		<section id="H7911F03168C545A4B7481209D02640C8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Healthier Heroes
			 Act</short-title></quote>.</text>
		</section><section id="H1FC7818E66B141E787BC6BE9A88EF689"><enum>2.</enum><header>Clarification of
			 objectives for and coordination between DoD and VA programs</header>
			<subsection id="H6190656F5D034B25B1A1055C06529D7E"><enum>(a)</enum><header>Single,
			 comprehensive, standardized medical examination</header><text display-inline="yes-display-inline">The Secretary of Defense and the Secretary
			 of Veterans Affairs shall develop a single, comprehensive, standardized medical
			 examination for members of the Armed Forces that, while administered by the
			 Department of Defense, will be—</text>
				<paragraph id="H50723CA52AC44D6AA19DF93147F20196"><enum>(1)</enum><text display-inline="yes-display-inline">used by medical evaluation boards and
			 physical evaluation boards of the Department of Defense to determine the
			 fitness of a member of the Armed Forces to perform the duties of the member’s
			 office, grade, rank, or rating; and</text>
				</paragraph><paragraph id="H2C12887623F44D1280A735AB24E9F52E"><enum>(2)</enum><text display-inline="yes-display-inline">used by the Department of Veterans Affairs
			 to establish the disability rating, compensation, and benefits programs for the
			 member if the member is retired or separated because of physical
			 disability.</text>
				</paragraph></subsection><subsection id="H6095FA5E032A483EA9C545EC7C53DF"><enum>(b)</enum><header>DOD role limited
			 to determining fitness To serve</header><text><external-xref legal-doc="usc" parsable-cite="usc/10/1216">Section 1216</external-xref> of title 10, United
			 States Code, is amended—</text>
				<paragraph id="H0506DEA64FAC4C66AE7B58A79D003EC5"><enum>(1)</enum><text>in subsection
			 (b)—</text>
					<subparagraph id="H7EA91D9F434A46A8004DCC27CA60F807"><enum>(A)</enum><text>by striking
			 paragraph (2); and</text>
					</subparagraph><subparagraph id="HB826BD9833264A20A36761FB897E9E1F"><enum>(B)</enum><text>by redesignating
			 paragraphs (3) and (4) as paragraphs (2) and (3), respectively; and</text>
					</subparagraph></paragraph><paragraph id="HB6CEA042AE194521A0504D84C89AB18"><enum>(2)</enum><text>by
			 adding at the end the following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="H89AB27FC152C4F499185018DE400994C" style="OLC">
						<subsection id="HCFD7FBDEA7694F50AA161D6B00072488"><enum>(e)</enum><text display-inline="yes-display-inline">The determination under this chapter of the
				percentage of disability of a member of the armed forces at the time of the
				member’s separation from active duty shall be made by the Department of
				Veterans
				Affairs.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HC34C52DE5389485FB6BAF98185B7B1B9"><enum>(c)</enum><header>Sense of
			 congress</header><text display-inline="yes-display-inline">It is the sense of
			 Congress that the use of a single, comprehensive, standardized medical
			 examination by both the Department of Defense and the Department of Veterans
			 Affairs and the clear differentiation of the roles of the Department of Defense
			 and Department of Veterans Affairs disability programs will eliminate
			 duplicative processes as well as reduce inequities for members of the Armed
			 Forces.</text>
			</subsection></section><section id="HD22D656F02FA4D5C954CC3C268063795"><enum>3.</enum><header>Availability of
			 post-traumatic stress disorder care</header><text display-inline="no-display-inline">Notwithstanding any other provision of law,
			 the Secretary of Veterans Affairs shall provide appropriate medical care to any
			 veteran of Operation Iraqi Freedom or Operation Enduring Freedom who needs
			 medical care for post-traumatic stress disorder regardless of the length of
			 time the veteran has been separated from active duty service in the armed
			 forces.</text>
		</section><section display-inline="no-display-inline" id="HAD0F9BD57B8A45C39B232F1DC7D2A5D0"><enum>4.</enum><header>Extended benefits
			 under TRICARE for primary caregivers of members of the uniformed services who
			 incur a serious injury or illness on active duty</header>
			<subsection id="H8222EEBA9BD540A5AA6CFFB9AA9B024D"><enum>(a)</enum><header>In
			 General</header><text><external-xref legal-doc="usc" parsable-cite="usc/10/1079">Section 1079(d)</external-xref> of title 10, United States Code, is
			 amended—</text>
				<paragraph id="HA1D0C6BF047B40EEBCF728012425BF1"><enum>(1)</enum><text>by
			 redesignating paragraphs (2) and (3) as paragraphs (3) and (4), respectively;
			 and</text>
				</paragraph><paragraph id="H1FC3E39C2E1646F4BD676BFE160881B9"><enum>(2)</enum><text>by inserting after
			 paragraph (1) the following new paragraph (2):</text>
					<quoted-block id="H7D5C15DB8F284C63B80025AD72D6E1DB" style="OLC">
						<paragraph id="H14ED353E2EF74F4A856073AA1FE0488B" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HF2975D4A80BE4ABDBEF8D47FBDE08200"><enum>(A)</enum><text>Subject to such terms,
				conditions, and exceptions as the Secretary of Defense considers appropriate,
				the program of extended benefits for eligible dependents under this subsection
				shall include extended benefits for the primary caregivers of members of the
				uniformed services who incur a serious injury or illness on active duty.</text>
							</subparagraph><subparagraph id="HBEB32B41F2DE423BB5131E0343E7ECC8" indent="up1"><enum>(B)</enum><text>The Secretary of Defense shall
				prescribe in regulations the individuals who shall be treated as the primary
				caregivers of a member of the uniformed services for purposes of this
				paragraph.</text>
							</subparagraph><subparagraph id="H1840D150B7B342AE852969047F5C6404" indent="up1"><enum>(C)</enum><text>For purposes of this section, a
				serious injury or illness, with respect to a member of the uniformed services,
				is an injury or illness that may render the member medically unfit to perform
				the duties of the member’s office, grade, rank, or rating and that renders a
				member of the uniformed services dependant upon a
				caregiver.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H7D7EC1B8CE6A4228BFEB7C00E8C267E8"><enum>(b)</enum><header>Effective
			 Date</header><text>The amendments made by subsection (a) shall take 60 days
			 after the date of the enactment of this Act.</text>
			</subsection></section><section id="H903550565348409A91585EB5AB211019"><enum>5.</enum><header>Family Medical
			 Leave Act</header>
			<subsection id="H6A59E6AA86B645F092E72C1FF602A659"><enum>(a)</enum><header>Servicemember
			 family leave under the Family and Medical Leave Act</header>
				<paragraph id="HACF78C8A958849B2BC3191200181B2C7"><enum>(1)</enum><header>Definitions</header><text>Section 101 of the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2611">29 U.S.C. 2611</external-xref>) is
			 amended by adding at the end the following:</text>
					<quoted-block id="HF4D744BAB4754127AA82FC63A9B9CF67" style="OLC">
						<paragraph id="HDED6B6E07E8F46D4AE50B4AEB758A5D5"><enum>(14)</enum><header>Active
				duty</header><text>The term <term>active duty</term> means duty under a call or
				order to active duty under a provision of law referred to in section
				101(a)(13)(B) of title 10, United States Code.</text>
						</paragraph><paragraph id="HCD02ACE29926454E8763830812ADB46F"><enum>(15)</enum><header>Covered
				servicemember</header><text>The term <term>covered servicemember</term> means a
				member of the Armed Forces, including a member of the National Guard or a
				Reserve, who is undergoing medical treatment, recuperation, or therapy, is
				otherwise in medical hold or medical holdover status, or is otherwise on the
				temporary disability retired list, for a serious injury or illness.</text>
						</paragraph><paragraph id="H7F090D346C5F4F7FB12376D15E6B14EB"><enum>(16)</enum><header>Medical hold or
				medical holdover status</header><text>The term <term>medical hold or medical
				holdover status</term> means—</text>
							<subparagraph id="H52FBCB6645A3416595224CE3B8FD800"><enum>(A)</enum><text>the status of a
				member of the Armed Forces, including a member of the National Guard or a
				Reserve, assigned or attached to a military hospital for medical care;
				and</text>
							</subparagraph><subparagraph id="H8F1AF99E6A3444E595DB5700A73BED84"><enum>(B)</enum><text>the status of a
				member of a reserve component of the Armed Forces who is separated, whether
				pre-deployment or post-deployment, from the member’s unit while in need of
				health care based on a medical condition identified while the member is on
				active duty in the Armed Forces.</text>
							</subparagraph></paragraph><paragraph id="HE33D9E79477E46129E47E8F6171008B"><enum>(17)</enum><header>Next of
				kin</header><text>The term <term>next of kin</term>, used with respect to an
				individual, means the nearest blood relative of that individual.</text>
						</paragraph><paragraph id="H7343A96A3DD141279148BBBE00EEA71"><enum>(18)</enum><header>Serious injury
				or illness</header><text display-inline="yes-display-inline">The term
				<term>serious injury or illness</term>, in the case of a member of the Armed
				Forces, means an injury or illness incurred by the member in line of duty on
				active duty in the Armed Forces that results in a serious physical disability,
				as defined in <external-xref legal-doc="regulation" parsable-cite="cfr/32/199.2">section 199.2</external-xref> of title 32, Code of Federal Regulations, or that
				renders the member medically unfit to perform the duties of the member’s
				office, grade, rank, or
				rating.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HB834CE56FE0045068C17B9154E5C1CDC"><enum>(2)</enum><header>Entitlement to
			 Leave</header><text>Section 102(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(a)</external-xref>) is amended
			 by adding at the end the following:</text>
					<quoted-block id="HEDF3A2C3943D4CAE91E2D1B9E8278117" style="OLC">
						<paragraph id="H4A0B2DC67F1646ED99B802821C3C9473"><enum>(3)</enum><header>Servicemember
				family leave</header><text>Subject to section 103, an eligible employee who is
				the spouse, son, daughter, parent, or next of kin of a covered servicemember
				shall be entitled to a total of 26 workweeks of leave during a 12-month period
				to care for the servicemember. The leave described in this paragraph shall only
				be available during a single 12-month period.</text>
						</paragraph><paragraph id="HC3F9505CBE45497C91BC55C514BB8F03"><enum>(4)</enum><header>Combined leave
				total</header><text>During the single 12-month period described in paragraph
				(3), an eligible employee shall be entitled to a combined total of 26 workweeks
				of leave under paragraphs (1) and (3). Nothing in this paragraph shall be
				construed to limit the availability of leave under paragraph (1) during any
				other 12-month
				period.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H9A71610D799247EC88D99D23BBCBB07F"><enum>(3)</enum><header>Requirements
			 Relating to Leave</header>
					<subparagraph id="H20B624A4A97641B8919657001B1FC1E5"><enum>(A)</enum><header>Schedule</header><text>Section
			 102(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(b)</external-xref>) is amended—</text>
						<clause id="H041C2AC7F1C64C208DCDD91CAD25489B"><enum>(i)</enum><text>in
			 paragraph (1), in the second sentence—</text>
							<subclause id="H8AECCE4AA41549B4ADDD137D4FD131C5"><enum>(I)</enum><text>by striking
			 <quote>section 103(b)(5)</quote> and inserting <quote>subsection (b)(5) or (f)
			 (as appropriate) of section 103</quote>; and</text>
							</subclause><subclause id="H3A80D569584248E78320008BACDB001D"><enum>(II)</enum><text>by inserting
			 <quote>or under subsection (a)(3)</quote> after <quote>subsection
			 (a)(1)</quote>; and</text>
							</subclause></clause><clause id="HBFAB45FC665F4EC8B399BDCCA0D573E3"><enum>(ii)</enum><text>in
			 paragraph (2), by inserting <quote>or under subsection (a)(3)</quote> after
			 <quote>subsection (a)(1)</quote>.</text>
						</clause></subparagraph><subparagraph id="H4CC3FE499458438BB4F7599675A19D74"><enum>(B)</enum><header>Substitution of
			 paid leave</header><text>Section 102(d) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(d)</external-xref>) is
			 amended—</text>
						<clause id="H6D0B1786D0D6428D9DD1E14BA495A4CD"><enum>(i)</enum><text>in
			 paragraph (1)—</text>
							<subclause id="H1ED61D996528417283ABBE1D9DFA60C2"><enum>(I)</enum><text>by inserting
			 <quote>(or 26 workweeks in the case of leave provided under subsection
			 (a)(3))</quote> after <quote>12 workweeks</quote> the first place it appears;
			 and</text>
							</subclause><subclause id="H515D6D27C76247F688AA1720759E326E"><enum>(II)</enum><text>by inserting
			 <quote>(or 26 workweeks, as appropriate)</quote> after <quote>12
			 workweeks</quote> the second place it appears; and</text>
							</subclause></clause><clause id="HE3E3D7D082DF468294CD53876CC2C3C1"><enum>(ii)</enum><text>in
			 paragraph (2)(B), by adding at the end the following: <quote>An eligible
			 employee may elect, or an employer may require the employee, to substitute any
			 of the accrued paid vacation leave, personal leave, family leave, or medical or
			 sick leave of the employee for leave provided under subsection (a)(3) for any
			 part of the 26-week period of such leave under such subsection.</quote>.</text>
						</clause></subparagraph><subparagraph id="HFA4E1BC156FA4E7E8B76736B5E2C7912"><enum>(C)</enum><header>Notice</header><text>Section
			 102(e)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(e)(2)</external-xref>) is amended by inserting <quote>or
			 under subsection (a)(3)</quote> after <quote>subsection (a)(1)</quote>.</text>
					</subparagraph><subparagraph id="HDD5FAA496CED4E9CB0AA8E03A6BB1E41"><enum>(D)</enum><header>Spouses employed
			 by same employer</header><text>Section 102(f) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(f)</external-xref>)
			 is amended—</text>
						<clause id="HC2F6682C3BD7473DA92B798C9464BB8D"><enum>(i)</enum><text>by
			 redesignating paragraphs (1) and (2) as subparagraphs (A) and (B), and aligning
			 the margins of the subparagraphs with the margins of section
			 102(e)(2)(A);</text>
						</clause><clause id="H8CF7DBA4B32146B5002D125546F7D301"><enum>(ii)</enum><text>by
			 striking <quote>In any</quote> and inserting the following:</text>

				general</header><text>The aggregate number of workweeks of leave to which both
				that husband and wife may be entitled under subsection (a) may be limited to 26
				workweeks during the single 12-month period described in subsection (a)(3) if
				the leave is—</text>
										<clause id="H059D104B681D4F899537CABE40C79BB"><enum>(i)</enum><text>leave under
				subsection (a)(3); or</text>
										</clause><clause id="H63BD07B000034FBDB557EA4D25B4A5F7"><enum>(ii)</enum><text>a
				combination of leave under subsection (a)(3) and leave described in paragraph
				(1).</text>
										</clause></subparagraph><subparagraph id="HAE6EF622A21A48C20067B099047F67D4"><enum>(B)</enum><header>Both limitations
				applicable</header><text>If the leave taken by the husband and wife includes
				leave described in paragraph (1), the limitation in paragraph (1) shall apply
				to the leave described in paragraph
				(1).</text>
									</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</clause></subparagraph></paragraph><paragraph id="HF0D23C92B4244EB5B1EB95CABB6046CC"><enum>(4)</enum><header>Certification</header><text>Section
			 103 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2613">29 U.S.C. 2613</external-xref>) is amended by adding at the end the
			 following:</text>
					<quoted-block id="HF01EC221A8C4443E980055F10F23C6" style="OLC">
						<subsection id="H1D26A8BAFDFD4499B227B00900AFBD74"><enum>(f)</enum><header>Certification
				for Servicemember Family Leave</header><text>An employer may require that a
				request for leave under section 102(a)(3) be supported by a certification
				issued at such time and in such manner as the Secretary may by regulation
				prescribe.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H4AEB2A1DB8EE4221806904B1D97C35F"><enum>(5)</enum><header>Failure To
			 Return</header><text>Section 104(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2614">29 U.S.C. 2614(c)</external-xref>) is
			 amended—</text>
					<subparagraph id="H4E2D1769695B47D9AFD7162814C8FA33"><enum>(A)</enum><text>in paragraph
			 (2)(B)(i), by inserting <quote>or under section 102(a)(3)</quote> before the
			 semicolon; and</text>
					</subparagraph><subparagraph id="HDA2741D7D73145BD9732D13EA01C9667"><enum>(B)</enum><text>in paragraph
			 (3)(A)—</text>
						<clause id="H05A95395686F4673BF984745B11D6DFB"><enum>(i)</enum><text>in
			 clause (i), by striking <quote>or</quote> at the end;</text>
						</clause><clause id="H7F6F9C6FE7004C7EA4F1682C66FB5886"><enum>(ii)</enum><text>in
			 clause (ii), by striking the period and inserting <quote>; or</quote>;

						</clause></subparagraph></paragraph><paragraph id="H2F4A6907BDBB40FDB9F4D4E900297D67"><enum>(6)</enum><header>Enforcement</header><text>Section
			 107 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2617">29 U.S.C. 2617</external-xref>) is amended, in subsection (a)(1)(A)(i)(II), by
			 inserting <quote>(or 26 weeks, in a case involving leave under section
			 102(a)(3))</quote> after <quote>12 weeks</quote>.</text>
				</paragraph><paragraph id="H2787B7AF063F4D02B9D48819586FA0B"><enum>(7)</enum><header>Instructional
			 Employees</header><text>Section 108 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2618">29 U.S.C. 2618</external-xref>) is amended, in
			 subsections (c)(1), (d)(2), and (d)(3), by inserting <quote>or under section
			 102(a)(3)</quote> after <quote>section 102(a)(1)</quote>.</text>
				</paragraph></subsection><subsection id="H2594A21DDFAA470F001DFE03E5EE89D4"><enum>(b)</enum><header>Servicemember
			 family leave for civil service employees</header>
				<paragraph id="HBA6B9C1875784AFA923425D5A3BE9117"><enum>(1)</enum><header>Definitions</header><text>Section
			 6381 of title 5, United States Code, is amended—</text>
					<subparagraph id="HB04E97DEC1174EBDBD47F905A2ECC759"><enum>(A)</enum><text>in paragraph (5),
			 by striking <quote>and</quote> at the end;</text>
					</subparagraph><subparagraph id="H484B97B426E54C86990033455219C3B2"><enum>(B)</enum><text>in paragraph (6),
			 by striking the period and inserting <quote>; and</quote>; and</text>
					</subparagraph><subparagraph id="H6399109A00B54226AB6355E849A9980"><enum>(C)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block id="H7902B0FCD8E840E395FFF55FBDBE12D8" style="USC">
							<paragraph id="HFBC3FDFBA50C4530A20000576B01EAAE"><enum>(7)</enum><text>the term

							</paragraph><paragraph id="H90AB5AE431E8421DB1E07CC6DBA7C89B"><enum>(8)</enum><text>the term
				<term>covered servicemember</term> means a member of the Armed Forces,
				including a member of the National Guard or a Reserve, who is undergoing
				medical treatment, recuperation, or therapy, is otherwise in medical hold or
				medical holdover status, or is otherwise on the temporary disability retired
				list, for a serious injury or illness;</text>
							</paragraph><paragraph id="H713A09B9D1154906B061CEAC266895E1"><enum>(9)</enum><text>the term
				<term>medical hold or medical holdover status</term> means—</text>
								<subparagraph id="H0768C18CACDF47F7ABE094E782A694EC"><enum>(A)</enum><text>the status of a
				member of the Armed Forces, including a member of the National Guard or a
				Reserve, assigned or attached to a military hospital for medical care;
				and</text>
								</subparagraph><subparagraph id="H35D34215BDE345F0B56E7EBEE41536ED"><enum>(B)</enum><text>the status of a
				member of a reserve component of the Armed Forces who is separated, whether
				pre-deployment or post-deployment, from the member’s unit while in need of
				health care based on a medical condition identified while the member is on
				active duty in the Armed Forces;</text>
								</subparagraph></paragraph><paragraph id="HF73B7F38B6444EB994DA8505EE072446"><enum>(10)</enum><text>the term
				<term>next of kin</term>, used with respect to an individual, means the nearest
				blood relative of that individual; and</text>
							</paragraph><paragraph id="H71625D52A6854B0C9798E0D79100E2A4"><enum>(11)</enum><text display-inline="yes-display-inline">the term <term>serious injury or
				illness</term>, in the case of a member of the Armed Forces, means an injury or
				illness incurred by the member in line of duty on active duty in the Armed
				Forces that results in a serious physical disability, as defined in section
				199.2 of title 32, Code of Federal Regulations, or that renders the member
				medically unfit to perform the duties of the member’s office, grade, rank, or
				rating.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="HF123484317924B818FBF62E1FEF53B14"><enum>(2)</enum><header>Entitlement to
			 Leave</header><text>Section 6382(a) of such title is amended by adding at the
			 end the following:</text>
					<quoted-block id="H110305975913476DB63BBF1093F0A33F" style="USC">
						<paragraph id="HF48B16C83983451086F0D578D9003E62"><enum>(3)</enum><text>Subject to section
				6383, an employee who is the spouse, son, daughter, parent, or next of kin of a
				covered servicemember shall be entitled to a total of 26 administrative
				workweeks of leave during a 12-month period to care for the servicemember. The
				leave described in this paragraph shall only be available during a single
				12-month period.</text>
						</paragraph><paragraph id="H784F7307179B454490BD5449512440C0"><enum>(4)</enum><text>During the single
				12-month period described in paragraph (3), an employee shall be entitled to a
				combined total of 26 administrative workweeks of leave under paragraphs (1) and
				(3). Nothing in this paragraph shall be construed to limit the availability of
				leave under paragraph (1) during any other 12-month
				period.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H8EE406A73D8642DA8B58001CA64149B0"><enum>(3)</enum><header>Requirements
			 Relating to Leave</header>
					<subparagraph id="H16B7C0A004284B0699EDA162F0FBB7FF"><enum>(A)</enum><header>Schedule</header><text>Section
			 6382(b) of such title is amended—</text>
						<clause id="H43EAD00A485142B690F5398C7F6090C6"><enum>(i)</enum><text>in
			 paragraph (1), in the second sentence—</text>
							<subclause id="H4C74F017E2BC44BB8D86F1910703BA14"><enum>(I)</enum><text>by striking
			 <quote>section 6383(b)(5)</quote> and inserting <quote>subsection (b)(5) or (f)
			 (as appropriate) of section 6383</quote>; and</text>
							</subclause><subclause id="H13A4D9FF139049319B5FFB002970A2B9"><enum>(II)</enum><text>by inserting
			 <quote>or under subsection (a)(3)</quote> after <quote>subsection
			 (a)(1)</quote>; and</text>
							</subclause></clause><clause id="H2BC811B7037A4B728200F892F2CA9B61"><enum>(ii)</enum><text>in
			 paragraph (2), by inserting <quote>or under subsection (a)(3)</quote> after
			 <quote>subsection (a)(1)</quote>.</text>
						</clause></subparagraph><subparagraph id="H7F957B6C19DA4583AAC9A5F71323EF7E"><enum>(B)</enum><header>Substitution of
			 paid leave</header><text>Section 6382(d) of such title is amended by adding at
			 the end the following: <quote>An employee may elect to substitute for leave
			 under subsection (a)(3) any of the employee’s accrued or accumulated annual or
			 sick leave under subchapter I for any part of the 26-week period of leave under
			 such subsection.</quote>.</text>
					</subparagraph><subparagraph id="HA8973CD98630443591D0C07A318C1FF"><enum>(C)</enum><header>Notice</header><text>Section
			 6382(e) of such title is amended by inserting <quote>or under subsection
			 (a)(3)</quote> after <quote>subsection (a)(1)</quote>.</text>
					</subparagraph></paragraph><paragraph id="HC1F4FC857CFC48EF8FD5AEF8B453B8C"><enum>(4)</enum><header>Certification</header><text>Section
			 6383 of such title is amended by adding at the end the following:</text>
					<quoted-block id="HC0DF6E1D26C74F8D924240C1C4CACBB8" style="USC">
						<subsection id="HE5338EDAC9C94283925B3F47586DD59C"><enum>(f)</enum><text>An employing
				agency may require that a request for leave under section 6382(a)(3) be
				supported by a certification issued at such time and in such manner as the
				Office of Personnel Management may by regulation
				prescribe.</text>
