<legis-type>A BILL</legis-type> 
<official-title>To amend the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 to exempt from the means test in bankruptcy cases, for a limited period, qualifying reserve-component members who, after September 11, 2001, are called to active duty or to perform a homeland defense activity for not less than 60 days.</official-title>

<section section-type="section-one" id="HACC385E67FEF4391A366FD4F6B67E3A5"><enum>1.</enum><header>Amendment</header><text display-inline="no-display-inline">Section 101(a)(2)(C) of the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 (<external-xref legal-doc="public-law" parsable-cite="pl/109/8">Public Law 109–8</external-xref>) is amended by adding at the end of paragraph (2) of <external-xref legal-doc="usc" parsable-cite="usc/11/707">section 707(b)</external-xref> of title 11 of the United States Code, as added by such Act, the following:</text> 
<quoted-block style="OLC" id="H616186D91F444361ABBA1283E3650AB"> 
<subparagraph indent="up2" id="HBBB02B14032048308C68042F1ECB358B"><enum>(E)</enum><text>Subparagraphs (A) through (C) shall not apply, and the court may not dismiss or convert a case filed under this chapter based on any form of means testing—</text> 
<clause id="H06EDE6E9972E4BF99E1F335CA60047A5"><enum>(i)</enum> 
<subclause display-inline="yes-display-inline" id="H1B6427ED4D34472CA745E858B08F555"><enum>(I)</enum><text>while the debtor is on, and during the 180-day period beginning immediately after the debtor is released from, a period of active duty (as defined in <external-xref legal-doc="usc" parsable-cite="usc/10/101">section 101(d)(1)</external-xref> of title 10) of not less than 60 days; or</text></subclause> 
<subclause indent="up1" id="HF9889F1CDCCB454499DC0004AC6F004B"><enum>(II)</enum><text>while the debtor is performing, and during the 180-day period beginning immediately after the debtor is no longer performing, a homeland defense activity (as defined in <external-xref legal-doc="usc" parsable-cite="usc/32/901">section 901(1)</external-xref> of title 32) performed for a period of not less than 60 days; and</text></subclause></clause> 
<clause id="HEF3381C6B43F4C98B7DA21DB4300AF53"><enum>(ii)</enum><text>if after September 11, 2001, the debtor while a member of a reserve component of the Armed Forces or a member of the National Guard, was called to such active duty or performed such homeland defense activity.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HDED31CE22A98432C839F980533D48DAA"><enum>2.</enum><header>Effective date; application of amendment</header> 
<subsection id="HDC1755E573F645E7877F1053FCF6FA5B"><enum>(a)</enum><header>Effective Date</header><text>Except as provided in subsection (b), this Act and the amendment made by this Act shall take effect on April 20, 2005.</text></subsection> 
<subsection id="HBC1BD9C3E9D745098680786D26EBC2A4"><enum>(b)</enum><header>Application of Amendments</header><text>The amendment made by this Act shall apply only with respect to cases commenced under title 11 of the United States Code after April 20, 2005.</text></subsection></section>
