		<section id="H7804204D013F454E85D04B587F4E126F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Negative Amortization Mortgage Loan
			 Transparency Act</short-title></quote>.</text>
		</section><section id="H325F6ED4FA884BAB937D7C2959549D91"><enum>2.</enum><header>Requirements for
			 mortgage loans that permit negative amortization</header>
			<subsection id="H22005B4DE8394A29BF968BCE427086CC"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Chapter 2 of the
			 Truth in Lending Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1631">15 U.S.C. 1631 et seq.</external-xref>) is amended by inserting after
			 section 129 the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="HD5C06FC1883B4E919F3F16EDD09DC243" style="USC">
					<section id="H621F76A7CB164EF3855BBFFFABA5C9EA"><enum>129A.</enum><header>Mortgages with
				negative amortization.</header><text display-inline="no-display-inline">No
				creditor may extend credit to a first-time borrower in connection with a
				consumer credit transaction under an open or closed end consumer credit plan
				secured by residential real property that includes a dwelling, other than a
				reverse mortgage, that provides or permits a payment plan that may, at any time
				over the term of the extension of credit, result in negative amortization
				unless, before such transaction is consummated—</text>
						<paragraph id="H2C9E11503B164E63BD7EFC58AE3B4905"><enum>(1)</enum><text>the creditor
				provides the consumer with a statement that—</text>
							<subparagraph id="H31F5BDB8A643418CBE4E02DB875520BA"><enum>(A)</enum><text>the pending
				transaction will or may, as the case may be result in negative
				amortization;</text>
							</subparagraph><subparagraph id="HAEA628B0B1B5430093EBF892244B0CE"><enum>(B)</enum><text>describes negative
				amortization in such manner as the Board shall prescribe;</text>
							</subparagraph><subparagraph id="H4EA814390A9547F4913C1CF8062B435D"><enum>(C)</enum><text display-inline="yes-display-inline">negative amortization increases the
				outstanding principal balance of the account; and</text>
							</subparagraph><subparagraph id="HC902FB94B03B4A7A9D436200D38C4BAE"><enum>(D)</enum><text display-inline="yes-display-inline">negative amortization reduces the
				consumer’s equity in the real property; and</text>
							</subparagraph></paragraph><paragraph id="H15537CB4BF2E4E8E819FF90091CE3CCC"><enum>(2)</enum><text display-inline="yes-display-inline">the consumer provides the creditor with
				sufficient documentation to demonstrate that the consumer received
				homeownership counseling from organizations or counselors certified by the
				Secretary of Housing and Urban Development as competent to provide such
				counseling.</text>
						</paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H3EA5E129228948260018F6B0ED1730C5"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of sections for chapter 2 of the Truth in
			 Lending Act is amended by inserting after the item relating to section 129 the
			 following new item:</text>
