2.It is the intent of
Congress in this Act—
(1)to safeguard
certain National Forest System lands in the Tongass National Forest in Alaska
in perpetuity to preserve the wilderness values of these lands;
(2)to guarantee the
public’s use and enjoyment of these lands through nondestructive uses,
including hunting, fishing, hiking, camping, and wildness appreciation;
and
(3)to continue to
provide an opportunity for residents of Alaska to engage in a subsistence way
of life.
3.In this Act, the term
Alaska Rainforest Map means the map entitled Alaska
Rainforest Conservation Proposal for the Tongass National Forest
and
dated September 10, 2007, which was prepared in connection with this
Act.
<enum>I</enum><header>Additional
Wilderness Areas in Tongass National Forest</header>
<section id="H3F2A27A06B254823A88416EC406D5E6E"><enum>101.</enum><header>Designation of
wilderness areas, Tongass National Forest</header><text display-inline="no-display-inline">In furtherance of the provisions of the
Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>), certain public lands within the
Tongass National Forest in Alaska, which together comprise approximately
3,231,200 acres and are depicted as <quote>Proposed Wilderness</quote> on the
Alaska Rainforest Map, are hereby designated as wilderness. The wilderness
areas are deemed to be incorporated into the indicted wilderness area
designated by section 703 of the Alaska National Interest Lands Conservation
Act (<external-xref legal-doc="public-law" parsable-cite="pl/96/487">Public Law 96–487</external-xref>; 94 Stat. 2418) or shall be an additional component of
the National Wilderness Preservation System, with the nomenclature and
approximate acreage as follows:</text>

public lands within the Tongass National Forest in Alaska, which together
comprise approximately 5,793,200 acres and are depicted on the Alaska
Rainforest Map as <quote>LUDII areas</quote>, are hereby designated as Land Use
Designation II lands, with the nomenclature and approximate acreage described
in the amendment made by subsection (b).</text>
</subsection><subsection id="H9E46193461D44C5880A9ED1139A35BB2"><enum>(b)</enum><header>Description of
designated areas</header><text>Section 508 of the Alaska National Interest
Lands Conservation Act, as added by section 201 of the Tongass Timber Reform
Act (<external-xref legal-doc="public-law" parsable-cite="pl/101/626">Public Law 101–626</external-xref>; 104 Stat. 4428), is amended—</text>

management rule</header><text>In managing the LUD II management areas

these areas with existing roads shall be managed as restoration areas under
section 301(c) of the <short-title>Alaska Rainforest
Conservation

</subsection></section><enum>III</enum><header>Restoration
areas in Tongass National Forest</header>
<section id="H5993BFEC7EC04E9CBEA063ED5B775192"><enum>301.</enum><header>Designation of
restoration areas</header>
<subsection id="H9A426CA1DBD64C0B8B435D00983E48FC"><enum>(a)</enum><header>Description</header><text>Restoration
areas in the Tongass National Forest are areas that have suffered environmental
damage from clearcutting, poorly constructed roads, or other land management
activities.</text>
</subsection><subsection id="HDB924E198FC74BBF93C00EDE67EAD8B"><enum>(b)</enum><header>Designation</header><text>The
following public lands within the Tongass National Forest in Alaska, which
together comprise approximately 29,000 acres and are depicted on the Alaska
Rainforest Map, are hereby designated as restoration areas for purposes of this
section:</text>
<paragraph id="HB6076609018C4C3C9FCFF581B85EA130"><enum>(1)</enum><text>Basket Bay
Restoration, consisting of approximately 3,900 acres and given map reference
#87.</text>
</paragraph><paragraph id="H8764538E67704A79AEA0CD273E4F002E"><enum>(2)</enum><text>North Prince of
Wales Restoration, consisting of approximately 25,100 acres and given map
reference #88.</text>
</paragraph></subsection><subsection id="HB54E67C3D5A14B25B67B954CB3AD5D25"><enum>(c)</enum><header>Management</header>
<paragraph id="HB011B201CA93428D804EF102C69B699"><enum>(1)</enum><header>In
general</header><text>The Secretary of Agriculture shall manage the restoration
areas designated by this section to restore their natural condition over the
short- and long-term.</text>
</paragraph><paragraph id="HEAD3689E4767401F85174C48F0C79057"><enum>(2)</enum><header>Road
closure</header><text>The Secretary shall close all roads (except vital
transportation links designated by the Secretary) in the restoration areas as
soon as possible after the date of the enactment of this Act and rehabilitate
the closed roads to a natural condition.</text>
</paragraph><paragraph id="H56281ABE559F4EA89F8BAC2B12A5A4A8"><enum>(3)</enum><header>Logged and other
damaged lands</header><text>The Secretary shall allow logged lands in the
restoration areas to return to a natural condition over time. Damage to stream
banks and other natural features shall be restored, with the goal of returning
the affected area to its natural state.</text>
</paragraph></subsection></section><enum>IV</enum><header>Special
Management Areas in Tongass National Forest</header>
<section id="H815B9D7EC2B240AC8301F100B46BCF99"><enum>401.</enum><header>Designation of
Special Management Areas</header>
<subsection id="H940122E6C5714C3A94AA6CF9F5ED9928"><enum>(a)</enum><header>Description</header><text>Special
Management Areas in the Tongass National Forest are areas subject to special
management as described in this section to protect the lands while still
allowing small-scale, community-based development of renewable resources that
are consistent with community needs, values, and traditions.</text>
</subsection><subsection id="H7AB5BA143ADE4F5ABD17F9D62B8D4DAE"><enum>(b)</enum><header>Designation</header><text>The
following public lands within the Tongass National Forest in Alaska, which
together comprise approximately 43,100 acres, are hereby designated as special
management areas for purposes of this section:</text>
<paragraph id="HE7A47916BD994D3CA1ECFFC374D4900"><enum>(1)</enum><text>Edna Bay Special
Management, consisting of approximately 16,600 acres and given map reference
#89.</text>
</paragraph><paragraph id="H3C1690931BD74ED2AB5768D1B29E9859"><enum>(2)</enum><text>Tenakee Special
Management, consisting of approximately 11,500 acres and given map reference
#91.</text>
</paragraph><paragraph id="H22E61564557D4A8300CE562FE37EE988"><enum>(3)</enum><text>Yakutat Beach
Special Management, consisting of approximately 15,000 acres and given map
reference #90.</text>
</paragraph></subsection><subsection id="HF499D342E21A41719D001245C3D86933"><enum>(c)</enum><header>Management</header><text>In
managing the special management areas designated by this section, the Secretary
of Agriculture shall prohibit the clearcutting and similar even-age management
of trees and the construction of any new roads, except for spur roads. Spur
roads are defined as extending no more than <fraction>1/4</fraction> mile from
an existing road and will either be closed or obliterated after project
activity ceases.</text>
</subsection></section><enum>V</enum><header>Wild,
Scenic, and Recreational Rivers in Tongass National Forest</header>
<section id="H115167609491416F9024363006935649"><enum>501.</enum><header>Designation of
wild, scenic, and recreational rivers</header><text display-inline="no-display-inline">Section 3 of the Wild and Scenic Rivers Act
(<external-xref legal-doc="usc" parsable-cite="usc/16/1274">16 U.S.C. 1274</external-xref>) is amended by adding at the end the following new
subsection:</text>

Forest, Alaska</header><text display-inline="yes-display-inline">In addition to

subsection (a), the following rivers and the land adjacent thereto are hereby
designated as components of the national wild and scenic rivers system:</text>
<paragraph id="HF0E615F2DCC54724B5715BBCC1CA29C0"><enum>(1)</enum><header>Antler
River</header><text>Approximately 13 miles of river within VCU 13 and 14 of the
Tongass National Forest, beginning at the Antler Glacier approximately 9 miles
downstream to the confluence with the Gilkey River and then approximately 4
miles downstream to its terminus at Berners Bay, to be administered by the
Secretary of Agriculture as a wild river.</text>
</paragraph><paragraph id="HE241FC5398B648CBA85B70C79C4CE227"><enum>(2)</enum><header>Gilkey
River</header><text>Approximately 9 miles of river within VCU 14 and 15 of the
Tongass National Forest, from the Gilkey Glacier to the confluence with the
Antler River, to be administered by the Secretary of Agriculture as a wild
river.</text>

river</header><text>Approximately 12 miles of river within VCU 12 of the
Tongass National Forest, from the Kakuhan Mountains to Berners Bay, to be

</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
</section><section id="H76DB201ED1854B51B773620631CF5959"><enum>502.</enum><header>Special
administrative provisions</header>
<subsection id="HF7520D4B3C7844D8925D5C96C4661F38"><enum>(a)</enum><header>Boundaries and
management plans</header><text>Within five years after the date of the
enactment of this Act, the Secretary of Agriculture shall take such action as
is necessary to establish detailed boundaries and formulate detailed management
plans for the components of the national wild and scenic rivers system
designated by this title.</text>
</subsection><subsection id="H530782ED6FAF4CEEA2CD466BC29542EF"><enum>(b)</enum><header>Adjacent lands;
withdrawal</header><text>Notwithstanding any provision to the contrary in
sections 3 and 9 of the Wild and Scenic Rivers Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1274">16 U.S.C. 1274</external-xref>, 1280), with
respect to each component of the national wild and scenic rivers system
designated by this title—</text>
<paragraph id="H08874BE8C58842F98EA6F2BC966061E"><enum>(1)</enum><text>the boundary of
each component shall include an average of not more than 640 acres per mile on
both sides of the river; and</text>
</paragraph><paragraph id="H72063F6C57504225AED8FD5BAE59B25F"><enum>(2)</enum><text>the withdrawal
made by clause (iii) of section 9(a) of such Act shall apply to the minerals in
Federal lands that constitute the bed or bank or are situated within
<fraction>1/2</fraction> mile from both sides of the component.</text>
</paragraph></subsection></section><enum>VI</enum><header>General
provisions</header>
<section id="H1097E0D8B3114D5781C192884F096E89"><enum>601.</enum><header>Maps and legal
description</header>
<subsection id="H71B5F97A17A741DFA14894BD91F9084D"><enum>(a)</enum><header>Submission</header><text>As
soon as practicable after the date of the enactment of this Act, the Secretary
of Agriculture shall submit to Congress a map and legal description of each
wilderness area, wilderness study area, Land Use Designation II management
area, restoration area, and special management area designated by this Act or
an amendment made by this Act.</text>
</subsection><subsection id="H31CA1C0E97CE4B098B962E61289C063C"><enum>(b)</enum><header>Force of
law</header><text>A map and legal description submitted under subsection (a)
shall have the same force and effect as if included in this Act, except that
the Secretary may correct clerical and typographical errors in the map and
legal description.</text>
</subsection><subsection id="H3BB11B6DA0F44C22B49759006EE834EE"><enum>(c)</enum><header>Public
availability</header><text>Each map and legal description submitted under
subsection (a) shall be filed and made available for public inspection in the
Office of the Chief of the Forest Service.</text>
</subsection></section><section id="H3C5ED9DB2A23455EA9CB9C9C1251364E"><enum>602.</enum><header>Fish and
wildlife</header><text display-inline="no-display-inline">Nothing in this Act
affects the jurisdiction of the State of Alaska with respect to wildlife and
fish on the public lands located in the State.</text>
</section><section id="HD2EDCDCFBF174190ACD7CDDE323E29CE"><enum>603.</enum><header>Management of
newly acquired lands</header><text display-inline="no-display-inline">Any land
within the boundaries of a wilderness area, wilderness study area, Land Use
Designation II management area, restoration area, or special management area
designated by this Act or an amendment made by this Act that is acquired by the
Federal Government after the date of the enactment of this Act shall—</text>
<paragraph id="H0327CF822B344CBDA29E04A8AC38E83C"><enum>(1)</enum><text>become part of the
wilderness area, wilderness study area, Land Use Designation II management
area, restoration area, or special management area in which the land is
located; and</text>
</paragraph><paragraph id="H0809B90941F94C69A662978F50674B55"><enum>(2)</enum><text>be managed in
accordance with the applicable title of this Act and other laws applicable to
such area.</text>
</paragraph></section><section id="H0DBB83E7CF5247E100ED03FEB28FF37"><enum>604.</enum><header>Water
rights</header>
<subsection id="H9E0E7410E1D2462190E0903C9BF36D4C"><enum>(a)</enum><header>Wilderness area
reservation</header><text>With respect to each wilderness area designated by
this Act, Congress hereby reserves a quantity of water sufficient to fulfill
the purposes of this Act. The priority date of such reserved water rights shall
be the date of the enactment of this Act. The Federal water rights so reserved
are specific to the wilderness areas located in Alaska designated under this
Act.</text>
</subsection><subsection id="H4A63E1A0BB90479D93005C32B876DA08"><enum>(b)</enum><header>Duties of
Secretary of Agriculture</header><text>The Secretary of Agriculture and all
other officers of the United States shall take all steps necessary to protect
the rights reserved by this section, including the filing by the Secretary of a
claim for the qualification of such rights in any present or future appropriate
stream adjudication in the courts of the State of Alaska in which the United
States is or may be joined and which is conducted in accordance with section
208 of the Act of July 10, 1952 (<external-xref legal-doc="usc" parsable-cite="usc/44/666">44 U.S.C. 666</external-xref>; commonly referred to as the
McCarran Amendment).</text>
</subsection><subsection id="HEC2D9C12F60C4A96B759B5A901CDD6FF"><enum>(c)</enum><header>Relation to
other reservations</header><text>Nothing in this Act shall be construed as a
relinquishment or reduction of any water rights reserved or appropriated by the
United States in the State of Alaska on or before the date of enactment of this
Act.</text>
</subsection><subsection id="HCAF599FDCB4D4AB08548C47D29E9C26B"><enum>(d)</enum><header>No precedents
established</header><text>Nothing in the Act related to the reserved Federal
water rights shall be construed as establishing a precedent with regard to any
future designations, nor shall it constitute an interpretation of any other Act
or any designation made thereto.</text>
</subsection></section><section id="H4D06C848DF4F44FB98B129D5CF559E97"><enum>605.</enum><header>Withdrawal</header><text display-inline="no-display-inline">Subject to valid rights existing on the date
of the enactment of this Act, the Federal land within a wilderness area,
wilderness study area, Land Use Designation II management area, restoration
area, or special management area designated by this Act or an amendment made by
this Act is withdrawn from all forms of—</text>
<paragraph id="HAF616D32462145C4A209A5B51F70B8D"><enum>(1)</enum><text>entry,
appropriation, or disposal under public law;</text>
</paragraph><paragraph id="H1590091C274C415BA8C2F359CF78BCC0"><enum>(2)</enum><text>location, entry,
and patent under mining law; and</text>
</paragraph><paragraph id="H6DE522395A034244B000FA54225EE3C"><enum>(3)</enum><text>disposition under
all laws pertaining to mineral and geothermal leasing or mineral
materials.</text>
