<section id="HDF192D31BB2447C9993206A8606BA08E" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Raritan Bay Stewardship Initiative of 2007</short-title></quote>.</text></section> 
<section id="H099B4ED9FC0149D2806E2F4F43FB58A4"><enum>2.</enum><header>Findings and purpose</header> 
<subsection id="H9F8F618BE48A4413A7CDD9BA6F5B9127"><enum>(a)</enum><header>Findings</header><text>The Congress finds the following:</text> 
<paragraph id="H021134383A1E4D8CB45FECF3D3E0001B"><enum>(1)</enum><text>Raritan Bay, located in New York and New Jersey, is a national treasure of great cultural, environmental, and ecological importance.</text></paragraph> 
<paragraph id="HDA7341D431C840D1BA91AAD8243F6899"><enum>(2)</enum><text>2,400,000 people live within the Raritan Bay watershed.</text></paragraph> 
<paragraph id="HC6A0D464D3444839AF21773ECD2942C2"><enum>(3)</enum><text>The portion of the shoreline of Raritan Bay that is accessible to the general public (estimated at less than 50 percent of the total shoreline) is not adequate to serve the needs of the people living in the area.</text></paragraph> 
<paragraph id="HD2350874056C4A16AF6BB7F5CDE7051E"><enum>(4)</enum><text>Existing shoreline facilities are in many cases overburdened and under funded.</text></paragraph> 
<paragraph id="H5AF5CB5FA1474040A9AD7F9656591683"><enum>(5)</enum><text>Large parcels of open space already in public ownership are strained by the effort to balance the demand for recreation with the needs of sensitive natural resources.</text></paragraph> 
<paragraph id="HB804466CF748426F9416C0C6D53CB1B"><enum>(6)</enum><text>Approximately 80 percent of the tidal marshes of Raritan Bay have been filled, and much of the remaining marshes have been ditched, dyked, or impounded, reducing the ecological value of the marshes.</text></paragraph> 
<paragraph id="H71E5017E0978477BB6F267FF0608DEE3"><enum>(7)</enum><text>Much of the remaining exemplary natural landscape is vulnerable to further development.</text></paragraph></subsection> 
<subsection id="H827C23246C5446638FC3078CBC2C4FE1"><enum>(b)</enum><header>Purpose</header><text>The purpose of this Act is to establish the Raritan Bay Stewardship Initiative to identify, protect, and enhance sites within the Raritan Bay ecosystem with significant ecological, educational, open space, public access, or recreational value through a bi-State network of sites best exemplifying these values.</text></subsection></section> 
<section id="H8A0544D69E65401A8BBA56A415052F5C"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="HFEBE9257A9EA4D8BA5824FB1B7135846"><enum>(1)</enum><header>Adaptive management</header><text>The term <term>adaptive management</term> means a scientific process—</text> 
<subparagraph id="HB6C7DE98D3414981B2DFAE511CFB96F6"><enum>(A)</enum><text>for—</text> 
<clause id="HD4B96EE7E5CC4CDB913DC4BBE240743F"><enum>(i)</enum><text>developing predictive models;</text></clause> 
<clause id="H54D2AF4CDA8B4336B7540024057BB7F"><enum>(ii)</enum><text>making management policy decisions based upon the model outputs;</text></clause> 
<clause id="H5B16AB1AD85245E98C5E37ADEAB54D5B"><enum>(iii)</enum><text>revising the management policies as data become available with which to evaluate the policies; and</text></clause> 
<clause id="H5B797A0E5AA84248AD24F2004E4CE550"><enum>(iv)</enum><text>acknowledging uncertainty, complexity, and variance in the spatial and temporal aspects of natural systems; and</text></clause></subparagraph> 
<subparagraph id="H66DE197A962745B2841C68013CE6B1F6"><enum>(B)</enum><text>that requires that management be viewed as experimental.</text></subparagraph></paragraph> 
<paragraph id="HC71FD9C3F8374EA18FF9C3E15FB52DF"><enum>(2)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text></paragraph> 
<paragraph id="H18494662A46C4701A7A4925465345B62"><enum>(3)</enum><header>Advisory Committee</header><text>The term <term>Advisory Committee</term> means the Raritan Bay Stewardship Advisory Committee established by section 5(a).</text></paragraph> 
<paragraph id="H7F0C07FF4BBC449E83ACC990D46E5273"><enum>(4)</enum><header>Region</header><text>The term <term>Region</term> means the Raritan Bay Stewardship Initiative Region established by section 4(a).</text></paragraph> 
<paragraph id="HDF26F9B1E5364FAEBA1B81CD30A0D4EF"><enum>(5)</enum><header>States</header><text>The term <term>States</term> means the States of New York and New Jersey.</text></paragraph> 
<paragraph id="HD9D6078313014FC7B215FB7EDD3804AF"><enum>(6)</enum><header>Stewardship site</header><text>The term <term>stewardship site</term> means a site that—</text> 
<subparagraph id="HF189DB276FBC4EADA837A523A634B82F"><enum>(A)</enum><text>qualifies for identification by the Advisory Committee under section 8; and</text></subparagraph> 
<subparagraph id="HDB9DA9AE7B0C44FA8FF366F74067EF09"><enum>(B)</enum><text>is an area of land or water or a combination of land and water—</text> 
<clause id="H8403C57C04AE40318200E0CD67000200"><enum>(i)</enum><text>that is in the Region; and</text></clause> 
<clause id="HB7AB11B20BCC4C08B5E83010F5531CAC"><enum>(ii)</enum><text>that is—</text> 
<subclause id="HCF4B7C2624B340FDBFBB0050295C7043"><enum>(I)</enum><text>Federal, State, local, or tribal land or water;</text></subclause> 
<subclause id="HE8FA8B11D00749C7AE76A1DB04B168E8"><enum>(II)</enum><text>land or water owned by a nonprofit organization; or</text></subclause> 
<subclause id="HE117F47D0520457BB5BD096C00762C59"><enum>(III)</enum><text>privately owned land or water.</text></subclause></clause></subparagraph></paragraph> 
<paragraph id="HA55B8A2C43D34A1AB1BB007D6578D17C"><enum>(7)</enum><header>Systematic site selection</header><text>The term <term>systematic site selection</term> means a process of selecting stewardship sites that—</text> 
<subparagraph id="H1580B4CFDF5F4D31A92F9FFBFB76D62"><enum>(A)</enum><text>has explicit goals, methods, and criteria;</text></subparagraph> 
<subparagraph id="HAE92C0C0B63042079B97E7DA580008D"><enum>(B)</enum><text>produces feasible, repeatable, and defensible results;</text></subparagraph> 
<subparagraph id="HCD73D5B09004466C9D266686A640D3E"><enum>(C)</enum><text>provides for consideration of natural, physical, and biological patterns;</text></subparagraph> 
<subparagraph id="HB3D4BA03EC5D4AF5B100AA6263D881AE"><enum>(D)</enum><text>addresses reserve size, replication, connectivity, species viability, location, and public recreation values;</text></subparagraph> 
<subparagraph id="H8BA792B981FF45659C175505A84C6DAD"><enum>(E)</enum><text>uses geographic information systems technology and algorithms to integrate selection criteria; and</text></subparagraph> 
<subparagraph id="H861BA1F64CE645AB838EE3666CB96600"><enum>(F)</enum><text>will result in achieving the goals of stewardship site selection at the lowest cost.</text></subparagraph></paragraph> 
<paragraph id="H6EC3FCE33B48440D007912AC3A1024B"><enum>(8)</enum><header>Qualified applicants</header><text>The term <term>qualified applicant</term> means a person or governmental entity applying for designation of a site as a stewardship site. The person or entity must own property within the boarders of the proposed stewardship site or own property that is both physically or ecologically connected to the proposed site and would benefit from management as part of the proposed site.</text></paragraph> 
<paragraph id="H374A3557F7A24560A12FBA9F9F05F68B"><enum>(9)</enum><header>Threat</header><text>The term <term>threat</term> means a threat that is likely to destroy or seriously degrade a conservation target or a recreation area.</text></paragraph></section> 
<section id="H31E1D88EE37A4E7AAC0142C44EA14BA"><enum>4.</enum><header>Raritan Bay Stewardship Initiative Region</header> 
<subsection id="H37381500E00A438000685BA3B0AF46B5"><enum>(a)</enum><header>Establishment</header><text>There is established in the States the Raritan Bay Stewardship Initiative Region.</text></subsection> 
<subsection id="H46AA163E399A47A28010895E63E17124"><enum>(b)</enum><header>Boundaries</header><text>The Region shall encompass the immediate coastal upland and underwater areas along Raritan Bay, including those portions of the Bay with coastally influenced vegetation.</text></subsection></section> 
<section id="H0DCB6E34699C4AB188D146F1C97E8D8"><enum>5.</enum><header>Raritan Bay Stewardship Advisory Committee</header> 
<subsection id="H884B541C99C7442F982678003DED45D2"><enum>(a)</enum><header>Establishment</header><text>There is established a committee to be known as the <quote>Raritan Bay Stewardship Advisory Committee</quote>.</text></subsection> 
<subsection id="H80E9DCF5BF124C8E9F2D3010B00FCFA"><enum>(b)</enum><header>Chairperson</header><text>The Chairperson of the Advisory Committee shall be the Director of the Region 2 Office of the Environmental Protection Agency, or a designee of the Director.</text></subsection> 
<subsection id="HE4156442D55E466DA6C78F677100D790"><enum>(c)</enum><header>Membership</header> 
<paragraph id="H3F92192937B94A1AB931228D86C3742E"><enum>(1)</enum><header>Composition</header> 
<subparagraph id="H4DAF135CE66F471DBE60370595A350C3"><enum>(A)</enum><header>Appointment of members</header> 
<clause id="HFAA596708AAD4F9991C64322664A180"><enum>(i)</enum><header>In general</header><text>The Chairperson shall appoint the members of the Advisory Committee in accordance with this subsection and section 320(c) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1330">33 U.S.C. 1330(c)</external-xref>); except that the Governor of a State may appoint 2 members of the Advisory Committee.</text></clause> 
<clause id="HB53B34BCDF774E629C31A284868B2B03"><enum>(ii)</enum><header>Additional members</header><text>In addition to the requirements described in clause (i), the Advisory Committee shall include—</text> 
<subclause id="HFC65366060C246FFA0E2A0CAF4EFF500"><enum>(I)</enum><text>a representative from the Regional Plan Association;</text></subclause> 
<subclause id="H76F66819DEE540B3BD9806A6BA76D188"><enum>(II)</enum><text>a representative of the marine trade organizations; and</text></subclause> 
<subclause id="HF726D14F90F24F12B961C7403637C99"><enum>(III)</enum><text>a representative of private landowner interests.</text></subclause></clause></subparagraph> 
<subparagraph id="H9C63A6500A9C42478043CC064B216C4C"><enum>(B)</enum><header>Representation</header><text>In appointing members to the Advisory Committee, the Chairperson shall consider—</text> 
<clause id="HA12423930B0F41C2BF646D30325BDCDA"><enum>(i)</enum><text>Federal, State, and local government interests;</text></clause> 
<clause id="HBF4BF0D70519440ABFF250C65D00D26D"><enum>(ii)</enum><text>the interests of nongovernmental organizations;</text></clause> 
<clause id="HE400B6CF01D2418FBE34D321296BA11F"><enum>(iii)</enum><text>academic interests;</text></clause> 
<clause id="H3A4602070609468EAEC0C9E0B374044"><enum>(iv)</enum><text>private interests; and</text></clause> 
<clause id="H602BBB0925484265B38ED0E918B4FE54"><enum>(v)</enum><text>recreational and commercial fishing interests</text></clause></subparagraph></paragraph> 
<paragraph id="H35565CFA27414F48A21844948B6955BA"><enum>(2)</enum><header>Date of appointments</header><text>Not later than 180 days after the date of enactment of this Act, the appointment of all members of the Advisory Committee shall be made.</text></paragraph></subsection> 
<subsection id="HA20602C9DCA64E4CB4828CF396F6FC07"><enum>(d)</enum><header>Term; vacancies</header> 
<paragraph id="H383DC4152E214473AF1E4E8F9DFAA97C"><enum>(1)</enum><header>Term</header> 
<subparagraph id="HBEBA2301D55543EFA5C65FBC628ED793"><enum>(A)</enum><header>In general</header><text>A member shall be appointed for a term of 4 years.</text></subparagraph> 
<subparagraph id="H625CC0D47F5541BC8C00CDD4F4B5B363"><enum>(B)</enum><header>Multiple terms</header><text>A person may be appointed as a member of the Advisory Committee for more than 1 term.</text></subparagraph></paragraph> 
<paragraph id="H894A6D5597554E14A6E2722DB1602E5"><enum>(2)</enum><header>Vacancies</header><text>A vacancy on the Advisory Committee shall—</text> 
<subparagraph id="H620A3E67B1A14C1DADE2BCAD8B001441"><enum>(A)</enum><text>be filled not later than 90 days after the vacancy occurs;</text></subparagraph> 
<subparagraph id="HCF40A8596545410CA5B6A3AD10926E09"><enum>(B)</enum><text>not affect the powers of the Advisory Committee; and</text></subparagraph> 
<subparagraph id="HC3CD2DF679414C43A90000E39F343F69"><enum>(C)</enum><text>be filled in the same manner as the original appointment was made.</text></subparagraph></paragraph> 
<paragraph id="H6D8204688E604CC084A5A2688BE4F723"><enum>(3)</enum><header>Staff</header> 
<subparagraph id="H3BFDA79FD9B04D7F8CDF8EDED51773EA"><enum>(A)</enum><header>In general</header><text>The Chairperson of the Advisory Committee may appoint and terminate personnel as necessary to enable the Advisory Committee to perform the duties of the Advisory Committee.</text></subparagraph> 
<subparagraph id="HB4C0A10FBCF14CD280D826E8854C76E2"><enum>(B)</enum><header>Personnel as Federal employees</header> 
<clause id="H12547394B043483FAB5E7D516D851B6C"><enum>(i)</enum><header>In general</header><text>Any personnel of the Advisory Committee who are employees of the Advisory Committee shall be employees under <external-xref legal-doc="usc" parsable-cite="usc/5/2105">section 2105</external-xref> of title 5, United States Code, for purposes of chapters 63, 81, 83, 84, 85, 87, 89, and 90 of that title.</text></clause> 
<clause id="HE4B4B4E4C51B4BDC80CD61839D46F33E"><enum>(ii)</enum><header>Members of Advisory Committee</header><text>Clause (i) does not apply to members of the Advisory Committee.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="HBF13FB8018444A5EB0FBFD89004E79F6"><enum>(e)</enum><header>Initial meeting</header><text>Not later than 30 days after the date on which all members of the Advisory Committee have been appointed, the Advisory Committee shall hold the initial meeting of the Advisory Committee.</text></subsection> 
<subsection id="H4776C76EDC224A570081AE848403017F"><enum>(f)</enum><header>Meetings</header> 
<paragraph id="H9F114AF6353D4886823F6E92F86269D1"><enum>(1)</enum><header>In general</header><text>The Advisory Committee shall meet at the call of the Chairperson, but no fewer than 4 times each year.</text></paragraph> 
<paragraph id="H4DF7C8713C1B4E48BDA6463F40F3A9E1"><enum>(2)</enum><header>Quorum</header><text display-inline="yes-display-inline">A majority of the members of the Advisory Committee shall constitute a quorum, but a lesser number of members may hold hearings.</text></paragraph></subsection> 
<subsection display-inline="no-display-inline" id="HF17D74B9B73F44B69B021F7CC223ABE9"><enum>(g)</enum><header>Termination of Advisory Committee</header><text>The Advisory Committee shall terminate on December 31, 2014.</text></subsection></section> 
<section id="HEEC0E0A11D924510B6BF6D18316544CD"><enum>6.</enum><header>Duties of the Advisory Committee</header><text display-inline="no-display-inline">The Advisory Committee shall—</text> 
<paragraph id="H9FC39D6137084E618B6E282F8100704D"><enum>(1)</enum><text>consistent with section 8—</text> 
<subparagraph id="H64AFAD8A2BAA4B83BF63F1C1CEFA15FA"><enum>(A)</enum><text>evaluate applications from government or nonprofit organizations qualified to hold conservation easements for funds to purchase land or development rights for stewardship sites;</text></subparagraph> 
<subparagraph id="HE0CC9D0768E547AC8DF80169B3F834E"><enum>(B)</enum><text>evaluate applications to develop and implement management plans to address threats;</text></subparagraph> 
<subparagraph id="H944712864A8743B1892181277F3818B7"><enum>(C)</enum><text>evaluate applications to act on opportunities to protect and enhance stewardship sites; and</text></subparagraph> 
<subparagraph id="H1E2895953F53409194E6DCE714449601"><enum>(D)</enum><text>recommend that the Administrator award grants to qualified applicants;</text></subparagraph></paragraph> 
<paragraph id="HD7B26761DC7841608096A80098476474"><enum>(2)</enum><text>develop recommended guidelines, criteria, schedules, and due dates for evaluating information to identify stewardship sites;</text></paragraph> 
<paragraph id="HF24D4C20B1F743EAABAC95F1C997D44B"><enum>(3)</enum><text>publish a list of sites that further the purposes of this Act after—</text> 
<subparagraph id="H57A9BC45EBA143B500899F65E9BC3FA"><enum>(A)</enum><text>notifying the owners of the sites; and</text></subparagraph> 
<subparagraph id="HA84461765E3547B08644A9637200C09"><enum>(B)</enum><text>providing the owners an opportunity to decline inclusion on the list;</text></subparagraph></paragraph> 
<paragraph id="H58F63D4E81224585AF72DC88DFB3E950"><enum>(4)</enum><text>raise awareness of the values of and threats to these sites; and</text></paragraph> 
<paragraph id="H3E52A931243242819E37BBE474B6961B"><enum>(5)</enum><text>leverage additional resources for improved stewardship of the Region.</text></paragraph></section> 
<section id="H259B42EAA6AD48AEAFFFE6CFC1C0B1D1"><enum>7.</enum><header>Powers of the Advisory Committee</header> 
<subsection id="H836F621AEFF64C01005E516770A19D9D"><enum>(a)</enum><header>Hearings</header><text>The Advisory Committee may hold such hearings, meet and act at such times and places, take such testimony, and receive such evidence as the Advisory Committee considers advisable to carry out this Act.</text></subsection> 
<subsection id="H8B2E36F35DE94D7C98C5633B238F991E"><enum>(b)</enum><header>Information from federal agencies</header> 
<paragraph id="H4EDA7901F7A347A39F5527BF8200F4A6"><enum>(1)</enum><header>In general</header><text>The Advisory Committee may secure directly from a Federal agency such information as the Advisory Committee considers necessary to carry out this Act.</text></paragraph> 
<paragraph id="H6769AA502DA449D0BAB54DBDB7F019D7"><enum>(2)</enum><header>Provision of information</header> 
<subparagraph id="H15BF9AAD359B4399B967C28CEF9EC8E6"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (C), on request of the Chairperson of the Advisory Committee, the head of a Federal agency shall provide the information requested by the Chairperson to the Advisory Committee.</text></subparagraph> 
<subparagraph id="H5A3397732A554A98A57B46FC395BB5B"><enum>(B)</enum><header>Administration</header><text>The furnishing of information by a Federal agency to the Advisory Committee shall not be considered a waiver of any exemption available to the agency under <external-xref legal-doc="usc" parsable-cite="usc/5/552">section 552</external-xref> of title 5, United States Code.</text></subparagraph> 
<subparagraph id="H0C4CC12AB8ED4A5780003DE437DB2277"><enum>(C)</enum><header>Information to be kept confidential</header> 
<clause id="H36268A4EB5E54398B5F99F8F540021F9"><enum>(i)</enum><header>In general</header><text>For purposes of <external-xref legal-doc="usc" parsable-cite="usc/18/1905">section 1905</external-xref> of title 18, United States Code—</text> 
<subclause id="H18CE49119D014BB88F07A849EB3D3F7"><enum>(I)</enum><text>the Advisory Committee shall be considered an agency of the Federal Government; and</text></subclause> 
<subclause id="H46B6B5BD0A9C44A69EC3D4F85713DF7"><enum>(II)</enum><text>any individual employed by an individual, entity, or organization that is a party to a contract with the Advisory Committee under this Act shall be considered an employee of the Advisory Committee.</text></subclause></clause> 
<clause id="H1D557C7D12C14ED4888444C446514308"><enum>(ii)</enum><header>Prohibition on disclosure</header><text>Information obtained by the Advisory Committee, other than information that is available to the public, shall not be disclosed to any person in any manner except to an employee of the Advisory Committee as described in clause (i) for the purpose of receiving, reviewing, or processing the information.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="H6EF789F337B7446D82E57EDEAC44D362"><enum>(c)</enum><header>Postal services</header><text>The Advisory Committee may use the United States mails in the same manner and under the same conditions as other agencies of the Federal Government.</text></subsection> 
<subsection id="HF2EE76229FC9448AA1BFA925977B188F"><enum>(d)</enum><header>Donations</header><text>The Advisory Committee may accept, use, and dispose of donations of services or property that advance the goals of the Raritan Bay Stewardship Initiative.</text></subsection></section> 
<section id="H3480EF7ED76E4694008FA70058CC9F54"><enum>8.</enum><header>Stewardship sites</header> 
<subsection id="HE3BE0D1CD5C24694A1DAAC5950003F96"><enum>(a)</enum><header>Initial Sites</header><text></text> 
<paragraph id="H1B9592A6CC2F4004A33E1F5192008001"><enum>(1)</enum><header>Identification</header> 
<subparagraph id="H303286C2857F43B9A074E321BD4F6701"><enum>(A)</enum><header>In general</header><text>The Advisory Committee shall identify 20 initial Raritan Bay stewardship sites that the Advisory Committee has determined—</text> 
<clause id="H9F4A99D7ED0043BB92D32D4FFBC8F23"><enum>(i)</enum> 
<subclause commented="no" display-inline="yes-display-inline" id="H1B70B54CDA8B406BB3D8898499C4BA34"><enum>(I)</enum><text>are natural resource-based recreation areas; or</text></subclause> 
<subclause id="H723904288F4A4080BEF13C033580C7EA" indent="up1"><enum>(II)</enum><text>are exemplary natural areas with ecological value; and</text></subclause></clause> 
<clause id="H61C30F29282A45C4A8BACBA3E664BF8"><enum>(ii)</enum><text>best promote the purposes of this Act.</text></clause></subparagraph> 
<subparagraph id="H89E802926A9040B8BC2F95E0B3E92CB8"><enum>(B)</enum><header>Exemption</header><text>Identification of initial Raritan Bay Stewardship Sites described under subparagraph (A) are not subject to the site identification process described in subsection (d).</text></subparagraph></paragraph> 
<paragraph id="HE1AD559F9E9F4DFBA126D9130400BB93"><enum>(2)</enum><header>Equitable distribution of funds for initial sites</header><text>In identifying initial sites under paragraph (1), the Advisory Committee shall exert due diligence to seek to ensure an equitable distribution of funds between the States for the initial sites.</text></paragraph></subsection> 
<subsection id="HB33211E97AAA4FA582061C15C1BE0095"><enum>(b)</enum><header>Application for Identification as a Stewardship Site</header><text>Subsequent to the identification of the initial stewardship sites under subsection (a), owners of sites may submit applications to the Advisory Committee in accordance with subsection (c) to have the sites identified as stewardship sites.</text></subsection> 
<subsection id="H45A61F6C35EA4B648CD6A432F9E1E19E"><enum>(c)</enum><header>Identification</header><text>The Advisory Committee shall review applications submitted by owners of potential stewardship sites to determine whether the sites should be identified as exhibiting values consistent with the purposes of this Act.</text></subsection> 
<subsection id="HE4D8C6DA05BE4197B8B1A633AFA01957"><enum>(d)</enum><header>Site Identification Process</header><text></text> 
<paragraph id="HC4DCFBA42B49453C9D24B5150069B9F0"><enum>(1)</enum><header>Natural resource-based recreation areas</header><text>The Advisory Committee shall identify additional potential recreation areas as stewardship sites using a selection technique that includes—</text> 
<subparagraph id="H1515A982A52947B1906990F0AA9350D5"><enum>(A)</enum><text>public access;</text></subparagraph> 
<subparagraph id="H084B335F019546239E00009145C93DA4"><enum>(B)</enum><text>community support;</text></subparagraph> 
<subparagraph id="HA97DC213127E4CA2A9E711E39E14336B"><enum>(C)</enum><text>areas with high population density;</text></subparagraph> 
<subparagraph id="HE08551B249D54B9297D010C4EBED9CAC"><enum>(D)</enum><text>connectivity to existing protected areas and open spaces;</text></subparagraph> 
<subparagraph id="H9D59E15E905A427C80F98BB03613B778"><enum>(E)</enum><text>cultural, historic, and scenic areas; and</text></subparagraph> 
<subparagraph id="H0E3FB12BC6F040C287F4A5A7FC4CCBB2"><enum>(F)</enum><text>other criteria developed by the Advisory Committee.</text></subparagraph></paragraph> 
<paragraph id="HAB2C06A5A5004027B7F279961526616"><enum>(2)</enum><header>Natural areas with ecological value</header><text>The Advisory Committee shall identify additional natural areas with ecological value and potential as stewardship sites to recommend to the Administrator—</text> 
<subparagraph id="H3D5579E6BDB947DCA076FD6F26D456E0"><enum>(A)</enum><text>based on measurable conservation targets for the Region; and</text></subparagraph> 
<subparagraph id="H6311CE3BFD1A4F04AF5D7BA17F8FC415"><enum>(B)</enum><text>following a process for prioritizing new sites using systematic site selection, that shall include—</text> 
<clause id="HA147DA325EA348ABB18C20096E6EA659"><enum>(i)</enum><text>ecological uniqueness;</text></clause> 
<clause id="HD37551CE016A4DE200F39915DC480087"><enum>(ii)</enum><text>species viability;</text></clause> 
<clause id="HCE3838325A4A479AA4ABFB627BB9C9BA"><enum>(iii)</enum><text>habitat heterogeneity;</text></clause> 
<clause id="H74606006C85D463BBF4E1F9CE92CC052"><enum>(iv)</enum><text>size;</text></clause> 
<clause id="H01E0DD2C34164886897B4927C41B476B"><enum>(v)</enum><text>quality;</text></clause> 
<clause id="H2377B22BC6E3476EB1570091251976BF"><enum>(vi)</enum><text>connectivity to existing protected areas and open spaces;</text></clause> 
<clause id="HD1BDE854C9164F528182E930D3D3C27"><enum>(vii)</enum><text>land cover;</text></clause> 
<clause id="H34C693C7AE8941E9A5C1A1E39DCE2DE1"><enum>(viii)</enum><text>scientific, research, or educational value;</text></clause> 
<clause id="HA0F21DF7B73048D686805E8EE4C0DF24"><enum>(ix)</enum><text>threats; and</text></clause> 
<clause id="H306C0F8BEBB1433A94ACEBA9A8A055AE"><enum>(x)</enum><text>other criteria developed by the Advisory Committee.</text></clause></subparagraph></paragraph> 
<paragraph id="H08CD4CAB3F1E4640AACECD2D488BECB"><enum>(3)</enum><header>Publication of list</header><text>After completion of the site identification process, the Advisory Committee shall—</text> 
<subparagraph id="H4DBF74D61D5C4303B9C2A0305B4C41B1"><enum>(A)</enum><text>publish in the Federal Register a list of sites that further the purposes of this Act; and</text></subparagraph> 
<subparagraph id="HB30AA1B5C7BA418BA1917BA13B16478E"><enum>(B)</enum><text>prior to publication of the list, provide to owners of the sites to be published—</text> 
<clause id="H0F160D11D7C74A3497B580F289989400"><enum>(i)</enum><text>a notification of publication; and</text></clause> 
<clause id="H6E8EDDEAFFA443DF8B61F89901AFA42E"><enum>(ii)</enum><text>an opportunity to decline inclusion of the site of the owner on the list.</text></clause></subparagraph></paragraph> 
<paragraph id="H002870D7F06A4ECFA3511FDA5C004400"><enum>(4)</enum><header>Deviation from process</header> 
<subparagraph id="H887D247C0EF8408199EFDE2321899BF6"><enum>(A)</enum><header>In general</header><text>The Advisory Committee may identify as a potential stewardship site to recommend to the Administrator, a site that does not meet the criteria in paragraph (1) or (2), if the Advisory Committee—</text> 
<clause id="H1409823B9226465AA87957AC2D3DF2DF"><enum>(i)</enum><text>selects a site that makes significant ecological or recreational contributions to the Region;</text></clause> 
<clause id="H9B9C809CAAEF48BE918DAA6E6DFD9CAA"><enum>(ii)</enum><text>publishes the reasons that the Advisory Committee decided to deviate from the systematic site selection process; and</text></clause> 
<clause id="HFAA7C5354F1945668BD6D5B9DF521976"><enum>(iii)</enum><text>before identifying the potential stewardship site, provides to the owners of the site the notification of publication, and the opportunity under paragraph (3)(B) to decline inclusion of the site on the list published under paragraph (3)(A).</text></clause></subparagraph></paragraph> 
<paragraph id="H2BBBBC0E7AFF42C39508229322673909"><enum>(5)</enum><header>Public comment</header><text>In identifying potential stewardship sites, the Advisory Committee shall consider public comments.</text></paragraph></subsection> 
<subsection id="H92C060BE681E4954B0B08B4F40014455"><enum>(e)</enum><header>General guidelines for management</header><text></text> 
<paragraph id="H9E8EA9ED4A22426EA436D67506468024"><enum>(1)</enum><header>In general</header><text>The Advisory Committee shall use an adaptive management framework to identify the best policy initiatives and actions through—</text> 
<subparagraph id="HB333C996996A4141A659BA6232CC87A7"><enum>(A)</enum><text>definition of strategic goals;</text></subparagraph> 
<subparagraph id="H238544A95AFE4A14A98710CAE42329B4"><enum>(B)</enum><text>definition of policy options for methods to achieve strategic goals;</text></subparagraph> 
<subparagraph id="HABED59F80B4A4262828941B51549BA7D"><enum>(C)</enum><text>establishment of measures of success;</text></subparagraph> 
<subparagraph id="HFDD8FD7BFC05474B97A824ADCD9B914E"><enum>(D)</enum><text>identification of uncertainties;</text></subparagraph> 
<subparagraph id="H01516D13AF3C464B0070F47B16754E71"><enum>(E)</enum><text>development of informative models of policy implementation;</text></subparagraph> 
<subparagraph id="H5B4C05FB2EBF4D12A4B242014CCE328C"><enum>(F)</enum><text>separation of the landscape into geographic units;</text></subparagraph> 
<subparagraph id="H0443FEA6950542C49C9FBBCCABFAF734"><enum>(G)</enum><text>monitoring key responses at different spatial and temporal scales; and</text></subparagraph> 
<subparagraph id="HCBA4876856D54650A83FCCA4ED7F9653"><enum>(H)</enum><text>evaluation of outcomes and incorporation into management strategies.</text></subparagraph></paragraph> 
<paragraph id="H577BD0F7D84F4B51961198F5E4FF7E55"><enum>(2)</enum><header>Application of adaptive management framework</header><text>The Advisory Committee shall apply the adaptive management framework to the process for updating the list of recommended stewardship sites.</text></paragraph></subsection></section> 
<section id="H66112F73DA0945D1BBD267E0D5225CF8"><enum>9.</enum><header>Reports</header> 
<subsection id="HA34915C63ABE40708DBB24C8062F1935"><enum>(a)</enum><header>In general</header><text>For each of fiscal years 2008 through 2015, the Advisory Committee shall submit to the Administrator an annual report that contains—</text> 
<paragraph id="H8EE87E64B45D43BC997FB93041239B03"><enum>(1)</enum><text>a detailed statement of the findings and conclusions of the Advisory Committee since the last report;</text></paragraph> 
<paragraph id="H6B93E219D5DF4A44BA0626288BD26EC3"><enum>(2)</enum><text>a description of all sites identified and recommended by the Advisory Committee to be approved as stewardship sites;</text></paragraph> 
<paragraph id="HB927F6506804436AA488990082051200"><enum>(3)</enum><text>the recommendations of the Advisory Committee for such legislation and administrative actions as the Advisory Committee considers appropriate; and</text></paragraph> 
<paragraph id="H6B65B522A35B4AA8B5298B77649B04A3"><enum>(4)</enum><text>in accordance with subsection (b), the recommendations of the Advisory Committee for the awarding of grants.</text></paragraph></subsection> 
<subsection id="H5E80C8D6A70B4B41971FD81C6251C31C"><enum>(b)</enum><header>General Guidelines for Recommendations</header> 
<paragraph id="HD86BF87CB5FB4F22831CA7E64C1B6B90"><enum>(1)</enum><header>In general</header><text>The Advisory Committee shall recommend that the Administrator award grants to qualified applicants to help to secure and improve the open space, public access, or ecological values of stewardship sites, through—</text> 
<subparagraph id="H9B4941EACAFE49F388C54CB4F39F573"><enum>(A)</enum><text>purchase of the property of the site;</text></subparagraph> 
<subparagraph id="H54216F0171ED41A5921C5B744FB92334"><enum>(B)</enum><text>purchase of relevant property rights of the site; or</text></subparagraph> 
<subparagraph id="H328A0E9D57784A54B4BB00B20236F0E9"><enum>(C)</enum><text>entering into any other binding legal arrangement that ensures that the values of the site are sustained, including entering into an arrangement with a land manager or owner to develop or implement an approved management plan that is necessary for the conservation of natural resources.</text></subparagraph></paragraph> 
<paragraph id="H84A8A891BD494FDE94B4B79654509182"><enum>(2)</enum><header>Equitable distribution of funds</header><text>The Advisory Committee shall exert due diligence to recommend an equitable distribution of funds between the States.</text></paragraph></subsection> 
<subsection id="H3654E05159044922B4C0EB0600C3A26C"><enum>(c)</enum><header>Action by the Administrator</header> 
<paragraph id="H290E7FA4A61B46EDA3AF49896010856C"><enum>(1)</enum><header>In general</header><text>Not later than 90 days after receiving a report under subsection (a), the Administrator shall—</text> 
<subparagraph id="H3C3D48442A1A4CEB0028421213F3DAEE"><enum>(A)</enum><text>review the recommendations of the Advisory Committee; and</text></subparagraph> 
<subparagraph id="HD13BC7FED6D44F01B28228F2FFA1CA4"><enum>(B)</enum><text>take actions consistent with the recommendations of the Advisory Committee, including the approval of identification of stewardship sites and the award of grants under this Act, unless the Administrator makes a finding that any recommendation is unwarranted by the facts.</text></subparagraph></paragraph> 
<paragraph id="HCE0674DB753841D3816538BD6E227121"><enum>(2)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this Act, the Administrator shall develop and publish a report that—</text> 
<subparagraph id="HB902C16C54E74A6DA8EE9E6564B12DC7"><enum>(A)</enum><text>assesses the current resources of and threats to Raritan Bay;</text></subparagraph> 
<subparagraph id="HB5A58DAE5AFB45D58C3B372B1E009256"><enum>(B)</enum><text>assesses the role of the Raritan Bay Stewardship Initiative in protecting Raritan Bay;</text></subparagraph> 
<subparagraph id="H0C1FF56664174AB686B79877A9F611A3"><enum>(C)</enum><text>establishes guidelines, criteria, schedules, and due dates for evaluating information to identify stewardship sites;</text></subparagraph> 
<subparagraph id="H3095AF3835CF4FEDBB8C103780BB6141"><enum>(D)</enum><text>includes information about any grants that are available for the purchase of land or property rights to protect stewardship sites pursuant to this Act;</text></subparagraph> 
<subparagraph id="H2EA462C5CED945679B027577C200E870"><enum>(E)</enum><text>accounts for funds received and expended during the previous fiscal year pursuant to this Act;</text></subparagraph> 
<subparagraph id="H4C7D254A8BC8420EA7CD394597718600"><enum>(F)</enum><text>shall be made available to the public on the Internet and in printed form; and</text></subparagraph> 
<subparagraph id="H6712091913664A16947D232EF745FC38"><enum>(G)</enum><text>shall be updated at least every other year, except that information on funding and any new stewardship sites identified shall be published more frequently.</text></subparagraph></paragraph></subsection></section> 
<section id="HE3A463207FC049BBBBB205C3A60247A"><enum>10.</enum><header>Private property protection</header> 
<subsection id="H9B94EC4493744A819D3081515086D3AB"><enum>(a)</enum><header>Access to private property</header><text>Nothing in this Act—</text> 
<paragraph id="H58EA7886887A49C6863FF79B6591A58C"><enum>(1)</enum><text>requires any private property owner to allow public access (including Federal, State, or local government access) to the private property; or</text></paragraph> 
<paragraph id="HB1392FC080C6459CAA937009534EDA58"><enum>(2)</enum><text>modifies any provision of Federal, State, or local law with regard to public access to or use of private property, except as entered into by voluntary agreement of the owner or custodian of the property.</text></paragraph></subsection> 
<subsection id="H419DFDCFEC824AAD98FE56BEDF3922F"><enum>(b)</enum><header>Liability</header><text>Establishment of the Raritan Bay Stewardship Initiative Region under this Act does not create any liability, or have any effect on any liability under any other law, of any private property owner with respect to any person injured on the private property.</text></subsection> 
<subsection id="H7DD8701D8035421E8E87E6F3B042803"><enum>(c)</enum><header>Recognition of authority To control land use</header><text>Nothing in this Act modifies the authority of Federal, State, or local governments to regulate land use.</text></subsection> 
<subsection id="HAE67BB24DACA405B9FA147FF07A7906D"><enum>(d)</enum><header>Participation of private property owners in the raritan bay stewardship initiative region</header><text>Nothing in this Act requires the owner of any private property located within the boundaries of the Region to participate in or be associated with the Initiative.</text></subsection> 
<subsection id="H8B51C95BA231484BB871FEA2A3E7D000"><enum>(e)</enum><header>Effect of Establishment</header> 
<paragraph id="HB76F0DBD6E544444854710EC2C469CC6"><enum>(1)</enum><header>In general</header><text>The boundaries of the Region under this Act constitute the only area within which Federal funds appropriated for the purpose of this Act may be expended.</text></paragraph> 
<paragraph id="H73A3F4A24E58495F8726A0621795B622"><enum>(2)</enum><header>Regulatory authority</header><text>The establishment of the Region and the boundaries of the Region do not provide any authority to regulate land use in the Region by any management entity, except for such property rights as may be purchased from or donated by the owner of the property (including the Federal Government or a State or local government, if applicable).</text></paragraph></subsection></section> 
<section id="HB6D72A0C6E2B40B79FBB352BEAE42687"><enum>11.</enum><header>Authorization of appropriations</header> 
<subsection id="H2BBF29ACEC0C482192ABC29DD9769247"><enum>(a)</enum><header>In general</header><text>There is authorized to be appropriated to carry out this Act $25,000,000 for each of fiscal years 2007 through 2014 for use by the Administrator pursuant to this Act, after reviewing the recommendations of the Advisory Committee submitted under section 9, for—</text> 
<paragraph id="HD704031900974E6FA3098EFFBCD38492"><enum>(1)</enum><text>award of grants for acquisition of land and interests in land;</text></paragraph> 
<paragraph id="HC49C9E7210564D2CA0ED788F03BEB8EE"><enum>(2)</enum><text>development and implementation of site management plans;</text></paragraph> 
<paragraph id="H8DC5FC276343473A91C6E5ECB75B7C58"><enum>(3)</enum><text>site enhancements to reduce threats or promote stewardship; and</text></paragraph> 
<paragraph id="HFEB3D524549A4AEAA2C9796200BDDB71"><enum>(4)</enum><text>administrative expenses of the Advisory Committee.</text></paragraph></subsection> 
<subsection id="H8FFAB457678A46A5BEC8B12B5C297354"><enum>(b)</enum><header>Federal share</header><text>The Federal share of the cost of an activity carried out using any grant or other assistance under this Act shall not exceed 75 percent of the total cost of the activity.</text></subsection></section>
