<official-title display="yes">To amend title 38, United States Code, to require the Secretary of Veterans Affairs to reimburse veterans receiving emergency treatment in non-Department of Veterans Affairs facilities for such treatment until such veterans are transferred to Department facilities, and for other purposes.</official-title>

<section id="HC93250BBD48948DD004F3800B89DE5EA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veterans Emergency Care Fairness Act of 2008</short-title></quote>.</text> </section>
<section id="HDEDB87BB35494455987150FF19D1EA97" section-type="subsequent-section"><enum>2.</enum><header>Mandatory reimbursement of veterans receiving emergency treatment in non-Department of Veterans Affairs facilities until transfer to Department facilities</header> 
<subsection id="HEAF55C63646B4F31B2B347EDD29D853F"><enum>(a)</enum><header>Certain veterans without service-connected disability</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/38/1725">Section 1725</external-xref> of title 38, United States Code, is amended—</text> 
<paragraph id="H987EBCBFFC8D4DDD8FAE7DA4D9753011"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(1), by striking <quote>may reimburse</quote> and inserting <quote>shall reimburse</quote>; and</text> </paragraph>
<paragraph id="H7434027760814944B1F151EDE7AF7C78"><enum>(2)</enum><text>in subsection (f)(1), by striking subparagraph (C) and inserting the following new subparagraph (C):</text> 
<quoted-block display-inline="no-display-inline" id="H846FE9C2A30F43EDB521CC8353008037" style="OLC"> 
<subparagraph id="H63EFD98AD68F499181221C56287F7BC1"><enum>(C)</enum><text>until—</text> 
<clause id="H2F92471217964AB0962C2983CE99598C"><enum>(i)</enum><text>such time as the veteran can be transferred safely to a Department facility or other Federal facility; or</text> </clause>
<clause id="H27F457CA18604346BAF8F6AA7D61CF6"><enum>(ii)</enum><text>such time as a Department facility or other Federal facility agrees to accept such transfer if—</text> 
<subclause id="H5A9C435FC4824439B3003E4960A13010"><enum>(I)</enum><text>at the time described in clause (i), no Department facility or other Federal facility agrees to accept such transfer; and</text> </subclause>
<subclause id="H6F39FA0513DA4BC0AE49B4E069CEF49C"><enum>(II)</enum><text>the non-Department facility in which such medical care or services is furnished makes and documents reasonable attempts to transfer the veteran to a Department facility or other Federal facility.</text> </subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection>
<subsection id="H11668BAB1B00477E8DB88CE56E00859D"><enum>(b)</enum><header>Certain veterans with service-connected disability</header><text>Section 1728 of such title is amended—</text> 
<paragraph id="H2FB36F1213034E01B57665572CB9251"><enum>(1)</enum><text>by striking subsection (a) and inserting the following new subsection (a):</text> 
<quoted-block display-inline="no-display-inline" id="HCFA2BF54743D4B8AB7E181F674151B31" style="OLC"> 
<subsection id="H63B8D95E48214E09ADF37100BF04E268"><enum>(a)</enum><text>The Secretary, under such regulations as the Secretary shall prescribe, shall reimburse veterans entitled to hospital care or medical services under this chapter for the reasonable value of emergency treatment (including travel and incidental expenses under the terms and conditions set forth in section 111 of this title) for which such veterans have made payment, from sources other than the Department, where such emergency treatment was rendered to such veterans in need thereof for any of the following:</text> 
<paragraph id="HD5F3FB0E46184C84A5E99B5F500C0FB"><enum>(1)</enum><text>An adjudicated service-connected disability.</text> </paragraph>
<paragraph id="H17744A412AFA4B2C8EEB8BCB483896EB"><enum>(2)</enum><text>A non-service-connected disability associated with and held to be aggravating a service-connected disability.</text> </paragraph>
<paragraph id="HD0C6CBA4994D44EF9938FFD5CB35AC7D"><enum>(3)</enum><text>Any disability of a veteran in the veteran has a total disability permanent in nature from a service-connected disability.</text> </paragraph>
<paragraph id="HDC8F6AC23179445A8CC799AA61C5BF95"><enum>(4)</enum><text>Any illness, injury, or dental condition of a veteran who—</text> 
<subparagraph id="H9BB7CD676DF04C5D812167D8687DFAFD"><enum>(A)</enum><text>is a participant in a vocational rehabilitation program (as defined in section 3101(9) of this title); and</text> </subparagraph>
<subparagraph id="H358F2A8CA0E44056B3D4E7221640B21B"><enum>(B)</enum><text>is medically determined to have been in need of care or treatment to make possible the veteran's entrance into a course of training, or prevent interruption of a course of training, or hasten the return to a course of training which was interrupted because of such illness, injury, or dental condition.</text> </subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block> </paragraph>
<paragraph id="H486D7F0C2FAD4D2E8869606C5C3EBC4"><enum>(2)</enum><text>in subsection (b), by striking <quote>care or services</quote> both places it appears and inserting <quote>emergency treatment</quote>; and</text> </paragraph>
<paragraph id="H30D563053CC742D6B0A9A748569651C7"><enum>(3)</enum><text>by adding at the end the following new subsection:</text>

<subsection id="H16E2C00A935B4EA3BAFA7258B799DA4C"><enum>(c)</enum><text>In this section, the term <term>emergency treatment</term> has the meaning given such term in section 1725(f)(1) of this title.</text> </subsection><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection></section>
