		<section id="HEE2A945B5F6B42640052AA438B110044" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>New Employment for Workers &amp; Job
			 Opportunities for Business Strength Act of 2007</short-title></quote> or the
			 <quote><short-title>NEW JOBS Act of
			 2007</short-title></quote>.</text>
		</section><section id="HC997144E5F354B519F9D2EF94BC45CBA" section-type="subsequent-section"><enum>2.</enum><header>Special allocation
			 under new markets tax credit in connection with trade adjustment
			 assistance</header>
			<subsection id="H0B58D39DC8AE490BACC50145343F0DB"><enum>(a)</enum><header>In
			 general</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/45D">Section 45D</external-xref> of the Internal Revenue Code of 1986 is
			 amended by redesignating subsection (i) as subsection (j) and by inserting
			 after subsection (h) the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="HCA38F8C4202545B7B76BA08CC000F786" style="OLC">
					<subsection id="H5D8053CAA09143ABAC4844CD0726CBB4"><enum>(i)</enum><header>Special
				allocations in connection with trade adjustment assistance</header>
						<paragraph id="H9DC32971F2A34EDB9E122ECBE404D780"><enum>(1)</enum><header>Allocations</header><text>The
				new markets tax credit limitation otherwise determined under subsection (f)(1)
				shall be increased by an amount equal to $500,000,000 for 2008 to be allocated
				among qualified community development entities to make capital or equity
				investments in, or loans to, qualified TAA businesses.</text>
						</paragraph><paragraph id="HE482D465F03A4E168054C0F049DD8624"><enum>(2)</enum><header>Restriction on
				designation</header><text>A qualified community development entity receiving an
				allocation under paragraph (1) may not use such allocation to designate any
				qualified equity investment under subsection (b)(1)(C) unless substantially all
				of such investment is used for the purpose described in paragraph (1).</text>
						</paragraph><paragraph id="H2D7B7E4D90EE4A0EAB80FFC22BD4DA22"><enum>(3)</enum><header>Qualified TAA
				businesses</header><text>For purposes of this subsection—</text>
							<subparagraph id="H811F850DC53A403EB00079689B8BC11E"><enum>(A)</enum><header>In
				general</header><text>The term <term>qualified TAA business</term> means, with
				respect to any taxable year—</text>
								<clause id="H4B475743604C4FDEA0E3CE3E71B5FD8B"><enum>(i)</enum><text>any qualified
				active low-income community business (as defined in subsection (d)(2)) which
				meets the requirements of clause (i) or (ii) of subparagraph (B) for such
				taxable year, and</text>
								</clause><clause id="HE000A0D528F5495097C14FB895F8D68D"><enum>(ii)</enum><text>any specified TAA
				business.</text>
								</clause></subparagraph><subparagraph id="H98BE603216C4484587F2BA3D52C13F52"><enum>(B)</enum><header>Specified TAA
				business</header><text>The term <term>specified TAA business</term> means, with
				respect to any taxable year, any corporation (including a nonprofit
				corporation) or partnership if—</text>
								<clause id="H1CBF227A4F334991BC2C131B579EEDDE"><enum>(i)</enum><text display-inline="yes-display-inline">not less than 40 percent of the individuals
				hired by such entity during such taxable year were eligible TAA recipients (as
				defined in section 35(c)(2)) or eligible alternative TAA recipients (as defined
				in section 35(c)(3)) with respect to any month beginning during the 1-year
				period ending on the hiring date (as defined in section 51(d)) of such
				individual,</text>
								</clause><clause id="HE17B34ABB7CF49709D581D5F21E0E7B6"><enum>(ii)</enum><text display-inline="yes-display-inline">such entity is certified by the Secretary
				of Commerce as eligible to apply for adjustment assistance under chapter 3 of
				title II of the Trade Act of 1974 with respect to any portion of the taxable
				year in which the investment or loan referred to in paragraph (1) is made,
				and</text>
								</clause><clause id="HCB7CA5764777485192A274A7A545E7B7"><enum>(iii)</enum><text>the Secretary
				determines that such entity will utilize the assistance provided pursuant to
				this section in a manner consistent with the purposes of subsection
				(d)(2)(A).</text>
								</clause><continuation-text continuation-text-level="subparagraph">The
				requirement of clause (i) shall be treated as satisfied for any taxable year if
				such clause would be satisfied if all individuals hired by such entity during
				such taxable year and all preceding taxable years which are not before the
				taxable year in which the investment or loan referred to in paragraph (1) was
				made were taken into account.</continuation-text></subparagraph></paragraph><paragraph id="H043A583F3AF6438FABF4E006ECDB8EC"><enum>(4)</enum><header>Reallocations</header><text>Subsection
				(f)(3) shall be applied separately with respect to the amount of the increase
				under paragraph
				(1).</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H44EA538E9ADD4108A015E4F97BD637F9"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to
			 allocations made after December 31, 2007.</text>
