		<official-title>To amend the Servicemembers Civil Relief Act to allow
		  individuals called to military service to terminate telecommunications
		  contracts entered into before the individual receives notice of a permanent
		  change of station or deployment orders.</official-title>

		<section id="H3AFBC0E6B7C843C594D6DA52D678D8A3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Servicemembers Telecom Contract Relief
			 Act</short-title></quote>.</text>
		</section><section id="HA3FB2026FB0C4ED7AD994B665EEDB7E"><enum>2.</enum><header>Termination by
			 servicemembers of telecommunications contracts entered into before permanent
			 change of station of deployment orders</header>
			<subsection id="H30FD77E1E24C48B6BF37C1B3D5C3997"><enum>(a)</enum><header>Termination</header><text>Title
			 III of the Servicemembers Civil Relief Act (50 U.S.C. App. 531 et seq.) is
			 amended by adding at the end the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="H1B422860AAD0410E8FF1D14793929500" style="OLC">
					<section id="HE8DD7E4B90C942B69EB841213879F536"><enum>309.</enum><header>Termination of
				telecommunications contracts</header>
						<subsection id="H7C381C60BA5C4B568DFCCC67E788004F"><enum>(a)</enum><header>Termination by
				servicemember</header><text>A person in military service who is party to a
				contract described in subsection (b) may, at the person’s option, terminate the
				contract at any time after—</text>
							<paragraph id="HC1A2B5C082A94FA9A5C1F07C8747EDEA"><enum>(1)</enum><text>the date of the
				entry of the person into military service; or</text>
							</paragraph><paragraph id="H9192A9A4FB7A4928903F79C0A64DD36E"><enum>(2)</enum><text>the date of the
				military orders of the person described in subsection (b)(2), as the case may
				be.</text>
							</paragraph></subsection><subsection id="H5F3E5C7CE46D4537B5330633DE27C53B"><enum>(b)</enum><header>Covered
				contracts</header><text>This section applies to a telecommunications contract
				for cellular phone service, cable or satellite television service, or internet
				service if—</text>
							<paragraph id="H9FF61533B8CB4E74944486E3889BB5AB"><enum>(1)</enum><text display-inline="yes-display-inline">the contract is executed by or on behalf of
				a person who thereafter and during the term of the contract enters military
				service (or receives order to enter military service) under a call or order
				specifying a period of not less than 90 days (or who enters military service
				under a call or order specifying a period of 90 days or less and who, without a
				break in service, receives orders extending the period of military service to a
				period of not less than 90 days); or</text>
							</paragraph><paragraph id="H36DB8731229F4C91B1F513EE74AD6E2D"><enum>(2)</enum><text display-inline="yes-display-inline">the person enters into the contract while
				in military service and thereafter receives military orders for a permanent
				change of station outside of the continental United States, or to deploy with a
				military unit for a period of not less than 90 days, to a location that does
				not support continuation of the service under the contract.</text>
							</paragraph></subsection><subsection id="HF506F3E57C844DA0AE7749CDA8FDF069"><enum>(c)</enum><header>Manner of
				termination</header>
							<paragraph id="H726696B3743047C98B7C9E5BA9DD57A2"><enum>(1)</enum><header>In
				general</header><text>Termination of a contract under subsection (a) is made by
				delivery by the person in military service of written notice of such
				termination, and a copy of the servicemember’s military orders, to the other
				party to the contract (or to that person’s grantee or agent).</text>
							</paragraph><paragraph id="H1EFDCCC299364905BEC778FC84D84841"><enum>(2)</enum><header>Nature of
				notice</header><text>Delivery of notice under paragraph (1) may be
				accomplished—</text>
								<subparagraph id="P6FAB3E3B46E1E165F50D0EA28DB59A2"><enum>(A)</enum><text>by hand
				delivery;</text>
								</subparagraph><subparagraph id="P16EDEB18400FAD97E8FDFA8B189B01D"><enum>(B)</enum><text>by private business
				carrier; or</text>
								</subparagraph><subparagraph id="P2902445B47CB34F9CCD6C4B8FD16E00"><enum>(C)</enum><text>by placing the
				written notice in an envelope with sufficient postage and with return receipt
				requested, and addressed as designated by the party to be notified (or that
				party’s grantee or agent), and depositing the written notice in the United
				States mails.</text>
								</subparagraph></paragraph></subsection><subsection id="H23486036D1A64863AB3CF9F53241C32C"><enum>(d)</enum><header>Date of contract
				termination</header><text>Termination of a contract under subsection (a) is
				effective on the day on which the notice is delivered in accordance with
				subsection (c).</text>
						</subsection><subsection id="HBF185D298A6A491390F3FA10C0FDD26B"><enum>(e)</enum><header>Arrearages and
				other obligations and liabilities</header><text>Contract amounts unpaid for the
				period preceding the effective date of the contract termination shall be paid
				on a prorated basis.</text>
						</subsection><subsection id="H4B096DE367A94C3D977D48152798CFF6"><enum>(f)</enum><header>Relief to other
				party</header><text>Upon application by the other party to the contract to a
				court before the termination date provided in the written notice, relief
				granted by this section to a person in military service may be modified as
				justice and equity require.</text>
						</subsection><subsection id="H101D55FCE41247B7B63C4B53DEB6E939"><enum>(g)</enum><header>Penalties</header>
							<paragraph id="H9A5795ADA7BD4A1E81AED30CE556200"><enum>(1)</enum><header>Misdemeanor</header><text display-inline="yes-display-inline">Any person who knowingly seizes, holds, or
				detains the personal effects, security deposit, or other property of a person
				in military service (or of a dependent of a person in military service) who
				lawfully terminates a contract covered by this section, or who knowingly
				interferes with the removal of such property from premises covered by such
				contract, for the purpose of subjecting or attempting to subject any of such
				property to a claim for contract payments accruing subsequent to the date of
				termination of such lease, or attempts to do so, shall be fined as provided in
				title 18, United States Code, or imprisoned for not more than one year, or
				both.</text>
							</paragraph><paragraph id="H0C274E794A574CF5A486C2F028A2A0D5"><enum>(2)</enum><header>Preservation</header><text>The
				remedy and rights provided under this section are in addition to and do not
				preclude any remedy for wrongful conversion otherwise available under law to
				the person claiming relief under this section, including any award for
				consequential or punitive
				damages.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HEC8A0DC32BE543B8B03CA2BFDFF7E8AA"><enum>(b)</enum><header>Clerical
			 amendment</header><text display-inline="yes-display-inline">The table of
			 contents in section 1(b) of such Act is amended by inserting after the item
			 relating to section 308 the following new item:</text>
