		<section display-inline="no-display-inline" id="H8AEC365956214911B8DA48BCBD696423" section-type="section-one"><enum>1.</enum><header>EPA authority to accept
			 diesel emissions reduction Supplemental Environmental Projects</header><text display-inline="no-display-inline">The Administrator of the Environmental
			 Protection Agency (hereinafter, the <quote>Agency</quote>) may accept
			 (notwithstanding sections <external-xref legal-doc="usc" parsable-cite="usc/31/3302">3302</external-xref> and <external-xref legal-doc="usc" parsable-cite="usc/31/1301">1301</external-xref> of title 31, United States Code) diesel
			 emissions reduction Supplemental Environmental Projects if the projects, as
			 part of a settlement of any alleged violations of environmental law—</text>
			<paragraph id="H44C60EDB5C1E4B5585F04E776C3EE18B"><enum>(1)</enum><text>protect human
			 health or the environment;</text>
			</paragraph><paragraph id="HE5E65BAF839C45C49F5F683E879237C9"><enum>(2)</enum><text>are related to the
			 underlying alleged violations;</text>
			</paragraph><paragraph id="H36FE8D2CB4E74752A89F367E493B6BE0"><enum>(3)</enum><text>do not constitute
			 activities that the defendant would otherwise be legally required to perform;
			 and</text>
			</paragraph><paragraph id="H9A6A05D104A54913841C337EB03CBEC9"><enum>(4)</enum><text>do not provide
			 funds for the staff of the Agency or for contractors to carry out the Agency’s
			 internal operations.</text>
