		  to an entertainment product containing material that is harmful to minors, and

		<section display-inline="no-display-inline" id="H5C06B4E4AD524344A734D1BB4F1F4914" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Parents’ Empowerment
			 Act</short-title></quote>.</text>
		</section><section id="H8E6FD19E7655494D8500C3F7BDE34670"><enum>2.</enum><header>Civil action for
			 a minor injured by exposure to an entertainment product containing material
			 that is harmful to minors</header>
			<subsection id="HD4ED66D5316042F980ACF5D7E62DC1B"><enum>(a)</enum><header>Civil
			 action</header><text>A minor, through a person acting on behalf of the minor in
			 accordance with Rule 17(c) of the Federal Rules of Civil Procedure to the
			 extent applicable, may, in a civil action in an appropriate district court of
			 the United States, obtain relief under
			 <internal-xref idref="H4E0F516ACD0C497987AEF39C4EDB8C18" legis-path="2.(b)">subsection (b)</internal-xref> against any person who
			 knowingly sells or distributes in interstate or foreign commerce an
			 entertainment product containing material that is harmful to minors, if—</text>
				<paragraph id="H269E5AB5370242AEBBD8B33B8D5C59D3"><enum>(1)</enum><text>a
			 reasonable person would expect a substantial number of minors to be exposed to
			 the material; and</text>
				</paragraph><paragraph id="HA049A230693D4AC4B0955D0441CD43C0"><enum>(2)</enum><text>the minor as a
			 result of exposure to that material is likely to suffer personal or emotional
			 injury or injury to mental or moral welfare.</text>
				</paragraph></subsection><subsection id="H4E0F516ACD0C497987AEF39C4EDB8C18"><enum>(b)</enum><header>Relief</header><text>In
			 an action under
			 <internal-xref idref="HD4ED66D5316042F980ACF5D7E62DC1B" legis-path="2.(a)">subsection (a)</internal-xref>, if the minor is the
			 prevailing party—</text>
				<paragraph id="H218E9D5843BD4E7A93A4A8DBAAE0C0F4"><enum>(1)</enum><text>the minor shall
			 recover compensatory damages of not less than $10,000 for each instance of any
			 such material in any such product to which such minor was so exposed;</text>
				</paragraph><paragraph id="H99719424669247E2BA9FA6E1C4784C98"><enum>(2)</enum><text>the minor may
			 recover punitive damages;</text>
				</paragraph><paragraph id="HEF68BDDD4BC946EA9FA02D303298787F"><enum>(3)</enum><text>the court, in its
			 discretion, may allow the minor a reasonable attorney’s fee (including expert
			 fees) as part of the costs; and</text>
				</paragraph><paragraph id="H4F608FB42ED94146AF3469EEE5BF399"><enum>(4)</enum><text>the court may order
			 any other appropriate relief.</text>
				</paragraph></subsection><subsection id="H276E189F4FF548599BEA4BB1B74FED19"><enum>(c)</enum><header>Affirmative
			 defense</header><text>It is an affirmative defense to an action under this
			 section that a parent or guardian of the minor owned or possessed the
			 entertainment product containing the material to which the minor was exposed,
			 and an act of that parent or guardian was the proximate cause of the minor’s
			 exposure to that material.</text>
			</subsection><subsection id="HF9C3892ACC5A4B18874B47E867F7B856"><enum>(d)</enum><header>Definitions</header><text>For
			 purposes of this section:</text>
				<paragraph id="H33357FB45DF84DB696D655F43B591CF3"><enum>(1)</enum><text>The term
			 <term>entertainment product</term> means a picture, photograph, image, graphic
			 image file, drawing, video game, motion picture film, or similar visual
			 representation or image, book, pamphlet, magazine, printed matter, or sound
			 recording.</text>
				</paragraph><paragraph id="H992E7FBCAAC04AC1BA6085A97F9FFB75"><enum>(2)</enum><text>The term
			 <term>material that is harmful to minors</term> means any pornographic
			 communication, picture, image, graphic image file, article, recording, writing,
			 or other pornographic matter of any kind that is obscene or that—</text>
					<subparagraph id="H85A72EC19D96452BB43668247C4EF375"><enum>(A)</enum><text>the average
			 person, applying the contemporary standards of the adult community in which the
			 minor resides with respect to what is suitable for minors, would find, taking
			 the material as a whole and with respect to minors of the ages that the person
			 reasonably would expect to be exposed to the material—</text>
						<clause id="H673FD8DDC6844828AB00666668531031"><enum>(i)</enum><text>is
			 designed to appeal to, or is designed to pander to, the prurient interest in
			 nudity, sex, or excretion, with respect to minors; and</text>
						</clause><clause id="H460375B84AC8483BB1EFBEAD4ED674AB"><enum>(ii)</enum><text>depicts,
			 describes, or represents, in a manner patently offensive with respect to
			 minors, an actual or simulated sexual act or sexual contact, an actual or
			 simulated normal or perverted sexual act, or a lewd exhibition of the genitals
			 or post-pubescent female breast; and</text>
						</clause></subparagraph><subparagraph id="H70A94D1332FF43B186611D807CD044B7"><enum>(B)</enum><text>a reasonable
			 person would find, taken as a whole, lacks serious literary, artistic,
			 political, and scientific value for minors sufficient to overcome the
			 pernicious effect of that material.</text>
					</subparagraph></paragraph><paragraph id="H3357982F817F4383980069FF761E677"><enum>(3)</enum><text>The term
			 <term>minor</term> means an individual under the age of 18.</text>
				</paragraph></subsection><subsection id="HCEE39C5D176548FE9C60DA537910E7DB"><enum>(e)</enum><header>Severability</header><text>If
			 any provision of this section or any application of such provision to any
			 person or circumstance is held to be unconstitutional, the remainder of this
			 section and the application of the provision to any other person or
			 circumstance shall not be affected.</text>
