<official-title>To amend the Consumer Product Safety Act to require independent safety certification of children’s products, to increase the Consumer Product Safety Commission’s inspection capability for imported products, and to prohibit hazardous imports based on manufacturing site, and for other purposes.</official-title>

<section id="H5C9213E8E8ED49D3A9A957692CFC161" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline"> This Act may be cited as the <quote><short-title>Safe Toys for Kids Act</short-title></quote>.</text></section> 
<section id="H1304909B7ED54B66989E50927684D959"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline"> The purpose of this Act and the amendments made by this Act is to prevent the introduction of dangerous toys and other products used by children into the marketplace by requiring independent third-party testing and certification that toys and other products intended for use by children comply with consumer product safety standards and rules before they enter the interstate stream of commerce.</text></section> 
<section id="HBD676218EC6F4F68ADA192AD37291DFD"><enum>3.</enum><header>Certification of compliance of children’s products with consumer product safety rules</header> 
<subsection id="HD7777CF0376D4A3888FB04031DAA1B9B"><enum>(a)</enum><header>Expansion of Certification Requirement</header><text>Subsection (a) of section 14 of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2063">15 U.S.C. 2063</external-xref>) is amended—</text> 
<paragraph id="H30CB306BA059465EB03E00133940771B"><enum>(1)</enum><text>by redesignating paragraph (2) as paragraph (5);</text></paragraph> 
<paragraph id="HC8177C15D4B44262B14E24E27C303905"><enum>(2)</enum><text>in paragraph (1)—</text> 
<subparagraph id="H1EBE5FD2F2CA42B58BD20062D023F3AB"><enum>(A)</enum><text>by striking <quote>Every manufacturer</quote> and inserting <quote>Except as provided in paragraph (2), every manufacturer</quote>; and</text></subparagraph> 
<subparagraph id="HEDB4D5E8DC8042B3B3D1485D923DE6E"><enum>(B)</enum><text>by designating the second and third sentences as paragraphs (3) and (4), respectively, and indenting the margin of such paragraphs, as so designated, 2 ems from the left margin;</text></subparagraph></paragraph> 
<paragraph id="H315DB91FFEBD404BADC9004CE334893"><enum>(3)</enum><text>by inserting after paragraph (1) the following:</text> 
<quoted-block id="H3E52DFA26DC24D3787E32DD89EDE49F0" style="OLC"> 
<paragraph id="HBD06C519486041A8B9E9A03694C12DB0"><enum>(2)</enum><text>Every manufacturer of a children’s product (and the private labeler of such product if it bears a private label) which is subject to a consumer product safety standard under this Act or a rule under this or any other Act administered by the Commission declaring a consumer product a banned hazardous product shall issue a certificate which shall certify that such product conforms to such consumer product safety standard or is not a banned hazardous product under such rule, and shall specify such consumer product safety standard or such rule.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HAE06974191EC4C329550E3D5388FE5A6"><enum>(4)</enum><text>in paragraph (3), as redesignated by paragraph (2)(B), by striking <quote>Such certificate shall</quote> and inserting <quote>A certificate required under this subsection shall</quote>; and</text></paragraph> 
<paragraph id="HE3554A5AF7134A5BA45532005BB143F9"><enum>(5)</enum><text>in paragraph (5), as redesignated by paragraph (1)—</text> 
<subparagraph id="H587465423BFE467EB56280C19985219B"><enum>(A)</enum><text>by striking <quote>required by paragraph (1) of this subsection</quote> and inserting <quote>required by paragraph (1) or (2) (as the case may be)</quote>; and</text></subparagraph> 
<subparagraph id="HA34CE1EEBF0F4C43B1A243E226BC28D4"><enum>(B)</enum><text>by striking <quote>requirement under paragraph (1)</quote> and inserting <quote>requirement under paragraph (1) or (2) (as the case may be)</quote>.</text></subparagraph></paragraph></subsection> 
<subsection id="H71772C24883B437AA0D122492CD3028E"><enum>(b)</enum><header>Third-Party Certification Required</header><text>Subsection 14(b) of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2063">15 U.S.C. 2063(b)</external-xref>) is amended—</text> 
<paragraph id="HECF3F0D0D49B4C08A8D716EBA56700FE"><enum>(1)</enum><text>by striking <quote>The Commission may</quote> and inserting <quote>(1) The Commission may</quote>;</text></paragraph> 
<paragraph id="H65A9C6332CD8404BA4E4A8470200B862"><enum>(2)</enum><text>by designating the second sentence as paragraph (2) and indenting the margin of such paragraph, as so designated, 2 ems from the left margin;</text></paragraph> 
<paragraph id="H1F52FF423A0E4A41B78CCE91CC77B14E"><enum>(3)</enum><text>in paragraph (2), as so designated, by striking <quote>Any test or</quote> and inserting <quote>Except as provided in paragraph (3), any test or</quote>; and</text></paragraph> 
<paragraph id="HD5E7679C20B24FCF894DB8E982100ED"><enum>(4)</enum><text>by adding at the end the following:</text>

<paragraph id="HC72626A6FBFB4EB5B81CA49922005123"><enum>(3)</enum><text>In the case of a children’s product, any test or testing program on the basis of which a certificate is issued under subsection (a)(2) shall be conducted by a nongovernmental independent third party qualified to perform such tests or testing programs.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H5EAB9A1B441542949B3CB1F42028A119"><enum>(c)</enum><header>Definition of Children’s Products and Independent Third Party</header><text>Section 14 of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2063">15 U.S.C. 2063</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block id="HD62D61DC138D46A8A8E3E51EAB00BF7E" style="OLC"> 
<subsection id="HD3FD17D747A7463C9F09F1649F567FDC"><enum>(d)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H4395782FF8FF4880B6002848A9F92500"><enum>(1)</enum><header>Children’s product</header><text>The term <term>children’s product</term> means a toy or other article intended for use by a child under 60 months of age that is introduced into the interstate stream of commerce. In determining whether a toy or article is intended for use by a child under 60 months of age, the following factors shall be considered:</text> 
<subparagraph id="H968BEF2296CF43B9B0E0BCD300384976"><enum>(A)</enum><text>A statement by a manufacturer about the intended use of such toy or article, including a label on such toy or article, if such statement is reasonable.</text></subparagraph> 
<subparagraph id="H71C93C4140C541D68FBBE856CA746B90"><enum>(B)</enum><text>The context and manner of the advertising, promotion, and marketing associated with the toy or article.</text></subparagraph> 
<subparagraph id="H728BB3E73B4249F384FA4F01B1EC3BA8"><enum>(C)</enum><text>Whether the toy or article is commonly recognized by consumers as being intended for use by a child under 60 months of age.</text></subparagraph> 
<subparagraph id="H485E3D271BD34B68A24715727036DE6D"><enum>(D)</enum><text>The Age Determination Guideline issued by the Consumer Product Safety Commission in September 2002 and any subsequent version of such Guideline.</text></subparagraph></paragraph> 
<paragraph id="H76F3F67606AF4E7EB4DA2E616300ECCC"><enum>(2)</enum><header>Independent third party</header><text>The term <term>independent third party</term>, with respect to a testing entity, means an independent testing entity that is physically separate from any manufacturer or private labeler whose product will be tested by such entity, and is not owned, managed, controlled, or directed by such manufacturer or private labeler.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H215FDE81AC8B42218126D2A811F6F0AF"><enum>(d)</enum><header>Label and Certification</header><text>Not later than 180 days after the date of the enactment of this Act, the Consumer Product Safety Commission shall prescribe a rule in accordance with subsection (c) of section 14 of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2063">15 U.S.C. 2063</external-xref>) for children’s products described in subsection (d)(1) of such section, as added by subsection (c) of this section.</text></subsection> 
<subsection id="H1037353575B049A49BC49E772F8E5B07"><enum>(e)</enum><header>Website listing of certified products</header><text>The Consumer Product Safety Commission shall post and maintain current in a clear and conspicuous location on its Internet website a list of all children’s products for which certificates have been issued under section 14(a)(2) of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2063">15 U.S.C. 2063</external-xref>).</text></subsection></section> 
<section id="H720CDC9B82A94647AA4DB08B0063C060"><enum>4.</enum><header>Prohibition on imports of children’s products without third-party testing certification</header><text display-inline="no-display-inline"> Section 17(a) of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2066">15 U.S.C. 2066</external-xref>) is amended—</text> 
<paragraph id="HAAEE08B213014F0AAE325205C3E0CEE5"><enum>(1)</enum><text>in paragraph (4), by striking <quote>or</quote> at the end;</text></paragraph> 
<paragraph id="H644F8557A9F749A7904CF9EFE27911B"><enum>(2)</enum><text>in paragraph (5), by striking the period at the end and inserting a semicolon and <quote>or</quote>; and</text></paragraph> 
<paragraph id="H8E1D17B3ADBA44B7AFEA378100A6E433"><enum>(3)</enum><text>by adding at the end the following:</text> 
<quoted-block id="H1CED8FB5D51741A1977FAE52E4D3D2E" style="OLC"> 
<paragraph id="H2CFA4C5414994C5DB8635D090034C2D9"><enum>(6)</enum><text>is a children’s product, as that term is defined in section 14(d), that is not accompanied by a certificate from a third-party verification entity required by section 14(a)(2).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H82EFF7C9DCC548B9A7E8E2D5F852C093" section-type="subsequent-section"><enum>5.</enum><header>Prohibited imports based on manufacturing site</header><text display-inline="no-display-inline">Section 17 of the Consumer Product Safety Commission (<external-xref legal-doc="usc" parsable-cite="usc/15/2066">15 U.S.C. 2066</external-xref>) is amended—</text> 
<paragraph id="H9FA24FC466974974A3AB33066F3E918E"><enum>(1)</enum><text>in subsection (a)—</text> 
<subparagraph id="H4C26C9F8BCD34ACE8D8B07B1B26E3A9"><enum>(A)</enum><text>in paragraph (4), by striking <quote>or</quote>;</text></subparagraph> 
<subparagraph id="H6A0613A801D64F10AC8922BD34AA00C8"><enum>(B)</enum><text>in paragraph (5), by striking the period and inserting <quote>; or</quote>; and</text></subparagraph> 
<subparagraph id="HD76476BC42AC4D068F1CDA6508CB2D42"><enum>(C)</enum><text>by adding at the end the following:</text> 
<quoted-block style="traditional" id="HFA3FB72A834A4FFC985270BC406D25EB" display-inline="no-display-inline"> 
<paragraph id="H75D0CA8BCD6441FFA7C3A70F56DCD1F"><enum>(6)</enum><text>is a product that was manufactured in a facility that the Commission has designated under subsection (i) a <quote>banned manufacturing site</quote>. </text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H1274D63282B74254A6E300A57F92F7EF"><enum>(2)</enum><text>by adding at the end the following:</text> 
<quoted-block style="traditional" id="HB88A2F2CB9D04B51ACCD08CB99E177F" display-inline="no-display-inline"> 
<subsection id="HEA515DF73FC74303A97E2226D712F34F"><enum>(i)</enum> 
<paragraph id="H63160A2CD0D14C828EB1E096FA2CBFA" display-inline="yes-display-inline"><enum>(1)</enum><text>The Commission may, by rule, designate as a banned manufacturing site any factory, warehouse, or other facility in which consumer products are manufactured, if the Commission determines—</text> 
<subparagraph id="H3A6DD16D2AC44AEBB9888E475F00D093"><enum>(A)</enum><text display-inline="yes-display-inline">such factory, warehouse, or other facility has regularly produced consumer products which fail to comply with any applicable consumer product safety standard; or</text></subparagraph> 
<subparagraph id="H525A94C31BD0420482E1FA5C0669B6BD"><enum>(B)</enum><text display-inline="yes-display-inline">upon inspection by the Commission, that such factory, warehouse, or other facility engages in acts or practices which are likely to result in the production of imminently hazardous consumer products.</text></subparagraph></paragraph> 
<paragraph id="H8CFE261EE73B4EB499AE8F2EDCA89014" indent="up1"><enum>(2)</enum><text>The designation under paragraph (1) shall be for such period of time as the Commission shall determine.</text></paragraph> 
<paragraph id="H23D9303E574A4FEBB55880E3AEB45C33" indent="up1" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">The Commission shall post in a clear and conspicuous location on its Internet website—</text> 
<subparagraph id="H1762D49D3DA5438ABBDBD8996CBE4914"><enum>(A)</enum><text>the names and location of each factory, warehouse, or other facility that the Commission designates a banned manufacturing site; and</text></subparagraph> 
<subparagraph id="H2654CDF4ACBD4885963648D691B2892E"><enum>(B)</enum><text>the names of all products produced at each factory, warehouse, or other facility.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H5FBD3B4778A948CC99BA291A5A0F7B5"><enum>6.</enum><header>Authorization of appropriations for CPSC</header> 
<subsection id="H8A6C27BAE2D0494CAE508B00B3218664"><enum>(a)</enum><header>Authorization of Appropriations</header><text display-inline="yes-display-inline">Section 32(a) of the Consumer Product Safety Commission (<external-xref legal-doc="usc" parsable-cite="usc/15/2081">15 U.S.C. 2081(a)</external-xref>) is amended by striking <quote>, not to exceed</quote> and all that follows through paragraph (2) and inserting <quote>such sums as may be necessary</quote>.</text></subsection> 
<subsection id="H6E2E8CAEA56B4E65ABA5DA001D8C7FCC"><enum>(b)</enum><header>Sense of Congress</header><text>It is the sense of Congress that—</text> 
<paragraph id="H4768DA77EB424E62A59E6F126D64BC08"><enum>(1)</enum><text>the Consumer Product Safety Commission should have at least 1 full-time inspector at each port of entry to the United States;</text></paragraph> 
<paragraph id="H298D3554BD2F4B6BB31BC9458E71A00"><enum>(2)</enum><text display-inline="yes-display-inline">that such inspectors should work closely with Customs officials and other Federal officials who monitor imported products; and</text></paragraph> 
<paragraph id="HD5712342340146AB91588218E0FBCD80"><enum>(3)</enum><text>that sufficient amounts should be appropriated to the Commission to enable the Commission to increase the number of full time inspectors to at least 340.</text></paragraph></subsection></section>
