<legis-type>AN ACT</legis-type> 
<official-title display="yes">To amend title 49, United States Code, to direct the Secretary of Transportation to register a person providing transportation by an over-the-road bus as a motor carrier of passengers only if the person is willing and able to comply with certain accessibility requirements in addition to other existing requirements, and for other purposes.</official-title>

<section id="HCF89D6F5719A4EB9843B59D1B642127" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Over-the-Road Bus Transportation Accessibility Act of 2007</short-title></quote>.</text> </section> 
<section id="H05CA926EFBE14FFF90968E9B1DE5E113" section-type="subsequent-section"><enum>2.</enum><header>Registration of Motor Carriers of Passengers</header> 
<subsection id="H1925A5B85D184E2682BEAFE9E8AD7293"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/49/13902">Section 13902(a)(1)</external-xref> of title 49, United States Code, is amended—</text> 
<paragraph id="HF198849DA4F84023B3B89F6B7FC81811"><enum>(1)</enum><text>by striking <quote>and</quote> at the end of subparagraph (B)(iii);</text> </paragraph> 
<paragraph id="H67BC57B8E2524B17B29811C6538879F1"><enum>(2)</enum><text>by redesignating subparagraph (C) as subparagraph (D); and</text> </paragraph> 
<paragraph id="H2447AFE6482A4B4D93903D006FFC7211"><enum>(3)</enum><text>by inserting after subparagraph (B) the following:</text>

<subparagraph id="H2DBD2242F85B423F9595C5BF739E8F45"><enum>(C)</enum><text>the accessibility requirements established by the Secretary under subpart H of part 37 of title 49, Code of Federal Regulations, or such successor regulations to those accessibility requirements as the Secretary may issue, for transportation provided by an over-the-road bus; and</text> </subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection> 
<subsection id="H4F2ACD10DF6741F2AEB06368B4434100"><enum>(b)</enum><header>Conforming amendments</header><text>Sections 13902(a)(5) and 13905(d)(1)(A) of such title are each amended by inserting after <quote>Board</quote> the following: <quote>(including the accessibility requirements established by the Secretary under subpart H of part 37 of title 49, Code of Federal Regulations, or such successor regulations to those accessibility requirements as the Secretary may issue, for transportation provided by an over-the-road bus)</quote>.</text> </subsection></section> 
<section id="H32B7B665E1524BE8A505648901F7BD7F"><enum>3.</enum><header>Over-the-road bus defined</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/49/13102">Section 13102</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text>

<paragraph id="H880E5A38A11142398200CEFBCEDEE0A2"><enum>(27)</enum><header>Over-the-road bus</header><text display-inline="yes-display-inline">The term <quote>over-the-road bus</quote> means a bus characterized by an elevated passenger deck located over a baggage compartment.</text> </paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </section> 
<section id="HC54B1F48013E4F46A3B0B50F7B6F233"><enum>4.</enum><header>Deadline for implementation of registration requirements</header><text display-inline="no-display-inline">Not later than 30 days after the date of enactment of this Act, the Secretary shall take necessary actions to implement the changes required by the amendment made by section 2(a) relating to registration of motor carriers providing transportation by an over-the-road bus.</text> </section> 
<section id="H11BB65A7E3034512B945CF6DB1BB6676"><enum>5.</enum><header>Coordination with the Department of Justice</header><text display-inline="no-display-inline">Not later than 6 months after the date of enactment of this Act, the Secretary of Transportation and the Attorney General shall enter into a memorandum of understanding to delineate the specific roles and responsibilities of the Department of Transportation and the Department of Justice, respectively, in enforcing the compliance of motor carriers of passengers providing transportation by an over-the-road bus (as defined in <external-xref legal-doc="usc" parsable-cite="usc/49/13102">section 13102</external-xref> of title 49, United States Code) with the accessibility requirements established by the Secretary under subpart H of part 37 of title 49, Code of Federal Regulations, or such successor regulations to those accessibility requirements as the Secretary may issue. Such memorandum shall recognize the Department of Transportation’s statutory responsibilities as clarified by this Act (including the amendments made by this Act).</text> </section>
