		<official-title>To amend the Elementary and Secondary Education Act of
		  1965 to require the Secretary of Education to address conflicts of interest
		  associated with use of advisory committees and technical assistance providers
		  in the administration of such Act.</official-title>

		<section id="H545D0AD954154BB780E1A1FA17AF595E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Educational Advisor and Contractor
			 Integrity Act</short-title></quote>.</text>
		</section><section display-inline="no-display-inline" id="HB117CCDE55DD447B8FC150199B3126E3" section-type="subsequent-section"><enum>2.</enum><header>Preventing conflicts
			 of interest</header><text display-inline="no-display-inline">Subpart 2 of part
			 E of title IX of the Elementary and Secondary Education Act of 1965 (20 U.S.C.
			 7901 et seq.) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="H859FE626D43340D0B7EEAFCD83B189D6" other-style="education" style="other">
				<section id="H911E112AC4504F26B3B5858E5EF501D"><enum>9537.</enum><header>Preventing
				conflicts of interest</header>
					<subsection id="H6FB7AF8A74F84A93AB89765B194EC420"><enum>(a)</enum><header>Service on
				advisory committees</header>
						<paragraph id="H87C6177DAD594AA4B109BDFB056FBDC"><enum>(1)</enum><header>Screening process
				for advisory committee candidates</header>
							<subparagraph id="H7F6957BE08154F4CA100EC0177200079"><enum>(A)</enum><header>In
				general</header><text>The Secretary shall establish a screening process to
				address conflicts of interest on the part of an individual who is being
				considered for service on an advisory committee established or used by the
				Secretary in the administration of this Act or any part of this Act.</text>
							</subparagraph><subparagraph id="HA4E622AC6E994CFF9D1C065146ED6300"><enum>(B)</enum><header>Factors</header><text display-inline="yes-display-inline">In addition to the disclosure requirements
				of the Ethics in Government Act of 1978 (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/5/38">5 U.S.C. App. 38</external-xref>), the screening
				process shall consider whether an individual has—</text>
								<clause id="H823AB270BA734B71A61F27304DA80789"><enum>(i)</enum><text display-inline="yes-display-inline">a past (withing the preceding 3 years) or
				present professional affiliation with an organization that promotes a
				pedagogical approach that is linked to specific products or services;</text>
								</clause><clause id="H317FA3FD5AF346F6BB27DE34658EAC6B"><enum>(ii)</enum><text display-inline="yes-display-inline">a past (within the preceding 3 years) or
				present involvement with a State educational agency or a local educational
				agency that may receive funds under this Act; or</text>
								</clause><clause id="H962F57D7F09B438BADFDC6002900D983"><enum>(iii)</enum><text display-inline="yes-display-inline">a past (within the preceding 3 years) or
				present direct or an indirect financial interest in a product or service that
				may, in fact or appearance, compromise the integrity of the advice or
				recommendations of the individual.</text>
								</clause></subparagraph><subparagraph id="H0BA71B61D584491386C04ED6D500A2AD"><enum>(C)</enum><header>Waivers</header>
								<clause id="HA40ABDC2AEB24DF0A8AD469103CFBB6"><enum>(i)</enum><header>In
				general</header><text>Where an individual being considered for service on an
				advisory committee described in paragraph (1) has a conflict of interest, the
				Secretary may, in consultation with the Office of General Counsel, grant an
				exemption pursuant to <external-xref legal-doc="usc" parsable-cite="usc/18/208">section 208(b)(3)</external-xref> of title 18, United States Code, if,
				considering the additional requirements of this subsection—</text>
									<subclause id="H0D7F8AA30F8F4F6889C8842E959DE76E"><enum>(I)</enum><text display-inline="yes-display-inline">the Secretary can demonstrate that the
				conflict does not compromise the integrity, in fact or in appearance, of the
				efforts of the advisory committee;</text>
									</subclause><subclause id="H112ADAEDFFB74DE3979D6771D03E4100"><enum>(II)</enum><text>the conflict can
				be sufficiently mitigated; and</text>
									</subclause><subclause id="HE6FAD881376E4CF4AEAFADC23AD29F6"><enum>(III)</enum><text>the Secretary can
				demonstrate that reasonable efforts were made to identify alternate individuals
				not having a conflict.</text>
									</subclause></clause><clause id="HFCC1762668B9469F8C28EEAC07982169"><enum>(ii)</enum><header>Reporting</header><text display-inline="yes-display-inline">The Secretary shall provide to the Congress
				an annual report containing information on any exemption granted under clause
				(i) to an advisory committee member, which shall include—</text>
									<subclause id="H8E4090B2A7E74DAB83EE9375008B7F67"><enum>(I)</enum><text>the identity of
				each exempted individual;</text>
									</subclause><subclause id="HDF78982B743D46588F8CA5BEF675EFDB"><enum>(II)</enum><text>a detailed
				description of the conflict of interest;</text>
									</subclause><subclause id="H49E5D895719348F2809E2BC91273787B"><enum>(III)</enum><text>a detailed
				description of the efforts made to identify alternate individuals; and</text>
									</subclause><subclause id="HD2F775B16B744CAD9BAB25206DEE7348"><enum>(IV)</enum><text>a detailed
				description of the conflict mitigation efforts.</text>
									</subclause></clause></subparagraph></paragraph><paragraph id="H037DC4FA897442EF9F780000A3CC6EB1"><enum>(2)</enum><header>Advisory
				committee members</header>
							<subparagraph id="HD1A7BB902FB24B639DBF896F8005ACF2"><enum>(A)</enum><header>Policies and
				procedures</header><text display-inline="yes-display-inline">The Secretary
				shall work with the Office of Government Ethics pursuant to the Ethics in
				Government Act of 1978 (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/5/38">5 U.S.C. App. 38</external-xref>) to develop policies and procedures to
				address conflicts of interest on the part of an individual who is serving on an
				advisory committee described in paragraph (1), including, at a minimum, the
				adoption of an alternative confidential financial disclosure form for such
				individual.</text>
							</subparagraph><subparagraph id="HCDD9BD08C6214E43A913ED00B200C9EB"><enum>(B)</enum><header>Special
				government employees</header><text display-inline="yes-display-inline">An
				individual who is serving on an advisory committee described in paragraph (1)
				shall be considered a special Government employee, as defined in section 202(a)
				of title 18, United States Code, for purposes of chapter 11 of part I of such
				title.</text>
							</subparagraph></paragraph><paragraph id="H8D576F6742784827B68B9E3006927F34"><enum>(3)</enum><header>Secretariat</header><text display-inline="yes-display-inline">Prior to the convening of any group of
				individuals who will serve in a capacity to render advice or recommendations to
				the Secretary, the Secretary shall consult with the Committee Management
				Secretariat within the General Services Administration to obtain advice as to
				the applicability of Federal Advisory Committee Act (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/5/1">5 U.S.C. App. 1</external-xref>).</text>
						</paragraph><paragraph id="HF8C01708600646A1A6FC30D6F19FA67C"><enum>(4)</enum><header>Definition</header><text>For
				purposes of this subsection, the term <term>advisory committee</term> has the
				meaning given such term in section 3(2) of the Federal Advisory Committee Act
				(<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/5/1">5 U.S.C. App. 1</external-xref>).</text>
						</paragraph></subsection><subsection id="H138D84BAB93646E7BEC5F9C0D99E80E2"><enum>(b)</enum><header>Technical
				assistance</header>
						<paragraph id="H5F0F7CEA4A014A7E894439C59F50FE71"><enum>(1)</enum><header>Screening
				process for technical assistance provider candidates</header>
							<subparagraph id="H87FFF26FCA0D4A26B6EB7EEF534E049F"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary shall
				establish a screening process to address conflicts of interest on the part of
				individuals who, and entities that, are being considered for service as a
				technical assistance provider in the administration of this Act or any part of
				this Act.</text>
							</subparagraph><subparagraph id="H953386AD4DCB4EA4981D38DA78B6C7EB"><enum>(B)</enum><header>Elements</header><text display-inline="yes-display-inline">The screening process shall consider, among
				other factors, whether an individual or entity has—</text>
								<clause id="H6F41B01A87274A7080757392CDE5AAFF"><enum>(i)</enum><text display-inline="yes-display-inline">a past (withing the preceding 3 years) or
				present professional affiliation with an organization that promotes a
				pedagogical approach that is linked to specific products or services;</text>
								</clause><clause id="H91893D870D464F059621DF2700007294"><enum>(ii)</enum><text display-inline="yes-display-inline">a past (within the preceding 3 years) or
				present involvement with a State educational agency or a local educational
				agency that may receive funds under this Act; or</text>
								</clause><clause id="HED96BAE4030646C18D89E0728B4FFFA"><enum>(iii)</enum><text display-inline="yes-display-inline">a past (within the preceding 3 years) or
				present direct or an indirect financial interest in a product or service that
				may, in fact or in appearance, compromise the integrity of the technical
				assistance being provided.</text>
								</clause></subparagraph></paragraph><paragraph id="H20A8B132BF094EA19D02106124AFA2C"><enum>(2)</enum><header>Requirements for
				contracting</header>
							<subparagraph id="H4014B6CF1F7042649C99D3CB663F7C39"><enum>(A)</enum><header>Prior to
				award</header><text>The Secretary shall require that, prior to awarding a
				technical assistance contract, potential technical assistance providers—</text>
								<clause id="HBFADA6D9CE6C41FFAFF0A8ECC9159313"><enum>(i)</enum><text>provide
				documentary evidence that the technical assistance provider will adopt and
				effectively implement policies and procedures to address conflicts of interest;
				and</text>
								</clause><clause id="H8E7AECAC374447A5817300DD14E59B85"><enum>(ii)</enum><text>disclose any
				conflicts of interest.</text>
								</clause></subparagraph><subparagraph id="H0ACE6EA88514418ABE288E8863668024"><enum>(B)</enum><header>Contract
				terms</header><text display-inline="yes-display-inline">All technical
				assistance contracts shall require the technical assistance provider—</text>
								<clause id="HF0EA43DF680340DF9D7F197629A3CBF3"><enum>(i)</enum><text display-inline="yes-display-inline">to implement fully the conflicts of
				interest policies and procedures provided to the Secretary prior to awarding of
				the contract;</text>
								</clause><clause id="HAA625A0B9C7F4F2ABD20E9CAB2C539C6"><enum>(ii)</enum><text display-inline="yes-display-inline">to ensure that any subcontracted
				individuals or entities, at any tier, adopt and implement the same policies and
				procedures as the primary technical assistance provider; and</text>
								</clause><clause id="H6A63A2D769D54CAAB48630A4A1FB07B7"><enum>(iii)</enum><text display-inline="yes-display-inline">to report to the Secretary any previously
				unidentified conflicts and the measures taken to avoid or mitigate such
				conflicts not later than 10 days after becoming aware of such a
				conflict.</text>
								</clause></subparagraph></paragraph><paragraph id="H7D45C9BA913B40BAB7F8FE989B927C71"><enum>(3)</enum><header>Monitoring</header><text display-inline="yes-display-inline">The Secretary shall develop and implement a
				process to continually monitor whether technical assistance providers are
				appropriately implementing their conflict of interest policies and
				procedures.</text>
						</paragraph><paragraph id="H7925F6D70FDE40F0B26098714DE5E571"><enum>(4)</enum><header>Definition</header><text display-inline="yes-display-inline">For the purposes of this subsection, the
				term <term>technical assistance provider</term> means any entity or individual
				providing technical assistance in the administration of this Act, or any part
				of this Act, directly or indirectly, to the Secretary, or on behalf of the
				Secretary, including—</text>
							<subparagraph id="HEC4CC6F1E435460483EE75249F06F3A1"><enum>(A)</enum><text>a contractor;
				and</text>
							</subparagraph><subparagraph id="H3AC1A7B222EE4CD5996F94E88B5100CD"><enum>(B)</enum><text>a contractor’s
				subsidiaries, subcontractors, employees, and other agents and
				affiliates.</text>
							</subparagraph></paragraph></subsection><subsection id="H8B850A29314F45A486353F5BAA9BBFAD"><enum>(c)</enum><header>Deadline</header><text>The
				Secretary shall carry out the duties described in this section not later than
				180 days after the date of the enactment of this
				section.</text>
