		<official-title>To provide lawful permanent resident status to the
		  immediate family members of military service personnel serving in Iraq or
		  Afghanistan.</official-title>

		<section id="H7B05C1C6C06F4EB40092289CC2637D5F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Safeguarding Families of Soldiers
			 Act</short-title></quote>.</text>
		</section><section id="H390727DC7505445BB24ECDFA4AA1E02"><enum>2.</enum><header>Permanent resident
			 status for immediate family members of military service personnel serving in
			 Iraq or Afghanistan</header>
			<subsection id="H611D2D11B87C447A91BE02EB2E560440"><enum>(a)</enum><header>In
			 general</header><text>The Secretary of Homeland Security shall adjust the
			 status of an alien described in subsection (b) to that of an alien lawfully
			 admitted for permanent residence if the alien—</text>
				<paragraph id="H8BD4EB33E3C74245B050D20095509F99"><enum>(1)</enum><text>was born before
			 the date of the enactment of this Act;</text>
				</paragraph><paragraph id="H0DF37E8846D9407DA390F83B478924F"><enum>(2)</enum><text display-inline="yes-display-inline">applies for such adjustment, and is
			 physically present in the United States on the date the application is
			 filed;</text>
				</paragraph><paragraph id="HD6683E3C202C440283C64875E0707DC2"><enum>(3)</enum><text>is admissible to
			 the United States as an immigrant, except as provided in subsection (c);
			 and</text>
				</paragraph><paragraph id="HCB7BE31140C144DEAAAF8F4257FE5FAA"><enum>(4)</enum><text>pays a fee
			 (determined by the Secretary) for the processing of such application.</text>
				</paragraph></subsection><subsection id="H1E9A38E5DD8B4186BB1FBFD74AEB94"><enum>(b)</enum><header>Aliens eligible
			 for adjustment of status</header><text>The benefits provided in subsection (a)
			 shall only apply to an alien who is—</text>
				<paragraph id="H59BBFAEC8AA847A6881F7400A6F82EC4"><enum>(1)</enum><text>a
			 parent or spouse of a member of the Armed Forces deployed, on the date on which
			 the application under subsection (a) is filed, in Iraq in connection with
			 Operation Freedom or Afghanistan in connection with Operation Enduring Freedom;
			 or</text>
				</paragraph><paragraph id="H6AB9B7AAAE1648C00073007773B3BFF6"><enum>(2)</enum><text>a
			 son or daughter of a member of the Armed Forces described in subsection (a),
			 but only if the son or daughter is under the age of 21 on the date on which the
			 application under subsection (a) is filed.</text>
				</paragraph></subsection><subsection id="H4B5D853516A44C63A427094D62799444"><enum>(c)</enum><header>Waiver of
			 certain grounds of inadmissiblity</header><text display-inline="yes-display-inline">The provisions of paragraphs (4), (5), and
			 (7)(A) of section 212(a) of the Immigration and Nationality Act shall not apply
			 to adjustment of status under this Act and the Secretary of Homeland Security
			 may waive any other provision of such section (other than paragraph (2)(C) and
			 subparagraphs (A), (B), (C), (E), or (F) of paragraph (3)) with respect to such
			 an adjustment for humanitarian purposes, to assure family unity, or when it is
			 otherwise in the public interest.</text>
			</subsection><subsection id="H9A4C2AA78FFE49C29454E8A6CAC86779"><enum>(d)</enum><header>Date of
			 approval</header><text>Upon the approval of such an application for adjustment
			 of status, the Secretary of Homeland Security shall create a record of the
			 alien’s admission as a lawful permanent resident.</text>
			</subsection><subsection id="HEE58F334A59341019462174B6020FADA"><enum>(e)</enum><header>No offset in
			 number of visas available</header><text>When an alien is granted the status of
			 having been lawfully admitted for permanent residence under this section, the
			 Secretary of State shall not be required to reduce the number of immigrant
			 visas authorized to be issued under the Immigration and Nationality Act.</text>
