<official-title>To provide for safe and humane policies and procedures pertaining to the arrest, detention, and processing of aliens in immigration enforcement operations.</official-title>

<section id="HD2D7932668DD4A81AB703E7EEA56A78E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Families First Immigration Enforcement Act</short-title></quote>.</text></section> 
<section id="H2B2C892F98A94789AEF5C1EB5D7CA4C5"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="H6EC5DF2F9D594A86BAD600CB877CAFDC"><enum>(1)</enum><header>Department</header><text>The term <term>Department</term> means the Department of Homeland Security.</text></paragraph> 
<paragraph id="HE360EAC595804519ABC606EF5B359F06"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Homeland Security.</text></paragraph> 
<paragraph id="H4A243730D8F44D93B8D9BA8D3FC4BF00"><enum>(3)</enum><header>SSA</header><text>The term <term>SSA</term> means appropriate State social service agencies.</text></paragraph></section> 
<section id="HD3CD658487704F6FB339EEFE46E5EF6"><enum>3.</enum><header>Arrest procedures</header> 
<subsection id="H7B2A978382344FBA89F0A59152B62558"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Any immigration workplace enforcement operation by the Department for alleged violations under the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>), which is reasonably calculated to apprehend, or results in the apprehension of, at least 50 aliens, shall be carried out in accordance with the procedures described in this section.</text></subsection> 
<subsection id="HB1F5CF57ED4944E2A98D16A83C9C788E"><enum>(b)</enum><header>State notification</header><text>The Department shall provide State officials with sufficient advance notice of all immigration workplace enforcement operations to allow State law enforcement officials to notify SSA of—</text> 
<paragraph id="H7C95618CA81B40E98739B3E07741A6BF"><enum>(1)</enum><text>the specific area of the State that will be affected;</text></paragraph> 
<paragraph id="H1CD4650B47B54CB9B63524C4DA605C00"><enum>(2)</enum><text>the languages spoken by employees at the target worksite; and</text></paragraph> 
<paragraph id="HD6435AD98157478EAECA96CA08637700"><enum>(3)</enum><text>any special needs of the employees.</text></paragraph></subsection> 
<subsection id="H7A44FD84E1C84232B92C1558F7226EC2"><enum>(c)</enum><header>NGO notification</header> 
<paragraph id="H0143854DEE694D18BDA9BD0079E2E996"><enum>(1)</enum><header>In general</header><text>The Department and the applicable SSA shall determine how appropriate nongovernmental organizations will be notified on the day of the enforcement action.</text></paragraph> 
<paragraph id="H78CF920DC381424DA1B1DFFC3967E6F0"><enum>(2)</enum><header>Participation</header><text>At the discretion of the SSA, representatives of the nongovernmental organization who speak the native language of the aliens detained in the enforcement action may be permitted to participate with SSA officials in interviewing such aliens.</text></paragraph></subsection> 
<subsection id="H4C40895080F0403A9CD0A94B0825D734"><enum>(d)</enum><header>Determination of risk to relatives</header><text>The Department shall provide the applicable SSA with unfettered and confidential access to aliens detained in the enforcement action to assist in the screening and interviews of aliens to determine whether the detainee, the detainee’s children, or other vulnerable people, including elderly and disabled individuals, have been placed at risk as a result of the detainee’s arrest.</text></subsection> 
<subsection id="H981723F4136F458C9E0987EC617FE627"><enum>(e)</enum><header>Medical screening</header><text>After SSA officials have met with the alien detainees, qualified medical personnel from the Division of Immigration Health Services of the Department of Health and Human Services shall—</text> 
<paragraph id="HAD3D7A2B50174853AD6CA9DBDFE668FD"><enum>(1)</enum><text>conduct medical screenings of the alien detainees; and</text></paragraph> 
<paragraph id="H85528BBDF4064539AF558EE0BA7B18CB"><enum>(2)</enum><text>identify and report any medical issues that might necessitate humanitarian release or additional care.</text></paragraph></subsection> 
<subsection id="H402C034EEB0F462394A851852BAA8EB6"><enum>(f)</enum><header>Consideration of recommendations</header><text>The Department shall immediately consider recommendations made by the applicable SSA and the Division of Immigration Health Services about alien detainees who should be released on humanitarian grounds, including alien detainees who—</text> 
<paragraph id="H0F709DF6EE7446A48706BC6E8700135D"><enum>(1)</enum><text>have a medical condition that requires special attention;</text></paragraph> 
<paragraph id="HC88F7EF3C83843E5B600222DEFAC047F"><enum>(2)</enum><text>are pregnant women;</text></paragraph> 
<paragraph id="HD2D6FBB845BB409000CA1000F2348F60"><enum>(3)</enum><text>are nursing mothers;</text></paragraph> 
<paragraph id="HE5AB90FD58364FDDA3337E6E77DCE167"><enum>(4)</enum><text>are the sole caretakers of their minor children or elderly relatives;</text></paragraph> 
<paragraph id="H5971187D072944EE84645C1F758905B6"><enum>(5)</enum><text>function as the primary contact between the family and those outside the home due to language barriers;</text></paragraph> 
<paragraph id="H5726136997F846E19E20EC3884DDD4FC"><enum>(6)</enum><text>are needed to support their spouses in caring for sick or special needs children;</text></paragraph> 
<paragraph id="HC0C4538B54E54E68001522BA3C84E818"><enum>(7)</enum><text>have spouses who are ill or otherwise unable to be sole caretaker; or</text></paragraph> 
<paragraph id="H6D52EEF5751045D400F9D9970014E000"><enum>(8)</enum><text>are younger than 18 years of age.</text></paragraph></subsection> 
<subsection id="H563615014CF4452AB2BD978F4F3304EF"><enum>(g)</enum><header>Publicity</header><text>The Department shall provide, and advertise in the mainstream and foreign language media, a toll-free number through which family members of alien detainees may report such relationships to operators who speak English and the majority language of the target population of the enforcement operation and will convey such information to the Department and the applicable SSA.</text></subsection></section> 
<section id="H146DB559757F40AB9BF8002C8EA3F190"><enum>4.</enum><header>Detention procedures</header> 
<subsection id="H381A656DE69C4BA78E187F16C8107982"><enum>(a)</enum><header>In general</header><text>In order to maximize full and fair visitation by children, immediate family members, and counsel, an alien should be detained, to the extent space is available, in facilities within the physical jurisdiction or catchment area of the local field office of United States Immigration and Customs Enforcement.</text></subsection> 
<subsection id="H2F322BC18CC44333BC22006D003B2CB8"><enum>(b)</enum><header>Release</header> 
<paragraph id="H923B40309D6C4ADC942817A0C520DB42"><enum>(1)</enum><header>In general</header><text>Not later than 72 hours of an alien’s apprehension, the alien shall be released from Department custody, in accordance with paragraph (2), if the alien—</text> 
<subparagraph id="HE0D9E2D6610E48BCB719331FE5A75256"><enum>(A)</enum><text>is not subject to mandatory detention under section 235(1)(B)(iii)(IV), 236(c), or 236A of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1225">8 U.S.C. 1225(1)(B)(iii)(IV)</external-xref>, 1226(c), and 1226a);</text></subparagraph> 
<subparagraph id="H98BC05577D0D4AB5B38DB0174456C5EC"><enum>(B)</enum><text>does not pose an immediate flight risk; and</text></subparagraph> 
<subparagraph id="HBE66F7F8F95540778300D5328092FC18"><enum>(C)</enum><text>meets any of the criteria set forth in section 3(f).</text></subparagraph></paragraph> 
<paragraph id="HFC543C721BB74BA794BE2DB463FC8D00"><enum>(2)</enum><header>Type of release</header><text>An alien shall be released under this subsection—</text> 
<subparagraph id="H44163815BD5D41BB94DDF09F8FBA4EE"><enum>(A)</enum><text>on the alien’s own recognizance;</text></subparagraph> 
<subparagraph id="HE573F61B5C2E4867939376C2171BAA83"><enum>(B)</enum><text>by posting a minimum bond under section 236(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1226">8 U.S.C. 1226(a)</external-xref>);</text></subparagraph> 
<subparagraph id="HBAAFEF3FB7C54E7AA362FE7BDE77006C"><enum>(C)</enum><text>on parole in accordance with section 212(d)(5)(A) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(d)(5)(A)</external-xref>); or</text></subparagraph> 
<subparagraph id="H7C00C85D360B48EAA07F1B42CB20FDFC"><enum>(D)</enum><text>through the Intensive Supervision Appearance Program or another comparable alternative to detention program.</text></subparagraph></paragraph></subsection></section> 
<section id="HBF16EB436BB74412B551C39435F2C8DA"><enum>5.</enum><header>Legal orientation presentations</header><text display-inline="no-display-inline">Any alien arrested in an immigration enforcement operation that is reasonably calculated to apprehend, or results in the apprehension of, at least 50 aliens shall have access to legal orientation presentations provided by independent, nongovernmental agencies through the Legal Orientation Program administered by the Executive Office for Immigration Review.</text></section> 
<section id="H349E7D49F5EE46DDAD4D461DD86CEDBE"><enum>6.</enum><header>Regulations concerning the treatment of aliens in a vulnerable population in the United States</header><text display-inline="no-display-inline">Not later than 6 months after the date of the enactment of this Act, the Secretary shall promulgate regulations to implement this Act, in accordance with the notice and comment requirements under subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/5">chapter 5</external-xref> of title 5, United States Code (commonly referred to as the Administrative Procedure Act).</text></section> 
<section id="H6E90DAE839DE4010BE44CD0050F2BF7D"><enum>7.</enum><header>Report to congress</header><text display-inline="no-display-inline">The Secretary shall submit an annual report that describes all the actions taken by the Department to implement this Act to—</text> 
<paragraph id="H152CA5341BB94E9598345DA44D83502F"><enum>(1)</enum><text display-inline="yes-display-inline"><committee-name committee-id="SSJU00">Committee on the Judiciary of the Senate</committee-name>;</text></paragraph> 
<paragraph id="H702334A9336149509079C89835EDF5D6"><enum>(2)</enum><text display-inline="yes-display-inline"><committee-name committee-id="">Committee on the Judiciary of the House of Representatives</committee-name>;</text></paragraph> 
<paragraph id="H92125A0A31F341B493E33F501FEC9699"><enum>(3)</enum><text display-inline="yes-display-inline">the Committee on Homeland Security and Governmental Affairs of the Senate; and</text></paragraph> 
<paragraph id="H58EB4E941B994A76A474CB896C22086D"><enum>(4)</enum><text display-inline="yes-display-inline">the Committee on Homeland Security of the House of Representatives.</text></paragraph></section> 
<section id="HB3B16CBC959946B788B8F334676F1EB9"><enum>8.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated such sums as may be necessary to carry out this Act.</text></section>
