<legis-type>AN ACT</legis-type> 
<official-title display="yes">To provide for the extension of transitional medical assistance (TMA), the abstinence education program, and the qualifying individuals (QI) program, and for other purposes.</official-title>

<section id="HAC70144EC62E4230B689B1D4DAA71577" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>TMA, Abstinence Education, and QI Programs Extension Act of 2007</short-title></quote>.</text></section> 
<section id="H4308253E655749828F119CCDC65EC8FE"><enum>2.</enum><header>Extension of transitional medical assistance (TMA) and abstinence education program through December 31, 2007</header><text display-inline="no-display-inline">Section 401 of division B of the Tax Relief and Health Care Act of 2006 (<external-xref legal-doc="public-law" parsable-cite="pl/109/432">Public Law 109–432</external-xref>), as amended by section 1 of <external-xref legal-doc="public-law" parsable-cite="pl/110/48">Public Law 110–48</external-xref>, is amended—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="H4DAA39614CBC4D7CB4B4E2F6375B3043"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>September 30</quote> and inserting <quote>December 31</quote>;</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H7486D72BACB749AEBB1D9274BEB53006"><enum>(2)</enum><text>by striking <quote>for fiscal year 2006</quote> and inserting <quote>for fiscal year 2007</quote>;</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H214E4BFEC43C4EE79543F7B300DF32AA"><enum>(3)</enum><text>by striking <quote>the fourth quarter of fiscal year 2007</quote> and inserting <quote>the first quarter of fiscal year 2008</quote>; and</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H783769326FCD4BA287D9FC8D2FB896BD"><enum>(4)</enum><text display-inline="yes-display-inline">by striking <quote>the fourth quarter of fiscal year 2006</quote> and inserting <quote>the first quarter of fiscal year 2007</quote>.</text></paragraph></section> 
<section id="H8C90C2499662434E84948B6959E24942"><enum>3.</enum><header>Extension of qualifying individual (QI) program through December 2007</header> 
<subsection id="H46D66D4ED9474232975149D4FF33FD11"><enum>(a)</enum><header>Through December 2007</header><text>Section 1902(a)(10)(E)(iv) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)(10)(E)(iv)</external-xref>) is amended by striking <quote>September 2007</quote> and inserting <quote>December 2007</quote>.</text></subsection> 
<subsection id="H7BDAAA8F33C04F0687CB87190074399F"><enum>(b)</enum><header>Extending Total Amount Available for Allocation</header><text>Section 1933(g) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396u-3">42 U.S.C. 1396u–3(g)</external-xref>) is amended—</text> 
<paragraph id="HAF81E32B2CB247BAA93630F86EC573E1"><enum>(1)</enum><text>in paragraph (2)—</text> 
<subparagraph id="HDECEAAECDE254FC88DB1768BE564009F"><enum>(A)</enum><text>by striking <quote>and</quote> at the end of subparagraph (F);</text></subparagraph> 
<subparagraph id="HA089363A5FF944A282353FBD398D2DD8"><enum>(B)</enum><text>by striking the period at the end of subparagraph (G) and inserting <quote>; and</quote>; and</text></subparagraph> 
<subparagraph id="H46223AE7572049B2A33800444D72CC07"><enum>(C)</enum><text>by adding at the end the following new subparagraph:</text>

<subparagraph id="HA1F0D593A6FD4860BA7FED46CB29E795"><enum>(H)</enum><text>for the period that begins on October 1, 2007, and ends on December 31, 2007, the total allocation amount is $100,000,000.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="HA8DD28028B234E4598F2BBDD2435D6F4"><enum>(2)</enum><text>in paragraph (3), in the matter preceding subparagraph (A), by striking <quote>or (F)</quote> and inserting <quote>(F), or (H)</quote>.</text></paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H1C1E7F0021CC45608FF29714C5EAF9DD"><enum>(c)</enum><header>Effective Date</header><text>The amendments made by this section shall be effective as of September 30, 2007.</text></subsection></section> 
<section id="HB285790CB25844B4A68C30749E039C25"><enum>4.</enum><header>Extension of SSI web-based asset demonstration project to the Medicaid program</header> 
<subsection id="HAB3271998E544E638870E4EB29739692"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Beginning on October 1, 2007, and ending on September 30, 2012, the Secretary of Health and Human Services shall provide for the application to asset eligibility determinations under the Medicaid program under title XIX of the Social Security Act of the automated, secure, web-based asset verification request and response process being applied for determining eligibility for benefits under the Supplemental Security Income (SSI) program under title XVI of such Act under a demonstration project conducted under the authority of section 1631(e)(1)(B)(ii) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1383">42 U.S.C. 1383(e)(1)(B)(ii)</external-xref>).</text></subsection> 
<subsection id="H3456DAEF30DD43EAA4023C2D26E097B"><enum>(b)</enum><header>Limitation</header><text display-inline="yes-display-inline">Such application shall only extend to those States in which such demonstration project is operating and only for the period in which such project is otherwise provided.</text></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H5FF43AB0205B407C868C0084E2FE1BA"><enum>(c)</enum><header>Rules of application</header><text>For purposes of carrying out subsection (a), notwithstanding any other provision of law, information obtained from a financial institution that is used for purposes of eligibility determinations under such demonstration project with respect to the Secretary of Health and Human Services under the SSI program may also be shared and used by States for purposes of eligibility determinations under the Medicaid program. In applying section 1631(e)(1)(B)(ii) of the Social Security Act under this subsection, references to the Commissioner of Social Security and benefits under title XVI of such Act shall be treated as including a reference to a State described in subsection (b) and medical assistance under title XIX of such Act provided by such a State.</text></subsection></section> 
<section id="H9C88F72226944610BBC1F64653997216"><enum>5.</enum><header>6-month delay in requirement to use tamper-resistant prescription pads under Medicaid</header><text display-inline="no-display-inline">Effective as if included in the enactment of section 7002(b) of the U.S. Troop Readiness, Veterans' Care, Katrina Recovery, and Iraq Accountability Appropriations Act, 2007 (<external-xref legal-doc="public-law" parsable-cite="pl/110/28">Public Law 110–28</external-xref>, 121 Sta. 187), paragraph (2) of such section is amended by striking <quote>September 30, 2007</quote> and inserting <quote>March 31, 2008</quote>.</text></section> 
<section display-inline="no-display-inline" id="HB05C8FB3F345489F00B87FA970D28B63" section-type="subsequent-section"><enum>6.</enum><header>Additional funding for the Medicare Physician Assistance and Quality Initiative Fund</header><text display-inline="no-display-inline">Section 1848(l)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-4">42 U.S.C. 1395w–4(l)(2)</external-xref>) is amended—</text> 
<paragraph id="H4A61B6EEAA154FC883D48D735FE21557"><enum>(1)</enum><text>in subparagraph (A), by adding at the end the following: <quote>In addition, there shall be available to the Fund for expenditures during 2009 an amount equal to $325,000,000 and for expenditures during or after 2013 an amount equal to $60,000,000.</quote>; and</text></paragraph> 
<paragraph id="HCF21D6F35B814D8F9B3860809053BF32"><enum>(2)</enum><text>in subparagraph (B)—</text> 
<subparagraph id="H324D935040B242FCBE81EF5C802658CB"><enum>(A)</enum><text>in the heading, by striking <quote><header-in-text level="subparagraph" style="OLC">furnished during 2008</header-in-text></quote>;</text></subparagraph> 
<subparagraph id="HE5AEB55520CC443A8E6123A0BA4AE00"><enum>(B)</enum><text>by striking <quote>specified in subparagraph (A)</quote> and inserting <quote>specified in the first sentence of subparagraph (A)</quote>; and</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HEC198728B208452094E300036786D00"><enum>(C)</enum><text>by inserting after <quote>furnished during 2008</quote> the following: <quote>and for the obligation of the entire first amount specified in the second sentence of such subparagraph for payment with respect to physicians' services furnished during 2009 and of the entire second amount so specified for payment with respect to physicians’ services furnished on or after January 1, 2013</quote>.</text></subparagraph></paragraph></section> 
<section id="HA0C900EDD95F406D99D3345BDC3DC3D1"><enum>7.</enum><header>Limitation on implementation for fiscal years 2008 and 2009 of a prospective documentation and coding adjustment in response to the implementation of the Medicare Severity Diagnosis Related Group (MS–DRG) system under the Medicare prospective payment system for inpatient hospital services</header> 
<subsection id="H17305E2B9CD343BDAB463160761C7FEB"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In implementing the final rule published on August 22, 2007, on pages 47130 through 48175 of volume 72 of the Federal Register, the Secretary of Health and Human Services (in this section referred to as the <quote>Secretary</quote>) shall apply prospective documentation and coding adjustments (made in response to the implementation of a Medicare Severity Diagnosis Related Group (MS–DRG) system under the hospital inpatient prospective payment system under section 1886(d) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ww">42 U.S.C. 1395ww(d)</external-xref>) of—</text> 
<paragraph id="HE65C5B0F2CC84E3FA476323E42B11300"><enum>(1)</enum><text display-inline="yes-display-inline">for discharges occurring during fiscal year 2008, 0.6 percent rather than the 1.2 percent specified in such final rule; and</text></paragraph> 
<paragraph id="H338BDD67CC5F4348BDBDF4C24FCC26D"><enum>(2)</enum><text display-inline="yes-display-inline">for discharges occurring during fiscal year 2009, 0.9 percent rather than the 1.8 percent specified in such final rule.</text></paragraph></subsection> 
<subsection commented="no" id="HCBFE471E05FA4BB980DCA770CEAF076"><enum>(b)</enum><header>Subsequent adjustments</header> 
<paragraph commented="no" id="HBF51ADD81F61432996BBFFFFC68E9E69"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, if the Secretary determines that implementation of such Medicare Severity Diagnosis Related Group (MS–DRG) system resulted in changes in coding and classification that did not reflect real changes in case mix under section 1886(d) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ww">42 U.S.C. 1395ww(d)</external-xref>) for discharges occurring during fiscal year 2008 or 2009 that are different than the prospective documentation and coding adjustments applied under subsection (a), the Secretary shall—</text> 
<subparagraph id="H3437D905EE7A456ABEDBA7048700A392"><enum>(A)</enum><text>make an appropriate adjustment under paragraph (3)(A)(vi) of such section 1886(d); and</text></subparagraph> 
<subparagraph id="H344AE6325C6247A8BAF6A100B8E59C7E"><enum>(B)</enum><text>make an additional adjustment to the standardized amounts under such section 1886(d) for discharges occurring only during fiscal years 2010, 2011, and 2012 to offset the estimated amount of the increase or decrease in aggregate payments (including interest as determined by the Secretary) determined, based upon a retrospective evaluation of claims data submitted under such Medicare Severity Diagnosis Related Group (MS–DRG) system, by the Secretary with respect to discharges occurring during fiscal years 2008 and 2009.</text></subparagraph></paragraph> 
<paragraph id="H6FEF69D7EE12482EA5BA8DC841319F81"><enum>(2)</enum><header>Requirement</header><text>Any adjustment under paragraph (1)(B) shall reflect the difference between the amount the Secretary estimates that implementation of such Medicare Severity Diagnosis Related Group (MS–DRG) system resulted in changes in coding and classification that did not reflect real changes in case mix and the prospective documentation and coding adjustments applied under subsection (a). An adjustment made under paragraph (1)(B) for discharges occurring in a year shall not be included in the determination of standardized amounts for discharges occurring in a subsequent year.</text></paragraph> 
<paragraph id="HA9293B5402EA495B00D235FCB32816EF"><enum>(3)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed as—</text> 
<subparagraph id="H614D4E490EFB4E6E8F6750C6F9828D85"><enum>(A)</enum><text>requiring the Secretary to adjust the average standardized amounts under paragraph (3)(A)(vi) of such section 1886(d) other than as provided under this section; or</text></subparagraph> 
<subparagraph id="H776CA5375E324E279D97CFCAD555837"><enum>(B)</enum><text>providing authority to apply the adjustment under paragraph (1)(B) other than for discharges occurring during fiscal years 2010, 2011, and 2012.</text></subparagraph></paragraph> 
<paragraph id="HDC4AC61FC1C94FCDB7471914005ED0AA"><enum>(4)</enum><header>Judicial review</header><text>There shall be no administrative or judicial review under section 1878 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395oo">42 U.S.C. 1395oo</external-xref>) or otherwise of any determination or adjustments made under this subsection.</text></paragraph></subsection></section>
