			 dioxide emission reductions</header>
			<section id="H1AD732272DB240A6ABC5107FB41053CD"><enum>101.</enum><header>Findings and
			 purposes</header>
				<subsection id="H223073EB55AE4B9DB67867178FDE7F8F"><enum>(a)</enum><header>Findings</header><text>Congress
			 finds that—</text>
					<paragraph id="HF09C50009952431987D900D1EB96662F"><enum>(1)</enum><text>fossil fuel-fired
			 electric generating units emit approximately <fraction>1/3</fraction> of the
			 total mercury and carbon dioxide emission in the United States;</text>
					</paragraph><paragraph id="HF3E9A3C31CBA4434ACF7BF0575C25CD"><enum>(2)</enum><text>the Environmental
			 Protection Agency has yet to adequately address the emissions of either mercury
			 or carbon dioxide;</text>
					</paragraph><paragraph id="HDD67FDB301684D8489B7CCC9DBF1CBEA"><enum>(3)</enum><text>owners of electric
			 generating units seek regulatory certainty when complying with environmental
			 standards; and</text>
					</paragraph><paragraph id="H938F165513B641D38066C5D066DA1C06"><enum>(4)</enum><text>many states have
			 already taken action, either by themselves or in partnerships, to reduce their
			 emissions of mercury and carbon dioxide.</text>
					</paragraph></subsection><subsection id="HCA3B6B17227540C5B83E563FA7AD7CA"><enum>(b)</enum><header>Purposes</header><text>The
			 purposes of this Act are—</text>
					<paragraph id="H105797D6CA284C66844517820575971F"><enum>(1)</enum><text>to protect the
			 quality of our Nation’s air and water quality by substantially reducing the
			 emissions from fossil fuel-fired electric generating units;</text>
					</paragraph><paragraph id="H2E039D7E73FA4678AD2B00D1ABBA33AE"><enum>(2)</enum><text>to reduce the
			 impact of climate change by limiting emissions of carbon dioxide;</text>
					</paragraph><paragraph id="HF2BBFCB1006442DA9200B4520800CDA2"><enum>(3)</enum><text>to enhance human
			 and wildlife health by limiting emissions of mercury; and</text>
					</paragraph><paragraph id="HB8795B6C20BF448DB31FF97DEBED1B4"><enum>(4)</enum><text>to
			 develop and promote sources of clean energy that do not require the burning of
			 fossil fuels.</text>
					</paragraph></subsection></section><section id="H587D97DEFB1B4CAAB8EDEC85F41C957C"><enum>102.</enum><header>Mercury and
			 carbon dioxide emissions reductions</header><text display-inline="no-display-inline">The Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401 et seq.</external-xref>)
			 is amended by adding at the end the following:</text>

						<section id="H443A9A9277D44D48B3BE54F2DD06B104"><enum>701.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
							<paragraph id="H3724B584A0F04944B9E33F42B6DEA742"><enum>(1)</enum><header>Affected
				unit</header><text>The term <quote>affected unit</quote> means a coal-fired
				electric generating facility (including a cogeneration facility) that—</text>
								<subparagraph id="HC26535260D81455E9E6842D019F657DA"><enum>(A)</enum><text>has a nameplate
				capacity greater than 25 megawatts; and</text>
								</subparagraph><subparagraph id="H2FA7D51987754858A441953494B2FDD6"><enum>(B)</enum><text>generates
				electricity for sale.</text>
								</subparagraph></paragraph><paragraph id="H1F08CEA7C6C342E08D4DABCDE8766E22"><enum>(2)</enum><header>Cogeneration
				facility</header><text>The term <quote>cogeneration facility</quote> means a
				facility that—</text>
								<subparagraph id="HAC17EA3BDA76471F82A18F0600E6D9AB"><enum>(A)</enum><text>cogenerates—</text>
									<clause id="H32C29BD83CF543879496D9BA9257106B"><enum>(i)</enum><text>steam; and</text>
									</clause><clause id="HEA2BF1F94680432386C8F23237CEBAFC"><enum>(ii)</enum><text>electricity;
				and</text>
									</clause></subparagraph><subparagraph id="HEAC7F0385D684E70008CFB575FA51194"><enum>(B)</enum><text>supplies, on a net
				annual basis, to any utility power distribution system for sale—</text>
									<clause id="H66D0C5EF37594A51B9C8ACF7A5CB698F"><enum>(i)</enum><text>more than
				<fraction>1/3</fraction> of the potential electric output capacity of the
				facility; and</text>
									</clause><clause id="HC913DC1CE2F24CACBBB64963AC65DA36"><enum>(ii)</enum><text>more than 25
				megawatts of electrical output of the facility.</text>
									</clause></subparagraph></paragraph></section><section id="HEB7B61DC030E4C5B88FFE6DF8EDFCCE3"><enum>702.</enum><header>Mercury
				reduction program</header>
							<subsection id="H6B16950CEA2B40DFB2A02751568BD084"><enum>(a)</enum><header>New unit
				requirement</header><text>Any affected unit that commences operation after
				December 31, 2008, shall be considered a new unit for the purposes of this
				section and shall not exceed the emission limit of 0.6 pounds mercury per
				trillion Btu (0.6 lb Hg/TBtu) upon commencement of operation.</text>
							</subsection><subsection id="H01D1873D6C96473595B8D285B7F64834"><enum>(b)</enum><header>Existing unit
				requirement</header><text>Any affected unit that commences operation on or
				before December 31, 2008, shall not exceed the emission limit of 0.6 pounds
				mercury per trillion Btu by January 1, 2011.</text>
							</subsection><subsection id="H05EB9DD78BFA42C29DE7A3DEEA372442"><enum>(c)</enum><header>Monitoring
				system</header><text>Not later than January 1, 2009, the Administrator shall
				promulgate regulations requiring operation, reporting and certification of
				continuous emissions monitoring systems (CEMS) to accurately measure the
				quantity of mercury that is emitted from each affected unit.</text>
							</subsection><subsection id="HE3EF8ADE5A504E708D10A864B81494C9"><enum>(d)</enum><header>Excess
				emissions</header>
								<paragraph id="HD710ADD702DC40EC80068400B14020E2"><enum>(1)</enum><header>In
				general</header><text>The owner or operator of an affected unit that emits
				mercury in excess of the emission limitation described in subsections (b) and
				(c) shall pay an excess emissions penalty determined under paragraph
				(2).</text>
								</paragraph><paragraph id="H1BB785B5F1FF456BA3E06BCC66714DCD"><enum>(2)</enum><header>Determination of
				excess emissions penalty</header><text>The excess emissions penalty shall be an
				amount equal to $10,000 for each ounce of mercury emitted in excess of the
				emission limitations for mercury described in subsections (b) and (c).</text>
								</paragraph></subsection><subsection id="HDC41BCB3FC604791B17F2B2800B18EB"><enum>(e)</enum><header>Prevention of
				mercury re-release</header><text display-inline="yes-display-inline">Not later
				than January 1, 2009, the Administrator shall promulgate regulations to ensure
				that any mercury captured or recovered by emission controls installed at an
				affected unit is not re-released into the environment.</text>
							</subsection></section><section id="H9B510B1425214EC0A0B0E48C3098E9C6"><enum>703.</enum><header>Carbon dioxide
				trading program</header>
							<subsection id="HE71F8F3006B24408AAD5C6CBC80049CE"><enum>(a)</enum><header>Definitions</header><text>In
				this section:</text>
								<paragraph id="H22963E21FA8C42FD980097F24EC75E34"><enum>(1)</enum><header>Allowance</header><text>The
				term <quote>allowance</quote> mean a carbon dioxide allowance equivalent to
				emitting one ton of carbon dioxide during the year that it was issued or any
				subsequent year.</text>
								</paragraph><paragraph id="HD95FEB1CE57745D69DCA45AAFD9800B8"><enum>(2)</enum><header>Renewable
				energy</header><text>The term <quote>renewable energy</quote> means electricity
				generated from—</text>
									<subparagraph id="HD3E88CC0AE004476B95EEEF65316D003"><enum>(A)</enum><text>wind;</text>
									</subparagraph><subparagraph id="H982E5FE0CD864153A67FA97C96DAEDA5"><enum>(B)</enum><text>organic waste
				(excluding incinerated municipal solid waste);</text>
									</subparagraph><subparagraph id="H88537D4095234201A6F5649C99F63010"><enum>(C)</enum><text>biomass (including
				anaerobic digestion from farm systems and landfill gas recovery);</text>
									</subparagraph><subparagraph id="H187F97DCD04C4F01A9CE73B1E3F7696F"><enum>(D)</enum><text>fuel cells;
				or</text>
									</subparagraph><subparagraph id="H8929B2CD612D4904A1DD2E7C7DD0194B"><enum>(E)</enum><text>a hydroelectric,
				geothermal, solar thermal, photovoltaic, or other nonfossil fuel, nonnuclear
				source.</text>
									</subparagraph></paragraph></subsection><subsection id="H34344AF54C974DAD91037700994CEFF"><enum>(b)</enum><header>Carbon dioxide
				emission levels for 2015, 2020, 2030, 2040, and 2050</header>
								<paragraph id="H9869067F3EA84B9A9C00C605B0BF18B3"><enum>(1)</enum><text>By January 1,
				2015, carbon dioxide emission levels for affected units shall not exceed the
				level of carbon dioxide emissions for affected units in 2005.</text>
								</paragraph><paragraph id="HA8356023D60840ACABB4FFCE5D97C9FD"><enum>(2)</enum><text>By January 1,
				2020, carbon dioxide emission levels for affected units shall not exceed 75
				percent of the level of carbon dioxide emissions for affected units in
				2005.</text>
								</paragraph><paragraph id="H831E73C611B549F4A203F410C8AFD39B"><enum>(3)</enum><text>By January 1,
				2030, carbon dioxide emission levels for affected units shall not exceed 50
				percent of the level of carbon dioxide emissions for affected units in
				2005.</text>
								</paragraph><paragraph id="HDACB8067F7E8413388BB00E080978871"><enum>(4)</enum><text>By January 1,
				2040, carbon dioxide emission levels for affected units shall not exceed 35
				percent of the level of carbon dioxide emissions for affected units in
				2005.</text>
								</paragraph><paragraph id="HE3BEA62A1A4541998706A57EDD0018AF"><enum>(5)</enum><text>By January 1,
				2050, carbon dioxide emission levels for affected units shall not exceed 20
				percent of the level of carbon dioxide emissions for affected units in
				2005.</text>
								</paragraph></subsection><subsection id="H5637C732E4C142C0B967E464711297A5"><enum>(c)</enum><header>Regulations</header>
								<paragraph id="H1F06B17D64524A639571CF036392788F"><enum>(1)</enum><header>In
				general</header><text>Not later than January 1, 2010, the Administrator shall
				promulgate regulations to establish an allowance trading program for affected
				units in the United States.</text>
								</paragraph><paragraph id="H6653C606BA2F47099616B0AFEAFECBC"><enum>(2)</enum><header>Required
				elements</header><text>Regulations promulgated under paragraph (1) shall
				establish requirements for the carbon dioxide allowance trading program under
				this section, including requirements concerning—</text>
									<subparagraph id="H711BA87A294E453F8718DAFDF61F5584"><enum>(A)</enum><text>the issuance,
				auction, and use of carbon dioxide allowances. Such allowances shall be—</text>
										<clause id="H33949CFB18514D40B5D2E19BC4F7783D"><enum>(i)</enum><text>100 percent
				auctioned; and</text>
										</clause><clause id="HC5BE4903A9734E07906E226E06C3161B"><enum>(ii)</enum><text>the proceeds of
				such auction shall be deposited into a special fund jointly administered by the
				Department of Energy and Environmental Protection Agency to fund research and
				development of renewable energy projects.</text>
										</clause></subparagraph><subparagraph id="H516F0A0FA662479D9C85D2D776F396D1"><enum>(B)</enum><text>the transfer of
				allowances;</text>
									</subparagraph><subparagraph id="H3C58C1CDADE24A00B3DE200517CCD899"><enum>(C)</enum><text>the monitoring,
				tracking and reporting of carbon dioxide allowances; and</text>
									</subparagraph></paragraph></subsection><subsection id="H9CEEA634E66C4222953534A2004F5DD"><enum>(d)</enum><header>Compliance and
				enforcement</header>
								<paragraph id="HFE756836838C4215BB2E5383D1EA3CDA"><enum>(1)</enum><header>In
				general</header><text>For calendar year 2015 and each calendar year thereafter,
				the owner of each affected unit shall surrender to the Administrator a quantity
				of allowances that is equal to the total tons of carbon dioxide emitted by the
				affected unit during the calendar year.</text>
								</paragraph><paragraph id="H2391CC296742442F93BAD9F1B972168D"><enum>(2)</enum><header>Penalty</header><text>The
				owner of an affected unit that emits carbon dioxide in excess of the allowances
				that the owner holds for use for the affected unit for the calendar year shall
				pay an excess emissions penalty equal to the product obtained by
				multiplying—</text>
									<subparagraph id="HF0F6F88D1E3E48DC820781B64613363"><enum>(A)</enum><text>the number of tons
				of carbon dioxide emitted inexcess of the total quantity of allowances held;
				and</text>
									</subparagraph><subparagraph id="HD1E96521BBBD4CF8B98DC302CEF7540"><enum>(B)</enum><text>$150, adjusted for
				changes in the Consumer Price Index for All-Urban Consumers published by the
				Department of Labor.</text>
									</subparagraph></paragraph></subsection><subsection id="H9B63A285F6724C64A2A161348810E992"><enum>(e)</enum><header>Allowance not a
				property right</header><text>An allowance—</text>
								<paragraph id="HBA3D1532F2E84A43B200DD2038B5E02"><enum>(1)</enum><text>is not a property
				right; and</text>
								</paragraph><paragraph id="HFAD0ADFAB9A049199EA5A49BAB9E11ED"><enum>(2)</enum><text>may be terminated
				or limited by the Administrator.</text>
								</paragraph></subsection><subsection id="HD90E9711920446EF8688A4DA4900362B"><enum>(f)</enum><header>No judicial
				review</header><text>An auction or issuance of an allowance by the
				Administrator shall not be subject to judicial review.</text>
							</subsection></section><section id="H5F002928C895451488D4216930753E83"><enum>704.</enum><header>Prohibitions</header><text display-inline="no-display-inline">It shall be unlawful—</text>
							<paragraph id="HA9984A4074A1476FAB2BE1A582908823"><enum>(1)</enum><text>for the owner or
				operator of any electricity generating facility—</text>
								<subparagraph id="HFA28012E1AA245A5ADD21FC54B1C9878"><enum>(A)</enum><text>to operate the
				electricity generating facility in noncompliance with the requirements of this
				title (including any regulations implementing this title);</text>
								</subparagraph><subparagraph id="H5DD142CF9E2E493B82A3ED1FA1E537ED"><enum>(B)</enum><text>to fail to submit
				by the required date any emission allowances, or pay any penalty, for which the
				owner or operator is liable;</text>
								</subparagraph><subparagraph id="HA2547831F11E441E8240F4BBA2F8FBCA"><enum>(C)</enum><text>to fail to provide
				and comply with any plan to offset excess emissions; or</text>
								</subparagraph><subparagraph id="HF3953634594B47FB834300B3731949D"><enum>(D)</enum><text>to emit mercury in
				excess of the emission limitations established under section 702; or</text>
								</subparagraph></paragraph><paragraph id="HFC2D828CCF884D51988B7786A9C0826"><enum>(2)</enum><text>for any person to
				hold, use, or transfer any emission allowance allocated under this title except
				in accordance with regulations promulgated by the Administrator.</text>
							</paragraph></section><section id="HD6284DDBA8D44584B14F9B8F24A5B5B7"><enum>705.</enum><header>Effect on other
				law</header><text display-inline="no-display-inline">Nothing in this
				title—</text>
							<paragraph id="H2DB62772A97E4EB3AB703805DD21855F"><enum>(1)</enum><text>affects the
				ability of a State to take State actions to further limit climate change
				(except that section 209 shall apply to standards for vehicles); and</text>
							</paragraph><paragraph id="H6D79636C711F4BA1AB463200C8878E6D"><enum>(2)</enum><text>except as
				expressly provided in this title—</text>
								<subparagraph id="H1724BE814FF342E492B9BA1D6212B1EA"><enum>(A)</enum><text>modifies or
				otherwise affects any requirement of this Act in effect on the day before the
				date of enactment of this title; or</text>
								</subparagraph><subparagraph id="H9CC7AF3ACC844751B5008107B33FEF5C"><enum>(B)</enum><text>relieves any
				person of the responsibility to comply with this
				Act.</text>
								</subparagraph></paragraph></section></title><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="HDCFB85B1318B4F79BB449C28C734E881"><enum>103.</enum><header>Protecting
			 sensitive regional ecosystems</header>
				<subsection id="H3F9F9C45D02847FB00F8366F74E80120"><enum>(a)</enum><header>Report</header>
					<paragraph id="H6529CB8127F84C50BFBB258CFFD4200"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than
			 December 31, 2010, the Administrator shall submit to Congress a report
			 identifying objectives for scientifically credible environmental indicators, as
			 determined by the Administrator, that are sufficient to protect and restore
			 sensitive ecosystems of the Adirondack Mountains, mid-Appalachian Mountains,
			 Catskill Mountains, Rocky Mountains, and Southern Blue Ridge Mountains and
			 water bodies of the Great Lakes, Lake Champlain, Long Island Sound, the
			 Chesapeake Bay and other sensitive ecosystems, as determined by the
			 Administrator.</text>
					</paragraph><paragraph id="H21C00908883841FF8EA11077F9CB847B"><enum>(2)</enum><header>Updated
			 report</header><text>Not later than December 31, 2019, the Administrator shall
			 submit to Congress a report updating the report under paragraph (1) and
			 assessing the status and trends of various environmental objectives and
			 indicators for the sensitive regional ecosystems referred to in paragraph
			 (1).</text>
					</paragraph><paragraph id="HC23B529AA9A3443D8D45BCC8EF10347D"><enum>(3)</enum><header>Reports under
			 the national acid precipitation assessment program</header><text>The reports
			 under this subsection shall be subject to the requirements applicable to a
			 report under section 103(j)(3)(E) of the Clean Air Act (42 U.S.C.
			 7403(j)(3)(E)).</text>
					</paragraph></subsection><subsection id="HFEE94F649A32431500E289FB36CFAAA"><enum>(b)</enum><header>Regulations</header>
					<paragraph id="HD49B68E06009499900BA5E9590D30026"><enum>(1)</enum><header>Determination</header><text>Not
			 later than December 31, 2019, the Administrator shall determine whether
			 emissions reductions under title VII of the Clean Air Act are sufficient to
			 ensure achievement of the objectives stated in subsection (a)(1).</text>
					</paragraph><paragraph id="H9DE321F001274FA6B98DD2B2DCE2C277"><enum>(2)</enum><header>Promulgation</header><text>If
			 the Administrator determines under paragraph (1) that emissions reductions
			 under title VII of the Clean Air Act are not sufficient to ensure achievement
			 of the objectives identified in subsection (a)(1), the Administrator shall
			 promulgate, not later than 2 years after making the finding, such regulations,
			 including modification of nitrogen oxide and sulfur dioxide allowance
			 allocations or any such measure, as the Administrator determines are necessary
			 to protect the sensitive ecosystems described in subsection (a)(1).</text>
					</paragraph></subsection></section><section id="HD2514C01F59B45C0B6F8F93897F72236"><enum>104.</enum><header>Authorization
			 of appropriations</header><text display-inline="no-display-inline">In addition
			 to amounts made available under any other law, there are authorized to be
			 appropriated for each of fiscal years 2008 through 2018—</text>
				<paragraph id="H515DEB2FD50F4EECB6871FDE6F44BA93"><enum>(1)</enum><text>for operational
			 support of the National Atmospheric Deposition Program National Trends
			 Network—</text>
					<subparagraph id="H49BB571220D5439BAC6E2C45D48600AA"><enum>(A)</enum><text>$2,000,000 to the
			 United States Geological Survey;</text>
					</subparagraph><subparagraph id="H02193CB110B6429BAA3230652F4626DB"><enum>(B)</enum><text>$600,000 to the
			 Environmental Protection Agency;</text>
					</subparagraph><subparagraph id="H7D62C777C0B94680BAD756608E623EF"><enum>(C)</enum><text>$600,000 to the
			 National Park Service; and</text>

			 amounts</header><text>Each of the amounts appropriated under subsection (b)
			 shall remain available until expended.</text>
				</subsection></section></title><title id="H59BABF12C2AD425FB49F5230BE9CFAF7"><enum>II</enum><header>Sulfur dioxide
			 and nitrogen oxide emissions</header>
			<section id="H6690C45A7FC04351946C63A64053E4ED"><enum>201.</enum><header>Reduction of
			 emissions from powerplants</header><text display-inline="no-display-inline">Part A of title I of the
			 <act-name parsable-cite="CAA">Clean Air Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401 et seq.</external-xref>)
			 is amended by adding at the end the following:</text>

					<section id="HF5A3E35766664311B4BED1C9EF549B6"><enum>132.</enum><header>Reduction of
				emissions from powerplants</header>
						<subsection id="H1F82666C5DEB4CFA8B00FED92252E8EE"><enum>(a)</enum><header>Emission
				reduction objectives</header><text>The emission reduction objectives of this
				section are to reduce, not later than January 1, 2010:</text>
							<paragraph id="H10DBC885ADBC45B6A8BC9E6B5B6C8BFB"><enum>(1)</enum><text>aggregate sulfur
				dioxide emissions from powerplants by 75 percent from the levels allowed under
				full implementation of the Phase II sulfur dioxide requirements under title IV
				(relating to acid deposition control); and</text>
							</paragraph><paragraph id="HAF0D91FDC65A46899325E2E7CB864587"><enum>(2)</enum><text>aggregate nitrogen
				oxide emissions from powerplants by 75 percent from 1997 levels.</text>
							</paragraph></subsection><subsection id="HBABDBD2131E043498216317F3EF39BD1"><enum>(b)</enum><header>Agency
				action</header>
							<paragraph id="H03E34010F9D44D239B79ACD7E9D3D47"><enum>(1)</enum><header>Regulations</header>
								<subparagraph id="H55AE89A4257B4440BE943E0791E925FE"><enum>(A)</enum><header>In
				general</header><text>Not later than 2 years after the date of enactment of
				this section, the Administrator shall promulgate regulations to achieve the
				emission reduction objectives specified in subsection (a).</text>
								</subparagraph><subparagraph id="H5B72303973934D23830075AEC532EC6C"><enum>(B)</enum><header>Elements</header><text>The
				regulations promulgated under subparagraph (A)—</text>
									<clause id="H275BD058991C436D9D761D1B4951004E"><enum>(i)</enum><text>shall achieve the
				objectives in a manner that the Administrator determines will allocate required
				emission reductions equitably, taking into account emission reductions achieved
				before the date of enactment of this section and other relevant factors;</text>
									</clause><clause id="HE6BB71BE602049DB963701DA60EF6875"><enum>(ii)</enum><text>may include
				market-oriented mechanisms (such as emissions trading based on generation
				performance standards, auctions, or other allocation methods);</text>
									</clause><clause id="H256FF0DCF1A34BCA00E5FCF929D6CB7C"><enum>(iii)</enum><text>shall prevent
				localized adverse effects on public health and the environment and ensure that
				significant emission reductions are achieved in both the Eastern and Western
				regions of the United States;</text>
									</clause><clause id="H15E2E150971A433BA5F8F08D3FE1AAA2"><enum>(iv)</enum><text>shall, include,
				consistent with achieving the objectives set forth in subsection (a),
				incentives for renewable energy.</text>
									</clause></subparagraph></paragraph><paragraph id="H88470677B17D47B4AA970037E3697069"><enum>(2)</enum><header>Interagency
				coordination to minimize costs and maximize gains</header><text>To minimize the
				economic costs and maximize the economic gains of achieving the emission
				reduction objectives specified in subsection (a), the Administrator shall
				coordinate with other departments and agencies of Federal and State government
				to increase energy efficiency, to increase the use of renewable energy, and to
				implement cost saving advanced demand and supply side policies, such as those
				described in the report prepared by the Interlaboratory Working Group of the
				Department of Energy entitled <quote>Scenarios for a Clean Energy
				Future</quote>, dated November 2000.</text>
							</paragraph></subsection><subsection id="HC699DD8C5A8D4518A3B6A20009DEA049"><enum>(c)</enum><header>Additional
				reductions</header><text>The regulations promulgated under subsection (b) may
				require additional reductions in emissions from powerplants if the
				Administrator determines that the emission levels necessary to achieve the
				emission reduction objectives specified in subsection (a) are not reasonably
				anticipated to protect public health or welfare.</text>
						</subsection><subsection id="H9C08AB26BF3A4EECADDCFCC7D2AF0384"><enum>(d)</enum><header>Modernization of
				outdated powerplants</header>
							<paragraph id="H0DC0DF1A44FC4BC79EF7EFB775D2DEDC"><enum>(1)</enum><header>In
				general</header><text>On the later of the date that is 30 years after a
				powerplant commenced operation or the date that is 5 years after the date of
				enactment of this section, it shall comply with—</text>
								<subparagraph id="HEBA0A06F7FAE4F2A9FC52FDB839F19C"><enum>(A)</enum><text>the most recent new
				source performance standards promulgated under section 111; and</text>
								</subparagraph><subparagraph id="H605D2E6081D7461DB092C878BAD9AB00"><enum>(B)</enum><text>the requirements
				under parts C and D that are applicable to modified sources.</text>
								</subparagraph></paragraph><paragraph id="H39D13B2E382A4098949CF49E8482313F"><enum>(2)</enum><header>Additional
				requirements</header><text>The requirements of this subsection shall be in
				addition to the requirements of the regulations promulgated under subsection
				(b).</text>
							</paragraph></subsection><subsection id="H51879748534B473C89FF00DF978F3C58"><enum>(e)</enum><header>Other
				requirements</header><text>The requirements of this section shall be in
				addition to, and not in lieu of, any other requirement of this Act.</text>
						</subsection><subsection id="H3B156BC7CA694F028897B203B5A7A5C3"><enum>(f)</enum><header>Definition</header><text>In
				this section, the term <term>powerplant</term> means an electric generation
				facility with a nameplate capacity of 25 megawatts or more that uses a
				combustion device to generate electricity for
				sale.</text>
