511CB20D3834FED82812F8FECBAE8C"><enum>(D)</enum><text>determine the cost of replacing each such bridge with a comparable facility or of rehabilitating such bridge.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H530669DC6AD94959A31EF674B3D905E"><enum>(2)</enum><header>Process for assigning risk-based priorities</header> 
<subparagraph id="H233AC1824F704B1381F454003FD5E4FA"><enum>(A)</enum><header>Deadline for establishment</header><text display-inline="yes-display-inline">After modifying national bridge inspection standards in accordance with the amendments made by section 3 and not later than 18 months after the date of enactment of this Act, the Secretary, in consultation with the States, shall establish a process for assigning risk-based priorities under sections 144(b)(3), 144(c)(1)(C), and 144(c)(3)(C) of title 23, United States Code, as amended by paragraph (1) of this subsection.</text></subparagraph> 
<subparagraph id="H80E2BAE50E484E8B9784F3DA2C900108"><enum>(B)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">Not later than 18 months after the date of enactment of this Act, the Secretary shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Environment and Public Works of the Senate a report containing a description of the process for assigning risk-based priorities established under subparagraph (A).</text></subparagraph> 
<subparagraph id="HC8C7271FCF574ED1AA15F43EACA64400" display-inline="no-display-inline"><enum>(C)</enum><header>Independent review</header> 
<clause id="HA3BABEB81CB741FCA68D74B503C1DFAA"><enum>(i)</enum><header>Participation of National Academy of Sciences</header><text>Not later than 18 months after the date of enactment of this Act, the Secretary shall enter into appropriate arrangements with the National Academy of Sciences to permit the Academy to conduct an independent review of the process for assigning risk-based priorities established under subparagraph (A).</text></clause> 
<clause id="H35A082B4B6ED48CBA31D19263CEAAF7F"><enum>(ii)</enum><header>Report to Congress</header><text>Not later than 2 years after the date of enactment of this Act, the Academy shall submit a report on the results of the review to the Secretary, the Committee on Transportation and Infrastructure of the House of Representatives, and the Committee on Environment and Public Works of the Senate.</text></clause> 
<clause id="H22F4B0FE4F9448A5BAC83400A976AD1"><enum>(iii)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this subparagraph $2,000,000 for fiscal year 2009. Such sums shall remain available until expended.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="HB0CC3F0DA53E49F18726E5E9D9A74357" commented="no"><enum>(b)</enum><header>Apportionment</header><text display-inline="yes-display-inline">Section 144(e) of such title is amended by adding at the end the following: <quote>In this subsection, the term <quote>deficient bridge</quote> means a bridge that is structurally deficient or functionally obsolete.</quote>.</text></subsection> 
<subsection id="H4915DAD9117C42AD93DEE716B7CCA930"><enum>(c)</enum><header>Participation</header><text>Section 144(d) of such title is amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="H190F95F445EC4D6B9300B59083229BCE" display-inline="no-display-inline"> 
<paragraph id="HF31270C761B548FD00158E34A5C8161D"><enum>(5)</enum><header>Requirements for State participation</header> 
<subparagraph id="HE6C26109A3A942DB00FB89E0EAE1C598"><enum>(A)</enum><header>In general</header><text>As a condition for providing assistance to a State under this section, the Secretary shall require the State to take the following actions:</text> 
<clause id="H7CEB37361F814143AB9FB9A3EAE24D23"><enum>(i)</enum><header>Inspections</header><text display-inline="yes-display-inline">Not later than 24 months after the date of enactment of this paragraph, and at least once every 24 months thereafter (except as otherwise provided by section 151(d)), the State shall inspect all highway bridges described in subsections (b) and (c) that are located in the State in accordance with the standards established under section 151 and provide updated information on such bridges to the Secretary for inclusion in the national bridge inventory. </text></clause> 
<clause id="HB6FA60AB732045D7A44C1287D5CE1DA3"><enum>(ii)</enum><header>Calculation of load ratings</header><text display-inline="yes-display-inline">The State shall—</text> 
<subclause id="H4578B9FC6A1A47088DC8E2625E218424"><enum>(I)</enum><text>not later than 24 months after the date of enactment of this paragraph, calculate the load rating for all highway bridges described in subsections (b) and (c) that are located in the State;</text></subclause> 
<subclause id="HC7D46791F30343919ED1F55C1061FEE"><enum>(II)</enum><text>at least once every 24 months thereafter, reevaluate and, as appropriate, recalculate the load rating for each such bridge; and</text></subclause> 
<subclause id="H770B4BA551F447C2A55F0015029E2153"><enum>(III)</enum><text>ensure that the safe load-carrying capacities for such bridges are properly posted.</text></subclause></clause> 
<clause id="HCFE73F2BA64E49AE8C823BB6745D9D3D" commented="no"><enum>(iii)</enum><header>Performance plan</header><text>The State shall develop, not later than 24 months after the date of enactment of this paragraph, update annually, and implement a 5-year performance plan for—</text> 
<subclause id="H6C397C2831224A9CA9F9786DC8F9D5F8"><enum>(I)</enum><text>the inspection of highway bridges described in subsections (b) and (c) that are located in the State; and</text></subclause> 
<subclause id="H609B3F037A7D40DA913F39CB7CBF12F8"><enum>(II)</enum><text>the rehabilitation and replacement of any of such bridges that are structurally deficient or functionally obsolete.</text></subclause></clause> 
<clause id="H1345028FD9C743FD8400B6AE004400AE"><enum>(iv)</enum><header>Bridge management system</header><text>Notwithstanding section 303(c), the State shall develop and implement a bridge management system that meets the requirements of section 303.</text> </clause></subparagraph> 
<subparagraph id="HCB019AC1976649F190009800ABD7AC43"><enum>(B)</enum><header>Approval of performance plans</header> 
<clause id="H8AA819156DF3428EBB51EA34AE00BCB7"><enum>(i)</enum><header>Submission to the secretary</header><text>A State that establishes a 5-year performance plan under subparagraph (A)(iii) shall submit the plan and each update of the plan to the Secretary for approval.</text></clause> 
<clause id="HFF09F3AC4C644DAF86DE51518DC7EE5"><enum>(ii)</enum><header>Criteria for approval</header><text>Not later than 1 year after the date of enactment of this paragraph, the Secretary shall establish criteria for the approval of performance plans and updates submitted under clause (i).</text> </clause> 
<clause id="HCCB5AFDDBD914436B1DEDF51D77B659D"><enum>(iii)</enum><header>Approval and disapproval</header><text>The Secretary shall approve or disapprove each 5-year performance plan and update submitted by a State under this subparagraph. If the Secretary disapproves a plan or update, the Secretary shall inform the State of the reasons for the disapproval and shall require the State to resubmit the plan or update with such modifications as the Secretary determines necessary.</text></clause></subparagraph> 
<subparagraph id="HA716FF7A8634488EB9B4071572748FA5" display-inline="no-display-inline"><enum>(C)</enum><header>Historic bridges</header> 
<clause id="H06E284F923044063ACE8958347D2ED5"><enum>(i)</enum><header>In general</header><text>A 5-year performance plan of a State under subparagraph (A)(iii) may provide for more frequent, in-depth inspection of a historic bridge located in the State in lieu of replacement of the bridge if the Secretary determines that—</text> 
<subclause id="H724D3D881B0D4C4AAECF14A236BC6EC"><enum>(I)</enum><text>it is appropriate based on the age, design, traffic characteristics, and any known deficiency of the bridge; and</text></subclause> 
<subclause id="HAA61948070C54C2AB3667E234FE6EBB4"><enum>(II)</enum><text>granting the exception will increase the overall safety of the State’s bridge inventory. </text></subclause></clause> 
<clause id="H4A16AC5B800F427D9454B2DFDEE7616B"><enum>(ii)</enum><header>Historic bridge defined</header><text>In this subparagraph, the term ‘historic bridge’ means any bridge that is listed on the National Register of Historic Places. </text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H773491BA19A94BBC8C769C85439150F6"><enum>(d)</enum><header>Information and reports</header><text display-inline="yes-display-inline">Section 144(h) of such title is amended to read as follows:</text> 
<quoted-block style="OLC" id="H451F0D59129F419EAA9FE355A3509269" display-inline="no-display-inline"> 
<subsection id="HCC41C87123914853BA70ED8135CE941B" display-inline="no-display-inline"><enum>(h)</enum><header>Information and reports</header> 
<paragraph id="HFC0F46DD3B4A4BAD95C4A4433E61115E"><enum>(1)</enum><header>Updates of information</header><text display-inline="yes-display-inline">The Secretary shall annually revise, as necessary, the information required under subsections (b) and (c).</text></paragraph> 
<paragraph id="H14877264AD0B4A8B9C626704A0BFDED6"><enum>(2)</enum><header>Reports to Congress</header><text>Concurrently with the President’s annual budget submission to Congress under <external-xref legal-doc="usc" parsable-cite="usc/31/1105">section 1105(a)</external-xref> of title 31, the Secretary shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Environment and Public Works of the Senate a report containing—</text> 
<subparagraph id="H04FA665FB4C84AE9994E846FD7C0F3C"><enum>(A)</enum><text>a description of projects and activities approved under this section;</text></subparagraph> 
<subparagraph id="H4B9DCB6888654022B33FF3BA47C5FFAC"><enum>(B)</enum><text>the information updated under paragraph (1), including a description of the priority assigned, on a national basis and by State, for the replacement or rehabilitation of each structurally deficient or functionally obsolete bridge on a Federal-aid highway;</text></subparagraph> 
<subparagraph id="HCB9DB0F4967B4CAFA6FF5C157E653772"><enum>(C)</enum><text>a description of any project or activity carried out by a State under this section in the preceding fiscal year that is inconsistent with the priorities assigned by the Secretary under subsection (b)(3), (c)(1)(C), and (c)(3)(C); and</text></subparagraph> 
<subparagraph id="H41AD0DCEA77449430029247D2F81CBC3"><enum>(D)</enum><text display-inline="yes-display-inline">such recommendations as the Secretary may have for improvements of the program authorized by this section.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HEAF22F9F54054A73ABE55F1B10F233A"><enum>(e)</enum><header>Transferability of funding</header><text>Section 144 of such title is amended by inserting after subsection (r) the following:</text> 
<quoted-block style="OLC" id="H043B52D92358415191698C4FF1AB3CB" display-inline="no-display-inline"> 
<subsection id="HF438403E2DDA42D9B367F7A85579ED00" commented="no"><enum>(s)</enum><header>Transferability of funding</header><text>Notwithstanding section 126 or any other provision of law, a State may transfer funds apportioned to the State under this section for a fiscal year to another apportionment of funds to the State under this title only if the State demonstrates to the satisfaction of the Secretary that there are not any bridges on the National Highway System located in the State that are eligible for replacement.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H1CE0608530BE45E5B21CFFA1B3D49130"><enum>(f)</enum><header>Definitions</header><text>Section 144 of such title is further amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="H5940B1C22F9749A0BB407087A9F74F48" display-inline="no-display-inline"> 
<subsection id="H5744EFE3557F4F2081E088EC56268599"><enum>(t)</enum><header>Definitions</header><text>In this section, the following definitions apply:</text> 
<paragraph id="HFE27176E5F694750A34E7B8669C1467"><enum>(1)</enum><header>Functionally obsolete</header><text>The term <quote>functionally obsolete</quote> as used with respect to a bridge means a bridge that no longer meets current design standards relating to geometrics, including roadway width, shoulder width, and approach alignment, for the traffic demands on the bridge.</text></paragraph> 
<paragraph id="H7FDCF1A28E0748C59947DFC97346D29B" commented="no"><enum>(2)</enum><header>Structurally deficient</header><text display-inline="yes-display-inline">The term <quote>structurally deficient</quote> as used with respect to a bridge means a bridge that has—</text> 
<subparagraph id="H1B8D666ECBA64D928F2814CC77A17387"><enum>(A)</enum><text>significant load-carrying elements that are in poor or worse condition due to deterioration or damage, or both;</text></subparagraph> 
<subparagraph id="HFFC5E846524449399928B3FB83D6B400"><enum>(B)</enum><text>a load capacity that is significantly below current truckloads and that requires replacement; or</text></subparagraph> 
<subparagraph id="H93B872DCDE6F49B99653002448CB619D"><enum>(C)</enum><text>a waterway opening causing frequent flooding of the bridge deck and approaches resulting in significant traffic interruptions.</text></subparagraph></paragraph> 
<paragraph id="HF207124589AA4B98A10746DBC9A881E5"><enum>(3)</enum><header>Rehabilitation</header><text display-inline="yes-display-inline">The term <quote>rehabilitation</quote> means major work necessary to restore the structural integrity of a bridge and work necessary to correct a major safety defect.</text></paragraph> 
<paragraph id="H203ABDB4930F4B0A9619333407AEC55D"><enum>(4)</enum><header>Replacement</header><text>The term <quote>replacement</quote> as used with respect to a structurally deficient or functionally obsolete bridge means a new facility constructed in the same general traffic corridor that meets the geometric, construction, and structural standards, in effect at the time of such construction, required for the types and volume of projected traffic of the facility over its design life.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H577C08AD19224A77BA1574FA1EF1D4DD"><enum>(g)</enum><header>National bridge inventory</header> 
<paragraph id="H9C3567B7A7924B6F8CBE9B7EC879C900"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall take necessary actions to make information contained in the national bridge inventory established under <external-xref legal-doc="usc" parsable-cite="usc/23/144">section 144</external-xref> of title 23, United States Code, more readily available to the public, including actions to make the information easier to understand.</text></paragraph> 
<paragraph id="H1F35D82CE5CF4009B25437E0D1355ECB"><enum>(2)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this subsection $2,000,000 for fiscal year 2009. Such sums shall remain available until expended.</text></paragraph></subsection></section> 
<section id="H9466143F6B0B4184A6104FB6D7C62E38"><enum>3.</enum><header>National bridge inspection program</header> 
<subsection id="HA88C977018E549FBB097C0819800EA2B" commented="no"><enum>(a)</enum><header>National bridge inspection standards</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/23/151">Section 151(a)</external-xref> of title 23, United States Code, is amended by adding at the end the following: <quote>The standards established under this subsection shall be designed to ensure uniformity among the States in the conduct of such inspections and evaluations.</quote>.</text></subsection> 
<subsection id="HDAF7C5F8D5C0401189E8D56488B0FF2D"><enum>(b)</enum><header>Minimum requirements of inspection standards</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/23/151">Section 151(b)</external-xref> of title 23, United States Code, is amended—</text> 
<paragraph id="H377F122B2928466EAB03E0750058C0F"><enum>(1)</enum><text>in paragraph (4) by striking <quote>and</quote> at the end;</text></paragraph> 
<paragraph id="H0DBAB5E27769485480265471E0256C00"><enum>(2)</enum><text>in paragraph (5) by striking the period at the end and inserting a semicolon; and</text></paragraph> 
<paragraph id="H7D0055D1535846CE93A03426B4EEFF"><enum>(3)</enum><text>by adding at the end the following:</text> 
<quoted-block style="OLC" id="H30C1B269A9B147C980B327104EB675DE" display-inline="no-display-inline"> 
<paragraph id="H5A6D2F36D1704B1781002249F02D4398"><enum>(6)</enum><text>establish procedures for conducting annual compliance reviews of State inspections, quality control and quality assurance procedures, load ratings, and weight limit postings of structurally deficient highway bridges;</text></paragraph> 
<paragraph id="H1DDC0E206F4D4C938CD9AC66957DF46E"><enum>(7)</enum><text>establish procedures for States to follow in reporting to the Secretary—</text> 
<subparagraph id="H0EB9F4765C0F4EFDAC6C64C0EE4BED8C"><enum>(A)</enum><text>critical findings relating to structural or safety-related deficiencies of highway bridges; and</text></subparagraph> 
<subparagraph id="H7612CEF21ABD46AB95EE3B52B6FFDE"><enum>(B)</enum><text>monitoring activities and corrective actions taken in response to such a finding; and</text></subparagraph></paragraph> 
<paragraph id="H8F25993F2F3C4774BD5C30BFD428BF0" commented="no"><enum>(8)</enum><text display-inline="yes-display-inline">provide for testing with a state-of-the-art technology that detects growth activity of fatigue cracks as small as 0.01 inches on steel bridges exhibiting fatigue damage or bridges with fatigue susceptible members.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H8842B5D54A404CDCBCF309C7E8F89019"><enum>(c)</enum><header>Regulations on critical findings of bridge deficiencies</header> 
<paragraph id="HA8D59EB48740492191E8C56791528F9"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this Act, the Secretary of Transportation shall issue regulations establishing procedures to be used by States in reporting critical findings of bridge deficiencies, and subsequent monitoring activities and corrective actions, to the Secretary in accordance with the standards to be established under <external-xref legal-doc="usc" parsable-cite="usc/23/151">section 151(b)(7)</external-xref> of title 23, United States Code, as added by subsection (b)(3) of this section.</text></paragraph> 
<paragraph id="HAAF1C147180742B1981D80EB00C94392"><enum>(2)</enum><header>Contents</header><text>Regulations to be issued under paragraph (1) shall—</text> 
<subparagraph id="H0027FBA4AAE64906AE56935C72809497"><enum>(A)</enum><text>establish a uniform definition of the term <quote>critical finding</quote>;</text></subparagraph> 
<subparagraph id="H0AC661B1568841F7A85DBBCD9969CEA2"><enum>(B)</enum><text>establish deadlines for State reporting of critical finding determinations to the Secretary;</text></subparagraph> 
<subparagraph id="H12AC22255481468191FDC76BFFD3F31"><enum>(C)</enum><text>establish requirements for monitoring and follow-up actions and reporting following a critical finding determination; and</text></subparagraph> 
<subparagraph id="HAECB32D8B15448E7BB2D738F14F195EF"><enum>(D)</enum><text>provide for enhanced training of bridge inspectors relating to critical findings.</text></subparagraph></paragraph></subsection> 
<subsection id="H685A55C86E82468683C0C1450527D3DC" commented="no"><enum>(d)</enum><header>Training program for all bridge inspectors</header><text>Section 151(c) of such title is amended by adding at the end the following: <quote>The Secretary shall expand the scope of the training program to ensure that all persons conducting highway bridge inspections receive appropriate training and certification under the program.</quote>.</text></subsection> 
<subsection id="HA3BC2B61276E4339B6CC8F5500B6C048"><enum>(e)</enum><header>Frequency of bridge inspections</header><text>Section 151 of such title is amended—</text> 
<paragraph id="HACEE7AB9790E4A49AD05BA4375C35C42"><enum>(1)</enum><text>in subsection (b)(2) by inserting <quote>in accordance with subsection (d)</quote> before the semicolon; </text></paragraph> 
<paragraph id="H670D2509382D4E54B81F0832CBC06DDD"><enum>(2)</enum><text>by redesignating subsection (d) as subsection (e); and</text></paragraph> 
<paragraph id="H56AEABB895E54086A53C913FA2EC23F0"><enum>(3)</enum><text>by inserting after subsection (c) the following:</text> 
<quoted-block style="OLC" id="H23C266F854F54DE990D0993359995852" display-inline="no-display-inline"> 
<subsection id="H06F65B15CA074D5B82CC1D1DB1761F92"><enum>(d)</enum><header>Frequency of bridge inspections</header> 
<paragraph id="H4C359D917BBA4A7585CA5B12CF8113E1"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to paragraph (2), the standards established under subsection (a), at a minimum, shall provide for—</text> 
<subparagraph id="H9D9BA616FF5D4B1090ECC49EE4B20474"><enum>(A)</enum><text>annual inspections of structurally deficient highway bridges using the best practicable technologies and methods;</text></subparagraph> 
<subparagraph id="H95961606C20A4423B63C949F55623559"><enum>(B)</enum><text display-inline="yes-display-inline">annual in depth inspections of fracture critical members, as such terms are defined in <external-xref legal-doc="regulation" parsable-cite="cfr/23/650.305">section 650.305</external-xref> of title 23, Code of Federal Regulations (as in effect on the date of enactment of this paragraph); and</text></subparagraph> 
<subparagraph id="HC56C83FD09C34D88B37792C451FEC64F"><enum>(C)</enum><text display-inline="yes-display-inline">biennial inspections of highway bridges that have not been determined to be structurally deficient.</text></subparagraph></paragraph> 
<paragraph id="HDF408C9A0D7548FC84D84B45CF8E8D12"><enum>(2)</enum><header>Extensions</header><text display-inline="yes-display-inline">Upon the request of a State, the Secretary may extend, to a maximum period of 48 months, the time between required inspections of a highway bridge that has not been determined to be structurally deficient if the Secretary determines that—</text> 
<subparagraph id="H11223D373C994AF984AFAB4D5922CF20"><enum>(A)</enum><text>the extension is appropriate based on the age, design, traffic characteristics, and any known deficiency of the bridge;</text></subparagraph> 
<subparagraph id="H4FEF7EC7A43C4C60003D53E8B2306900"><enum>(B)</enum><text>the extension is consistent with the 5-year performance plan of the State approved under section 144(d)(5)(B); and</text></subparagraph> 
<subparagraph id="HAAE21634F1784A36A75BE600AEC65A6"><enum>(C)</enum><text>granting the extension will increase the overall safety of the State’s bridge inventory.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HF2546A9CB3224A7DB054422400142C08"><enum>(f)</enum><header>Qualifications of program managers and team leaders</header> 
<paragraph id="H7EFA1A7088514BB180BA205437623E14"><enum>(1)</enum><header>Revision of regulations</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary of Transportation shall revise regulations contained in <external-xref legal-doc="regulation" parsable-cite="cfr/23/650.309">section 650.309</external-xref> of title 23, Code of Federal Regulations, relating to the qualifications of highway bridge inspection personnel, to require that, in addition to meeting the qualifications identified in such section (as in effect on the date of enactment of this Act)—</text> 
<subparagraph id="H98496E26C02F47C6B9567F7E6FE56E25"><enum>(A)</enum><text>an individual serving as the program manager of a State be a professional engineer licensed under the laws of that State;</text></subparagraph> 
<subparagraph id="HFF6A4121486D4EE5A5CBD8B719B16084"><enum>(B)</enum><text>an individual serving as a team leader for a State for the inspection of complex bridges or follow-up inspections of bridges for which there has been a critical finding be a licensed professional engineer; and</text></subparagraph> 
<subparagraph id="H77886A6D34274C238C7502D9953279FB"><enum>(C)</enum><text>an individual serving as a team leader for a State for the inspection of all other bridges be a licensed professional engineer or have at least 10 years of bridge inspection experience.</text></subparagraph></paragraph> 
<paragraph id="H83B692BE165A4C0BA1CB17FF9BC800B3"><enum>(2)</enum><header>Applicability</header><text>The additional qualification requirements specified in paragraphs (1)(A), (1)(B), and (1)(C) shall apply only to an individual selected by a State to serve as the program manager or a team leader after the date of issuance of revised regulations under paragraph (1).</text></paragraph> 
<paragraph id="H6CA22E18C6674F03B709942BA242BAD9"><enum>(3)</enum><header>Complex bridge defined</header><text display-inline="yes-display-inline">In this subsection, the term “complex bridge” means a highway bridge with unusual characteristics, including movable, suspension, and cable-stayed highway bridges.</text></paragraph></subsection> 
<subsection id="H727D821A33374E739C3307985BB42EC0"><enum>(g)</enum><header>Effective date</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall modify national bridge inspection standards and modify the training program for bridge inspectors in accordance with the amendments made by this section.</text> </subsection> 
<subsection id="H569949A565104D3FB700B14E2B44D6AD" display-inline="no-display-inline"><enum>(h)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">Not later than 15 days after a critical finding determination is made by a State which results in the closure of a bridge, the Secretary of Transportation shall report to the appropriate Committees of Congress regarding the impact, including the economic impact, on regional transportation and transit that will result from the such bridge closure and recommend solutions to mitigate such impact.</text></subsection></section> 
<section id="HDF7B4016912545F0A1AC4732B3B7DC25" display-inline="no-display-inline" section-type="subsequent-section"><enum>4.</enum><header>GAO study</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, the Comptroller General shall conduct a study and report its findings to the Secretary of Transportation regarding—</text> 
<paragraph id="H030B2B8DA2C04DAEA86F4D0334419ED0"><enum>(1)</enum><text>the identification of factors that contribute to construction delays of bridge rehabilitation; and</text></paragraph> 
<paragraph id="H3743FCB7344A49E69331A774F6A70233"><enum>(2)</enum><text>any recommendations the Comptroller General may have to simplify and expedite the construction of bridges that are to be rehabilitated.</text></paragraph></section> 
<section id="H6AC62D34E0854553B100930927BCD300"><enum>5.</enum><header>Surface transportation research</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/23/502">Section 502(d)</external-xref> of title 23, United States Code, is amended—</text> 
<paragraph id="H4C4D9C8C1A9C4DE684DF7F94FF989C79"><enum>(1)</enum><text>in paragraph (2) in the matter preceding subparagraph (A) by inserting <quote>and enhance the safety</quote> before <quote>of bridge structures</quote>; and</text></paragraph> 
<paragraph id="H6466EFB7D5674437891CCFD9CE2617A7"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (4) by striking <quote>for use with existing infrastructure facilities and with next-generation infrastructure facilities</quote> and inserting <quote>for assessing the structural integrity of existing infrastructure facilities and next-generation infrastructure facilities</quote>.</text></paragraph></section> 
<section id="H1E246A9FF9C5408482D88D6700A2A208"><enum>6.</enum><header>Authorization of appropriations</header> 
<subsection id="H9619AD6074E94D0AB9EA405E858D5B7E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out <external-xref legal-doc="usc" parsable-cite="usc/23/144">section 144</external-xref> of title 23, United States Code, $1,000,000,000 for fiscal year 2009.</text></subsection> 
<subsection id="H6F092ABA63644DC593726CCBB0E3A6FB"><enum>(b)</enum><header>Apportionment and use of funds</header><text>Funds appropriated pursuant to subsection (a)—</text> 
<paragraph id="HCE9E441C8AF8402E9D66E9C555FB3857"><enum>(1)</enum><text>shall be apportioned among the States under paragraphs (1) and (2) of section 144(e) of such title;</text></paragraph> 
<paragraph id="H038E835798084732A66CB5961721FD00"><enum>(2)</enum><text>shall be used for the replacement and rehabilitation of structurally deficient highway bridges on the National Highway System; and</text></paragraph> 
<paragraph id="HFAB670393BAD4F308C1949F491558B8C"><enum>(3)</enum><text display-inline="yes-display-inline">shall be available for obligation in the same manner as other funds apportioned under chapter 1 of such title, except that such funds shall not be transferable and shall remain available until expended.</text></paragraph></subsection> 
<subsection id="HBE888CD0B1B94278ACCC06CBF32725A"><enum>(c)</enum><header>Limitation</header><text>None of the funds appropriated pursuant to subsection (a) may be earmarked by Congress or any Federal department or agency for a specific project or activity.</text></subsection> 
<subsection id="H7AC2AB07344944BEBA05AFE3424BC1BE"><enum>(d)</enum><header>Compliance with Immigration and Nationality Act</header><text display-inline="yes-display-inline">None of the funds appropriated pursuant to subsection (a) may be used to employ workers in violation of section 274A of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1324a">8 U.S.C. 1324a</external-xref>).</text></subsection></section> 
<section id="H9F6B1AAB6F934E98AF1314C973140018"><enum>7.</enum><header>Bridge advanced condition assessment pilot program</header> 
<subsection id="H0908BD7F6C1A494EAB393857D69B3087"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary of Transportation shall establish and implement a pilot program to evaluate the effectiveness, accuracy, and reliability of the use of advanced condition assessment inspection processes and technologies (including fiber optic, vibrating wire, acoustical emissions, and peak strain displacement technologies) in monitoring and evaluating the structural health of a highway bridge. Technologies evaluated under the pilot program shall be real-time sensing technologies that record objective data to determine accurate conditions assessments of critical bridge elements.</text></subsection> 
<subsection id="H03DAFED455034C469FFD3BBD283E7335"><enum>(b)</enum><header>Grants</header> 
<paragraph id="H0766E79A775F4FA0BF3667E4C064B8FA"><enum>(1)</enum><header>In general</header><text>The Secretary may make grants to States to conduct projects under the pilot program.</text></paragraph> 
<paragraph id="H32B3929ABE974250A1C10384083B5F11"><enum>(2)</enum><header>Applications</header><text>A State seeking a grant under the pilot program shall submit an application to the Secretary in such form and containing such information as the Secretary may require by regulation.</text></paragraph></subsection> 
<subsection id="HBE3F3338B8424FDB81E9B10087E57285"><enum>(c)</enum><header>Eligibility</header> 
<paragraph id="H4F3CE5DE44F24DAF925337A54861E43"><enum>(1)</enum><header>Selection of highway bridges</header> 
<subparagraph id="H0A9B5F6CE9E8435E9D343F0004D2767D"><enum>(A)</enum><header>In general</header><text>In awarding grants under the pilot program, the Secretary shall select not more than 15 highway bridges in not more than 5 States for participation in the program.</text></subparagraph> 
<subparagraph id="H33FC49A11AB547E38416B30574ED2B2"><enum>(B)</enum><header>Bridge requirements</header><text>The Secretary may select a highway bridge under subparagraph (A) only if the bridge is—</text> 
<clause id="H8226EA2160514FF581B00CB155BB0F2"><enum>(i)</enum><text>as of the date of enactment of this Act, classified as structurally deficient under <external-xref legal-doc="usc" parsable-cite="usc/23/144">section 144</external-xref> of title 23, United States Code;</text></clause> 
<clause id="H7A571523BF21486BA56D299289DA927F" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">a nonredundant, fracture critical structure; and</text></clause> 
<clause id="HF2A45862E72D493F8EA5F89D3300CC89"><enum>(iii)</enum><text>greater than 200 feet in length.</text></clause></subparagraph></paragraph> 
<paragraph id="HA20C5094644F4D40B196881D662B2D00"><enum>(2)</enum><header>Selection and use of technologies</header> 
<subparagraph id="H14526709FEC74446A5F411C79B3C226F"><enum>(A)</enum><header>In general</header><text>The Secretary shall select no fewer than 2 types of real-time, in-service, sensor-based, commercially-available, advanced-condition assessment technologies to be used in the pilot program.</text></subparagraph> 
<subparagraph id="HDA6821092011436D84A57213B9124B85"><enum>(B)</enum><header>Duration of real-time data collection</header><text>The duration of real-time data collection from each highway bridge selected for participation in the pilot program shall be not less than 1 year.</text></subparagraph> 
<subparagraph id="H80F4BCC2FC1C47F389819D71B92BB714"><enum>(C)</enum><header>Use of calibrated finite element analysis model</header><text>At least one-half of the highway bridges selected for participation in the pilot program shall also be evaluated using a calibrated finite element analysis model of the bridge, based upon data from the advanced condition assessment technologies.</text></subparagraph></paragraph></subsection> 
<subsection id="HDD49CA6E7D1B43FD8F3407FF16CDAFE2"><enum>(d)</enum><header>Federal share</header><text>The Federal share payable on account of a project carried out under the pilot program shall be 80 percent of the cost of the project.</text></subsection> 
<subsection id="H8F1B4BFEC61944FD884CA93522E70091"><enum>(e)</enum><header>Duration of the pilot program</header><text display-inline="yes-display-inline">The Secretary shall carry out the pilot program for a period of 2 fiscal years. </text></subsection> 
<subsection id="HBB9713BBB9A144E990922BBA4158D3B3"><enum>(f)</enum><header>Final report</header> 
<paragraph id="H36B8D60FF95040EABC7E6D1BA645D910"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 6 months after the last day of the pilot program, the Secretary shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Environment and Public Works of the Senate a report that describes the effectiveness and benefits of the pilot program carried out under this section.</text></paragraph> 
<paragraph id="H83EEC603274D4FAF9295E35FDC08A7D1"><enum>(2)</enum><header>Contents</header><text>The report shall describe, at a minimum––</text> 
<subparagraph id="HAF3530AE704E4BF08500C4117F56344F"><enum>(A)</enum><text>the cost effectiveness of the technologies and processes selected;</text></subparagraph> 
<subparagraph id="H51FDAF0C1BA6496F9884E404DE4C3E7"><enum>(B)</enum><text>the objectivity, reliability, and accuracy of the technologies and processes employed in providing condition assessments of the highway bridge;</text></subparagraph> 
<subparagraph id="HEB353AB530574BB6969F3C6DB9D6DBCD"><enum>(C)</enum><text>the quality of the data collected and measured; and</text></subparagraph> 
<subparagraph id="H68FBE7C2F7394C22B792E84C3C5C4D"><enum>(D)</enum><text>any recommendations for improving or expanding the pilot program or the use of structural health monitoring technologies or processes, including a suggested plan for wider adoption based on potential highway bridge repair and replacement savings by the Federal Government and State governments.</text></subparagraph></paragraph></subsection> 
<subsection id="H9798D337719249C98327BF64768E6616"><enum>(g)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out this section $5,000,000.</text></subsection> 
<subsection id="H7EFCE2A68CA74A51AC87DF13766902F"><enum>(h)</enum><header>Availability of amounts</header><text>Amounts appropriated to carry out this section shall be available for obligation in the same manner as funds apportioned under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/1">chapter 1</external-xref> of title 23, United States Code, except that such funds shall not be transferable and shall remain available until expended.</text></subsection></section> 
<section id="H6C1B78997413489C91A08E7DF535E292" display-inline="no-display-inline" section-type="subsequent-section"><enum>8.</enum><header>Effectiveness of bridge rating system</header> 
<subsection id="H390282C29F5C4C7DA3D558F37C4DEEA6"><enum>(a)</enum><header>Study</header><text>The Comptroller General shall conduct a study of the effectiveness of the bridge rating system of the Federal Highway Administration, including the use of the terms <quote>structurally deficient</quote> and <quote>functionally obsolete</quote> to describe the condition of highway bridges in the United States.</text></subsection> 
<subsection id="H0D9137559FE34582A0F33923EF00A778"><enum>(b)</enum><header>Evaluation of State systems</header><text>In conducting the study, the Comptroller General shall evaluate bridge rating systems used by State departments of transportation and provide recommendations on how successful aspects of such bridge rating systems may be incorporated into the bridge rating system of the Federal Highway Administration.</text></subsection> 
<subsection id="HC9D49F3E09774BAFA3C2493FA3B13C1"><enum>(c)</enum><header>Report</header><text>Not later than February 1, 2009, the Comptroller General shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on the Environment and Public Works of the Senate a report on the results of the study.</text></subsection></section> 
<section id="H6CBABC9D8ED047390070963CC20660DF" display-inline="no-display-inline" section-type="subsequent-section"><enum>9.</enum><header>Use of carbon fiber composite materials in bridge replacement and rehabilitation projects</header> 
<subsection id="H834CDC49A29D456D90A1C8F47FBF1EA9"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">The Secretary of Transportation shall conduct a study of the cost benefits of using carbon fiber composite materials in bridge replacement and rehabilitation projects instead of traditional construction materials.</text></subsection> 
<subsection id="H209173AEEA244A35BA344BBE979ED001"><enum>(b)</enum><header>Report</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall transmit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Environment and Public Works of the Senate a report on the results of the study conducted under this section.</text></subsection></section> 
<section id="H81F2FEB120064C5FB0CBF520E7A16650" display-inline="no-display-inline" section-type="subsequent-section"><enum>10.</enum><header>Sense of congress</header><text display-inline="no-display-inline">It is the sense of Congress that each State should prepare a corrosion mitigation and prevention plan, for a project for construction, replacement, or rehabilitation of a bridge, that includes the following:</text> 
<paragraph id="H349FD90F5AC24F689F325D86F182FC4"><enum>(1)</enum><text display-inline="yes-display-inline">An estimate of the expected useful life of the bridge.</text></paragraph> 
<paragraph id="H581A87729E4D41BBA6D64939F8BFC900"><enum>(2)</enum><text>An estimate of environmental exposure of the bridge, including marine, deicer application, industrial, rural, rainfall, temperature, freeze-thaw, and other factors that influence corrosion prevention and corrosion mitigation strategies.</text></paragraph> 
<paragraph id="H29E10418837941598D322F8800EB5E41"><enum>(3)</enum><text>An identification of the functional classification of the bridge.</text></paragraph> 
<paragraph id="H047A952E76C24EA094721956EDA5CBF3"><enum>(4)</enum><text>Details of corrosion mitigation and prevention methods that will be used with respect to the bridge, taking into account—</text> 
<subparagraph id="HF629345174704B9890956B6DA629FFC0"><enum>(A)</enum><text>material selection;</text></subparagraph> 
<subparagraph id="HF4E78148FA1E41AD92B301A118C27453"><enum>(B)</enum><text>coating considerations;</text></subparagraph> 
<subparagraph id="H7B8BB90AF79F4F2692CE1EED06CB786"><enum>(C)</enum><text>cathodic protection considerations;</text></subparagraph> 
<subparagraph id="HC17BC53F26684C39BDE144DA1F8DBC89"><enum>(D)</enum><text>design considerations for corrosion; and</text></subparagraph> 
<subparagraph id="H6B65CA94A64E4C5298664F11FA7BBF40"><enum>(E)</enum><text>concrete requirements.</text></subparagraph></paragraph> 
<paragraph id="H592957793E74403FA0B9FFC44DD5CF9C" display-inline="no-display-inline"><enum>(5)</enum><text>Details of a project maintenance program for the life of the bridge.</text></paragraph> 
<paragraph id="HFEF875DBA07440DB8646EB3467DD3D00"><enum>(6)</enum><text>A certification that the plan was developed by the State or States and approved by a corrosion expert.</text></paragraph> 
<paragraph id="H4A9D9AEF04104D7382E7D8691DA7F260"><enum>(7)</enum><text>A certification that each individual conducting inspections of Federal-aid highway bridges in the State or States receives training from a corrosion expert.</text></paragraph></section> 
<section id="H7368A91340B34F489F9D924FFF6E0026" display-inline="no-display-inline" section-type="subsequent-section"><enum>11.</enum><header>Flood risks to bridges</header> 
<subsection id="HEED031F98C524990AF56B9EAA005FD4"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">The Secretary of Transportation, in consultation with the States, shall conduct a study of the risks posed by floods to bridges on Federal-aid highways, bridges on other public roads, bridges on Indian reservations, and park bridges that are located in a 500-year floodplain. </text></subsection> 
<subsection id="H7F1D23DB794C4C5AAA9889B7E203243"><enum>(b)</enum><header>Considerations</header><text>In conducting the study, the Secretary shall give consideration to safety, serviceability, essentiality for public use, and public safety, including the potential impacts to regional and national freight and passenger mobility if the serviceability of a bridge is restricted or diminished. </text></subsection> 
<subsection id="H0340EF0368544C2D8BC6236707D6A5E"><enum>(c)</enum><header>Report</header><text>Not later than 2 years after the date of enactment of this Act, the Secretary shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Environment and Public Works of the Senate a report on the results of the study.</text></subsection></section> 
<section id="H2C4D70BF596F456DA919995E59534806" display-inline="no-display-inline" section-type="subsequent-section"><enum>12.</enum><header>National tunnel inspection program</header> 
<subsection id="HE352414E165040F0B6CFD0B1BD3FB300"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Title 23, United States Code, is amended by inserting after section 149 the following:</text> 
<quoted-block style="USC" display-inline="no-display-inline" id="HDFC0EDC979484D69A4E0C49377BDDB80"> 
<section id="H0B15F7574531474C8BDD5DCB4C6CB4C2"><enum>150.</enum><header>National tunnel inspection program</header><text display-inline="yes-display-inline"></text> 
<subsection id="H33678097BC3C477494C700D7E4D216DE"><enum>(a)</enum><header>National tunnel inspection standards</header><text display-inline="yes-display-inline">The Secretary, in consultation with State transportation departments and interested and knowledgeable private organizations and individuals, shall establish national tunnel inspection standards for the proper safety inspection and evaluation of all highway tunnels. The standards established under this subsection shall be designed to ensure uniformity among the States in the conduct of such inspections and evaluations.</text></subsection> 
<subsection id="H5FB24C050DE54076B0939E43935C54BA"><enum>(b)</enum><header>Minimum requirements for inspection standards</header><text>The standards established under subsection (a) shall, at a minimum—</text> 
<paragraph id="H32CC2784B26C4E389D669F8484691064"><enum>(1)</enum><text>specify, in detail, the method by which highway tunnel inspections shall be carried out by the States;</text></paragraph> 
<paragraph id="HDEFE5EBA67B84EDD888560A0009B4F61"><enum>(2)</enum><text>establish the maximum time period between the inspections based on a risk-management approach;</text></paragraph> 
<paragraph id="HD423F50D552D4800B1C59E4A6D3E8AA"><enum>(3)</enum><text>establish the qualifications for those charged with carrying out the inspections;</text></paragraph> 
<paragraph id="H8C362CE3D7824552B048449970471465"><enum>(4)</enum><text display-inline="yes-display-inline">require each State to maintain and make available to the Secretary upon request—</text> 
<subparagraph id="H8531F2514F4B48A1838F59CBD05DFE3"><enum>(A)</enum><text>written reports on the results of the inspections together with notations of any action taken pursuant to the findings of the inspections; and</text></subparagraph> 
<subparagraph id="HE26977EEDC5D4F34A6AB016E44D09B22"><enum>(B)</enum><text>current inventory data for all highway tunnels located in the State reflecting the findings of the most recent highway tunnel inspections conducted;</text></subparagraph></paragraph> 
<paragraph id="HC1FACCF164A54DFE9391EA9367A1AF5C"><enum>(5)</enum><text>establish procedures for national certification of highway tunnel inspectors;</text></paragraph> 
<paragraph id="HF291B95203EB4F1099BD0AB53FB3240"><enum>(6)</enum><text display-inline="yes-display-inline">establish procedures for conducting annual compliance reviews of State inspections and State implementation of quality control and quality assurance procedures; and</text></paragraph> 
<paragraph id="H671AF5D990D64274ADDCA4CA7168BFFE"><enum>(7)</enum><text>establish standards for State tunnel management systems to improve the tunnel inspection process and the quality of data collected and reported by the States to the Secretary for inclusion in the national tunnel inventory to be established under this section.</text></paragraph></subsection> 
<subsection id="H086B53DEA407418AAAE287564C6B3826"><enum>(c)</enum><header>Training and certification program for tunnel inspectors</header><text>The Secretary, in cooperation with State transportation departments, shall establish a program designed to ensure that all individuals carrying out highway tunnel inspections receive appropriate training and certification. Such program shall be revised from time to time to take into account new and improved techniques.</text></subsection> 
<subsection id="H5D3208F59034448B9242BC1E746E8065" commented="no"><enum>(d)</enum><header>National tunnel inventory</header><text display-inline="yes-display-inline">The Secretary shall establish a national inventory of highway tunnels reflecting the findings of the most recent highway tunnel inspections conducted by States under this section.</text></subsection> 
<subsection id="H4C0710FBA9AB412BA9E5B4E75C584B6B"><enum>(e)</enum><header>Availability of funds</header><text display-inline="yes-display-inline">To carry out this section, the Secretary may use funds made available pursuant to the provisions of sections 104(a) and 502.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H562F4B72C03A44B19F349BE925704185"><enum>(b)</enum><header>Surface transportation program</header><text>Section 133(b)(1) of such title is amended by inserting <quote>, tunnels that are eligible for assistance under this title (including safety inspection of such tunnels),</quote> after <quote>highways)</quote>.</text></subsection> 
<subsection id="HDFB0704A5477496E005D1DAAB19CE187"><enum>(c)</enum><header>Conforming amendment</header><text>The analysis for chapter 1 of such title is amended by inserting after the item relating to section 149 the following:</text>
