			</subsection></section><section id="HFDD789CB88D24D118FFCCE66C1E2EC81"><enum>2.</enum><header>Purposes</header><text display-inline="no-display-inline">The purpose of this Act is to—</text>
			<paragraph id="H11C81E39E95A4B3090C9D6FD00EE30AA"><enum>(1)</enum><text>continue the progress of
			 the Multifamily Assisted Housing Reform and Affordability Act of 1997, as
			 amended by the Mark-To-Market Extension Act of 2001;</text>
			</paragraph><paragraph id="HE8CA656C84E74991B5E5E16BFAA79EEC"><enum>(2)</enum><text>expand eligibility for
			 Mark-to-Market restructuring so as to further the preservation of affordable
			 housing in a cost-effective manner; and</text>
			</paragraph><paragraph id="H4B1F712CA063492A8379D12B93C24223"><enum>(3)</enum><text>provide for the
			 preservation and rehabilitation of projects damaged by Hurricanes Katrina,
			 Rita, and Wilma, or by other natural disasters.</text>
			</paragraph></section><section id="H49C0F8183D474B679F60F6D7D8614DFD"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 512 of the Multifamily Assisted
			 Housing Reform and Affordability Act of 1997 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref> note) is amended
			 by adding at the end the following:</text>
			<quoted-block id="H1FFE8E34653A4623A09F00BE79EED26" style="OLC" changed="added" reported-display-style="italic" committee-id="HBA00">
				<paragraph id="H03496D869AE34D3CB8FEC4F5FF233600"><enum>(20)</enum><header>Disaster-damaged
				eligible project</header>
					<subparagraph id="HE5876CB8FAFA4804B4BBC16F55FA4"><enum>(A)</enum><header>In
				general</header><text>The term <term>disaster-damaged eligible project</term>
				means an otherwise eligible multifamily housing project—</text>
						<clause id="HFEF42E26CD934F4C8E709948E12E22D"><enum>(i)</enum><text>that is located in a
				county that was designated a major disaster area on or after January 1, 2005,
				by the President pursuant to title IV of the Robert T. Stafford Disaster Relief
				and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121 et seq.</external-xref>);</text>
						</clause><clause id="H50D1A4DB004B4746A707635C6FBC3347"><enum>(ii)</enum><text>whose owner carried
				casualty and liability insurance covering such project in an amount required by
				the Secretary;</text>
						</clause><clause id="HE6BE524C66E04F3687D551FE008210BC"><enum>(iii)</enum><text>that suffered damages
				not covered by such insurance that the Secretary determines is likely to exceed
				$5,000 per unit in connection with the natural disaster that was the subject of
				the designation described in subparagraph (A); and</text>
						</clause><clause id="H0491354D544A410600D142871B965BEB"><enum>(iv)</enum><text>whose owner requests
				restructuring of the project not later than 2 years after the date that such
				damage occurred.</text>
						</clause></subparagraph><subparagraph id="H042DECCEFD1E4353B63DD4D789688476"><enum>(B)</enum><header>Rule of
				construction</header><text>A disaster-damaged eligible project shall be
				eligible for amounts under this Act without regard to the relationship between
				rent levels for the assisted units in such project and comparable rents for the
				relevant market
				area.</text>
					</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H97549DE8D19247B8BE937ECDD4708DF8"><enum>4.</enum><header>Extension of
			 Mark-to-Market program</header><text display-inline="no-display-inline">Section
			 579 of the Multifamily Assisted Housing Reform and Affordability Act of 1997
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref> note) is amended by striking <quote>October 1, 2011</quote>
			 each place such term appears and inserting <quote>October 1,
			 2012</quote>.</text>
		</section><section display-inline="no-display-inline" id="H24C56877AC844F2F883B64E42D28C3BD"><enum>5.</enum><header>Funding for tenant and
			 other participation and capacity building</header><text display-inline="no-display-inline">Paragraph (3) of section 514(f) of the
			 Multifamily Assisted Housing Reform and Affordability Act of 1997 (42 U.S.C.
			 1437f note) is amended—</text>
			<paragraph id="HC9CF4E0A29744AA28FC5EF8595AB541C"><enum>(1)</enum><text>in subparagraph
			 (A)—</text>
				<subparagraph id="HDEFB8DFD88C7440BAB65ACF70000D9FD"><enum>(A)</enum><text>in the first
			 sentence—</text>
					<clause id="H81697BABABEA452CA7B6F0C74EF9ED16"><enum>(i)</enum><text>by striking <quote>not
			 more than</quote> and inserting <quote>not less than</quote>;</text>
					</clause><clause id="H9EBD56B1E3C441C795B79C3C78D7BB0"><enum>(ii)</enum><text>by striking <quote>of
			 low-income housing for which project-based rental assistance is provided at
			 below market rent levels and may not be renewed</quote> and inserting the
			 following: <quote>and improvement of low-income housing for which project-based
			 rental assistance, subsidized loans, or enhanced vouchers under section 8(t)
			 are provided</quote>; and</text>
					</clause><clause id="H9CF78EE1238D4296955641E9452C24A5"><enum>(iii)</enum><text>in the second
			 parenthetical clause, by inserting before the closing parenthesis the
			 following: <quote>, and predevelopment assistance to enable such
			 transfers</quote>; and</text>
					</clause></subparagraph><subparagraph id="HA9B79F7A08604643BF0092E9FBEECAD"><enum>(B)</enum><text>by inserting after the
			 period at the end the following: <quote>For outreach and training of tenants
			 and technical assistance, the Secretary shall implement a grant program
			 utilizing performance-based outcome measures for eligible costs incurred.
			 Recipients providing capacity building or technical assistance services to
			 tenant groups shall be qualified nonprofit Statewide, countywide, areawide or
			 citywide organizations with demonstrated experience including at least a
			 two-year recent track record of organizing and providing assistance to tenants,
			 and independence from the owner, a prospective purchaser, or their managing
			 agents. The Secretary may provide assistance and training to grantees in
			 administrative and fiscal management to ensure compliance with applicable
			 Federal requirements. The Secretary shall expedite the provision of funding for
			 fiscal year 2008 by entering into new multi-year contracts with any prior
			 grantee without adverse audit findings or whose adverse audit findings have
			 been cleared, and by entering into an interagency agreement for not less than
			 $1,000,000 with the Corporation for National and Community Service or any other
			 agency of the Federal Government, that is selected by the Secretary and the
			 Secretary determines is qualified to conduct such program, to conduct a tenant
			 outreach and training program under the same or similar terms and conditions as
			 was most recently conducted by the Corporation. The Secretary shall also make
			 available flexible grants to qualified nonprofit organizations that do not own
			 eligible multifamily properties, for tenant outreach in underserved areas, and
			 to experienced national or regional nonprofit organizations to provide
			 specialized training or support to grantees assisted under this section.
			 Notwithstanding any other provision of law, funds authorized under this section
			 for any fiscal year shall be available for obligation in subsequent fiscal
			 years. The Secretary shall require each recipient of amounts made available
			 pursuant to this subparagraph to submit to the Secretary reports, on a
			 quarterly basis, detailing the use of such funds and including such information
			 as the Secretary shall require.</quote>; and</text>
				</subparagraph></paragraph><paragraph id="HFA9BC1E6AD5E4BC8A48E5FCC5DCF1022"><enum>(2)</enum><text>by adding at the end the
			 following new subparagraphs:</text>
				<quoted-block display-inline="no-display-inline" id="HDDDA48BEB66E4E2FA035D8A552339128" style="OLC" changed="added" reported-display-style="italic" committee-id="HBA00">
					<subparagraph id="H40E60B403B624C549ED3FD3080C08E89"><enum>(D)</enum><header>Prohibitions</header><text display-inline="yes-display-inline">None of the funds made available under
				subparagraph (A) may be used for any political activities, political advocacy,
				or lobbying (as such terms are defined by Circular A–122 of the Office of
				Management and Budget, entitled <quote>Cost Principles for Non-Profit
				Organizations</quote>), or for expenses for travel to engage in political
				activities or preparation of or provision of advice on tax returns.</text>
					</subparagraph><subparagraph id="H00135096FBF4463C966F2CC531EFD9B"><enum>(E)</enum><header>Program compliance
				systems</header><text display-inline="yes-display-inline">Each recipient of
				amounts made available under subparagraph (A) shall develop systems to ensure
				compliance with the program and the requirements of this paragraph.</text>
					</subparagraph><subparagraph id="H8E987CB5CF464B3385CE89C3812FFDE2"><enum>(F)</enum><header>Penalties</header><text>The
				Secretary may impose penalties on any recipient of amounts made available under
				subparagraph (A) that fails to comply with any requirement under this paragraph
				or of the program established pursuant to this paragraph, which penalties may
				include—</text>
						<clause id="H6F19E9C9C2FA4F759E5BD6AD66582F41"><enum>(i)</enum><text>ineligibility for further
				assistance from amounts made available under subparagraph (A); and</text>
						</clause><clause id="H17D136D4C0134709B5D0C7E5D81939CB"><enum>(ii)</enum><text>requiring the recipient
				to reimburse the Secretary for any amounts that were so
				misused.</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H5074869A1A5742ECA9957F5CCE7DB453"><enum>6.</enum><header>Exception
			 rents</header><text display-inline="no-display-inline">In the matter preceding
			 clause (i) of section 514(g)(2)(A) of the Multifamily Assisted Housing Reform
			 and Affordability Act of 1997 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref> note) is amended—</text>
			<paragraph id="H29539C25BFEF4A7AA82B7096EFB4D316"><enum>(1)</enum><text>by inserting
			 <quote>disaster-damaged eligible projects and</quote> after <quote>waive this
			 limit for</quote>; and</text>
			</paragraph><paragraph id="H3AB16A0197F2437388F96DAE378D3B89"><enum>(2)</enum><text>by striking <quote>five
			 percent</quote> and inserting <quote>9 percent</quote>.</text>
			</paragraph></section><section id="H10A9464159C04728A9C88BFAE7ED76F"><enum>7.</enum><header>Otherwise eligible
			 projects</header><text display-inline="no-display-inline">Section 514 of the
			 Multifamily Assisted Housing Reform and Affordability Act of 1997 (42 U.S.C.
			 1437f note) is amended by adding at the end the following:</text>
			<quoted-block id="HCC7A12A26F0344F29067B0856D43839D" style="OLC" changed="added" reported-display-style="italic" committee-id="HBA00">
				<subsection id="HC6ECB1D7208144199424CEFF4DA5D4F6"><enum>(i)</enum><header>Other Eligible
				Projects</header>
					<paragraph id="H1C74CAB318914A5EA72CFF158CBCAED"><enum>(1)</enum><header>In
				general</header><text>Notwithstanding any other provision of this subtitle, a
				project that meets the requirements of subparagraphs (B) and (C) of section
				512(2) but does not meet the requirements of subparagraph (A) of section
				512(2), may be treated as an eligible multifamily housing project on an
				exception basis if the Secretary determines, subject to paragraph (2), that
				such treatment is necessary to preserve the project in the most cost-effective
				manner in relation to other alternative preservation options.</text>
					</paragraph><paragraph id="H01EAB5C478E54B20A9F3651BDE70EFCF"><enum>(2)</enum><header>Owner request</header>
						<subparagraph id="H84DCEAC3E3924C228161C49892BE7772"><enum>(A)</enum><header>Request
				required</header><text>The Secretary shall not treat an otherwise eligible
				project described under paragraph (1) as an eligible multifamily housing
				project unless the owner of the project requests such treatment.</text>
						</subparagraph><subparagraph id="H5A9F8F63181A489CB8F6D4EC8D9E1E00"><enum>(B)</enum><header>No adverse treatment if
				no request made</header><text>If the owner of a project does not make a request
				under subparagraph (A), the Secretary shall not withhold from such project any
				other available preservation option.</text>
						</subparagraph></paragraph><paragraph id="H082FFA9B2C71442CB200B23591049CE"><enum>(3)</enum><header>Cancellation</header>
						<subparagraph id="HDEDA283488DE4569ADCE352E4B1CBC2E"><enum>(A)</enum><header>Timing</header><text>At
				any time prior to the completion of a mortgage restructuring under this
				subtitle, the owner of a project may—</text>
							<clause id="H9B7090271093404CAFABE8D0001992E9"><enum>(i)</enum><text>withdraw any request made
				under paragraph (2)(A); and</text>
							</clause><clause id="H4CA9CA196ECE41FAB3BF123459255517"><enum>(ii)</enum><text>pursue any other option
				with respect to the renewal of such owner’s section 8 contract pursuant to any
				applicable statute or regulation.</text>
							</clause></subparagraph><subparagraph id="H59AB64BF08BE4C5E95976BF46B5BC3E6"><enum>(B)</enum><header>Documentation</header><text>If
				an owner of a project withdraws such owner’s request and pursues other renewal
				options under this paragraph, such owner shall be entitled to submit
				documentation or other information to replace the documentation or other
				information used during processing for mortgage restructuring under this
				subtitle.</text>
						</subparagraph></paragraph><paragraph id="HBC017590B1094D90A062A82790A03D77"><enum>(4)</enum><header>Limitation</header><text>The
				Secretary may exercise the authority to treat projects as eligible multifamily
				housing projects pursuant to this subsection only to the extent that the number
				of units in such projects do not exceed 10 percent of all units for which
				mortgage restructuring pursuant to section 517 is
				completed.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H3091C73D35934DC09B499BA198C4061"><enum>8.</enum><header>Disaster-damaged
			 eligible projects</header>
			<subsection id="H61AB8E1FABAA4FE1A706FB130700A200"><enum>(a)</enum><header>Market Rent
			 Determinations</header><text>Section 514(g)(1)(B) of the Multifamily Assisted
			 Housing Reform and Affordability Act of 1997 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref> note) is amended
			 by striking “determined, are equal” and inserting the following:
			 “determined—</text>
				<quoted-block id="H1C937927A84D4B4DAB26702B7BE2DC81" style="OLC" changed="added" reported-display-style="italic" committee-id="HBA00">
					<clause id="H45E98877A6D9492B87BD35137DEC866E"><enum>(i)</enum><text>with respect to a
				disaster-damaged eligible property, are equal to 100 percent of the fair market
				rents for the relevant market area (as such rents were in effect at the time of
				such disaster); and</text>
					</clause><clause id="H360DBE2853B74EB8A7B7F39D5C575114"><enum>(ii)</enum><text>with respect to other
				eligible multifamily housing projects, are
				equal</text>
					</clause><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HC734A3D8D01642EBB5EC76AA47FF329B"><enum>(b)</enum><header>Owner
			 Investment</header><text>Section 517(c) of the Multifamily Assisted Housing
			 Reform and Affordability Act of 1997 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref> note) is amended by
			 adding at the end the following:</text>
				<quoted-block id="H178211F3670C4D6F959B99D4A55B2BF4" style="OLC" changed="added" reported-display-style="italic" committee-id="HBA00">
					<paragraph id="HE56966A79C324D61B794C5EC886D1FD8"><enum>(3)</enum><header>Properties damaged by
				natural disasters</header><text>With respect to a disaster-damaged eligible
				property, the owner contribution toward rehabilitation needs shall be
				determined in accordance with paragraph
				(2)(C).</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="H50CB5D7AA94B40F78C61E5A683DA6104"><enum>9.</enum><header>Period of eligibility
			 for nonprofit debt relief</header><text display-inline="no-display-inline">Section 517(a)(5) of the Multifamily
			 Assisted Housing Reform and Affordability Act of 1997 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref> note) is
			 amended by adding at the end the following: “If such purchaser acquires such
			 project subsequent to the date of recordation of the affordability agreement
			 described in section 514(e)(6)—</text>
			<quoted-block display-inline="no-display-inline" id="H8F8B753FB8364D498793A903E1F634A" style="OLC" changed="added" reported-display-style="italic" committee-id="HBA00">
				<subparagraph id="HBC1EA10F549A4C2A9493A46FDD00F943"><enum>(A)</enum><text display-inline="yes-display-inline">such purchaser shall acquire such project
				on or before the later of—</text>
					<clause id="HDEF98BEB8FFE493A96CB8D4069462902"><enum>(i)</enum><text>5 years after the date of
				recordation of the affordability agreement; or</text>
					</clause><clause id="H76DEBF76858E4B0CB49873251EDF5C45"><enum>(ii)</enum><text>2 years after the date
				of enactment of the <short-title>Mark-to-Market Extension
				and Enhancement Act of 2007</short-title>; and</text>
					</clause></subparagraph><subparagraph id="HD42BCB5DC1C04A4F9E003CC0563F661C"><enum>(B)</enum><text>the Secretary shall have
				received, and determined acceptable, such purchaser’s application for
				modification, assignment, or forgiveness prior to the acquisition of the
				project by such
				purchaser.</text>
				</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section display-inline="no-display-inline" id="H41FC3AFB69E14578B29EF091D836F632"><enum>10.</enum><header>Acquisition of
			 restructured projects by nonprofit organizations</header><text display-inline="no-display-inline">Paragraph (5) of section 517(a) of the
			 Multifamily Assisted Housing Reform and Affordability Act of 1997 (42 U.S.C.
			 1437 note) is amended by inserting <quote>, or the sole general partner of the
			 limited partnership owning the project,</quote> after <quote>if the

		</section><section display-inline="no-display-inline" id="H6CDE4D8C305445BE88601D2C6C60EFE2"><enum>11.</enum><header>Mark-to-market for
			 moderate rehabilitation projects</header>
			<subsection id="H6A81E9488E514668B064BC5B1DA77F87"><enum>(a)</enum><header>Renewal of expiring
			 project-based section 8 moderate rehabilitation contracts</header><text display-inline="yes-display-inline">Section 524 of the Multifamily Assisted
			 Housing Reform and Affordability Act of 1997 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref> note) is
			 amended—</text>
				<paragraph id="HDB864EC5DFED40DDA24238D9E7635E39"><enum>(1)</enum><text>in subsection
			 (a)(4)(A)(iv)—</text>
					<subparagraph id="H590DB8DD81B1413383A8AE9C75337127"><enum>(A)</enum><text>in subclause (I), by
			 inserting <quote>or</quote> after the semicolon;</text>
					</subparagraph><subparagraph id="HB5836B8643C04C3DA560B9D2E474DF5D"><enum>(B)</enum><text>by striking subclause
			 (II); and</text>
					</subparagraph><subparagraph id="H33B344AD546941FFAD4E084800F1ABCA"><enum>(C)</enum><text>by redesignating
			 subclause (III) as subclause (II); and</text>
					</subparagraph></paragraph><paragraph id="HFDE1E5BD83FD4946BA127EDA78C6003F"><enum>(2)</enum><text>in subsection (b), by
			 striking paragraph (3).</text>
				</paragraph></subsection><subsection id="HF2FB2302A10444918B861D6100882C78"><enum>(b)</enum><header>Rent adjustments for
			 covered projects</header>
				<paragraph id="H5AB9F6E21A5E4BE991A135D4E4B9FC2F"><enum>(1)</enum><header>Rent determination at
			 initial renewal after enactment</header><text display-inline="yes-display-inline">Upon the first request by an owner of a
			 covered housing project for renewal of project-based assistance pursuant to
			 section 524 of the Multifamily Assisted Housing Reform and Affordability Act of
			 1997 made after the date of the enactment of this Act—</text>
					<subparagraph id="H0F11A3582C0B4DF99CE6CD48097724BE"><enum>(A)</enum><text>the rent levels at which
			 assistance will be provided pursuant to such renewal shall be determined as if
			 such renewal were the initial renewal of a contract for assistance under
			 section 524, as amended by subsection (a) of this section; and</text>
					</subparagraph><subparagraph id="H9B19E455E4BA45599D8F06B0A4B4EB67"><enum>(B)</enum><text>solely for purposes of
			 determining the rent levels at which assistance will be provided pursuant to
			 such first renewal after the date of the enactment of this Act, in the case of
			 a project for which contract rents were reduced upon a prior renewal of an
			 expiring contract pursuant to subsection (b)(3) of section 524, as in effect on
			 the day before the date of the enactment of this Act, the contract rent levels
			 in effect immediately prior to such first renewal after the date of the
			 enactment of this Act shall be the considered to be the deemed rent levels
			 described in paragraph (3)(C).</text>
					</subparagraph></paragraph><paragraph id="H5A041E55ED71481A97A8467650BCAEA"><enum>(2)</enum><header>Rent adjustments after
			 initial renewal after enactment</header><text display-inline="yes-display-inline">After the first renewal of a contract for
			 assistance of a covered housing project after the date of the enactment of this
			 Act in accordance with paragraph (1) of this subsection, the Secretary of
			 Housing and Urban Development shall adjust rents in accordance with subsection
			 (c) of section 524.</text>
				</paragraph><paragraph id="HEC833442593E4F71A79117D00020EA3"><enum>(3)</enum><header>Definitions</header><text>For
			 purposes of this subsection, the following definitions shall apply:</text>
					<subparagraph id="H2A5CF66E8BD24D0DAD25B4FF6D93D2B"><enum>(A)</enum><text display-inline="yes-display-inline">The term <quote>section 524</quote> means
			 section 524 of the Multifamily Assisted Housing Reform and Affordability Act of
			 1997 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref> note).</text>
					</subparagraph><subparagraph id="HDA93937B6C8A451BA900D56E17600DD"><enum>(B)</enum><text display-inline="yes-display-inline">The term <quote>covered housing
			 project</quote> means a project that receives project-based assistance under
			 section 8 of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref>) which was
			 renewed prior to the date of the enactment of this Act pursuant to subsection
			 (b)(3) of section 524, as in effect on the day before the date of the enactment
			 of this Act.</text>
					</subparagraph><subparagraph id="H548E5BB1A0714CED968B55F2A425E93D"><enum>(C)</enum><text display-inline="yes-display-inline">The term <quote>deemed rent levels</quote>
			 means the contract rent levels in effect immediately prior to the first renewal
			 of assistance pursuant to subsection (b)(3) of section 524, as in effect on the
			 day before the date of the enactment of this Act, upon which contract rent
			 levels were reduced, as adjusted by the applicable operating cost adjustment
			 factor established by the Secretary at the date of such renewal and at the date
			 of any subsequent renewal pursuant to such subsection (b)(3).</text>
					</subparagraph><subparagraph id="HC27AFAD155104DF9BBBF77B978D543E2"><enum>(D)</enum><text display-inline="yes-display-inline">The term <quote>Secretary</quote> means the
			 Secretary of Housing and Urban Development or any public housing agency
			 approved by the Secretary to serve as the contracting party in lieu of the
			 Secretary.</text>
					</subparagraph></paragraph></subsection></section><section display-inline="no-display-inline" id="HB0AB685E40DB41C6941BADCB57EA5878" section-type="subsequent-section"><enum>12.</enum><header>Enhanced voucher
			 assistance upon contract termination</header><text display-inline="no-display-inline">Subsection (d) of section 524 of the
			 Multifamily Assisted Housing Reform and Affordability Act of 1997 (42 U.S.C.
			 1437 note) is amended—</text>
			<paragraph id="H0489B22A5ACD45919C76B9FBB69B6166"><enum>(1)</enum><text>in the subsection
			 heading, by inserting <quote><header-in-text level="subsection" style="OLC">or
			 termination</header-in-text></quote> after <quote><header-in-text level="subsection" style="OLC">contract expiration</header-in-text></quote>;
			 and</text>
			</paragraph><paragraph id="HC69C47C877E64F08A6008CC41FF3663F"><enum>(2)</enum><text>in paragraph (1)—</text>
				<subparagraph id="H523F73D91AF54379BB7CCF9E0024E284"><enum>(A)</enum><text>by inserting <quote>or
			 termination</quote> after <quote>the date of the expiration</quote>;</text>
				</subparagraph><subparagraph id="H53AF2A32F6AD4326BC8123AEFB7FEE77"><enum>(B)</enum><text>by striking <quote>shall
			 make</quote> and inserting <quote>shall provide</quote>;</text>
				</subparagraph><subparagraph id="HE6A4B7D40B9E4134A087C0EB607C2D40"><enum>(C)</enum><text>by striking
			 <quote>available on behalf of</quote> and inserting <quote>for</quote>;
			 and</text>
				</subparagraph><subparagraph id="HEEC469152A6B48E8A178AD1E83CA5E4"><enum>(D)</enum><text display-inline="yes-display-inline">by inserting <quote>or termination</quote>
			 after <quote>the date of such expiration</quote>.</text>
				</subparagraph></paragraph></section><section display-inline="no-display-inline" id="HA6CC218220634CC6B17C9725F280B7E3"><enum>13.</enum><header>Correcting harm caused
			 by late subsidy payments</header><text display-inline="no-display-inline">Section 8 of the United States Housing Act
			 of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref>) is amended by adding at the end the following new
			 subsection:</text>
			<quoted-block display-inline="no-display-inline" id="H19A30375F76040828DD265DEC5D2996C" style="OLC" changed="added" reported-display-style="italic" committee-id="HBA00">
				<subsection id="H90E283B28087465396F313B7DAAD0081"><enum>(ff)</enum><header>Late payments</header>
					<paragraph id="HE6E0F1DC84EA480F9CF5029D86ED34D"><enum>(1)</enum><header>General</header><text>The
				Secretary shall make payments of project-based rental assistance provided under
				this section for each month on or before the due date under paragraph (2) for
				the payment.</text>
					</paragraph><paragraph id="H00F3715D84574BC892592D22AE8DC426"><enum>(2)</enum><header>Due
				date</header><text>The due date under this paragraph for a monthly payment is
				the first business day of the month.</text>
					</paragraph><paragraph id="HA7A0245A3A6641098E6BB08E2F5781B"><enum>(3)</enum><header>Notification of late
				payment</header><text>The Secretary shall notify a project owner at least 10
				days before the due date for a housing assistance payment if such payment will
				be late and shall inform the project owner of the approximate date the payment
				will be made.</text>
					</paragraph><paragraph id="H0B3D1107B3B245C985B179BFAF684E59"><enum>(4)</enum><header>Use of
				reserves</header><text display-inline="yes-display-inline">If a housing
				assistance payment for a project has not been received before the expiration of
				the 10-day period beginning upon the due date for such payment, the project
				owner shall, after the expiration of such period, be entitled to obtain funds
				from a project replacement reserve, residual receipts reserve, or other project
				reserve in order to pay operating and debt service costs for the project. Upon
				receipt of the monthly housing assistance payment from the Secretary, the
				project owner shall promptly replace or replenish any such funds advanced
				pursuant to the preceding sentence.</text>
					</paragraph><paragraph id="H93BCE8B8DE684CBEA2DEC501B79223CE"><enum>(5)</enum><header>Interest
				payment</header><text>If a monthly housing assistance payment is not made
				before the expiration of the 30-day period beginning upon the due date for such
				payment, the Secretary shall pay to the owner simple interest on the amount of
				such monthly payment, from the due date until the date of payment, at a rate
				determined by the Secretary of Treasury in accordance with section 12 of the
				Contract Disputes Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/41/611">41 U.S.C. 611</external-xref>). Interest payments under this
				paragraph shall be made from amounts made available for management and
				administration of the Department of Housing and Urban
				Development.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HBF5544C02CA74C7FA087D578CBDA00BF"><enum>14.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">This Act, and the
			 amendments made by this Act, shall take effect on the earlier of—</text>
			<paragraph id="H780C7B13C5114159BF4CC9CBFA140479"><enum>(1)</enum><text>the date of enactment of
			 this Act; or</text>
			</paragraph><paragraph id="H1F4CBFD04C5C4EF58E7DDA3290DB4385"><enum>(2)</enum><text>September 30,
			 2008.</text>
