			 introduced the following bill; which was referred to the

			 Reform</committee-name>, and in addition to the Committee on
			 <committee-name committee-id="HHA00">House Administration</committee-name>, for
			 a period to be subsequently determined by the Speaker, in each case for
			 consideration of such provisions as fall within the jurisdiction of the
			 committee concerned</action-desc>

		<legis-type>A BILL</legis-type>
		<official-title>To provide that 8 of the 12 weeks of parental leave made
		  available to a Federal employee shall be paid leave, and for other
		  purposes.</official-title>

		<section id="HFA30FF1D487B496495A9274C93A15791" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Federal Employees Paid Parental Leave
			 Act of 2007</short-title></quote>.</text>
		</section><section id="HF669EEF8C95E4567A8E92353E933912D"><enum>2.</enum><header>Paid parental
			 leave under title 5</header>
			<subsection id="H9662042D60D44F209BC75F1D336FE3A2"><enum>(a)</enum><header>Amendment to
			 title 5</header><text display-inline="yes-display-inline">Subsection (d) of
			 <external-xref legal-doc="usc" parsable-cite="usc/5/6382">section 6382</external-xref> of title 5, United States Code, is amended to read as
			 follows:</text>
				<quoted-block id="H937CDD2B3FE64E6C0020AA94A472A7AA" style="OLC">
					<subsection id="H2B03E11D77254E009273CD78DFFDAA7C"><enum>(d)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H2A290E7BBF8046D6ABABC96D00422690"><enum>(1)</enum><text>An employee may elect to
				substitute for any leave without pay under subparagraph (A) or (B) of
				subsection (a)(1) any paid leave which is available to such employee for that
				purpose.</text>
						</paragraph><paragraph id="H42AA3C4125E24728A6DFAB220000585C" indent="up1"><enum>(2)</enum><text>The paid leave that is available to
				an employee for purposes of paragraph (1) is—</text>
							<subparagraph id="H7B7425CCA4784013945BB54FD57200A3"><enum>(A)</enum><text>8 administrative workweeks of paid
				leave under this subparagraph in connection with the birth or placement
				involved; and</text>
							</subparagraph><subparagraph id="HC1FE60B596C243308E14838573DA3406"><enum>(B)</enum><text>any annual or sick leave accrued or
				accumulated by such employee under subchapter I.</text>
							</subparagraph></paragraph><paragraph id="H727496426FC54236AD04594FB3D3AB08" indent="up1"><enum>(3)</enum><text>Nothing in this subchapter shall be
				considered to require—</text>
							<subparagraph id="HFBFE3A768E4347850059A7874CA6FE02"><enum>(A)</enum><text>that an employing agency provide paid
				sick leave in any situation in which such employing agency would not normally
				be required to provide such leave; or</text>
							</subparagraph><subparagraph id="H3AAA4296AC1D4B57829CDB054D19AD"><enum>(B)</enum><text>that an employee first use all or any
				portion of the leave described in subparagraph (B) of paragraph (2) before
				being allowed to use leave described in subparagraph (A) of such
				subparagraph.</text>
							</subparagraph></paragraph><paragraph id="H95D497146D07411CAD85DDEB00D7784C" indent="up1"><enum>(4)</enum><text>Leave under paragraph (2)(A)—</text>
							<subparagraph id="H540C7403622B42C5A4998684DA8CBC73"><enum>(A)</enum><text>shall be payable from any
				appropriation or fund available for salaries or expenses for positions within
				the employing agency;</text>
							</subparagraph><subparagraph id="H033B9376891E4ACBBCCA7B12183E159"><enum>(B)</enum><text>shall not be considered to be annual
				or vacation leave for purposes of section 5551 or 5552 or for any other
				purpose; and</text>
							</subparagraph><subparagraph id="HD2767B31940F470A93699EC7C21977E8"><enum>(C)</enum><text>if not used by the employee before the
				end of the 12-month period (as referred to in subsection (a)(1)) to which it
				relates, shall not accumulate for any subsequent use.</text>
							</subparagraph></paragraph><paragraph id="H51E4FDC04C3B4B2284331313582F28B6" indent="up1"><enum>(5)</enum><text>The Office shall prescribe any
				regulations necessary to carry out this subsection, including, subject to
				paragraph (3)(B), the manner in which an employee may designate any day or
				other period as to which such employee wishes to use leave described in
				paragraph
				(2)(A).</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H9B406BB5285B43B3B466AA97A9AC6BA0"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made by this section shall not be effective
			 with respect to any birth or placement occurring before the end of the 6-month
			 period beginning on the date of the enactment of this Act.</text>
			</subsection></section><section id="HD34D15BEFF674F909527D4D3DB33AC3"><enum>3.</enum><header>Paid parental
			 leave for Congressional employees</header>
			<subsection id="H3285D3D317E94C0BA47703B92E4E7700"><enum>(a)</enum><header>Amendment to
			 Congressional Accountability Act</header><text>Section 202 of the Congressional
			 Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1312">2 U.S.C. 1312</external-xref>) is amended—</text>
				<paragraph id="H306B5950028E4F669FC4186B156F005F"><enum>(1)</enum><text>in subsection
			 (a)(1), by adding at the end the following: <quote>In applying section
			 102(a)(1)(A) and (B) to covered employees, subsection (d) shall
			 apply.</quote>;</text>
				</paragraph><paragraph id="H2573FE56B2014395AB241DC5F74404C2"><enum>(2)</enum><text>by redesignating
			 subsections (d) and (e) as subsections (e) and (f), respectively; and</text>
				</paragraph><paragraph id="HD317F5D4716F43F8A9AFA8DAF150D1B0"><enum>(3)</enum><text>by inserting after
			 subsection (c) the following:</text>
					<quoted-block display-inline="no-display-inline" id="H4A25BFC76F5A452A97D6C614A4206000" style="OLC">
						<subsection id="HB49955F2E7874A4E9E4E13CBC3E613EE"><enum>(d)</enum><header>Special rule for
				paid parental leave for Congressional employees</header>
							<paragraph display-inline="no-display-inline" id="H8F2337365AE74E92A927A796F81E9307"><enum>(1)</enum><header>Substitution of
				paid leave</header><text>A covered employee taking leave without pay under
				subparagraphs (A) or (B) of section 102(a)(1) of the Family and Medical Leave
				Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(a)(1)</external-xref>) may elect to substitute for any such leave
				any paid leave which is available to such employee for that purpose.</text>
							</paragraph><paragraph id="HF31FB3665E364C9491E5A82DDA41976"><enum>(2)</enum><header>Amount of paid
				leave</header><text>The paid leave that is available to a covered employee for
				purposes of paragraph (1) is—</text>
								<subparagraph id="H57FEAEC56FA9484FA1EDDE387D58A77F"><enum>(A)</enum><text>8 workweeks of
				paid leave under this subparagraph in connection with the birth or placement
				involved; and</text>
								</subparagraph><subparagraph id="HF1A54DC9E14E4498BC87CD9E1C3723A1"><enum>(B)</enum><text>any additional
				paid vacation or sick leave provided by the employing office to such
				employee.</text>
								</subparagraph></paragraph><paragraph id="H6202F2D3B7684AD2B49EFDC8680821AC"><enum>(3)</enum><header>Limitation</header><text>Nothing
				in this section shall be considered to require—</text>
								<subparagraph id="H8C7F0EE2BD5A4413A7DD53AD79433FF"><enum>(A)</enum><text>that an employing
				office provide paid sick leave in any situation in which such employing office
				would not normally be required to provide such leave; or</text>
								</subparagraph><subparagraph id="HCC6EDE662FD44A78B9DB3D6B7677BFF8"><enum>(B)</enum><text>that a covered
				employee first use all or any portion of the leave described in subparagraph
				(B) of paragraph (2) before being allowed to use leave described in
				subparagraph (A) of such paragraph.</text>
								</subparagraph></paragraph><paragraph id="H9C0B631E6C2242BCA0C768600875B10"><enum>(4)</enum><header>Additional
				rules</header><text>Leave under paragraph (2)(A)—</text>
								<subparagraph id="H0B9A32F69A724A4285AB88ED4E9BD8B1"><enum>(A)</enum><text>shall be payable
				from any appropriation or fund available for salaries or expenses for positions
				within the employing office; and</text>
								</subparagraph><subparagraph id="H494B154A71184A3DB18C44F9A779682E"><enum>(B)</enum><text display-inline="yes-display-inline">if not used by the covered employee before
				the end of the 12-month period (as referred to in section 102(a)(1) of the
				Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(a)(1)</external-xref>)) to which it
				relates, shall not accumulate for any subsequent
				use.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H775F1DC1F7E94E1FBC218B9D2392CE20"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made by this section shall not be effective
			 with respect to any birth or placement occurring before the end of the 6-month
			 period beginning on the date of the enactment of this Act.</text>
