		<section id="H3E739F572F1041A38DA200E1DC7685B1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Responsible and Effective Solutions
			 for Children Using and Entering Online Services Act of
			 2007</short-title></quote>.</text>
		</section><section id="H437594D489B34D2DA2955EC55523952F"><enum>2.</enum><header>Data relating to
			 crimes of child exploitation</header><text display-inline="no-display-inline">Section 227(b) of the Victims of Child Abuse
			 Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/13032">42 U.S.C. 13032(b)</external-xref>) is amended—</text>
			<paragraph id="HB85B4BAA0367450DA47D64262EF6B035"><enum>(1)</enum><text>by redesignating
			 paragraphs (3) and (4) as paragraphs (4) and (5), respectively;</text>
			</paragraph><paragraph id="H69382C9AEF17480C882BEC114F2618A4"><enum>(2)</enum><text>by inserting after
			 paragraph (2) the following new paragraph:</text>

					<paragraph id="HC9C373D5B5B34B009F543F2601A24E24"><enum>(3)</enum><header>Contents of
				report</header>
						<subparagraph id="H860F01B5DEBB49B48D99D66E672C71FF"><enum>(A)</enum><text display-inline="yes-display-inline">A provider of electronic communication
				services or remote computing services described in paragraph (1) who makes a
				report under that paragraph shall, to the extent possible, include in such
				report information related to the facts and circumstances of such report that
				is reasonably available to the provider, and that the provider considers to be
				reliable information, which may include—</text>
							<clause id="H499A5D05B3A54654A12B1FDE34662302"><enum>(i)</enum><text>any identifying
				information of the person who is the subject of the report, including—</text>
								<subclause id="H6E4B001FCDC8477BA071198E3D876BD9"><enum>(I)</enum><text>a user
				identification or other online identifier;</text>
								</subclause><subclause id="HC80D5EF3D9064A54B7716E1275ED7BC7"><enum>(II)</enum><text>an electronic
				mail address;</text>
								</subclause><subclause id="H4F4118F69F3141718CD765FFE053B631"><enum>(III)</enum><text>a website
				address; or</text>
								</subclause><subclause id="H8157C81601EF4FF294FD80BCBF88D034"><enum>(IV)</enum><text>a uniform
				resource locator;</text>
								</subclause></clause><clause id="H55AE59D8B0634E0FAE37A8E05083E9DC"><enum>(ii)</enum><text display-inline="yes-display-inline">information pertaining to the geographic
				location of the person, website, or URL involved in the alleged incident, which
				may include—</text>
								<subclause id="H389CA77E6A04476B8C28008E9FA39D00"><enum>(I)</enum><text>street
				address;</text>
								</subclause><subclause id="HECD2400DC83E4AF6AF0000FD795B681E"><enum>(II)</enum><text>telephone
				number;</text>
								</subclause><subclause id="H6EDFF9D8F9384ADE8DC393442D489098"><enum>(III)</enum><text>area
				code;</text>
								</subclause><subclause id="H019E826F4A4E4E2FB573D42C42B0D942"><enum>(IV)</enum><text>ZIP code;
				or</text>
								</subclause><subclause id="HC428128AE45F41DF977688CADBEBDE1"><enum>(V)</enum><text>Internet Protocol
				address;</text>
								</subclause></clause><clause id="H059285837CBE443CAD6EEFCC5DB744EF"><enum>(iii)</enum><text>any image of
				apparent child pornography that is the subject of the report;</text>
							</clause><clause id="H69A742ECEE914F3B91007FA3D57282BD"><enum>(iv)</enum><text display-inline="yes-display-inline">the dates and times of the incident of
				apparent child pornography, which may include when images were uploaded,
				transmitted, reported, or discovered; and</text>
							</clause><clause id="H637C57EE373946E6B3F7594E21B6CD6C"><enum>(v)</enum><text display-inline="yes-display-inline">if not registered with the National Center
				for Missing and Exploited Children, accurate contact information for such
				provider, including address, telephone number, facsimile number, electronic
				mail address, and an individual point of contact for such provider.</text>
							</clause></subparagraph><subparagraph commented="no" id="HBE40186972BF47BDA9C2C49F2118CF7F"><enum>(B)</enum><text display-inline="yes-display-inline">A provider of electronic communication
				services or remote computing services who makes a report under paragraph (1)
				and provides information in good faith compliance shall not be considered in
				violation of this
				section.</text>
						</subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph commented="no" id="HD1A22249713040A4974BEF47EEBB68C2"><enum>(3)</enum><text display-inline="yes-display-inline">by amending paragraph (4) (as so
			 redesignated by
			 <internal-xref idref="HB85B4BAA0367450DA47D64262EF6B035" legis-path="2.(1)">paragraph (1)</internal-xref> of this subsection) to read as
			 follows:</text>
				<quoted-block display-inline="no-display-inline" id="H88515C3D162A4A64AE0040ADC4CAD151" style="OLC">
					<paragraph commented="no" id="H67859BBA59724398A65C4D41B3DD9B59"><enum>(4)</enum><header>State, local,
				and international referrals</header><text display-inline="yes-display-inline">In addition to forwarding such reports to
				those agencies designated in paragraph (2), the National Center for Missing and
				Exploited Children is authorized to forward any such report to an appropriate
				official of a State or subdivision of a State for the purpose of enforcing
				State criminal law, or to an appropriate official of a foreign law enforcement
				agency that—</text>
						<subparagraph commented="no" id="HC4E3E453B60A4094BB511C8599C0F1DB"><enum>(A)</enum><text>is willing to
				reciprocally refer such reports to law enforcement authorities in the United
				States;</text>
						</subparagraph><subparagraph commented="no" id="H01441CED7BB94655818F5888B2805424"><enum>(B)</enum><text>is a signatory to
				the Council of Europe Convention on Cybercrime or a Mutual Legal Assistance
				Treaty with the United States;</text>
						</subparagraph><subparagraph commented="no" id="H065DD9B415164698AB4C6ED400F17525"><enum>(C)</enum><text>has set forth a
				legal basis to use the materials for purposes of investigating, or engaging in
				enforcement proceedings related to, possible violations of foreign laws related
				to child pornography and child exploitation similar to practices prohibited by
				sections 2251, 2251A, 2252, 2252A, 2252B, or 2260 of title 18, United States
				Code, involving child pornography (as defined in section 2256 of that title),
				or 1466A of that title;</text>
						</subparagraph><subparagraph commented="no" id="HA39BC8E6785348B9AA03C750399CD6DE"><enum>(D)</enum><text>has set forth a
				bona fide legal basis for the foreign law enforcement agency’s authority to
				maintain the material in confidence; and</text>
						</subparagraph><subparagraph commented="no" id="HFAD3A26586434DCDB21968BF4E894350"><enum>(E)</enum><text>is not from a
				foreign state that the Secretary of State has determined, in accordance with
				section 6(i) of the Export Administration Act of 1979 (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/50/2405">50 U.S.C. App. 2405(i)</external-xref>),
				has repeatedly provided support for acts of international terrorism, unless and
				until such determination is rescinded pursuant to section 6(i)(4) of that Act
				(<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/50/2405">50 U.S.C. App. 2405(i)(4)</external-xref>).</text>
						</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H25D56012ACFF4CE5831E009C6606BA35"><enum>(4)</enum><text>by adding at the
			 end the following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="H291DA4BF64DA4431BFB6BE45A43C1698" style="OLC">
					<paragraph commented="no" id="HBE67D089B8C54083B498EDD21525691"><enum>(6)</enum><header>Duty to preserve
				evidence</header><text display-inline="yes-display-inline">The Attorney General
				shall designate necessary staff members, as specified by the Attorney General,
				who are assigned to work full-time at the National Center for Missing and
				Exploited Children on reports of child pornography to have responsibility for
				issuing preservation requests under <external-xref legal-doc="usc" parsable-cite="usc/18/2703">section 2703(f)</external-xref> of title 18, United States
				Code, to a provider of electronic communication services or remote computing
				services to preserve any records or other information related to the facts or
				circumstances used by such provider to make a report under paragraph (1) which
				has been referred for investigation to an Internet Crimes Against Children Task
				Force in the jurisdiction of such law enfocement agency. Such preservation
				request may be issued related to—</text>
						<subparagraph commented="no" id="H1C03562E704D4E1488DA03829FC3DF67"><enum>(A)</enum><text display-inline="yes-display-inline">a report to the Cyber Tip Line made by a
				provider of electronic communication services or remote computing services
				pursuant to paragraph (1); or</text>
						</subparagraph><subparagraph commented="no" id="HD30A69D089F84027AD878B48F1943012"><enum>(B)</enum><text display-inline="yes-display-inline">a report to the Cyber Tip Line made by a
				member of the public or a provider of electronic communication services or
				remote computing services, if the circumstances are such that the provider of
				electronic communication services or remote computing services reasonably
				believes that an emergency involving the immediate danger or serious physical
				injury to any child justifies
				preservation.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H63B65367BA1D40349833C5C489AB23E"><enum>3.</enum><header>Enhanced immunity
			 to encourage reporting by providers</header><text display-inline="no-display-inline">Section 227(c) of the Victims of Child Abuse
			 Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/13032">42 U.S.C. 13032(c)</external-xref>) is amended to read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="HF1DB3BBDABB449ED985EE8D6A6AABC55" style="OLC">
				<subsection id="HBAE8A770C34D49A2B8711D45EE36E61F"><enum>(c)</enum><header>Limited
				liability</header><text display-inline="yes-display-inline">No civil claim or
				criminal charge may be brought in Federal or State court against any provider
				of electronic communication services or remote computer services on account of
				any action taken in good faith by such provider to comply with or pursuant to
				this
				section.</text>
				</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H6D18B6FE62CF4B85AA4BABCDB9CA3600"><enum>4.</enum><header>Use of
			 information by the NCMEC</header><text display-inline="no-display-inline">Section 227(f) of the Victims of Child Abuse
			 Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/13032">42 U.S.C. 13032(f)</external-xref>) is amended—</text>
			<paragraph id="H38A1DDB595DA4B1984B100537608B7B2"><enum>(1)</enum><text>by redesignating
			 paragraph (2) as paragraph (3); and</text>
			</paragraph><paragraph id="HD7F543CB503844EEACB7AF29EFDE98D5"><enum>(2)</enum><text>by inserting after
			 paragaph (1) the following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="HDBE8BC94C1BA4B42A4CCE8F43CD1114" style="OLC">
					<paragraph commented="no" id="H5B5B35238D9F41CB8DE0FF09B736EDC0"><enum>(2)</enum><header>Use of
				information to combat child pornography</header><text display-inline="yes-display-inline">The National Center for Missing and
				Exploited Children is authorized to provide elements relating to any image,
				including the image itself, or other relevant information reported to its Cyber
				Tipline in accordance with this section, to any provider of electronic
				communication services or remote computing services for the purposes described
				in subparagraphs (A) and (B), if such provider provides an assurance that such
				elements shall be used by the provider only for the following purposes:</text>
						<subparagraph id="H4916CC0F917A4830AC58226D4019E8A8"><enum>(A)</enum><text>To permit such
				provider to stop the further transmission of child pornography images.</text>
						</subparagraph><subparagraph id="H77741A66EB3246179B2E8E303D8406DE"><enum>(B)</enum><text>To develop
				technologies to prevent and detect child pornography.</text>
						</subparagraph><subparagraph id="HA1FA457B799A4FCC926900BD602C9762"><enum>(C)</enum><text display-inline="yes-display-inline">To develop industry best practices related
				to the prevention and detection of child
				pornography.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section commented="no" id="HEE9165CD04B241DBA1EFA412ECE79EFA"><enum>5.</enum><header>Additional
			 provisions</header><text display-inline="no-display-inline">Section 227 of the
			 Victims of Child Abuse Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/13032">42 U.S.C. 13032(c)</external-xref>) is further amended by
			 adding at the end the following new subsections:</text>
			<quoted-block display-inline="no-display-inline" id="H1195FE9AC1CF42A79F5EFD8A2B5A591" style="OLC">
				<subsection commented="no" id="HDD8A5BD3A476466DBBDA34EC67664300"><enum>(h)</enum><header>State
				preemption</header><text display-inline="yes-display-inline">Any law,
				regulation, provision, or action of any State that requires any person to
				notify another person, governmental agency, or other entity regarding images of
				child pornography or of child sexual exploitation displayed or transmitted on
				the Internet, or under which liability is imposed on any person for failure to
				notify another person, a governmental agency, or other entity regarding such
				images shall be preempted.</text>
				</subsection><subsection commented="no" id="HD808C9801323408A9600823579550087"><enum>(i)</enum><header>Reports to
				Congress</header>
					<paragraph commented="no" id="H64912B5A131A4DEA854BBD8796F037C5"><enum>(1)</enum><header>Annual report by
				the Attorney General</header><text>The Attorney General of the United States
				shall submit to Congress, and make publicly available on the website of the
				Department of Justice, an annual report containing—</text>
						<subparagraph commented="no" id="HDB740D53FEB34B26AE85231147A426AF"><enum>(A)</enum><text>the number
				of—</text>
							<clause commented="no" id="H025BA8F2F0254BACAAF7F14057FC896E"><enum>(i)</enum><text>investigations by
				Federal, State, and local law enforcement agencies of crimes of sexual
				exploitation against children that are initiated by a report made to the
				National Center for Missing and Exploited Children under subsection
				(b)(1);</text>
							</clause><clause commented="no" id="H630384A64D864254A7A2ED527763304E"><enum>(ii)</enum><text display-inline="yes-display-inline">prosecutions resulting from investigations
				by Federal, State, and local law enforcement agencies of crimes of sexual
				exploitation against children initiated by such a report;</text>
							</clause><clause commented="no" id="H89D6322600464780A427654FED58CDE7"><enum>(iii)</enum><text display-inline="yes-display-inline">convictions resulting from prosecutions by
				Federal, State, and local authorities of crimes of sexual exploitation against
				children initiated by such a report; and</text>
							</clause><clause commented="no" id="H38670303933B4840B41F3189941BDC33"><enum>(iv)</enum><text>convictions of
				repeat offenders initiated by such a report;</text>
							</clause></subparagraph><subparagraph commented="no" id="H7D02100DB584417CB0F49DD5FE180027"><enum>(B)</enum><text display-inline="yes-display-inline">descriptions of sentences given to persons
				convicted as a result of investigations initiated by such a report;</text>
						</subparagraph><subparagraph commented="no" id="HD46B3AEA99364CF88D37B9A800894D3F"><enum>(C)</enum><text display-inline="yes-display-inline">the length of time between initiation and
				completion of investigations, prosecutions, and convictions initiated by such a
				report;</text>
						</subparagraph><subparagraph commented="no" id="HFCEF7A48994F4DC6A500DDCC3FC622FC"><enum>(D)</enum><text display-inline="yes-display-inline">the results of investigation initiated by
				such a report, including whether a closed investigation was reopened, the
				reasons an investigation was reopened (if applicable), and the ultimate result
				of the investigation.</text>
						</subparagraph></paragraph><paragraph commented="no" id="HDBFC1CF416364498A4DCF592A9E344D"><enum>(2)</enum><header>Annual
				verification report by the Inspector General</header><text>The Inspector
				General of the Department of Justice shall submit to Congress, and make
				publicly available on the website of the Department of Justice, an independent
				verification of the report submitted by the Attorney General in accordance with
				<internal-xref idref="H64912B5A131A4DEA854BBD8796F037C5" legis-path="(i)(1)">paragraph
				(1)</internal-xref>.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" id="H02FCCA304FDD45039915D77237917439"><enum>6.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">This Act, and the
			 amendments made by this Act, shall take effect 180 days after the date of the
			 enactment of this Act.</text>
