		<official-title>To amend the Consumer Product Safety Act to require the
		  development of a multi-stage product testing process to ensure compliance of
		  children’s products with consumer product safety standards, and for other
		  purposes.</official-title>

		<section id="H74963E0B736040D300667EDBAF3997BC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Kids’ Toys Safety
			 Act</short-title></quote>.</text>
		</section><section id="HCB8A0259370344B8A21DA6E190C4174E"><enum>2.</enum><header>Mandatory testing
			 for certain children’s products</header>
			<subsection id="H9DF50F0DB8B54E8C0093EE588C717E09"><enum>(a)</enum><header>Mandatory and
			 third-party testing</header><text display-inline="yes-display-inline">Section
			 14 of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2063">15 U.S.C. 2063(b)</external-xref>) is amended—</text>
				<paragraph id="H3AF687A6E4CC4CA69B0700CF99D8BB9E"><enum>(1)</enum><text>in subsection
			 (b)—</text>
					<subparagraph id="H2E3BFAB70A90484FB8FE7545D500FAD3"><enum>(A)</enum><text>by striking
			 <quote>The Commission</quote> and inserting <quote>(1) The
			 Commission</quote>;</text>
					</subparagraph><subparagraph id="HFAC281610EE74D9EAA6761D592780074"><enum>(B)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H65808ECCE41F46FE976FAA20C497065D" style="traditional">
							<paragraph id="H34ABA31E318640E99CE484155926D54B"><enum>(2)</enum><text display-inline="yes-display-inline">In the case of a children’s product subject
				to a consumer product safety standard under this Act, the Commission shall
				prescribe a comprehensive testing program for such products that—</text>
								<subparagraph id="HE439C2E75AF0448ABD00507F6E35F915"><enum>(A)</enum><text>is designed to
				insure that all children’s products conform to all applicable consumer product
				safety standards;</text>
								</subparagraph><subparagraph id="H3A99478CCF4C4E7481F6B9CFED61FD68"><enum>(B)</enum><text display-inline="yes-display-inline">includes testing for multiple stages of
				production, including development, pre-production, production, assembly, and
				packaging; and</text>
								</subparagraph><subparagraph commented="no" id="H9B6E10BBCFCD4D718DA07433B540E102"><enum>(C)</enum><text>shall be conducted
				by a nongovernmental independent third party qualified to perform such tests or
				testing programs.</text>
								</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H61E62D675DF640A40079AF8919A6AB1D"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HA8C33C18B0C74C6ABA033BD2ECBE0423" style="traditional">
						<subsection id="HC94D0C4F7E13435480C9239348E4176"><enum>(d)</enum><header>Definitions</header><text display-inline="yes-display-inline">The term <quote>children’s product</quote>
				means a toy or other article intended for use by a child under 60 months of age
				that is introduced into the interstate stream of commerce. In determining
				whether a toy or article is intended for use by a child under 60 months of age,
				the following factors shall be considered:</text>
							<paragraph id="HDABBDB10B0514818A5F75119FD5CF8F7"><enum>(1)</enum><text>A statement by a
				manufacturer about the intended use of such toy or article, including a label
				on such toy or article, if such statement is reasonable.</text>
							</paragraph><paragraph id="HC767BFDC7DA244D7AEA380D74EBEA2D3"><enum>(2)</enum><text>The context and
				manner of the advertising, promotion, and marketing associated with the toy or
				article.</text>
							</paragraph><paragraph id="HEB2F0ABB6D26446AA88D00A85DD98112"><enum>(3)</enum><text>Whether the toy or
				article is commonly recognized by consumers as being intended for use by a
				child under 60 months of age.</text>
							</paragraph><paragraph id="H36F512F323DA4F5AA2EA243EA7F288AC"><enum>(4)</enum><text>The Age
				Determination Guideline issued by the Consumer Product Safety Commission in
				September 2002 and any subsequent version of such
				Guideline.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="H590EF3F0969242B48F02584690686E25"><enum>3.</enum><header>CPSC notification
			 of voluntary manufacturer recalls</header><text display-inline="no-display-inline">Section 15 of the Consumer Product Safety
			 Act is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="HC72A70A47E6248F90054F1ABF7D37242" style="OLC">
				<subsection id="HDD4C764430B94B75A4006F00E3FF5408"><enum>(i)</enum><header>Notification of
				recalled products</header><text display-inline="yes-display-inline">Not later
				than 48 hours after the Commission is formally notified of any voluntary recall
				of any consumer product self-initiated by a manufacturer (or a retailer in the
				case of a retailer selling a product under its own label), or issues an order
				under subsection (c) or (d) with respect to any product, the Commission
				shall—</text>
					<paragraph id="H2B173D4C76C743B7B98BA523FEBDA7EE"><enum>(1)</enum><text>post a notice of
				such recall or order on the Internet website maintained by the Commission which
				shall include the name and description of the product and the reason for the
				recall; and</text>
					</paragraph><paragraph id="HC800F72C4B3B44BEA831D23B8435CB75"><enum>(2)</enum><text>notify the State
				Health Department of each State of the recall or
				order.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H3B38FD3569C04575B7110014C0013EF8"><enum>4.</enum><header>Tracking label’s
			 for children’s products</header><text display-inline="no-display-inline">Section 14(a) of the Consumer Product Safety
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2063">15 U.S.C. 2063(a)</external-xref>) is further amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="HE4C8DD3668D346FBBB6618C9AC7FC79" style="traditional">
				<paragraph id="H1F59CD8B29F84DD0B0C8ED7F8CFB87CD"><enum>(6)</enum><text display-inline="yes-display-inline">The manufacturer of a children’s product
				shall place distinguishing marks on the product or its packaging that will
				enable the ultimate purchaser to ascertain the source, date, and other
				production information of the product by reference to those
				marks.</text>
				</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H5403182CC22047D79C9BB0EDE9E9D73"><enum>5.</enum><header>Database of
			 certain production facilities</header><text display-inline="no-display-inline">Not later than 3 months after the date of
			 enactment of this Act, the Consumer Product Safety Commission shall establish a
			 database to serve as a clearinghouse for the submission and exchange of
			 information regarding factories, warehouses, or other facilities where consumer
			 products which have been subject to a recall were manufactured. The database
			 shall include the names and locations of such facilities, a description of the
			 types of products known to have been produced in such facilities, and the
			 reasons such products were recalled. The database shall not contain proprietary
			 information or information regarding confidential business
			 relationships.</text>
