		<section id="H1FCC4A8411B141318B604BABADB023E6" section-type="section-one"><enum>1.</enum><header>Short Title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>U.S. Capitol Police and Library of
			 Congress Police Merger Implementation Act of 2007</short-title></quote>.</text>
		</section><section id="HF9C0C7F4601F4F27A67268FA460015C"><enum>2.</enum><header>Transfer of
			 Personnel</header>
			<subsection id="H5F4B834965664A88B483666CFE7B27C3"><enum>(a)</enum><header>Transfers</header>
				<paragraph id="HF5D45FDF2128452B8EA860C6A9ED4E78"><enum>(1)</enum><header>Library of
			 Congress Police employees</header><text display-inline="yes-display-inline">Effective on the employee’s transfer date,
			 each Library of Congress Police employee shall be transferred to the United
			 States Capitol Police and shall become either a member or civilian employee of
			 the Capitol Police, as determined by the Chief of the Capitol Police under
			 subsection (b).</text>
				</paragraph><paragraph id="H3961A6F8547D45FE92BB7F177054C1F1"><enum>(2)</enum><header>Library of
			 Congress Police civilian employees</header><text display-inline="yes-display-inline">Effective on the employee’s transfer date,
			 each Library of Congress Police civilian employee shall be transferred to the
			 United States Capitol Police and shall become a civilian employee of the
			 Capitol Police.</text>
				</paragraph></subsection><subsection id="H46295F54AF93447797ACC2C4056700B6"><enum>(b)</enum><header>Treatment of
			 Library of Congress Police Employees</header>
				<paragraph id="H637563379D284E27A5B37189A03D1F12"><enum>(1)</enum><header>Determination of
			 status within Capitol Police</header>
					<subparagraph id="H1B3E6471077249DFA5D7AE3CDC7CBD5"><enum>(A)</enum><header>Eligibility to
			 serve as Members of the Capitol Police</header><text display-inline="yes-display-inline">A Library of Congress Police employee shall
			 become a member of the Capitol Police on the employee’s transfer date if the
			 Chief of the Capitol Police determines and issues a written certification that
			 the employee meets each of the following requirements:</text>
						<clause id="H295810209848485A82C555B8C527F612"><enum>(i)</enum><text display-inline="yes-display-inline">Based on the assumption that such employee
			 would perform a period of continuous Federal service after the transfer date,
			 the employee would be entitled to an annuity for immediate retirement under
			 section <external-xref legal-doc="usc" parsable-cite="usc/5/8336">8336(b)</external-xref> or <external-xref legal-doc="usc" parsable-cite="usc/5/8412">8412(b)</external-xref> of title 5, United States Code (as determined by
			 taking into account paragraph (3)(A)), on or before the date such employee
			 becomes 60 years of age.</text>
						</clause><clause id="HC589C88DF6E840A2A20005201DDBC6F3"><enum>(ii)</enum><text display-inline="yes-display-inline">During the transition period, the employee
			 successfully completes training, as determined by the Chief of the Capitol
			 Police.</text>
						</clause><clause id="HA0E3D5EBDA114412BC03247F5398F73D"><enum>(iii)</enum><text display-inline="yes-display-inline">The employee meets the qualifications
			 required to be a member of the Capitol Police, as determined by the Chief of
			 the Capitol Police.</text>
						</clause></subparagraph><subparagraph display-inline="no-display-inline" id="H4A3F9BCFA2734C8B82A010F6005EE342"><enum>(B)</enum><header>Service as
			 civilian employee of Capitol Police</header><text display-inline="yes-display-inline">If the Chief of the Capitol Police
			 determines that a Library of Congress Police employee does not meet the
			 eligibility requirements, the employee shall become a civilian employee of the
			 Capitol Police on the employee’s transfer date.</text>
					</subparagraph><subparagraph id="HC4FA15ABA1B046B880C35E989736C73"><enum>(C)</enum><header>Finality of
			 determinations</header><text display-inline="yes-display-inline">Any
			 determination of the Chief of the Capitol Police under this paragraph shall not
			 be appealable or reviewable in any manner.</text>
					</subparagraph><subparagraph id="H8613D0DCF9184CB8BEC22B2C18DFE541"><enum>(D)</enum><header>Deadline for
			 determinations</header><text>The Chief of the Capitol Police shall complete the
			 determinations required under this paragraph for all Library of Congress Police
			 employees not later than September 30, 2009.</text>
					</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H902E5BBCA5454F70B001CE8979E64355"><enum>(2)</enum><header>Exemption from
			 mandatory separation</header><text display-inline="yes-display-inline">Section
			 8335(c) or 8425(c) of title 5, United States Code, shall not apply to any
			 Library of Congress Police employee who becomes a member of the Capitol Police
			 under this subsection, until the earlier of—</text>
					<subparagraph id="H6D4B6C48ADF04727B4C094C097356D00"><enum>(A)</enum><text display-inline="yes-display-inline">the date on which the individual is
			 entitled to an annuity for immediate retirement under section 8336(b) or
			 8412(b) of title 5, United States Code; or</text>
					</subparagraph><subparagraph id="HBE4DE31EDB6C41F0BF65914687FF9360"><enum>(B)</enum><text display-inline="yes-display-inline">the date on which the individual—</text>
						<clause id="H2BA1B0E9928F4ED28D75732692BA872F"><enum>(i)</enum><text>is
			 57 years of age or older; and</text>
						</clause><clause id="HAA76C0EA5EA942F3BE0048EBB2A04DDF"><enum>(ii)</enum><text display-inline="yes-display-inline">is entitled to an annuity for immediate
			 retirement under section <external-xref legal-doc="usc" parsable-cite="usc/5/8336">8336(m)</external-xref> or <external-xref legal-doc="usc" parsable-cite="usc/5/8412">8412(d)</external-xref> of title 5, United States Code, (as
			 determined by taking into account paragraph (3)(A)).</text>
						</clause></subparagraph></paragraph><paragraph display-inline="no-display-inline" id="HE9E087F9B77348C6B4DC24677954486"><enum>(3)</enum><header>Treatment of
			 prior creditable service for retirement purposes</header>
					<subparagraph id="H97FB02C97C5B4F95AE8DEE326B9A839"><enum>(A)</enum><header>Prior service for
			 purposes of eligibility for immediate retirement as member of Capitol
			 Police</header><text display-inline="yes-display-inline">Any Library of
			 Congress Police employee who becomes a member of the Capitol Police under this
			 subsection shall be entitled to have any creditable service under section 8332
			 or 8411 of title 5, United States Code, that was accrued prior to becoming a
			 member of the Capitol Police included in calculating the employee's service as
			 a member of the Capitol Police for purposes of section 8336(m) or 8412(d) of
			 title 5, United States Code.</text>
					</subparagraph><subparagraph id="H1A18EC158E454A40B1B2501EB1FA3B91"><enum>(B)</enum><header>Prior service
			 for purposes of computation of annuity</header><text display-inline="yes-display-inline">Any creditable service under section 8332
			 or 8411 of title 5, United States Code, of an individual who becomes a member
			 of the Capitol Police under this subsection that was accrued prior to becoming
			 a member of the Capitol Police—</text>
						<clause id="HA8578F709BF346F5A5E332132D2309EC"><enum>(i)</enum><text display-inline="yes-display-inline">shall be treated and computed as employee
			 service under subsection 8339 or 8415; but</text>
						</clause><clause id="H20EDBD34ED56471E93FA00E7BB9B84C"><enum>(ii)</enum><text>shall not be
			 treated as service as a member of the Capitol Police or service as a
			 congressional employee for purposes of computing the amount of any benefit
			 payable out of the Civil Service Retirement and Disability Fund.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="HE4F939022F3D4B7F813BF0D33826D39F"><enum>(c)</enum><header>Duties of
			 Employees Transferred to Civilian Positions</header>
				<paragraph id="H3ADDBC9830404E6C92EA338401B9516F"><enum>(1)</enum><header>Duties</header><text>The
			 duties of any individual who becomes a civilian employee of the Capitol Police
			 under this section, including a Library of Congress Police civilian employee
			 under subsection (a)(2) and a Library of Congress Police employee who becomes a
			 civilian employee of the Capitol Police under subsection (b)(1)(B), shall be
			 determined solely by the Chief of the Capitol Police, except that a Library of
			 Congress Police civilian employee under subsection (a)(2) shall continue to
			 support Library of Congress police operations until all Library of Congress
			 Police employees are transferred to the United States Capitol Police under this
			 section.</text>
				</paragraph><paragraph id="H88F7EDFDAD594A1FB4BFF155497EAA3E"><enum>(2)</enum><header>Finality of
			 determinations</header><text display-inline="yes-display-inline">Any
			 determination of the Chief of the Capitol Police under this subsection shall
			 not be appealable or reviewable in any manner.</text>
				</paragraph></subsection><subsection id="H7F35F27D279047E4AAF01B73A1541CDE"><enum>(d)</enum><header>Protecting
			 Status of Transferred Employees</header>
				<paragraph id="H2158AB4751224F099681D286AE56350"><enum>(1)</enum><header>Nonreduction in
			 pay, rank, or grade</header><text display-inline="yes-display-inline">The
			 transfer of any individual under this section shall not cause that individual
			 to be separated or reduced in basic pay, rank or grade.</text>
				</paragraph><paragraph id="H54D5F0AF145E43968E157F6C8F728E24"><enum>(2)</enum><header>Leave and
			 compensatory time</header><text display-inline="yes-display-inline">Any annual
			 leave, sick leave, or other leave, or compensatory time, to the credit of an
			 individual transferred under this section shall be transferred to the credit of
			 that individual as a member or an employee of the Capitol Police (as the case
			 may be). The treatment of leave or compensatory time transferred under this
			 section shall be governed by regulations of the Capitol Police Board.</text>
				</paragraph><paragraph changed="added" committee-id="HHA00" id="H28DA348800E74C0D00A279DBB5E2B90" reported-display-style="italic"><enum>(3)</enum><header>Prohibiting imposition
			 of probationary period</header><text>The Chief of the Capitol Police may not
			 impose a period of probation on any individual who is transferred under this
			 section.</text>
				</paragraph></subsection><subsection id="H339FA3A84FD5403B88FC00AEE4C2BEE3"><enum>(e)</enum><header>Rules of
			 Construction Relating to Employee Representation</header>
				<paragraph id="HECE24C4441E64477A7604E35D01BCC1"><enum>(1)</enum><header>Employee
			 representation</header><text display-inline="yes-display-inline">Nothing in
			 this Act shall be construed to authorize any labor organization that
			 represented an individual who was a Library of Congress police employee or a
			 Library of Congress police civilian employee before the individual’s transfer
			 date to represent that individual as a member of the Capitol Police or an
			 employee of the Capitol Police after the individual’s transfer date.</text>
				</paragraph><paragraph id="HEFEF765E7306415E881EB3AF4D02D161"><enum>(2)</enum><header>Agreements not
			 applicable</header><text display-inline="yes-display-inline">Nothing in this
			 Act shall be construed to authorize any collective bargaining agreement (or any
			 related court order, stipulated agreement, or agreement to the terms or
			 conditions of employment) applicable to Library of Congress police employees or
			 to Library of Congress police civilian employees to apply to members of the
			 Capitol Police or to civilian employees of the Capitol Police.</text>
				</paragraph></subsection><subsection id="HF2ACB4CF0CD24C2D9F04C12FDA053B3"><enum>(f)</enum><header>Rule of
			 Construction Relating to Personnel Authority of the Chief of the Capitol
			 Police</header><text display-inline="yes-display-inline">Nothing in this Act
			 shall be construed to affect the authority of the Chief of the Capitol Police
			 to—</text>
				<paragraph id="HC14FE433F4C2414F9C8B120690E5D6F9"><enum>(1)</enum><text>terminate the
			 employment of a member of the Capitol Police or a civilian employee of the
			 Capitol Police; or</text>
				</paragraph><paragraph id="HBC70C51397974481B8AD6ED11E22AE6"><enum>(2)</enum><text>transfer any
			 individual serving as a member of the Capitol Police or a civilian employee of
			 the Capitol Police to another position with the Capitol Police.</text>
				</paragraph></subsection><subsection id="H77A92A8C912240818FD9CC8BB4A4D900"><enum>(g)</enum><header>Transfer Date
			 Defined</header><text display-inline="yes-display-inline">In this Act, the term
			 <term>transfer date</term> means, with respect to an employee—</text>
				<paragraph id="H03C0B43FFEC341AAA415C7FFD185D5F4"><enum>(1)</enum><text>in the case of a
			 Library of Congress Police employee who becomes a member of the Capitol Police,
			 the first day of the first pay period applicable to members of the United
			 States Capitol Police which begins after the date on which the Chief of the
			 Capitol Police issues the written certification for the employee under
			 subsection (b)(1);</text>
				</paragraph><paragraph id="H866F71AB8A7546ACBBC126595E6126C4"><enum>(2)</enum><text>in the case of a
			 Library of Congress Police employee who becomes a civilian employee of the
			 Capitol Police, the first day of the first pay period applicable to employees
			 of the United States Capitol Police which begins after September 30, 2009;
			 or</text>
				</paragraph><paragraph id="H35D0236453FE43F7B9156988C4B2CEE"><enum>(3)</enum><text display-inline="yes-display-inline">in the case of a Library of Congress Police
			 civilian employee, the first day of the first pay period applicable to
			 employees of the United States Capitol Police which begins after September 30,
			 2008.</text>
				</paragraph></subsection></section><section id="HAA3AC0AA39C1499AB36499BB5D1800FC"><enum>3.</enum><header>Transition
			 Provisions</header>
			<subsection id="HDCAE5084CAEB49D4B559CC6880C0E884"><enum>(a)</enum><header>Transfer and
			 allocations of property and appropriations</header>
				<paragraph id="HC8B11874665348EDBC8E033783DC587B"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Effective on the
			 transfer date of any Library of Congress Police employee and Library of
			 Congress Police civilian employee who is transferred under this Act—</text>
					<subparagraph id="HF49491D58D7449F286B0DD2C1F33A990"><enum>(A)</enum><text display-inline="yes-display-inline">the assets, liabilities, contracts,
			 property, and records associated with the employee shall be transferred to the
			 Capitol Police; and</text>
					</subparagraph><subparagraph id="H2E0975D9BAFF4833913100BF0175BEA0"><enum>(B)</enum><text display-inline="yes-display-inline">the unexpended balances of appropriations,
			 authorizations, allocations, and other funds employed, used, held, arising
			 from, available to, or to be made available in connection with the employee
			 shall be transferred to and made available under the appropriations accounts
			 for the Capitol Police for <quote>Salaries</quote> and <quote>General
			 Expenses</quote>, as applicable.</text>
					</subparagraph></paragraph><paragraph id="H21F47B279F544E64A1FD5DF85B037C"><enum>(2)</enum><header>Joint
			 review</header><text display-inline="yes-display-inline">During the transition
			 period, the Chief of the Capitol Police and the Librarian of Congress shall
			 conduct a joint review of the assets, liabilities, contracts, property records,
			 and unexpended balances of appropriations, authorizations, allocations, and
			 other funds employed, used, held, arising from, available to, or to be made
			 available in connection with the transfer under this Act.</text>
				</paragraph></subsection><subsection id="HE23FD4D11056417B83C405BA739BA7C0"><enum>(b)</enum><header>Treatment of
			 Alleged Violations of Certain Employment Laws With Respect to Transferred
			 Individuals</header>
				<paragraph id="H9C73178B93DE4DF9A3DC595DA14770E1"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Notwithstanding any
			 other provision of law and except as provided in paragraph (3), in the case of
			 an alleged violation of any covered law (as defined in paragraph (4)) which is
			 alleged to have occurred prior to the transfer date with respect to an
			 individual who is transferred under this Act, and for which the individual has
			 not exhausted all of the remedies available for the consideration of the
			 alleged violation which are provided for employees of the Library of Congress
			 under the covered law prior to the transfer date, the following shall
			 apply:</text>
					<subparagraph id="HA378181878E046969E000005ABBD3DB5"><enum>(A)</enum><text display-inline="yes-display-inline">The individual may not initiate any
			 procedure which is available for the consideration of the alleged violation of
			 the covered law which is provided for employees of the Library of Congress
			 under the covered law.</text>
					</subparagraph><subparagraph id="H4891829AC4254E70AD6700A954EFAE8F"><enum>(B)</enum><text display-inline="yes-display-inline">To the extent that the individual has
			 initiated any such procedure prior to the transfer date, the procedure shall
			 terminate and have no legal effect.</text>
					</subparagraph><subparagraph id="H2F92AE13CEAF46FE951DA502DA555E3C"><enum>(C)</enum><text display-inline="yes-display-inline">Subject to paragraph (2), the individual
			 may initiate and participate in any procedure which is available for the
			 resolution of grievances of officers and employees of the Capitol Police under
			 the Congressional Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1301">2 U.S.C. 1301 et seq.</external-xref>) to provide
			 for consideration of the alleged violation. The previous sentence does not
			 apply in the case of an alleged violation for which the individual exhausted
			 all of the available remedies which are provided for employees of the Library
			 of Congress under the covered law prior to the transfer date.</text>
					</subparagraph></paragraph><paragraph id="HF57094D79F7548B9871CD2688B5BE47"><enum>(2)</enum><header>Special rules for
			 applying Congressional Accountability Act of 1995</header><text display-inline="yes-display-inline">In applying paragraph (1)(C) with respect
			 to an individual to whom this subsection applies, for purposes of the
			 consideration of the alleged violation under the Congressional Accountability
			 Act of 1995—</text>
					<subparagraph id="H315BFE798FD64EEC83D64F399C437BF7"><enum>(A)</enum><text display-inline="yes-display-inline">the date of the alleged violation shall be
			 the individual’s transfer date;</text>
					</subparagraph><subparagraph id="H80084AAE6B274C468249F914F8F52E5"><enum>(B)</enum><text>notwithstanding the
			 third sentence of section 402(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/2/1402">2 U.S.C. 1402(a)</external-xref>), the
			 individual’s request for counseling under such section shall be made not later
			 than 60 days after the date of the alleged violation; and</text>
					</subparagraph><subparagraph id="H9F4233420733475599E359AFFCD9D37"><enum>(C)</enum><text>the employing
			 office of the individual at the time of the alleged violation shall be the
			 Capitol Police Board.</text>
					</subparagraph></paragraph><paragraph id="H3F7C700DC60647CD811CCC35419430D0"><enum>(3)</enum><header>Exception for
			 alleged violations subject to hearing prior to transfer</header><text display-inline="yes-display-inline">Paragraph (1) does not apply with respect
			 to an alleged violation for which a hearing has commenced in accordance with
			 the covered law on or before the transfer date.</text>
				</paragraph><paragraph id="H3FAE22B365934F3196155432B5CB833F"><enum>(4)</enum><header>Covered law
			 defined</header><text>In this subsection, a <quote>covered law</quote> is any
			 law for which the remedy for an alleged violation is provided for officers and
			 employees of the Capitol Police under the Congressional Accountability Act of
			 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1301">2 U.S.C. 1301 et seq.</external-xref>).</text>
				</paragraph></subsection><subsection id="H91133C2D5C594F07986B763C2C932C60"><enum>(c)</enum><header>Availability of
			 Detailees During Transition Period</header><text display-inline="yes-display-inline">During the transition period, the Chief of
			 the Capitol Police may detail additional members of the Capitol Police to the
			 Library of Congress, without reimbursement.</text>
			</subsection><subsection id="H7CFEE33E0ABA487C8F4088D00AAA6C8"><enum>(d)</enum><header>Effect on
			 Existing Memorandum of Understanding</header><text display-inline="yes-display-inline">The Memorandum of Understanding between the
			 Library of Congress and the Capitol Police entered into on December 12, 2004,
			 shall remain in effect during the transition period, subject to—</text>
				<paragraph id="H38D29082279A4D3A9511F7BEED473300"><enum>(1)</enum><text display-inline="yes-display-inline">the provisions of this Act; and</text>
				</paragraph><paragraph id="HA2069A0F9ADB4D3398CF146C57E4D92F"><enum>(2)</enum><text display-inline="yes-display-inline">such modifications as may be made in
			 accordance with the modification and dispute resolution provisions of the
			 Memorandum of Understanding, consistent with the provisions of this Act.</text>
				</paragraph></subsection><subsection id="H2B1693F757DE49A794005C492DD12503"><enum>(e)</enum><header>Rule of
			 Construction Relating to Personnel Authority of the Librarian of
			 Congress</header><text display-inline="yes-display-inline">Nothing in this Act
			 shall be construed to affect the authority of the Librarian of Congress
			 to—</text>
				<paragraph id="H8BCF00786019464C98C6B759B12A464"><enum>(1)</enum><text display-inline="yes-display-inline">terminate the employment of a Library of
			 Congress Police employee or Library of Congress Police civilian employee;
			 or</text>
				</paragraph><paragraph id="HF923EDD4A74D47ADA91504B10006F8C2"><enum>(2)</enum><text>transfer any
			 individual serving in a Library of Congress Police employee position or Library
			 of Congress Police civilian employee position to another position at the
			 Library of Congress.</text>
				</paragraph></subsection></section><section id="HA5DC815408F14D38B3ACBDE207B2172"><enum>4.</enum><header>Police
			 Jurisdiction, Unlawful Activities, and Penalties</header>
			<subsection id="H1EF2A8F9266642CFB943E817F779B92"><enum>(a)</enum><header>Jurisdiction</header>
				<paragraph id="H2304763EE6F447F6A8626CDDA83EB67"><enum>(1)</enum><header>Extension of
			 Capitol Police jurisdiction</header><text>Section 9 of the Act entitled
			 <quote>An Act to define the area of the United States Capitol Grounds, to
			 regulate the use thereof, and for other purposes</quote>, approved July 31,
			 1946 (<external-xref legal-doc="usc" parsable-cite="usc/2/1961">2 U.S.C. 1961</external-xref>) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HA6340BD0C1DE440DA74324F9AC82DC59" style="traditional">
						<subsection id="H21A97D8966664CF093BF801FB507B0AF"><enum>(d)</enum><text display-inline="yes-display-inline">For purposes of this section, <quote>United
				States Capitol Buildings and Grounds</quote> shall include the Library of
				Congress buildings and grounds described under section 11 of the Act entitled
				<quote>An Act relating to the policing of the buildings of the Library of
				Congress</quote>, approved August 4, 1950 (<external-xref legal-doc="usc" parsable-cite="usc/2/167j">2 U.S.C. 167j</external-xref>), except that in a
				case of buildings or grounds not located in the District of Columbia, the
				authority granted to the Metropolitan Police Force of the District of Columbia
				shall be granted to any police force within whose jurisdiction the buildings or
				grounds are
				located.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HA00BF50E7BFE41708D1ED572205B483C"><enum>(2)</enum><header>Repeal of
			 Library of Congress Police jurisdiction</header><text display-inline="yes-display-inline">The first section and sections 7 and 9 of
			 the Act of August 4, 1950 (<external-xref legal-doc="usc" parsable-cite="usc/2/167">2 U.S.C. 167</external-xref>, 167f, 167h) are repealed on October 1,
			 2009.</text>
				</paragraph></subsection><subsection id="H6A29586172A24008AC00F93DBAC84169"><enum>(b)</enum><header>Unlawful
			 activities and penalties</header>
				<paragraph id="HD1AF3BA20A1F4732B317DCAC622535A6"><enum>(1)</enum><header>Extension of
			 United States Capitol buildings and grounds provisions to the Library of
			 Congress buildings and grounds</header>
					<subparagraph id="H6DA3AE3EB2C64FDCBCE816BD9CEF95DD"><enum>(A)</enum><header>Capitol
			 buildings</header><text display-inline="yes-display-inline">Section 5101 of
			 title 40, United States Code, is amended by inserting <quote>all buildings on
			 the real property described under section 5102(d)</quote> after
			 <quote>(including the Administrative Building of the United States Botanic
			 Garden)</quote>.</text>
					</subparagraph><subparagraph id="H6C6B2D81BC664E53BF00903FC6854E01"><enum>(B)</enum><header>Capitol
			 grounds</header><text display-inline="yes-display-inline">Section 5102 of title
			 40, United States Code, is amended by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H27AF8E63338941C88D26FC5897AA2500" style="USC">
							<subsection id="HF676874712C64E3E945BBC0D4B3EB5C"><enum>(d)</enum><header>Library of
				Congress buildings and grounds</header>
								<paragraph id="HB4EC5615C17F4968B730DEB5BE0134D"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Except as provided
				under paragraph (2), the United States Capitol Grounds shall include the
				Library of Congress grounds described under section 11 of the Act entitled
				<quote>An Act relating to the policing of the buildings of the Library of
				Congress</quote>, approved August 4, 1950 (<external-xref legal-doc="usc" parsable-cite="usc/2/167j">2 U.S.C. 167j</external-xref>).</text>
								</paragraph><paragraph id="H6C6D8B5886D347ABA66BA3E6B3B86E00"><enum>(2)</enum><header>Authority of
				Librarian of Congress</header><text display-inline="yes-display-inline">Notwithstanding subsections (a) and (b),
				the Librarian of Congress shall retain authority over the Library of Congress
				buildings and grounds in accordance with section 1 of the Act of June 29, 1922
				(<external-xref legal-doc="usc" parsable-cite="usc/2/141">2 U.S.C. 141</external-xref>; 42 Stat.
				715).</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="HD62E33C26F7F457EB1874EAC30CF563B"><enum>(C)</enum><header>Conforming
			 amendment relating to disorderly conduct</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/40/5104">Section 5104(e)(2)</external-xref> of title 40, United
			 States Code, is amended by striking subparagraph (C) and inserting the
			 following:</text>
						<quoted-block display-inline="no-display-inline" id="H8563B21C131942F595F76F7CBB00ACE" style="USC">
							<subparagraph id="H6C0CEDEDEC92491E8EBEEE69F3FAAEF3"><enum>(C)</enum><text display-inline="yes-display-inline">with the intent to disrupt the orderly
				conduct of official business, enter or remain in a room in any of the Capitol
				Buildings set aside or designated for the use of—</text>
								<clause id="HED26E0E3C12F47898BCCB2F9635D3EFB"><enum>(i)</enum><text display-inline="yes-display-inline">either House of Congress or a Member,
				committee, officer, or employee of Congress, or either House of Congress;
				or</text>
								</clause><clause id="H46DF94818FE143258D6CD53EEEE967D4"><enum>(ii)</enum><text display-inline="yes-display-inline">the Library of
				Congress;</text>
								</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="HF7C2078244B54718B5F82142AC3609AE"><enum>(2)</enum><header>Repeal of
			 offenses and penalties specific to the Library of Congress</header><text display-inline="yes-display-inline">Sections 2, 3, 4, 5, 6, and 8 of the Act of
			 August 4, 1950 (<external-xref legal-doc="usc" parsable-cite="usc/2/167a">2 U.S.C. 167a</external-xref>, 167b, 167c, 167d, 167e, and 167g) are
			 repealed.</text>
				</paragraph><paragraph id="H2EA7CA7676374A2588EF34E290158857"><enum>(3)</enum><header>Suspension of
			 prohibitions against use of Library of Congress buildings and
			 grounds</header><text display-inline="yes-display-inline">Section 10 of the Act
			 of August 4, 1950 (<external-xref legal-doc="usc" parsable-cite="usc/2/167i">2 U.S.C. 167i</external-xref>) is amended by striking <quote>2 to 6,
			 inclusive, of this Act</quote> and inserting <quote>5103 and 5104 of title 40,
			 United States Code</quote>.</text>
				</paragraph><paragraph id="HE6F1018BCEC94A6A900063F131B323B2"><enum>(4)</enum><header>Conforming
			 amendment to description of Library of Congress grounds</header><text display-inline="yes-display-inline">Section 11 of the Act of August 4, 1950 (2
			 U.S.C. 167j) is amended—</text>
					<subparagraph id="H888A60F6FF6C4606A534F5867FBDD05"><enum>(A)</enum><text>in subsection (a),
			 by striking <quote>For the purposes of this Act the</quote> and inserting
			 <quote>The</quote>;</text>
					</subparagraph><subparagraph display-inline="no-display-inline" id="H6CF24520E8784228B0098672A3045B4B"><enum>(B)</enum><text>in subsection (b),
			 by striking <quote>For the purposes of this Act, the</quote> and inserting
			 <quote>The</quote>;</text>
					</subparagraph><subparagraph display-inline="no-display-inline" id="HA599C9D622DE4E93B03C79C00F6C974"><enum>(C)</enum><text>in subsection (c),
			 by striking <quote>For the purposes of this Act, the</quote> and inserting
			 <quote>The</quote>; and</text>
					</subparagraph><subparagraph display-inline="no-display-inline" id="HB88B240594A747E0BF7900B8DC835C1"><enum>(D)</enum><text>in subsection (d),

					</subparagraph></paragraph></subsection><subsection display-inline="no-display-inline" id="H5423D16CF56A4DF7A6AFFFD843E677E0"><enum>(c)</enum><header>Conforming
			 Amendment Relating to Jurisdiction of Inspector General of Library of
			 Congress</header><text>Section 1307(b)(1) of the Legislative Branch
			 Appropriations Act, 2006 (<external-xref legal-doc="usc" parsable-cite="usc/2/185">2 U.S.C. 185(b)</external-xref>), is amended by striking the
			 semicolon at the end and inserting the following: <quote>, except that nothing
			 in this paragraph may be construed to authorize the Inspector General to audit
			 or investigate any operations or activities of the United States Capitol
			 Police;</quote>.</text>
			</subsection><subsection id="HF3ECA435FB104418AF5574B05DD85314"><enum>(d)</enum><header>Effective
			 Date</header><text>The amendments made by this section shall take effect
			 October 1, 2009.</text>
			</subsection></section><section id="H91ADEC5C3CCA415C922D00E9D99C4F85"><enum>5.</enum><header>Collections,
			 Physical Security, Control, and Preservation of Order and Decorum Within the
			 Library</header>
			<subsection id="HCDBDF33571AD49FB9BC5E48622463321"><enum>(a)</enum><header>Establishment of
			 Regulations</header><text display-inline="yes-display-inline">The Librarian of
			 Congress shall establish standards and regulations for the physical security,
			 control, and preservation of the Library of Congress collections and property,
			 and for the maintenance of suitable order and decorum within Library of
			 Congress.</text>
			</subsection><subsection id="H0D907BB24D71457DBFE966E0CECCED24"><enum>(b)</enum><header>Treatment of
			 Security Systems</header>
				<paragraph id="HB7F448A14C9E4702B09359ED48D0809D"><enum>(1)</enum><header>Responsibility
			 for security systems</header><text display-inline="yes-display-inline">In
			 accordance with the authority of the Capitol Police and the Librarian of
			 Congress established under this Act, the amendments made by this Act, and the
			 provisions of law referred to in paragraph (3), the Chief of the Capitol Police
			 and the Librarian of Congress shall be responsible for the operation of
			 security systems at the Library of Congress buildings and grounds described
			 under section 11 of the Act of August 4, 1950, in consultation and coordination
			 with each other, subject to the following:</text>
					<subparagraph id="H6A8C48FBBF034384823D5DD7559355A0"><enum>(A)</enum><text>The Librarian of
			 Congress shall be responsible for the design of security systems for the
			 control and preservation of Library collections and property, subject to the
			 review and approval of the Chief of the Capitol Police.</text>
					</subparagraph><subparagraph id="HAC40F6D25C8943AC82C9666470297D00"><enum>(B)</enum><text display-inline="yes-display-inline">The Librarian of Congress shall be
			 responsible for the operation of security systems at any building or facility
			 of the Library of Congress which is located outside of the District of
			 Columbia, subject to the review and approval of the Chief of the Capitol
			 Police.</text>
					</subparagraph></paragraph><paragraph id="H68697D51E03944C3B8A8895F321520BA"><enum>(2)</enum><header>Initial proposal
			 for operation of systems</header><text>Not later than October 1, 2008, the
			 Chief of the Capitol Police, in coordination with the Librarian of Congress,
			 shall prepare and submit to the Committee on House Administration of the House
			 of Representatives, the Committee on Rules and Administration of the Senate,
			 and the Committees on Appropriations of the House of Representatives and the
			 Senate an initial proposal for carrying out this subsection.</text>
				</paragraph><paragraph id="HF6DB9597BCCC45ECBFD1A9CF2D8B0014"><enum>(3)</enum><header>Provisions of
			 law</header><text>The provisions of law referred to in this paragraph are as
			 follows:</text>
					<subparagraph id="HBDA0D21F92134887BE7BA3F1E1D348B"><enum>(A)</enum><text display-inline="yes-display-inline">Section 1 of the Act of June 29, 1922 (2
			 U.S.C. 141).</text>
					</subparagraph><subparagraph id="H876BAE44B6EE4C0781B12BE04DAC4849"><enum>(B)</enum><text>The undesignated
			 provision under the heading <quote>General Provision, This Chapter</quote> in
			 chapter 5 of title II of division B of the Omnibus Consolidated and Emergency
			 Supplemental Appropriations Act, 1999 (<external-xref legal-doc="usc" parsable-cite="usc/2/141a">2 U.S.C. 141a</external-xref>).</text>
					</subparagraph><subparagraph id="HB49C089313D64126B517DCFD8D4F8098"><enum>(C)</enum><text display-inline="yes-display-inline">Section 308 of the Legislative Branch
			 Appropriations Act, 1996 (<external-xref legal-doc="usc" parsable-cite="usc/2/1964">2 U.S.C. 1964</external-xref>).</text>
					</subparagraph><subparagraph id="H64BD512818134CB6B69CC42F1542924C"><enum>(D)</enum><text display-inline="yes-display-inline">Section 308 of the Legislative Branch
			 Appropriations Act, 1997 (<external-xref legal-doc="usc" parsable-cite="usc/2/1965">2 U.S.C. 1965</external-xref>).</text>
					</subparagraph></paragraph></subsection></section><section id="HFB65CC8D4C7B44DE8E2096DAF2C653FA"><enum>6.</enum><header>Payment of
			 Capitol Police Services Provided in Connection with Relating to Library of
			 Congress Special Events</header>
			<subsection id="H430B6414C19A471EB232764D7F7496AE"><enum>(a)</enum><header>Payments of
			 Amounts Deposited in Revolving Fund</header><text display-inline="yes-display-inline">Section 102(e) of the Library of Congress
			 Fiscal Operations Improvement Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/2/182b">2 U.S.C. 182b(e)</external-xref>) is amended to read
			 as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H9615B213C10E4636AE00DE1BBA75C6E" style="OLC">
					<subsection id="H2FB0C6AB8F484DF4ACFD574DFC8BA8F2"><enum>(e)</enum><header>Use of
				Amounts</header>
						<paragraph id="H00859782CBE14952839E745E2B08502F"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Except as provided in
				paragraph (2), amounts in the accounts of the revolving fund under this section
				shall be available to the Librarian, in amounts specified in appropriations
				Acts and without fiscal year limitation, to carry out the programs and
				activities covered by such accounts.</text>
						</paragraph><paragraph id="HF2BF8998E1F0485698834CD584339FA6"><enum>(2)</enum><header>Special rule for
				payments for certain capitol police services</header><text>In the case of any
				amount in the revolving fund consisting of a payment received for services of
				the United States Capitol Police in connection with a special event or program
				described in subsection (a)(4), the Librarian shall transfer such amount upon
				receipt to the Capitol Police for deposit into the applicable appropriations
				accounts of the Capitol
				Police.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HB636ECD484F4421DAFCD7090D22DB500"><enum>(b)</enum><header>Use of Other
			 Library Funds To Make Payments</header><text display-inline="yes-display-inline">In addition to amounts transferred pursuant
			 to section 102(e)(2) of the Library of Congress Fiscal Operations Improvement
			 Act of 2000 (as added by subsection (a)), the Librarian of Congress may
			 transfer amounts made available for salaries and expenses of the Library of
			 Congress during a fiscal year to the applicable appropriations accounts of the
			 United States Capitol Police in order to reimburse the Capitol Police for
			 services provided in connection with a special event or program described in
			 section 102(a)(4) of such Act.</text>
			</subsection><subsection id="HE1247F22BC1046BB888BB8B8711CFC17"><enum>(c)</enum><header>Effective
			 Date</header><text>The amendments made by this section shall apply with respect
			 to services provided by the United States Capitol Police on or after the date
			 of the enactment of this Act.</text>
			</subsection></section><section id="HDECAE5F699A34FA7ACE19C5077A23625"><enum>7.</enum><header>Other Conforming
			 Amendments</header>
			<subsection id="HB47B8DE593804B6ABD378E99B2CE7DFC"><enum>(a)</enum><header>In
			 General</header><text>Section 1015 of the Legislative Branch Appropriations
			 Act, 2003 (<external-xref legal-doc="usc" parsable-cite="usc/2/1901">2 U.S.C. 1901</external-xref> note) and section 1006 of the Legislative Branch
			 Appropriations Act, 2004 (<external-xref legal-doc="usc" parsable-cite="usc/2/1901">2 U.S.C. 1901</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/108/83">Public Law 108–83</external-xref>; 117 Stat.
			 1023) are repealed.</text>
			</subsection><subsection id="HE2163630E28749FE9300DA009B23CB83"><enum>(b)</enum><header>Effective
			 Date</header><text>The amendments made by subsection (a) shall take effect
			 October 1, 2009.</text>
			</subsection></section><section id="HA193F397CCE24CF79210C972356E0061"><enum>8.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act—</text>
			<paragraph id="H3547221FF1D6474299AFDFC5003F00E9"><enum>(1)</enum><text>the term <term>Act
			 of August 4, 1950</term> means the Act entitled <quote>An Act relating to the
			 policing of the buildings and grounds of the Library of Congress,</quote> (2
			 U.S.C. 167 et seq.);</text>
			</paragraph><paragraph id="H5A533120CEF34412855F2318C77F48D6"><enum>(2)</enum><text>the term
			 <term>Library of Congress Police employee</term> means an employee of the
			 Library of Congress designated as police under the first section of the Act of
			 August 4, 1950 (<external-xref legal-doc="usc" parsable-cite="usc/2/167">2 U.S.C. 167</external-xref>);</text>
			</paragraph><paragraph id="H2BE6EF7D1D264753A9D1B17F6C95AF5"><enum>(3)</enum><text>the term
			 <term>Library of Congress Police civilian employee</term> means an employee of
			 the Library of Congress Office of Security and Emergency Preparedness who
			 provides direct administrative support to, and is supervised by, the Library of
			 Congress Police, but shall not include an employee of the Library of Congress
			 who performs emergency preparedness or collections control and preservation
			 functions; and</text>
			</paragraph><paragraph id="H15869A45CC4E4D2FB266F25E1BF3FB00"><enum>(4)</enum><text>the term
			 <term>transition period</term> means the period the first day of which is the
			 date of the enactment of this Act and the final day of which is September 30,
			 2009.</text>
