<official-title>To amend <external-xref legal-doc="usc" parsable-cite="usc/40/1308">section 1308</external-xref> of title 40, United States Code, to provide immunity for Federal Government agencies from claims resulting from the donation of unfit horses and mules and to allow certain agents of United States Customs and Border Protection to adopt such horses and mules.</official-title>

<section id="H582D1261E9044BD39CA54690006D7B2B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Immunity from Claims Related to Donated Horses Act of 2007</short-title></quote>.</text></section> 
<section id="H6177106B300E4A8797C11C25990765A0"><enum>2.</enum><header>Immunity from claims related to donated horses</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/40/1308">Section 1308</external-xref> of title 40, United States Code, is amended—</text> 
<paragraph id="HD1CACC8320764B13BC6402D7ABE4372D"><enum>(1)</enum><text>by striking <quote>Subject to applicable regulations</quote> and inserting the following: </text> 
<quoted-block style="OLC" id="H566294DA50004FFC92F58668E03D4BAB" display-inline="no-display-inline"> 
<subsection id="H9C0C95D0BD574EC0B3367DC725DA5689"><enum>(a)</enum><header>Disposition</header> 
<paragraph id="HA88CB3D58BFA44BB8D917000CA48B9C8"><enum>(1)</enum><header>In general</header><text>Subject to applicable regulations </text></paragraph></subsection> <after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HD7E0B8FEBD7D4931BFE1F8FF4FDBA52"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text> 
<quoted-block style="USC" id="H8F2C3D5BE29C4767A1F64F43F2429C09" display-inline="no-display-inline"> 
<paragraph id="H9B713BB6C8984EED93528DD1B1E7BFB0"><enum>(2)</enum><header>Immunity from claims</header><text display-inline="yes-display-inline">Each humane organization that receives any horse or mule under paragraph (1) shall hold the Department of Homeland Security, including United States Customs and Border Protection, harmless from any demand, suit, action, or claim of any nature arising from or related to the donation of the horse or mule, including damages to the property of the organization and any personal injury, disability, or death of any officer, employee, or agent of the organization. </text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H8B25B38ACAD74520BDC5148257263868"><enum>3.</enum><header>Adoption of unfit horses and mules</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/40/1308">Section 1308</external-xref> of title 40, United States Code, as amended by section 2, is further amended by adding at the end the following new subsection:</text>

<subsection id="H2D70CAE898E84015AC516FA617CD8092"><enum>(b)</enum><header>Adoption</header><text>Subject to regulations implementing this subsection, horses and mules belonging to the Federal Government that have become unfit for service may be adopted by any agent of the Department of Homeland Security who worked with any such horse or mule.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>
