		<official-title>To amend title XVIII of the Social Security Act to
		  provide for Medicare coverage of services of qualified respiratory therapists
		  performed under the general supervision of a physician.</official-title>

		<section id="H012D6586858146AE9CC4FC10DD3B623" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Medicare Respiratory Therapy Initiative Act of
			 2007</short-title></quote>.</text>
		</section><section id="HB87C3DE2913A46DABEA1496DC7A35600"><enum>2.</enum><header>Medicare coverage
			 of services of qualified respiratory therapists performed under the general
			 supervision of a physician</header>
			<subsection id="HD997F95C20F545FF9B76A483C1831C67"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 1861 of the
			 Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x</external-xref>) is amended—</text>
				<paragraph id="HCEC38A3216404F8EA8F9C85535FA4B1B"><enum>(1)</enum><text>in subsection
			 (s)(2)—</text>
					<subparagraph id="HDD009B4F662A4C42A002D815095DB669"><enum>(A)</enum><text>by striking
			 <quote>and</quote> at the end of subparagraph (Z);</text>
					</subparagraph><subparagraph id="H5A9107856B094D1386B009A94CCD69A8"><enum>(B)</enum><text>by adding
			 <quote>and</quote> at the end of subparagraph (AA); and</text>
					</subparagraph><subparagraph id="HDD66811DF9D2467280ECEB00DAC1359D"><enum>(C)</enum><text>by adding at the
			 end the following new subparagraph:</text>
						<quoted-block display-inline="no-display-inline" id="H1956DC4B084E4903A44364CD80D3B7FE" style="traditional">
							<subparagraph id="H6587A581A8EB406692007DF28E4F0100" indent="up1"><enum>(BB)</enum><text display-inline="yes-display-inline">respiratory therapy services which would be
				physicians’ services if furnished by a physician (as defined in subsection
				(r)(1)) for the diagnosis and treatment of respiratory illnesses and which are
				performed by a respiratory therapist (as defined in subsection (ccc)) under the
				general supervision of a physician and which the respiratory therapist is
				legally authorized to perform by the State in which the services are performed,
				but only if no facility or other provider charges or is paid any amounts with
				respect to the furnishing of such
				services.</text>
							</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H2C661DACF0274B0AA3CDF4119F34E5E0"><enum>(2)</enum><text>by adding at the
			 end the following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="H329A6011735C413100022321067EE2FB" other-style="archaic" style="other">
						<subsection id="H7758CC51A35A4BAAAEDCA23221A767DF"><enum>(ccc)</enum><header>Respiratory Therapist</header><text display-inline="yes-display-inline">For purposes of subsection (s)(2)(BB) and
				section 1833(a)(1)(W) only, the term ‘respiratory therapist’ means an
				individual who—</text>
							<paragraph id="H398FD01A57A8400200DCDC7E688F88A8"><enum>(1)</enum><text>is credentialed by
				a national credentialing board recognized by the Secretary;</text>
							</paragraph><paragraph id="H589ED4BD01DA4D54BE64F848C6EDA3D"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H321F6D013AD9422DA9938C7CD30332C1"><enum>(A)</enum><text>is licensed to practice
				respiratory therapy in the State in which the respiratory therapy services are
				performed, or</text><clause commented="no" display-inline="yes-display-inline" id="H08ADE86E2B4540F5829BD626D25B11A"><enum>(B)</enum><text>in the case of an
				individual in a State which does not provide for such licensure, is legally
				authorized to perform respiratory therapy services (in the State in which the
				individual performed such services) under State law (or the State regulatory
				mechanism provided by State law);</text>
									</clause></subparagraph></paragraph><paragraph id="idFF5C5705DDC94EF38AE02503F6F50CDA"><enum>(3)</enum><text>is a registered
				respiratory therapist; and</text>
							</paragraph><paragraph id="idF6948C24844445DDBD0EC01711B06BE6"><enum>(4)</enum><text>holds a
				bachelor’s
				degree.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HE7B57EE375254D12007304E7D711BBE"><enum>(b)</enum><header>Payment</header><text display-inline="yes-display-inline">Section 1833(a)(1) of such Act (42 U.S.C.
			 1395l(a)(1)) is amended—</text>
				<paragraph id="H5281F05643E84DF7B0069CD2D145B139"><enum>(1)</enum><text>by striking
			 <quote>and</quote> before <quote>(V)</quote>; and</text>
				</paragraph><paragraph id="H7E9FD643FDF94E939C3C1435BE932FA"><enum>(2)</enum><text>by
			 inserting before the semicolon at the end the following: <quote>(W) with
			 respect to services described in section 1861(s)(2)(BB) (relating to services
			 furnished by a respiratory therapist) that are furnished by a respiratory
			 therapist (as defined in section 1861(ccc)), the amount paid shall be equal to
			 80 percent of the lesser of the actual charge for the services or 85 percent of
			 the fee schedule amount provided under section 1848 for the same services if
			 furnished by a physician</quote>.</text>
				</paragraph></subsection><subsection id="H481002C9D28642ACA4A42EC28339C521"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to services
			 furnished on or after January 1, 2008.</text>
