<subsection id="HD566310964B74961BA9EB1326ECD213C"><enum>(a)</enum><header>In general</header><text>The Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1801">50 U.S.C. 1801 et seq.</external-xref>) is amended—</text> 
<paragraph id="H3FCB6CCF77754CB3A36EFF57E3A8854F"><enum>(1)</enum><text>by striking title VII; and</text></paragraph> 
<paragraph id="H37846D2521D9404C9597D2BB60A09D83"><enum>(2)</enum><text>by adding after title VI the following new title:</text>

<subsection id="H2C3E097324044B5199113DC8C776F5DF"><enum>(a)</enum><header>In general</header><text>The terms <quote>agent of a foreign power</quote>, <quote>Attorney General</quote>, <quote>contents</quote>, <quote>electronic surveillance</quote>, <quote>foreign intelligence information</quote>, <quote>foreign power</quote>, <quote>minimization procedures</quote>, <quote>person</quote>, <quote>United States</quote>, and <quote>United States person</quote> have the meanings given such terms in section 101, except as specifically provided in this title.</text></subsection> 
<subsection id="HE443452F37064F1884A504F1DA17D775"><enum>(b)</enum><header>Additional Definitions</header> 
<paragraph id="H86AE2D9963F7416AB0497CCF8F4293AB"><enum>(1)</enum><header>Congressional intelligence committees</header><text>The term <quote>congressional intelligence committees</quote> means—</text> 
<subparagraph id="HDE33C656221349268D185BE3CE4EF13"><enum>(A)</enum><text>the Select Committee on Intelligence of the Senate; and</text></subparagraph> 
<subparagraph id="H650233BAA4834A57BF93837559D797B8"><enum>(B)</enum><text>the Permanent Select Committee on Intelligence of the House of Representatives.</text></subparagraph></paragraph> 
<paragraph id="H836600040235489FBF88EBC767EEC263"><enum>(2)</enum><header>Foreign intelligence surveillance court; court</header><text>The terms <quote>Foreign Intelligence Surveillance Court</quote> and <quote>Court</quote> mean the court established by section 103(a).</text></paragraph> 
<paragraph id="H24E87517D249466DA769003B24005744"><enum>(3)</enum><header>Foreign intelligence surveillance court of review; court of review</header><text>The terms <quote>Foreign Intelligence Surveillance Court of Review</quote> and <quote>Court of Review</quote> mean the court established by section 103(b).</text></paragraph> 
<paragraph id="H3ABFC72F350A400F80E6F75F448D174B"><enum>(4)</enum><header>Electronic communication service provider</header><text>The term <quote>electronic communication service provider</quote> means—</text> 
<subparagraph id="H622DE0F65D3D4E1980A28F9B0FCF37F"><enum>(A)</enum><text>a telecommunications carrier, as that term is defined in section 3 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/153">47 U.S.C. 153</external-xref>);</text></subparagraph> 
<subparagraph id="HB72F71D454F64DF8837F0445A2D67EF4"><enum>(B)</enum><text>a provider of electronic communication service, as that term is defined in <external-xref legal-doc="usc" parsable-cite="usc/18/2510">section 2510</external-xref> of title 18, United States Code;</text></subparagraph> 
<subparagraph id="H75EC9A94CD08472BA37BB84F3DD9F273"><enum>(C)</enum><text>a provider of a remote computing service, as that term is defined in <external-xref legal-doc="usc" parsable-cite="usc/18/2711">section 2711</external-xref> of title 18, United States Code;</text></subparagraph> 
<subparagraph id="H468D892F98334DA5A6D543BF7CF2732"><enum>(D)</enum><text>any other communication service provider who has access to wire or electronic communications either as such communications are transmitted or as such communications are stored; or</text></subparagraph> 
<subparagraph id="HCE32E17013984D86B0C17B1B9DD20F4"><enum>(E)</enum><text>an officer, employee, or agent of an entity described in subparagraph (A), (B), (C), or (D).</text></subparagraph></paragraph> 
<paragraph id="H048840A3F7D24CF1AE00C9C9FDF65991"><enum>(5)</enum><header>Intelligence community</header><text>The term <quote>intelligence community</quote> has the meaning given the term in section 3(4) of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/401a">50 U.S.C. 401a(4)</external-xref>).</text></paragraph></subsection></section> 
<section id="H9D689344B820436FAA57B6AF752C448B"><enum>702.</enum><header>Procedures for targeting certain persons outside the United States other than United States persons</header> 
<subsection id="H8BA4573E4ECC42A88D25C6C5EE54CCC"><enum>(a)</enum><header>Authorization</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, pursuant to an order issued in accordance with subsection (i)(3) or a determination under subsection (g)(1)(B), the Attorney General and the Director of National Intelligence may authorize jointly, for a period of up to 1 year from the effective date of the authorization, the targeting of persons reasonably believed to be located outside the United States to acquire foreign intelligence information.</text></subsection> 
<subsection id="HAD0DB0E7F8004A3F8BB1FB635160F604"><enum>(b)</enum><header>Limitations</header><text>An acquisition authorized under subsection (a)—</text> 
<paragraph id="H8CB6A54F36E8453989E39303139238C0"><enum>(1)</enum><text>may not intentionally target any person known at the time of acquisition to be located in the United States;</text></paragraph> 
<paragraph id="H2498115DC77849CDAB4CB8C6404F466F"><enum>(2)</enum><text>may not intentionally target a person reasonably believed to be located outside the United States in order to target a particular, known person reasonably believed to be in the United States;</text></paragraph> 
<paragraph id="HFB475E1E5ED14AC0A7F69D9595B0EF9D"><enum>(3)</enum><text>may not intentionally target a United States person reasonably believed to be located outside the United States;</text></paragraph> 
<paragraph id="HD44CCA2CDB8E4642BA951077C47BA97F"><enum>(4)</enum><text>may not intentionally acquire any communication as to which the sender and all intended recipients are known at the time of the acquisition to be located in the United States; and</text></paragraph> 
<paragraph id="H12F245C3DD964881834DD00143879606"><enum>(5)</enum><text>shall be conducted in a manner consistent with the fourth amendment to the Constitution of the United States.</text></paragraph></subsection> 
<subsection id="H2DC26256326445E29554CD861D807B19" commented="no"><enum>(c)</enum><header>Conduct of acquisition</header><text>An acquisition authorized under subsection (a) may be conducted only in accordance with—</text> 
<paragraph id="H3B545374C3E84E70BD6B91F02000687F" commented="no"><enum>(1)</enum><text>a certification made by the Attorney General and the Director of National Intelligence pursuant to subsection (g) or a determination under paragraph (1)(B) of such subsection; and</text></paragraph> 
<paragraph id="HFE39DE83B6F241488E302E123FBC0066" commented="no"><enum>(2)</enum><text>the procedures and guidelines required pursuant to subsections (d), (e), and (f).</text></paragraph></subsection> 
<subsection id="HB7BECB8ADA994AB0A8E4644E52772124"><enum>(d)</enum><header>Targeting Procedures</header> 
<paragraph id="H5A0C3307E5884B4CA322C100F9091EB0"><enum>(1)</enum><header>Requirement to adopt</header><text>The Attorney General, in consultation with the Director of National Intelligence, shall adopt targeting procedures that are reasonably designed to ensure that any acquisition authorized under subsection (a) is limited to targeting persons reasonably believed to be located outside the United States and does not result in the intentional acquisition of any communication as to which the sender and all intended recipients are known at the time of the acquisition to be located in the United States.</text></paragraph> 
<paragraph id="HE62BF9A1C45F48CBB5D22E1CCE647CD8"><enum>(2)</enum><header>Judicial review</header><text>The procedures required by paragraph (1) shall be subject to judicial review pursuant to subsection (i).</text></paragraph></subsection> 
<subsection id="H25EFA86B773440ADA45DC853FF1165FD"><enum>(e)</enum><header>Minimization Procedures</header> 
<paragraph id="HFD4DB8E8EC1F4BB198C56837D976A1B5"><enum>(1)</enum><header>Requirement to adopt</header><text>The Attorney General, in consultation with the Director of National Intelligence, shall adopt minimization procedures for acquisitions authorized under subsection (a) that—</text> 
<subparagraph id="HC22D43B0E8F44EE0B395DC88106814E2"><enum>(A)</enum><text>in the case of electronic surveillance, meet the definition of minimization procedures under section 101(h); and</text></subparagraph> 
<subparagraph id="H4A98F6108CC94A0487BE8537273E4175"><enum>(B)</enum><text>in the case of a physical search, meet the definition of minimization procedures under section 301(4).</text></subparagraph></paragraph> 
<paragraph id="H32129F9102BE4B56AAAEFD69ED75AE1F"><enum>(2)</enum><header>Judicial review</header><text>The minimization procedures required by paragraph (1) shall be subject to judicial review pursuant to subsection (i).</text></paragraph></subsection> 
<subsection id="H583C5B26EBC64BBA851D08AE94593CBD"><enum>(f)</enum><header>Guidelines for compliance with limitations</header> 
<paragraph id="H892DCA23FF4448AAB943A96A62E0725"><enum>(1)</enum><header>Requirement to adopt</header><text>The Attorney General, in consultation with the Director of National Intelligence, shall adopt guidelines to ensure—</text> 
<subparagraph id="HF0105BDFFF424291BDFFD0065117800"><enum>(A)</enum><text>compliance with the limitations in subsection (b); and</text></subparagraph> 
<subparagraph id="HA02A2183B925426B8F94C1E08200CE40"><enum>(B)</enum><text>that an application is filed under section 104 or 303, if required by this Act.</text></subparagraph></paragraph> 
<paragraph id="H42A0AAFAA4214D9D97B5E613118F9D6"><enum>(2)</enum><header>Criteria</header><text>With respect to subsection (b)(2), the guidelines adopted pursuant to paragraph (1) shall contain specific criteria for determining whether a significant purpose of an acquisition is to acquire the communications of a specific United States person reasonably believed to be located in the United States. Such criteria shall include consideration of whether—</text> 
<subparagraph id="H3AB459A9C1FB4B8FB509B970BB42D86F"><enum>(A)</enum><text display-inline="yes-display-inline">the department or agency of the Federal Government conducting the acquisition has made an inquiry to another department or agency of the Federal Government to gather information on the specific United States person;</text></subparagraph> 
<subparagraph id="H6B3D83E22B6B4AF29CBB1CC83C80B3BC"><enum>(B)</enum><text>the department or agency of the Federal Government conducting the acquisition has provided information that identifies the specific United States person to another department or agency of the Federal Government;</text></subparagraph> 
<subparagraph id="H4F1F3628CA524B558905005F3B7F48D5"><enum>(C)</enum><text display-inline="yes-display-inline">the department or agency of the Federal Government conducting the acquisition determines that the specific United States person has been the subject of ongoing interest or repeated investigation by a department or agency of the Federal Government; and</text></subparagraph> 
<subparagraph id="HF80AF4888A0C417E9124062DC140E94C"><enum>(D)</enum><text display-inline="yes-display-inline">the specific United States person is a natural person.</text></subparagraph></paragraph> 
<paragraph id="HF65AAA2E61634002B31E45DCD3CE06C6"><enum>(3)</enum><header>Training</header><text>The Director of National Intelligence shall establish a training program for appropriate personnel of the intelligence community to ensure that the guidelines adopted pursuant to paragraph (1) are properly implemented.</text></paragraph> 
<paragraph id="HA800D928BC4C4762918ECF2EF350AEB7"><enum>(4)</enum><header>Submission to Congress and Foreign Intelligence Surveillance Court</header><text>The Attorney General shall submit the guidelines adopted pursuant to paragraph (1) to—</text> 
<subparagraph id="HD0AD889D3C09424AA0810998881117A0"><enum>(A)</enum><text>the congressional intelligence committees;</text></subparagraph> 
<subparagraph id="HCA16A2583D954DBA88F37B397F672E8"><enum>(B)</enum><text>the Committees on the Judiciary of the House of Representatives and the Senate; and</text></subparagraph> 
<subparagraph id="H08C179B65CC046A0A20160DDCF2CE76C" commented="no"><enum>(C)</enum><text>the Foreign Intelligence Surveillance Court.</text></subparagraph></paragraph></subsection> 
<subsection id="HAA552F6EE4A942CABAAD001EA37D5D46"><enum>(g)</enum><header>Certification</header> 
<paragraph id="HC1E1C1792A9643B79238EFA04742028F"><enum>(1)</enum><header>In general</header> 
<subparagraph id="H2F26923C7A4B4FA1B52D2E756C4F64CE"><enum>(A)</enum><header>Requirement</header><text display-inline="yes-display-inline">Subject to subparagraph (B), if the Attorney General and the Director of National Intelligence seek to authorize an acquisition under this section, the Attorney General and the Director of National Intelligence shall provide, under oath, a written certification, as described in this subsection.</text></subparagraph> 
<subparagraph id="H21DD0130ACBC46FDA55E68620021F7D4"><enum>(B)</enum><header>Emergency authorization</header><text>If the Attorney General and the Director of National Intelligence determine that an emergency situation exists, immediate action by the Government is required, and time does not permit the completion of judicial review pursuant to subsection (i) prior to the initiation of an acquisition, the Attorney General and the Director of National Intelligence may authorize the acquisition and shall submit to the Foreign Intelligence Surveillance Court a certification under this subsection as soon as possible but in no event more than 7 days after such determination is made.</text></subparagraph></paragraph> 
<paragraph id="H47A22ADAFC7140488208A6CFD1051C4D"><enum>(2)</enum><header>Requirements</header><text>A certification made under this subsection shall—</text> 
<subparagraph id="H0B802B6036744772A9CBF27600A95639"><enum>(A)</enum><text>attest that—</text> 
<clause id="HE8987C74424D47678745AFC89C7DFA81"><enum>(i)</enum><text>there are reasonable procedures in place for determining that the acquisition authorized under subsection (a)—</text> 
<subclause id="H0324B76B53394C9CB19B3ED637A7CC72"><enum>(I)</enum><text>is targeted at persons reasonably believed to be located outside the United States and such procedures have been submitted to the Foreign Intelligence Surveillance Court; and</text></subclause> 
<subclause id="H2C00D5B1B53B4E6D9D9E1975C7F11B92"><enum>(II)</enum><text display-inline="yes-display-inline">does not result in the intentional acquisition of any communication as to which the sender and all intended recipients are known at the time of the acquisition to be located in the United States, and such procedures have been submitted to the Foreign Intelligence Surveillance Court;</text></subclause></clause> 
<clause id="HF4FCF536FCF0448A9E64CB8DF0173C2D"><enum>(ii)</enum><text>guidelines have been adopted in accordance with subsection (f) to ensure compliance with the limitations in subsection (b) and to ensure that applications are filed under section 104 or section 303, if required by this Act;</text></clause> 
<clause id="HE439F17C0E35406E8C63F25B56D6E884"><enum>(iii)</enum><text>the minimization procedures to be used with respect to such acquisition—</text> 
<subclause id="H3CFCCE52C7B84D3293CA3C431CB22719"><enum>(I)</enum><text>meet the definition of minimization procedures under section 101(h) or section 301(4) in accordance with subsection (e); and</text></subclause> 
<subclause id="H1202F11CC1A34B2F81C92F5C737B0506" commented="no"><enum>(II)</enum><text>have been submitted to the Foreign Intelligence Surveillance Court;</text></subclause></clause> 
<clause id="H3F177505EEAE4F4AB4D99E002C234BC8"><enum>(iv)</enum><text>the procedures and guidelines referred to in clauses (i), (ii), and (iii) are consistent with the requirements of the fourth amendment to the Constitution of the United States;</text></clause> 
<clause id="HA960724F576D443499E946D27929E2D2"><enum>(v)</enum><text>a significant purpose of the acquisition is to obtain foreign intelligence information;</text></clause> 
<clause id="HF4F13E859F7F432BAFE1B1DA5BA8D261"><enum>(vi)</enum><text>the acquisition involves obtaining the foreign intelligence information from or with the assistance of an electronic communication service provider; and</text></clause> 
<clause id="HBA0EAE0AD8B6421BA8B8196BAC1F0075"><enum>(vii)</enum><text>the acquisition complies with the limitations in subsection (b);</text></clause></subparagraph> 
<subparagraph id="H7E3B47690A754FDBBFA34D5B5CAFBCE"><enum>(B)</enum><text>be supported, as appropriate, by the affidavit of any appropriate official in the area of national security who is—</text> 
<clause id="H06A10AC9C111400496D274ACCD5D9EBA"><enum>(i)</enum><text>appointed by the President, by and with the consent of the Senate; or</text></clause> 
<clause id="H51C6BD3341A34A070050E042F1C217BB"><enum>(ii)</enum><text>the head of an element of the intelligence community; and</text></clause></subparagraph> 
<subparagraph id="H979ED0D22A884C3D847E76376677C4BC"><enum>(C)</enum><text>include—</text> 
<clause id="HBF8FB904112340789C172DFB992EB120"><enum>(i)</enum><text>an effective date for the authorization that is between 30 and 60 days from the submission of the written certification to the court; or</text></clause> 
<clause id="H022F794EC7A84D8B80A347F31C368D11"><enum>(ii)</enum><text display-inline="yes-display-inline">if the acquisition has begun or will begin in less than 30 days from the submission of the written certification to the court—</text> 
<subclause id="H4E02104CFCB9427282B34F557DCC5600"><enum>(I)</enum><text>the date the acquisition began or the effective date for the acquisition;</text></subclause> 
<subclause id="HFE5CC48011A64336BE753337405E3722"><enum>(II)</enum><text>a description of why implementation was required in less than 30 days from the submission of the written certification to the court; and</text></subclause> 
<subclause id="HE1D59CE027EC4F41B21C99DC80007339"><enum>(III)</enum><text>if the acquisition is authorized under paragraph (1)(B), the basis for the determination that an emergency situation exists, immediate action by the government is required, and time does not permit the completion of judicial review prior to the initiation of the acquisition.</text></subclause></clause></subparagraph></paragraph> 
<paragraph id="H8F16AAE2582847DB88A111376F62CC63"><enum>(3)</enum><header>Limitation</header><text>A certification made under this subsection is not required to identify the specific facilities, places, premises, or property at which the acquisition authorized under subsection (a) will be directed or conducted.</text></paragraph> 
<paragraph id="H0DD9D41E6F9F49ED9B38B539BAC8DCC"><enum>(4)</enum><header>Submission to the court</header><text>The Attorney General shall transmit a copy of a certification made under this subsection, and any supporting affidavit, under seal to the Foreign Intelligence Surveillance Court before the initiation of an acquisition under this section, except in accordance with paragraph (1)(B). The Attorney General shall maintain such certification under security measures adopted by the Chief Justice of the United States and the Attorney General, in consultation with the Director of National Intelligence.</text></paragraph> 
<paragraph id="H3D5124A75DDA48EA813689847E52519C"><enum>(5)</enum><header>Review</header><text>A certification submitted pursuant to this subsection shall be subject to judicial review pursuant to subsection (i).</text></paragraph></subsection> 
<subsection id="HCE6FB8CC654D4E3D9D1509DFDEFB4131"><enum>(h)</enum><header>Directives and Judicial Review of Directives</header> 
<paragraph id="H650F66354A3B4D83AACFB57B6333713E"><enum>(1)</enum><header>Authority</header><text>Pursuant to an order issued in accordance with subsection (i)(3) or a determination under subsection (g)(1)(B), the Attorney General and the Director of National Intelligence may direct, in writing, an electronic communication service provider to—</text> 
<subparagraph id="H0AFCEE20D57445D78009CE3093B115D1"><enum>(A)</enum><text>immediately provide the Government with all information, facilities, or assistance necessary to accomplish the acquisition authorized in accordance with this section in a manner that will protect the secrecy of the acquisition and produce a minimum of interference with the services that such electronic communication service provider is providing to the target of the acquisition; and</text></subparagraph> 
<subparagraph id="HF394442036004FDDA34D5F928CF9E78D"><enum>(B)</enum><text>maintain under security procedures approved by the Attorney General and the Director of National Intelligence any records concerning the acquisition or the aid furnished that such electronic communication service provider wishes to maintain.</text></subparagraph></paragraph> 
<paragraph id="HF91D48FB4221467B88C16CA0172FEBD"><enum>(2)</enum><header>Compensation</header><text>The Government shall compensate, at the prevailing rate, an electronic communication service provider for providing information, facilities, or assistance pursuant to paragraph (1).</text></paragraph> 
<paragraph id="H7F658252F0294D319B27D3D89200A37C"><enum>(3)</enum><header>Release from liability</header><text>Notwithstanding any other provision of law, no cause of action shall lie in any court against any electronic communication service provider for providing any information, facilities, or assistance in accordance with a directive issued pursuant to paragraph (1).</text></paragraph> 
<paragraph id="HD6BB90A6E5AC41AFA80025F16DCC2000"><enum>(4)</enum><header>Challenging of directives</header> 
<subparagraph id="H678D23E11B1C40C282E8078066E6C200"><enum>(A)</enum><header>Authority to challenge</header><text>An electronic communication service provider receiving a directive issued pursuant to paragraph (1) may challenge the directive by filing a petition with the Foreign Intelligence Surveillance Court, which shall have jurisdiction to review such a petition.</text></subparagraph> 
<subparagraph id="H68D8ED6A61AA435A9B5BD4CE083EAC96"><enum>(B)</enum><header>Assignment</header><text>The presiding judge of the Court shall assign the petition filed under subparagraph (A) to 1 of the judges serving in the pool established by section 103(e)(1) not later than 24 hours after the filing of the petition.</text></subparagraph> 
<subparagraph id="H34BFF3FACB0549888FC26CC71E3949B3"><enum>(C)</enum><header>Standards for review</header><text>A judge considering a petition to modify or set aside a directive may grant such petition only if the judge finds that the directive does not meet the requirements of this section or is otherwise unlawful.</text></subparagraph> 
<subparagraph id="H4F46F608ED684ABD896D9C98AAE8B5B6"><enum>(D)</enum><header>Procedures for initial review</header><text display-inline="yes-display-inline">A judge shall conduct an initial review of a petition filed under subparagraph (A) not later than 5 days after being assigned such petition. If the judge determines that the petition does not consist of claims, defenses, or other legal contentions that are warranted by existing law, a nonfrivolous argument for extending, modifying, or reversing existing law, or establishing new law, the judge shall immediately deny the petition and affirm the directive or any part of the directive that is the subject of the petition and order the recipient to comply with the directive or any part of it. Upon making such a determination or promptly thereafter, the judge shall provide a written statement for the record of the reasons for a determination under this subparagraph.</text></subparagraph> 
<subparagraph id="H1CA6C6CE17B3421FB508F89D13DA3379"><enum>(E)</enum><header>Procedures for plenary review</header><text display-inline="yes-display-inline">If a judge determines that a petition filed under subparagraph (A) requires plenary review, the judge shall affirm, modify, or set aside the directive that is the subject of that petition not later than 30 days after being assigned the petition. If the judge does not set aside the directive, the judge shall immediately affirm or modify the directive and order the recipient to comply with the directive in its entirety or as modified. The judge shall provide a written statement for the records of the reasons for a determination under this subparagraph.</text></subparagraph> 
<subparagraph id="HD6BBF0B05B9C4475BDE25919FFF2D53D"><enum>(F)</enum><header>Continued effect</header><text>Any directive not explicitly modified or set aside under this paragraph shall remain in full effect.</text></subparagraph> 
<subparagraph id="H3CEDFAE878E64BC3915BFC2801746E84"><enum>(G)</enum><header>Contempt of court</header><text>Failure to obey an order of the Court issued under this paragraph may be punished by the Court as contempt of court.</text></subparagraph></paragraph> 
<paragraph id="H258BF36EF8A2401DBB047FA5CD994CB0"><enum>(5)</enum><header>Enforcement of directives</header> 
<subparagraph id="H5870C4E0D58D4E469B17FB1E234C7CA7"><enum>(A)</enum><header>Order to compel</header><text display-inline="yes-display-inline">If an electronic communication service provider fails to comply with a directive issued pursuant to paragraph (1), the Attorney General may file a petition for an order to compel the electronic communication service provider to comply with the directive with the Foreign Intelligence Surveillance Court, which shall have jurisdiction to review such a petition.</text></subparagraph> 
<subparagraph id="H6EF411B3EF434850B78FFD391949CEBA"><enum>(B)</enum><header>Assignment</header><text>The presiding judge of the Court shall assign a petition filed under subparagraph (A) to 1 of the judges serving in the pool established by section 103(e)(1) not later than 24 hours after the filing of the petition.</text></subparagraph> 
<subparagraph id="H4046948246BB46F4AA86D12358DFA856" commented="no"><enum>(C)</enum><header>Procedures for review</header><text>A judge considering a petition filed under subparagraph (A) shall issue an order requiring the electronic communication service provider to comply with the directive or any part of it, as issued or as modified not later than 30 days after being assigned the petition if the judge finds that the directive meets the requirements of this section and is otherwise lawful. The judge shall provide a written statement for the record of the reasons for a determination under this paragraph.</text></subparagraph> 
<subparagraph id="H84072A8337F44BF0BF679130148D1F63"><enum>(D)</enum><header>Contempt of court</header><text>Failure to obey an order of the Court issued under this paragraph may be punished by the Court as contempt of court.</text></subparagraph> 
<subparagraph id="HC11B17BFA90948D9AFD82F00ED892581"><enum>(E)</enum><header>Process</header><text>Any process under this paragraph may be served in any judicial district in which the electronic communication service provider may be found.</text></subparagraph></paragraph> 
<paragraph id="HBCFE590B3449432483FE5FDD9BCBB814"><enum>(6)</enum><header>Appeal</header> 
<subparagraph id="H052CF33B7F0C4B06AC7FC12B28FC4078"><enum>(A)</enum><header>Appeal to the court of review</header><text>The Government or an electronic communication service provider receiving a directive issued pursuant to paragraph (1) may file a petition with the Foreign Intelligence Surveillance Court of Review for review of a decision issued pursuant to paragraph (4) or (5). The Court of Review shall have jurisdiction to consider such a petition and shall provide a written statement for the record of the reasons for a decision under this paragraph.</text></subparagraph> 
<subparagraph id="H65825D8F0D814BFDB4991922E344BE12"><enum>(B)</enum><header>Certiorari to the supreme court</header><text>The Government or an electronic communication service provider receiving a directive issued pursuant to paragraph (1) may file a petition for a writ of certiorari for review of the decision of the Court of Review issued under subparagraph (A). The record for such review shall be transmitted under seal to the Supreme Court of the United States, which shall have jurisdiction to review such decision.</text></subparagraph></paragraph></subsection> 
<subsection id="HC744B8A55555469692EE70AEE48BC87D"><enum>(i)</enum><header>Judicial Review of Certifications and Procedures</header> 
<paragraph id="H858C98C89BAB41D999D22D45F405E5FB"><enum>(1)</enum><header>In general</header> 
<subparagraph id="H73A63828269B4BC996D79BD45B28B211"><enum>(A)</enum><header>Review by the foreign intelligence surveillance court</header><text>The Foreign Intelligence Surveillance Court shall have jurisdiction to review any certification submitted pursuant to subsection (g) and the targeting and minimization procedures required by subsections (d) and (e).</text></subparagraph> 
<subparagraph id="HF8E7AC8FBF564A788ED6141D5F61B263"><enum>(B)</enum><header>Time period for review</header><text>The Court shall review the certification submitted pursuant to subsection (g) and the targeting and minimization procedures required by subsections (d) and (e) and approve or deny an order under this subsection not later than 30 days after the date on which a certification is submitted.</text></subparagraph></paragraph> 
<paragraph id="HB544AC436A5D416680C68FFBBF20673C"><enum>(2)</enum><header>Review</header><text>The Court shall review the following:</text> 
<subparagraph id="H6042DAD0537C4677A7CD0EFE1590482"><enum>(A)</enum><header>Certifications</header><text>A certification submitted pursuant to subsection (g) to determine whether the certification contains all the required elements.</text></subparagraph> 
<subparagraph id="H2CA452F04A4446FEA660FBC04DB5273D"><enum>(B)</enum><header>Targeting procedures</header><text>The targeting procedures required by subsection (d) to assess whether the procedures are reasonably designed to ensure that the acquisition authorized under subsection (a) is limited to the targeting of persons reasonably believed to be located outside the United States and does not result in the intentional acquisition of any communication as to which the sender and all intended recipients are known at the time of the acquisition to be located in the United States.</text></subparagraph> 
<subparagraph id="H7BD0CDD7B650485AB138EF83E5A051C2"><enum>(C)</enum><header>Minimization procedures</header><text>The minimization procedures required by subsection (e) to assess whether such procedures meet the definition of minimization procedures under section 101(h) or section 301(4) in accordance with subsection (e).</text></subparagraph></paragraph> 
<paragraph id="H8871A072C6FE40D100EB449394FB153B"><enum>(3)</enum><header>Orders</header> 
<subparagraph id="HC693515E326049CBB36919797CA07522"><enum>(A)</enum><header>Approval</header><text>If the Court finds that a certification submitted pursuant to subsection (g) contains all of the required elements and that the procedures required by subsections (d) and (e) are consistent with the requirements of those subsections and with the fourth amendment to the Constitution of the United States, the Court shall enter an order approving the certification and the use of the procedures for the acquisition.</text></subparagraph> 
<subparagraph id="H101D6B7D0F514FDCA8B69549DF73F0E"><enum>(B)</enum><header>Correction of deficiencies</header><text>If the Court finds that a certification submitted pursuant to subsection (g) does not contain all of the required elements or that the procedures required by subsections (d) and (e) are not consistent with the requirements of those subsections or the fourth amendment to the Constitution of the United States—</text> 
<clause id="HF09EE06EF1254B2ABD3C1B453B33A7F3" commented="no"><enum>(i)</enum><text>in the case of a certification submitted in accordance with subsection (g)(1)(A), the Court shall deny the order, identify any deficiency in the certification or procedures, and provide the Government with an opportunity to correct such deficiency; and</text></clause> 
<clause id="HD3C19D4B70A2441D90F0B9670859DAE5"><enum>(ii)</enum><text>in the case of a certification submitted in accordance with subsection (g)(1)(B), the Court shall issue an order directing the Government to, at the Government’s election and to the extent required by the Court’s order—</text> 
<subclause id="HF3EC57F2BFC74DCF8417D4DCD33E19E"><enum>(I)</enum><text>correct any deficiency identified by the Court not later than 30 days after the date the Court issues the order; or</text></subclause> 
<subclause id="HDC57F42EFD5E4DCB88E9AEE55292F572"><enum>(II)</enum><text>cease the acquisition authorized under subsection (g)(1)(B).</text></subclause></clause></subparagraph> 
<subparagraph id="HFC0A2C0BB4A646E893C9CBCE655E934F"><enum>(C)</enum><header>Requirement for written statement</header><text>In support of its orders under this subsection, the Court shall provide, simultaneously with the orders, for the record a written statement of its reasons.</text></subparagraph></paragraph> 
<paragraph id="H7B79293B96964CC48E1D29E3A575875D"><enum>(4)</enum><header>Appeal</header> 
<subparagraph id="H5ED7B2944A59426C8525B49633CB7177"><enum>(A)</enum><header>Appeal to the court of review</header><text>The Government may appeal any order under this section to the Foreign Intelligence Surveillance Court of Review, which shall have jurisdiction to review such order. For any decision affirming, reversing, or modifying an order of the Foreign Intelligence Surveillance Court, the Court of Review shall provide for the record a written statement of its reasons.</text></subparagraph> 
<subparagraph id="HE093938C69B3416C86D4F2241665E3BF"><enum>(B)</enum><header>Continuation of acquisition pending rehearing or appeal</header><text>Any acquisition affected by an order under paragraph (3)(B)(ii) may continue—</text> 
<clause id="HF9761F17CAB545D9A626DC11D0EDA06F"><enum>(i)</enum><text>during the pendency of any rehearing of the order by the Court en banc; and</text></clause> 
<clause id="HCBBD7758293C4AC2A0920004F7B62BD2" commented="no"><enum>(ii)</enum><text>if the Government appeals an order under this section, subject to subparagraph (C), until the Court of Review enters an order under subparagraph (A).</text></clause></subparagraph> 
<subparagraph id="HF0CA65FAA0CF480F89670010114B89FA"><enum>(C)</enum><header>Implementation of emergency authority pending appeal</header><text>Not later than 60 days after the filing of an appeal of an order issued under paragraph (3)(B)(ii) directing the correction of a deficiency, the Court of Review shall determine, and enter a corresponding order regarding whether all or any part of the correction order, as issued or modified, shall be implemented during the pendency of the appeal. The Government shall conduct an acquisition affected by such order issued under paragraph (3)(B)(ii) in accordance with an order issued under this subparagraph or shall cease such acquisition.</text></subparagraph> 
<subparagraph id="HFE8E18857DF94DB197C63E8735601244"><enum>(D)</enum><header>Certiorari to the supreme court</header><text>The Government may file a petition for a writ of certiorari for review of a decision of the Court of Review issued under subparagraph (A). The record for such review shall be transmitted under seal to the Supreme Court of the United States, which shall have jurisdiction to review such decision.</text></subparagraph></paragraph> 
<paragraph id="HA039AC41E1D342EE96EDA04438AE631"><enum>(5)</enum><header>Schedule</header> 
<subparagraph id="H18782F76F688400F802B0378AD42EB1F"><enum>(A)</enum><header>Replacement of authorizations in effect</header><text>If the Attorney General and the Director of National Intelligence seek to replace an authorization issued pursuant to section 105B of the Foreign Intelligence Surveillance Act of 1978, as added by section 2 of the Protect America Act of 2007 (<external-xref legal-doc="public-law" parsable-cite="pl/110/55">Public Law 110–55</external-xref>), the Attorney General and the Director of National Intelligence shall, to the extent practicable, submit to the Court a certification under subsection (g) and the procedures required by subsections (d), (e), and (f) at least 30 days before the expiration of such authorization.</text></subparagraph> 
<subparagraph id="H752AC0C1DA6748388D94F7C277719F00"><enum>(B)</enum><header>Reauthorization of authorizations in effect</header><text>If the Attorney General and the Director of National Intelligence seek to replace an authorization issued pursuant to this section, the Attorney General and the Director of National Intelligence shall, to the extent practicable, submit to the Court a certification under subsection (g) and the procedures required by subsections (d), (e), and (f) at least 30 days prior to the expiration of such authorization.</text></subparagraph> 
<subparagraph id="H2EA31856A79448ADA9CF88CAE6C890D3"><enum>(C)</enum><header>Consolidated submissions</header><text>The Attorney General and Director of National Intelligence shall, to the extent practicable, annually submit to the Court a consolidation of—</text> 
<clause id="H67E91D1C30934F948DE45906911198F2"><enum>(i)</enum><text>certifications under subsection (g) for reauthorization of authorizations in effect;</text></clause> 
<clause id="H51117B6943DD45688E5F243F58E1189C"><enum>(ii)</enum><text>the procedures required by subsections (d), (e), and (f); and</text></clause> 
<clause id="H282F9591C2444D2B8D86F053F0D1EE8C"><enum>(iii) </enum><text>the annual review required by subsection (l)(3) for the preceding year.</text></clause></subparagraph> 
<subparagraph id="H4DA39437D9F541C9AE9846DEF9221A6"><enum>(D)</enum><header>Timing of reviews</header><text>The Attorney General and the Director of National Intelligence shall, to the extent practicable, schedule the completion of the annual review under subsection (l)(3) and a semiannual assessment under subsection (l)(1) so that they may be submitted to the Court at the time of the consolidated submission under subparagraph (C).</text></subparagraph> 
<subparagraph id="H32B8DE6143C54737ADB9DB2F84B941FC"><enum>(E)</enum><header>Construction</header><text>The requirements of subparagraph (C) shall not be construed to preclude the Attorney General and the Director of National Intelligence from submitting certifications for additional authorizations at other times during the year as necessary.</text></subparagraph></paragraph> 
<paragraph id="H762681D34F5940E29400A47503F20573" display-inline="no-display-inline" commented="no"><enum>(6)</enum><header>Compliance</header><text>At or before the end of the period of time for which a certification submitted pursuant to subsection (g) and procedures required by subsection (d) and (e) are approved by an order under this section, the Foreign Intelligence Surveillance Court may assess compliance with the minimization procedures required by subsection (e) by reviewing the circumstances under which information concerning United States persons was acquired, retained, or disseminated.</text></paragraph></subsection> 
<subsection id="H04AACA1E8A0B4CD0AA000340A58174A3"><enum>(j)</enum><header>Judicial Proceedings</header> 
<paragraph id="H22C8F9FAF923418789A6B26FD60888B"><enum>(1)</enum><header>Expedited proceedings</header><text>Judicial proceedings under this section shall be conducted as expeditiously as possible.</text></paragraph> 
<paragraph id="HCDBB941B62964D79B796DF086DCEF85C" commented="no"><enum>(2)</enum><header>Time limits</header><text display-inline="yes-display-inline">A time limit for a judicial decision in this section shall apply unless the Court, the Court of Review, or any judge of either the Court or the Court of Review, by order for reasons stated, extends that time for good cause.</text></paragraph></subsection> 
<subsection id="H284D803B4A2F45649C2B097C1345D86C"><enum>(k)</enum><header>Maintenance and Security of Records and Proceedings</header> 
<paragraph id="H853545B893974BCDB078479735761834"><enum>(1)</enum><header>Standards</header><text>The Foreign Intelligence Surveillance Court shall maintain a record of a proceeding under this section, including petitions filed, orders granted, and statements of reasons for decision, under security measures adopted by the Chief Justice of the United States, in consultation with the Attorney General and the Director of National Intelligence.</text></paragraph> 
<paragraph id="HE78FD10AB1D84BE88C969B15CCD5AE5B"><enum>(2)</enum><header>Filing and review</header><text>All petitions under this section shall be filed under seal. In any proceedings under this section, the court shall, upon request of the Government, review ex parte and in camera any Government submission, or portions of a submission, which may include classified information.</text></paragraph> 
<paragraph id="HD0089669F543417EAF93EDB00228B77B"><enum>(3)</enum><header>Retention of records</header><text>The Director of National Intelligence and the Attorney General shall retain a directive made or an order granted under this section for a period of not less than 10 years from the date on which such directive or such order is made.</text></paragraph></subsection> 
<subsection id="H7D579D5514AD4E0000D100B800AE74F8"><enum>(l)</enum><header>Assessments and Reviews</header> 
<paragraph id="HDC238B767C0C41239973EE00581C95CE"><enum>(1)</enum><header>Semiannual assessment</header><text>Not less frequently than once every 6 months, the Attorney General and Director of National Intelligence shall assess compliance with the procedures and guidelines required by subsections (d), (e), and (f) and shall submit each assessment to—</text> 
<subparagraph id="H98CD3A756CB6495FAE27F947B407E85D"><enum>(A)</enum><text>the congressional intelligence committees;</text></subparagraph> 
<subparagraph id="HEC4BB45435E84B2FB65F8158779B99A5"><enum>(B)</enum><text>the Committees on the Judiciary of the House of Representatives and the Senate; and</text></subparagraph> 
<subparagraph id="HDCEDFC1A47C345F0B0685E7202F0696F"><enum>(C)</enum><text>the Foreign Intelligence Surveillance Court.</text></subparagraph></paragraph> 
<paragraph id="H4AA2999119954B7C9F3F2600C3FB42F3"><enum>(2)</enum><header>Agency assessment</header><text>The Inspectors General of the Department of Justice and of each element of the intelligence community authorized to acquire foreign intelligence information under subsection (a), with respect to such Department or such element—</text> 
<subparagraph id="H07A8DA4F00EE46AA004BDF1CDCB00085"><enum>(A)</enum><text>are authorized to review compliance with the procedures and guidelines required by subsections (d), (e), and (f);</text></subparagraph> 
<subparagraph id="HE1316A24D97548E1A4D278A19C074E26"><enum>(B)</enum><text>with respect to acquisitions authorized under subsection (a), shall review the disseminated intelligence reports containing a reference to a United States person identity and the number of United States person identities subsequently disseminated by the element concerned in response to requests for identities that were not referred to by name or title in the original reporting;</text></subparagraph> 
<subparagraph id="H18C5916C1E274EB9B3498CE16F4B3FD4"><enum>(C)</enum><text>with respect to acquisitions authorized under subsection (a), shall review the targets that were later determined to be located in the United States and, to the extent possible, whether their communications were reviewed; and</text></subparagraph> 
<subparagraph id="HE09E7D71FDFF482B881F21B799B9D269"><enum>(D)</enum><text>shall provide each such review to—</text> 
<clause id="H2CDB2A578F1B452C9D23E575329CB94E"><enum>(i)</enum><text>the Attorney General;</text></clause> 
<clause id="H86CE8ED28DBF43FA9858DDB4E066FD60"><enum>(ii)</enum><text>the Director of National Intelligence;</text></clause> 
<clause id="HF87A957DBE6C409F968B00D9ACE28C05"><enum>(iii)</enum><text>the congressional intelligence committees;</text></clause> 
<clause id="H5279555942994F4686CC96ED110094AF"><enum>(iv)</enum><text>the Committees on the Judiciary of the House of Representatives and the Senate; and</text></clause> 
<clause id="HF5DA7916C0FB4C7D94653FB66E4B2357"><enum>(v)</enum><text>the Foreign Intelligence Surveillance Court.</text></clause></subparagraph></paragraph> 
<paragraph id="H6231BB3985CF4675ABAADCC871D8712"><enum>(3)</enum><header>Annual review</header> 
<subparagraph id="HD4C63E4B22F14C318DDC762E325703A7"><enum>(A)</enum><header>Requirement to conduct</header><text>The head of each element of the intelligence community conducting an acquisition authorized under subsection (a) shall conduct an annual review to determine whether there is reason to believe that foreign intelligence information has been or will be obtained from the acquisition. The annual review shall provide, with respect to such acquisitions authorized under subsection (a)—</text> 
<clause id="H2C3BD707E2AF4E2289BFB622A17CD058"><enum>(i)</enum><text>the number and nature of disseminated intelligence reports containing a reference to a United States person identity;</text></clause> 
<clause id="H758019E271BB4870BD1B92BCF6808238"><enum>(ii)</enum><text>the number and nature of United States person identities subsequently disseminated by that element in response to requests for identities that were not referred to by name or title in the original reporting;</text></clause> 
<clause id="HE09C0DFDA62945D59895A0AB15227145"><enum>(iii)</enum><text>the number of targets that were later determined to be located in the United States and, to the extent possible, whether their communications were reviewed; and</text></clause> 
<clause id="HCCFF181DBD3D41628BF820F85D002104"><enum>(iv)</enum><text>a description of any procedures developed by the head of such element of the intelligence community and approved by the Director of National Intelligence to assess, in a manner consistent with national security, operational requirements and the privacy interests of United States persons, the extent to which the acquisitions authorized under subsection (a) acquire the communications of United States persons, and the results of any such assessment.</text></clause></subparagraph> 
<subparagraph id="H2CF988F0FB9A440195A17F3F8990B527"><enum>(B)</enum><header>Use of review</header><text>The head of each element of the intelligence community that conducts an annual review under subparagraph (A) shall use each such review to evaluate the adequacy of the minimization procedures utilized by such element or the application of the minimization procedures to a particular acquisition authorized under subsection (a).</text></subparagraph> 
<subparagraph id="H127062A5A36940978099117251CE2EE1"><enum>(C)</enum><header>Provision of review</header><text>The head of each element of the intelligence community that conducts an annual review under subparagraph (A) shall provide such review to—</text> 
<clause id="H4A40829F1AEB4231BEF92C8C57E46301"><enum>(i)</enum><text>the Foreign Intelligence Surveillance Court;</text></clause> 
<clause id="HD90529BE69A14DF3B50931CF78E36F78"><enum>(ii)</enum><text>the Attorney General;</text></clause> 
<clause id="HE5D3F268A4F34271A4959BE788EB24C"><enum>(iii)</enum><text>the Director of National Intelligence;</text></clause> 
<clause id="HEE9CC8006C7F446B8758AA7E00F628B9"><enum>(iv)</enum><text>the congressional intelligence committees; and</text></clause> 
<clause id="H4C67F0414F8947838652549C67579392"><enum>(v)</enum><text>the Committees on the Judiciary of the House of Representatives and the Senate.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="H1329520DC6DD416EBBEFA7C273BBBE25"><enum>(m)</enum><header>Construction</header><text>Nothing in this Act shall be construed to require an application under section 104 for an acquisition that is targeted in accordance with this section at a person reasonably believed to be located outside the United States.</text></subsection></section> 
<section id="H4DEC1B7A93944B289800B728636CB8FF"><enum>703.</enum><header>Certain acquisitions inside the United States of United States persons outside the United States</header> 
<subsection id="H1D9F4054FF41422D85C3B19089006621"><enum>(a)</enum><header>Jurisdiction of the Foreign Intelligence Surveillance Court</header> 
<paragraph id="HDBDE31A3D4A1470FB71157D11CEFC2CD"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Foreign Intelligence Surveillance Court shall have jurisdiction to review an application and enter an order approving the targeting of a United States person reasonably believed to be located outside the United States to acquire foreign intelligence information if the acquisition constitutes electronic surveillance or the acquisition of stored electronic communications or stored electronic data that requires an order under this Act and such acquisition is conducted within the United States.</text></paragraph> 
<paragraph id="H1651E9A5EC384C8596A7E85407177371"><enum>(2)</enum><header>Limitation</header><text>If a United States person targeted under this subsection is reasonably believed to be located in the United States during the pendency of an order issued pursuant to subsection (c), such acquisition shall cease unless authority, other than under this section, is obtained pursuant to this Act or the targeted United States person is again reasonably believed to be located outside the United States during the pendency of an order issued pursuant to subsection (c).</text></paragraph></subsection> 
<subsection id="HFEEDA41AC9424191BD86802398235CBC"><enum>(b)</enum><header>Application</header> 
<paragraph id="HAF697BCA0F9B4E040069020054966EE1"><enum>(1)</enum><header>In general</header><text>Each application for an order under this section shall be made by a Federal officer in writing upon oath or affirmation to a judge having jurisdiction under subsection (a)(1). Each application shall require the approval of the Attorney General based upon the Attorney General’s finding that it satisfies the criteria and requirements of such application, as set forth in this section, and shall include—</text> 
<subparagraph id="H33E0DF0610CE499F8D09FDACC8555873"><enum>(A)</enum><text>the identity of the Federal officer making the application;</text></subparagraph> 
<subparagraph id="HB94EA15CEA4E4838901B7631B6576F8B"><enum>(B)</enum><text>the identity, if known, or a description of the United States person who is the target of the acquisition;</text></subparagraph> 
<subparagraph id="HC9A997E15D194C7BBCC9C922C808D02C"><enum>(C)</enum><text>a statement of the facts and circumstances relied upon to justify the applicant’s belief that the United States person who is the target of the acquisition is—</text> 
<clause id="H493291290486479400E492CEC3E92F8D"><enum>(i)</enum><text>a person reasonably believed to be located outside the United States; and</text></clause> 
<clause id="H236D38C9C8054D44B0EBAF002EC96485"><enum>(ii)</enum><text>a foreign power, an agent of a foreign power, or an officer or employee of a foreign power;</text></clause></subparagraph> 
<subparagraph id="HE327A176D46E4557A332BD30E01E3898"><enum>(D)</enum><text>a statement of proposed minimization procedures that—</text> 
<clause id="HA01FD1B66C70445E9DEE8CEB5B039B68"><enum>(i)</enum><text>in the case of electronic surveillance, meet the definition of minimization procedures in section 101(h); and</text></clause> 
<clause id="HD667A8CD1AD545049CD927AB5B83E1E"><enum>(ii)</enum><text>in the case of a physical search, meet the definition of minimization procedures in section 301(4);</text></clause></subparagraph> 
<subparagraph id="H167C8C020A294E268DF17F1487E5DD13"><enum>(E)</enum><text>a description of the nature of the information sought and the type of communications or activities to be subjected to acquisition;</text></subparagraph> 
<subparagraph id="HC87B81D9227C4C11A5EE3EBE2D140740"><enum>(F)</enum><text>a certification made by the Attorney General or an official specified in section 104(a)(6) that—</text> 
<clause id="H1F437E77C41A44FA00D1B31C00274BF"><enum>(i)</enum><text>the certifying official deems the information sought to be foreign intelligence information;</text></clause> 
<clause id="HB2A819AE4D384D0DA1F9998C8563DA3C"><enum>(ii)</enum><text>a significant purpose of the acquisition is to obtain foreign intelligence information;</text></clause> 
<clause id="HE3138445A4B148DD83DA13AADCBB725B"><enum>(iii)</enum><text>such information cannot reasonably be obtained by normal investigative techniques;</text></clause> 
<clause id="H88BB53263D264F43A756B971649E6B03"><enum>(iv)</enum><text>identifies the type of foreign intelligence information being sought according to the categories described in each subparagraph of section 101(e); and</text></clause> 
<clause id="H7A5D47C49D2F479A90EED5289CE9D349"><enum>(v)</enum><text>includes a statement of the basis for the certification that—</text> 
<subclause id="H910BEA69FB4A44CEA8D89800309FE7F4"><enum>(I)</enum><text>the information sought is the type of foreign intelligence information designated; and</text></subclause> 
<subclause id="HC128C3DEA73A4844B8DBA33FE2B1BB9"><enum>(II)</enum><text>such information cannot reasonably be obtained by normal investigative techniques;</text></subclause></clause></subparagraph> 
<subparagraph id="H8C70C86941D14723BAC37CCD87975425"><enum>(G)</enum><text>a summary statement of the means by which the acquisition will be conducted and whether physical entry is required to effect the acquisition;</text></subparagraph> 
<subparagraph id="H52A40698EB50480B87CD05CDA204C7E"><enum>(H)</enum><text>the identity of any electronic communication service provider necessary to effect the acquisition, provided, however, that the application is not required to identify the specific facilities, places, premises, or property at which the acquisition authorized under this section will be directed or conducted;</text></subparagraph> 
<subparagraph id="H0818AAE74B2246EC84C86800F1AF453F"><enum>(I)</enum><text>a statement of the facts concerning any previous applications that have been made to any judge of the Foreign Intelligence Surveillance Court involving the United States person specified in the application and the action taken on each previous application; and</text></subparagraph> 
<subparagraph id="H5D5326BB071242BB8BDC026E7952FA00"><enum>(J)</enum><text>a statement of the period of time for which the acquisition is required to be maintained, provided that such period of time shall not exceed 90 days per application.</text></subparagraph></paragraph> 
<paragraph id="H9D94D941BA3D449884635CA74F20FD1D"><enum>(2)</enum><header>Other requirements of the attorney general</header><text>The Attorney General may require any other affidavit or certification from any other officer in connection with the application.</text></paragraph> 
<paragraph id="H9F1E3436DC86443FAA627F4F8E013BA7"><enum>(3)</enum><header>Other requirements of the judge</header><text>The judge may require the applicant to furnish such other information as may be necessary to make the findings required by subsection (c)(1).</text></paragraph></subsection> 
<subsection id="HB5923075624443488C80062117989D3B"><enum>(c)</enum><header>Order</header> 
<paragraph id="HA24A0376146F4B1A009198965E044C26"><enum>(1)</enum><header>Findings</header><text>Upon an application made pursuant to subsection (b), the Foreign Intelligence Surveillance Court shall enter an ex parte order as requested or as modified by the Court approving the acquisition if the Court finds that—</text> 
<subparagraph id="H889E2D4C085245C3955700D528DC9D7F"><enum>(A)</enum><text>the application has been made by a Federal officer and approved by the Attorney General;</text></subparagraph> 
<subparagraph id="H47566741AA574736B7FC40EAF08034B5"><enum>(B)</enum><text>on the basis of the facts submitted by the applicant, for the United States person who is the target of the acquisition, there is probable cause to believe that the target is—</text> 
<clause id="H264EF2F5D98749C6B600616440714005"><enum>(i)</enum><text>a person reasonably believed to be located outside the United States; and</text></clause> 
<clause id="H1FEF1A64EB1A4C31AAF282ED87E58B21"><enum>(ii)</enum><text>a foreign power, an agent of a foreign power, or an officer or employee of a foreign power;</text></clause></subparagraph> 
<subparagraph id="H1BCFE60498864FD3A01F8ED6D03E1269"><enum>(C)</enum><text>the proposed minimization procedures—</text> 
<clause id="HCCF7C1ED204143868795217BF848AC42"><enum>(i)</enum><text>in the case of electronic surveillance, meet the definition of minimization procedures in section 101(h); and</text></clause> 
<clause id="H923D5BD54737488000DBCA55403C2BC3"><enum>(ii)</enum><text>in the case of a physical search, meet the definition of minimization procedures in section 301(4);</text></clause></subparagraph> 
<subparagraph id="H6F310983EFEE4178BF01181693C0D85F"><enum>(D)</enum><text>the application that has been filed contains all statements and certifications required by subsection (b) and the certification or certifications are not clearly erroneous on the basis of the statement made under subsection (b)(1)(F)(v) and any other information furnished under subsection (b)(3).</text></subparagraph></paragraph> 
<paragraph id="H5ACB34BAE6BA4846A9945300C4BC186C"><enum>(2)</enum><header>Probable cause</header><text>In determining whether or not probable cause exists for purposes of paragraph (1)(B), a judge having jurisdiction under subsection (a)(1) may consider past activities of the target and facts and circumstances relating to current or future activities of the target. No United States person may be considered a foreign power, agent of a foreign power, or officer or employee of a foreign power solely upon the basis of activities protected by the first amendment to the Constitution of the United States.</text></paragraph> 
<paragraph id="HB974648056CC48328559B1D703A112AC"><enum>(3)</enum><header>Review</header> 
<subparagraph id="H11E8F56F21324330908DF87630D91F1B"><enum>(A)</enum><header>Limitation on review</header><text>Review by a judge having jurisdiction under subsection (a)(1) shall be limited to that required to make the findings described in paragraph (1).</text></subparagraph> 
<subparagraph id="H1B7BB82571184CF09DA1FA98BA47CC01"><enum>(B)</enum><header>Review of probable cause</header><text>If the judge determines that the facts submitted under subsection (b) are insufficient to establish probable cause under paragraph (1)(B), the judge shall enter an order so stating and provide a written statement for the record of the reasons for such determination. The Government may appeal an order under this subparagraph pursuant to subsection (f).</text></subparagraph> 
<subparagraph id="HD1AA6B4F14C64929BD13BE7E4600345D"><enum>(C)</enum><header>Review of minimization procedures</header><text>If the judge determines that the proposed minimization procedures referred to in paragraph (1)(C) do not meet the definition of minimization procedures as required under such paragraph the judge shall enter an order so stating and provide a written statement for the record of the reasons for such determination. The Government may appeal an order under this subparagraph pursuant to subsection (f).</text></subparagraph> 
<subparagraph id="HCFE7A7B5629D4F54AC73FFD6B22CF17"><enum>(D)</enum><header>Review of certification</header><text>If the judge determines that an application under subsection (b) does not contain all of the required elements, or that the certification or certifications are clearly erroneous on the basis of the statement made under subsection (b)(1)(F)(v) and any other information furnished under subsection (b)(3), the judge shall enter an order so stating and provide a written statement for the record of the reasons for such determination. The Government may appeal an order under this subparagraph pursuant to subsection (f).</text></subparagraph></paragraph> 
<paragraph id="HD094CB1BD6A74318A394DD46ABBBD954"><enum>(4)</enum><header>Specifications</header><text>An order approving an acquisition under this subsection shall specify—</text> 
<subparagraph id="H9089DF8D004D494FBCB22FA0E949FEAE"><enum>(A)</enum><text>the identity, if known, or a description of the United States person who is the target of the acquisition identified or described in the application pursuant to subsection (b)(1)(B);</text></subparagraph> 
<subparagraph id="H4046E62B1BB9459887B4A5A4FD3DAA8"><enum>(B)</enum><text>if provided in the application pursuant to subsection (b)(1)(H), the nature and location of each of the facilities or places at which the acquisition will be directed;</text></subparagraph> 
<subparagraph id="HA31A61ED24E14E0CB898D4E28B24BBC3"><enum>(C)</enum><text>the nature of the information sought to be acquired and the type of communications or activities to be subjected to acquisition;</text></subparagraph> 
<subparagraph id="H8E523555930649F699D3D5AF58744345"><enum>(D)</enum><text>the means by which the acquisition will be conducted and whether physical entry is required to effect the acquisition; and</text></subparagraph> 
<subparagraph id="HB72412F603564FE995EACFACDF60FDE7"><enum>(E)</enum><text>the period of time during which the acquisition is approved.</text></subparagraph></paragraph> 
<paragraph id="HA3E5DF640B0D40AA87CCD3C312BFDB8E"><enum>(5)</enum><header>Directions</header><text>An order approving an acquisition under this subsection shall direct—</text> 
<subparagraph id="H91BB7337A12E44A18C6127D0326581F2"><enum>(A)</enum><text>that the minimization procedures referred to in paragraph (1)(C), as approved or modified by the Court, be followed;</text></subparagraph> 
<subparagraph id="H36E50A8D73D44AE1BD8617E51DDEF65"><enum>(B)</enum><text>an electronic communication service provider to provide to the Government forthwith all information, facilities, or assistance necessary to accomplish the acquisition authorized under such order in a manner that will protect the secrecy of the acquisition and produce a minimum of interference with the services that such electronic communication service provider is providing to the target of the acquisition;</text></subparagraph> 
<subparagraph id="H85AF66637248490BA0E12D62CBFBFA9B"><enum>(C)</enum><text>an electronic communication service provider to maintain under security procedures approved by the Attorney General any records concerning the acquisition or the aid furnished that such electronic communication service provider wishes to maintain; and</text></subparagraph> 
<subparagraph id="H1B0250E6089A4D5792F976CFDED4E1D4"><enum>(D)</enum><text>that the Government compensate, at the prevailing rate, such electronic communication service provider for providing such information, facilities, or assistance.</text></subparagraph></paragraph> 
<paragraph id="HF61F4481B9604D2BB113BBF12F75DAFF"><enum>(6)</enum><header>Duration</header><text>An order approved under this subsection shall be effective for a period not to exceed 90 days and such order may be renewed for additional 90-day periods upon submission of renewal applications meeting the requirements of subsection (b).</text></paragraph> 
<paragraph id="H54583FF3440E4B78AD6CC050950330D8"><enum>(7)</enum><header>Compliance</header><text>At or prior to the end of the period of time for which an acquisition is approved by an order or extension under this section, the judge may assess compliance with the minimization procedures referred to in paragraph (1)(C) by reviewing the circumstances under which information concerning United States persons was acquired, retained, or disseminated.</text></paragraph></subsection> 
<subsection id="HB0AA76017C344F149267003D1100A2B"><enum>(d)</enum><header>Emergency Authorization</header> 
<paragraph id="H4EB21E3A293B4577840698CC5932AA19"><enum>(1)</enum><header>Authority for emergency authorization</header><text>Notwithstanding any other provision of this Act, if the Attorney General reasonably determines that—</text> 
<subparagraph id="H5BB4E21E10D54DE7BA61B734DB9FA873"><enum>(A)</enum><text>an emergency situation exists with respect to the acquisition of foreign intelligence information for which an order may be obtained under subsection (c) before an order authorizing such acquisition can with due diligence be obtained, and</text></subparagraph> 
<subparagraph id="HD3B91DE32CBE4731B48787363F1FB7B6"><enum>(B)</enum><text>the factual basis for issuance of an order under this subsection to approve such acquisition exists, </text></subparagraph><continuation-text continuation-text-level="paragraph">the Attorney General may authorize such acquisition if a judge having jurisdiction under subsection (a)(1) is informed by the Attorney General, or a designee of the Attorney General, at the time of such authorization that the decision has been made to conduct such acquisition and if an application in accordance with this section is made to a judge of the Foreign Intelligence Surveillance Court as soon as practicable, but not more than 7 days after the Attorney General authorizes such acquisition.</continuation-text></paragraph> 
<paragraph id="H0C92EAF0EEBA4E4EBDB2C8927559E794"><enum>(2)</enum><header>Minimization procedures</header><text>If the Attorney General authorizes an acquisition under paragraph (1), the Attorney General shall require that the minimization procedures referred to in subsection (c)(1)(C) for the issuance of a judicial order be followed.</text></paragraph> 
<paragraph id="HAF5E602903694D82B3D74B665E27D5E9"><enum>(3)</enum><header>Termination of emergency authorization</header><text>In the absence of a judicial order approving an acquisition authorized under paragraph (1), such acquisition shall terminate when the information sought is obtained, when the application for the order is denied, or after the expiration of 7 days from the time of authorization by the Attorney General, whichever is earliest.</text></paragraph> 
<paragraph id="H3C8BB220504F44248DAEDF55E339C18E" commented="no"><enum>(4)</enum><header>Use of information</header><text>If an application for approval submitted pursuant to paragraph (1) is denied, or in any other case where the acquisition is terminated and no order is issued approving the acquisition, no information obtained or evidence derived from such acquisition, except under circumstances in which the target of the acquisition is determined not to be a United States person, shall be received in evidence or otherwise disclosed in any trial, hearing, or other proceeding in or before any court, grand jury, department, office, agency, regulatory body, legislative committee, or other authority of the United States, a State, or political subdivision thereof, and no information concerning any United States person acquired from such acquisition shall subsequently be used or disclosed in any other manner by Federal officers or employees without the consent of such person, except with the approval of the Attorney General if the information indicates a threat of death or serious bodily harm to any person.</text></paragraph></subsection> 
<subsection id="HD54B7944ABD14472A6D3FBC1EF2FE19E"><enum>(e)</enum><header>Release from liability</header><text>Notwithstanding any other provision of law, no cause of action shall lie in any court against any electronic communication service provider for providing any information, facilities, or assistance in accordance with an order or request for emergency assistance issued pursuant to subsection (c) or (d).</text></subsection> 
<subsection id="HB631E3FBD0DA4EF4A91D75DFE7D88C40"><enum>(f)</enum><header>Appeal</header> 
<paragraph id="H94A73AE815344664857C813490274B60"><enum>(1)</enum><header>Appeal to the Foreign Intelligence Surveillance Court of review</header><text>The Government may file an appeal with the Foreign Intelligence Surveillance Court of Review for review of an order issued pursuant to subsection (c). The Court of Review shall have jurisdiction to consider such appeal and shall provide a written statement for the record of the reasons for a decision under this paragraph.</text></paragraph> 
<paragraph id="H7087F5E40404477195C92EC75D93673"><enum>(2)</enum><header>Certiorari to the Supreme Court</header><text>The Government may file a petition for a writ of certiorari for review of a decision of the Court of Review under paragraph (1). The record for such review shall be transmitted under seal to the Supreme Court of the United States, which shall have jurisdiction to review such decision.</text></paragraph></subsection> 
<subsection id="H061BA85968804E24945E7EA2C42CFFAE"><enum>(g)</enum><header>Construction</header><text>Nothing in this Act shall be construed to require an application under section 104 for an acquisition that is targeted in accordance with this section at a person reasonably believed to be located outside the United States.</text></subsection></section> 
<section id="HBBF80C5710634F3EB80004192500A0B0"><enum>704.</enum><header>Other acquisitions targeting United States persons outside the United States</header> 
<subsection id="H0E4EDA5603C3420BA37FDBE392C56F6"><enum>(a)</enum><header>Jurisdiction and Scope</header> 
<paragraph id="HDF78313443794C2E94FDEFB092EDD959"><enum>(1)</enum><header>Jurisdiction</header><text>The Foreign Intelligence Surveillance Court shall have jurisdiction to enter an order pursuant to subsection (c).</text></paragraph> 
<paragraph id="H75B5457A3B954BE5B2B89E186534F434"><enum>(2)</enum><header>Scope</header><text>No department or agency of the Federal Government may intentionally target, for the purpose of acquiring foreign intelligence information, a United States person reasonably believed to be located outside the United States under circumstances in which the targeted United States person has a reasonable expectation of privacy and a warrant would be required if the acquisition were conducted inside the United States for law enforcement purposes, unless a judge of the Foreign Intelligence Surveillance Court has entered an order with respect to such targeted United States person or the Attorney General has authorized an emergency acquisition pursuant to subsection (c) or (d) or any other provision of this Act.</text></paragraph> 
<paragraph id="H6826E234801B40B68F4286E38E8DE44B"><enum>(3)</enum><header>Limitations</header> 
<subparagraph id="H4AC56C14FFDA4C9C9500E4034D314697"><enum>(A)</enum><header>Moving or misidentified targets</header><text>If a targeted United States person is reasonably believed to be in the United States during the pendency of an order issued pursuant to subsection (c), acquisitions relating to such targeted United States Person shall cease unless authority is obtained pursuant to this Act or the targeted United States person is again reasonably believed to be located outside the United States during the pendency of such order.</text></subparagraph> 
<subparagraph id="H339B774CECE746ABBDDE741200C63248" commented="no"><enum>(B)</enum><header>Applicability</header><text display-inline="yes-display-inline">If an acquisition is to be conducted inside the United States and could be authorized under section 703, the acquisition may only be conducted if authorized under section 703 or in accordance with another provision of this Act other than this section.</text></subparagraph></paragraph></subsection> 
<subsection id="HA63FDAD7CD354A76A09FAA781CC31C20"><enum>(b)</enum><header>Application</header><text>Each application for an order under this section shall be made by a Federal officer in writing upon oath or affirmation to a judge having jurisdiction under subsection (a)(1). Each application shall require the approval of the Attorney General based upon the Attorney General’s finding that it satisfies the criteria and requirements of such application as set forth in this section and shall include—</text> 
<paragraph id="HD2B77BBEE30943FE8009BA9BAEB3A592"><enum>(1)</enum><text>the identity of the Federal officer making the application;</text></paragraph> 
<paragraph id="H417361681FF14F15A77B5C59738704CB"><enum>(2)</enum><text>the identity, if known, or a description of the specific United States person who is the target of the acquisition;</text></paragraph> 
<paragraph id="HCBB0AA4483684DD0984C56C900C29CE6"><enum>(3)</enum><text>a statement of the facts and circumstances relied upon to justify the applicant’s belief that the United States person who is the target of the acquisition is—</text> 
<subparagraph id="H549F98FEB5C54046ADC96DA8456513D"><enum>(A)</enum><text>a person reasonably believed to be located outside the United States; and</text></subparagraph> 
<subparagraph id="H0773EB6C3061438BBDDB72F7E9B93DC9"><enum>(B)</enum><text>a foreign power, an agent of a foreign power, or an officer or employee of a foreign power;</text></subparagraph></paragraph> 
<paragraph id="HE6A65CE9662E4CA89EC6A503E55D520"><enum>(4)</enum><text>a statement of proposed minimization procedures that—</text> 
<subparagraph id="HD48D3F44E244402788633F57007FE266"><enum>(A)</enum><text>in the case of electronic surveillance, meet the definition of minimization procedures in section 101(h); and</text></subparagraph> 
<subparagraph id="HE4B692B965264FB38406695C28F6500"><enum>(B)</enum><text>in the case of a physical search, meet the definition of minimization procedures in section 301(4);</text></subparagraph></paragraph> 
<paragraph id="HFA20E99408D543A8B758EDBAD2AA2E66"><enum>(5)</enum><text>a certification made by the Attorney General, an official specified in section 104(a)(6), or the head of an element of the intelligence community that—</text> 
<subparagraph id="HFBCF83CCB3A34AACAB64FE8C37155B27"><enum>(A)</enum><text>the certifying official deems the information sought to be foreign intelligence information; and</text></subparagraph> 
<subparagraph id="HC3291D47E5304B4FBF76FBB85FCACF81"><enum>(B)</enum><text>a significant purpose of the acquisition is to obtain foreign intelligence information;</text></subparagraph></paragraph> 
<paragraph id="H4A1C4E98884C4A26866972B0AAD33E37"><enum>(6)</enum><text>a statement of the facts concerning any previous applications that have been made to any judge of the Foreign Intelligence Surveillance Court involving the United States person specified in the application and the action taken on each previous application; and</text></paragraph> 
<paragraph id="H8209FF40AB544D19A10596239E15644D"><enum>(7)</enum><text>a statement of the period of time for which the acquisition is required to be maintained, provided that such period of time shall not exceed 90 days per application.</text></paragraph></subsection> 
<subsection id="H241A455AE01145E98422EFD3387784C6"><enum>(c)</enum><header>Order</header> 
<paragraph id="H3E53EDB6206B40A2B9C221DC1D6FADB0" commented="no"><enum>(1)</enum><header>Findings</header><text>Upon an application made pursuant to subsection (b), the Foreign Intelligence Surveillance Court shall enter an ex parte order as requested or as modified by the Court if the Court finds that—</text> 
<subparagraph id="H9C0FA75F2BE54621B99CCFB3E5A21683" commented="no"><enum>(A)</enum><text>the application has been made by a Federal officer and approved by the Attorney General;</text></subparagraph> 
<subparagraph id="H3CBBB346BFB2494AA16965CF46D0F046" commented="no"><enum>(B)</enum><text>on the basis of the facts submitted by the applicant, for the United States person who is the target of the acquisition, there is probable cause to believe that the target is—</text> 
<clause id="H51E6FF2F3DC34B169BB39FC4EE7F7D18" commented="no"><enum>(i)</enum><text>a person reasonably believed to be located outside the United States; and</text></clause> 
<clause id="H69F1FA012591488F8BCB5D3383420044" commented="no"><enum>(ii)</enum><text>a foreign power, an agent of a foreign power, or an officer or employee of a foreign power;</text></clause></subparagraph> 
<subparagraph id="HFA3386A604BF4BFC82DA8B24C108E0D" display-inline="no-display-inline" commented="no"><enum>(C)</enum><text>the proposed minimization procedures—</text> 
<clause id="H610E78907B2942B68584B13FAED100FC" commented="no"><enum>(i)</enum><text>in the case of electronic surveillance, meet the definition of minimization procedures in section 101(h); and</text></clause> 
<clause id="HE52E2487ABC24DFDBF381971A02C34A2" commented="no"><enum>(ii)</enum><text>in the case of a physical search, meet the definition of minimization procedures in section 301(4);</text></clause></subparagraph> 
<subparagraph id="HAA1A96656EA6419F805EB662E43B231" commented="no"><enum>(D)</enum><text>the application that has been filed contains all statements and certifications required by subsection (b) and the certification provided under subsection (b)(5) is not clearly erroneous on the basis of the information furnished under subsection (b).</text></subparagraph></paragraph> 
<paragraph id="H8DA588A500FA4F469EEA801C3328A6A1"><enum>(2)</enum><header>Probable cause</header><text>In determining whether or not probable cause exists for purposes of an order under paragraph (1)(B), a judge having jurisdiction under subsection (a)(1) may consider past activities of the target and facts and circumstances relating to current or future activities of the target. No United States person may be considered a foreign power, agent of a foreign power, or officer or employee of a foreign power solely upon the basis of activities protected by the first amendment to the Constitution of the United States.</text></paragraph> 
<paragraph id="HB079706FA1BF4A71B2E209C58DA6005E"><enum>(3)</enum><header>Review</header> 
<subparagraph id="H4EEE07C7001047F3AE471D3ED033FE16"><enum>(A)</enum><header>Limitations on review</header><text>Review by a judge having jurisdiction under subsection (a)(1) shall be limited to that required to make the findings described in paragraph (1). The judge shall not have jurisdiction to review the means by which an acquisition under this section may be conducted.</text></subparagraph> 
<subparagraph id="H36055371D5194D50A9697C12D9048117"><enum>(B)</enum><header>Review of probable cause</header><text>If the judge determines that the facts submitted under subsection (b) are insufficient to establish probable cause under paragraph (1)(B), the judge shall enter an order so stating and provide a written statement for the record of the reasons for such determination. The Government may appeal an order under this clause pursuant to subsection (e).</text></subparagraph> 
<subparagraph id="HDA97DD6A267A4A68B97C6D74FDC94B51"><enum>(C)</enum><header>Review of minimization procedures</header><text display-inline="yes-display-inline">If the judge determines that the proposed minimization procedures referred to in paragraph (1)(C) do not meet the definition of minimization procedures as required under such paragraph, the judge shall enter an order so stating and provide a written statement for the record of the reasons for such determination. The Government may appeal an order under this clause pursuant to subsection (e).</text></subparagraph> 
<subparagraph id="H191DD5E121EE4EA38F5922B7DAC2A9B7"><enum>(D)</enum><header>Scope of review of certification</header><text>If the judge determines that an application under subsection (b) does not contain all the required elements, or that the certification provided under subsection (b)(5) is clearly erroneous on the basis of the information furnished under subsection (b), the judge shall enter an order so stating and provide a written statement for the record of the reasons for such determination. The Government may appeal an order under this clause pursuant to subsection (e).</text></subparagraph></paragraph> 
<paragraph id="H6143A6BB1BF64FF79829FBDAFB52D7C1"><enum>(4)</enum><header>Duration</header><text>An order under this paragraph shall be effective for a period not to exceed 90 days and such order may be renewed for additional 90-day periods upon submission of renewal applications meeting the requirements of subsection (b).</text></paragraph> 
<paragraph id="H9A7BEA8A0D21418B8704F38360DE3F55"><enum>(5)</enum><header>Compliance</header><text>At or prior to the end of the period of time for which an order or extension is granted under this section, the judge may assess compliance with the minimization procedures referred to in paragraph (1)(C) by reviewing the circumstances under which information concerning United States persons was disseminated, provided that the judge may not inquire into the circumstances relating to the conduct of the acquisition.</text></paragraph></subsection> 
<subsection id="H6CB13E1281B0493BA2D228CDB4F2DDC5"><enum>(d)</enum><header>Emergency Authorization</header> 
<paragraph id="H9D45E3D758404CA598005667FC791881"><enum>(1)</enum><header>Authority for emergency authorization</header><text>Notwithstanding any other provision of this section, if the Attorney General reasonably determines that—</text> 
<subparagraph id="H2C283D070E3A46139CC201984BFC74D"><enum>(A)</enum><text>an emergency situation exists with respect to the acquisition of foreign intelligence information for which an order may be obtained under subsection (c) before an order under that subsection may, with due diligence, be obtained, and</text></subparagraph> 
<subparagraph id="HB192C26ABBC242B3B24587E2BBA6F052"><enum>(B)</enum><text>the factual basis for the issuance of an order under this section exists, </text></subparagraph><continuation-text continuation-text-level="paragraph">the Attorney General may authorize such acquisition if a judge having jurisdiction under subsection (a)(1) is informed by the Attorney General or a designee of the Attorney General at the time of such authorization that the decision has been made to conduct such acquisition and if an application in accordance with this section is made to a judge of the Foreign Intelligence Surveillance Court as soon as practicable, but not more than 7 days after the Attorney General authorizes such acquisition.</continuation-text></paragraph> 
<paragraph id="H48A2BEB0099D488BAE963355DDBF9B06"><enum>(2)</enum><header>Minimization procedures</header><text>If the Attorney General authorizes an emergency acquisition under paragraph (1), the Attorney General shall require that the minimization procedures referred to in subsection (c)(1)(C) be followed.</text></paragraph> 
<paragraph id="H6C351EE138964F22879D2395F600F4A"><enum>(3)</enum><header>Termination of emergency authorization</header><text>In the absence of an order under subsection (c), the acquisition authorized under paragraph (1) shall terminate when the information sought is obtained, if the application for the order is denied, or after the expiration of 7 days from the time of authorization by the Attorney General, whichever is earliest.</text></paragraph> 
<paragraph id="H346C80C4666A448100966F9E98FA7600"><enum>(4)</enum><header>Use of information</header><text>If an application submitted pursuant to paragraph (1) is denied, or in any other case where an acquisition under this section is terminated and no order with respect to the target of the acquisition is issued under subsection (c), no information obtained or evidence derived from such acquisition, except under circumstances in which the target of the acquisition is determined not to be a United States person, shall be received in evidence or otherwise disclosed in any trial, hearing, or other proceeding in or before any court, grand jury, department, office, agency, regulatory body, legislative committee, or other authority of the United States, a State, or political subdivision thereof, and no information concerning any United States person acquired from such acquisition shall subsequently be used or disclosed in any other manner by Federal officers or employees without the consent of such person, except with the approval of the Attorney General if the information indicates a threat of death or serious bodily harm to any person.</text></paragraph></subsection> 
<subsection id="H12A2E95621714A41A8B33B0529D400AB"><enum>(e)</enum><header>Appeal</header> 
<paragraph id="H1D486A19083F410B96FD95F51B40AE17"><enum>(1)</enum><header>Appeal to the court of review</header><text>The Government may file an appeal with the Foreign Intelligence Surveillance Court of Review for review of an order issued pursuant to subsection (c). The Court of Review shall have jurisdiction to consider such appeal and shall provide a written statement for the record of the reasons for a decision under this paragraph.</text></paragraph> 
<paragraph id="H228653E5D7794A959CAB59AB5CFD8449"><enum>(2)</enum><header>Certiorari to the supreme court</header><text>The Government may file a petition for a writ of certiorari for review of a decision of the Court of Review issued under paragraph (1). The record for such review shall be transmitted under seal to the Supreme Court of the United States, which shall have jurisdiction to review such decision.</text></paragraph></subsection></section> 
<section id="HC68D13CDFE2B4C778933C296794EB987"><enum>705.</enum><header>Joint applications and concurrent authorizations</header> 
<subsection id="HCEA437D3508C4ADFA478BC08555F54A6"><enum>(a)</enum><header>Joint applications and orders</header><text>If an acquisition targeting a United States person under section 703 or section 704 is proposed to be conducted both inside and outside the United States, a judge having jurisdiction under section 703(a)(1) or section 704(a)(1) may issue simultaneously, upon the request of the Government in a joint application complying with the requirements of section 703(b) and section 704(b), orders under section 703(c) and section 704(c), as appropriate.</text></subsection> 
<subsection id="H3683FDD081994E47A822E5327674D07"><enum>(b)</enum><header>Concurrent authorization</header> 
<paragraph id="H38D0C585A2B9469489E517A869D188ED"><enum>(1)</enum><header>Electronic surveillance</header><text>If an order authorizing electronic surveillance has been obtained under section 105 and that order is still in effect, during the pendency of that order the Attorney General may authorize, without an order under section 703 or 704, electronic surveillance for the purpose of acquiring foreign intelligence information targeting that United States person while such person is reasonably believed to be located outside the United States.</text></paragraph> 
<paragraph id="H27B19FF80A804F7B81BFE9D0CA46D0FC"><enum>(2)</enum><header>Physical search</header><text display-inline="yes-display-inline">If an order authorizing a physical search has been obtained under section 304 and that order is still in effect, during the pendency of that order the Attorney General may authorize, without an order under section 703 or 704, a physical search for the purpose of acquiring foreign intelligence information targeting that United States person while such person is reasonably believed to be located outside the United States.</text></paragraph></subsection></section> 
<section id="H61C6BC94AB6842809995E9E9F6335DC8"><enum>706.</enum><header>Use of information acquired under title VII</header><text display-inline="no-display-inline">Information acquired pursuant to section 702 or 703 shall be considered information acquired from an electronic surveillance pursuant to title I for purposes of section 106.</text></section> 
<section id="HDB67CD08F2A3484D92C2B376EE41D07F"><enum>707.</enum><header>Congressional oversight</header> 
<subsection id="H38F7D10C50A44AE1873128687C7C7832"><enum>(a)</enum><header>Semiannual report</header><text>Not less frequently than once every 6 months, the Attorney General shall fully inform, in a manner consistent with national security, the congressional intelligence committees and the Committees on the Judiciary of the Senate and the House of Representatives, concerning the implementation of this title.</text></subsection> 
<subsection id="H6BD6AA1B014B41F4A669B476972CFBBA"><enum>(b)</enum><header>Content</header><text>Each report made under subsection (a) shall include—</text> 
<paragraph id="HAF42350082A64A9F97C6F0A31EABCC16"><enum>(1)</enum><text>with respect to section 702—</text> 
<subparagraph id="HF47C0689360E49BB82A1F4F6F6288530"><enum>(A)</enum><text>any certifications made under section 702(g) during the reporting period;</text></subparagraph> 
<subparagraph id="HD97CA82BE1BD4278A6754E831B679BE3"><enum>(B)</enum><text>with respect to each certification made under paragraph (1)(B) of such section, the reasons for exercising the authority under such paragraph;</text></subparagraph> 
<subparagraph id="HB3B9CB2EE3354ED2B6312581A980B276"><enum>(C)</enum><text>any directives issued under section 702(h) during the reporting period;</text></subparagraph> 
<subparagraph id="H9D862E6D1A7D466100077413F27DBD3F"><enum>(D)</enum><text>a description of the judicial review during the reporting period of any such certifications and targeting and minimization procedures adopted pursuant to subsections (d) and (e) of section 702 utilized with respect to such acquisition, including a copy of any order or pleading in connection with such review that contains a significant legal interpretation of the provisions of section 702;</text></subparagraph> 
<subparagraph id="H88BB49B0FF6642BC991B9B00E9DBFBE1"><enum>(E)</enum><text>any actions taken to challenge or enforce a directive under paragraph (4) or (5) of section 702(h);</text></subparagraph> 
<subparagraph id="H2A3A90C3CF584B8C98AC34427420313C"><enum>(F)</enum><text>any compliance reviews conducted by the Attorney General or the Director of National Intelligence of acquisitions authorized under subsection 702(a);</text></subparagraph> 
<subparagraph id="H0B0B3732E6DC4524A858E8A3B6B52079"><enum>(G)</enum><text>a description of any incidents of noncompliance with a directive issued by the Attorney General and the Director of National Intelligence under subsection 702(h), including—</text> 
<clause id="H9F124AC5F6424FD29DFF312613EDD49E"><enum>(i)</enum><text>incidents of noncompliance by an element of the intelligence community with procedures and guidelines adopted pursuant to subsections (d), (e), and (f) of section 702; and</text></clause> 
<clause id="H8BA53F98067F4C5384C5EDFDFD51F800"><enum>(ii)</enum><text>incidents of noncompliance by a specified person to whom the Attorney General and Director of National Intelligence issued a directive under subsection 702(h); and</text></clause></subparagraph> 
<subparagraph id="H8E19ABE971D84A349E509E71F9921D8"><enum>(H)</enum><text>any procedures implementing section 702;</text></subparagraph></paragraph> 
<paragraph id="HBBA9BD24E5D94BF283002601A1607559"><enum>(2)</enum><text>with respect to section 703—</text> 
<subparagraph id="HEC3A738260F846DC85FD64843FDDB4D4"><enum>(A)</enum><text>the total number of applications made for orders under section 703(b);</text></subparagraph> 
<subparagraph id="H73E9604AE3A0483581CD296000A798BA"><enum>(B)</enum><text>the total number of such orders—</text> 
<clause id="HF5745281FD304E46802FE62306A87213"><enum>(i)</enum><text>granted;</text></clause> 
<clause id="H4E5B968F91564074A98400813E9B3B55"><enum>(ii)</enum><text>modified; or</text></clause> 
<clause id="H407328916A404AE997CFDC008EFDE293"><enum>(iii)</enum><text>denied; and</text></clause></subparagraph> 
<subparagraph id="H7055D9C7FFD84973972020238D457B5C"><enum>(C)</enum><text>the total number of emergency acquisitions authorized by the Attorney General under section 703(d) and the total number of subsequent orders approving or denying such acquisitions; and</text></subparagraph></paragraph> 
<paragraph id="H0AC9139035DC4CA984B2127200D24189"><enum>(3)</enum><text>with respect to section 704—</text> 
<subparagraph id="HF80EB34BD31843889287D6BC595EAAB0"><enum>(A)</enum><text>the total number of applications made for orders under 704(b);</text></subparagraph> 
<subparagraph id="H1C73A95383064093AECDF66F789E30FD"><enum>(B)</enum><text>the total number of such orders—</text> 
<clause id="H0E1ECB343807417FA78B2887BA379121"><enum>(i)</enum><text>granted;</text></clause> 
<clause id="HB9568F5BF573404199B37FA40A1C1E"><enum>(ii)</enum><text>modified; or</text></clause> 
<clause id="HF97C4B9F015146289BDEAB521593B3"><enum>(iii)</enum><text>denied; and</text></clause></subparagraph> 
<subparagraph id="H0291049D82444AB3AB1F17F39EEB3881"><enum>(C)</enum><text>the total number of emergency acquisitions authorized by the Attorney General under subsection 704(d) and the total number of subsequent orders approving or denying such applications.</text></subparagraph></paragraph></subsection></section> 
<section id="H1AAF1A75AD4547A6B8467EF8009878FA" section-type="subsequent-section" display-inline="no-display-inline"><enum>708.</enum><header>Savings provision</header><text display-inline="no-display-inline">Nothing in this title shall be construed to limit the authority of the Federal Government to seek an order or authorization under, or otherwise engage in any activity that is authorized under, any other title of this Act.</text></section></title><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>

<subsection id="HE542C399E33744C783FB144E2757E841"><enum>(d)</enum><header>Protection of national security</header><text>The Attorney General, in consultation with the Director of National Intelligence, may authorize redactions of materials described in subsection (c) that are provided to the committees of Congress referred to in subsection (a), if such redactions are necessary to protect the national security of the United States and are limited to sensitive sources and methods information or the identities of targets.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<subparagraph id="H95F752B5B4B64954836790E4EF51C48F"><enum>(A)</enum><text>reasonably determines that an emergency situation exists with respect to the employment of electronic surveillance to obtain foreign intelligence information before an order authorizing such surveillance can with due diligence be obtained;</text></subparagraph> 
<subparagraph id="H29B6A063827D4717B99B29B203CF7B4E"><enum>(B)</enum><text>reasonably determines that the factual basis for the issuance of an order under this title to approve such electronic surveillance exists;</text></subparagraph> 
<subparagraph id="H292EC5649310408DAA08D93941B600D7"><enum>(C)</enum><text>informs, either personally or through a designee, a judge having jurisdiction under section 103 at the time of such authorization that the decision has been made to employ emergency electronic surveillance; and</text></subparagraph> 
<subparagraph id="H0AB28343C0D849CABF9E50C7C75B6DA"><enum>(D)</enum><text>makes an application in accordance with this title to a judge having jurisdiction under section 103 as soon as practicable, but not later than 7 days after the Attorney General authorizes such surveillance.</text></subparagraph></paragraph> 
<paragraph id="HF2AC0A6C87644A39A8D3D7272371175D"><enum>(2)</enum><text>If the Attorney General authorizes the emergency employment of electronic surveillance under paragraph (1), the Attorney General shall require that the minimization procedures required by this title for the issuance of a judicial order be followed.</text></paragraph> 
<paragraph id="HEB1A5D03B87946E68F166B6F4ED66DDA"><enum>(3)</enum><text>In the absence of a judicial order approving such electronic surveillance, the surveillance shall terminate when the information sought is obtained, when the application for the order is denied, or after the expiration of 7 days from the time of authorization by the Attorney General, whichever is earliest.</text></paragraph> 
<paragraph id="H33C0FDD4510843E28511EC56E2D7C434"><enum>(4)</enum><text>A denial of the application made under this subsection may be reviewed as provided in section 103.</text></paragraph> 
<paragraph id="H744C89095EFF4BCDAF03354EACB0AEFE"><enum>(5)</enum><text>In the event that such application for approval is denied, or in any other case where the electronic surveillance is terminated and no order is issued approving the surveillance, no information obtained or evidence derived from such surveillance shall be received in evidence or otherwise disclosed in any trial, hearing, or other proceeding in or before any court, grand jury, department, office, agency, regulatory body, legislative committee, or other authority of the United States, a State, or political subdivision thereof, and no information concerning any United States person acquired from such surveillance shall subsequently be used or disclosed in any other manner by Federal officers or employees without the consent of such person, except with the approval of the Attorney General if the information indicates a threat of death or serious bodily harm to any person.</text></paragraph> 
<paragraph id="H5B9A5D2C13214EC48E0050C2DCFC80F7"><enum>(6)</enum><text>The Attorney General shall assess compliance with the requirements of paragraph (5).</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H2E4C12F6179A471ABD3C7BF29253A1C2"><enum>(7)</enum><text>by adding at the end the following:</text>

<subsection id="H02F188E261CD4BFC8F9D7402DED3957B"><enum>(i)</enum><text>In any case in which the Government makes an application to a judge under this title to conduct electronic surveillance involving communications and the judge grants such application, upon the request of the applicant, the judge shall also authorize the installation and use of pen registers and trap and trace devices, and direct the disclosure of the information set forth in section 402(d)(2).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HF002EA9F632E4255B71C1651C00C209"><enum>106.</enum><header>Use of information</header><text display-inline="no-display-inline">Subsection (i) of section 106 of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/8/1806">8 U.S.C. 1806</external-xref>) is amended by striking <quote>radio communication</quote> and inserting <quote>communication</quote>.</text></section>

<subparagraph id="H345B783AD7AB4E559671909E589DC335"><enum>(B)</enum><text>reasonably determines that the factual basis for issuance of an order under this title to approve such physical search exists;</text></subparagraph> 
<subparagraph id="HA63B5A899CCD41D28C5269C86F8910FF"><enum>(C)</enum><text>informs, either personally or through a designee, a judge of the Foreign Intelligence Surveillance Court at the time of such authorization that the decision has been made to employ an emergency physical search; and</text></subparagraph> 
<subparagraph id="H3D780462ACDF4B399F62CC9D6C6F5BA4"><enum>(D)</enum><text>makes an application in accordance with this title to a judge of the Foreign Intelligence Surveillance Court as soon as practicable, but not more than 7 days after the Attorney General authorizes such physical search.</text></subparagraph></paragraph> 
<paragraph id="HB13B2FD1585049E7A8FE18135807373E"><enum>(2)</enum><text>If the Attorney General authorizes the emergency employment of a physical search under paragraph (1), the Attorney General shall require that the minimization procedures required by this title for the issuance of a judicial order be followed.</text></paragraph>

<subsection id="H4E834EAD4C4E4C968FF6237D5F5F9DB0" display-inline="no-display-inline" commented="no"><enum>(b)</enum><header>En banc authority</header> 
<paragraph id="H8CC8A5FB05F8459CB6073CD67520FD01" commented="no"><enum>(1)</enum><header>In general</header><text>Subsection (a) of section 103 of the Foreign Intelligence Surveillance Act of 1978, as amended by subsection (a) of this section, is further amended—</text> 
<subparagraph id="HED0211B07ED145FF91A1457E5EF400A5" commented="no"><enum>(A)</enum><text>by inserting <quote>(1)</quote> after <quote>(a)</quote>; and</text></subparagraph> 
<subparagraph id="H32EE259A00B241A998096F91666072D7" commented="no"><enum>(B)</enum><text>by adding at the end the following new paragraph:</text>

<paragraph id="H9EEC874C30A94E63808E00DAB1DA738" indent="up1" commented="no"><enum>(2)</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="H76871583321940C9B7D24838C3D000DF"><enum>(A)</enum><text>The court established under this subsection, on its own initiative or upon the request of the Government in any proceeding or a party under section 501(f) or paragraph (4) or (5) of section 703(h), may hold a hearing or rehearing, en banc, when ordered by a majority of the judges that constitute such court upon a determination that—</text> 
<clause id="HF290B4079E094822801BDB05CACBF69E" indent="up1" commented="no"><enum>(i)</enum><text>en banc consideration is necessary to secure or maintain uniformity of the court's decisions; or</text></clause> 
<clause id="HBD8A269307FA4E13BCF0CCD6E4DEA1BA" indent="up1" commented="no"><enum>(ii)</enum><text>the proceeding involves a question of exceptional importance.</text></clause></subparagraph> 
<subparagraph id="H03DC7325CEF044E48630AE5C66DD7791" indent="up1" commented="no"><enum>(B)</enum><text>Any authority granted by this Act to a judge of the court established under this subsection may be exercised by the court en banc. When exercising such authority, the court en banc shall comply with any requirements of this Act on the exercise of such authority.</text></subparagraph> 
<subparagraph id="H9545E5863E7D4CACB5E69B58D7B3836" indent="up1" commented="no"><enum>(C)</enum><text>For purposes of this paragraph, the court en banc shall consist of all judges who constitute the court established under this subsection.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H64B586F496B24CEAA0E419EA6183489C" commented="no"><enum>(2)</enum><header>Conforming amendments</header><text>The Foreign Intelligence Surveillance Act of 1978 is further amended—</text> 
<subparagraph id="H66658C7F10274757A0F9DEA819A5834B" commented="no"><enum>(A)</enum><text>in subsection (a) of section 103, as amended by this subsection, by inserting <quote>(except when sitting en banc under paragraph (2))</quote> after <quote>no judge designated under this subsection</quote>; and</text></subparagraph> 
<subparagraph id="HD1B8979BD8634238ADCAAAA92023B600" commented="no"><enum>(B)</enum><text>in section 302(c) (<external-xref legal-doc="usc" parsable-cite="usc/50/1822">50 U.S.C. 1822(c)</external-xref>), by inserting <quote>(except when sitting en banc)</quote> after <quote>except that no judge</quote>.</text></subparagraph></paragraph></subsection> 
<subsection id="H2765DCEE65C44D7F9D02AB89DEA547BA"><enum>(c)</enum><header>Stay or modification during an appeal</header><text>Section 103 of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1803">50 U.S.C. 1803</external-xref>) is amended—</text> 
<paragraph id="H769BD818CE6E48E099E342FCC05F1CC8"><enum>(1)</enum><text>by redesignating subsection (f) as subsection (g); and</text></paragraph> 
<paragraph id="HDA830F629C7C44C0917528EFEA49BF04"><enum>(2)</enum><text>by inserting after subsection (e) the following new subsection:</text>

<subsection id="H7F63BF69A9CD428DA3EBD0F8C4169C36"><enum>(f)</enum> 
<paragraph id="HD3FCF0EB8FAA4D3FBF3566E130001920" display-inline="yes-display-inline"><enum>(1)</enum><text>A judge of the court established under subsection (a), the court established under subsection (b) or a judge of that court, or the Supreme Court of the United States or a justice of that court, may, in accordance with the rules of their respective courts, enter a stay of an order or an order modifying an order of the court established under subsection (a) or the court established under subsection (b) entered under any title of this Act, while the court established under subsection (a) conducts a rehearing, while an appeal is pending to the court established under subsection (b), or while a petition of certiorari is pending in the Supreme Court of the United States, or during the pendency of any review by that court.</text></paragraph> 
<paragraph id="H63A8B62686884BCE9F5F15A7B449AAB2" indent="up1"><enum>(2)</enum><text>The authority described in paragraph (1) shall apply to an order entered under any provision of this Act.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H65F214B7097848CAAD9091AD29F2615E"><enum>(d)</enum><header>Authority of foreign intelligence surveillance court</header><text>Section 103 of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1803">50 U.S.C. 1803</external-xref>), as amended by this Act, is further amended by adding at the end the following:</text>

<subsection id="HF621A5A10E6641D099DCCE20DC928D7B"><enum>(i)</enum><text>Nothing in this Act shall be construed to reduce or contravene the inherent authority of the court established by subsection (a) to determine or enforce compliance with an order or a rule of such court or with a procedure approved by such court.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="H3ABBACC6E5F1493BB76D65932DA0213B"><enum>110.</enum><header>Inspector General review of previous actions</header> 
<subsection id="HAFC8E2F749DB433685ED79EC38A597E8"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="HE1CDC524E46643928982A7E99C9BAD2F"><enum>(1)</enum><header>Appropriate committees of Congress</header><text>The term <quote>appropriate committees of Congress</quote> means—</text> 
<subparagraph id="H92CF66AA40AD4787A3C16DFC603FDA46"><enum>(A)</enum><text>the Select Committee on Intelligence and the Committee on the Judiciary of the Senate; and</text></subparagraph> 
<subparagraph id="H88D57821916248FD9185EC8979F7DB06"><enum>(B)</enum><text>the Permanent Select Committee on Intelligence and the Committee on the Judiciary of the House of Representatives.</text></subparagraph></paragraph> 
<paragraph id="HBF86BCE2584E43A68B607B08C8AB109C"><enum>(2)</enum><header>Foreign Intelligence Surveillance Court</header><text>The term <quote>Foreign Intelligence Surveillance Court</quote> means the court established by section 103(a) of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1803">50 U.S.C. 1803(a)</external-xref>).</text></paragraph> 
<paragraph id="HE183FABCF4BA447CA226DF16F7EF16B6"><enum>(3)</enum><header>President’s Surveillance Program and Program</header><text>The terms <quote>President’s Surveillance Program </quote> and <quote>Program</quote> mean the intelligence activity involving communications that was authorized by the President during the period beginning on September 11, 2001, and ending on January 17, 2007, including the program referred to by the President in a radio address on December 17, 2005 (commonly known as the Terrorist Surveillance Program).</text></paragraph></subsection> 
<subsection id="H467D1FAD60024B96A23C09194F309B64"><enum>(b)</enum><header>Reviews</header> 
<paragraph id="H937ADB754329469FBA4E2C0031051313"><enum>(1)</enum><header>Requirement to conduct</header><text>The Inspectors General of the Department of Justice, the Office of the Director of National Intelligence, the National Security Agency, and any other element of the intelligence community that participated in the President’s Surveillance Program shall complete a comprehensive review of, with respect to the oversight authority and responsibility of each such Inspector General—</text> 
<subparagraph id="H8FD32CDFB25B4AA0A92EAE68F2B0B6CA"><enum>(A)</enum><text>all of the facts necessary to describe the establishment, implementation, product, and use of the product of the Program;</text></subparagraph> 
<subparagraph id="H9A02C24EE2D94CC196FA478E2148D5A7"><enum>(B)</enum><text>the procedures and substance of, and access to, the legal reviews of the Program;</text></subparagraph> 
<subparagraph id="HF53194D0B31B4133A8EC29EF7403A547"><enum>(C)</enum><text>communications with and participation of individuals and entities in the private sector related to the Program;</text></subparagraph> 
<subparagraph id="HEB71F1760572497FB22366BE5C62E087"><enum>(D)</enum><text>interaction with the Foreign Intelligence Surveillance Court and transition to court orders related to the Program; and</text></subparagraph> 
<subparagraph id="HBEB4E5E682E4452695F31965AE814DD"><enum>(E)</enum><text>any other matters identified by any such Inspector General that would enable that Inspector General to complete a review of the Program, with respect to such Department or element.</text></subparagraph></paragraph> 
<paragraph id="H3ECD129C4FAC4BB7A213A26FE797C981"><enum>(2)</enum><header>Cooperation and coordination</header> 
<subparagraph id="H6C6E4B0670D54372001800CDC5D7E811"><enum>(A)</enum><header>Cooperation</header><text>Each Inspector General required to conduct a review under paragraph (1) shall—</text> 
<clause id="H0C3BB6E912AC47319E74002FBAB007D"><enum>(i)</enum><text>work in conjunction, to the extent practicable, with any other Inspector General required to conduct such a review; and</text></clause> 
<clause id="H6E9DD96FC92D4E4893E3D2C057B9C635"><enum>(ii)</enum><text>utilize, to the extent practicable, and not unnecessarily duplicate or delay such reviews or audits that have been completed or are being undertaken by any such Inspector General or by any other office of the Executive Branch related to the Program.</text></clause></subparagraph> 
<subparagraph id="H0B71F6C617BA4F7CBF83EE5ED1B82A4"><enum>(B)</enum><header>Coordination</header><text>The Inspectors General shall designate one of the Inspectors General required to conduct a review under paragraph (1) that is appointed by the President, by and with the advice and consent of the Senate, to coordinate the conduct of the reviews and the preparation of the reports.</text></subparagraph></paragraph></subsection> 
<subsection id="H186D346E4D1744A2828746AA0091F861"><enum>(c)</enum><header>Reports</header> 
<paragraph id="H26B1EFBE646C4519A9553653C9EC0862"><enum>(1)</enum><header>Preliminary reports</header><text>Not later than 60 days after the date of the enactment of this Act, the Inspectors General of the Department of Justice, the Office of the Director of National Intelligence, the National Security Agency, and any other Inspector General required to conduct a review under subsection (b)(1) shall submit to the appropriate committees of Congress an interim report that describes the planned scope of such review.</text></paragraph> 
<paragraph id="H758AE25B44A94F3E9704EDD2F5C816D"><enum>(2)</enum><header>Final report</header><text>Not later than 1 year after the date of the enactment of this Act, the Inspectors General of the Department of Justice, the Office of the Director of National Intelligence, the National Security Agency, and any other Inspector General required to conduct a review under subsection (b)(1) shall submit to the appropriate committees of Congress and the Commission established under section 301(a) a comprehensive report on such reviews that includes any recommendations of any such Inspectors General within the oversight authority and responsibility of any such Inspector General.</text></paragraph> 
<paragraph id="H4F5C9A3E20AB4B449FB901D6833016A8"><enum>(3)</enum><header>Form</header><text>A report submitted under this subsection shall be submitted in unclassified form, but may include a classified annex. The unclassified report shall not disclose the name or identity of any individual or entity of the private sector that participated in the Program or with whom there was communication about the Program, to the extent that information is classified.</text></paragraph></subsection> 
<subsection id="HB390160B14B94DDEB868D5357D23BE29"><enum>(d)</enum><header>Resources</header> 
<paragraph id="H1C784CA306D848D592A210AA9FE456C"><enum>(1)</enum><header>Expedited security clearance</header><text>The Director of National Intelligence shall ensure that the process for the investigation and adjudication of an application by an Inspector General or any appropriate staff of an Inspector General for a security clearance necessary for the conduct of the review under subsection (b)(1) is carried out as expeditiously as possible.</text></paragraph> 
<paragraph id="H0025645F8EE64F37B1671C5DCBC9C5DF"><enum>(2)</enum><header>Additional personnel for the inspectors general</header><text>An Inspector General required to conduct a review under subsection (b)(1) and submit a report under subsection (c) is authorized to hire such additional personnel as may be necessary to carry out such review and prepare such report in a prompt and timely manner. Personnel authorized to be hired under this paragraph—</text> 
<subparagraph id="H26B6B7FABE7B4E9BA1B15339E153F408"><enum>(A)</enum><text>shall perform such duties relating to such a review as the relevant Inspector General shall direct; and</text></subparagraph> 
<subparagraph id="H1C744AD55FC146C0A2C653F305DC07E4"><enum>(B)</enum><text>are in addition to any other personnel authorized by law.</text></subparagraph></paragraph></subsection></section> 
<section id="HBC11241F543E46C58D8600280064F128"><enum>111.</enum><header>Weapons of mass destruction</header> 
<subsection id="HF3A550599110439BA575A161B9892F44"><enum>(a)</enum><header>Definitions</header> 
<paragraph id="HE4CA0B83280D493E98BB6E5C35950942"><enum>(1)</enum><header>Foreign power</header><text>Subsection (a) of section 101 of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1801">50 U.S.C. 1801(a)</external-xref>) is amended—</text> 
<subparagraph id="HF5FFE7388B4A45B7834FE7C32D190000"><enum>(A)</enum><text>in paragraph (5), by striking <quote>persons; or</quote> and inserting <quote>persons;</quote>;</text></subparagraph> 
<subparagraph id="HED105B3ABCCD4AF200EDC900BBDBC580"><enum>(B)</enum><text>in paragraph (6), by striking the period and inserting <quote>; or</quote>; and</text></subparagraph>

<paragraph id="H0CEBBB29C61F480B81794D00817479BB"><enum>(2)</enum><header>Agent of a foreign power</header><text>Subsection (b)(1) of such section 101 is amended—</text> 
<subparagraph id="HD14FA89D15B545BEA2495FDE2D4311DE" commented="no"><enum>(A)</enum><text>in subparagraph (B), by striking <quote>or</quote> at the end; and</text></subparagraph> 
<subparagraph id="HA04B1B0F00164BEAA6AEF0DE06419381" commented="no"><enum>(B)</enum><text>by adding at the end the following new subparagraph:</text> 
<quoted-block id="HC941FC9B4DD640098483951011C97837" style="OLC"> 
<subparagraph id="HE5BC2C9E3A6B49220093B0561690CE00" commented="no"><enum>(D)</enum><text>engages in the international proliferation of weapons of mass destruction, or activities in preparation therefor; or</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H7B865BD13337492892BFD79DCAE9C3FF"><enum>(3)</enum><header>Foreign intelligence information</header><text>Subsection (e)(1)(B) of such section 101 is amended by striking <quote>sabotage or international terrorism</quote> and inserting <quote>sabotage, international terrorism, or the international proliferation of weapons of mass destruction</quote>.</text></paragraph> 
<paragraph id="HA3D4F7FF7EFA402590E6AE36F9DA0007"><enum>(4)</enum><header>Weapon of mass destruction</header><text>Such section 101 is amended by adding at the end the following new subsection:</text> 
<quoted-block id="H773AD218B4604DBE9BC9FE256B54EBEA" style="OLC"> 
<subsection id="H76139FCC46BF438FB059D570C4AF87EF"><enum>(p)</enum><text><quote>Weapon of mass destruction</quote> means—</text> 
<paragraph id="H6F5286C3EDB64EBF89FF7C4B00491C2C"><enum>(1)</enum><text>any explosive, incendiary, or poison gas device that is intended or has the capability to cause a mass casualty incident;</text></paragraph> 
<paragraph id="H9035F4F4BABF45C1A86854D51B654CBE"><enum>(2)</enum><text>any weapon that is designed or intended to cause death or serious bodily injury to a significant number of persons through the release, dissemination, or impact of toxic or poisonous chemicals or their precursors;</text></paragraph> 
<paragraph id="H49063428A6A54D7B863583A780C74847"><enum>(3)</enum><text>any weapon involving a biological agent, toxin, or vector (as such terms are defined in <external-xref legal-doc="usc" parsable-cite="usc/18/178">section 178</external-xref> of title 18, United States Code) that is designed, intended, or has the capability of causing death, illness, or serious bodily injury to a significant number of persons; or</text></paragraph> 
<paragraph id="HCFC66F91051B4715B5A21DEDB94E1DC"><enum>(4)</enum><text>any weapon that is designed, intended, or has the capability of releasing radiation or radioactivity causing death, illness, or serious bodily injury to a significant number of persons.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H2B501AB8DF67418692C35EB7958FBF3"><enum>(b)</enum><header>Use of Information</header> 
<paragraph id="H786AA350CAA648C0AC4943A1AB134FA"><enum>(1)</enum><header>In general</header><text>Section 106(k)(1)(B) of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1806">50 U.S.C. 1806(k)(1)(B)</external-xref>) is amended by striking <quote>sabotage or international terrorism</quote> and inserting <quote>sabotage, international terrorism, or the international proliferation of weapons of mass destruction</quote>.</text></paragraph> 
<paragraph id="H5B1F312871EB4F35B719F045DBACDCBE"><enum>(2)</enum><header>Physical searches</header><text>Section 305(k)(1)(B) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1825">50 U.S.C. 1825(k)(1)(B)</external-xref>) is amended by striking <quote>sabotage or international terrorism</quote> and inserting <quote>sabotage, international terrorism, or the international proliferation of weapons of mass destruction</quote>.</text></paragraph></subsection> 
<subsection id="H8B1F96012F3D4F3E9B3300AE00C9C23F"><enum>(c)</enum><header>Technical and conforming amendment</header><text>Section 301(1) of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1821">50 U.S.C. 1821(1)</external-xref>) is amended by inserting <quote>weapon of mass destruction ,</quote> after <quote>person,</quote>. </text></subsection></section> 
<section id="H3C3E73A5B11245B9A9EBDDF2BCE86B64"><enum>112.</enum><header>Statute of limitations</header> 
<subsection id="H2DBC24F6A3C840B3B48E0233B04DD845"><enum>(a)</enum><header>In general</header><text>Section 109 of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1809">50 U.S.C. 1809</external-xref>) is amended by adding at the end the following new subsection:</text>

<subsection id="H038A57AE8BAF4919A679F74B806F2580"><enum>(e)</enum><header>Statute of limitations</header><text>No person shall be prosecuted, tried, or punished for any offense under this section unless the indictment is found or the information is instituted not later than 10 years after the commission of the offense.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H8876EBA59AD54908A3765C6DAA93C237"><enum>(b)</enum><header>Application</header><text>The amendment made by subsection (a) shall apply to any offense committed before the date of the enactment of this Act if the statute of limitations applicable to that offense has not run as of such date.</text></subsection></section></title> 
<title id="H0132A073D34E45E38DD013C18510A507"><enum>II</enum><header>Protection of persons assisting the Government</header> 
<section id="HDB12923577B14898B95FE1B37E727CDE" section-type="subsequent-section"><enum>201.</enum><header>Statutory defenses</header><text display-inline="no-display-inline">The Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1801">50 U.S.C. 1801 et seq.</external-xref>) is amended by adding after title VII the following:</text>

<paragraph id="H1B11D9B94B324C5BB3B6A7A4C500207D"><enum>(2)</enum><header>Attorney general</header><text>The term <quote>Attorney General</quote> has the meaning given that term in section 101(g).</text></paragraph> 
<paragraph id="HB1D3D16DF8C44CA0AD34CF34CE169664"><enum>(3)</enum><header>Contents</header><text>The term <quote>contents</quote> has the meaning given that term in section 101(n).</text></paragraph> 
<paragraph id="HC314533EE44E4D2B88006386B1370018"><enum>(4)</enum><header>Covered civil action</header><text>The term <quote>covered civil action</quote> means a suit in Federal or State court against any person for providing assistance to an element of the intelligence community.</text></paragraph> 
<paragraph id="HC26B65789B0B494A972C58784FF465AA"><enum>(5)</enum><header>Electronic communication service provider</header><text>The term <quote>electronic communication service provider</quote> means—</text> 
<subparagraph id="HE47ED83A36314B1FAFCF04E0DEA3A876"><enum>(A)</enum><text>a telecommunications carrier, as that term is defined in section 3 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/153">47 U.S.C. 153</external-xref>);</text></subparagraph> 
<subparagraph id="H4BAF069546254E789BC76970911EC651"><enum>(B)</enum><text>a provider of electronic communication service, as that term is defined in <external-xref legal-doc="usc" parsable-cite="usc/18/2510">section 2510</external-xref> of title 18, United States Code;</text></subparagraph> 
<subparagraph id="H168E4CAC58554743A96D63C551FDF092"><enum>(C)</enum><text>a provider of a remote computing service, as that term is defined in <external-xref legal-doc="usc" parsable-cite="usc/18/2711">section 2711</external-xref> of title 18, United States Code;</text></subparagraph> 
<subparagraph id="HF146D58602B74DCB95C5B8EEA989E65E"><enum>(D)</enum><text>any other communication service provider who has access to wire or electronic communications either as such communications are transmitted or as such communications are stored;</text></subparagraph> 
<subparagraph id="HA342ECCC0F2F469F9B62AA29188BB293"><enum>(E)</enum><text>a parent, subsidiary, affiliate, successor, or assignee of an entity described in subparagraph (A), (B), (C), or (D); or</text></subparagraph> 
<subparagraph id="H741EB86F6B0E4E8C982F69A556D0519D"><enum>(F)</enum><text>an officer, employee, or agent of an entity described in subparagraph (A), (B), (C), (D), or (E).</text></subparagraph></paragraph> 
<paragraph id="H1284CA08AFC04D0795C34FBB2E5F55BC" commented="no"><enum>(6)</enum><header>Intelligence community</header><text>The term <quote>intelligence community</quote> has the meaning given that term in section 3(4) of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/401a">50 U.S.C. 401a(4)</external-xref>).</text></paragraph> 
<paragraph id="HC642CB6A69494E658796358657AAB6CE"><enum>(7)</enum><header>Person</header><text>The term <quote>person</quote> means—</text> 
<subparagraph id="H998E443DA45F441F87C88DDAFB06B6B"><enum>(A)</enum><text>an electronic communication service provider; or</text></subparagraph> 
<subparagraph id="HC6E4DDD55B94487890B9C3A7169CCD85"><enum>(B)</enum><text>a landlord, custodian, or other person who may be authorized or required to furnish assistance pursuant to—</text> 
<clause id="H5E2F2CF825EC4B989343AD77D929A1F"><enum>(i)</enum><text>an order of the court established under section 103(a) directing such assistance;</text></clause> 
<clause id="H0FCC35C76C1C4834A26F32A0FF2BE697"><enum>(ii)</enum><text>a certification in writing under section <external-xref legal-doc="usc" parsable-cite="usc/18/2511">2511(2)(a)(ii)(B)</external-xref> or <external-xref legal-doc="usc" parsable-cite="usc/18/2709">2709(b)</external-xref> of title 18, United States Code; or</text></clause> 
<clause id="H5404C0E9EE2E4CD8A4B399374987ACC7"><enum>(iii)</enum><text>a directive under section 102(a)(4), 105B(e), as added by section 2 of the Protect America Act of 2007 (<external-xref legal-doc="public-law" parsable-cite="pl/110/55">Public Law 110–55</external-xref>), or 703(h).</text></clause></subparagraph></paragraph> 
<paragraph id="H17F350CDF02C4F7AAEDF2417149FFED"><enum>(8)</enum><header>State</header><text>The term <quote>State</quote> means any State, political subdivision of a State, the Commonwealth of Puerto Rico, the District of Columbia, and any territory or possession of the United States, and includes any officer, public utility commission, or other body authorized to regulate an electronic communication service provider.</text></paragraph></section> 
<section id="H45D3DD42240345BD00A96B88CC4DA98E"><enum>802.</enum><header>Procedures for covered civil actions</header> 
<subsection id="H5B6FD235A1B7409FBD25FA5D02C42BE6"><enum>(a)</enum><header>Intervention by Government</header><text display-inline="yes-display-inline"> In any covered civil action, the court shall permit the Government to intervene. Whether or not the Government intervenes in the civil action, the Attorney General may submit any information in any form the Attorney General determines is appropriate and the court shall consider all such submissions. </text></subsection> 
<subsection id="HA2310B31DCCE4113B3E9A9E2CCE89420"><enum>(b)</enum><header>Factual and legal determinations</header><text display-inline="yes-display-inline">In any covered civil action, any party may submit to the court evidence, briefs, arguments, or other information on any matter with respect to which a privilege based on state secrets is asserted. The court shall review any such submission in accordance with the procedures set forth in section 106(f) and may, based on the review, make any appropriate determination of fact or law. The court may, on motion of the Attorney General, take any additional actions the court deems necessary to protect classified information. The court may, to the extent practicable and consistent with national security, request that any party present briefs and arguments on any legal question the court determines is raised by such a submission even if that party does not have full access to the submission. The court shall consider whether the employment of a special master or an expert witness, or both, would facilitate proceedings under this section.</text></subsection> 
<subsection id="HDD02B86938FF4C2591152F91C690536B"><enum>(c)</enum><header>Location of review</header><text>The court may conduct the review in a location and facility specified by the Attorney General as necessary to ensure security.</text></subsection> 
<subsection id="H4FE957FEE6DB49158724064765D9D46E"><enum>(d)</enum><header>Removal</header><text>A covered civil action that is brought in a State court shall be deemed to arise under the Constitution and laws of the United States and shall be removable under <external-xref legal-doc="usc" parsable-cite="usc/28/1441">section 1441</external-xref> of title 28, United States Code.</text></subsection> 
<subsection id="H32C21F470F6F4A15BE7EF7B40811E871"><enum>(e)</enum><header>Special rule for certain cases</header><text display-inline="yes-display-inline">For any covered civil action alleging that a person provided assistance to an element of the intelligence community pursuant to a request or directive during the period from September 11, 2001 through January 17, 2007, the Attorney General shall provide to the court any request or directive related to the allegations under the procedures set forth in subsection (b). </text></subsection> 
<subsection id="H8EE2B97613104324959FA3B587F25F35"><enum>(f)</enum><header>Applicability</header><text>This section shall apply to a civil action pending on or filed after the date of the enactment of this Act.</text></subsection></section></title><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H2DDACA4294814F23964044CC97F3ECC5"><enum>202.</enum><header>Technical amendments</header><text display-inline="no-display-inline">The table of contents in the first section of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1801">50 U.S.C. 1801 et seq.</external-xref>) is amended by adding at the end the following:</text>

<section id="H3053FBA7FB3644D4BD996B69DFEBCC4"><enum>301.</enum><header>Commission on Warrantless Electronic Surveillance Activities</header> 
<subsection id="HF0DA4881EA5C4608A2A53362278FBA29"><enum>(a)</enum><header>Establishment of Commission</header><text>There is established in the legislative branch a commission to be known as the <quote>Commission on Warrantless Electronic Surveillance Activities</quote> (in this section referred to as the <quote>Commission</quote>).</text></subsection> 
<subsection id="H861E432051ED4498AA1B07DE20B78396"><enum>(b)</enum><header>Duties of Commission</header> 
<paragraph id="H3AA205446C4A447AA1E3D19EB9ADAFA2"><enum>(1)</enum><header>In general</header><text>The Commission shall—</text> 
<subparagraph id="H1B921AA0D6854B9F93AC00A68884F2D5"><enum>(A)</enum><text>ascertain, evaluate, and report upon the facts and circumstances relating to electronic surveillance activities conducted without a warrant between September 11, 2001 and January 17, 2007;</text></subparagraph> 
<subparagraph id="HBFFB78F24C8E46E0A17F6999DEDA1B2E"><enum>(B)</enum><text>evaluate the lawfulness of such activities;</text></subparagraph> 
<subparagraph id="H0983B3FE4F354CB8A6CBE1FC5077D515" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">examine all programs and activities relating to intelligence collection inside the United States or regarding United States persons that were in effect or operation on September 11, 2001, and all such programs and activities undertaken since that date, including the legal framework or justification for those activities; and</text></subparagraph> 
<subparagraph id="H18A7DF7E6AAB4A6D0017787CE8E19DB"><enum>(D)</enum><text>report to the President and Congress the findings and conclusions of the Commission and any recommendations the Commission considers appropriate.</text></subparagraph></paragraph> 
<paragraph id="H3BA5D2C6F4D74B63BFE98B7DBEA816A8"><enum>(2)</enum><header>Protection of national security</header><text>The Commission shall carry out the duties of the Commission under this section in a manner consistent with the need to protect national security.</text></paragraph></subsection> 
<subsection id="H5B8486D0629F46BDB6CEB01FB7538547"><enum>(c)</enum><header>Composition of Commission</header> 
<paragraph id="H11E240A8380D4C179C1F0772B5E059EB"><enum>(1)</enum><header>Members</header><text>The Commission shall be composed of 9 members, of whom—</text> 
<subparagraph id="H411099F959DF4F18A1002CB5A9996000"><enum>(A)</enum><text>5 members shall be appointed jointly by the majority leader of the Senate and the Speaker of the House of Representatives; and</text></subparagraph> 
<subparagraph id="HD10C357899C14987BC58E8B8D7BDA1E1"><enum>(B)</enum><text>4 members shall be appointed jointly by the minority leader of the Senate and the minority leader of the House of Representatives.</text></subparagraph></paragraph> 
<paragraph id="H53F56B3E3D90487EB9C35705D2284415"><enum>(2)</enum><header>Qualifications</header><text>It is the sense of Congress that individuals appointed to the Commission should be prominent United States citizens with significant depth of experience in national security, Constitutional law, and civil liberties.</text></paragraph> 
<paragraph id="HA16296905F194D7AB032479D6202E5FD"><enum>(3)</enum><header>Chair; Vice Chair</header> 
<subparagraph id="HB6FD8E71335843FAAE2299D2E767100"><enum>(A)</enum><header>Chair</header><text display-inline="yes-display-inline">The Chair of the Commission shall be jointly appointed by the majority leader of the Senate and the Speaker of the House of Representatives from among the members appointed under paragraph (1)(A).</text></subparagraph> 
<subparagraph id="H57B24B20C64C40008CD348DC3180D96F"><enum>(B)</enum><header>Vice Chair</header><text display-inline="yes-display-inline">The Vice Chair of the Commission shall be jointly appointed by the minority leader of the Senate and the minority leader of the House of Representatives from among the members appointed under paragraph (1)(B).</text></subparagraph></paragraph> 
<paragraph id="HC2495286433F42ED99D001C4DF1DA6F"><enum>(4)</enum><header>Deadline for appointment</header><text>All members of the Commission shall be appointed not later than 90 days after the date of the enactment of this Act.</text></paragraph> 
<paragraph id="H1EEA9CAB850D42C48503725854192F00"><enum>(5)</enum><header>Initial meeting</header><text>The Commission shall hold its first meeting and begin operations not later than 45 days after the date on which a majority of its members have been appointed.</text></paragraph> 
<paragraph id="H2219712B20164DC2A166528503E45CAF"><enum>(6)</enum><header>Subsequent meetings</header><text display-inline="yes-display-inline">After its initial meeting, the Commission shall meet upon the call of the Chair.</text></paragraph> 
<paragraph id="H192BFE7EBE3C4EC6B987B67FA8A12DB" commented="no"><enum>(7)</enum><header>Quorum</header><text>A majority of the members of the Commission shall constitute a quorum, but a lesser number may hold hearings.</text></paragraph> 
<paragraph id="H92D725C92D9C44C5920035408C4FD37F"><enum>(8)</enum><header>Vacancies</header><text>Any vacancy in the Commission shall not affect its powers and shall be filled in the same manner in which the original appointment was made.</text></paragraph></subsection> 
<subsection id="H7034B5289CB34AC1BB647D42BEBEE518"><enum>(d)</enum><header>Powers of Commission</header> 
<paragraph id="HB26192D0E7A540919DBD4CBCAE7B731"><enum>(1)</enum><header>Hearings and evidence</header><text>The Commission or, on the authority of the Chair, any subcommittee or member thereof may, for the purpose of carrying out this section, hold such hearings and sit and act at such times and places, take such testimony, receive such evidence, and administer such oaths as the Commission, such designated subcommittee, or designated member may determine advisable.</text></paragraph> 
<paragraph id="H1F5D2C2A5DBF4EEDBAA5BEFC287C54B1"><enum>(2)</enum><header>Subpoenas</header> 
<subparagraph id="H6FF6DE07239D46B496372B3F27CF47A3"><enum>(A)</enum><header>Issuance</header> 
<clause id="H9531413302664DC5838540F90199BB4F"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The Commission may issue subpoenas requiring the attendance and testimony of witnesses and the production of any evidence relating to any matter that the Commission is empowered to investigate under this section. The attendance of witnesses and the production of evidence may be required from any place within the United States at any designated place of hearing within the United States.</text></clause> 
<clause id="H07073A7A054742F78891D7D1D64B1E10"><enum>(ii)</enum><header>Signature</header><text>Subpoenas issued under this paragraph may be issued under the signature of the Chair of the Commission, the chair of any subcommittee created by a majority of the Commission, or any member designated by a majority of the Commission and may be served by any person designated by such Chair, subcommittee chair, or member.</text></clause></subparagraph> 
<subparagraph id="HA2ED7865907C4DC7B1CD7A78992213F"><enum>(B)</enum><header>Enforcement</header> 
<clause id="HD8EA884E072643EBB8C33C7FF4174300"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">If a person refuses to obey a subpoena issued under subparagraph (A), the Commission may apply to a United States district court for an order requiring that person to appear before the Commission to give testimony, produce evidence, or both, relating to the matter under investigation. The application may be made within the judicial district where the hearing is conducted or where that person is found, resides, or transacts business. Any failure to obey the order of the court may be punished by the court as civil contempt.</text></clause> 
<clause id="H45E3A9B2E7ED427B96FD182D252E3FEA"><enum>(ii)</enum><header>Jurisdiction</header><text>In the case of contumacy or failure to obey a subpoena issued under subparagraph (A), the United States district court for the judicial district in which the subpoenaed person resides, is served, or may be found, or where the subpoena is returnable, may issue an order requiring such person to appear at any designated place to testify or to produce documentary or other evidence. Any failure to obey the order of the court may be punished by the court as a contempt of that court.</text></clause> 
<clause id="HFEC4D12E903E4A458DD18039E6306B16"><enum>(iii)</enum><header>Additional enforcement</header><text>In the case of the failure of a witness to comply with any subpoena or to testify when summoned under authority of this paragraph, the Commission, by majority vote, may certify a statement of fact attesting to such failure to the appropriate United States attorney, who shall bring the matter before the grand jury for its action, under the same statutory authority and procedures as if the United States attorney had received a certification under sections 102 through 104 of the Revised Statutes of the United States (2 U.S.C. 192 through 194).</text></clause></subparagraph></paragraph> 
<paragraph id="HA301322A921D445C9D6F65CB06BC498E"><enum>(3)</enum><header>Contracting</header><text>The Commission may, to such extent and in such amounts as are provided in appropriations Acts, enter into contracts to enable the Commission to discharge its duties under this section.</text></paragraph> 
<paragraph id="H8AE08A6FEBF546B9A0EF6886CA3139E4"><enum>(4)</enum><header>Information from Federal agencies</header> 
<subparagraph id="H7B14CBF3E03D45C5AC644FDFDA702C28"><enum>(A)</enum><header>In general</header><text>The Commission is authorized to secure directly from any executive department, bureau, agency, board, commission, office, independent establishment, or instrumentality of the Government documents, information, suggestions, estimates, and statistics for the purposes of this section. Each department, bureau, agency, board, commission, office, independent establishment, or instrumentality shall furnish such documents, information, suggestions, estimates, and statistics directly to the Commission upon request made by the Chair, the chair of any subcommittee created by a majority of the Commission, or any member designated by a majority of the Commission.</text></subparagraph> 
<subparagraph id="HDEB92B2F4B9E4F94A863F8DAE60818F6"><enum>(B)</enum><header>Receipt, handling, storage, and dissemination</header><text>Information shall only be received, handled, stored, and disseminated by members of the Commission and its staff in a manner consistent with all applicable statutes, regulations, and Executive orders.</text></subparagraph></paragraph> 
<paragraph id="H2046F34486C34CE78D4F6604D155256D"><enum>(5)</enum><header>Assistance from Federal agencies</header> 
<subparagraph id="HCACF8478E83B427688BB25D3DCA41AF"><enum>(A)</enum><header>General Services Administration</header><text>The Administrator of General Services shall provide to the Commission on a reimbursable basis administrative support and other services for the performance of the Commission's functions.</text></subparagraph> 
<subparagraph id="H2D34EE37F87549769FAEF7FD00D802F2"><enum>(B)</enum><header>Other departments and agencies</header><text>In addition to the assistance prescribed in subparagraph (A), departments and agencies of the United States may provide to the Commission such services, funds, facilities, staff, and other support services as they may determine advisable and as may be authorized by law.</text></subparagraph></paragraph> 
<paragraph id="HF6AE6C69FE60472BBFE55E40B309D2DC"><enum>(6)</enum><header>Gifts</header><text>The Commission may accept, use, and dispose of gifts or donations of services or property.</text></paragraph> 
<paragraph id="HE91BCC84E5B543AEB0061FFC4000FD47"><enum>(7)</enum><header>Postal services</header><text>The Commission may use the United States mails in the same manner and under the same conditions as departments and agencies of the United States.</text></paragraph></subsection> 
<subsection id="H220B44A828A74632B0D32B36F7D6D3C"><enum>(e)</enum><header>Staff of Commission</header> 
<paragraph id="HF6F647D985714BB4A36CB440F23B64FC"><enum>(1)</enum><header>In general</header> 
<subparagraph id="H99A071724DD64332B519EF2FDDDB161F"><enum>(A)</enum><header>Appointment and compensation</header><text>The Chair, in consultation with Vice Chair and in accordance with rules agreed upon by the Commission, may appoint and fix the compensation of an executive director and such other personnel as may be necessary to enable the Commission to carry out its functions, without regard to the provisions of title 5, United States Code, governing appointments in the competitive service, and without regard to the provisions of chapter 51 and subchapter III of chapter 53 of such title relating to classification and General Schedule pay rates, except that no rate of pay fixed under this paragraph may exceed the equivalent of that payable for a position at level V of the Executive Schedule under <external-xref legal-doc="usc" parsable-cite="usc/5/5316">section 5316</external-xref> of title 5, United States Code.</text></subparagraph> 
<subparagraph id="H385A9630E49A49A99EEC8D619CC93B2"><enum>(B)</enum><header>Personnel as Federal employees</header> 
<clause id="HA59C2D80CAA34416B6526CD9654B8494"><enum>(i)</enum><header>In general</header><text>The executive director and any personnel of the Commission who are employees shall be employees under <external-xref legal-doc="usc" parsable-cite="usc/5/2105">section 2105</external-xref> of title 5, United States Code, for purposes of chapters 63, 81, 83, 84, 85, 87, 89, 89A, 89B, and 90 of that title.</text></clause> 
<clause id="H27BB5FC4284D474888E1D307AF9B494"><enum>(ii)</enum><header>Members of Commission</header><text>Clause (i) shall not be construed to apply to members of the Commission.</text></clause></subparagraph></paragraph> 
<paragraph id="H350C9744E01946B8AD6DE3308391765E"><enum>(2)</enum><header>Detailees</header><text>A Federal Government employee may be detailed to the Commission without reimbursement from the Commission, and such detailee shall retain the rights, status, and privileges of his or her regular employment without interruption.</text></paragraph> 
<paragraph id="H283B37B93402442FB3461996C6034703"><enum>(3)</enum><header>Consultant services</header><text>The Commission is authorized to procure the services of experts and consultants in accordance with <external-xref legal-doc="usc" parsable-cite="usc/5/3109">section 3109</external-xref> of title 5, United States Code, at rates not to exceed the daily rate paid a person occupying a position at level IV of the Executive Schedule under <external-xref legal-doc="usc" parsable-cite="usc/5/5315">section 5315</external-xref> of title 5, United States Code.</text></paragraph></subsection> 
<subsection id="HB31B1AFA570944EAAC5CAB89C9AB74DF"><enum>(f)</enum><header>Security clearances for Commission members and staff</header> 
<paragraph id="HEE520FC8CBF846EC81D047B6509BAE09"><enum>(1)</enum><header>Expeditious provision of clearances</header><text>The appropriate Federal agencies or departments shall cooperate with the Commission in expeditiously providing to the Commission members and staff appropriate security clearances to the extent possible pursuant to existing procedures and requirements, except that no person shall be provided with access to classified information under this section without the appropriate security clearances.</text></paragraph> 
<paragraph id="HCCF4EF9F3EED42DCBE8CCAD7E8F192B4"><enum>(2)</enum><header>Access to classified information</header><text>All members of the Commission and commission staff, as authorized by the Chair or the designee of the Chair, who have obtained appropriate security clearances, shall have access to classified information related to the surveillance activities within the scope of the examination of the Commission and any other related classified information that the members of the Commission determine relevant to carrying out the duties of the Commission under this section.</text></paragraph> 
<paragraph id="HA0E5840E9E294A8EA039334B84FFBBF5" commented="no"><enum>(3)</enum><header>Facilities and resources</header><text>The Director of National Intelligence shall provide the Commission with appropriate space and technical facilities approved by the Commission.</text></paragraph></subsection> 
<subsection id="H3FDFBF21082E47679E47F8D4F6F2701D"><enum>(g)</enum><header>Compensation and travel expenses</header> 
<paragraph id="H1EC9E2A31D0F4A17AE8C8D51F99E34F9"><enum>(1)</enum><header>Compensation</header><text>Each member of the Commission may be compensated at a rate not to exceed the daily equivalent of the annual rate of basic pay in effect for a position at level IV of the Executive Schedule under <external-xref legal-doc="usc" parsable-cite="usc/5/5315">section 5315</external-xref> of title 5, United States Code, for each day during which that member is engaged in the actual performance of the duties of the Commission.</text></paragraph> 
<paragraph id="H406A99BD3B38489E9D4630DEBC5DDD6"><enum>(2)</enum><header>Travel expenses</header><text>While away from their homes or regular places of business in the performance of services for the Commission, members of the Commission shall be allowed travel expenses, including per diem in lieu of subsistence, in the same manner as persons employed intermittently in the Government service are allowed expenses under <external-xref legal-doc="usc" parsable-cite="usc/5/5703">section 5703(b)</external-xref> of title 5, United States Code.</text></paragraph></subsection> 
<subsection id="HB9D48E8C34134B398EAB58113BFFB800"><enum>(h)</enum><header>Nonapplicability of Federal Advisory Committee Act</header> 
<paragraph id="HBD351AC9C0ED45409E92D64C42FACCA"><enum>(1)</enum><header>In general</header><text>The Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the Commission.</text></paragraph> 
<paragraph id="H3419FF768F3D441F96BA498ADCB52B4"><enum>(2)</enum><header>Public meetings</header><text>The Commission shall hold public hearings and meetings to the extent appropriate.</text></paragraph> 
<paragraph id="H1BCF0DA0FE6840F1ADD291062357CB35"><enum>(3)</enum><header>Public hearings</header><text>Any public hearings of the Commission shall be conducted in a manner consistent with the protection of information provided to or developed for or by the Commission as required by any applicable statute, regulation, or Executive order.</text></paragraph></subsection> 
<subsection id="H99722E64CB454A0ABD4CCAFBC9362F25"><enum>(i)</enum><header>Reports and recommendations of Commission</header> 
<paragraph id="HC15D5CED4AC74E8786EA5F727D619737"><enum>(1)</enum><header>Interim reports</header><text>The Commission may submit to the President and Congress interim reports containing such findings, conclusions, and recommendations for corrective measures as have been agreed to by a majority of Commission members.</text></paragraph> 
<paragraph id="H3B432F81E51547E292E8FAE966F537C"><enum>(2)</enum><header>Final report</header><text>Not later than one year after the date of its first meeting, the Commission, in consultation with appropriate representatives of the intelligence community, shall submit to the President and Congress a final report containing such information, analysis, findings, conclusions, and recommendations as have been agreed to by a majority of Commission members.</text></paragraph> 
<paragraph id="H7DADACCB58444D28B64B8C5FFB8157ED"><enum>(3)</enum><header>Form</header><text>The reports submitted under paragraphs (1) and (2) shall be submitted in unclassified form, but may include a classified annex.</text></paragraph> 
<paragraph id="HE3A2FE11116343C5AC6B17A937FBD1C6"><enum>(4)</enum><header>Recommendations for declassification</header><text>The Commission may make recommendations to the appropriate department or agency of the Federal Government regarding the declassification of documents or portions of documents.</text></paragraph></subsection> 
<subsection id="H779B83823CB9462B8C2BE600BFA035C2"><enum>(j)</enum><header>Termination</header> 
<paragraph id="H386DCEC32B354B598C053E4D87829000"><enum>(1)</enum><header>In general</header><text>The Commission, and all the authorities of this section, shall terminate 60 days after the date on which the final report is submitted under subsection (i)(2).</text></paragraph> 
<paragraph id="H89497EDB126A491FB000E2DD9D645166"><enum>(2)</enum><header>Administrative activities before termination</header><text>The Commission may use the 60-day period referred to in paragraph (1) for the purpose of concluding its activities, including providing testimony to committees of Congress concerning its report and disseminating the final report.</text></paragraph></subsection> 
<subsection id="H75D16E287FDB427090E895F07D4FEB00"><enum>(k)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="HB947A610096F453D8F483840A3B7C75B"><enum>(1)</enum><header>Intelligence community</header><text>The term <quote>intelligence community</quote> has the meaning given the term in section 3(4) of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/401a">50 U.S.C. 401a(4)</external-xref>). </text></paragraph> 
<paragraph id="H160581173965454F80108EFBCACEE786"><enum>(2)</enum><header>United States person</header><text>The term <term>United States person</term> has the meaning given the term in section 101(i) of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1801">50 U.S.C. 1801(i)</external-xref>).</text></paragraph></subsection> 
<subsection id="H711D3A7395A44A118591DBD19EE56F45"><enum>(l)</enum><header>Funding</header> 
<paragraph id="H3A864F80C98D4B6F93B673B6FCEE27C6"><enum>(1)</enum><header>In general</header><text>There are authorized to be appropriated such sums as may be necessary to carry out the activities of the Commission under this section.</text></paragraph></subsection></section></title> 
<paragraph id="H7C41948E63494A5FB2CAC36E3E3BE172"><enum>(2)</enum><header>Duration of availability</header><text>Amounts made available to the Commission under paragraph (1) shall remain available until the termination of the Commission.</text></paragraph> 
<title id="H5555B30D96D04060BBDEC7852097DBDA"><enum>IV</enum><header>Other provisions</header> 
<section id="HCA8D8FD2E71A4769B255007E3C7494E7"><enum>401.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act, any amendment made by this Act, or the application thereof to any person or circumstances is held invalid, the validity of the remainder of the Act, any such amendments, and of the application of such provisions to other persons and circumstances shall not be affected thereby.</text></section>

<paragraph id="HA6301E37D6CC47B6AFFE31F5121C6CB3"><enum>(2)</enum><header>Applicability of Protect America Act of <enum-in-header>2007 </enum-in-header>to continued orders, authorizations, directives</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this Act or of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1801">50 U.S.C. 1801 et seq.</external-xref>)—</text>

<paragraph commented="no" id="HF2894EC214024332A32370A969891398"><enum>(3)</enum><header>Use of information</header><text>Information acquired from an acquisition conducted pursuant to an order, authorization, or directive referred to in paragraph (1) shall be deemed to be information acquired from an electronic surveillance pursuant to title I of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1801">50 U.S.C. 1801 et seq.</external-xref>) for purposes of section 106 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1806">50 U.S.C. 1806</external-xref>).</text></paragraph> 
<paragraph commented="no" id="H7439FB0053604C9AA805F1393CFECAD"><enum>(4)</enum><header>Protection from liability</header><text>Subsection (l) of section 105B of the Foreign Intelligence Surveillance Act of 1978, as added by section 2 of the Protect America Act of 2007, shall continue to apply with respect to any directives issued pursuant to such section 105B.</text></paragraph> 
<paragraph id="HF826DC287F93445C95F1D282DBEB566"><enum>(5)</enum><header>Jurisdiction of Foreign Intelligence Surveillance Court</header><text>Notwithstanding any other provision of this Act or of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1801">50 U.S.C. 1801 et seq.</external-xref>), section 103(e), as amended by section 5(a) of the Protect America Act of 2007 (<external-xref legal-doc="public-law" parsable-cite="pl/110/55">Public Law 110–55</external-xref>; 121 Stat. 556), shall continue to apply with respect to a directive issued pursuant to section 105B of the Foreign Intelligence Surveillance Act of 1978, as added by section 2 of the Protect America Act of 2007, until the expiration of all orders, authorizations, and directives issued or made pursuant to such section.</text></paragraph> 
<paragraph commented="no" id="H489B11996E0D4CCC84CB6200B2EE617F"><enum>(6)</enum><header>Reporting requirements</header> 
<subparagraph commented="no" id="H2456740B59BC483FA86701C8994EC688"><enum>(A)</enum><header>Continued applicability</header><text>Notwithstanding any other provision of this Act, the Protect America Act of 2007 (<external-xref legal-doc="public-law" parsable-cite="pl/110/55">Public Law 110–55</external-xref>), or the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1801">50 U.S.C. 1801 et seq.</external-xref>), section 4 of the Protect America Act of 2007 shall continue to apply until the date that the certification described in subparagraph (B) is submitted.</text></subparagraph> 
<subparagraph commented="no" id="H975C133CA72941E5B4D7002B9976F1D3"><enum>(B)</enum><header>Certification</header><text>The certification described in this subparagraph is a certification—</text> 
<clause commented="no" id="H65619F60B13C456C962BCF84FE38B7B"><enum>(i)</enum><text>made by the Attorney General;</text></clause> 
<clause commented="no" id="H8B3DD98B1D65431EABF49C3792353289"><enum>(ii)</enum><text>submitted as part of a semi-annual report required by section 4 of the Protect America Act of 2007;</text></clause> 
<clause commented="no" id="HAA047A3B681042D7AD91FA0360DF8B00"><enum>(iii)</enum><text>that states that there will be no further acquisitions carried out under section 105B of the Foreign Intelligence Surveillance Act of 1978, as added by section 2 of the Protect America Act of 2007, after the date of such certification; and</text></clause> 
<clause id="H462B15D13AAA4A17991950F53C75B8E" commented="no"><enum>(iv)</enum><text>that states that the information required to be included under such section 4 relating to any acquisition conducted under such section 105B has been included in a semi-annual report required by such section 4.</text></clause></subparagraph></paragraph> 
<paragraph id="HF9DBC5E21E00498600AD20D8F1EA5D45"><enum>(7)</enum><header>Effective date</header><text>Paragraphs (1) through (6) shall take effect as if enacted on August 5, 2007.</text></paragraph></subsection> 
<subsection id="H6D274B9E9DBF483ABFCC78CBC33B4B3"><enum>(b)</enum><header>Transition procedures for FISA Amendments Act of <enum-in-header>2008</enum-in-header> provisions</header> 
<paragraph commented="no" display-inline="no-display-inline" id="H475B70704D8449B184233600ADBE316"><enum>(1)</enum><header>Orders in effect on December <enum-in-header>31</enum-in-header>, <enum-in-header>2009</enum-in-header></header><text>Notwithstanding any other provision of this Act or of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1801">50 U.S.C. 1801 et seq.</external-xref>), any order, authorization, or directive issued or made under title VII of the Foreign Intelligence Surveillance Act of 1978, as amended by section 101(a), shall continue in effect until the date of the expiration of such order, authorization, or directive.</text></paragraph> 
<paragraph id="HCD990C69728F43B4AE3493C200843285" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Applicability of title VII of FISA to continued orders, authorizations, directives</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this Act or of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1801">50 U.S.C. 1801 et seq.</external-xref>), with respect to any order, authorization, or directive referred to in paragraph (1), title VII of such Act, as amended by section 101(a), shall continue to apply until the expiration of such order, authorization, or directive.</text></paragraph> 
<paragraph commented="no" id="H7CF89CCC63364115A5D934625C460077"><enum>(3)</enum><header>Challenge of directives; protection from liability; use of information</header><text>Notwithstanding any other provision of this Act or of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1801">50 U.S.C. 1801 et seq.</external-xref>)—</text> 
<subparagraph id="H5B1E82AEF6A74F22A53820D2EF87D38"><enum>(A)</enum><text>section 103(e) of such Act, as amended by section 113, shall continue to apply with respect to any directive issued pursuant to section 702(h) of such Act, as added by section 101(a);</text></subparagraph> 
<subparagraph commented="no" id="HCFB41CC31FC1402683BBF94D295D8778"><enum>(B)</enum><text>section 702(h)(3) of such Act (as so added) shall continue to apply with respect to any directive issued pursuant to section 702(h) of such Act (as so added);</text></subparagraph> 
<subparagraph commented="no" id="H365C57FE16034FB6A33C5D3F675DAEDE"><enum>(C)</enum><text display-inline="yes-display-inline">section 703(e) of such Act (as so added) shall continue to apply with respect to an order or request for emergency assistance under that section;</text></subparagraph> 
<subparagraph id="HEAF75CB849464C4C834045FE24905F24"><enum>(D)</enum><text display-inline="yes-display-inline">section 706 of such Act (as so added) shall continue to apply to an acquisition conducted under section 702 or 703 of such Act (as so added); and</text></subparagraph> 
<subparagraph id="HB102592B4A7441CE9023136BB250D31F"><enum>(E)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/18/2511">section 2511(2)(a)(ii)(A)</external-xref> of title 18, United States Code, as amended by section 101(c)(1), shall continue to apply to an order issued pursuant to section 704 of the Foreign Intelligence Surveillance Act of 1978, as added by section 101(a).</text></subparagraph></paragraph> 
<paragraph id="HF056F0D68C7845F0BE7322BDA2003F28" commented="no"><enum>(4)</enum><header>Reporting requirements</header> 
<subparagraph id="HEF9DA393A84045918E46A8FF4ADEAB0" commented="no"><enum>(A)</enum><header>Continued applicability</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this Act or of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1801">50 U.S.C. 1801 et seq.</external-xref>), section 601(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1871">50 U.S.C. 1871(a)</external-xref>), as amended by section 101(c)(2), and sections 702(l) and 707 of such Act, as added by section 101(a), shall continue to apply until the date that the certification described in subparagraph (B) is submitted.</text></subparagraph> 
<subparagraph id="H3CD38C74E19941EDAAB47779E9E728A0" commented="no"><enum>(B)</enum><header>Certification</header><text>The certification described in this subparagraph is a certification—</text> 
<clause commented="no" id="HAF4F5267681940B3A09944CA59021C70"><enum>(i)</enum><text>made by the Attorney General;</text></clause> 
<clause commented="no" id="H17008F79E1304FAFB65C536C3B8196B9"><enum>(ii)</enum><text display-inline="yes-display-inline">submitted to the Select Committee on Intelligence of the Senate, the Permanent Select Committee on Intelligence of the House of Representatives, and the Committees on the Judiciary of the Senate and the House of Representatives;</text></clause> 
<clause commented="no" id="HF8DF479EBB5C4FAAACADA25E8454D77E"><enum>(iii)</enum><text>that states that there will be no further acquisitions carried out under title VII of the Foreign Intelligence Surveillance Act of 1978, as amended by section 101(a), after the date of such certification; and</text></clause> 
<clause id="H4DD8D21CC7814E7796C95B74CED5C00" commented="no"><enum>(iv)</enum><text>that states that the information required to be included in a review, assessment, or report under section 601 of such Act, as amended by section 101(c), or section 702(l) or 707 of such Act, as added by section 101(a), relating to any acquisition conducted under title VII of such Act, as amended by section 101(a), has been included in a review, assessment, or report under such section 601, 702(l), or 707.</text></clause></subparagraph></paragraph> 
<paragraph commented="no" id="HD9E6761528C2472E8EB7FD3B600046DD"><enum>(5)</enum><header>Transition procedures concerning the targeting of United States persons overseas</header><text>Any authorization in effect on the date of enactment of this Act under section 2.5 of Executive Order 12333 to intentionally target a United States person reasonably believed to be located outside the United States shall continue in effect, and shall constitute a sufficient basis for conducting such an acquisition targeting a United States person located outside the United States until the earlier of—</text> 
<subparagraph commented="no" id="H97F6B82F7F1F413A9F6995FAA18CDBB2"><enum>(A)</enum><text>the date that such authorization expires; or</text></subparagraph> 
<subparagraph commented="no" id="H85CEF410182B46B5BCE2614E6E7B5159"><enum>(B)</enum><text>the date that is 90 days after the date of the enactment of this Act.</text></subparagraph></paragraph></subsection></section> 
<section id="H5B87616C7DCB4966BE28ABBDB177F938" display-inline="no-display-inline" section-type="subsequent-section"><enum>405.</enum><header>No rights under the FISA Amendments Act of <enum-in-header>2008</enum-in-header> for undocumented aliens</header><text display-inline="no-display-inline">This Act and the amendments made by this Act shall not be construed to prohibit surveillance of, or grant any rights to, an alien not permitted to be in or remain in the United States.</text></section> 
<section id="HD73BA9A0554B46D1BB36D13D9849646B"><enum>406.</enum><header>Surveillance to protect the United States</header><text display-inline="no-display-inline">This Act and the amendments made by this Act shall not be construed to prohibit the intelligence community (as defined in section 3(4) of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/401a">50 U.S.C. 401a(4)</external-xref>)) from conducting lawful surveillance that is necessary to—</text> 
<paragraph id="H12A4AF58FDA64B9EA3EE2C5DDB8D1FE6" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">prevent Osama Bin Laden, al Qaeda, or any other terrorist or terrorist organization from attacking the United States, any United States person, or any ally of the United States;</text></paragraph> 
<paragraph id="HD56018871776401F8CD76C1AA972013" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">ensure the safety and security of members of the United States Armed Forces or any other officer or employee of the Federal Government involved in protecting the national security of the United States; or</text></paragraph> 
<paragraph id="HD29C5C437FF747369049477FA011EB02" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">protect the United States, any United States person, or any ally of the United States from threats posed by weapons of mass destruction or other threats to national security.</text></paragraph></section></title>
