		<official-title>To amend the Internal Revenue Code of 1986 to allow for
		  expenditures from the Harbor Maintenance Trust Fund for certain harbor
		  construction activities, and for other purposes.</official-title>

		<section id="H63A897D4673B4BDAA622DEE4B55DA5C2" section-type="section-one"><enum>1.</enum><header>Automatic expenditures from
			 Harbor Maintenance Trust Fund</header>
			<subsection id="H4E1F5D2746784DDBBA23D5648EF46A3"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 9505 of the
			 Internal Revenue Code of 1986 (relating to Harbor Maintenance Trust Fund) is
			 amended by adding at the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="HA834E76B8CEF40B0B9FE24FD5FC170CF" style="OLC">
					<subsection id="HFF204A7E995B4FC6BAA307126CEE9AF"><enum>(d)</enum><header>Automatic
				expenditures from Harbor Maintenance Trust Fund</header>
						<paragraph id="HE8B59E58241C49CA9C725529215FA440"><enum>(1)</enum><header>In
				general</header><text>Amounts in the Harbor Maintenance Trust Fund shall be
				available, without regard to appropriation Acts, for making expenditures for
				the payment of 100 percent of the Federal share of harbor construction
				activities by the Secretary of the Army related to preserving geological
				structures which create natural harbors.</text>
						</paragraph><paragraph id="H18D26E53BF7345F799332D9B16CA3BE4"><enum>(2)</enum><header>Permitted
				expenditures</header><text>Appropriate expenditures permitted under paragraph
				(1) shall consist of—</text>
							<subparagraph id="H61ED61FF4F5E44B0ABA5180078216557"><enum>(A)</enum><text>annual shoreline
				erosion control projects, including breakwater construction and sand
				replenishment, and</text>
							</subparagraph><subparagraph id="HD855758AA729481FAEDCBB26248DC8BC"><enum>(B)</enum><text>an environmental
				mitigation or remediation component.</text>
							</subparagraph></paragraph><paragraph id="HC207EC423F2A456DA5E8D0B822D71C9E"><enum>(3)</enum><header>Project
				prioritization</header><text display-inline="yes-display-inline">In weighing
				whether a project contains an environmental mitigation or remediation
				component, the Secretary of the Army shall give priority to those projects
				containing a critical habitat (as defined by the Endangered Species Act of
				1973).</text>
						</paragraph><paragraph id="HEAFD20C0B3D0448F99CBA064386EFEF0"><enum>(4)</enum><header>Limitations</header>
							<subparagraph id="H5B053E901EB34F768473308455510306"><enum>(A)</enum><header>Limitation based
				on annual project limitation</header>
								<clause id="H7EB43EF665F84E9FB3CFD4C3FD8F6913"><enum>(i)</enum><header>In
				general</header><text>Amounts made available under paragraph (1) for any fiscal
				year for a project shall not exceed the annual project limitation.</text>
								</clause><clause id="H7AF416DDB6564F71943C1F8780AC6B6F"><enum>(ii)</enum><header>Annual project
				limitation</header>
									<subclause id="H2E4EBB7D0BA740A3A0F4D005D249C1C"><enum>(I)</enum><header>Surplus
				year</header><text display-inline="yes-display-inline">If the Secretary
				certifies that the Harbor Maintenance Trust Fund is projected to have a surplus
				for a fiscal year, the annual project limitation for that fiscal year is
				$2,000,000 per project.</text>
									</subclause><subclause id="HBD7FEE6599E945D88FF32B69C4EF02D8"><enum>(II)</enum><header>Nonsurplus
				year</header><text display-inline="yes-display-inline">If the Secretary
				certifies that the Harbor Maintenance Trust Fund is projected not to have a
				surplus for that fiscal year, the annual project limitation for that fiscal
				year is zero.</text>
									</subclause></clause><clause id="H6ED392D9CB884EF8BEBFDA487867E9B9"><enum>(iii)</enum><header>Annual
				certification</header><text display-inline="yes-display-inline">The Secretary
				shall, prior to the start of any Federal fiscal year, certify to Congress
				whether the Harbor Maintenance Trust Fund is projected to have a surplus in
				excess of $2,000,000 for that fiscal year (determined without regard to this
				subsection).</text>
								</clause></subparagraph><subparagraph id="H7F3A8FCD59C44AD8909DE9009CCAA1EF"><enum>(B)</enum><header>Limitation based
				on amounts in Fund</header><text display-inline="yes-display-inline">Amounts
				may not be made available for a project under paragraph (1) if doing so would
				result in a deficit in the Harbor Maintenance Trust
				Fund.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H6E1BBDB55AD649A0B300C6FBA7C4D7C5"><enum>(b)</enum><header>Effective
			 date</header><text>The amendment made by subsection (a) shall apply to
			 expenditures from the Harbor Maintenance Trust Fund for fiscal years beginning
			 after the date of the enactment of this Act.</text>
