		<official-title>To temporarily raise the portfolio caps applicable to
		  Freddie Mac and Fannie Mae, to provide the necessary financing to curb
		  foreclosures by facilitating the refinancing of at-risk subprime borrowers into
		  safe, prime loans, to preserve liquidity in the mortgage lending markets, and
		  for other purposes.</official-title>

		<section display-inline="no-display-inline" id="HC60B4737A8C744FB9B2D67DC62F43A8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Protecting Access to Safe Mortgages
			 Act</short-title></quote>.</text>
		</section><section id="H68CFB92129134E2285A88934F62704F3" section-type="subsequent-section"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds that—</text>
			<paragraph id="HA637C0EED8CE48119604F6561189428"><enum>(1)</enum><text>American families
			 will be severely harmed by an unprecedented wave of potential foreclosures
			 expected to occur in the next 12 months, as adjustable rate subprime mortgages
			 reset to higher interest rates;</text>
			</paragraph><paragraph id="H886BD249EA1C41BE8585CEF82F25F13"><enum>(2)</enum><text>preventing such
			 foreclosures and facilitating the refinancing of at-risk subprime borrowers
			 into safe prime loans will require additional capacity on the part of the
			 government sponsored enterprises, the Federal National Mortgage Association,
			 and the Federal Home Loan Mortgage Association, and any affiliates thereof, to
			 purchase additional financing;</text>
			</paragraph><paragraph id="H655D3D5B09994213BC001DBC4BC8046C"><enum>(3)</enum><text>there is a lack of
			 liquidity in the financial markets for mortgage backed securities, which
			 threatens to impair financing for all mortgages; and</text>
			</paragraph><paragraph id="H2D6D8072EA7547FCA8ACFCA57C538901"><enum>(4)</enum><text>the government
			 sponsored enterprises, the Federal National Mortgage Association, and the
			 Federal Home Loan Mortgage Corporation, and any affiliates thereof, are
			 uniquely positioned to provide the financing necessary to alleviate the
			 predicted wave of upcoming foreclosures, and the liquidity necessary to help
			 United States markets.</text>
			</paragraph></section><section id="HB8814C66D52847519C896047FFC54BE1"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">For purposes of this Act, the following
			 definitions shall apply:</text>
			<paragraph id="HA5A2888DB00344E3A38EA102F10272A3"><enum>(1)</enum><header>Director</header><text>The
			 term <term>Director</term> means the Director of the Office of Federal Housing
			 Enterprise Oversight of the Department of Housing and Urban Development.</text>
			</paragraph><paragraph id="HBE394F16DC60419C9CEAA7739F5586B5"><enum>(2)</enum><header>Enterprise</header><text>The
			 term <term>enterprise</term> means—</text>
				<subparagraph id="H33537ADAD02D4D46ABF877DDD00090D2"><enum>(A)</enum><text>the Federal
			 National Mortgage Association, and any affiliate thereof; and</text>
				</subparagraph><subparagraph id="H428FCCC27C52416D8B26DEF07700AE5F"><enum>(B)</enum><text>the Federal Home
			 Loan Mortgage Corporation, and any affiliate thereof.</text>
				</subparagraph></paragraph><paragraph id="H885D4D7FFEA14898804D236C8EA1B4C8"><enum>(3)</enum><header>Fannie mae
			 consent order</header><text>The term <term>Fannie Mae Consent Order</term>
			 means the order of the Office of Federal Housing Enterprises Oversight dated
			 May 23, 2006, in the matter of the Federal National Mortgage
			 Association.</text>
			</paragraph><paragraph id="H03DC63D76F6347D080A3A9249CB9A567"><enum>(4)</enum><header>Freddie mac
			 letter</header><text>The term <term>Freddie Mac Letter</term> means the letter
			 dated July 31, 2006, from the Chairman and Chief Executive Officer of the
			 Federal Home Loan Mortgage Corporation to the Director.</text>
			</paragraph><paragraph id="H7035047F4BBF4274BC104EC6E3006E8"><enum>(5)</enum><header>OFHEO</header><text>The
			 term <term>OFHEO</term> means the Office of Federal Housing Enterprises
			 Oversight.</text>
			</paragraph></section><section id="HB3A5D610DD7D49740023C09771FABE55"><enum>4.</enum><header>Lifting of
			 Portfolio Caps</header>
			<subsection id="H85819E37E58C492CA46E1300BE36D9B4"><enum>(a)</enum><header>In
			 general</header><text>Immediately upon the date of enactment of this Act, the
			 Director shall terminate, suspend, modify, or otherwise lift—</text>
				<paragraph id="H0293F54C2C294C0DA54E00387077554E"><enum>(1)</enum><text>the limitation on
			 growth provision set forth in section 4, Article III of the Fannie Mae Consent
			 Order, as interpreted and modified by OFHEO on September 19, 2007; and</text>
				</paragraph><paragraph id="HDE25F057AA8F4F87BAB2354FC7E1D18"><enum>(2)</enum><text display-inline="yes-display-inline">the voluntary temporary growth limitation
			 described in the Freddie Mac Letter, as interpreted and modified by OFHEO on
			 September 19, 2007.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H99FE098D611D48BD871D6F5FA7886898"><enum>(b)</enum><header>Factors</header><text>In
			 carrying out subsection (a), the Director shall increase the mortgage portfolio
			 limitations of both enterprises by not less than 10 percent, unless the
			 Director certifies in writing to the Committee on Banking, Housing, and Urban
			 Affairs of the Senate and the Committee on Financial Services of the House of
			 Representatives, and demonstrates by compelling evidence that such action is
			 likely to result in a significant depletion of the core capital of an
			 enterprise, or otherwise create an unsafe and unsound condition.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H30404C98FCEF45A089C55535CA130966"><enum>(c)</enum><header>Rule of
			 construction</header><text display-inline="yes-display-inline">Nothing in this
			 section shall be construed to prevent or prohibit the Director from exercising
			 any authority of the Director to terminate, suspend, modify, or otherwise lift
			 the limitations referred to in paragraphs (1) and (2) of subsection (a) beyond
			 the minimum increase specified in subsection (b), as the Director deems
			 appropriate.</text>
			</subsection></section><section id="HE4B7706080694451A1236361951517F7"><enum>5.</enum><header>Sunset
			 provision</header><text display-inline="no-display-inline">This Act is
			 repealed, effective 1 year after the date of enactment of this Act.</text>
