<official-title>To amend the Clean Air Act to promote and assure the quality of biodiesel fuel, and for other purposes.</official-title>

<section id="H4A4919C58A674CFE91E4D4D8CE20D3E6" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Biodiesel Promotion and Quality Assurance Act of 2007</short-title></quote>.</text></section> 
<section id="H34467B15285E4B2FAF835603F3DE34E"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text> 
<paragraph id="H11E3870BCB4B4D2FBD5760EDB5913E1C"><enum>(1)</enum><text>the promotion of the biodiesel industry of the United States is a critical component of an energy policy that reduces dependence on foreign sources of petroleum;</text></paragraph> 
<paragraph id="H083BC6E41CC34344A63E26807103DA95"><enum>(2)</enum><text>a strong biodiesel industry will—</text> 
<subparagraph id="H7A131B26490949CA943D1FA4798314A4"><enum>(A)</enum><text>significantly enhance the energy security of the United States; and</text></subparagraph> 
<subparagraph id="H0541F02BA9A74CEF81DD70191B36974E"><enum>(B)</enum><text>promote economic development and job creation (particularly in rural areas of the United States), while providing environmental, health, and greenhouse gas reduction benefits;</text></subparagraph></paragraph> 
<paragraph id="HF2412FAE1928485C81C9579E00136369"><enum>(3)</enum><text>a federally-implemented biodiesel standard will result in the most efficient pricing for biodiesel across the United States;</text></paragraph> 
<paragraph id="H9B2A827636524A1AA92188E0CD8C30DB"><enum>(4)</enum><text>it is critical to ensure that only high quality biodiesel is dispensed;</text></paragraph> 
<paragraph id="H007EE701B4B340E0A43CF338643BC1BB"><enum>(5)</enum><text display-inline="yes-display-inline">biodiesel contributes to cleaner air and lifecycle reductions of greenhouse gases;</text></paragraph> 
<paragraph id="H1E74F99F5A394F89B41F4BD250C7005F"><enum>(6)</enum><text>biodiesel is an environmentally safe fuel, and is the most viable transportation fuel when measuring its carbon footprint, life cycle and energy balance;</text></paragraph> 
<paragraph id="HBD636315975748D7B719609EF69283B4"><enum>(7)</enum><text>the United States Department of Agriculture lifecycle study shows a 78.4 percent reduction in lifecycle CO2 for B100;</text></paragraph> 
<paragraph id="H2A315C23E0B44451B4D058F64329CD91"><enum>(8)</enum><text>1 billion gallons of biodiesel will reduce current life cycle greenhouse gas emissions by 16.12 billion pounds, the equivalent of removing 1.4 million passenger vehicles from America’s roads; and</text></paragraph> 
<paragraph id="H5AE62A72780F435B84002D6C74AC1F67"><enum>(9)</enum><text>in 2006 alone, biodiesel’s contribution to reducing greenhouse gas emissions was equal to removing 350,000 passenger vehicles from America’s roads.</text></paragraph></section> 
<section id="H4EDDBC495A9541EBA5DF1F5F6D4400A4"><enum>3.</enum><header>Biodiesel fuel standard</header><text display-inline="no-display-inline">Section 211 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545</external-xref>) is amended by inserting after subsection (o) the following:</text> 
<quoted-block display-inline="no-display-inline" id="HCD579767A1AC42548B9FF65FE4E45367" style="OLC"> 
<subsection id="H1581E0FBB03B4951BA05B68F20615456"><enum>(p)</enum><header>Biodiesel fuel</header> 
<paragraph id="HD3852691F0E049438F752E4CB020000"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text> 
<subparagraph id="H2AB6B0D2FB744D199791A5EB38DACCE"><enum>(A)</enum><header>ASTM</header><text>The term <term>ASTM</term> means the American Society of Testing and Materials.</text></subparagraph> 
<subparagraph id="HCB4BCC3C788744C4BC292400B93469CC"><enum>(B)</enum><header>Bio-based diesel replacement</header><text>The term <term>bio-based diesel replacement</term> means any type of bio-based renewable fuel derived from plant or animal matter that—</text> 
<clause id="HA2BC8AEEC661470F89922ECD09636710"><enum>(i)</enum><text>may be used as a substitute for standard diesel fuel; and</text></clause> 
<clause id="H58DF7E29460246A68078A7AFFF23ED08"><enum>(ii)</enum><text>meets—</text> 
<subclause id="HB4E1945C27644747970050CAF9F71DC3"><enum>(I)</enum><text>the registration requirements for fuels and fuel additives under this section; and</text></subclause> 
<subclause id="HA4F2540A637E4D1DB360507F7FC55B77"><enum>(II)</enum><text>the requirements of applicable ASTM standards.</text></subclause></clause></subparagraph> 
<subparagraph id="H289FC9ACBFB44CA28F8DB4125962EF5"><enum>(C)</enum><header>Biodiesel</header> 
<clause id="HD92BA01C3BE240F58C6EA5A3E9209E9D"><enum>(i)</enum><header>In general</header><text>The term <term>biodiesel</term> means the monoalkyl esters of long chain fatty acids derived from plant or animal matter that meet—</text> 
<subclause id="H5B3AF54B57724067AA0000365188F5A0"><enum>(I)</enum><text>the registration requirements for fuels and fuel additives under this section; and</text></subclause> 
<subclause id="HC01C9FD4827E49629077B5314275B251"><enum>(II)</enum><text>the requirements of ASTM standard D6751.</text></subclause></clause> 
<clause id="H936F153133404E9BBF386665F776F2D5"><enum>(ii)</enum><header>Inclusion</header><text>For the purpose of measuring the applicable volume of the biodiesel fuel standard under paragraph (2), the term <term>biodiesel</term> includes any bio-based diesel replacement that meets—</text> 
<subclause id="H47838509C7BE47E9AA04BDAB00A18936"><enum>(I)</enum><text>applicable registration requirements for fuels and fuel additives under this section; or</text></subclause> 
<subclause id="H76BFB40BF6514144BBF2009387136CC6"><enum>(II)</enum><text>applicable ASTM standards.</text></subclause></clause></subparagraph> 
<subparagraph id="H348C89101D424E6F9219E72DA8875ED6"><enum>(D)</enum><header>Biodiesel blend</header><text>The term <term>biodiesel blend</term> means a blend of biodiesel fuel that meets the requirements of ASTM standard D6751 with petroleum-based diesel fuel.</text></subparagraph></paragraph> 
<paragraph id="H812BB875CB1E4A5EA0003E8970306F92"><enum>(2)</enum><header>Biodiesel fuel standard</header> 
<subparagraph id="HCBEB6D4AB7B646A0941B458D3968DEC3"><enum>(A)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this subsection, the Administrator shall promulgate regulations to ensure that diesel fuel sold or introduced into commerce in the United States, on an annual average basis, contains the applicable volume of biodiesel determined in accordance with subparagraphs (B) and (C).</text></subparagraph> 
<subparagraph id="HF6107C3E63DA4ACA92C9AE568FC9594"><enum>(B)</enum><header>Calendar years 2008 through 2012</header><text>For the purpose of subparagraph (A), the applicable volume for any of calendar years 2008 through 2012 shall be determined in accordance with the following table:</text>

<subparagraph id="H1B0C9D4C985D42B6B92C00BEC6F4BD30"><enum>(C)</enum><header>Calendar year 2013 and thereafter</header><text>For the purpose of subparagraph (A), the applicable volume for calendar year 2013 and each calendar year thereafter shall be determined by the Administrator, in consultation with the Secretary of Energy and the Secretary of Agriculture, based on a review of the implementation of the program during calendar years 2008 through 2012, including a review of—</text> 
<clause id="H55C3F3E6C6144939A63225009803F4C2"><enum>(i)</enum><text>the impact of the use of renewable fuels on the environment, air quality, energy security, job creation, and rural economic development; and</text></clause> 
<clause id="HE6115027C2214C7DA974E390B9BBACFD"><enum>(ii)</enum><text>the expected annual rate of future production of biodiesel.</text></clause></subparagraph> 
<subparagraph id="H58102D3D67E14543B3DF29D5A4D2FE58"><enum>(D)</enum><header>Minimum percentage of biodiesel</header><text>For the purpose of subparagraph (B), at least 80 percent of the minimum applicable volume for each of calendar years 2008 through 2012 shall be biodiesel.</text></subparagraph> 
<subparagraph id="H545372417D834F92BE65EEA8F05BF800"><enum>(E)</enum><header>Compliance</header><text>The regulations promulgated under subparagraph (A) shall contain compliance provisions applicable to refineries, blenders, distributors, and importers, as appropriate, to ensure that the requirements of this paragraph are met, but shall not—</text> 
<clause id="H21F222EBF6DA40FBB3946BB59F4D5DEC"><enum>(i)</enum><text>restrict geographic areas in which biodiesel may be used; or</text></clause> 
<clause id="HDF2C517B3D0845FBA5E62395D2E40095"><enum>(ii)</enum><text>impose any per-gallon obligation for the use of biodiesel.</text></clause></subparagraph> 
<subparagraph id="HFCA9757FD22E4D5C8E94A9C8DF88A490"><enum>(F)</enum><header>Waivers</header> 
<clause id="H2CA43B4B71614FA0805774B1AC6222A3"><enum>(i)</enum><header>Market evaluation</header><text>The Administrator, in consultation with the Secretary of Energy and the Secretary of Agriculture, shall continually evaluate the impact of the biodiesel requirements established under this paragraph on the price of diesel fuel.</text></clause> 
<clause id="H0C29AD9D3ED04B87B0C7F47CF9599E1E"><enum>(ii)</enum><header>Waiver</header><text>If the Administrator determines that there is a significant biodiesel feedstock disruption or other market circumstances that would make the price of biodiesel fuel unreasonable, the Administrator, with the concurrence of the Secretary of Energy and the Secretary of Agriculture, shall issue an order to reduce, for a 60-day period, the quantity of biodiesel required under subparagraph (A) by an appropriate quantity that does not exceed 15 percent of the applicable annual requirement for biodiesel.</text></clause> 
<clause id="H36FC867EE98847CDBBBB506633A99CCE"><enum>(iii)</enum><header>Factors</header><text>In making determinations under this subparagraph, the Administrator shall consider—</text> 
<subclause id="HC1A330A96FC5402AB419002BAB8990FA"><enum>(I)</enum><text>the purposes of this Act;</text></subclause> 
<subclause id="H5CFACB0473D142B58CBDD2160071A8C5"><enum>(II)</enum><text>the differential between the price of diesel fuel and the price of biodiesel; and</text></subclause> 
<subclause id="HAF9026714E8147B9BDC7DB76279FD3DA"><enum>(III)</enum><text>the impact the biodiesel mandate has on consumers.</text></subclause></clause> 
<clause id="HE91337BFA0664D3594A1D2D1F608DCA2"><enum>(iv)</enum><header>Extensions</header><text>If the Administrator determines that the feedstock disruption or circumstances described in clause (ii) is continuing beyond the 60-day period described in clause (ii) or this clause, the Administrator, with the concurrence of the Secretary of Energy and the Secretary of Agriculture, may issue an order to reduce, for an additional 60-day period, the quantity of biodiesel required under subparagraph (A) by an appropriate quantity that does not exceed an additional 15 percent of the applicable annual requirement for biodiesel.</text></clause> 
<clause id="HC5697A699BF14DB1907440EC81C2CD1F"><enum>(v)</enum><header>Restoration</header><text>If the Administrator determines that the feedstock disruption or circumstances described in clause (ii) or (iv) has concluded and that it is practicable, the Administrator, with the concurrence of the Secretary of Energy and the Secretary of Agriculture, may issue an order to increase the quantity of biodiesel required under subparagraph (A) by an appropriate quantity to account for the gallons of biodiesel not used during the period a waiver or extension was in effect under this subparagraph.</text></clause></subparagraph> 
<subparagraph id="H4F5B781F25B84FE5959291DC60BEF868"><enum>(G)</enum><header>Preemption</header> 
<clause id="H29468FD1ADED41D0A344A05BEF839B16"><enum>(i)</enum><header>In general</header><text>Except as provided in clause (ii) of this subparagraph, the provisions of this section shall supersede any law of any State or political subdivision thereof insofar as it mandates the use of biodiesel.</text></clause> 
<clause id="HC32A33B200834C469C79F100317137F3"><enum>(ii)</enum><header>Construction and application</header><text display-inline="yes-display-inline">Nothing in this section shall be construed—</text> 
<subclause id="H5871EBBB589E4443BB95687D06C26F00"><enum>(I)</enum><text display-inline="yes-display-inline">to supersede any biodiesel mandate provided in any law described in clause (i) that is enacted as of January 1, 2008;</text></subclause> 
<subclause id="H6C06746B609C4AE6B6637376F30072CD"><enum>(II)</enum><text display-inline="yes-display-inline">to prohibit a State or political subdivision thereof from mandating the use of biodiesel in vehicles owned by such State or political subdivisions thereof; or</text></subclause> 
<subclause id="H7EFD1B17BD7D4F99B2A1B4A940795229"><enum>(III)</enum><text display-inline="yes-display-inline">to prohibit a State or political subdivision thereof from enacting financial incentives to promote the voluntary use of biodiesel.</text> </subclause></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </section> 
<section id="H2C7A16BB98124C84AB8C555E339DAF59"><enum>4.</enum><header>Biodiesel quality</header><text display-inline="no-display-inline">Subsection (p) of section 211 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545</external-xref>) (as added by section 3(a)) is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H9B2A7AD86EDF4D2691B3AA28FC00AFDA" style="OLC"> 
<paragraph id="HF81982CD044B441897341D67B8053589"><enum>(3)</enum><header>Biodiesel quality</header> 
<subparagraph id="H641D853202124C5D96591FED78BB1CA2"><enum>(A)</enum><header>Quality regulations</header><text>Not later than 180 days after the date of enactment of this subsection, the Administrator, in consultation with the Secretary of Energy and the Secretary of Agriculture, shall promulgate regulations to ensure that only high-quality biodiesel that is consistent with appropriate ASTM International standards for biodiesel and biodiesel blends is introduced into commerce.</text></subparagraph> 
<subparagraph id="H9758442E3A5D43358E8662B75E40C64B"><enum>(B)</enum><header>Enforcement</header><text>The Administrator shall establish an inspection program to ensure that biodiesel and biodiesel blends entering commerce meets the standards established under subparagraph (A).</text></subparagraph> 
<subparagraph id="H13A4F010F62948B1BF085322E8C98E16"><enum>(C)</enum><header>Violations</header><text>Regardless of whether the Administrator promulgates regulations under subparagraph (A), it shall be a violation of this Act to produce or distribute—</text> 
<clause id="HBE610F0D21894630927CCBE273D2003C"><enum>(i)</enum><text>biodiesel or any bio-based diesel replacement that does not meet the requirements of ASTM standard D6751; or</text></clause> 
<clause id="H424F8CC466344E8EB0165FF54E08BBEA"><enum>(ii)</enum><text>a biodiesel blend that does not meet the equivalent ASTM standard, as determined by the Administrator.</text></clause></subparagraph> 
<subparagraph id="HEBEB7566E8E041DFA07F6BDA785F40C8"><enum>(D)</enum><header>Funding</header><text>There are authorized to be appropriated to carry out this paragraph $3,000,000 for each of fiscal years 2008 through 2010.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H9574389F028247B499007D365ED9A6F6"><enum>5.</enum><header>Biodiesel labeling</header><text display-inline="no-display-inline">Subsection (p) of section 211 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545</external-xref>) (as amended by section 4) is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H2E1044AC3EBD4FD2A9B7204BC4BF5F9E" style="OLC"> 
<paragraph id="H45555D9335CC47FB9F002EFB86A23946"><enum>(4)</enum><header>Biodiesel labeling</header> 
<subparagraph commented="no" display-inline="no-display-inline" id="H7F5F782E2F8B41D4A59645B494F1AFA8"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Each retail diesel fuel pump shall be labeled in a manner that informs consumers of the percent of biodiesel that is contained in the biodiesel blend that is offered for sale, as determined by the Administrator.</text></subparagraph> 
<subparagraph id="H65A4F948D3B04F01A25F47004FC23D6"><enum>(B)</enum><header>Labeling requirements</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this subsection, the Administrator shall promulgate biodiesel labeling requirements as follows:</text> 
<clause id="H24E8661837434993AAF6AAE3B261FBC4"><enum>(i)</enum><text>Biodiesel blends that contain less than or equal to 5 percent biodiesel by volume and that meet ASTM D975 diesel specifications shall not require any additional labels.</text></clause> 
<clause id="H3C465364CC9E46E8A2F691CA0665FF3"><enum>(ii)</enum><text>Biodiesel blends that contain more than 5 percent biodiesel by volume but not more than 20 percent by volume shall be labeled <quote>contains biodiesel in quantities between 5 percent and 20 percent</quote>.</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H312DB26E4CA84EA4B8F46700075F00F1"><enum>(iii)</enum><text>Biodiesel blends that contain more than 20 percent biodiesel by volume shall be labeled <quote>contains more than 20 percent biodiesel</quote>.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section>
